group of people outside a migrant shelter killing eight. we'll bring you that news conference as soon as it begins. we're learning more about what could be behind the mass shooting at a busy outlet mall on saturday that left eight dead. we'll talk to a dad who was with his teen daughter when the shots rang out. meanwhile, in california, we're live at a migrant camp where hundreds of people from all over the world have come to seek asylum days before the u.s. lifts health restrictions at the border this morning. there is word that the governor of texas is now sending more troops to the border in his state. in new york, protesters stand on subway tracks interrupting service as calls grow for authorities to charge the man who put a fellow subway rider into a deadly chokehold. and we'll break down president biden's new strategy to raise the debt ceiling as he prepares to meet with top congressional leaders tomorrow. and we begin with breaking news out of texas where officials say eight people were killed after an suv plowed into

a crowd just outside a shelter for migrants. later this hour, we're expecting law enforcement officials to deliver their first press conference since the crash, which we will bring you live. videos captured the moments before and after, and i want to warn you some may find what you're about to see very disturbing. now, surveillance footage shows the group of people there, you see them in the top left of your screen, just seconds before the vehicle runs into them at full speed, right after this white one. there you see it. as of this morning, law enforcement officials are still trying to determine whether the driver drove into the crowd intentionally or if it was some sort of tragic accident. joining us from brownsville, texas, is nbc's gabe gutierrez. what do we know about the victims and the person behind the wheel of the car? >> reporter: hi there, jose. good morning. we don't know a whole lot about the victims other than most of them were venezuelan. you see this makeshift memorial

right behind me. people have been coming here and paying their respects. the mayor of brownsville said several of those injured remain in critical condition at the hospital. as you said, jose, eight people killed, at least nine others injured at this point. jose, right behind me across the street is that migrant shelter, and just a short time ago, i went over there and spoke with some of the migrants that were still there. what they told me is they are just devastated. this happened yesterday morning, and police say that driver plowed into that group of people, again, investigators looking into whether this was intentional or accidental. i did speak with one of the migrants. he claims as the driver tried to flee the scene, he made an obscene gesture and yelled antiimmigrant language. it's important to know that authorities have not substantiated those allegations. they're still looking into it. several of the migrants said that the driver appeared intoxicated. again, authorities are looking into that and waiting to see what the result is of toxicology

reports. so far the driver has been arrested and charged with reckless driving, but again, more charges could be pending and we are awaiting potentially new details within the hour as authorities hold that news conference. so again, a makeshift memorial growing here in brownsville, this community stunned, a community as you know, jose that has welcomed migrants for many, many years. and they -- i spoke with some of those migrants, some of them were just stunned that they could go through everything they had gone through to come here from venezuela, some of them went through the dare yan gap, they went through jungles. they survived attempts and assaults through their journey and to arrive here, and for some of them to be killed waiting at the bus stop, it's too much for them to bear. >> and gabe, do we know anything else about the driver there, those reports that you're saying that maybe he hurled some insults, but do we know anything? i mean, were those insults in

spanish? do we know anything about the driver? >> reporter: speaking with the migrants, they describe them as a hispanic male and police have confirmed that. they also say that he's uncooperative at this point, so it took a while to identify him. we still don't know, at least authorities have not identified him publicly. as for what we're hearing here on the scene, you know, they just don't know at this point. he appeared to be a hispanic male, again, unidentified. we stress -- we do not know a motive at this point. some of the witnesses described him as potentially being intoxicated. again, authorities have not confirmed that is what they're looking into, jose. >> gabe gutierrez, i thank you so very much from brownsville, appreciate that. let's turn now to the other mass casualty tragedy in texas. officials are searching for answers this morning after a shooting in allentown just outside dallas that left eight people dead there including a 5-year-old boy.

this shooting is now the second deadliest mass shooting this year. the suspect was killed by a police officer who happened to be nearby on an unrelated call. right now six victims who survived the shooting are still in the hospital, three of which are still in critical condition at this hour. joining us now with more is nbc news correspondent morgan chesky in allen, texas. morgan, good morning, what more are we learning about the victims today? >> reporter: just within the last few hours, we've learned the identities of two of the eight victims killed here at this allen, texas, mall. we'd like to share their names and photos with you. the first has been identified as ashwaria, she was a woman shopping here on saturday afternoon when if gunman opened fire. we're told that her family has plans to send her back to her native country of india. and then we also have 20-year-old christian lecure. we've learned christian was actually working as a security

guard here at this outlet mall saturday, saturday afternoon when he came into contact with that 33-year-old gunman who fatally shot him. we heard from christian's grandmother who said he was just 20 years old, so many goals ahead in his life. he was a beautiful soul and she was so proud of him. in the meantime, this investigation deepens despite authorities not making any public statements about the investigation since saturday evening, the night after this shooting took place. according to two senior law enforcement officials, jose, they're now looking into this crime as a potentially racially or ethnically violent extremism and this is with because the be 33-year-old gunman, mauricio gar sio has been known to interact with neo-nazis or white supremacist content online. that's according to two senior law enforcement officials who shared that with nbc news.

