plus a single move by the states that pays away for desantis's presidential run, if he makes one. the new hour starts now. e new hour starts now. as a bid to all a very good day from msnbc world headquarters here in new york. welcome, everyone to alex witt reports. we begin with breaking news right now. police are trying to find this man, suspected of carrying out a deadly mass shooting against his neighbors. five people, including an eight-year-old, were killed over in -- cleveland, that just north of houston. priscilla and tosses is on the scene for us. priscilla, you've got some of the details in the last hour, they are horrific and tragic, but talk about what led to this incident. >> yeah, alex, incredibly horrific and traffic. this was a situation where police say, the suspect was shooting an ar-15 in his front yard, and then a neighbor walked over to his gate, the gate that you see just behind

me, and asked if he would please stop shooting that gun because they had a baby that they were trying to keep asleep. shortly after that, we know that the suspect went over to the neighbor's home, barged in, and effectively opened fire, according to what police had said. we know that five people were killed, four women and, three women, one man, and also an eight year old child was killed. we also know that there were three other juveniles who were in the home. police said that they found them covered in blood and it appears that some of the deceased may have been shielding those children. thankfully, those children were taken to a hospital and are uninjured. just an incredibly horrific and gruesome scene here. the sheriff telling me it's one of the worst scenes he has seen in the 40 plus years that he has been doing this work. at this hour, there is still a massive manhunt underway for the suspect. he's believed to be about two miles from here.

i just spoke with a sheriff who tells me they are still searching for him. i want to play a bit for you about what the sheriff had to say about the search efforts underway right now. take a listen. >> he's probably bully within two miles of where we're standing right now. we do have that area surrounded. it's a large acreage of land, maybe several different parcels, but there is one house we have a patrol unit at the house just to make sure that that house is safe, and like i said, we have the drone in the air, dogs and horses on the ground. >> the sheriff says that this suspect is considered armed and dangerous, they have identified him as 38-year-old francisco or hazza. police say he's a mexican national now charged with five counts of murder. many people in this community, certainly shaken by this. i spoke to a neighbor who says are often people out shooting their guns in the yard over the

weekends or on holiday weekends. they often called police on them but they never suspected something like this for -- certainly such a tragedy here today. >> absolutely, and it's alleged that he's huge an ar-15 stop cell rifle to use these murders. which means police have to approach very, very cautiously. it's a heartbreaker, not soon going to forget the story. thank you very much, priscilla thompson. more breaking news, flooded cities along the city river -- even higher today. let's go right to nbc's george soliz. he's a pleasant valley iowa, where things aren't too pleasant right now. let's talk about the flooding where you are. >> that's right, a disaster in slow motion as it's been described. here, will consider this neighborhood parking right now, because the only way in and out of this neighborhood is by boat or by kayak. residents here are parking. we're here on the outskirts of this water that is just continuing to rise. the way we are able to keep

tabs on how much this water is rising as slowly as it is, is that home side, sort of directing where the homes are. we expect that's fine to be completely underwater in the next few hours, if not days. as we know, this river is still expected to crest either late sunday or early into monday. residents here understandably frustrated. many of them saying, look, we know we're along the mississippi and we know that the river tends to flood, but this is not something they had foreseen. adding insult to injury, for a lot of the residents here who are trying to stay behind and cleanup and salvage what they can, they have no heat. the local utility shutting off about 140 residents or so. many of them are going in there and spending as much time as they can to recover what they can, and then they're heading out to find shelter, either at a hotel or at a community center where they can wait it out. it's been really frustrating. i spoke with a couple earlier this morning, the heel ease, who are devastated by this. they had plans they had to put

on hold. the wife, very emotional, as she wants to go back in there and assess the damage. her husband telling her look, there's nothing you can do. she still wants to go in there and understandably, save as much as she can. take a listen to what patrick told me, alex. >> it's almost seven feet in our basement. everything i hadn't put up, it wasn't supposed to be this mad, they said at the beginning, it's too late to move. so now everything is getting ruined. there's no way we can move anything. it's impossible, the curtain is too strong. >> and, as we know, a lot of these water levels are piling -- flood stage, and again, what you expect, a few more inches of this water to rise for a lot of homeowners, they just feel, what's next. a lot of them are saying, look, we're not going to move even after this water receives, this is our home, this is where we want to say. a lot of residents, now, it's a question of waiting for this water to receive. how long that's going to take,

