around 5:30 pm last night in a washington crossing area when emergency personnel arrived at the scene, finding several vehicles in high water and see bodies of two women in the man found outside of their cars. and this, morning officials confirmed two more people have died. >> i can say as a witness to that in my 44 years of not seen -- with approximately six up to seven inches of rain. when they wander came up, you came a very swiftly. we do not think that anybody drove into it, they were actively on that roe. the road was approximately 45 feet of water over the road. >> nbc's kathy parks will bring us live there on the flooding in just minutes. in the, meantime our crews are definitely on the scene. so we will have that for you very shortly. pennsylvania is one of the places under the northeast under flood alerts today, and we're giving you a look at hartford, connecticut as well

as boston. those are just two cities that are also under tornado watch right now. nbc news meteorologist michelle grossman is keeping you so busy from the heat to the rain but today let's talk about the worst rain, where it is and how bad it's going to get. >> hi, there alex. i love about 50 minutes from washington crossing so we heard the silence sirens last night, that rain coming out fast and furious. that's what we're seeing. today a lot of grants from new england to parts of virginia and the mid-atlantic, looking at really saturated grounds. all the rain will be runoffs. we have -- the really high and we'll see you throughout the day. let's take a look at, this we hit 66 million people under flood alerts weather flood watch or flash flood warning. the streets are flooded as well. we have a life-threatening situation if you are out and about. we have flood warnings, that means that floodings are happening now. those in the dark right here on this map. portions of new england into the northeast and mid-atlantic

are seeing heavy rain falling. this is what it looks like on radar. where you see this brightest colors, reds and oranges and yellows, we are seeing the rain falling and look at some lightning too. severe weather concerns and that tornado watch for portions of the northeast as well into new england. taking a look at this map you can see how quickly it is moving. sort of trading over the same areas. what's that means -- the same area over and over and over again. we're seeing five or six inches of rain in the same spots. we're looking at this bright colors again telling us where the heavy rain is falling. a lot of the northeast into new england mid-atlantic seeing some very heavy rain. where you see those pink lines those outlines is a tornado watch which extends to portions of new england into the northeast and also the mid-atlantic. this is not until 3:00. so we're going to continue to watch. that this is the severe weather threat is not just the northeast. we're talking with the planes to but really focusing on the northeast because of that heavy rainfall with the storms. we could see winds gusting up to 60 miles an hour, ground so saturated. and we'll see some trees coming

down with some power lines. so we could see some power outages with any of these storms. also could see some hail and even the chance of a tornado or two. i know that earlier today we had a tornado warning. portions of mcgovern county. this is what it does to us. it is a slow-moving cold front moving through that warm humid air. we'll be watching this as we go throughout the day along with the heat affecting so many of us as well. back to you. >> i tell, you i hope you're no safe. that is very unnerving to hear about the kind of rain and tornado watches. thank, you my. friend we'll have more for all of you on the impact of that record breaking heat. a live report from phoenix a little later this hour on that. we are going right now to another story breaking this hour. the capture of that escaped inmate in pennsylvania. the manhunt lasted four days until last night when he was captured in a residential area. now, for the first time we're hearing from the homeowners behind to his capture and the details are fascinating. nbc's george soliz is joining us with more on all of that. george, what did you find out from this couple?

>> yeah, alex. really remarkable story, a number of law enforcement officers searching for that inmate for nine days. he turned and was found in the backyard of this couple, thanks to their barking dog. it is hard to believe that as we eventually led to law enforcement to the inmate, michael burns. they were sitting in their yard and say that their dog, a lap, was a plan. they go into -- their area and did not come back which is unusual. then the dog starts to bark, the husband goes and find the suspect, michael burrow there. they ask what do you? doing he says i'm camping. he says i cannot buy for that for a minute in races and calls 9-1-1 and of course than a large law enforcement presence. then on their home and very shortly after as we know the suspect was apprehended and there is a video of those images circulating of his capture. very dramatic things playing out there and they had no idea that they were shot of that

