before he appears before a judge. now trump says that he'll plead not guilty to charges connected to his handling of classified documents. and of course as you may know, this is his 2nd indictment in 3 months. despite that growing legal peril that he finds himself and during an interview with political last night, trump vowed to continue campaigning for president even if he were convicted. now that's not entirely shocking to be honest. trump never admitted defeat after losing the 2020 election, he's not going to tap out of the 2024 race when it's just getting started. there's more to this move then his inability to back down. it's not about politics, trump's 3rd white house bid has a bigger strategy at its core. as axios explains, for donald trump 2024 campaign is more than a race to return to the white house. this is a fight to stay out of prison, legal experts believe

or using these motions to claim partisanship. we saw that in new york, when he went after the new york state attorney general, and her investigation and claimed it was a partisan witch hunt. used to digicel process to do, that so i think we're gonna see very aggressive motion practice. we're gonna see lots of politicking in those. motions and they have very little to do with the law. and many of us looking and reading that indictment are sitting there thinking, i'm glad i don't have to come up with it. because it's very hard to come up with one, and if it were not donald trump i promise you the lawyers for anybody facing the evidence and that indictment would be saying we made a plea

their there are reports that some trump supporters are calling for violence ahead of this arraignment on tuesday, what are you most concerned for as we approach the state and the people that are involved with our beach ox met, or the judge or any of the attorneys that are working this case? >> well, first of all i think we all need to be concerned about the rise of hate and violence, it's affecting us across all communities and we're seeing a 36% rise in antisemitism, the majority of folks facing hate and bias are black, lgbtq is a massive rising number as well, it's simply to stay we're seeing proportions of rising violence that is unique and has been on the rise. and frankly since donald trump took office, here's the thing

we need to worry about, we need to worry about the fact that there are those individuals who are paying attention to the disinformation, and the rhetoric that's been ratcheted up, just as we heard the rhetoric from donald trump before january. six and have an impact on how organized hate, the proud boys, the oath keepers face prosecution actively engaging and working with one another and had discussions with one another organized but in this case. thanks to the prosecution more hearing from groups like the southern poverty law center. which is one of the member organization leadership conference on civil and human rights that tracks it has said, look, the prosecution is good, but it's driven it down to local level. what we have as more local organizing, and those individuals who show up are the ones that we need to worry

about but i will say this what we saw on the mobilization around the midterm was a fear of heightened violence and usually there is an election cycle we saw affective management of that threat so it's important for us to understand those preparations being taken from law enforcement side, it's really important that we have community leaders and communities organizing with one another. this simply counter as you point out of joe biden, which is to stand up and say, it doesn't matter who you want to vote for, doesn't matter what your politics are, none of us

his indictment was unsealed people who are once pivotal in defending trump they're speaking openly about trump's flagrant wrongdoing in this case what is the say about the case that jack smith laid out so far? >> the case is devastating, it's very rare that i find myself agreeing with bill barr but in this instance it's not a matter of opinion of course it's a presumption of innocence but i would urge your viewers to read the indictment it's really our easy rate, very easy to raid, it's filled with statements from trump's own, recorded statements, transcribe statements, filled with statements from his own attorney with the attorney high prevalence was held not applicable here he was using his attorneys to commit serious felonies, felonies that endanger all of us, he was essentially stockpiling

informational weapon ions of mass destruction. and then showing them to people. the indictment goes through instances, to them from bad where he showed top secret documents, documents about military plans, how would react if attacked. what are the military strains, the weaknesses of certain adversaries, stuff that he said out loud. this is top secret, i shouldn't be showing it to you but take a look. so there's just no way to read this indictment. and i think that there is some kind of defense. >> speaking of defense -- >> the defense might be a judge who's in the tank. i sure hope it's not true of

aileen cannon. but an all the discussion i heard earlier with my -- other saying that it's important to have a speedy. trialed someone said sure it is but a judge slowdown at trial. it's not that i got anything against aileen cannon personally. she's a nice woman. she's a smart woman. the fact is that when she interfered with an earlier stage of this very case, the investigation. she was outside the coloring lines, she was basically seizing jurisdiction, she didn't have an anonymous conservative 11th circuit flannel. whose members were appointed by donald trump, slapped heard out and criticize there for interfering. so, she certainly has an obligation to take herself off the case under 28 u.s. code section 4:55. which says if anyone could reasonably questioned the impartiality of no business judging a case. so unless they do, that they may not get a speedy trial. >> let me ask you about the defense a moment here, or bill barr did say that the charges are solid, in want to wait and see what the defense looks,

