came together and issued this open letter. publicly stating that they would not vote for their party 's nominee, then with aj trump in the upcoming election. these officials warn that the trump presidency would, quote, put it risk our country's national security and well-being. they wrote that then-candidate trump, quote, would be the most reckless president in american history. and what we've learned in recent days in particular makes that that letter of theirs look particularly prescient. prophetic, even. this week donald trump became the first ex president in u.s. history to be indicted on federal criminal charges. in a stunning indictment

unsealed on friday the justice department charged trump with 37 felony counts stemming from their investigation into the hundreds of classified documents recovered at his mar-a-lago resort. those charges include 31 counts of violating the espionage act through will for of classified records. trump also faces six other counts for his alleged efforts to impede the investigation. for the first time we got a look at just how sensitive some of these classified documents retained by trump were. according to the indictment included information regarding defense and weapons capabilities and united states and foreign countries. united states nuclear grams, potential vulnerabilities for the allies and plans for possible retaliation in response to a foreign attack. that's the kind of stuff the foreign intel agencies would, i

am assuming, literally killed to get their hands on. for months that highly sensitive information was just laying around the ex-florida presidents home slash wedding venue. here you can see boxes of documents stored in a mar-a-lago ballroom -- boxes were even crammed into a bathroom at the resorts. the boxes were then moved to a storage room where they were later discovered by trump aide and walt nauta spilled on the floor. you can see a document with redactions clearly visible. the indictment states that the

hallway leading to that storage room, quote, could be reached from multiple outside entrances including one accessible from the mar-a-lago club patio through a doorway that was often kept open. oh how convenient, you can have a day at the pool, dry yourself off and then take a quick stroll down the hallway to indulge in some light reading of our nation's most sensitive secrets. now the truth is we didn't need it full indictment to know how vulnerable mar-a-lago is. remember the ukrainian woman who infiltrated multiple times after posing as a fake heiress? or the chinese business woman who was convicted of a unlawfully entering mar-a-lago while carrying a bag. those are just two of the cases we know about. we can't forget all of the dozens of temporary foreign workers that trump housed to

clean toilets and bathrooms, maybe like this one. how my kids bedroom is more secure than mar-a-lago. this week's indictment makes the criminal case against trump, it was already quite clear that the ex president couldn't be trusted with classified information. remember how kid rock, yes, kid rock told us just last year that in 2017 during an oval office meeting trump showed him, kid rock, stuff about north korea that he probably shouldn't have been shown. so is there any wonder that with that kind of information already out there on top of the new information laid out clearly in the night mint, which i should know includes a transcript of an audio recording where trump admits he knew the documents in his possession were classified. that even some of the ex president now flipping the script. here's trump's former attorney general speaking just this morning. >> i do think that even what

mccarthy said, if even half of it is true then he is toast. it's a very detailed indictment and it's very damning. and this idea of presenting trump as a victim here, a victim of a witch hunt is ridiculous. >> but i'm sure trump will be screaming which hot on tuesday night. today we learned that he plans to get public remarks after he surrendered to authorities during the day at a courthouse in miami. if convicted on everything trump could face up to 100 years in prison that's up to a florida jury and his peers and up to a florida judge, aileen cannon, who rather conveniently he appointed, and who is already ruled in his favor during the early stages of this investigation. a ruling, i should know, that was later overturned. we are months or perhaps years away from a possible verdict in this case. but what is already clear to me as someone who is not a lawyer but as a u.s. citizen is that this man should not be running for high office again. he should never be allowed near classified intelligence ever again. forget president of the united states, forget commander-in-chief. donald trump isn't fit. done trump is just unfit to be the treasurer of the local rotary club. he's a real and present danger