this was even unfolding in their yard. let alone right there in front of their home. i spoke with him earlier today, here's what they told me. >> we get in the golf court to go see what he is barking at, so we get into the creek and he is still barking. a gentleman stands up and i asked him, what are you doing? he says i am camping. i, say all right have a nice day. then -- she was out of the gulf creek at the time, i get back in the golf cart. we were not halfway up the yard a look -- down when i know exactly who that is i've seen his pitcher. he is one of the news. i'm thinking that this guy is long gone, and even around anymore. but since he started never shown i see all the tattoos he has, and his, face and i say no. you know the gulf part, let's go. >> waste of pace with demand that everyone is looking for, alex. so that was -- and his wife cindy. you know there was a reward for information leading to the arrest of this inmates. and of course they believe that

they will definitely likely be able to get them. they're also hoping to reward the dog because again if you think about it had not been for tucker, which is the dog's name, all this would not have unfolded. it's a very remarkable story there alex. >> it is remarkable. gosh, win-win for everyone. what in the street observation from that couple. and the dog. george, phillies thank you so much for the story. more storms developing this. our the senate is preparing for a possible face-off this week. it could take up the pass defense bill. several controversial amendments were passed by the republican-led house, and they include restricting pentagon policies on abortion access and transgender health care and diversity programs. earlier today, senators on both sides made clear where they stand. >> i hope all these measures stay there because, again the military should not be paying for abortion tourism or diversity consultants or sex change operations. they should be buying the weapons that we need to defend our nation and to support our troops. >> my hope is that we will in

fact be able to pass a clean nda that really meets the needs of our department of defense, our families and our people. >> and as u.s. made cluster bombs are now in the hands of ukraine this weekend, the biden administration is giving an update on ammunitions. after the president said that the u.s. was running low. here's national security advisor jake sullivan on meet the press earlier today. >> our current plan is not to replenish the stockpile but rather to build up the capacity to produce the unitarian round of the 155. the non -- brand of ammunition. we began that process months ago as we anticipated the need for continuing supply to ukraine. but it takes time and that is why we need a bridge. >> and former president trump is revealing that he could look to his republican primary competition to fill key roles if he were to win another white house term. >> is nobody on that stage who you see is a potential running

mate? >> possibly, yeah. either way some good people on this stage, actually. some very talented people. i've been impressed by some of them. i think you've good potential cabinet members, too. >> let's go to nbc's mike mentally in washington for us. , mike welcome. what are we hearing from the white house today about the controversy surrounding the national defense act? >> yeah, alex. this defense policy bill as it is known here inside the beltway is really unique in washington. yes there tend to be some bipartisan skirmishes between democrats and republicans and the committee as it is working its way through the congress but ultimately it is something that tends to pass with significant bipartisan support. in fact you often see this bill as a source of tension between the white house and congress rather than the traditional washington conflict between democrats and republicans. that is obviously changed as you've seen a group of republicans in the house pushing for these so-called anti-woke amendments to be added to the defense policy bill.

and today's top sullivan was making the rounds on the sunday shows he really offered a most full-throated response back from the biden ministration that we've seen so far. take a listen. >> this legislation is never getting to the presidents dak. what you have seen from an extreme group of republicans is to put forward a set of amendments that's trying to mix domestic social debates with the needs, and the security gates, of our nation. the should be an area where politics stops and national security starts. we believe it at the end of the day after the senate has done its work, after the sun has come back together with the house, that we will end up in a place where there is a broad bipartisan bill that can go to the presidents desk and be signed. >> now alex, remember that the republicans who are pushing for these amendment votes in the house say that they were really inspired by the fight that is being waged in the senate by alabama senators tommy timberville. similarly over controversial abortion. he is using that to hold a number of military promotions.