the gunman, of course, jose, was shot and killed by one police officer who happened to be here at the mall on an unrelated matter, whenever he heard the gunshots and immediately engaged the gunman. we're still awaiting to hear any potential motive for this shooting. we do know according to authorities they were able to recover a rifle and a handgun from the 33-year-old, and they found additional ammunition in his vehicle. and there's just chilling video from surveillance, jose, that we've watched that shows the gunman essentially stepping out of his vehicle right in the parking lot and opening fire all within just a few seconds giving the hundreds, if not thousands of people here little to no warning as to what was about to take place. as you can see behind me, there is a growing memorial for these eight lives lost, hundreds packed a local church last night to pay their respects. we know that seven are in nearby hospitals and three of those

victims are currently listed in critical condition. jose. >> morgan chesky in allen, texas, thank you very much. and for more on this i want to bring in eyewitness jeffrey keaton. he was at the mall with his daughter during the horrific shooting. jeffrey, i thank you very much for being with us this morning. my first question is how is your daughter? how are you doing today? >> we're extremely grateful to still be here, to have seen and just -- we're just grateful to be here, very. >> so jeffrey, take us back to that day, the moments of the shooting. what did you witness? >> what i witnessed was, as me and my daughter dined, we were

just out having a meal before we went to go see family, and out of nowhere we just started seeing chaos outside, and then the chaos got closer. you could hear the shots get closer and louder, so i had my daughter duck under the metal counter, and then the manager of the restaurant told everybody to come into the back, so as we went into the back, you could still just hear the shots and then we tried to rush out through another building going out to the car, and that's where we saw police and you just you say melee and mayhem out there. it was a difficult thing. >> yeah, how do you -- you know,

what do you tell your daughter now? >> of course you want to tell your child to be vigilant and -- but there's really nothing i can explain to her about somebody having no regards for human life to just do what has been done, and it's -- i tell her to keep her faith and to know that there is love in this world, you know. there are good people that want to care, and that small minority of people that don't care about anybody and anybody's lives, that's a very small fragment of this world, but i feel like if we all just stay together as a

people, i mean, we'll get through it. we shall. >> geoffrey, you through -- very close to you you actually witnessed evil face-to-face, it was very close to you. how do you process that, geoffrey, and how do you process what no doubt your daughter is going to have to be going through going forward? >> i mean, it is hard to digest, and it's difficult mentally to get those thoughts out of my mind. it's hard to close my eyes right now because i just keep seeing it, and you see the victims, you see the shooter. i see the upstanding police officers that came to make sure that the situation was taken care of. it's all -- it's all still there

and it's -- it becomes hard to digest at times, but i found that by speaking on it and just trying to stay positive and let the world know that it's -- there is -- there is a greater cause, it helps me to try to get through it, but i am going to talk to somebody, some crisis counselors and everything because it is -- it is difficult. >> sure. >> for myself. >> let us know, geoffrey how you're doing, how your daughter's doing, my apologies for interrupting. keep us abreast of how you're doing. we're thinking of you, we're thinking of everybody who, you know, lost a family member there, eight people, eight lives taken. i thank you for being with us

the equipment and tools that will be needed for them to be effective. it includes aircraft, it includes boats on the water, night vision as well as riot gear to prepare for anything they may encounter, as they are protecting and securing our border. >> texas is not the only place where this humanitarian crisis is playing out. more migrants are also trying to cross the border into california as well. nbc's guad venegas joins us now from san diego. good morning. what have you been seeing there? and you know, the governor talks about the tactical gear and riot gear. we have to kind of put a perspective on this. the people that are coming across are men, women, and children. and they have the dream of being able to ask for asylum legally. that hasn't been available for people. what are you saying? >> reporter: jose, well, here between san diego and tijuana,