lawyers former deputy assistant attorney general the office of legal policy she served under both bill clinton and george h. w. bush. david henderson civil rights attorney and the cnbc contributor former federal prosecutor and the legal defense. thank you all for joining me lisa let's start with you as a former doj official. what were the calculations behind the scenes, why charge this case in florida with the risk of judge cannon and all of the other stuff? >> i think they perhaps had to charge the case in florida because of the acts that were committed in florida particularly by donald trump. you can see from the indictment that was issued by florida citizens, florida residents who were on that grand jury that there's compelling evidence of had donald trump in florida sought to comply with a lawful subpoena or those documents and even sought to have those attorneys lie for him or remove classified evidence. as you pointed out donald trump is a clear and present danger to the united states, to our constitution, into our democracy. i can't imagine anyone more reckless, to these very important secretly keep everyone safe. our design, help protect our national security, then what donald trump did hear. >> republicans have of course reverted back to the common refrain, but her emails. very briefly please explain to our audience weather is no legal comparison between what hillary was accused of and trump is accused of.

>> hillary is accused of having a private email server where there is information that later turned out to be classified on the email server. very different situation from someone who had classified information, was told not just classified information but some of our nation's most important nuclear secrets, attack plans, vulnerability, so on. was told to return that information repeatedly asked nicely, issued a subpoena, personal visit from the doj. he not only refused to return the material but actually worked with his lawyers and tried to convince them to obstruct justice, to lead a law enforcement, ultimately that was in obstruction of justice. >> and david, i want you to respond to this tweet from republican lawyer mike davis, former chief counsel of nomination for the senate judiciary committee. he argued that trump was allowed to have those,

documents under the presidential records act because those are his presidential records and he received them as the president, classified or not but that's not with the presidential record access, is it? >> not at all. keep in mind when you talk about the presidential records act you are talking about a series of laws defining what a presidential records to how it has to be maintained and under what circumstances information can be excluded. we are talking about these broad statutes it's best to understand them through analogy. when a doctor is treating a patient in a hospital, a doctor actually has a duty to document certain information for the benefit of the patient. the president has a duty to document certain information for the benefit of the people. if the doctor stops working at the hospital, he is here she is not allowed to take the records with them. if they ask to because they say these are my records, my thoughts, my ideas. and i was the person making the

call. the hospital is going to say that is correct. but as administrator it's our responsibility to maintain those records for the patient. and here the archives are saying the same thing. we have a duty to maintain these records for the benefit of the people and the moment you leave office they belong to us. this will be like the doctor saying hang on if i want to take them home and keep them in my bathroom and look at them on the toilet by gully i should be able to. if i want to show my friends that come over because they are curious about him or trump people who wonder into a ballroom i should able to do that too and that is absolutely ridiculous. >> the idea that the nation's nuclear secrets are his personal records is absurd. the case is set to be overseen by trump appointed judge aileen cannon. she's clearly biased, we saw that last year. can the doj do anything to challenge that, to force her to recuse? or are they stuck here? >> i think they could ask her to recuse and certainly as you point out during the early stages of this case she was putting her thumb on the scale of justice for the president who appointed to such a significant degree that the 11th circuit which is one of the most conservative circuits

in the country in a panel of republican appointees criticized her. i think she should remove herself, i don't think she ever should've been confirmed in the first place based on her lack of experience for such a position. -- >> i suspect she won't go voluntarily, lisa. >> in a new piece for politico you run with the timeline for the trial which everyone is interested in. why is that is there any way for jack smith media to hurry up? >> it's difficult because jack smith included a lot. 31 counts related to the specific pieces of highly classified information. there's an act and the statute is true there that will actually allow for appeals if the discovery disputes and other issues that come up between the parties. those appeals, of course, they put everything on pause jack smith would have to narrow down in his indictment -- typically in a national security case the government the government actually allows the government to have, the defense to have access to information but tightly controls how it's presented in trial. you have to lay down on that petition to reveal some secrets in order to try to sweep the trial alone. >> last quick question to you, if you are trump's defense lawyer and looking at this transcript of an audio recording in which trump admits he has caused by information, but what you do, what would the defense be?