a few minutes. also new reaction on the showdown over the gop's passage of a get limit bill full of spending cuts, seth moulton telling us in the last hour, it is going nowhere fast. >> this is a completely ridiculous premise. it cuts programs for 300,000 kids, including cans of thousands of those kids in some of the most conservative house district in the country. cutting benefits for 1 million seniors, those ctsa wait times at the airports go up 300%. if you are used to a 20-minute security line, plan on waiting an hour just to get through security. republicans are never actually going to do this. this is a ransom, not an actual bill. you are right, it is never gonna see the light of day. >> and a new bill passed by the florida legislature clears the way from ron sanchez to run for president in 2024 without having to resign as governor.

democrats say that bill also restrict voting in communities of color. there is also some new fallout in the feud between desantis and disney world. new video protesters in st. petersburg today opposing the governor's moves as disney responds with a lawsuit. >> joining me now, stephanie stanton in gulfport, florida. stephanie, welcome. what are you hearing about this today? >> good afternoon to you, alex. the war between disney and desantis is indeed heating up. that would appear that some in his own party may be breaking ranks with the governor. back in february as we know, the florida legislature voted to dismantle the improvement district. that district had been in place for about 50 years. it essentially allowed that bissell governor. in instead, that board was placed by several of desantis's handpicked loyalists. does need this point, they simply were not having. after some legal wrangling just

this past week, they filed a first amendment federal lawsuit against desantis and that five member board accusing it among other things of political retaliation for disney's support of parental rights in education bill. that is the bill that opponents have labeled the don't say gay legislation. essentially, they are saying that the governor and this board is weaponizing the florida state legislature. earlier this week, we also saw state senator marco rubio speak out in desantis's feud. take a listen. >> i think we're gets problematic is when you start creating the idea, and nothing were there yet as a state. but the idea that some -- if you are in crosshairs with us politically, then you may end up in the crosshairs of the legislature for political purposes. i don't think disney's gonna go anywhere, i think that is going to find itself there.

person political event since declaring his candidacy this week. and joining me now is former white house press secretary and msnbc political analyst robert gibbs. always good to see. let's get into this. look, and majority of the country disapproves of president biden's job as president. make democrats think he should not run again. but the recent new york times opinion piece argues that biden has a number of factors in his favor, chief of which is the case rounding donald trump in other republicans. how common are you that the perception of biden as the alternative to embattled an extreme opponent will be enough to get him 270 electoral votes? >> it is a great question, alex. i think if you look at what happened in the lead up to the 2022 election. some of the things that republicans have pursued in 2023 leading into the election of 2024, you have to believe that democrats have an

advantage in the issue environment. unfortunately, we are talking in the news again about the guns this morning. we have had a lot of discussion about abortion rights in this country since the supreme court struck roe v. wade down last year. i think those are just two of the issues that i think biden has a significant advantage on. you taught touch about things that i've heard biden say before. when he was vice president, excuse me. but president biden said, compare me not to the almighty, but to the alternative. that is exactly what i think you are seeing and setting up. it is not a referendum, or in this case the president doesn't want just to be a referendum on him, he wants it to be a choice in this election between two different contrasting and competing visions. that is really the role of a campaign in the white house to force that and have them make that contrasting decision.

haley has the experience to run the country and can envision her based on that experience being capable of being president of the united states. i think the white house understands that they're going to have to answer questions and the president is to. about his age and about his energy. i think what they will do and say is what they have been saying. look at all that he is accomplished, look at his travel schedule, look at what he has been able to get past. i think that in of itself is a good argument to start pushing back on all of that. i think issues are gonna play an important role to as we discuss the second ago. i think, we saw this again leading into 2022, we had one party that was seen as quite out of step, despite a lot of factors in their favor. quite out of step with mainstream america. i don't see republicans have taken much of a different pack or different path to try to ameliorate that in the first four months of 2023.

