three years. i love live in this country, i love bringing up my kids in this country but i think many immigrants would agree with me and saying that the one thing we cannot stand about having to bring up our kids in this country is the gun violence. it is top of the list of things that make us think, maybe we shouldn't have come here. it amazes me that americans still don't quite understand how unique this country is when it comes to gun violence. they still don't quite understand that the rest of the world does not live like this. i mean, i used to drop my kid to school in england and never had to worry about whether they would come home at the end of the day. now i have to worry about that when i drop my kids to school here. it is astonishing and it is just inexcusable. >> it is inexcusable. i've to think say, mehdi i think more more people are sharing your sentiment. i was on the air last night throughout the tragedy now is seeing some realtime reaction from republicans as their statements were coming in, these holiday tense, just simply offering more thoughts and prayers. and listening to the officials give that briefing where they talk more and more about just

trying to offer their thoughts and prayers. but not once mentioning the word guns. we heard rehab centers, we talked about mental health. everything in the statement except dressing the guns. one of the women that we heard from yesterday, a local resident of texas, she just wants to move out. she does not feel safe anymore in her community. -- >> can you blame anyone for saying that? >> exactly. i think more and more people are sharing those thoughts exactly. mehdi, thank you so much my friend, always great to see you, enjoy the rest of your evening off. , always great t>> coming up a . tonight, holding up them countable, the -- environment that we are seeing in texas and their refusal to change it. plus, damning video from the donald trump's deposition in the e. jean carroll case an all in the family, occurrence thomas's ethics scandals are growing by the minute and now involve his wife jeanne. surprise. i'm ayman mohyeldin, let's get started.

we start tonight with that breaking news on the horrific mall shooting in allen, texas. according to two senior law enforcement officials, the suspect gunman, the suspected gunman, excuse me, interacted with neo-nazis and white supremacist content online. one of the officials said that the suspect posted this kind of content himself. the other official said that he consumed such rhetoric online and said that authorities found him with a patch with a right-wing acronym on his chest. we should note that the official said it is too early in the investigation to ascribe a motive, but here's what we do know. eight people, including a five-year-old child, died in that shooting. of course, as we just said, the republican ruffling after massacres like this one is always thoughts and prayers. no action. zero change. that is, undoubtedly, the standard republican party line. but another line is now

coinciding with it. we heard it last night on fox. it is the news of the word -- allen, texas, where is unfolding. >> just like -- the polite, the professional. but don't plan to kill everyone you meet because you never know. >> that was former u.s. marshal special deputy alex -- telling fox viewers that in america, in 2023, we must have a plan to quote, kill everyone in order to survive this society that our lawmakers have created. any necessary line that conservatives will now use when discussing guns. it is not enough to go oh negan, it is not enough to have that gun on you, what you need to do is be prepared, to consider murder everywhere you go. whether it is thoughts and prayers or plans to kill everyone you meet, republicans

make these kinds of statements because they want to avoid accountability. so let's talk about that accountability for a moment and what exactly it is that they have done. take, for example, this guy. jeff leech. you may remember him from last night. he was the state representative who actually serves this city of allen, texas. he coauthored the 2021 texas carrie bill. leach, last night, said thoughts and prayers after making it easier for people to have guns in public. first, this guy, greg abbott who in 2015 said he was embarrassed that texas was the number tuesday in the nation for new gun purchases and demanded that texan start arming themselves as quickly as possible. abbott put out the empty statement of thoughts and prayers as well, and said the attack was evidence of a mental health crisis in america. greg abbott, that guy, that same governor, caught $211 million in texas mental health

some funding in 2022 alone. how about this guy, daniel patrick? that is abbott's lieutenant governor, who was one of the pioneers of the door control movement. remember that one? it was asserting that guns were the issue at the heart of school shootings in our country, the number of doors these school has is the real danger. if only we could guard the doors. to be clear, we are not saying these individuals are responsible, but these people have worked to create the environment that we are seeing in texas. no doubt about it. and that environment is one where guns seem to matter more than human life. joining me now is democratic congressman -- of texas. congressman, thank you so much for making time tonight. i know that your state is in mourning once again, just after the horrible events in cleveland, texas. now, your reckoning with another mass shooting, this time in allen, texas. how are you doing? how are your constituents doing?