we have a very particular infrastructure because there's two border walls or barriers, this is the first one, and for the first time ever, jose, we've seen people that are camping out in between the two border barriers. if you look up on top of the hill, the first wall essentially that's the end of san diego and the beginning of tijuana, mexico, a lot of the migrants went over that wall. they tell me there's also someplace down the road where they can actually go under the wall, and then they came to this area to turn themselves in to border patrol and seek asylum. now, border patrol told me yesterday that their facilities, the stations, and the processing centers are at capacity, so they can only take a few of these migrants at a time. we saw them yesterday morning and they took a few. we've seen ambulances come in and help some of these migrants. some of the people here have babies. some of them have young girls and boys. and they're from all over the

world, jose. when you look at what's happening in texas, we do have a large group of people coming from south america. here in tijuana particularly, i spoke to people from jamaica, people from africa. there's some europeans, people from turkey also from south america. i'm going to play part of a conversation that i had yesterday with a couple that had a 10-month-old baby. [ speaking non-english ] >> reporter: and jose, a lot of these migrants arrived thinking they'd be process right after arriving, but again, because of facilities are full, this is what i was told by the border

patrol officers, they have to stay here 24 or 48 hours. some of them are holding their cell phones because they're stuck there, right? they can't go anywhere, and what they do is they hold out their phone and humanitarian groups and we've helped them as well. we help charge their phones. that's the only way they can communicate with the world. at some point there's groups who have arrived to bring water and food. there's one bathroom that has been provided for them, and that's really all they have. you can see some of the makeshift camps that they've created using whatever they have available to them, but they're just waiting to be picked up and be processed. again, these are individuals that have arrived attempting to seek asylum in the u.s. as you mentioned earlier, jose. >> guad venegas in san diego, thank you very much. with us now from el paso, texas, to talk more about the humanitarian crisis there is john martin, director of the opportunity center for the homeless, sheltering migrants. good to see you. i just want to pick your brain on what's the reality for you on

the ground there? >> well, the reality is that we're overwhelmed. we've got several partners within the community. all of the emergency shelters are operating at or over capacity, and to give you an example of our situation with the opportunity center for the homeless, we've got 200 inside the shelter, and we've had up to 810 outside the shelter camped had in the alley. so it truly is a humanitarian crisis. >> and this is before title 42's lifted on thursday night at midnight. what are you expecting come friday? >> well, you're absolutely correct. this all started for us a little over a week and a half ago when we saw the influx come in and that it's exponentially increased, and it is prior the lifting of title 42, and we are expecting the worst. we are hearing numbers anywhere from 500 to a thousand to 1,500, and it just depends upon the

source that you're talking to. the difficulty that we have is that we've got a mix of individuals and/or families as it relates to the processing, some of which have gone through it, many of which have not, and they've been relying on either the cpp 1 app or they've been trying to file their applications online. host recently we found that you're not able to travel if you go through the online process or also what's referred to as the pro se. so again, that means they're staying in el paso. >> so john, i mean, i was actually in one of your shelters back in september speaking to folks there, how have thing changed since september to now at the different centers that you're in charge of? >> in all honesty, even at the height of what we saw at the latter part of 2022, we've never seen the situation as critical as what you've got here.

i do recall the day you gotdown here. we call it the welcome center that has been impacted. that particular facility still focuses on families whereas our single men and our single women's facility was located on merle, which is where we had the encampment behind us of up to 800 individuals. >> john martin, i thank you very much. it was -- having the opportunity to visit there in september and the shelter, it was a place where you could sense so much peace and, you know, it's just your words today, i mean, you've never seen it like this before. >> no, we haven't. the way that i approached this, this is a national issue and we happened to be on the front doorstep along with multiple border communities, but we do need to address the issue nationally. >> i thank you so very much, john, for being with us. really appreciate your time. >> thank you. >> coming up, more protests are expected today surrounding the chokehold death of homeless subway rider in new york city. what the manhattan d.a. is