sullivan also on the sunday show is pushing back there, saying that for the first 150 years we do not have a confirmed marine corps. that we are running the risk of not even having a chairman of the joint chiefs of staff, if this hole is not lifted us 11 point. it then the simply has to stop. we're gonna hear more from the white house as the week moves on. and continuing to keep the pressure up on timberville and on other republicans to also put some pressure on him as well. >> i know you are under persons right on that one. as usual. thank you mike mentally, appreciate. that back to the news on the deadly flood we were talking about from pennsylvania and kathy park is now joining us on the ground in washington crossing. what is the latest on the search efforts? we are talking about two, infants right? >> hi, alex. good afternoon, we are just getting to the area right now but according to officials, they are still looking for three people. they are looking for an infant and also a two year old. a toddler. so there is still an active

search effort underway right now. officials also confirming for fatalities but earlier today we heard from the fire chief in this area. he said this is a weather event that he has not seen in roughly four decades. the rain came down so hard and fast, he thinks 6 to 7 inches all in under an hour. and that is why so many cars got stuck on the roadways. we were just on taylorsville road a few moments ago and you can already see the damage done by the floodwaters. the roads even buckled over there. here's a little bit more from tomorrow or about this how, how this happened so quickly. take a listen. >> we can tell, you tragically, we are looking for two children from the same family. one boy who was nine months and one female who is -- his little sister, who is to.

we are attempting to locate one more female adults at this time. at this time, we have no further information. >> and alex, right now we are told that there will be another update later on this afternoon. fortunately they believe this is going to be a recovery effort. right, now we know that dozens of folks are out there right along the creek thanks. ongoing with a search efforts and they are hoping to find the missing person at this point. they're saying that the area here is very narrow, especially along those roadways. we have seen the incline so that proves that they are up against a lot of challenges. not to mention the ongoing weather situation here. there is still a flash flood emergency still in effect. we have seen downpour even getting to this area. so not only are they dealing with the elements currently but also the damage in the area.

shortfalls that our services are facing. and instead it will only make it more difficult to recruit americans on diverse backgrounds. representing the true makeup of our nation. what are you so afraid of? why do you keep bringing the divisive issues to the body of this floor? you are out of order, you are exhausting. but >> joining me now is that man, nevada congressman stephen horse for democratic member of the financial services an armed services committee. he is also chair of the congressional black caucus. i'm glad to have you here. give me your sense of republican intentions with these amendments. is it really to help service members? >> absolutely not, thank you preferably on alex. as you indicated i am a member of the armed services committee. i have worked in previous congresses to make sure that we put our military service members and their families

first. the amendments that were brought to the floor were actually rejected and defeated in committee and the twilight is speaker mccarthy that conceded it to the extreme maga faction of his cotton chris that allowed the amendments to be brought to the floor and that will deny access to health care for service members that are employed due to no fault of their own and no control over where they are deployed. if they happen to be deployed to a state that does not provide health care services because of bans by extreme republicans, in those states, then they are denies that care. but because of secretary austin's directive, those services can be provided in other locations. they also wanted to defund and eliminates the chief diversity officer position. more than 40% of the service

members that serve our country our service members of color but. black and latino and asian americans. who served our country -- and it is going to continue to grow. so my question to the maker of the motion, the amendment, mr. gaetz, is what is he so afraid of? the growing diversity of this country? every time he uses the word woke i really think that he means black. and he really means anti-black and anti-people of color, and it is why i thought it was time to call him out and that was like in the door trying to divide our nation. >> when you get very forcefully, and i would love to have you back on when you get a direct answer from him to that question. that said, will the democratic led senate strip out these contagious measures when it takes up the bill? >> it must. the senate democrats have to put national security first. that includes the diversity of our service members.

and these most egregious amendments that are now included in the house version must come out. otherwise we jeopardize having the defense authorization act not implemented. it is a must pass a bill. i have voted for it every time in the past. it has been done in a bipartisan way. but sadly we have these extreme factions that wants to use culture wars to divide our nation and prevent us from carrying out our duty as members of congress. this is not what we should be doing at a time when our military men and women around the world are putting their lives at risk. i have for military installations here in my district and at -- an air force base. among others. and i meet with him all the time. they are service members from all walks of life. from all backgrounds, and they deserve to be respected in our

military as secretary austin says. diversity is our strength and we should promote that. also one last thing alex, i found it interesting that republicans always think that government should operate more like a business, well all the major defense contractors that do work have diversity officers, heads of diversity and global diversity forum -- for lockheed martin and for other companies. so isa good for them and not good for the department of defense? and our u.s. military? >> yes, and ironic point you put up right there. let me ask you about this. because there is outrage growing this weekend, after arizona republican eli crane used a derogatory term during his debate over the bill. take a listen to what he set. >> my amendment has nothing to do with whether or not colored people or -- people or anybody can serve. okay? it is nothing to do with colored or --

