julia? where do negotiations stand right now? >> you heard speaker mccarthy. he was very confident, and what a difference a week makes, right? yasmin, when i was talking to you last weekend, he sounded so far from a deal. he said they were not close at all today, after several long nights, including last night, they went into the wee hours of the early morning. they're feeling very hopeful a deal could come together, and it sort of have to. if speaker mccarthy wants the house to take this up on tuesday, as he told reporters this morning. that would be the earliest time the house would vote on it, and if this happens, that means a deal needs to be solidified today. that bill text needs to be available for members because remember, that's one of the concessions mccarthy gave his members, that 72-hour rule to read the bill certainly applies. you will notice the capital is empty of members, but certainly, not of tourists behind the enjoyment this memorial day weekend. but members are back in their districts, and they're going to need some time to get back here as well. so, mccarthy told us they are getting really close. you heard from the white house there. close, but no deal yet. we are all camping outside his

political shakeup happening right now in texas. pretty shocking, to say the least. impeachment proceedings are underway for ken paxton, the republican attorney general of the state since 2015. in a highly unusual move, a republican-led committee unanimously voted this week to recommend paxton's impeachment. in the state house, following a monthlong investigation into his behavior. let's bring in priscilla thompson, on the ground for us. she is in austin. what is happening as of now, knowing the vote will be happening today? >> yeah, yasmin. that vote and that debate, really, it's expected to get underway any moment now. we are expecting, i am told, from a number of sources, at least four hours of fiery debate over these 20 articles of impeachment that have been adopted against the republican attorney general, ken paxton. these are allegations of bribery that he is unfit for office. that he abused public trust,
11:07 am
obstructed justice, and many today, and ken paxton hastha called on his supporters to show up here at the capital and to voice their opposition and their support of him, and we have seen dozens of folks who are lined up, waiting to get in, and they are now in the gallery preparing to listen to all of this play out. and it does appear to be causing a fracture in the republican party, with obviously, this republican-led committee voting unanimously to adopt these articles of impeachment. this is a republican-controlled legislations, but at the same time, you see the texas gop, the statewide party, backing ken paxton, senator ted cruz tweeting earlier today, calling this a travesty. so, it remains to be seen how all this is going to play out. i will tell you, we spoke to paxton's supporters here, who are calling this a witch hunt, saying it is politically motivated and what we do now is if the house ultimately voted to impeach today, paxton would be suspended from office
11:08 am
immediately. pending a trial in the senate. yasmin? >> give us the background here, right? let's remind folks what happens with this investigation that led to this point we are at? >> yeah, so, ken paxton has been under investigation since his first term as attorney general. he is now in his third term as attorney general, but the reason this is coming up now is because of a wrongful termination lawsuit that his office settled. it has to deal with several high-level staffers that reported inappropriate behavior, misconduct to authorities, and were subsequently fired. so, in february, paxson's office settled that for three point $3 million, but that settlement would need to be paid out with the state tax dollars. so, this is how all of this came before the texas house, and investigators earlier this week gave hours long testimony,
11:09 am
legging out years of a pattern of misconduct. much of this centering on a political donor of ken paxton's that paxton basically used his office to help that donor, who was under investigation by the fbi, and also facing a lawsuit. that is according to what house investigators have found. now, ken paxton did speak out about this on camera yesterday, a very fiery message to lawmakers here. take a listen to some of what he had to say. >> by proceeding with this illegal impeachment scheme to overturn a decision, made by texas voters, just a few short months ago, the corrupt politicians of the texas house are demonstrating that blind loyalty to speaker dan phelan is more important than upholding their oath of office. they are determined to ignore the law. they have denied me the opportunity to present the evidence that contradicts are politically motivated narrative,
11:10 am
