terri sewell, who sits on the armed services committee. , plastile trump has vowed to stay in the race for the republican nomination, even if he's convicted. we're gonna dig into why both his primary competitors are criticizing ham. with donald trump's former attorney general, bill barr, he's someone who's actually not holding back. saying if half of what's in this indictment is true, donald trump's quote, toast. he called this indictment detailed, and very, very damning. i agree with mr. barr, and it doesn't happen every day. i'm symone sanders townsend, and i have something to say. ♪ ♪ ♪ former president donald trump is set to appear in court in two days. he's accused of violating seven federal laws and he's facing 37 federal counts. 31 of the counts deal with the

espionage act, specifically for the willful retention of national defense information, the re-counts for withholding or concealing documents in a federal investigation. two counts of false statements. and one count of conspiracy to obstruct justice in the classified documents case. but as the first former president to face federal charges he's actually doubling down on defiance. donald trump was back on the 2024 campaign trail with a speech in georgia, and north carolina yesterday. and he is a denying the charges. trump used -- as a platform to rile up his supporters. >> in a sick way i kind of enjoy a. [laughter] because it exposes them. . it exposes them for what they are. and it's also lifted the poll numbers to even higher lines. but still, you get indicted over nothing. you get indicted over the presidential records act which they don't even admit they call

the espionage act. these are sick people. >> what was sick is the fundamental misunderstanding on the presidential record acts in the spanish back. but my friends, that's why we're here to help you break things down. known trump is considered innocent until proven guilty. very important to note. special counsel jack smith, he -- here is what the former presidents own attorney general, former attorney general bill barr what he had to say on the matter. >> if even half of the strongman, his toes. it's a pretty detailed indictment. and it's very, very damning. and this idea of preventing trump as a victim here, reflect him of a witch hunt. it's ridiculous. >> yeah, bill barr, the 40 plus-page indictment cites trump own staffers the, testimony from his own staffers even his own former lawyer. it details how the former president knew that he was in

possession of documents that he wasn't authorized to have. it detailed sensitive national security matters, it breaks down the lens to which donald trump went to mislead the fbi and even his own attorneys about the existence of these documents. after receiving a subpoena from the grand jury allegedly coordinating with his valet, personal aides, it creates a timeline of events that culminated in the infamous p.i. search warrant executed. at mar-a-lago last year. as the indictment lays out, the documents in trump's possession originated from a host of federal agencies. including the cia, the department of defense. folks, this is not some clerical offense, a bureaucratic misstep, it isn't about random papers, this is a serious violation of the rules, about how documents related to our national security are handled. it matters. it is these roles that keep the people serving our country

safe. and it is the violation of these varying roles that can get those same people killed. according to the indictment the classified documents trump stored and his boxes included information regarding defense and weapons capabilities, about the united states in four countries. the united states nuclear program potential vulnerabilities of the united states and its allies to military attack, and plans for possible retaliation in response to a foreign attack. the former president took no care to secure the sensitive information, putting the documents in a ballroom stage, in a random bathroom at mar-a-lago, americans including the people. maybe even especially the folks who voted for donald trump, believing he could be trusted to guard the nation secrets, they deserve better. this is why actions matter, folks, this is why voting matters. this is why the peoples ability

to participate in the electoral process is critical. and why the recent supreme court decision and allen versus milligan is another monumental development. that we must discuss. ten years after the supreme court gutted the voting rights act in shelby county v. holder, section to the voting rights act which forbids election structures that result in discrimination on the basis of race. it is the last defense voting rights advocates have. wow, despite the firing at regulations and despite what we all the assumptions folks had, the court supreme court found that alabama's voting disenfranchised black voters by packing them into one district. diluting their voting power. this ruling now giving alabama the chance for a second black majority district, and its impact isn't stopping at the alabama state line. joining me now to discuss all of this is democratic congresswoman terri sewell, the lady from alabama.

welcome, congresswoman. let's start with the trump indictment. you're someone that sits on the armed services committee, he received classified briefings, you are well versed on some of the most sensitive conversations happening at the highest levels of our country. what was your reaction to the extent of the defense argument that the former president possessed? >> well, these allegations, symone, are serious. no one is above the law, our president is not above the law. or any former president above the law. this is really important not only to make to the rule of law, but especially torrential security. as you stated, i was formally on the intelligence committee, the house intel committee for eight years. and privy to the same briefing of the president get on a daily basis, i can't tell you that the allegations against former president trump are very serious.

