great to see you as always. great show. enjoy the rest of your evening off. tonight on ayman, the real 2024 rebranded for donald trump the presidential campaign is more than a race to return to the white house. it is now a fight to stay out of prison. then the strength of the special counsel's case all be joined by harvard constitutional law professor, lawrence tribe, who says the indictment is a vindication for the rule of law. and an unhinged and dangerous gop effort to protect trump. congresswoman so lofgren breaks it down with. me i'm ayman mohyeldin, let's get started. ♪ ♪ ♪ so, in less than 48 hours donald trump will be arraigned in federal court in miami. he's expecting to surrender himself to authorities. still likely be arrested, booked, taken into custody before he appears before a judge. now trump says that he'll plead

not guilty to charges connected to his handling of classified documents. and of course as you may know, this is his 2nd indictment in 3 months. despite that growing legal peril that he finds himself and during an interview with political last night, trump vowed to continue campaigning for president even if he were convicted. now that's not entirely shocking to be honest. trump never admitted defeat after losing the 2020 election, he's not going to tap out of the 2024 race when it's just getting started. there's more to this move then his inability to back down. it's not about politics, trump's 3rd white house bid has a bigger strategy at its core. as axios explains, for donald trump 2024 campaign is more than a race to return to the white house. this is a fight to stay out of prison, legal experts believe it's unlikely that the criminal trial be resolved before the 2024 election whoever wins the president could see the position to influence trump's

>> so, that is something that depending on how the court rules under the motion. we will see the proceedings either speed up or slow down. something with the duchess parent has in its favor is that the southern district of florida is known to be a really quick jurisdiction. they like to move their cases and they look to get them off the doctors. they like to have speedy trials. will be interesting to see how the judge rules on these. motions whether not trump is able to stall in the lead up to

any trial. >>, mildmay reaction to this idea of a speedy trial, and what that looks like. the entire campaign could be about trump trying to keep himself out oppression, he is going to politicize this as we've already. seen what is this is a, both about the state of ice politics and the legal institutions and our country to be shielded from those politics? what will you be watching for? >> well, i certainly gonna be watching for how the court responds to all these delay motions, i think we're gonna see. it let me be clear, and the defendant has the right to bring legitimate emotions and their case, that includes donald trump, but what we've seen from donald trump is bringing cases there not many lawyers thought there is any chance of winning. like his executive privilege claims that he brought over and over again. even when it was four witnesses that didn't have executive privilege like steve bannon. or using these motions to claim

partisanship. we saw that in new york, when he went after the new york state attorney general, and her investigation and claimed it was a partisan witch hunt. used to digicel process to do, that so i think we're gonna see very aggressive motion practice. we're gonna see lots of politicking in those. motions and they have very little to do with the law. and many of us looking and reading that indictment are sitting there thinking, i'm glad i don't have to come up with it. because it's very hard to come up with one, and if it were not donald trump i promise you the lawyers for anybody facing the evidence and that indictment would be saying we made a plea deal. >> and that is not gonna happen here. but it means that the politicized official process and the question as the judge who presides over this proceeding going to allow it. >> molly, your reaction to the idea that trump is running again in effect to stay out of prison. i'm trying to gain the various scenarios and there's so many even if he's in committing any

tries to pardon himself it'll be legally tested maybe the all the way to the scene quite phoenix a deal with a running mate that says, all put you in my tickets so long as you promised me that i have to resign my position will pardon me it's gonna be the defining issue of his political campaign. >> well, you will remember all he announced his candidacy had a little bit early, he was worried about investigation trump has always thought of this as kind of a very useful to stay out of jail i still think a lot of this is gonna take a long time and we think that the judge in florida aileen cannon, of the special master of appointing a special master is a very trump friendly judge if she ends up being the judge. , you could see her and him taking a long time to delay this, but even the soonest that we get going would be around

the time of the gop primary, it seems like this kind of thing really delays the gop primary base, they love it when he fights with the federal government, they feel that for some reason he's an issue that they relate to. >> katie, the biden administration is not commenting on this case, do we have any sense of what the white house is thinking on that front going forward. especially as we get closer to the election time perhaps. especially if the investigation into the biden administration, or joe biden and his classified documents issue is resolved. what a change the dynamic at the white house perhaps go into a different attack mode on it politically? >> one of the reasons why you're seeing the justice department not comment. it's because one, it's aptly not something they should do it would be a violation of policy in so many ways. the justice department must uphold the rule of law. without their favor they're not supposed to be seen --

as an attack dog of the president. that's exactly what we don't, want and it's exactly why americore linda portland special counsel in the first place he wanted to create separation between what the justice department was doing, and the white house and because he does serve at the pleasure of joe biden and he didn't feel like it was gonna be a good idea for him to directly oversee this. queso, if the white house where to start taking an attack position and using this as a campaign for joe biden, that would put merrick arland in a terrible position, i can't imagine anything worse. for the justice department or for garland, so i don't think you're gonna say that however to your point, that does leave this huge opening rhetorically for donald trump. joe biden, will stay silent because he's not supposed to be using the desk as apartment for political gain. donald trump will fill that silence again and again again. one of the things that's different this time,, though is that he'll be doing it with not just one but two different criminal cases going forward during the campaign, if judges decide this kind of rhetoric is

