lots of questions to answer, so let's get started. breaking news, another texas tragedy. a shooter opens fire at a packed outlet mall killing eight people and wounding seven others including a fire the year old child. before the shooter is taken down by police. . what we are learning with the latest mass shooting in america, ahead on the live report plus, the trump tape. the jury and the civil rape independent defamation case gets a look at former trump's deposition. the twice impeached now index president is facing a deadline. plus, trump's defense of him that infamous hollywood comment and later. scotus scandal. collin crow picking up the tuition talk for the justices grand. new ethics concern which the court needs to address a little later. all of this and more is coming up. so, for the

third time in just over one week, the country is waking up to yet another mass shooting the latest happening at a packed outlet mall in dallas yesterday afternoon we know at least nine people are dead, including the suspect and at least seven others including a five-year-old child, were injured as of right now, we do not know the identity or the motive of the suspect but authorities are saying that they believe that the shooter acted alone in one statement, texas governor greg abbott calls the shooting an unspeakable tragedy the white house says president biden has been briefed on the incident we are going to go to texas state senator roland gutierrez in just a moment but first let's go to allen, texas, about 25 miles northeast of dallas that is where we have nbc news correspondent chesky there live

morgan, sorry to put you in the morning for such horrible news but we need to know from you, what is the latest you can share with our viewers about what is happening over allen, texas? >> katie, tough morning indeed here in allen, texas the alamo is closed to investigators right now police are calling on the public to provide any video, any witness accounts, to help them better understand this horrific shooting. which, as you mentioned, has left eight people dead and seven others wounded of those we won't, three remains in critical condition. the age range of these victims is five years old to 61 years old, as a result of what this gunman did yesterday afternoon. on the first reports of gunfire came in here at the alamo around 3:30. that is when witnesses described this man dressed in all-black wearing body armor looking very similar in fact a police officer. walking through the property, firing indiscriminately. the

police chief of allen said that an officer with an unrelated call he heard the gunfire and immediately ran towards the sound, seeing the gunman who he immediately engaged. that officer was able to shoot and kill that gunman within just a few minutes. katie, within that timeframe thousands of shoppers and employees were hiding for cover as best they could to win whatever they could to survive we are still waiting to hear the density of the gunman and the weapon used any sort of potential, motive here but right now the atf and fbi are assisting local authorities in this very much ongoing investigation katie? >> morgan, you have the chance to speak some of the witnesses that were there on the scene what was able to tell you about this frightening incident? >> chilling account, no matter who you spoke to everyone can hear that sound i spoke to a mother who had driven to the outlet mall this weekend to take her $2 on a shopping trip before summer vacation she told

me that when she heard the initial sound she thought it was fireworks and they realized now that this was an active shooter she called her, boyfriend wasn't law enforcement, asking what should they do. she helped 20 other people inside of the stores here, in the dressing rooms. she hit her own daughters in a bathroom, and then because she has a concealed carry permit, actually withdrew her own sidearm in stood guard outside that door for about half an hour, waiting to see what happens next as gunshots continued to wring out. katie, fortunately, police after half an hour were able to escort everybody safely outside she told me that she had to guard her daughter's eyes from seeing dead bodies as they walked out. katie. >> god. . morgan chesky, thank you so much for joining us on cnet allen, texas this morning. right now, texas senator roland

gutierrez. senator gutierrez, i know that you have been speaking out since yesterday's tragedy. us early this morning. first of the gate i need to know what your reaction is to this horrific shooting from yesterday. do you know how the community is currently doing? >> katie, as you know that areas up near, dallas texas i can tell you that we are all devastated from the perspective of how horrific this is. i texted a few of the uvalde families, and every time there is a mass shooting in around texas or anywhere in the united states, they feel a horrific sense of guilt, oddly enough. that they did not do enough to stop all of this. when indeed it is the responsibility of lawmakers. . i'm disgusted by the fact that we have a governor and lieutenant governor there refuses to do anything. we have a long way to go. we have three weeks left in this legislative