24-year-old marine vet daniel penny has not been criminally charged, but the manhattan d.a. is expected to present evidence before a grand jury, according to two sources familiar with this. the law firm representing penny released a statement reading in part, quote, when mr. neely began aggressively threatening daniel penny and the other passengers, daniel with the help of others acted to protect themselves until help arrived. daniel never intended to harm mr. neely and could not have foreseen his untimely death. the family joining us this morning, george solis. what more can you tell us about this d.a. investigation? >> we're still waiting on the impact time line on when this case could go before a grand jury. we do know the d.a.'s office has assigned a senior prosecutor to this case, and they're going to be looking at a wide berth of evidence, including that medical

examiner's report that does indicate that jordan neely died from that chokehold. there's also 911 calls. we believe there's about five of them, and then of course that video that went viral that shows that 24-year-old marine veteran putting jordan neely into that chokehold. of course as you mentioned over the weekend and throughout the week there were a number of protests, the most visual and large that we saw was the one that took place on saturday which included that clash with police there. that result led to about 13 arrest, we're told, that's according to the nypd. you mentioned both sides issuing statements, the attorneys for jordan neely going on the air over the weekend as well expressing their frustration that charges were not immediately filed in this case. i want you to take a listen to what they said. >> even to say who he was as a person and what his history is, it had nothing to do with this incident so what we're asking is

that deadly incident in which someone driving an suv literally plowed into a group of people just outside a migrant shelter. eight people lost their lives. >> really appreciate you all's presence. and i am here as chief of police, felix f-e-l-i-x, brownsville, texas, and i am here to deliver a brief on the tragic event that took place within our city yesterday. since the investigation is ongoing, our objective is to provide you with a better understanding about what occurred as we currently understand it. yesterday morning at 8:29 a.m., we received multiple calls for service in regards to a major crash on the 600 block of minnesota road. upon arrival, officers found multiple casualties and several injured. officers also found a gray suv with heavy damage and a driver on scene. through the investigation it was

found that the suv ran a red light, lost control, flipped on its side and struck a total of 18 individuals. it was further found that there were six fatalities on scene and 12 critically injured. from then to now fatalities have grown to eight. the investigation also revealed that the driver of the vehicle later identified as george alvarez november 9th, 1988, had attempted to flee the scene after impact but was held down by several individuals on scene. the investigation also revealed that the driver of the vehicle -- i'm sorry, george alvarez is a brownsville local with an extensive rap sheet. he has been formally charged and arraigned with eight counts of manslaughter, ten counts of aggravated assault with a deadly weapon. he has received bonds totaling $3.6 million, and we have his picture on record of various

gutierrez who's been with us from brownsville, and gabe, you know, not a lot of information, but -- and i'm seeing that location where this incident occurred has now become kind of a place where people are coming to pray and to support those folks, the eight people who lost their lives and some who were also in critical at this hour. gabe, what were your impressions of this information we just heard? >> that's right, jose. i want to give you a sense of the scene right here really quickly. gary, if you can show what's going on right here. there is a group that has gotten here to the scene. this is the scene where those eight people were standing when the suv crashed into the bus stop, and now there is this group paying their respects, and jose, my impressions about this news conference, we did get some new information about the suspect here. we know that jorge alvarez now

according to police has an exe tensive history, assault with a deadly weapon, assault causing bodily injury to a family member and theft of property and many more. he now has been charged with eight counts of manslaughter. he's being held on $3.6 million bond. there's still several unanswered questions at this point. authorities were asked whether this was an intentional act. they say it is part of an ongoing investigation. we had spoken with migrants earlier today. one of them specifically who says firsthand that as the suspect was leaving the scene that he had an obscene gesture, and that he yelled anti-immigrant rhetoric to these migrants. again, that has been unsubstantiated by police, but they call this an ongoing investigation. he is under arrest. the suspect name jorge alvarez with an extensive criminal

history and is now facing eight counts of manslaughter. the latest we heard from the mayor is several of those who were injured remain in critical condition here, and of course this community is just stunned that this has happened and right across the street from a migrant shelter that has seen an influx of venezuelan migrants over the last few weeks. >> i know you picked this up as well, even though it was a question and answer in spanish, but we translated it here, but one of the questions was is he cooperating, and it seemed like the head of police said no, he's not cooperating as of right now. >> and you know, that tracks with what we were hearing yesterday. the police said that he was not cooperating. it took some time to identify him indeed. now that news is that he has been publicly identified, and his history has been laid out. still jose, there's a lot of unanswered questions here in terms of was this intentional, was it not. was he drunk, was he not. that question did also come up

in the news conference. the authorities came back and said they were waiting on toxicology reports. from speaking with the one firsthand witness on the scene and several others that were in the vicinity that were bystanders, they said that the suspect did appear to be intoxicated while the tragedy unfolded yesterday. again, authorities say they're waiting for toxicology reports to confirm that. but this scene, of course, you know, it's devastating for those in this community as you can hear behind me the prayer ongoing, an impromptu vigil, a makeshift memorial that has grown in the last few hours in front of this migrant shelter, jose. >> and gabe, there was one line that he said, we haven't ruled out whether it was on purpose or not, but they started by saying that he ran a red light, lost control, and then hit the people. that would be, you know, just -- anyway, gabe gutierrez, i thank you very much for bringing us the very latest.

