donald trump hates the campaign trail just days before his historic arraignment on federal charges. and vows that he will keep running even if he is convicted. we are breaking down everything we need to know before tuesday's unprecedented hearing at federal court right here in miami, florida. standing by their, man some of trump's 2024 challengers are coming to his defense, but for how long? rick wilson, of the lincoln project, joins me live to talk about the pressure on trump to stay on top. and, later a sop in the face. not 11 families fuming after the pga strikes a deal with a saudi-backed liv golf. a woman who lost her husband on the tragic day joins us to talk about this there are new partnership which could also end up benefiting donald trump. all of that and more is coming up. and the good sunday morning to

you, i'm katie phang. we begin today's show with a look ahead to the historic arraignment. it just today, former president donald trump is expected to surrender to miami authorities. it will be his second arraignment after federal charges were filed over his mishandling of classified documents. on friday, the department of justice on the seal to the 49-page indictment revealing that trump is facing 31 felony counts of willful retention of national defense information, under the espionage app act. charges include making false, statements a conspiracy to obstruct justice, and withholding in concealing records. ahead of tuesday's arraignment, trump made his first public response to the indictment while on the campaign trail in north carolina. and in georgia. >> the ridiculous and baseless indictments of me by the biden administration's weaponized departments of injustice will go down as among the most horrific abuses of power in the history of our country.

>> nbc's garrett hague is here in miami and actually joins me now. gary, good morning, it is good to see you. you are on that campaign trail with donald trump yesterday and had the chance to speak to former president trump. what was his message to you and his messaging to voters? >> well, katie, it is pretty clear it is going to be almost impossible to separate mr. trump's legal defense from his efforts to go on offense politically. he has made this idea of what the weaponization of the federal governments an internal part of his campaign. and it is what is left of his legal team and part of their strategy. going into this arraignment and going into this case. to argue that all this is political. they've heard some of what he told, basically a crowd of activists on the road in georgia, about this case. and the first time yesterday afternoon. but i had the chance to throw in a question yesterday. i tried to pin him down on this idea of voting, one thing that was not answered in the indictment itself. why do they want to keep these documents and why keep them so

long? here's what he told me. >> how did you keep those documents? >> we did nothing wrong. nothing wrong whatsoever. we did absolutely nothing wrong, take a look at the presidential records act. we dates by the book perfectly. we have thugs in creeps running this country and it is a real problem for our country. we are gonna win the election big and we are gonna clean up the mess and we are gonna clean up the cancer. that's what we have. >> so, katie, here are the more personalized attacks against prosecutors. that's nothing new for mr. trump we saw with robert mueller and jim comey. that goes back years. his answer on the presidential records act does deserve its fact-check. the national archives has a great one hours online. which people can go reference for themselves. it is very much clear that mr. trump did not do things by the book when leaving the white house for the first things the presidential records act says is that you have got to separate your papers from a personal and presidential.

before you leave the white house. there is no provision in the air to take things home. and do your homework later, so to speak. i think you heard one thing there for mr. trump that i know you're gonna touch along with some of these other candidates. if he wins, he wants to clean at the justice department talk to law them. that has become an applause line, not just for him but for other republican candidates. who have so far embraced to the front runner rather than trying to use this moment to create space for him within the republican primary. katie. >>, yeah. garrett may be the need to do a factor that goes along with these campaign trails. garrett, hey thank you for getting the show started this morning. i appreciate you. >> and joining me now on to face lowman, for the southern district of florida, it is a new partner or stubhub sir insulin, jeff and so get to. so you are the u.s. attorney for the southern district of florida. for a while. and i want to get to the nuts and bolts of tuesday. there are a lot of misconceptions out there and i

want to put them to rest. so tuesday is an arraignment for donald trump and number one people want to know, is there going to be a mugshot, yes or no? >> yes. >> will the mugshot be publicly available? >> i don't think so. >> will donald trump be handcuffed? i'll give you a spot, here he still has his united states service detail. >> i don't know the answer to that question but i know that for regular people, when you voluntarily surrender, be it about eight or nine in the morning, an agent who is in charge of the case takes the defendant into costa early pretrial services department does a full and complete history of the defendants. or the three pm arraignment and initial appearance. and during that, period the defendant sits in a jail cell for the four or five hours, awaiting the appearance. i don't know whether the same is going to be true for mr., trump but for regular people that is the way it works.

