related to the classified documents case. this hour all speak to former trump lawyer, bob bray, about the likely trunk defense in the face of indictment that details a litany of evidence. that includes photos, testimony and so much more. trump for his part announcing a public defense that claims that he's a victim in all this, supporters, opponents and that was in between dumped it out on sunday shows. >> if he even half of it is true that he's toast. it's a pretty detailed indictment. and it's very, very damning. >> he said time and time again he's declassified all this material, this is the most political thing i've ever seen. >> reading the indictment it was a stunning brazenness the premeditation, the active efforts to obstruct, mislead. >> in a few minutes all speak to congressman king castro, an impeachment manager about this

case. also this, our new questions about china spying on the u.s. from cuba after an about face from the biden administration on what's going on. and we continue to follow the breaking news on a porch clap to the major highway here in the northeast in pennsylvania, a live report on that coming up as well. we begin this hour though with the historic arraignment of the former president said to happen exactly 40 hours from now in miami. we're getting more information on what exactly trump will arrive in florida, as -- expected to surrender trump i am authorities. at three pm on tuesday. this will be trump second arraignment in just two months time, this time on federal charges a massive security operation surrounding the -- that's where we find nbc justice and intelligence correspondent ken delaney and with more on. this can, talk us through what we're learning about travel schedule, the tiktok of the former president from now until tuesday? >> hey,, yasmin or learning

that the former president is expected to fly from his bed club in miami tomorrow. miami international airport until land and spend the night on his life club winter olympics as 20 minutes or so by car from here depending on traffic not as far as mar-a-lago would've been so it's a change in plans to meet the shorter motorcade if that's how they intend to get him here so perhaps fewer security risks ahead of his surrounded at three pm in this courthouse behind me on tuesday. >> we're getting some news now, and just in the last two minutes or so while we've been on the air they've been able to take a look at it. it seems as a half the former president is gonna be delivering some remark as bad minister after his arraignment, on tuesday after his arraignment were learning that he was flying right back to new jersey where he spends his summers. he actually can, as you and i both know a lot of folks watching as well did a similar

event at mar-a-lago. after his arraignment in new york back in april as well. we'll be looking out for that and what he has to say there but it's gonna be similar to what we've been hearing so far from the former president. what are we learning about what tuesdays actually gonna look like the arraignment? >> sure, i'll say that that decision you just mentioned it's a relief for security officials. who certainly wouldn't want mr. trump to be giving a speech here near the courthouse. in terms of how it's gonna go down on tuesday, we're told that he'll enter this building through an underground tunnel. this is a number of things that's happening. air it's both the surrender, a first appearance, at an arraignment. essentially he's surrendering to to federal law enforcement agencies, the fbi the federal marshals. the federal marshals prosecute federal defendants pending trial. they treat him like any other federal defendant. and we're told that they will do that. they'll take his mugshot and fingerprints. the mugshots never supposed to

be released, there's some question about whether or not his passport will be confiscated, if the magistrate judge presiding over the situation will order that. he'll then go into court for the first appearance on these charges, and he'll be asked whether he waives the indictment, and that 49-page indictment most defendants to wave that it will be asked how he pleads. we expect him to plead not guilty. the judge will set conditions for his release. we all expect him to be released and not held in jail. and we'll see whether the judge opposes any -- on what he could say about the prosecutors, the judges, are people on this. case because you don't normally see criminal defendants attacking and calling the prosecutors deranged because they risk from court when they do. that the same time he's running for president, this first amendment concerns, we'll have to see what the magistrate judge. >> right, we saw some of that happening up here in manhattan as well. in which the judge here warned

the former president of some of that incendiary language and rhetoric that he was putting out there in the lead up to that arraignment. again, watching that and seeing how that all plays out there on tuesday. ken dilanian, sank you, remember when folks as well the former president's birthday is wednesday he'll be turning 76 years old. originally tuesday night was supposed to be a birthday fund-raiser. i believe that's still happening. but again, breaking news we're getting now is the former president leave lowering remarks from bedminster, new jersey, hefty returns from miami at his arraignment on tuesday afternoon. let's bring in representative joaquin castro, the number of the house intelligence committee and former impeachment manager and trump's second impeachment. congressman, thank you for joining us. we appreciate it. after the sun tightening came out and you tweeted in part that's, again and again his crimes put national security at. mask nobody not even a former president is above the law. what was your additional reaction to the details of this thing? >> well, i think like the rest

of the country. our most of the country in one sense i'm shocked that our former president who understands how secretive, how dangerous it would be for that kind of classified material to get out. the former president would just leave it where he left it at mar-a-lago. it's a place where you have not only americans who are gassed of the club but also a lot of corners. and i believe the folks that have been associated with intelligence agencies, importing governments, who go through that building and so he subjected the highly sensitive, highly classified information that could be dangerous to the united states. and he subjected to people being able to be around it and get at it. >> they're speaking to this one part of the indictment which i thought was very interesting. i want to read it for folks. per what some of these classified documents contain. his boxes including information