like it's been a couple days since the indictment was unsealed, is there any legal defense strategy here that you can envision being played with the law. whether it's the national presidential records act, or something that the president could possibly make as a legal challenge to this. >> no, very straightforward presidential records act which the president but the cnn town hall, saying that that particular on the contrary the presidential records act which was passed to prevent presidents like richard nixon from hoarding the governmental documents. that requires that they be returned to the government. it's part of the reason why he's in such hot water. he doesn't have a legal leg to stand. on all he can do is try and delay. he can try and get judge cannon

who as i say, has been very friendly to him in the past. he can try to get him to slow things down, get her to say, even though there's already been authoritarian of j. k.. schumm that all the statements by his own attorney or admissible. even might get her to say that the -- but you can't actually use the

recorded transcript for something. none of those arguments that i thought very hard about, what they might be. because the smoothest way to look at a cases to see what are the other side's best arguments, and here i just keep coming up empty, i don't think they have any good arguments. >> given how sensitive the material is that we're talking about. here some have talked about the classified information procedures, after what's known as -- the case deals with our country's most second set of secrets. there was some limits on what could be said publicly about the evidence, in order to ensure the trial doesn't expose the sensitive documents, and national security information to the public. some of the really key evidence might never be accessible to the american people. is that a factor in this, how do you think it will impact the trial and the reception of this case. especially to people who as we know with donald trump and his defenders, are skeptical, politicizing, hiding. informational weaponize every aspect of this trial to their advantage. >> it's a very good question, it's the statute that governs the procedures by which the top secret information, which cannot be safely exposed. it's going to enter the trial. the special counsel's already

taken account of that. because of the hundreds of top secret documents, only 31 or referenced, here they have carefully selected those that could either be expose now, without danger or that could be shown to the judge and to the jurors in a closed courtroom. i think they can navigate that but would be unusual with this trial and most federal charges -- in realtime. the only way that we can judge [inaudible] the only way that could satisfy the proof -- regardless of this guilty [inaudible] when certain -- that's normal. much of what the indictment reveals, [inaudible] -- but much of what the indictment reveals is not top secret. the indictment describes the attempt to hide material, to lie to the government about what they're material marked top secret had already been

turned over. all of that can be introduced. but it is critical. and i think the chief justice of the united states has an obligation to make an exception to the judicial conference, to the usual blackouts that accompanied charles. you know when -- aileen cannon, looks like she is going to be presiding over this case went through this bizarre exercise of appointing a special master's, she was anything but transparent. she wouldn't even allow coverage of what was going on in the courtroom until the end of the day. and then there would be a readout or report. this trial has got to be transparent. because otherwise we are not as a nation going to be able to assure ourselves that in this extremely important contacts where he was essentially stockpiling the material of potential treason.

it's very hard to understand how anybody, any politician who says, that national security that they believe in a strong military, that they are the tough on crime party, can actually look at this and make a statements that we're hearing. including ignoring the varied inconsistent -- in the indictment with what trump said in 2016. >> a law in order part doesn't seem to care about the law and order when it comes to trial. trump, molly what do you make of the u-turn that we've seen from folks like jim jordan, lindsey graham about protecting classified material? we know that their bad faith actors. but even they must know that boxy they're engaging. and and watching jim jordan today say that donald trump declassified the document was probably one of the most awkward cringeworthy things i've seen in television for a long time. >>, yeah that was amazing, and dana bash kept saying you just don't make any sense. none of this makes. and then his argument was

that donald trump finds himself, and you need to understand how we got here. , so we want to cut through the noise, and review the major actions that trump and his associates took to bring him to this moment. and indicted for the second time in just three months. and to do that we need to begin a few days before trump leaves office. january 2021, according to the special counsel's indictment trump and his white house staff packed items. including some of trump's boxes in preparation for his departure from the white house. the indictment says that trump was personally involved in this process. a 12 the app on january 20th, 2020, one donald trump ceases to be president. and as he departs the white house those boxes which we now know contain classified material.

distributed to all the republican members, and that's what they said. they didn't care about the facts or the law. it's very disappointing and it doesn't bode well for the country that some of the leaders would basically try and undercut our system of justice. just to support when man. it's not the way we should act. >> trump said that he won't back out of the race, even if he's convicted. i have to partner for you, are you concerned that trump might try a pardon himself if he wins in 2024, or requires a running mate to promise to pardon him if he's required to resign, or do you think that this is going to be a referendum on this particular issue in the 2024 race? >> i think it's a certainty that he would pardon himself a seat convicted. i don't think there's any scenario where he wouldn't do that. obviously, he has a right to run for president. he is running for president, he's, we had a nonmainstream