and if, true he's definitely violated our security and obstructive desantis. i think when you need to let this process play out, i don't want in any way to suggest that he's guilty. the evidence against him is pretty powerful. and these allegations are very, very serious. >> so, congresswoman, given that i'm struggling with house speaker mccarthy responded after the indictment. he vowed to quote, the house republicans will hold this brazen weaponization of power accountable. this weaponization of power something we continue to. here is even a weaponization committee in the current congress. are you concerned about your republican colleagues, their bravado, but also there seemingly willingness to mock up investigations that are happening in other branches of

the government? >> while, you know, symone, their spot on. i think for my republican colleagues to politicize this and dive and, an indictment that goes through the very hot our national defense, or national security, and keeping us safe as well -- and more importantly, were destined poured in the men and women who every day fight on the front lines. and who do our intelligence investigations, and make sure that we're safe. the fact that we're politicizing that as i'm not surprised that my republican colleagues are politicizing the indictment. i'm very, very disappointed and i think this is yet another reason why representation does matter. >> congressman, there are house republicans who have minimize the severity of the charges, yet they know the gravity of them. and the calls for handling the document. but then you have regular folks across the country, people in

your district i'm sure who are wondering, is this even really that serious. what do you say to those folks? >> well, i say that a 37 count indictment against the former president is very serious. when you take what jackson it's sad with respect to the gravity, and the extent of the information that he had in his possession, the clare listeners by which he kept those documents. and when you consider the fact that nobody is above the law especially those who are elected like the president. >> i want to move to the historic voting rights decision by the supreme court earlier this week, the shape of your district, alabama's seventh, it was established in 1992, it is the states currently only majority black district. i would like to note that this district establish more than 100 years post reconstruction.

under the provisions of the voting rights act. the new decision that paves the way for a potential second majority black district in alabama. talk about the impact of that, and your reaction when you heard the decision? >> you know, symone, this is a historic victory. a great victory. not just for alabama's black voters but for minority voters across the country. and a victory for democracy itself. as you sad, if this particular decision upholds voting right act of 1960. five and section two in particular we are really concerned those of us that had the oral argument that the supreme court would use this opportunity to further got the voting rights act of 1965. we know we're on the cusp, the eve of the tenth anniversary of the shelby versus holder decision. and that decision, the shelby

decision was a decision that guided federal oversight and found unconstitutional section four. as you know, i've been carrying the seminal piece of legislation, the john robert lewis voting rights advancement act. that would fully restore the protections, all the protections of the vr a. so, this win in milligan case is huge. it means alabama must redraw its maps. but it also means that other states, other maps whether they're congressional or state legislator maps or even county commission maps cannot dilute the power of black voters. and if they do, if those maps do, they should be redrawn to fall in line with the law. so, the reason why i guess i'm smiling from ear to ear, is because i feel like minority voters across this nation won on this decision. and the supreme court follow the law. they upheld the voting rights act of 1965.

>> congressman, i don't mean to interrupt you. but you make a very important point. there are dozens of section two cases that are still unfolding across the country. and as you just said this case could lead to several rulings and those instances. if they do, these maps only need to be redrawn prior to 2024 elections. and could political report, in response to this ruling shift could they actually -- are at a toss-up. and one district toss-up to lean the for democrats. the implication for a democratic house of representatives here potential in 2024, how can democrats capitalize on this momentum and deliver house majority? >> it does, it doesn't mean that elections do matter and election, the result of objections could be changed by this. we must remember, this isn't about democrats and republicans. it's about minority

representation, a fair representation. and this decision will reverberate around the nation when it comes to making sure that minority voters, african american voters in the case of alabama, that their power is not diluted. that they have an opportunity to elect candidates of their choice. that state legislators cannot redraw maps such that the candidates that are available for them to vote on our candidates that would not represent their best interests. i think this has huge implications for this nation, and like i said, it's not about me, it's not about alabama, alone and it's not about republican or democrat. it's about what's fair. and what's fair, symone, is that african american voters, minority voters across this nation their power, whether voting power should not be diluted. and you know, i know that john lewis and those foot soldiers that marched, that blood, that died in my hometown of selma,