>> mr. -- ! >> -- or any of that stuff. >> the congressman was asked to amend what he said to people of color later said he misspoke. his words were stricken from the record. just bleep the tape. what's your reaction to hearing that and what is your message to the congressman as chair of the cpc? >> members like representative crane and matt gaetz and timberville prove every day why diversity equity and inclusion are actually needed. and it also proves why the opinion from chief justice roberts and justice clarence thomas that we live in a color blind society are false. the word colored being used on the floor of the house of representatives and the year 2023 in a debate around equity is unprofessional and unbecoming of a member. we called representative kate crane to apologize to our

colleague, representative beaty and to the members and for him to seek diversity training himself. which is offered through the house of representatives diversity office. >> let me just say, i think there are many people as americans who are going to find that very offensive. let me ask you one more question about the u.s. made cluster missions. you know they're in ukraine now, for about a week or so after president biden made the controversial decision to send them. it comes as we learned the wagner group is no longer on the front lines. so where do things stand in the war in ukraine? do you think this could be a turning point? i would remind our viewers that we heard national security advisor jake sullivan saying the u.s. is working on scaling up production on a low supply of ammunitions. i'm curious how critical that is right now. >> look, we've done everything that we can as a country to support ukraine and to build the alliance through nato to ensure that this is not something that we are doing alone or that we're doing not

overnight and the campaign trail. that they can pay shop for on desantis is roughly a dozen staffers have been let go. new campaign finance numbers show flashing warning signs for desantis, and most of his cash coming from donors who have maxed out. speaking in florida last night, trump tells desantis to get home, accusing the governor of neglecting states needs as insurance companies flee the state. nbc's garrett hague is joining me from west palm beach and garrett is good to see you again on the sunday here. you were there for trump's speech. are you detecting a new energy in this campaign attack on run desantis? >> yeah, alex. i do think it is the case. trump and his allies clearly smell blood in the water when it comes to ron desantis and they are not backing off. the speech last night was an hour and 40 minutes -- and it was mostly focused on education topics and culture war topics. he's speaking to a group of conservative activists who are

currently doing asa hutchison pretty gusty behind me. it is not just -- on the stage it is a pretty pro trump bias. obviously anti trump, very critical of trump candidates. but donald trump is clearly directed the detected there is weakness in the desantis campaign and his poll numbers are going the wrong direction and he's putting gasoline on that fire. here's some of what he had to say about his chief rival onstage last night. >> we are totally dominating the sank disarray here in the state of florida. so we want him to get home and take care of his insurance because you are the highest insurance in the nation. of all the people there supporting, him saying wait a minute you're down by 50 points. the sanctimonious are spending so much time in many dividing the party and he's wrapping so quickly so it's probably not going to be second place much longer. i wonder who is going to be? maybe it is the back.

>> and, alex and is the crowd behind me chance donald trump's name it just gives you an idea of what a home game this was for the former president. how will that message was received. a lot of these folks are for florida residents and they voted for on desantis as the governor. so trump's line about that being the job he helps to return to has some strategic value. i'm not saying he is a bad guy or bad conservative necessarily but that he ought to stay right near the sunshine state. >> hey garrett, i want to look together to this politicos who won lost and face planted in the presidential money race. in which they say nearly every candidates fundraising came with a caveats. i know you looked at over in-depth. what stood out to you? >> nbc's done a lot of reporting on this too. the bottom line to me is the candidates not named trump all have varying degrees of trouble raising money or looking like they will be able to continue raising money. look at mike pence for example.