regarding defense weapons capabilities, of both the united states and foreign countries, united states nuclear programs, potential viability that united states and its allies, to military attack and plans for possible retaliation response to a foreign attack. the unauthorized disclosure of these classified documents could put at risk the national security of the united states, foreign relations, the safety u.s. military, human resources, and the continued viability of sensitive intelligence collection methods. there are people that put their lives at risk every single day to keep documents like this, sources like this, private. they're folks that work for the cia, for the fbi, that are doing just. that and yet the president, former president i should say had them hidden and or stored in his shower, a storage room, and a ballroom. >> that's right. >> -- glad. >> i mean if they contain names of individual are different operations.

he could have compromised about those people. and put them in danger. and compromise the operation. but i think it's important to mention we're at a very crucial point in the next i would say 3 to 10 years in terms of national security when it comes to this competition that we're in with our adversaries over the advancement of technology. and over artificial intelligence for example, computing, and other technologies that will determine who's got the upper hand when it comes to issues of national security and our military. the idea that very sensitive documents about our own strategies might get out to foreigners, and other countries is incredibly dangerous and could be very damning to our military, to intelligence agencies. but it's also part of the chorus, who with the presidents that's lawless with several different things. >> as a former impeachment

manager, congressman, you've had a sense of what it's like to try a case against the former president. what some of your advice to the prosecutors on this. >> first, i hope that they have a fair jury than we had when we went over the senate, and laid out our case. to the senate there and couldn't get the two thirds that we needed, we got a flu republicans and voted with, us and they voted their conscious and a few more now that wished that they could change the vote i would suspect. i hope they get a fair jury, i hope that they just lay out all their evidence, and the facts to the jury in florida. and i hope in the end if they're able to do that that he'll be convicted convicted. it was a very detailed indictment, very straightforward there was no politics a minute. very sti can only hope for the county

msnbc just a couple days ago. when it denied a wall street journal report that china was putting a new spy base in cuba, nbc's monica alba is at the white house for us with more on this. what changed here? >> there's been quite a trajectory here, yasmin, it's notable just given the geopolitical implications of everything happening right now between the united states and china. clearly what secretary blinken expecting to visit beijing in the coming weeks it's unclear how when exactly is going. it was a trip that was delayed after it was canceled in february after the chinese spy balloon incident that flew across much of the country. and given relations took on a new low level after that. now they're expecting he'll be able to go there but this is the backdrop of the conversation now about a completely different situation. which is these reports that popped up on thursday of china having a spy coast that would

amount to a base for electronic signal detection in cuba. which the administration did deny at the time. we had national security spokesman john kirby on our own air with andrea mitchell speaking to that after it happened. take a listen to that exchange. >> i've seen the press report, it's not accurate what i can tell you as that we have concerns and say they want to the administration of china's influence and activities around the world. and certainly in this hemisphere and in this region. we're watching this closely. >> later we also saw different type of statement that called the wall street journal inaccurate. it didn't get specifically to what it was saying that they had -- with cuba about what's notable this week is that the administration officials this was already in place in cuba.

and it was upgraded their pointing the finger to the past administration saying this is an issue they inherited have been dealing. with what they were trying to argue is the piece that wasn't accurate here was the fact that something knew was gonna be installed. when it sounds like this had been monitored by u.s. officials for all that time. again, there's critics here in some skeptics that are saying that this is a u.s. attempt to try and keep the relationship with china right now in a way that's forward-looking to continue the talks, continue restoring communications, given secretary blinken shrimp that could be upcoming. it comes after what happened last weekend which was this provocation at sea with a chinese warship, which was the latest example of an act of aggression by the chinese military. there is a lot to this but it's a notable update from the u.s. government. >> monica, thank you. still ahead everybody former president trump's allies are spinning his a diamond as an act of war. and calling for retribution.

on tuesday in miami, specifically florida, florida friendly state. to the former president donald trump, won florida in the last election. how is it different than the threats that we were anticipating possibly happening in manhattan for that arraignment there? in addition to that the new york times saying this, even if aggressive language by high-profile divisions does not directly end in physical harm, it creates a dangerous atmosphere. in which the idea of violence becomes more accepted. especially such rhetoric is left unchecked. what do you make, how concerned are you for potential balance, if not tuesday but beyond that with these mounting legal woes from the former president? >> well, anytime we have political rhetoric that inches off the scale towards advocating for violence. we should become worry. be seen it over the last several years. the more people talk about violence the more violence we

see. the challenge of all this is what we called so casting terrorism or violence. where it's mediated, it's published out social media or television, news the internet during interviews with high-level people, you don't know who will gravitate toward and see it as an order to do that i wouldn't know just in the last 18 months to two years in the era post insurrection we've seen a lot of calls to violence but i would say there's been a marked change in terms of the audience reaction. on the insurrection, january six people did mobilize they committed violence and they were sent to prison they were charged, the audience perspective for many people they thought they were following their leaders and weren't going to have their back. i haven't noticed the same sort of spiking in terms of activity we were worried about it if election of 2022. even during the midterms. we heard a lot of the surrendering, we hadn't seen -- thankfully.