i just want to make this observation that we don't want to become the republican nominee and should he win the election, his inauguration, he will be older than joe biden was when he was inaugurated. people need to keep that in mind as well. the perspective here is important. let me also ask you about unlock times opinion piece that said that younger voters are going to be the key to biden's victory. in spite of his age, he can make inroads with younger voters. if he demonstrates energy and passion for progressive issues, how important is it for bind to portray a sense of bigger in his campaign? >> well look, i think, you've seen this before, he can get deeply passionate about what is at stake in this country. i think he has been on the political scene for decades. he has seen really the ups and downs of democracy in american life. i think that he got back into this is that he said four years ago when he announced, the idea of what was in stake. we were in a battle for the

soul of america. i think he believes passionately that he has to keep that going. i think you will see that, i think you have to see that, people going to want to understand and believe, as i said earlier, that the president is engaged and ready to take on this fight. i think that they're going to see a lot of that, voters will. the belief is somehow that he is not going to be vigorous out there on the campaign trail. i think they are in for a much different picture of what they're going to see from president biden. you already see it in a travel schedule, cutting those ribbons, in factories that he has pushed legislation through to create. i think we're gonna continue to see a vigorous campaign schedule throughout the 2024 election. >> as he says, watch me. to your point about it campaign for the soul of america, in biden's campaign launch video, he use the word freedom six times. some democratic pollsters are saying freedom is testing very

strongly with voters. especially in the wake of assault on abortion rights and book bans across red america. for a long time, the word freedom has been co-opted by the right. how effective can it be used in rebuking maga republicans robert quickly? >> yeah, i think deeply effective. at the you touched on one of the biggest issues on abortion rights. you know, you have arbitrary -- you every decision that was made by the courts, you have state legislatures that are deeply restricting a woman's right to choose, even restricting their ability to travel outside of that state and seek an abortion somewhere else. that seems to me to hit right at the heart and root of what freedom means in this country. it certainly is animated a lot of voters. >> always a pleasure my friend, robert gibbs, we appreciate you. meantime, mike pence and his graduate testimony, the new details we're learning next. details we're learning next.

committees lead investigator speaking out after mike pence testified for a grand jury, the former vice president sat down for hours long interview in a significant embellishment for the investigation. let's go to gary. welcome. what more kellis about pence's testimony? >> mike pence spent seven hours testifying for the grand jury and special counsel jack smith. to be clear, this is not the former vice president just jet, he was subpoenaed earlier this

year. he tried fighting that subpoena first then don trump tried to prevent him from topping it off. a court revealed that he did have to comply with the subpoena and testify. just about 12 hours after the ruling came down, which was before trump's team could actually file an appeal to the supreme court, i was there when pence rolled into the garage of the federal courthouse, and pence stayed there all day. while we may never know exactly what he told gradually word for word, we have a good sense of where his head is on this. he is never wavered, pence believes that he is there to oversee the certification of the election and to hear any evidence that lawmakers may have on why it should not be certified. unless of course, that did not exist. last hour, you had a really interesting conversation about the importance of this testimony with timothy from the johnny six committee. i want to have our viewers listen to a portion of that right now. >> that is why mike pence is so important. we kind of encircled him on the

move that had officer grounder grounding all flights worldwide except those involving critical missions after thursday's deadly helicopter collision coming just weeks after another fatal helicopter crash. both linked to training missions, let's head now to courtney for more. courtney, what are you learning? >> this is a significant move by the u.s. army. for the first time in nearly a decade, announcing a tepper stand out of all aviation assets, this would mean snow helicopters will fly anywhere in the world unless it is emergency and only when it is ordered by a general officer.

this comes less than 24 hours after two u.s. army apache helicopters from fort wayne right collided in mid air over alaska. they killed three u.s. soldiers and wounding another. the soldiers were returning from a daytime training mission and there were no reports of any inclement weather conditions. there is no issues with visibility. this is the latest collision raising alarms after two other recent deadly helicopter crashes in the u.s. army. a collision by two black hawks killed nine troops near fort campbell during a nighttime training mission last month and to tennessee national guard soldiers were killed in another black hawk rash in february. late friday, the army's top officer released a statement saying that we will focus on a safety in training protocols to ensure our pilots and crews have the knowledge, training, and awareness to safely complete their assigned missions. now all u.s. army pilots are given a mandatory safety training before being allowed