session. it is my hope that this governor and this lieutenant governor will do something in this space. and we can do some things. it is my hope to be able to look at the age limit restriction in closing the gun show loophole. things they push back on forever. telling me to do something. and it is very clear. >> senator, you bring up the families next of kin the victims on the uvalde shooting were actually just about to be on the anniversary of that shooting at robb elementary and uvalde county. that being inside of your district, one of the deadly shootings over the texas public school. that anniversary is coming up at the end of the month. you just mentioned that the governor and lieutenant governor and lawmakers have the power to effect change. yourself of repeatedly introduced legislation going on four sets of bills to work to address gun safety. talk about the kinds of laws that need to be passed to

prevent these shootings were happening in the first place. >> well, it is very clear that these parents have not asked for weapons ban. nobody is trying to take anybody's guns away. we just need to ensure that we don't have any are 15 between 20 1820 1920 years old. we have an restriction of handguns, we should have the same kind of restrictions on ar-15 type of rifles. we need to have extreme protective -- some knowledge of a person that has some problems. and has issuing threats to the community. we can go out and be able to address the issue and grab those guns from them for a period of time. determine whether this person should have those weapons or not lastly, you can go into a new gun show in texas today and by an ar-15 if you can show them your drivers license. you will be asked to questions. are you uscis and have you ever been arrested for a felony?

if your answer yes and no then you walk out with an ar-15. there is no question it is happening in this state. -- a, all these republicans have done is amplify access to these types of weapons. this crime, this horrific tragedy that you are seeing unfold today and beyond is on the republican party. they are responsible for making our texas communities less safe. >> senator, quickly before i have to let you go, i want to get your brief response to representative keith selfie as a republican congressman representing allen texas, in response to asking the people who felt prayers are not cutting it saying, well those are people who do not believe in the almighty god that is absolutely in control of our lives. what is your response to congressman self? >> the god that i believe in gives us free will. they allow us to make decisions. gives us the ability to go out and make

assume it is judge johnson? it is very blurry. >> so, when trump denied these allegations, he said, christian, that asian carroll is not his type we just saw him on tape on video mistaking -- for his wife ali was married to at the top of the electorate in the 90s. how much does this undermine his credibility in this case? >> it undermines his credibility completely. but i think one of the things that's really powerful about all of the plaintiffs case is that it is not about sexual gratification. rape has never been about sexual gratification. it is about power and control. and when the jury heard those deposition experts, all of those, that is when trump is actually testifying, even though he's not physically there, the jury is able to hear his words and hear his words which are off the cuff. which typically will

appeal to his face. but for a jury who is determining whether or not he sexually assaulted a woman, i cannot believe it is going to come off well. >> question, this is a civil case. both of us are former prosecutors. they've to prove this beyond a reasonable doubt. for civil case it is lower, preponderance of the evidence. at this point they put for no witnesses and no evidence has been introduced. unless of course trump decided last minute to testify, as judge kaplan has asked him to do. how does the fact that trump puts nothing forward interns a substantive case and chief affect the burden of proof for e. jean carroll at this point? >> it does not affect the burden of proof for carol. they have no requirements to put on the case. but in this case, just from a practical standpoint knowing that jurors are people like you and i who bring within the colin experiences back in the deliberation room, i think is very detrimental. here the

plaintive put on a complaint witness. not just one but two. this is somebody who jean carroll actually called before any -- fabrications that donald trump raped me, right when it actually happened. fast forward, and that really undermines the argument that this is politically motivated. that show this right when he was running for president. we have symmetrical close in time and before trump was running that it really bolsters her climb. and then you heard from other individuals who themselves said they were sexually assaulting a substantially similar way that carole was. then you learn how this actually affected her. that type of case is really important for the defense to have some type of case. while they did put on cross examination of these witnesses, i think we probably agree that from a prosecutors standpoint it is not enough. >> christian, i really wanted you to come on today because you are a special prosecutor in the bill cosby trial. more than 60 women have