but the manhattan indictment when he arrived we did not see it. lisa that was manhattan. it would be a different scenario this week. i'm a little more optimistic that maybe we passed that threshold of constant mobilization of violence. let's hope that nothing happens on that day. >> why do you think the audience isn't necessarily responding, is it because the leader that called on them to attack the capitol did not in fact have their back, is it because they've seen folks that invaded the capital, lead to serve time in jail because they were actually held accountable, what do you think it is? >> i think it's both those pieces. they've watched the leader make the calls for violence and not participate, they watched it at the capitol, they really were unable to do anything, or they should've done anything once those cases went to trial. i think there are two other trials that we forget about in the contacts. which is the proud boys and oath keepers. all those groups were severely punished as they should've been further activities on january six.

they were organizations that were really telling people where to go, what to do and who look at their exchanges sometimes these one-off actions or arrest we'd, seemingly gets one person doing something crazy. but it was actually part of an online network that was being empowered by real world associations, both in the proud boys and the oath keepers another groups. they're not what they were three years ago, i'm still quite worried. anytime you hear elected leaders of arrives, we should be worried there won't be any violence at the same play. audiences i felt turned on by the same people that calls for violence. but they're on their own, but things were told to them as a lie. there's a lot of revelations amongst the audience that the election was not stolen. they should not have march of the capital, they should've have committed federal crimes, we're seeing harsh consequences as it should have been for a lot of people that went into the capitol committed violence that day. >> clint watts, thank you. coming, up legal experts weigh in on the indictment of former

we learned a short time ago that donald trump now set to deliver remarks at his golf club in new jersey on tuesday try following an arraignment in miami. he was scheduled to host a private fund-raiser close to the press, meanwhile legal experts continue to weigh in on the 49-page indictment charging former president with repeated violations of national security laws. nbc's justice and intelligence correspondent, ken dilanian, has more on this. >> what some are calling a devastating criminal case against the nation's 45th president. even lawyers who want supported former president trump say that the evidence is overwhelming. >> the evidence in this indictment is very damning for the former president. >> republican jade tao, was

trump himself acknowledging that he possesses secret information about u.s. military plans. >> how powerful is a tape recording of donald trump saying in his own words that he has a classified document? >> it's extraordinary. it would be so compelling to jurors. >> he believes the justice department should not have charge trump with retaining classified documents. because he says it raises an uncomfortable comparison to president biden. who's under investigation over secret material found in his home in office. multiple sources tell nbc news, that investigation is nowhere near a completion. i said even if convicted -- >> these instruction counts which are very compelling in the indictment, and if true the presidents now hard time getting around the six counts. >> prison time is unlikely he says. >> i don't think that president trump will serve a day in prison. he's entitled to secret service protection for the rest of his life. the secret service cannot delegate that to the bureau of prisons. >> thank too ken dilanian for

that. i want to now bring in robert ray, who served on the former presidents legal team during his first impeachment in 2020. robert, thanks for joining us. >> thank you. >> we both read through this whole thing, it reads like an of all. way which the prosecution has laid out this case. the way the jacques myths laid out the. case >> it's referred to a speaking indictment. >> what was your reaction to this indictment, what you? brad >> the reaction i have to the clips that you just played from others is that it's not very nice for them to say this is an overwhelming case based upon a reading of the indictment except for the fact that overwhelming cases are not, they will jump off the page from an indictment. they need to be proven in court. i take indictments for what they are. in fact every federal judge who instructed jury at the end of the case says the indictment is a charge only. it's evidence of nothing. i appreciate the commentary and everyone jumping on the bandwagon. and the hurray hand raise, you

can't tell whether amazes overwhelming until -- the trial actually happens. >> let's go through the evidence that they have. it seems like recordings that they have, notes that they have. >> from the recording aspect, it's misleading. it's suggesting that it's a recording of donald trump. it's not a recording of donald trump as i understand. and it's a recording of the lawyer who made mental impressions and notes as a result of his conversations. >> it's twofold, there was audio recording and then there's a recording of the note taking of evan corcoran as well. per donald trump's actions within their conversation. and at what point evan corcoran knows that donald trump makes this plucking impression with his hand to say, if you're gonna put them in the same maybe pluck went out. >> well, not the same thing as having donald trump recorded. i understand those other things that donald trump's made statements. i'm sure the government will try and introduce those against him a trial as admissions. but i guess the piece was a little misleading to suggest