watching hollywood spy movies like mission impossible. they thought it was supposed to be really hard to get to classified documents like the knock list. but apparently in real life you can just walk into a florida resort bathroom and stumble upon some of our country's most highly confidential information. nuclear secrets, even, and no need for any tom cruise-esque stunts. so putting aside the federal charges donald trump is facing for hoarding and refusing to turn over these documents we have to talk about the undeniable national security implications of it all. according to the indictment there were tens of thousands of guests doing an out of mar-a-lago while the boxes were

how concerned are you that there were breaches, that this stuff got shared with the wrong people or taken by the wrong people from the bathroom for the storage closet? >> i'm very concerned because trump has a long pattern of treating classified information badly for months into his ministration he had the russian foreign minister and ambassador in his office. he shared classified information from a foreign ally with them. throughout his administration he tried to put his own people in charge of the intelligence community because he was more concerned with loyalty that he was with the ice city. and he regularly denigrated them including standing next to vladimir putin and i have the situation where a location that was clearly one of the most targeted by foreign intelligence services he had

nuclear records, he had records of foreign warplanes. he had records of if we were to have them to vote could put him and assets at risk, could put allies at risk. he didn't care about any of it. he knew it was illegal and he obstructed the effort to get it. >> so douglas, during your time with the cia you, how worried you were you at the time that he would hold on to classified documents on to the paperwork and misuse them and expose them later what steps did you take the agency to protect secrets from the commander-in-chief? because according to the indictment he had top secret stuff from the cia mar-a-lago. >> you camelback top secrets from the commander-in-chief. you have to find a way that he gets to use them in an effective way that hopefully protects you from compromise. the inclusion of sourcing was done in a way that was a bit more ginger to make sure the he would not give the names of the individual. the indictment that we saw 31 document cited two cases of the former president discussing the sensitive information with

writers, journalists, political activists and stuff like that. a fear that the tip of the iceberg. because the department of justice is going to document what it can prove. the intelligence community is worried about the attacks taking place that we don't know about, we don't know what the president intends was. this information could expose human beings and millions of dollars of technology. >> you mentioned expose human beings, douglas. there's a new york times story from 2021 that is doing the rounds on social media right now about how the cia has been losing dozens of informants particularly those recorded from other countries to spy for the u.s.. could this theoretically be one of the real world consequences of failing to guard the nation's top intelligence information? >> theoretically you can't dismiss it. the intelligence community would've done extensive damage assessments. at the time the president was still transitioning. these documents had not become the force majeure they have. i think the problem is it's going to be intelligence

community resources our own agents, our own technology -- it's gonna be our best way to know if we can trace it. when we talk about donald trump as a national security threat it's not just in terms of our intelligence and our secrets and how reckless he has but also the violence that he insights. when you see plans for maga folks to turn up at the courthouse on tuesday to protest trump's arraignment. when you hear prominent trump supporters like kari lake suggesting 75 million republicans with guns will protect trump from the justice system. how worried are you about pro trump violence in the coming days and weeks? >> very worried about it. the fbi director said that it was actually domestic terrorism that was the greatest threat we face. particularly extreme right and white supremacists, domestic terrorism. and those are the people who form trump's base. you've gotta ask yourself how stupid is this guy? because here he is calling for

exactly the kind of action he called for on january six in an attempt to intimidate the prosecutor who is also prosecuting him for january six. . the moment he attacked our democracy, he's trying to recreate it. i'm worried about it but he should be worried about it too because it's really going to damage the other big case which is looming off in the future. >> you questioned how stupid this guy could be the title of multiple books about donald trump and his legacy. >> ahead, oh the hypocrisy. republicans are flipped so many times on the importance of securing classified information they must have vertigo. first, richard louis is here with the headlines. >> president biden offered assistance as state leaders fall >> -- that incident occurred after a fuel tanker caught fire. philadelphia's mayor says there were no deaths or injuries. nicholas sturgeon, the former leader of the scottish nationalist party was arrested over financial misconduct. sturgeon was. questioned over allegations of funds for a scottish independence campaign had been diverted elsewhere. she was released without being charged pending further investigation. and novak djokovic, won the french open at roland garros. this marks the 23rd grand slam singles title for djokovic. they get on the record for the most major singles title and all of men's tennis.

