plus, damning video from donald trump's deposition in the e. jean carroll case. an all in the family, clarence thomas's ethics scandals are growing by the minute, and now involve his wife, ginni thomas. surprise, i'm ayman mohyeldin, let's get started. ♪ ♪ ♪ we start tonight with that breaking news, on the horrific mall shooting in allen, texas. according to two senior law enforcement officials, the suspected gunman, the suspected gunman, excuse me, interacted with neo-nazis and white supremacist content online. one of the officials said the suspect posted this kind of content himself. the other official said he consume such rhetoric online, and said that authorities found him with a patch with a right-wing acronym on his chest. we should note the official said it is too early an investigation to ascribe a motive, but here's what we do know.

eight people, including a five year child, died in that shooting. of course, as we've just said, the republican refrain after massacres like this one is always thoughts and prayers. no action, zero change. that is undoubtedly the standard republican party line. but another line is now coinciding with it. and we heard last night on fox, as the news of the horror in allen, texas, was unfolding. >> just like general mattis once said, you know, people like to be professional, have a plan to kill everyone you meet, because you never know. >> that was former u.s. marshals special deputy alex caulker, telling fox viewers that in america in 2023, we must have a plan to, quote, kill everyone in order to survive this society that our lawmakers have created for us. a new necessary line that conservatives will now use when

discussing guns. it's not enough to own again, it's not enough to have that gun on you, what you need to do is be prepared, is to consider murder everywhere you go. whether it's thoughts and prayers or plan to kill everyone you meet, republicans make these kinds of statements because they want to avoid accountability. so, let's talk about that accountability for a moment and what exactly it is they have done. take, for example, this guy, jeff the leach. you may have remembered him from last night, he was the state representative that actually serves the city of allen, texas. he coauthored the 2021 texas permit-less carry bill. leach last night said thoughts and prayers after making it easier for people to have guns in public. of course, this guy, governor greg abbott, who, in 2015, said he was embarrassed that texas was the number two state in the nation for gun purchases, and

demanded that texans start arming themselves as quickly as possible. abbott put out an empty statement of thoughts and prayers as well, and said the attack was evidence of a mental health crisis in america. greg abbott, that guy, that same governor, cut 200 and $11 million in texas mental health funding in 2022 alone. how about this guy, dan patrick? that is abbott's lieutenant governor, who is one of the pioneers of the door control movement. you remember that one? asserting that guns weren't the issue at the heart of school shootings at this country, the number of doors a school has is the real danger. if only we could guard the doors. now, to be clear, we are not saying these individuals are responsible. but these people have worked to create the environment we're seeing in texas, no doubt about it. and that investment is one where guns seem to matter more than human life.

joining me now is democratic congressman mark veasey of texas. congressman, thank you so much for making time for us tonight. i know your state is in mourning, once again, just after the horrible events in cleveland, texas, now your reckoning with another mass shooting, this time in allen, texas. how are you doing? how are your constituents doing? how do texans wake up every day in that state with all of this grief and tragedy and heartbreak? >> yeah, you, know the first thing that i thought of is that, you know, allen, is not far from fort worth, where my family and i reside. and we've been to that outlet mall in several occasions. it's very popular outlet mall. the fact that a white supremacist would go there is honestly not a shock, because collin county is a very diverse county. a lot of the newer tech jobs that weekend created in the last several years in the dmv area are in column county, and lots of family, international

families reside there, and use that mall. it's scary. and we do need more than thoughts and prayers. if republicans would pick up the bible and read it, read james to 26, they know that face without works is dead. and god want us to take action, when there's been so much carnage, so much bloodshed, so many families that have been devastated by the senseless violence that continues to take place in america, almost on a daily basis now. >> yeah, in your past life as a representative in the texas state legislator, you are fighting governor greg abbott and his gun extremism every day. talk a little bit about that response from abbott last week, the one that was tone deaf, posting a photo of his dog after the cleveland shooting, calling the victims illegal immigrants. and house reacting to the events in allen, where he's basically saying mental health before any official has come out and publicly ascribe any