they were donald trump's words. they're donald trump's recorded words recorded by a lawyer who speaks to a tape reporting to preserve what -- supposedly said. >> what about the words to the biographer and saying, i have this classified document that i could've classified when i was president but i can't anymore. and it pertains to a possible invasion on iran. that was a recording of the former president? >> right, and that will be evidence that will be introduced against him at trial. >> is that damning evidence do you think? >> my overall sense of this is that this is a very serious case. there is no way of cutting it any other way. they are serious felony charges. -- when the case goes on trial. there is jury appeal in a case like this if there was harm to the united states as a result of the former presidents conduct. i haven't seen allegations yet that would suggest there was harm to the united states and the government should be clear, it doesn't need to prove harm to the united states in order to prevail on these charges. i'm just suggesting to you that it's altogether another

situation as a result of this alleged conduct harm came to the united states. that's a serious matter. >> what about this, that this is obviously alleging this 49-page indictment that the documents contained defense and weapons capabilities of both the u.s. and foreign countries, united states nuclear program, potential vulnerabilities united states and its allies to military attack and plans for retaliation and response to foreign attacks. and the unauthorized disclosure of classified documents could put at risk the national security of the united states, formulation, safety these military, and human resources, and the continued viability of sensitive intelligence collection about that. i know sir, and you know how important those sources are to see eye agents with their lives on the line every single day. >> my question as -- was there an authorized to closure or wasn't there? we won't know that until trial. they haven't allege there was an disclosure. they simply said that if it were disclosed that would be the kind of damage that would come to the united states.

it's something that we're gonna have to look for when and if the case goes to trial. >> how damning is it that allegedly the former president lie to his own attorney, evan corcoran, on the day at what she was supposed to obtain more classified documents, june 2nd he instructed to move documents out of that area. and then told evan corcoran to get the classified documents. >> if there is proof that the contact was willful in the game of musical chairs in order to avoid compliance with the subpoena, which is essentially the -- of the obstruction charge, obviously, i said this. that's trouble. and this is concerning. but there's also some predicate questions that need to go on here about what was the presidents right to retain these documents. everybody understands classified information, and at the highest level some of that classified information is top secret. another, words the most at the highest classification that there as the question though is, once the president authorized to retain these documents i think that there's a substantial on general be litigated pretrial about constitutional issues about the

former presidents prerogative, whether the presidential records act is constitutional, all those things are gonna be addressed imagine in a series of pretrial motions that will start after the arraignment. they'll probably extend well into next year, 2024. i do not anticipate this case will actually go to trial during an election year. i think it will be seriously bad for a country that's divided, for an attempt to be made to try to force this case to trial before the election. >> bill barr, former presidents attorney general said if even half of this thing is true, he's toast. >> that's nice for him to say but that's why we have trials. i don't think it's an appropriate role for anybody to say about what this actually means. it's an indictment, an accusation, it calls for a process to begin. that criminal justice process is gonna be tested in this case, and the country is gonna be under a task in the rule of gonna be under a task. and it's important that we as a country, all of, us whatever

our views are committed to trying to get this right. that won't be easy to do in an election. yeah and that's what i look forward to. all of the histrionics need to be put to one side. so, we can calmly and safely get the country through this in the best interest of the country, toward an appropriate conclusion with a rule of law spin respect that. i respect juries, outcomes, i think it's way premature that we talked about whether this is an overwhelming case based upon an indictment. >> when you took over the indictment of president bill clinton from ken starr, you push for an indictment, you said no one is above the law even the president of the united states. >> and that's true. that's right. it's still true. but of course the law applies to everyone in the united states but everyone in the united states is not a president of the united states. and the rules in ways and which case unfold is different, presidents are different. there's only two constitutional officers in our system. that are subject to election by all of the people. and that's the president, the

i want to go to nbc's jordan rubin, we wrote all about judge cannon in his post. gordon, given her history is there any likelihood that she's steps aside or is forced to do so because of a conflict of interest? >> given our history, i wouldn't necessarily expect her to voluntarily step aside. it doesn't mean that you won't. it doesn't mean that you won't be kicked off the case if she doesn't voluntarily step aside. i wouldn't bank on it happening. whether voluntarily or being forced to do. so it's possible,, remember how the appeals court really snapped down the substance of a rulings before. it's possible that those judges could wind up forcing her to step. aside or others in the core. it's really a different ball game telling a judge that she's essentially to biased and can't do the case fairly. that's something much more serious in a way than saying, you don't know what the law is. which the judges said the last time. it's a possibility but not one