impacting the case negatively, is making it impossible to have a fair trial, they can try to curb that speech and we don't really know what will happen because it is uncharted territory for. trump and for the american public. >> maya, you've pointed out that the dangers of maga rhetoric which we've seen inflamed once again since this indictment was unsealed around their there are reports that some trump supporters are calling for violence ahead of this arraignment on tuesday, what are you most concerned for as we approach the state and the people that are involved with our beach ox met, or the judge or any of the attorneys that are working this case? >> well, first of all i think we all need to be concerned about the rise of hate and violence, it's affecting us across all communities and we're seeing a 36% rise in antisemitism, the majority of folks facing hate and bias are black, lgbtq is a massive rising number as well, it's

simply to stay we're seeing proportions of rising violence that is unique and has been on the rise. and frankly since donald trump took office, here's the thing we need to worry about, we need to worry about the fact that there are those individuals who are paying attention to the disinformation, and the rhetoric that's been ratcheted up, just as we heard the rhetoric from donald trump before january. six and have an impact on how organized hate, the proud boys, the oath keepers face prosecution actively engaging and working with one another and had discussions with one another organized but in this case. thanks to the prosecution more hearing from groups like the southern poverty law center. which is one of the member organization leadership conference on civil and human rights that tracks it has said, look, the prosecution is good, but it's driven it down to local level. what we have as more local organizing, and those

individuals who show up are the ones that we need to worry about but i will say this what we saw on the mobilization around the midterm was a fear of heightened violence and usually there is an election cycle we saw affective management of that threat so it's important for us to understand those preparations being taken from law enforcement side, it's really important that we have community leaders and communities organizing with one another. this simply counter as you point out of joe biden, which is to stand up and say, it doesn't matter who you want to vote for, doesn't matter what your politics are, none of us can survive in a democracy that says, that people can be armed, and express their hate against anyone with violence. because that simply the opposite of democracy and it's some of what we're seeing happening. and if someone the things we need to see that we're encouraging. >> maya, let me get your thoughts on the politics of the

gop's response. i've seen time and time again far-right republicans undying support for trump, it's beyond a cult at this. point and even as some of them are actually vying for the same office in 2024, they want to knock him out of the race, you would think that they take this opportunity islam, him try to get ahead in the polls to discredit tab, but they continue to come to his defense in a freakish way. >> it's unbelievable, every time we've seen them do it again and again. i have a moment of maybe. a high know that they want, but maybe just this time, and in fact they just won't. even mike pence, even the quote unquote brave republicans, i'm using that ironically. they were saying that it was terrible to prosecute these crimes, what is the justice department doing. and just unbelievable, even like senators, mike mike rounds from south dakota is out there saying, the justice department

now even he thinks that this indictment is, quote very damning in that trump is toast, his words by the way not. my special counsel jack smith has made it clear that's office is seeking a speedy trial and one that upholds the rule of law an honor. -- on the accused. to take us through how he might do that, i'm joined now by laurence tribe, professor emeritus at harvard law school. professor tribe, great to have you on the show. let's talk about the significance of reactions from folks by bill barr, a key trump ally in his time and his time as attorney general, and since his indictment was unsealed people who are once pivotal in defending trump they're speaking openly about trump's flagrant wrongdoing in this case what is the say about the case that jack smith laid out so far? >> the case is devastating, it's very rare that i find

myself agreeing with bill barr but in this instance it's not a matter of opinion of course it's a presumption of innocence but i would urge your viewers to read the indictment it's really our easy rate, very easy to raid, it's filled with statements from trump's own, recorded statements, transcribe statements, filled with statements from his own attorney with the attorney high prevalence was held not applicable here he was using his attorneys to commit serious felonies, felonies that endanger all of us, he was essentially stockpiling informational weapon ions of mass destruction. and then showing them to people. the indictment goes through instances, to them from bad where he showed top secret documents, documents about

military plans, how would react if attacked. what are the military strains, the weaknesses of certain adversaries, stuff that he said out loud. this is top secret, i shouldn't be showing it to you but take a look. so there's just no way to read this indictment. and i think that there is some kind of defense. >> speaking of defense -- >> the defense might be a judge who's in the tank. i sure hope it's not true of aileen cannon. but an all the discussion i heard earlier with my -- other saying that it's important to have a speedy. trialed someone said sure it is but a judge slowdown at trial. it's not that i got anything against aileen cannon personally. she's a nice woman. she's a smart woman. the fact is that when she