motivation. >> yeah, well, first of all, politically you have to understand that greg abbott is a desperate man. he doesn't get nearly as much attention as ron desantis does. and a lot of this rhetoric, a lot of this dehumanizing, you know, human beings that are here in texas working hard, regardless of their immigration status, is a way for him to sort of try to catch up with desantis in the crazy department. and again, on the gun, he seemed completely tone-deaf when it comes that. absolutely no surprise. we used to have very reasonable gun laws here in texas. if people want to, you, know have a concealed carry license, for instance, they have to go and take a course and make sure they're proficient at shooting. you know, they've gotten rid of that. used to not be able to walk into the state capital without a gun. now, they've taken the metal detectors out at the state

capital. you can just, you know, walk right in into the state capital now. so, you know, things here are going backwards as it relates to gun safety. and i can tell you, this whole talk about gun grabbing needs to stop. i'm a gun owner. i'm never going to give up our guns. most residents i know are never going to give up their guns. but we expect for reasonable steps to be taken, when this much blood continues to be still. why can't we passed background check bill? why can we pass an extended back on track bill? why can't we make sure that the ways, or man, that are not even old enough to rent a car can't rent an ar? why not do that? no one is going to lose anything that way. they are perfectly reasonable steps, and any texan, a lot of republicans you talked, it will say they believe in those things. but it just shows you how off the deep and the republican

primary has become in states like texas. >> yeah, you can have a beer, sorry, you cannot have a beer as an 18 year old, but you can certainly buy an assault rifle and do what you want with it. what you make of this metastasizing campaign of fearmongering from conservatives? first, it was everyone by a gun, then everyone carry a gun at all times, and now, as we heard there from that fox personality saying carry a gun at all times and constantly think about how you can kill everyone you meet. >> you know, i'm out visiting colleges right now with my 17 year old. and we're actually in houston right now. and i was, we were in the galleria here in houston, i told my son, a, if something happens, you need to think about what you would do. and that's just such a unusual thing that someone should have to say to their kid.

and let me just tell you, as someone who has a concealed handgun license, i'll never forget when my instructor told a group of us that she was teaching you have to think about anytime you pull that trigger. when you're slinging bullets, you don't know where they're going. and let me tell you, no one with any, you know, no one within reasonable mind wants to ever have to make the decision to use their firearm inside a mall or grocery store or school or any place like that. because that's not what everyday citizens are trained to do. that's what law enforcement and military personnel are trying to do. no one in their right mind, republican, democrat, liberal, conservative, wants to have to make that decision. so, to hear republicans say things like that, it's just absolutely insane and just shows how these radical reckless republicans in a state like texas, how far removed

they are from the average everyday texan. >> yeah, i was going to say, imagine surviving a mass shooter only get caught up in a shoot out between civilians trying to protect themselves from who they perceive to have been the mass shooter. that would not be a situation i would want to see unfolding in this country, and certainly not for law enforcement, either, walking into something that crazy. i don't want to get your thoughts, if i can, congressman, about this developing story out of brownsville, the border town in texas there. a another heartbreaking horrific situation. seven people, dead almost a dozen injured. >> i have not seen, that until you just put that up. i think i need to find out more facts about that. but that is -- that is terrible, that someone would run a car into a group of migrants. >> yeah, i mean, authorities are still saying they're investigating it. all that you, all that you get caught up on that. i know you are on a busy trip with your son. but it's just a heartbreaking situation. and again, i want to ask you about it, just because i know texas is going through so much