how do texans wake up every day in that state with all of this grief and tragedy and heartbreak? >> yeah, you know, the first thing that i thought of was that allen is not far from fort worth, where my family and i reside. and we have been to that outlet mall several occasions because it is a very popular outlet mall in the fact that a white supremacist would go there is honestly not a shock because collin county is a very diverse county. a lot of the newer tech jobs that have been created in the last few years here in the dfw area collin county, and lots of families, international families reside there and use that mall. it's scary. and we do need more than boston prayers. if you, if republicans would pick up the bible and read it and read james to 2016 might know that fate, that works is dead and the got one just to

take action when there has been so much carnage and bloodshed, so many families that have been devastated by the senseless violence that continues to take place in america almost on a daily basis. >> yeah. in your past life as a representative in the texas legislation, you are fighting driven or grab abbott and his gun extremism every day. talk a little bit about that response from abbott last week, the one that was tone-deaf, posting a photo of his dog after the cleveland shooting, calling the victims illegal immigrants and i's reaction to the events and allen, where he basically is saying mental health before any official has come out and publicly described a motivation. >> yeah. well, first of all, politically you have to understand that greg abbott has been a desperate man. he doesn't get nearly as much attention as ron desantis does. and a lot of this rhetoric, a lot of this dehumanizing human beings that are here in texas

working hard, regardless of their immigration status, is a way for him to sort of try to catch up with desantis in the crazy department. and again, on the guns, he's completely tone-deaf when it comes to that. he is absolutely not a surprise. we used to have very reasonable gun laws here in texas. if people wanted to have a concealed, a carry license for, instance, the take a course to make sure their profession and shooting. these did not be able to walk into the state capital without a gun. now they have taken the metal detectors down at the state capital. you can just walk right in and to the state capital now. so, things here are going backwards as it relates to gun safety. and i can tell you this whole talk about gun grabbing needs to stop. i am a gun owner. i am never going to give up my

guns. most -- i know will not give up our guns. but we expect for reasonable steps to be taken when this much blood continues to be spilled. why can't we have to pass the background check bill? why can't we pass an extended background check bill? why can't we make sure that boys are, men that are not even old enough to rent a car can't buy an ar? why not do that? no one will lose anything that way. they are perfectly reasonable steps, that any person, even republicans that you talk to, we'll tell you that they believe in those things. but it just shows you how off the deep and the republican primary has become in states like texas. >> you can have a beer is an 18, sorry you, cannot have an beer is an 18-year-old but you can certainly buy an assault rifle and do what you want with it. what do you make of this metastasizing campaign of fearmongering from conservatives? first it was, everyone by a gun,

then everyone carry a gun at all times. and now, as we heard there from that fox personality saying carry a gun at all times and constantly think about how you can kill everyone you meet? >> you know, i am out visiting colleges right now with my 17 year olds. and we, we are actually in houston right now. we were in -- my son that if something happens you, know, you need to think about what you would do. that is just such an unusual thing that someone should have to say to their kids. and let me just tell you, as someone that has a concealed handgun license, i will never forget when -- told the group of us that she was teaching, you have to think about, anytime you pull that trigger, you know when, you are slinging bullets, you don't know where they are grilling.

let me tell you, no one with any, no one with a reasonable mind wants to ever have to make the decision to use their firearm inside of a mall or a grocery store or a school or any place like that, because that is not what everyday citizens are trained to do. that is what law enforcement and military personnel are trained to do. no one in the right mind, republican democrats, liberal, conservative's, want to have to make that decision. so to hear republicans say things like that is just absolutely insane. it just shows how these radical house republicans in a state like texas, how far removed they are from the average, everyday texan. i >> was going. to say, imagine -- shot or get caught up in a shoot out between civilians trying to protect themselves from who they perceive to have been the mass shooter. that would not be a situation that i would want to -- in the country. certainly not for law