coleman. welcome to the msnbc family. all right, everybody. charles, you. first our resident lawyer here. you have seen a lot of indictments as a former prosecutor. how do you think this stacks up with indictments that have led to convictions. >> well, simone, there's a lot in this indictment that we see paying attention to. what jacks mitt did was lay out a very meticulous and carefully planned and detailed timeline. not only the acts that donald trump was engaged in that letters to this place, also gives us an incredible insight into it. that's something we will have to focus on as we go forward. the acts are undeniable. they're not in dispute. what people have to understand, this case will be one in establishing donald trump's intent. that's why those phone, calls the recordings, that's why those conversations about plucking bad documents, all of those things helped to establish donald trump's intent that he intended to lie, he

intended to invade u.s. law enforcement they were intending to get documents back and he intended to hold on to documents that he was well aware he should not have had in this possession. as far as indictments are, concerned this was super solid, it was a speaking indictment. it sets jack smith and very strong grounds moving forward. . it >> what do you make of all of these insistence is from the former president that he's done nothing wrong? i mean, we will do tape. >> trump is being trump. those tapes are quite damning. it shows he understands the significance. he understood the gravity. he understands it's not trivial to mishandle classified information. i agree with charles, this is a rock-solid indictment. i had high expectations. this exceeded them. this has tapes. this has testimony from lawyers. this is an extraordinary moment. the question is whether or not

donald trump can throw up enough dust and distraction to turn this around. so far republicans have been falling in the line. my question to a lot of these republicans that are leaning to the defenses, have you read this indictment, heavy listen to this indictment of. do you know all of the evidence they have there? are you willing to die on this mountain when you see what jackson it has put together? it's extraordinary. >> i'm looking for my indictment, as charlie, said charlie is right. this is damning. the storytelling that happens in here is just crazy. the pictures we are showing on the screen or photos that came from donald trump's old staff. that's from their phones. you know better than most insensitivity around documents such as these. just carelessly stored in a

bathroom. talk about this point. the fact that the rules that govern the violation of these documents, they are really in place to keep us safe. >> i'm glad you raise that. i would encourage all americans, don't take our word, read the indictment, it speaks for itself. the fact is, any of us who handled classified information do it. we have to do it in a secure area. we understand the penalties when interviewing classified documents. you have to sign something that says you understand that if you distribute it or communicate it it's a violation of federal law. we have donald trump's own words speaking himself about his understanding that these are top secret documents. you really shouldn't look at this. take a look anyway. i think americans will clearly

understand by reading this document and understanding the story that donald trump, he didn't just have the document, he intentionally kept them and retain them. it's a reason he is facing an indictment under the espionage act. he knew he was supposed to return it and he lied he. lied about what he had he move the documents around he conspired with william and order to do that his actions really speak to the gravity of what is happening. . >> charles, the damages of the details. that's what the congresswoman is saying. when you look at the significant dates leading up to this indictment, when the documents removed went messages were sent to hide the fact they had documents, the review of mar-a-lago surveillance footage by the fbi. just before the fbi search warrant. it was donald trump the gum self into the struggle. what could his lawyers be

advising him at this point? law>> simone, i'm so glad you brought that up. it's very important that people understand. for anyone who is trying to make a comparison between donald trump and joe biden, but donald trump and even mike pence, it's important to understand there is a point in this timeline when what donald trump was doing, the information he had did not rise to the level of legality it. wasn't until, as you, said he took matters into his own hand. he brought this on himself. he found himself in criminal peril which he lives. his attorneys are going to have a very difficult time from a legal standpoint. rattling a defense that's on solid ground because of the timeline. he wanted the doj to protest as an administrative issue. not as a criminal issue. the problem with that, it's just that. it's the timeline. there are so many different instances that donald trump has been as politely to get the

dissonance or a. now he's unwilling to take us. and he's unwilling to be too hot or too cold with donald trump. unlike chris christie. who is understood with all of his baggage and with his 1% in the polls that you're not going to beat donald trump unless you go through them. unless you specifically address this. you have a republican field where you have chris christie and isa hutchinson willing to call this for what it is. you have everyone else ringing their hand and expressing concern about this prosecution. it was david from the atlantic who said their concern is about is sincere as grief at a mafia funeral. a course they'll want him gone. they don't want to be the guys to push him out of the way. mike pence in those soundbites illustrate why he has no shot at the nomination. he can't even settle on a legitimate rationale. >> on special coverage of donald trump's indictment last night, my colleagues and i