the credibility of accusing bill cosby of sexual assault and sexual battery. only one being able to bring the case, andrew atkinson. because of the statute of limitations issues with other alleged victims. after that was overturned you said quote, the conviction has been overturned by the merits of the case are still in place. talk to us a little bit about the similarities in these cases. talk to us again about the criminal case with bill cosby, with this idea that judge kaplan allowed multiple alleged victims of donald trump to testify in just aging carols trial. >> because molly was a state prosecution and this is a federal civil trial, the evidence here is a little different. but what that does is ex talks about how that individual, that perpetrator in this case trump in my case cosby, had that same motive. there was no accident or mistake when these perpetrators sexually abuse those women.

there was no consent and they knew there was no consent. because time and time again when they grab a woman or did those sexually inappropriate things without their consent, they knew that those women were not consenting. there is a lot of similarity. even from a holistic standpoint, jean carroll just like andre kosik did not have to stand alone through those allegations he had other witnesses who took the stand they were able to say hey, this also happened to me. from working with survivors both in the prosecution realm and as a civil liberties litigator representing numerous survivors, one of the things that survivors really feel comfortable with when they have to go through testimonies is not feeling alone. and well it is nice to go and look at your lawyer, it is also really nice to know that your allegations do not stand alone. and then being able to look with the other people care for you as well. >> christian givens feathering, thank you for taking the time to share your

state in less than two weeks texas has seen multiple mass shootings in recent years we are just weeks shy from the first nursery of the robb elementary school shooting in uvalde but representative, your state texas is still has permit-less carry which they voted for last year in 2022 making a law that you do not require a permit to carry a firearm. what was the legislature's reasoning for that law? >> thank you for your thoughts for our state. this has been a recurring nightmare for texas for our country. the reason the we keep living -- in america is because our policy makers refused to change the status quo. we are the only country that allows this to happen. and we can make a different choice. our policy makers can make a different choice. but they refused to do so. like you. said we are the state to pass permit-less carry. text republicans passed

that law over the objections of educators and parents and law enforcement in our state. and i don't have any justification for that bill, except it all i can see is that it was aimed to please the far-right primary voters that many elected officials are -- to get reelected >> representative, the gun violence projects as the 22 mass shootings so far have been used the congressional defamation of a minimum of four deaths occurring in the year 2023 alone. the gun violence archive says 199 mass shootings, which means a minimum of four victims injured or killed to be able to qualify for a mass shooting. in texas has also lower the age to be able to purchase a firearm rifles from 21 to 18. now you have perilous carrie. you've got uvalde, mass shootings, el paso. why is it that republicans in texas are

just not listening to what the voters want? which are actual background checks and common sense legislation? what you and other democrats are trying to explain is it just makes everybody safe, including republicans own children. >> it has not even been a year since the 19 80s and two teachers at robb elementary and uvalde, texas. and we've got dedicates. now, on the other side of our state, in allen, texas. republican politicians in texas and around the country are banning books in the name of protecting children. republican politicians here in texas and around the country are banning drag queens in the name of protecting children. yet today will not lift a finger when it comes to addressing the number one cause of death for children in the united states. which is gun violence. if you are not doing something about guns than you don't really care about our kids. >> what do you say in

response, representative, to texas governor greg abbott? and ted cruz? they are all sending their thoughts and prayers. i do not devalue that in any way, and i think there is value to praying for the well-being of people. and i think you should keep people in your thoughts after they've got through such a horrific experience. but let's be blunt. if the guns that are a problem, what more can you continue to do in texas? we are fighting a fight in florida we have a lot of problems with desantis and others. what are you doing in texas to make sure that your state is safer for everyone? >> i think that we all stand with the allen compete is he in our grief this morning. by the republican congressman who. represents represents allen in the u.s. house set a solution to this epidemic of gun violence which is more than prayer like you, i believe in the power of prayer i believe that prayer can change lives

desantis, took office in 2019, he vowed to pursue an agenda that would heal the states political divisions. with the states 2023 legislative session and in just two days ago, i wouldn't say healing was on the agenda. and back, to the republican supermajority passed a slew of controversial bills that deepens the already divisive culture wars. we're talking everything from legislation allowing floridians to carry guns without permits, to a new bill put preventing abortions after -- weeks of pregnancy.