an election campaign and how they reacted to the indictment of donald trump on 31 counts of violating the espionage act of willful retention of classified information. senator marco rubio of florida had already dismissed trump's mishandling of top secret documents last year in the wake of the fbi search of mar-a-lago as simply a storage issue. on thursday he told the conservative media outlet, the harm, the harm created by documents being stored and biden's carriage or wherever it's far outweighed by the harm of bringing this indictment. that's weird because in 2016 this is what he said about harm in the context of hillary clinton and classified documents. he said there is simply no excuse for hillary clinton to set up a home cook emo system

that left sensitive information vulnerable to theft and an explanation exploitation. her actions were grossly negligent, damaged national security and put lives at risk. then senator ted cruz called the indictment of trump an assault on democracy, garbage, a political attack. and yet in april of 2016 crews fired up the crowd with a valid to keep democratic front runner from the white house and possibly behind bars. i've got slightly different government housing. and the crowd of that cruise rally in california slapped up hillary for prison badges after the event. how about florida governor ron desantis? he didn't think trump did anything wrong and instead tweeted on thursday in response to the indictment, the weaponization of federal law enforcement represents a threat to a free society. and yet a much younger congressman desantis -- he was removed from the gop oversight committee in 2016 which held a hearing to slam james comey for not bringing charges against clinton. even if desantis asked at that hearing american lives are at stake a lot of people are upset that there are no consequences for mrs. clinton. desantis wanted consequences for clinton but not for trump. meanwhile kevin mccarthy tweeted on thursday that it's a dark day for america and i and every american it believes in

he's running for president is the tough on crime party telling career criminals to just run for president because that apparently gives you immunity from any and all prosecution. >> their defenses of donald trump they are the party of law and disorder now and they actually work as the law firm for donald trump with jim jordan being the managing partner. what's so striking to me that i've seen this before as a prosecutor is that they are offering donald trump defenses that he does not even want. i've heard so many different defenses from lindsey graham and jim jordan about about the national archives and the presidential records act but at the end of the day what donald trump is saying is if i did it legal. because i did it. and that relates to everything. it's a perfect phone call when i shake down president zelenskyy because i'm the one that made the phone call. the other point here is what was the alternative.

being accused of in this indictment are true, which all signs lead to that being the case the me to call a spade a spade. what we he did was wrong, he had no right to hold on to these classified documents. and when he was asked to return them he refused to do so and then try to instruct his lawyers to hide them from the fbi. this is not okay and i believe that if you wouldn't leave your social security number on the open for people then you should be outraged that trump left some of our nation's top secrets in the bathroom in mar-a-lago. this is a national security issue and republicans in the 2024 field need to be calling it out and be more concerned with our nation's national security then trying to win over trump voters.

i certainly believed in a lot of the policies that we enacted during the trump administration and i'm proud of that time and being able to serve our country but i think that i felt a duty to serve our country at the white house because i want the white house staff to be people who are of good character so if it wasn't someone like me in those positions then who would be filling them? and that's what i'm most concerned about now is if donald trump gets back into the white house who will be staffing them because i think the type of people he is surrounding himself with as of late clearly are encouraging his worst instincts. >> understand the argument and it's a fair argument. if we are not there there will be worse people there. i get that, but at the same time to accept the counter argument that by being there, knowing the man he was, to quote you. this is a man who called mexicans rapists and kidnap children from their parents, told a black congresswoman to go back where they came from. that you are complicit in that as well. but you are going to have to carry that around. you did the right thing in the end but there was a period where you were working for a man who you knew was off the charts. >> i certainly have some regrets and i think as a spokesperson for him it was a difficult job because you are not always going to agree with 100 percent of the things he said. as you outlined some of those things were very offensive but