default. tomorrow afternoon, president biden will meet with the four most powerful lawmakers from both chambers, chuck schumer, hakeem jeffries, kevin mccarthy and mitch mcconnell. the president is also vowing to take the vote to republicans with critical fighting to raise the debt ceiling. joining us mike memoli, and brendan buck to former house speaker paul ryan and served as press secretary to john boehner. he's an msnbc analyst. mike, what should we expect this week? >> well, really, whether there's a breakthrough if in the debt ceiling standoff. the stakes couldn't be higher for the economy. president biden suggesting in that interview with stephanie ruhle which he thinks congress needs to do its job without strings attached. that's been the position of the

white house throughout. we know they're hoping to get a short-term decision nation to align with political battles in the fall. the political strategy, when you look at what the president is doing on wednesday, the day after the meeting. he's leaving washington for the first time since he announced he would seek a second term, going to the battleground district won by a republican in the midterm elections but in a seat that biden carried in the 2020 elections to really use congressional republicans as sort of his foil, arguing about the debt ceiling, saying the bill they passed recently would include draconian cuts for things like veterans benefits. there's a center near the district. there are 18 districts, jose, carried by republicans last november but that were also carried by president biden in 2020. that's the definition of a swing district. and the hope for the white house here is that these moderate republicans, these districts where they might have a tough race in 2024, they'll be pressuring mccarthy to find more

compromise here. we've seen the republican position, though, pretty hard -- and obviously, speaker mccarthy, as the president alluded to in that interview as well, has his own concerns what might happen if he breaks from their position. and brendon has a lot of thoughts on i think on this, being through the spending battles in the obama administration whether or not we might see moderates as sort of a path to a deal here. >> yeah, brendon, how unusual is it for this to happen? >> yeah, curious strategy here. look, the people that he's targeting are the ones most reliably have to be there on a final deal. if their plan is to beat the moderates into submission on the limit, that's a concerning sign because that's not going to happen. kevin mccarthy is not going to throw it on the floor and harden their position to what the president is calling for. so i hope they thought this

through pretty clearly. look, maybe this is just posturing. we don't have a lot of time left for posturing. we might have a little time left for posturing. but if they can get this out of their position, tomorrow, we need to, not necessarily a deal, but we need some type of agreement where we keep talking and we have to get together and work something out. because we're just going through partisan warfare right now. that's fine, people will score political points but there's not an easy off-ramp, even a short-term one. >> yeah, i'm just wondering, time is ticking, we're talking about a couple weeks is all that's left, brendan, so far, there has been no talk, there hasn't even been any talk to talk, except for this meeting right now. i'll just wondering how do you see this ending? >> look. there is still time to get a deal. i was closely involved in the

2011 debt deal that was very kay yacht and it wasn't until the last week. i don't think kevin mccarthy is asking for anything outrageous. obviously, they passed that big bill, that's not part of the negotiations. he's looking for a couple years of spending cuts which you need anyway and a few other things like permitting reform. i think that's a good place to end. i actually think there's political incentive for joe biden to do a deal with republicans going into a general election saying, look, i worked with republicans to limit spending. the deal is there to get something done. but it requires people to walk back their position and walk back their rhetoric which happens a lot in politics. they just have to have the willingness to do that because the consequences if they don't are pretty significant. >> and mike, it's simple, the white house seems to think they have the upper hand on this specific issue? >> yeah, especially the way

they're targeting republicans based on that vote, the limit say grow act, that would call for across-the-board spending reductions on some. republicans are arguing they didn't identify which programs would get cut by how much. but the white house is saying, exactly, we'll fill in the blanks for you. that's why they're working with democratic allies, interest groups as well to put these out in districts. but political strategy aside, brendan is right, asking what is the way to get to a deal? and one of the unilateral options, even biden is saying he's not there yet. >> mike memoli and brendan buck, thank you for being here. now, to cuba in what may have been the first anti-government protest of the year. it happens in the town of caimanera. an independent journalist told nbc news that hundreds of people participated in the protest.