interfered with an earlier stage of this very case, the investigation. she was outside the coloring lines, she was basically seizing jurisdiction, she didn't have an anonymous conservative 11th circuit flannel. whose members were appointed by donald trump, slapped heard out and criticize there for interfering. so, she certainly has an obligation to take herself off the case under 28 u.s. code section 4:55. which says if anyone could reasonably questioned the impartiality of no business judging a case. so unless they do, that they may not get a speedy trial. >> let me ask you about the defense a moment here, or bill barr did say that the charges are solid, in want to wait and see what the defense looks, like it's been a couple days since the indictment was unsealed, is there any legal

defense strategy here that you can envision being played with the law. whether it's the national presidential records act, or something that the president could possibly make as a legal challenge to this. >> no, very straightforward presidential records act which the president but the cnn town hall, saying that that particular on the contrary the presidential records act which was passed to prevent presidents like richard nixon from hoarding the governmental documents. that requires that they be returned to the government. it's part of the reason why he's in such hot water. he doesn't have a legal leg to stand. on all he can do is try and delay. he can try and get judge cannon who as i say, has been very friendly to him in the past. he can try to get him to slow things down, get her to say,

even though there's already been authoritarian of j.k.. schumm that all the statements by his own attorney or admissible. even might get her to say that the -- but you can't actually use the recorded transcript for something. none of those arguments that i thought very hard about, what they might be. because the smoothest way to look at a cases to see what are the other side's best arguments, and here i just keep coming up empty, i don't think they have any good arguments. >> given how sensitive the material is that we're talking about. here some have talked about the classified information procedures, after what's known as -- the case deals with our country's most second set of secrets. there was some limits on what could be said publicly about the evidence, in order to ensure the trial doesn't expose the sensitive documents, and national security information to the public. some of the really key evidence might never be accessible to the american people.

is that a factor in this, how do you think it will impact the trial and the reception of this case. especially to people who as we know with donald trump and his defenders, are skeptical, politicizing, hiding. informational weaponize every aspect of this trial to their advantage. >> it's a very good question, it's the statute that governs the procedures by which the top secret information, which cannot be safely exposed. it's going to enter the trial. the special counsel's already taken account of that. because of the hundreds of top secret documents, only 31 or referenced, here they have carefully selected those that could either be expose now, without danger or that could be shown to the judge and to the jurors in a closed courtroom. i think they can win

tapes we've been told that they had at -- justice department. and that, a mix explicit reference to, they just lost 30,000 emails, can't we just lose them he suggest replete it way to his attorney the strategy that he believes -- for hillary clinton which is the exact same thing that was on that stump. utilizing to ask voters to vote for him in 2016. the other thing is what it does in the indictment. the work it does in the indictment. is to say that he cannot say that he did not believe a national security was important, . he can't say that the very document that is described in the indictment as having information so classified because it gave away information about our vulnerability to attack as a country. it's very hard to understand how anybody, any politician who

says, that national security that they believe in a strong military, that they are the tough on crime party, can actually look at this and make a statements that we're hearing. including ignoring the varied inconsistent -- in the indictment with what trump said in 2016. >> a law in order part doesn't seem to care about the law and order when it comes to trial. trump, molly what do you make of the u-turn that we've seen from folks like jim jordan, lindsey graham about protecting classified material? we know that their bad faith actors. but even they must know that boxy they're engaging. and and watching jim jordan today say that donald trump declassified the document was probably one of the most awkward cringeworthy things i've seen in television for a long time. >>, yeah that was amazing, and dana bash kept saying you just don't make any sense. none of this makes. and then his argument was basically, she can't do it because she --

that donald trump finds himself, and you need to understand how we got here. , so we want to cut through the noise, and review the major actions that trump and his associates took to bring him to this moment. and indicted for the second time in just three months. and to do that we need to begin a few days before trump leaves office. january 2021, according to the special counsel's indictment trump and his white house staff packed items. including some of trump's boxes in preparation for his departure from the white house. the indictment says that trump was personally involved in this process. a 12 the app on january 20th, 2020, one donald trump ceases to be president. and as he departs the white house those boxes which we now know contain classified material. or transported to mar-a-lago. over the course of the next several months those boxes are centered on a stage in one of mar-a-lago's gilded ballrooms. but then move to a business center into a bathroom and shower stack next to a toilet.

in may of that year, according to the indictment trump directs employees to clean out a storage room in a highly accessible area of mar-a-lago's ground. for so it could be used to store has boxes. trump also direct some boxes be brought to his bedminster residents. that same month realizing documents of trump's presidency maybe this thing. the national archives asking turn over any presidential records he may have kept. those requests are repeated for months. july 21st, 2020, when trump shows a military plan of attack that he says is highly confidential to all writer interviewing him at bedminster. trump remarks as president that he could've declassified at now i can't, that's according to the indictment a month or two later the indictment says trump allegedly shows a classified, not related to a foreign military operation to representative of his path -- that minister. fast forward to november 2021,