be over. last, week the judge overseeing writer e. jean carroll's civil rape and defamation case against the ex president left the door open for a possible last-minute decision from trump to testify, if he so chose. after both carroll and trump's

lawyers rested their case, judge lewis gave the defense team until 5 pm on today to confirm whether or not trump would appear in court. guess what? 5 pm came and went, and it appears the ex president has chosen not to take the stand, surprise. as far as we can tell, no notice has been filed by trump's team. and while the jury may not get a chance to see trump questioned in court, they did in fact hear from him last week. jurors got to see videos of trump's october 2020 deposition regarding carroll's allegations. the video, which we should note is edited, runs about an hour in total, during which time the agitated ex president repeatedly denies allegations against him, and rattles of a barrage of insults at both his accuser and her lawyer. although trump had said he had never met carole, she isn't his, quote, type, he did inadvertently admit she had a familiar face. here is his reaction when shown a picture of himself, his then

him have every right to a woman's body, as it's merely a fact of evolution, true for the last million years. it's also worth noting the earliest population of modern humans arose just about 200,000 years ago. well, trump's obvious lack of historical knowledge aside for a moment, this video leaves us with some serious, serious questions about a man who is currently the front runner for the republican nomination. i mean, for all of the talk about president biden's so-called mental decline, the gop's standard bearer, he cannot even identify one of his own ex wife's. and as for the republican party, a party that launched an all out assault on the lgbtq+ community, painting them as predators, they seem to have no issue aligning themselves with a man who takes pride in his ability to touch and groped women without their consent. look, in the coming weeks, a jury in manhattan will decide

whether or not donald trump is liable for rape. but in the meantime, there's anything we, the american public, can glean from that deposition, it is this. donald trump is not suitable for office. let's discuss this with msnbc legal analyst lisa rubin, she has been covering this trial and has been in the courtroom already, and simply azali, msnbc legal analyst and former federal prosecutor. it could have both of you with us. cynthia, let me get your reaction to that. i want to play you another clip from trump's deposition. watch this. >> still don't know this woman. think she's a whack job. i know nothing about her. i think she's sick, mentally sick. you wouldn't be a choice of mine either, to be honest, i hope you're not insulted. i hope not under any circumstances have any interest in you. i'm honest when i say it. >> what do you make of that? i mean, based on what you've seen from that day, those three

clips we've played for you, the inability recognize his ex-wife, the stupidity of the second comment about stars have been doing it for 1 million years, and then that bit where his defense is you're not my type, and attacking the attorney there. did trump seemingly make the right decision not to take the stand? >> [laughter] yes, that's for sure. but let's remember this. when he takes the stand of that deposition, he's talking to the jury. and what we know from the first point, not only does he not identify carroll, thinking she's marla maples, when he is confronted with that, and leaving aside his lawyers improper coaching of him, when he is confronted with it, and when he is cornered like a rat, what does he do? what does he say? he lies. he says oh, it's blurry. and here's why that's important. and that's because the jury has the photograph. and they know when he is

cornered, he lies. because he lied to them. that's what the deposition is. it's him talking to the jury. and in this case, not only did he not have the guts to come talk to them, he didn't even have the guts to come sit in the courtroom. instead, he sent a bully to cross examine this woman. and on the one occasion he was talking to them and was cornered, he lied to them. and i think it's important, and my guess is, in closing, it is highlighted. >> alicia, take us inside the courtroom the last couple of days. tell us how the jury reacted to that deposition video of trump. >> cynthia can tell me better than i can that trying to assess how a jury feels about a defendant's a art, not a science, and it's an art in which many of us feel -- fail repeatedly. having been said, you could hear a pin drop during the

deposition. and he did not just lie about the photograph being blurry. and by the way, the jury has seen that photograph multiple times throughout the trial. i can even tell you what plate number it, is 1:12. but you can hear -- the dangerous libel, that he lied about all sorts of things, big and small, including whether or not he cheated on his first wife, of on a trump, when he was seeing marlette maples. he claimed not to know whether those relationships over lap. he was seen escorting marla maples as early as 1989. he wasn't divorced from of on a trump until 1992. he can even give robbie kaplan, the lawyer, the dates he was married to marla maples. he just continued a pattern of mendacity all throughout that deposition, that the jury is really going to have to think about in confronting whether or not this is a person about whom e. jean carroll was telling the truth. >> cynthia, trump initially had an expert, i believe, expert witness, i believe, lined up to try and rebut carroll's claims.