i, sir. let's get to the details as to why. what do you take away from the social media messages, the prosecutors chose to file with the court. i'm assuming it's another alarming aspect beyond the widespread in philly. alex, i think we all got to say, maybe we dodged an even bigger bullet here than the release of the classified information. clearly this is a deeply troubled young man who has, if not visions of committing great violence, starting to build ideas and plans to communicate them. by the way, everybody on that email chain ought to be tapped on the shoulder by the fbi and prosecuted in my view for not reporting this. the bottom line here is, yes, enormous damage to national security by the release of this. but boy, in a sense are we lucky that we caught him before he took on a big crowd with a

weapon of mass destruction. he had in his hands, probably an ar-15. let's look at the new statement from his family, they say they are standing together in solidarity in support that he will receive just treatment. questions remain about how he was hired and able to get a security clearance given will prosecutors say they have learned about his history. that includes a suspension from high school. what does this reveal? what does it say about military recruitment? >> i think you've got one particular challenge here which is that in the military we have to hire very young, largely untested people. they don't have long track records. maybe they have something in their high school situation that we can flag. there's really not much to look at. yet, we have got to hire them because we need them. we need them to do things like he was doing information

technology. basically, cyber repair guy. we have got to do it, but i think what i take away from this, alex, and the point to be made here is that we have got to deeper into these social networks. we've got to look at background. i think number two, we've got to revisit these clearance timings. in other words, you get that top secret clearance which i had for example. you don't get looked at again for five years, that is too long. it probably for some of that -- it should be the one year, two year, maybe a probationary degree. and then thirdly, back to the point about all of the other people on the circuit with them. we have got to encourage a larger culture of, if you see something, say something. we talk about that all the time with terrorism, we talk more about it with protecting classified material. >> i love the way you've analyze this, very interesting and implementing those things

would be fantastic. but let's move to what is also happened this week with president biden who's promised to allow nuclear submarines to make calls in south korea to help protect that country from north korea's threats. this happened during a state visit by the south korean president. are you concerned that north korea by -- it could potentially have the opposite effect of increasing the threat of nuclear war. >> i'm smiling because that clip you're showing of course is the president of south korea and he is singing american goodbye. i mean listen to him do that, that guy is fabulous. he has got a real future in performing arts. i think president biden's move is smart politics. it is smart military strategy as follows. he gets a twofer here by reassuring the public of south korea that we stand with them.

he sends a shot across the bow to north korea. is a provocative? perhaps a bit, but not to the degree that it will cause kim jong-un to lash out. more likely it will cause kim jong-un to realize that south korea has very powerful protection in the form of that nuclear umbrella from the united states of america. >> well said. one of the u.s. that welcomed what days phone call between president xi and president zelenskyy. john kirby said in fact quote, we think that is a good thing. whether that's going to lead to some sort of movement or plan for a proposal, i just don't think we know that right now. how about you admiral? do you see this as a real opportunity to negotiate peace or some sort of a truth? >> i think it is too soon to tell. i agree with my fellow admiral, i think he's analyzed it quickly. anytime that we can get a major world leader like president xi talking to president zelenskyy,

-- >> yes. >> and you shared all of the audio recordings of them? i've been subpoenaed. >> we have shared anything. >> has the special counsel jack smith been in contact with the? >> i've been contacted by several law enforcement authorities. >> if the doj one of those entities? >> yes. >> abby grossberg, her attorney, jerry, they have breaking news on msnbc this week. joining me now is rebecca, former manhattan district attorney. now professor at new york law school. okay rebecca, before we get into the details of what might be in these recordings, why would one set of audiotapes lead to a very different criminal investigations? >> well, there are some pretty explosive allegations in that complaint, alex. some of them claiming that fox news lawyers were in fact coaching, bullying, miss

grossberg to lie and take the fall for what was in fact the involvement of fox news. some of that could be relevant to some of the inquiries into january 6th. i think that has a potential relevance to a lot of different investigations. of course, there is a great deal of her allegations that have to do with workplace harassment that probably are less important to those other investigators. >> so, grossberg is suing fox news and she claims that she has found 90 audio recordings from her time as a producer on the show and tucker carlson. on one tape, ted cruz can be her talking about certification and who gets inaugurated, let's take a listen to part of that. >> i think that the country deserves to have a credible assessment of these claims and what the evidence shows.