>> and yet nobody is above the law. and should be treated the same. and you, endo they're not gonna put a secret service detail into a jail cell with donald. trump as he is waiting those hours for the, arraignments will he be -- my understanding for speaking off the record with d.h.a., joins there's not gonna be anyone else in this courthouse for obvious conservative reasons. he's the president of the united states. he will show up in front of this judge. and during this arrangement, the charges will not be or the lads of him. >> if he proceeds through an arraignment, because this is an initial appearance, he can either postpone the arraignment or have the arraignment writes that in there. he can wave the reading of the indictment. i anticipate that's what will happen. and then the body will be settled. i'm sure there is a prearranged bond. , usually for most, people there are restrictions. i don't know whether or not those restrictions will apply to mr. trump. >> stop for a second. pray arrangements could be made. could we reasonably anticipate that the federal government has made arrangements with council for donald trump? in terms of surrendering a

passport, whether another chance to be some type of monetary bond post by mr. trump? things like that? >> yeah. i doubt the would be a monetary bond, but he would have to post. a pure there's a personal assured you bond. and, i don't know whether they will have waved the regular restrictions to travel within the southern district of florida. i doubt they're gonna restrict his travel to the southern district of florida. so i'm sure that's all going to be prearranged with council. >> okay. the judges presiding over the arraignment is really only a ministerial function, right? it's own leaders could say i'm rejecting this arrangement that you've made with doj, donald trump, when i'm actually going to make you post a monetary bond. that's not gonna happen on tuesday. >> that will not happen. >> my colleague just heard at the beginning, he had a really good point. he asked donald trump for. motive why did he keep these documents? and this indictment has 31

coats of willful retention of india. national defense information. how often do you see these types of cases prosecuted? even in your tenure at the u.s. attorney's office? >> the southern district of florida, i don't think we had very many with a couple of material support cases over the years. but usually that was done out of d.c.. but this in the southern district of florida is used to high terrorism and it's security cases. so, whether we're doing goopy with local prosecutors or the national security sector i say this as -- it was passed for this case. this will all be done through the u.s. attorney's office in the southern district of florida, primarily responsibilities national security center. >> i get a little bit ahead of myself because one of the questions we are trying to get an answer to him that i am also theorizing is going to be sooner than other people are expecting is a trial date. will a trial date be set at the

arraignment on tuesday? do you think it's going to be a possibility? >> i. don't i think the trial judge if it is judge cannon will come and be on tuesday, if he perceives through an arraignment there will be a discovery order entered. and that will for donald trump's lawyers to file motions and receive discovery within a prescribed period of time. then, it's some period of maybe a month or so, a trial judge will say the trial data will probably be an artificial trial dates. at least the first time. up then the second trial date will probably be the trial data that is going to be imposed. >> even if it is artificial, should we anticipate seeing this case of trial in 2023? or in 2024? >> good question. i don't know whether or not the discovery of the case is going to require donald trump's lawyers to undergo security clearances. because there is top secret information.