last week, the judge overseeing writer e. jean carroll's civil rape and defamation case against the ex president left the door open for a possible last-minute decision from trump to testify, if he so chose. after both carroll and trump's lawyers rested their case, judge lewis kaplan gave the defense team until 5 pm on today to confirm whether or not trump would appear in court. guess what? 5 pm came and went, and it appears the ex president has chosen not to take the stand, surprise. as far as we can tell, no notice has been filed by trump 's team. and while the jury may not get a chance to see trump questioned in court, they did in fact hear from him last week. jurors got to see videos of trump's october 2020 deposition regarding carroll's allegations. the video, which we should note is edited, runs about an hour in total, during which time the agitated ex president repeatedly denies allegations against him, and rattles off a

barrage of insults at both his accuser and her lawyer. although trump had said he had never met carroll, she isn't his, quote, type, he did inadvertently admit she had a familiar face. here is his reaction when shown a picture of himself, his then wife, ivana trump, carroll, and carroll's then husband, taken a few years before the alleged attack. watch. >> it's marla. >> you are saying marla is in this photo? >> that's marla, yeah. that's my wife. >> which women are you pointing to? >> here. >> the woman you just pointed to is e. jean carroll. and the woman on the right is your then wife, ivana. >> i assume that's john jansen? that's carroll? because it's very blurry. >> now, here is the picture the ex president was actually shown. it doesn't look very blurry to me.

and then there was a separate exchange, a troubling one. trump is asked about the now infamous access hollywood tape, which became public shortly after the 2016 election. he was caught on a hot mic back in 2005 boasting about how he could grope and kiss women without their consent. in his deposition, trump not only confirmed that he made those remarks, but he also doubled down on his apparent entitlement to a woman's body. watch. >> and you say it, again this has become very famous, in this video, i just start kissing them. it's like a magnet. just kiss, i don't even wait. and when you're a star, they let you do it. you can do anything. grab them by the [bleep], you can do anything. that's what you said. >> historically, that's true with stars. >> it's true with stars, they can grab women by the [bleep]? >> well, if you look over the last million years, it's been largely, not always, but

largely true, unfortunately or fortunately. >> you consider yourself to be a star? >> i think you can say that, yeah. >> so much for quote, locker room talk. according to trump, stars like him have every right to a woman's body, as it's merely a fact of evolution, true for the last million years. it's also worth noting the earliest population of modern humans arose just about 200,000 years ago. look, trump's obvious lack of historical knowledge aside for a moment, this video leaves us with some serious, serious questions about a man who is currently the front runner for the republican nomination. i mean, for all of the talk about president biden's so-called mental decline, the gop's standard bearer, he cannot even identify one of his own ex wives. and as for the republican party, a party that's launched an all out assault on the lgbtq+

community, painting them as predators, they seem to have no issue aligning themselves with a man who takes pride in his ability to touch and grope women without their consent. look, in the coming weeks, a jury in manhattan will decide whether or not donald trump is liable for rape. but in the meantime, if there's anything we, the american public, can glean from that deposition, it is this. donald trump is not suitable for office. let's discuss this with msnbc legal analyst lisa rubin, she has been covering this trial and has been in the courtroom all week, and cynthia alksne, msnbc legal analyst and a former federal prosecutor. it is great to have both of you with us. cynthia, let me get your reaction to that. i want to play you another clip from trump's deposition. watch this. >> still don't know this woman. i think she's a whack job. i know nothing about her. i think she's sick, mentally sick. you wouldn't be a choice of

mine either, to be honest, i hope you're not insulted. i hope not under any circumstances have any interest in you. i'm honest when i say it. >> what do you make of that? i mean, based on what you've seen from that tape, those three clips we've played for you, the inability to recognize his ex-wife, the stupidity of the second comment about stars have been doing it for a million years, and then that bit where his defense is you're not my type, and attacking the attorney there. did trump seemingly make the right decision to not take the stand? >> [laughter] yes, that's for sure. but let's remember this. when he takes the stand of that deposition, he's talking to the jury. and what do we know from the first one, not only does he not identify carroll, thinking she's marla maples, when he is confronted with that, and leaving aside his lawyer's improper coaching of him, when