the mechanism to try to force that is denying certification. >> who is deciding who gets inaugurated? >> it would be the results of the commission and what they find and if they found credible evidence of fraud that undermines confidence in the electoral results in any given state, they would report on that. >> fox news says they are vigorously defending against his lawsuit, saying her claims are on meritorious, delivering false allegations. after sunday crews, he responded on twitter saying that there is no secrecy since he also said the same things publicly. his spokesperson said there is nothing new to add. but rebecca, do you see any legal concerns around the recordings themselves in terms of how they were made? >> absolutely. the question here of course is the date and how they were made and what was being said. of course this effort to undermine the voters choice on

january 6th was in some ways dressed up as a legal move. that makes a whole lot of sense because rather than making it look like a coup, these officials and senators and leaders were acting as if they were pursuing legal means. of course, in certain ways, more investigation makes sense. but at this point, at this late point, 16 courts had already weighed in on this question and had cruz knew that. he had acknowledge that. at this point there is a sort of two things going on. his knowledge that the election was no fraud, no substantial fraud to undermine the results of the election and he is pushing to have this commission. >> as you mentioned, grossberg is accusing fox news of gender discrimination, religious harassment. you umbrella'd it as employment -- from what we learned, would you take your case if you would

employment lawyer. >> certainly if she has audio to backup those claims. i think it would be a very strong case. that all remains, we know she has audio. we know what some of those claims are if there's audio to back up some of those claims. i think would be a very strong case against discrimination. >> let me ask you about fox news. there is audio that exist, don't you want to sell? >> yeah, fox news, it is motivated by it's -- what we saw with the firing of tom curse, it is obviously recognizing that there are threats that are not just going to rile up a political base. but rather, in fact the network. and it's online. absolutely, you think that at some point it might be in its interest to settle this case.

are seeing on multiple subjects, whether it comes to the tented ceiling of elections, which we just discussed featuring ted cruz, to the tax on the first amendment to attacks on marriage equality and of course on privacy and the right to access abortion care. i think we already knew that before the supreme court got protection of women all across the nation. we are seeing it play out in red states across the country. >> but jenna, the battle for access to abortion medication, mifepristone, that heads back to a federal appeals court next month. what concerns you have around that case and how are you and other democrats summit -- preparing for the possible rulings? >> my number one concern on this entire subject is that women will die, little kids will lose their moms. partners will lose their wife.

and women are dying because of these extremist restrictions on medical access in this country. it is horrific. and as secretary of state, i've done everything within my jurisdiction, including joining the governor of colorado in not extraditing anybody for the criminalization of abortion care in other states. but as democratic secretaries across the country, we are fighting for the right to protect the right. vote because the rollback on the right about is how other extremist elected officials get these draconian policies in place in the first place. so abortion access, women's rights, equal rights in this country go hand in hand with the american people's ability to cast a ballot in free and fair elections. >> give me a sense of what the most alarming moves you have seen republicans make as they try to restrict access to elections and people being able to vote. >>, well i think that the topic

you just touched on in your last segment, senator ted cruz talking about stealing the presidency from the american people in 2020. but, then newly-, reported information that it did not stop just. there that trump allies were actually considering using breached stolen election data as a basis to stop the duly elected 2021 georgia senatorial runoff candidates. and so, just seeing how deep this went, the efforts to steal democracy from the american people. and it just has not stopped. we have seen the conspiracies continue to be justification for further voter suppression. we've seen the conspiracies used as motivation to breach election infrastructure. and also threaten the lives of election officials. >> jenna, what kind of safeguards can be put in place so the integrity of our elections will not be

questioned? >> well, there is two different subjects on what you just said. the integrity of our elections, will be questioned by extremists because they're trying to steal elections from the american people. and so they questioned to try to seize power in an undemocratic way. and then it's tied to all the other extremist policies we are seeing across the nation. but, americans should rest assured, our elections are safe and secure. and what states can do and should be doing right now. is following colorado. 's lee so far, example making it a felony to compromise voting equipment. aggressively prosecuting any individual who would threaten the life of an election worker as part of the attack on democracy. and american should be paying attention to the efforts to restrict voting rights across the country. it is part of the effort to try to take our voices away. but we are winning this fight,