that witness was unable to testify because of health issues. since the ex president will likely not appear, exactly, not appear this week, his defense included no witnesses. and that stands in contrast with what we saw from carroll's, which put forward multiple witnesses, including two women who alleged trump assaulted them. from a legal perspective, that the lack of witnesses on his side hurt the former presidents case? >> of course. and not only do we have the two women who have been assaulted, but we have one woman that e. jean carroll spoke to within minutes of the assault and told her about it. those contemporaneous witnesses, we call them outcry witnesses, that happened at the time of the assault are very important for us establishing credibility and corroboration. and we also are in a situation where joe tacopina promised there wasn't going to be any corroboration. and what do we know at closing? her lawyer can get up and go,

oh no, he said there was not corroboration. but there is. and here's these two witnesses. and by the way, there's also these other cases. and by the way, there's also all this line. so, yes, the number of witnesses makes a huge difference. remember, this is not beyond a reasonable doubt criminal case, although i would suggest youth that they have proven this case beyond a reasonable doubt. this is a preponderance of the evidence case. this is really holding out, you know, the scales of justice, and has to just tip ever so much. it's not the 52 yard line, it's not the 95 yard line, it's one inch over the 50 yard line. and unless there is some kind of surprised juror in there, i'd be very surprised in this case doesn't come back quickly for e. jean carroll. >> lisa, should we, now the -- deadline has come, gone assumed he has missed it and not will be testifying, so, what are your expectations for closing arguments this week? >> we should definitely assume

that he has missed it. judge liu kaplan, who gave trump the opportunity to move to reopen his case once his defense rested, has gone above and beyond to ensure this trial is 100% fair to donald trump, knowing that if there is a verdict for e. jean carroll, that will likely be appealed. so, what he is doing is try to do everything within his power to ensure a verdict here stands on appeal. in terms of closing arguments, i think cynthia's right. what we will see is a plaintive pointing to all the different ways in which e. jean carroll's testimony was not only credible in and of itself, but bolstered multiple times over by the two people she told in realtime, by the other two accusers who both alleged assault by donald trump, literally decades apart, one in 1970, 91 in 2005. and even by her psychological expert who talked about having spent 22 hours with e. jean carroll, and seen the person,

despite her resilience, definitely shows signs of being traumatized in the same way that this person knows is evocative, not only of sexual assault victims, but of post combat veterans with ptsd. i think all those things together are going to add up to a powerful presentation tomorrow on behalf of e. jean carroll. and i'm really looking forward to being there and seeing the jury's reaction, ayman. >> all right, lisa rubin, cynthia alksne, thank you so much for breaking that down for us. after the break, we're going to dive into the very latest ethical scandals involving clarence thomas, and you up, his wife. ♪ ♪ ♪ ♪ ♪

perceived as a bribe. what do you think it is? what do you make of it? >> certainly, it has the appearance of impropriety. it could be pay for play. so the only knee that he funneled to mrs. thomas, he funneled it through a nonprofit organization that ended up having matters before the court, they filed an amicus brief in section five shelby county the hold her case, that actually -- the heart of the voting rights act where justice thomas has been -- majority in that case, striking down the heart of the voting rights act. so at the very least, there is the appearance of impropriety. there is paul sibley a full-out conflict of interest and possibly a street bribe. but there seems to be no bottom to the ethical conflict that the court has and that justice thomas is executing. that is why we absolutely need ethical standards to apply to this court. >> basil, i want to give your thoughts on --