he is confronted with it, and when he is cornered like a rat, what does he do? what does he say? he lies. he says, oh, it's blurry. and here's why that's important. because the jury has the photograph. and they know when he is cornered, he lies. because he lied to them. that's what the deposition is. it's him talking to the jury. and in this case, not only did he not have the guts to come talk to them, he didn't even have the guts to come sit in the courtroom. instead, he sent a bully to cross examine this woman. and on the one occasion he was talking to them and was cornered, he lied to them. and i think it's important, and my guess is, in closing, it is highlighted. >> lisa, take us inside the courtroom the last couple of days. tell us how the jury reacted to that deposition video of trump. >> cynthia can tell me better

than i can that trying to assess how a jury feels about a defendant is a art, not a science, and it's an art in which many of us fail repeatedly. that having been said, you could hear a pin drop during the deposition. and he did not just lie about the photograph being blurry. and by the way, the jury has seen that photograph multiple times throughout the trial. i can even tell you what plaintiff exhibit number it is, 112. but you can hear -- the dangerous libel, that he lied about all sorts of things, big and small, including whether or not he cheated on his first wife, ivana trump, when he was seeing marla maples. he claimed not to know whether those relationships overlapped. he was seen escorting marla maples as early as 1989. he wasn't divorced from ivana trump until 1992. he could not even give robbie kaplan, the lawyer, the dates he was married to marla maples. he just continued a pattern of mendacity all throughout that deposition, that the jury is really going to have to think

about in confronting whether or not this is a person about whom e. jean carroll was telling the truth. >> cynthia, trump initially had an expert, i believe, expert witness, i believe, lined up to try and rebut carroll's claims. that witness was unable to testify because of health issues. since the ex president will likely not appear, exactly, not appear this week, his defense included no witnesses. and that stands in contrast with what we saw from carroll's team, which put forward multiple witnesses, including two women who also alleged trump assaulted them. from a legal perspective, that the lack of witnesses on his side hurt the former president's case? >> of course. and not only do we have the two women who have been assaulted, but we have one woman that e. jean carroll spoke to within minutes of the assault and told her about it. those contemporaneous witnesses, we call them outcry witnesses, that happened at the time of the assault are very important

for us establishing credibility and corroboration. and we also are in a situation where joe tacopina promised there wasn't going to be any corroboration. and what do we know at closing? her lawyer can get up and go, oh no, he said there was not corroboration. but there is. and here's these two witnesses. and by the way, there's also these other cases. and by the way, there's also all this lying. so, yes, the number of witnesses makes a huge difference. remember, this is not a beyond a reasonable doubt criminal case, although i would suggest youth that they have proven this case beyond a reasonable doubt. this is a preponderance of the evidence case. this is really holding out, you know, the scales of justice, and has to just tip ever so much. it's not the 52 yard line, it's not the 95 yard line, it's one inch over the 50 yard line. and unless there is some kind of surprise juror in there, i'd

be very surprised in this case doesn't come back quickly for e. jean carroll. >> lisa, should we, now the 5 pm deadline has come, gone, assumed he has missed it and not will be testifying, so, what are your expectations for closing arguments this week? >> we should definitely assume that he has missed it. judge lou kaplan, who gave trump the opportunity to move to reopen his case once his defense rested, has gone above and beyond to ensure this trial is 100% fair to donald trump, knowing that if there is a verdict for e. jean carroll, that will likely be appealed. so, what he is doing is trying to do everything within his power to ensure a verdict here stands on appeal. in terms of closing arguments, i think cynthia's right. what we will see is a plaintive pointing to all the different ways in which e. jean carroll's testimony was not only credible in and of itself, but bolstered multiple times over by the two people she told in real time, by the other two accusers who

from propublica found that gop mega donor harlan crow was footing the bill for clarence thomas's grandnephew to attend a private boarding school in the foothills of northern georgia. this according to bank statements and other documents obtained by the outlet. thomas did not report the tuition payments potentially worth more than $100 million on his financial disclosures. quote, this is way outside the norm. this is way in excess of anything i've seen. that is according to richard