mike pence can't decide who he wants to be in this race. and that accounts for why his numbers are so low. he was part of the administration. , on one hand he dances between criticizing donald trump. on the other, defending him. there's not a real rationale for the candidacy. i think. that was some of the other candidates in the race rather than christiane asia hutchins, then, they are former prosecutors. they understand the gravity of the indictment. mike pence either is unwilling to acknowledge that or simply can't do it. there's no real rationale for his candidacy. >> this is my pants. this is rhonda sanchez. he's also in a similar boat. i'm someone who says ron desantis is the scott walker of 2024. untested outside of florida. ever since the indictment broke

we haven't heard much from him. he tweeted the date before the indictment was unsealed. let me read it for you. he was calling the weaponization. he said the weaponization of it represents a mortal threat. he says it's a political bias. bringing accountability to the department of justice. so on and so forth. after the unsealing of the indictment, the comments, didn't even touch it. >> what's his excuse? >> he thinks he can get this nomination by clinging closely to the maga base. not antagonizing them. somehow something magical is going to happen. did we step away from the politics just for a second? we are talking about them as politicians. we have to hold them as a standard. as american citizens and

thought. leaders right now, this countries at the brink. we have donald trump and many of his most fellow supporters suggesting acts of violence that in fact there should be some sort of a pushback. maybe a january six type reaction to all of this. this is an incendiary moment. it's incumbent upon all americans to say, look, lets lower the temperature. let's let the system play out. . whatever specter the criminal justice system. he's going to get his day in court. instead, what they are doing, they're attacking the justice system. they're attacking this judicial system. they are feeding the fuel of the anger out there. people think that this is somehow a coup. it's an insurrection. what they are doing, they're providing cover for some of the most reckless and violent voices out there. i think that the concern ought to be blinking red right now with some of the things that donald trump is saying. some of the things that kari lake is saying.

some of the things that you're seeing on social media right now. i get the feeling of some of the rhetoric that we saw before january six. even if that doesn't happen, what a responsible people doing? they said let's keep the powder dry. let's lower the temperature. let's let the system work the way it's supposed to. you're not hearing that from a lot of republican leaders. >> you know, charlie, i am concerned. i'm very concerned about the violence and the rhetoric. i think the rhetoric has been ratcheting up all summer. . i think of what meacham said friday night on our network he said the question before now is what kind of democracy are we going to be? eric going to be a democracy that forces rules and laws, are we going to be an amateur democracy that uses chaos over the constitution. the people have the power here. our elected officials have power. frankly, maybe we should all be

first-ever emergency declaration this past week. it highlighted some damaging trends and our nation. a cooling to the hrc of 525 anti-lgbtq+ bills were introduced in 41 states. of those, bills more than 220 of them targeted trans people. more than 76 anti-lgbtq+ bills have already become law this year. that is more than doubled last year's number. that means that 2023 is now officially the worst year on record for anti-lgbtq plus legislation in america. this is a lot to taken. its pride month. lgbtq plus individual should be is celebrating their pride. they should be comfortable living out loud. this year that's not everyone's reality. many folks are living in states led by conservative politicians who are hell-bent on targeting them. not just in their own communities either there's trying to spread a message of hate a nation line. look at florida. a prime example.

just this week, a judge struck down a new florida law designed to ban transgender minors from receiving gender affirming care. the judge said that gender identity is real. another judge had to rule tennessee law constitutional after it strictly limited drag shows and public. places where children may be present. all of this rhetoric, it can turn to action. i'm just talking about it with charlie. it can be dangerous and result in violence against communities. we're almost a year to the day of the attack in colorado springs. this rhetoric, it matters. in the midst of these attacks on the lgbtq+ community, whether it's legislation, whether it's rhetoric, people are actually trying to find hope anyway they can. president biden hosted the largest pride celebration in white house history yesterday. he called for new measures to support the rights and safety

of lgbtq+ people amid terrifying attacks and legislation. look, you can be a lawmaker, you can be an organizer, you can be someone who wants better for the people of this nation. it's time to stand up against this rhetoric. it's time to stand up for lgbtq+ people. it's time to speak out against hate, all forms of. it it's time to, we don't need any more allies, folks need to be accomplices. they need to get into the trenches. this is a call to action. you've got to walk the walk. as much as we talk it. literally, literally, the lives of so many people in this country are on the line. up next, i will be right back. ill be right back.