to anti-trans bill and the don't say gay law. there is also election laws that are clearing the way for desantis to run for presidents. the sunshine state is decidedly red. been a republican or democrat makes you persona non grata. after such a divisive legislative session, what does the future hold for florida? joining me now is florida state representative. representative, i know you have been fighting the good fight in tel aviv for a long time. and light of yesterday's tragic shooting in texas, let's start with guns. it's always the guns. the florida house, late last week, passed a bill to lower the age to buy a rifle from 21 to 18. this reverses a restriction that was enacted after the stony douglass massacre. polls are showing, representative, that americans overwhelmingly want stricter gun laws, so why are florida republicans occurring what their constituents want?

treatments for chandler minors, and potentially taking those kids away from their families if they are receiving gender affirming care. what are democrats doing to fight against these attacks on individual liberties? are you seen this actually motivate voters? >> well, first of, all of my republican colleagues spent the same type of energy they did on attacking lgbtq plus community, then addressing things like gun violence, like the rising costs of insurance, the rise in rent, then we would see real solutions in florida, rather than this bigoted, homophobic, transphobic, and just dangerous policy agenda. the ban on gender affirming care in our state, it's already pushing families out of florida. this seems to be their intention. they want to create a state that is only going to be safe for people who look a certain way, who have a certain amount of money, who have a certain

political ideology. meanwhile, for those who don't fit those boxes are been otherized, endangered, and pushed out. as democrats, were not only fighting back and the narrative, and trying to help ensure that people understand that this is a fundamental freedoms, but of course, for fine heaton this fight to the streets. we have -- abortion access that will kick off tomorrow. we're doing everything we can to bring the fight directly to the people, because their gerrymandered legislature, with the voter suppression policies coming out, we realize it's very difficult to initiate change at that level. we have to go to the community, grassroots level. >> let me make it clear, representative, i am a floridian. i am raising a child here. i am paying taxes to live here. putting aside to santa's not being here, been a total, you know, deadbeat governor. not helping those that are here for the insurance costs, and for the climate problems that we're having, we are actually

having a legitimate fear of brain drain. the idea that kids are not going to come here to go to school. they're not going to get the education that they need or deserve. then you have families that are going to flee the state because they cannot raise their children in a place where the children will feel safe, and where they themselves, as parents, they have control over how they're going to raise their children. what can be done to reassure floridians that are currently here, and those that are thinking about coming to the state, to be able to raise their own families here? >> honestly, that is the struggle we're grappling with right now. we are experiencing a brain drain. we have challenges in retaining and recruiting top talent, whether it's a workforce, or with our universities. with the political agenda of governor ron desantis -- what i think it's going to take's leader is stepping up to the plate, helping to pave the way forward, where we prioritize human dignity, our

collective freedoms. we address issues like economic insecurity, like the cost of housing. it's really going to be leadership of our local elected officials, alongside are democrats who are in the minority legislature, but reflects majority perspectives outside. it's up to us to paint a picture of our future, into engaging 24/7 organization with our constituents. that is what is going to have to, taken it won't be one election cycle, it might not even be a two election cycle. when we think long term above florida, i know there is a prosperous, and equitable future before us. >> you know, representative, i got 30 seconds left. i do want to, ask we're now not in session. meaning the legislative session has been done and concluded. is there anything we're done, well not in session, to try to help move aggressive policies along? >> absolutely, i mean, yesterday we joined congressman -- who is my congressman and kicking it off in 24/7