there is classified information, protection act requirements that have statutes in place. that allowed donald trump's lawyers to be able to see national security, or theoretically we exposed to not security information. there is ways to get around that so that it is not disseminated to council on the case. >> i unfortunately amount of time. but i do want you to come back very soon because i do want to get into the substance of this indictments and post the arraignment on tuesday which i'm really grateful draft that you came today. there are a lot of pundits out there including me who talk about these cases but don't actually talk about the nitty-gritty nuts and bolts. i think it is important for the viewers in the public to understand initial expectation so i appreciate just lowman, former u.s. attorney of the senators are to for a florida. thanks for being here. coming up, -- monika mattis will take a

devil, a plot to save america from trump. and democrats from themselves. rick, good morning. according to politico, trump announcing that he will keep running even if he is convicted. i have this image of him in handcuffs and the ball and chain running down the street. let's start with the big question. how delusional is donald trump to think that he could literally run for the oval office as a convicted felon? >> he could. there is nothing in the constitution that says he can't iran. maybe the 14th amendment said that. but this is a guy who has a group of people in the republican party, you see it from every other candidates running in the primary. you see it from the media apparatus. they have convinced themselves that these serious dangerous and real consequential charges from trump's terrible behavior of exposing national security secrets in clear violation of the law will convince themselves does not trump but a conspiracy against him and so

he could run, i think, even as a convicted felon. i don't know how quickly this will go to trial, i don't know that to doj will have the stones to stay in this fight, as the election gets closer, but you have got a guy who has got a powerful delusional shield around him. that is spread not only by trump himself but by the republican base in republican media apparatus in of course even the other republican candidates who claim they want to replace him. >> so, where. nick let's talk about how sycophants can actually become violence. the new york times has an article with the headline, quote, trump supporters violent rhetoric in the defense disturbs experts. the piece goes on to, say experts on political violence warned the tax against people or an institution when elected officials are prominent media figures are able to offer violence with impunity. how realistic are concerns that trump and his followers could incite more violence as his indictments continue to rise in

number and his prison exposure grows? >>, katy it is enormously significance. look, we ended up in january six of 2021 with a mob destroying the capitol. trying to kill people. we ended up with a mob at donald trump's direct order. trying to overthrow an election. you have got play higgins, you've got kari lake. you've got all these other folks who are now saying the quiet part out loud. but if you try to hold trump to stand of accountability and justice we will kill you. that's what they are saying. we should take it seriously. the department doses should take it seriously. law enforcement should take it seriously. these are people who are not doing it rhetorically, they're not doing it with a -- there are no saying things, like we are gonna storm the battlements and you will rational trump. are you conduct on, the trump there will be violence. take the promise. seriously we are in the late stage american democracy right now. and there is an authoritarian movement and understands the

force of action through -- willing to, use and they believe it is politically consequential for them. and that there will not be repercussions in the political space. >> but, rick let's talk about the realities and the deterrent effect of people like the oath keepers and the proud boys, doing a time in serious prison time for their involvement on january 6th. you don't think that sends a clear message to those that want to follow the call for violence that comes from people like donald trump? that there is some very real jail consequences when they take up arms? >> what the folks like lauren boebert and kari lake and clay higgins and the rest have not seen yet of the january six convictions, is any one of the ringleaders status. maybe stewart's friends in that category. they have not seen footsoldiers going to jail. they're more than willing to have lower tier people engage

in stochastic violence against the country, to protect donald trump. any number of foot under the wheels in order to achieve their political -- because people like josh hawley, again, clay higgins, hansen and nudging and nodding in winking a violent action to protect donald trump. and they know so, far roger stone is in jail. steve bannon is in jail. alex jones is not in jail. they wesley will that are where in the war room they are not in jail. so, those people at the top feel like they are protected and immune. they are also gambling. i think it is not the worst gamble in the world. but if they get donald trump elected again, all will be forgiven and everyone will be pardoned and everyone will go on their merry way. if donald trump is elected again, every january six person, i promise, you will be out of jail in. it will free them all. >>, right lick, the lincoln project has a new adult. let's take a quick listen. >> what will trump get?