painter, who was the former chief white house ethics lawyer for george w. bush. he was referring to the cascade of gifts from harlan crow over the years. now, thomas has not addressed the questions about the payments. harlan crow did not dispute the facts of the reporting in a statement, instead fo notion thg been passion about the importance of quality education, and giving back to those less fortunate. and there is your point for the washington post that further complicates matters for justice thomas. quote, no mention of ginni, of course, that's what conservative judicial activists leonard leota gop pollster kellyanne conway after directing her to bill a nonprofit group he advises, and use that money to secretly pay ginni thomas, who is of course the wife of clarence thomas. that is according to documents reviewed by the post. nbc news has not independently verify those documents. but according to the post, conway's firm sent that

nonprofit a 25,000 dollar bill that day. per ellen heard leo's instructions, the bill listed the purpose of the payment as supplement for constitutional polling and opinion consulting. in a statement to the post, leonard leo said that ginni thomas's work had nothing to do with the courts, adding, quote, knowing how disrespectful malicious and gossipy people can be, i am always trying to protect the privacy of justice thomas and ginni. and kellyanne conway only confirmed to fox that ginni thomas was one of her contractors at the time. and as we've reported on the show before, leonard leo is not exactly your average conservative judicial activist. no, he's widely considered as the architect behind the right-wing takeover of the nation's highest court, advising donald trump on his three far-right appointments. we should note that both of these stories came after this senate judiciary committee held

a hearing on ethics in the supreme court this week. >> how low can the court go? the highest court in the land should not have the lowest ethical standards. >> joining me now, alina beverley, the former national deputy director of african american outreach for obama's first presidential campaign, and the host of our mayors podcast, and basil us michael, democratic strategist, former -- democratic party, and director of the public policy program at roosevelt house institute of 1hunter college. it is great to have both of you with us. alina, i will start with you. the post is reporting that leonard leo and ginni thomas, it paints a pretty damning picture. it seems to me that it could be perceived as a bribe. what do you think it is? what do you make of it? >> certainly, it has the appearance of impropriety. it could be allout pay for play. so, the money that he funneled

to ginni thomas, he funneled through a nonprofit organization that actually ended up having matters before the court. they filed an amicus brief in the section five shelby county, the holder case, that actually struck down the heart of the voting rights act, where justice thomas was in the 54 majority in that case, striking down the heart of the voting rights act. so, at the very least, there is the appearance of impropriety. there's possibly a full out conflict of interest, and possibly a straight ride. there seems to be no bottom to the ethical conflicts this court has, and that justice thomas is executing. that's why we absolutely need ethical standards to apply to this court. >> basil, i want to get your thoughts on this propublica reporting about harlan crow paying full tuition for a child in clarence thomas's care. harlan crow basically dismissing the evidence as him simply saying he wants to help people that are less fortunate.

funny enough, there are millions of american kids who could use tuition support. this one just happens to be the one in the care of a powerful supreme court justice. >> yeah, ayman, this is so, this is such an amazing report. because, look, if clarence thomas needed the money and asked for it, or harlan knew he needed it and give it to him anyway, the reality is, as anyone who's grown up the way i grew up, you would imagine that clarence thomas -- is now indebted to this, man because it doesn't seem like this was just a onetime payment, right, he is consistently paying this young man's tuition to school, the courses, potentially for at least four years in school. so, one wonders, as was said earlier, the kind of influence, the potential for undue influence, even borderline bribery, that clarence thomas

accountable for all of these questions? >> i don't think it is essential to justice thomas. look, this court has shown an inability to police itself. the last time they looked at any type of ethical reform is back in 1991 and it is not working. that is why i do think it is within congress's authority and congress should affirmatively act to set ethical guidelines as it pertains to non judicial conduct. efforts to recuse themselves when the justice recuse themselves, what types of disclosures they should have, and what types of interactions they should be able to have with individuals that potentially have matters before the court. they do not dictate what types of decisions the courts should, make but can determine what the ethical context should be for judges. i prefer these judges, these judges should hold themselves to the highest professional

