won't get away with the latest deadly attack in a city in southern ukraine we have a live report from kyiv. also, kevin mccarthy notches a political win but his debt ceiling plan is dead on arrival in the senate. where does it go from here our nbc news reporters are following all the latest developments and we begin in washington where the path to averting a massive u.s. debt default at this hour is unclear nbc's ali vitali is on capitol hill for us. so look, republicans know their plan isn't going to go anywhere in the senate but does this force president biden and the democrats to the negotiating table? >> reporter: that's what speaker mccarthy is hoping for, this show of force within the conference, the fact that they were able to pass something is enough to restart negotiations with the white house and democrats. you're right that broadly, senate majority leader chuck schumer said this is dead on arrival in the senate. the numbers aren't there

speaker mccarthy really challenging senators to put up something better watch. >> we have taken action. what's going to happen here, the senate needs to pass a bill. if chuck schumer believes a clean bill can pass. put it on the floor then the thing you have to realize, you have a 60 vote margin in the senate he can't pass it manchin says he won't vote for that either. they've got to find something, and they need to negotiate >> reporter: so look, mccarthy there pointing out the obvious and hoping that it works in his favor, frankly in these negotiations the fact that democrats say they want a clean debt ceiling but they probably can't get that through the senate even though they have the majority there this brings us back to the drawing board as senate democrats now say they're going to continue working and looking, that they still want a clean debt ceiling raise, and republicans of course saying this is what they feel is palatable. i do think it's notable, and this is what i asked speaker mccarthy last night, it took such meticulous cajoling on the

part of the speaker and leadership to get people on board enough you have the votes to pass this bill in the first place, what happens when there are inevitably changes mccarthy, instead, wouldn't engage with the substance of that and said, look, at this point, republicans are the only ones who have done any voting to raise the debt ceiling >> thank you for that. now to nbc exclusive reporting on the southern border where the biden administration is bracing for a potential record surge in migration once the title 42 covid policy is lifted nbc's julia ainsley got that scoop and joins us now julia, the administration, i understand announced a new effort to get ahead of the surge. what's the plan? >> that's right, today we heard from secretary blinken and alejandro mayorkas about the plan, someone saying guatemala or colombia could go there and apply for refugee status rather

than making the dangerous trip to the southern border my reporting says even with measures in place, and with stricter measures supposed to deter migrants from coming across the southern border, the fact that the covid-19 restrictions are still lifting on may 1 1th has a lot of officials nervous. they need 3 million more dollar from congress, republicans don't want to get behind a biden border plan, and they don't have the capacity those in the border patrol shelters and on the streets. people we have spoken to in el paso say there are a thousand migrants sleeping on the street. mayorkas said there's a plan, and here's what he had to say today. >> beginning on may 12th, we place eligible individuals who arrive at our southern border in expedited removal proceedings. those who arrive at our border and do not have a legal basis to stay will have made the journey

>> reporter: the ministry of defense has acknowledged carrying out strikes overnight high precision strikes on a ukraine reserve deployment point. those are the words they used. ukrainian officials, the pictures we have on the ground from independent journalists tells a different story. ukrainian officials there are saying this was an act of terror that civilians bore the brunt of this attack. one of the reasons they are saying this particular missile strike amounts to an act of terrorism is because of the types of missiles they say were used, the operation command of ukraine's forces in this region of the country and the south they say that russia wants caliber missiles, high precision

missiles that use gps system that can program in the coordinates, and specific locations. because of that, you have military leaders operating in the area, and calling this an obvious terror attack, and saying the specific things hit were primarily residential homes, residential high-rise building as well, as some sort of civilian, historical building 23 people, all of them, civilians were injured, and at least one person also a civilian was killed in this strike. meanwhile, the most intense fighting is still taking place in the east in the city of bakhmut. that has been by far the bloodiest and longest battle we have seen since the full scale invasion began the commander for the forces there, colonel general sursky, a local outlet, and talked about how despite how grinding the battle has been, how little territory has shifted between russia and ukraine, in their view, it's still worth the fight in the city. he said, one, because they have prevented russian forces from

expanding the front line for months now, and two, he said because of the fighting here, they have been able to inflict significant damage on russia specifically, he said, some of the most specialized units on their western supply as well as just other military equipment. all things that outside military analysts have said could put ukraine in a better position when they eventually launch that counter offensive in the south, which we have been told and expect it could come sometime soon chris. >> ellison barber, thank you. >> ron desantis is in jerusalem today where he met with israeli prime minister benjamin netanyahu, a man well known for his relationship with donald trump. gabe gutierrez spoke to the prime minister about that meeting. what did he tell you, gabe >> reporter: benjamin netanyahu walking a fine line, saying he's reluctant to weigh in on u.s. politics he said his meeting this

in him and that will cut the republican party in half. >> reporter: chris, look at the polling here from the university of new hampshire, over the last four months, ron desantis, while he pondered a presidential run himself, he was looking at actually building a base of potential support, but what you have seen over the last three months, according to that polling is a 32 point swing here in favor of the former president. i was talking to one oether woman, and she told me a couple of months ago, she was considering ron desantis, after learning about his votes to cut social security, she's going to go with the person she knows and trusts and that is donald trump, and that's why you see him as the presidential candidate trying to solidify that support and trying to undercut ron desantis before he's an official candidate. >> tara, at least according to one of the folks that vaughan talked to, ron desantis doesn't