and they are showcasing their absolute contempt for the electoral process. >> and paxton has denied any wrongdoing. he says if the house wants to impeach, he expects there will be a speedy resolution in the senate. he expects that process will be quote, fair and just. yasmin? >> all right, we are going to continue to monitor this situation as well as it develops. priscilla thompson, thank you for that. we are back in just 60 seconds, folks, with new information on the evidence just submitted by manhattan prosecutors in the criminal case against former president donald trump, including a mysterious tape that trump himself apparently stars in. we'll be right back. right back. ♪ music (“i swear”) plays ♪ jaycee tried gain flings for the first time the other day... and forgot where she was. trump. first, we have prosecutors in his new york hush money case. they've informed his attorneys. they now have an audio recording of him and an unnamed witness as part of their evidence. manhattan d.a. alvin bragg's office, new disclosure in a filing later this week. that is coming as the washington post in the new york times poll report that employees of former president trump may have helped move some boxes of papers a day before fbi agents went to mar-a-lago last june. timing that investigators view as suspicious, and possible obstruction as well. we'll get into this with msnbc legal analyst, catherine grisham. thank you for joining us on this saturday. we appreciate you. let's talk first about this audio recording revealed by the manhattan d.a.'s office. we knew right that an audio recording was submitted and revealed by his former attorney, michael cohen, his former fixer, michael cohen. it was between michael cohen and the former president about these hush money payments, right? we don't necessarily know if
11:13 am
that is the same recording that is being referred to in this latest filing by the manhattan d.a.. what do you make of this evidence? what does it mean overall? >> as you said, we don't know that it is. it probably is. this was revealed by mr. cohen, by his attorney, a while ago. and if it is the recording, a recording that took place right before the election in 2016. mr. cohen secretly recorded a conversation with mr. trump about making payments to miss mcdougal. also known as the former playboy model. and how he would pay her off to not reveal what they had in the fair. so, that, we assume, is the audio that was provided to the offense, which they would have already known about because many of us who have been following this case had not known about. that was required for the prosecutor of the new york state law to disclose that. they also disclosed a number of
11:14 am
other recordings that do not involve mr. trump being recorded, but other witnesses or other and identify people. and they also have to disclose that under the law in new york state. you have to disclose everything to the events that relate to the subject matter of the case against the defendant. they require you to do that. especially if they intend to try to get that into trial. i think it's safe to assume that this is the tape that mr. cohen had already released. that defense, of course, will argue because it is my understanding that this does not include the entire conversation that they had that day. they will argue that, of course, pieces are missing are the ones that go to the innocence of their client, but we'll hear that trial. i think this is probably the michael cohen take. >> so, i want to pin from that if we can, over to mar-a-lago and some of the reports are coming out of the washington post in the new york times of that. kind of twofold here, right? what we've been talking about

over the last two days, which is this revelation from the reporting that there were trump employees actually moving boxes a day before the fbi showed up at mar-a-lago. the significance of that. i want to read a little bit more of this recording we have of this as well. trump and aphasia legibly carried out the quote unquote dress rehearsal for moving sensitive papers even before the may 2022 subpoena. prosecutors, addition, have gathered evidence that trump kept classified documents in his office in a place that were visible and sometimes showed them to others, according to these people. what do you make of this reporting from the washington post? that's this really speak to the former presidents knowledge of the fact that he should not have had these classified documents in his possession? and really, kind of overall, intent? >> without a doubt. this is what you call a smoking gun. this evidence, if it's true, the subpoena was issued and
11:16 am
allegedly, boxes removed. so, the way it works is if a prosecutor serves a subpoena on you for documents, and it's called subpoena to just veedum. if you don't to comply, you kyra lawyer. that goes to court, and the lawyer will move to squash the subpoena. if you're way of dealing with a subpoena is to destroy, to change, or to hide the documents, that is a crime. so, yes, it goes to the knowledge. so, if these boxes were move, that recording says they were moved, after subpoena, then it could possibly be a crime. they're hiding evidence that could be used in an official proceedings, these alleged classified documents. that is of traction. yes, it goes to mr. trump's intent. if it was before of subpoena, you could always argue, you know, i didn't know. i thought i could keep them. once you were put on notice, we want these documents, this is a grand jury subpoena, and then you evade that subpoena, you hide the documents, that could be considered a crime.