city police were called to lafayette subway station, after receiving reports of a fight on the subway car. when the officers arrived, they found jordan, a 34 year old black man, unconscious, according to one alberta vazquez, and freelance journalist on that subway just a short time earlier, he had boarded that northbound f train and began yelling, quote, i do not have food, i do not have a drink, i am set up. he was homeless and also reportedly screamed, i don't mind going to jail and getting life in prison, i am ready to die. and while vazquez told the new york times that he was fighting, he stressed a 30 year old had not assaulted anyone. but the situation quickly took a turn one another writer grabbed him and placed him in a chokehold. video of that incident, which we have chosen not to play for you tonight, shows a 24-year-old white man who later identified as daniel petty wrapping an arm around nearly's neck after two other passengers help to restrain him.

you saw him trying to break free from the hold, as the minutes ticked by. he visibly weekends, the arm wrapped around his neck, say's firmly in place for almost 15 minutes. even after he stops moving. the man continued to hold him down. vazquez told nbc news that the chokehold lasted for 15 minutes in total. jordan neely was later pronounced dead at a nearby hospital, and on wednesday, the medical examiner ruled neely's death a homicide caused by compression of the neck. plenty, a marine veteran, was taken into custody on monday, questioned by police and later released. he has not been charged with a crime. in a statement, penny's lawyer said their client never intended to harm neely, and was simply acting to protect himself and others until help arrived. the manhattan district attorney's office says they are investigating the incident. and on friday, two sources familiar with the matter told nbc news the d. a. has plans to present the case to a grand jury. now, before his death, jordan neely had a passion for entertaining.

no stranger to the subway, he had spent years as a busker, busting out dance routines as a michael jackson impersonator. but according to his family, he also suffered from severe mental health issues, stemming from the loss of his mother, who was strangled by her boyfriend in 2007 when neely was just 14 years old. nearly told the daily news that he loved his mother so much he lost so much he just wasn't the same anymore. his aunt said he develop depression and later schizophrenia and was finding it difficult to get the help he needed. she told the new york post, quote, the whole system just failed him. he fell through the cracks of the system. and following neely's that, new york city mayor eric adams issued a statement saying, quote, any loss of life is tragic. the mayor then wrote he would not comment any further because, quote, there's a lot we do not know about what happened here. adams made addressing the cities homelessness crisis a key part of his agenda since taking office, sending outreach

workers and stepping up police presence across the subway system. last year, he announced plans to hospitalize more homeless people by involuntarily committing those in a psychiatric crisis. and some advocates have actually disagreed with adam's approach, saying it criminalizes those who live in the streets, many of whom suffer from mental illness. they also say it shapes residents perceptions as people who are homeless as being inherently violent. experts point out that people experiencing homelessness or mental illness are actually at a greater risk of being harmed themselves then of harming others. there's another factor we cannot ignore here. that of course is jordan's race. research has often shown that people show blackmon as more threatening than their counterparts. had neely been a white man suffering on that subway car that afternoon, one can't help but wonder if he would be alive today. look, any new yorker, myself included, can tell you about a

time they may have felt uncomfortable on a subway car. it's part of life in new york city. but in that instance, but most of us do, move to the next car, maybe call for help in the next stop. you do not take it upon yourself to put someone, someone, who by all accounts, did not put his hands on anyone that day, in a deadly chokehold for 15 minutes. because as much as you deserve to get your destination safely, so does everyone else, whether they are homeless or not. jordan neely's was not worthless because he was homeless or mentally ill. jordan neely did not deserve to spend his last moments gasping for air on a subway car floor when he needed food and water. jordan neely deserved help. he deserved compassion. and he, like all of us, deserve to feel safe in his own city. we'll be right back. you can have nice things.