when the court was found in favor of black americans. in a five for, ruling the justices rejected a republican -led efforts to weaken a landmark voting rights law. alabama had been try to implement congressional apps, it's such a way that could've taken representation away from that americans. not only was the ruling itself a shock, but the three liberals in the bench were joined by not only to chief justice correspondent, who can sometimes book his conservative, colleagues but i don't if you're sitting down, here justice brett kavanaugh, he usually is far more loyal the to hard-line conservatism. joining me now for, more is -- dolly correspond with his light and the author of lady justice, woman is a lot in the battle to save america. dahlia, my friend, so good to have you back on the show. please explain to our viewers why this ruling is so surprising. >> i think it is surprising, katie, because last term we got

used to the feeling of, you lose and then you wake up in the new. lose then you lose again. and the next, day you. lose this term has kind of been like that so far. it will probably be like that, going through the next two weeks. this was a win and i think maybe were surprised because it seemed as though the court has become so partisan with the supermajority. and unwilling to try to mitigate the appearance of being partisan. that you get an opinion that is legitimately a win, it is a win for section two of the voting rights act, it is a win for voters around the country, it's just feels like oh they stop hitting me in the math for minutes. so i think that in some sense, this reminds us of what the court when john roberts was really in charge, looked like. which was a much more moderates and careful set of decisions, even if it was fundamentally very conservative. as opposed to the kind of

shopping spree that we saw last time. >> dahlia, are there gonna be national effects to this decision? louisiana, for example. it has a similar proposed congressional map that way to dilute black voting rights in the eight states. but considering this recent ruling from, scotus do you think exactly gonna give pause to some of the republican efforts in red states to attack voting rights? >> i think so. i think to take john roberts very seriously in the majority this opinion when they say that actually section two of the voting rights act means what you thought it manson what we thought it meant. and that sort of the alabama effort to say, why don't you take this moment to re-write it so that is functionally unusable, the court rebuffed that and said any other state that's thought they were going to get to the courts to rewrite the law, i think is probably discouraged today. a, moreover i think this is going to have a profound effect

not just on the state level but at the county level of the school board and local levels, and i think that voting rights activists really believed going into this case, that they were going to be left with a toolkit that was like a toothbrush and a hairspray. in order to get through the voting rights. but that's just not true anymore. so i think that over emboldened red states are kind of going to get spoofed out of those a little and i think that voting rights activists have meaningful tools now that they can use. >> one of the dissent snow shocker in allen versus militias from clarence thomas. about to make sure heard some other news this week. he and justice alito asking for a delay in their financial disclosure forms. they were given that delay. and by the, way let's be. clear sense pro forma's who give this additional time. but you know dahlia, given the controversy that justice thomas has already faced, and accepting gifts and other benefits from a conservative

billionaire, were you surprised by the fact that he asked for more time versus just, saying you know, i take it. take it as it is, you can't do anything to me anyway. >> in some, sends katie, i'm not surprised at all. i think that this is a through line to what you were just talking about, with rick wilson i think that part of the problem with the imperial court is the same problem we have with the imperial presidency with folks who think that law is for the little guys. and i think that even in spite of the revelation after revelation after revelation about not just harlan crow but leonard leo and all the dark money slashing around in all the gifts and gifting that has been going on, the idea that the justices two of the justices are just like, should we do our disclosures or should we go for brunch? let's go for brunch. i think that is just still the vibe among some of the justices and the contrast between we have the congee brand jackson disclosing flowers that she got

from oprah winfrey, we have elena katie disclosing a parking space. and the other hand we've just got this sort of sense of, i know i told you i was going to avail my filings but he little time. it just gives this sense that this is an afterthought and not top of mind. and i think it just goes to this fundamental sense that some of the justices have that this is not a serious consequential environments. where you disclose your gifts and discuss your travel and disclose your income. for some of. them and by the way the chief justice was very clear about his wife's status and some of them take it very seriously but i think the sense that we are unrepentant in our feeling that this is just kind of small ball and not really something we should be frost about, it is such a continuation of this sort of monarch view of the justices, that some of them continue i think to perform in public. >> well i guess that dahlia i