have enough gumption what's your take on the dramatic shift in the poll numbers, what do you think is driving it >> there's a few things, first in politics, you're popular when the idea of you as a candidate is out there when people get to know you if you see the polls going in the opposite direction, which is what happened with ron desantis, that's never a good sign and so what's happened is people have gotten to know ron desantis more other than just the specter of him doing what he does in florida, okay, this guy's got it, until they started to be exposed to him more and more and saw how arrogant and awkward he is he's not a good retail politician his book tour has been a disaster this obligatory foreign policy trip that he's on to try to demonstrate that he has some type of foreign policy chops has also been a disaster with a weird reaction during the japa trip

here a couple of weeks ago to appear in the criminal matter, there are huge protests, a lot of media attention it shut down the courthouse and this whole area for some time. so the judge wants to anticipate that right now, in court, carroll is back on the witness stand being questioned by trump's lead attorney, and they are at the point now where he is questioning her about exactly what happened at bergdorf f goodman. she has pointed a very vivid and graphic decision of meeting trump at the store, that he asked her to go up stairs and help him buy a gift for another woman. they end up in the lingerie department, which is where she says this attack happened. trump's lawyers questioning her about every detail about bergdorf, did she come through a revolving door or a push oor she has said on a number of occasions she doesn't remember details about all of this. she doesn't remember exactly when it happened,the date, the

month, earlier in her questioning, she was asked about a photograph where she and trump were seen, and she was asked when that was, where that was, and there were aspects of all of this that she keeps saying i don't remember, i don't remember, but she does say she vividly remembers the attack, and that's what the defense is trying to do, put in the jury's mind, the fact that she can only remember this but can't remember other things she perhaps should, and we expect this questioning to go on through the afternoon, the cross-examination, now, again, really focused on what happened at bergdorf, why were there no witnesses in this department store on fifth avenue in new york, no witnesses have come forward to say they saw trump and carroll in the store she described going up an escalator, six flights, no one saw that she described the area where they were shopping, no store attendants around, why was that. again, the defense -- trump's attorneys are trying to convince the jury that they are story is

his own safety yesterday there was a virtual town hall he did with a new york city councilman, take a listen. >> i don't think a ton about my personal safety. i know that they are the best at doing this i do worry you know, as an employer, we have more than 1,500 people work at the manhattan district attorney's office, and they're coming and going throughout lower manhattan, and worry about the neighborhood >> is he right to be worried about the safety of those 1,500 people who work at the d.a.'s office >> he is, chris. i think that that is a sign of strong leadership. having been a former district attorney myself, i can say that you are always mindful of how people outside of your office are interpreting your job, and at the end of the day, we live in an extremely volatile space around our political discourse, and everything about what d.a. bragg is doing in manhattan is being carefully chronicled and

trying to help him get out of the country and they paint a picture of him as somebody whose state of mind was trafficking in violent rhetoric on social media, who is fascinated with guns, who, you know, can't be trusted to keep a promise because he couldn't be trusted with classified information. now, his attorneys push back strongly on that and andsaid, lk he has no prior criminal record. he has many relatives until the community that could watch over him. if he was released, they wanted him to go to his father's house, which is monitored with ring cameras, and they have plans for him not to have access to the internet in cases where national security is concerned, judges give great deference to the government, and the government is saying it would be very dangerous to release jack teixeira. >> courtney, while the justice department prosecutors him, the military is trying to figure out if anybody else might have been responsible. what's the latest on that investigation? >> that's right. and frankly, there's a number of

investigations ongoing right now. there's an air force inspector general investigation that we got a little news out of that. the air force has temporarily suspended two commanders at otis air national guard base in massachusetts, where jack teixeira was assigned when the alleged leaks occurred one of them, it's not the overall commander of the 102nd intelligence wing, the unit he was assigned to. it's the squadron that supports the overall intelligence wing. the commander was temporarily suspended, and then the person who's in charge of essentially supporting guardsmen, guard men and women who were activated on active duty like he was in this case both of them temporarily suspended pending the outcome of an air force inspector general report the reality is we should, we will, we expect to see more people held accountable, if, in fact, it turns out that these leaks occurred out of this air force base, the intelligence

wing the military tends to look at the commanders, the command climate they have settle, and so i expect that over course of the next several weeks and months, we'll learn about more held accountable, even if they weren't directly responsible for the leaks. >> likely to be people who worked in the unit or could it go beyond that >> commander, so, yeah, the leaders of the military unit are responsible for setting what the military calls the command climate. they're responsible for teaching the subordinates in their units, how critical it is to safeguard classified information we often see that when there is some sort of a wrong doing that occurs in a unit that the commanders, the leadership there are held accountable in some way, certainly not in the way we see jack teixeira being arrested, but more in the form of reprimands, that's the thing we expect to hear in the course of the next days and months.

they have agreed to an extension of the cease fire by 72 hours, so rather than expiring tonight at 6 eastern, it would go through until sunday now, we have only heard from the regular army we have not heard from the rapid support forces, the para military group they are fighting against. we don't know if both sides have agreed to the cease fire it was brokered by the u.s. and saudi arabia saudi arabia has been a major player in sudan. it's one of its regional neighbors. it's where a lot of refugees have been evacuated to, and in earlier today, we saw secretary of state antony blinken meeting with the secretary general of the united nations in washington they talked at the dire humanitarian situation and the need for an extension to the cease fire take a listen to a little bit of what the secretary general of the u.n. had to say earlier

today. >> in both stages some success >> reporter: and chris, you can see from the body language there, a lot lof uncertainty about whether these diplomatic efforts were going to come through, and frankly, some uncertainty about whether the cease fires are leading to an end to the violence. there has been a lowering of violence in khartoum, the capital over the last couple of days as you said earlier today, witnesses said air strikes are being resumed in the city, those are being carried out against the rapid support forces there's a lot of concern about what's going on in the western region of darfur, a place we heard a lot about when there was the genocide violence.