harlan crow paying for the tuition of a child in clarence thomas's care. harlan crow basically dismissing the report morales as him saying that he wants to help people that are less fortunate. funny how there are millions of american kids who could use tuition support. this one just happens to be the one in the care of a powerful supreme court justice. >> yeah. amen, this is such an amazing report. because, look, if clarence thomas needed the money and asked for it or harlan knew he needed it and gave it to him anyway, the reality is that as everyone who is grown up the way i grew up, he would imagine that clarence thomas in some way, shape, or form would be indebted to this man. it doesn't seem like this was just a onetime payment, right, he has insistently paid this young man's tuition to schools over the course of potentially

wrongdoing against clarence thomas, specifically. how he reported his wife's income. those concerns spurred internal process changes but no additional probe of thomas's conduct. why does it seem like no one will ever hold thomas accountable for all of these questions? >> i don't think it is essential to justice thomas. i this court has shown an inability to police itself. the last time they tried to look up any type of ethical reform was back in 1991. and it is not working. that is why i do think that it is within congresses authority and congresses should act to set african guidelines as it pertains to non judicial conduct, efforts to recuse themselves when the justice should recuse themselves, what type of disclosures they should have and what type of interactions they should be able to have within individuals that potentially of matters before the court. they do not dictate what types

vásquez, a freelance journalist was on that subway just a hour earlier, neely boarded a northbound bound train -- started, yelling i don't have a drink, i don't have food, i give up. and neely, who is reportedly homeless, said i don't mind going to jail, going to, prison and ready to josh. -- that the neely's screaming was frightening, the 30 old had not assaulted anyone. but the situation quickly took a turn when another rider grabbed neely and placed him in a chokehold. video of that incident, which we have chosen not to play for you tonight, shows a 24-year-old light -- white man, later identified as daniel penny, wrapping an arm around neely's neck, while others passers try to restrain. neely scene riling, trying to break free from the hold, as the minutes take by, he visibly weekends. the arm wrapped around his neck stays firmly in place for almost 15 minutes. even after neely stops moving,

the men continue to hold him down. told nbc news the chokehold lasted for 15 minutes in total. jordan neely was later pronounced dead at a nearby hospital, and on wednesday, the medical examiner ruled neely's death a homicide caused by compression of the neck. plenty, a marine veteran, was taken into custody on monday, questioned by police and later released. he has not been charged with a crime. in a statement, penny's lawyer said their client never intended to harm neely, and was simply acting to protect himself and others until help arrived. the manhattan district attorney's office says they are investigating the incident. and on friday, two sources familiar with the matter told nbc news the d.a. has plans to present the case to a grand jury. now, before his death, jordan neely had a passion for entertaining. no stranger to the subway, he had spent years as a busker, busting out dance routines as a michael jackson impersonator. but according to his family, he also suffered from severe

mental health issues, stemming from the loss of his mother, who was strangled by her boyfriend in 2007 when neely was just 14 years old. nearly told the daily news that he loved his mother so much he lost so much he just wasn't the same anymore. his aunt said he develop depression and later schizophrenia and was finding it difficult to get the help he needed. she told the new york post, quote, the whole system just failed him. he fell through the cracks of the system. and following neely's that, new york city mayor eric adams issued a statement saying, quote, any loss of life is tragic. the mayor then wrote he would not comment any further because, quote, there's a lot we do not know about what happened here. adams made addressing the cities homelessness crisis a key part of his agenda since taking office, sending outreach workers and stepping up police presence across the subway system. last year, he announced plans to hospitalize more homeless

people by involuntarily committing those in a psychiatric crisis. and some advocates have actually disagreed with adam's approach, saying it criminalizes those who live in the streets, many of whom suffer from mental illness. they also say it shapes residents perceptions as people who are homeless as being inherently violent. experts point out that people experiencing homelessness or mental illness are actually at a greater risk of being harmed themselves then of harming others. there's another factor we cannot ignore here. that of course is jordan's race. research has often shown that people show blackmon as more threatening than their counterparts. had neely been a white man suffering on that subway car that afternoon, one can't help but wonder if he would be alive today. look, any new yorker, myself included, can tell you about a time they may have felt uncomfortable on a subway car. it's part of life in new york city. but in that instance, but most of us do, move to the next car,