he raised just over 1 million. dollars he is in danger of not making the debate stage and not meeting the requirements, aluminum requirements to make the debate stage. that is shocking for somebody who is a former vice president of the united states. then we get to the santas here is a good caveat, for example. he raised a ton of money, it's like $70 million between -- in his campaign. a lot of that money's general election money. a lot of money for people who gave him the absolute maximum donation. we knew that they cannot give again. he is maxing out from the people who love him and potentially having a hard time finding people who like him to help keep the campaign going. here are the last time several laid off stoppers as a cost cutting measure. we're only a few months into this campaign and that is not a position you want to be in right now. >> and listen, there is the answer to the question everybody. we asked earlier which one filet supplanted? it was mike pence. thank you garrett hague. good to see you, my friend. there is no information about that suspect in a new york murder spree. you might be surprised with 88

americans are suffering under the extreme and unrelenting heat wave. more than two dozen record highs are likely today. like in las vegas where it is just a little past 10:30 a.m., it is already a scorching 36 degrees. this is on track to tie the all-time record high of 117 degrees today. in el paso, texas, poor air quality and ozone pollution or concerns there. you can see the haze of the mountains from the hot and stagnant conditions. finally, the phoenix where the city looks is breaking its 25 year old record high today of 118. degrees nbc's marissa cara is there, i'm sorry to say for you. there was already passed 100 degrees and all the way up.

so how are people there coping with this historic heat? including you, my goodness. >> hey alex, it's a bit hard to hear you right now but i can tell you that it is hot. sweltering we. hot we are going on 17 consecutive days of temperatures over 110 degrees. so it's pretty obvious where i am right now, at the phoenix fire department. one of the reasons that we are here is that they have been so busy. i want to get to something in this entire segment here is i want to stress that in terms of how the heat has felt it really depends on who you are and your circumstances. you're gonna have a totally different experience if you have access to our conditioning. that may not be that that, you just have to run to and from the car. it is only hot for a minute or two. but if you are stuck outside for one reason or another, when you don't have a home or some other circumstance, then that is it where this can get not only dangerous and uncomfortable but even deadly. that but i want to get to what we saw. with a chance to get inside of an emergency room yesterday.

impactful the conduct was. how potentially dangerous. and how well crafted the indictment is. so i certainly would agree with that assessment. but >> let me take through just a few of the arguments. this is from trump's legal team and they're filing seeking to delay the start of his trials be on the 2024 election. first up it says there is no reason for any expedited trial. then it was the. legal questions are significant and present issues a first impression. the presidential records act in the various criminal statutes that issues had never been addressed by any court. propriety of utilizing and the secret evidence in a case of this nature, and then potential inability to select an impartial jury during a national presidential election. i should think about all of these, are the substantial legal arguments or is it more kind of a wildcard? and nothing to lose tight proposal? >> i think it is the latter. and i think that special counsel jack smith's team

smashed it down pretty handily. i think that they pointed out that these issues are not in fact novel. the presidential records act is a complete red herring. it is absolutely an opposite. and it is nothing to do with these proceedings which are criminal in nature. and the parade does not address criminal conduct. so i think that they very quickly i think and concisely and forcefully pushback on that argument and say you cannot just attack something as novel and then ask the courts to push off the trial date indefinitely. on that basis. and they said that this former president should be treated just like any other criminal defendants. everybody has a schedule. the fact that this particular defendant is running for election is not a basis. he can work around that.

and the administration of justice requires a speedy trial. both the defendants and the government, the people, deserve that. so i think they were very adept in making that argument in its ten-page response. >> yeah. look, donald trump is using things to his advantage. here on the campaign trail is now referring to his indictment as, quote election interference. he's a good last night in florida. do you see a legal strategy emerging behind that concept? >> no. because not legal in nature. that is political and aimed a jury nullification or even a self fulfilling prophecy that he cannot or the court cannot handle an impartial jury. because he is out there all the time agitating in raising these issues and he's going to say baja there is no one in the state of florida or in the southern district of florida who can be impartial in this

case that can push this off. these are not permissible in a court of law. absolutely, full, stop cannot to do. >> given all the wrinkles that need to be ironed out involving trial and classified documents, when you see this actually going to trial? i know jack smith wants to start december 11th, is that possible? >> it is certainly possible. the only real wrinkle here is the [inaudible] procedures. even though they are classified and highly sensitive documents, there is a certain process that is required under the classified information procedures act. i think a point that is filing today, that can happen in a matter of months. this is not a document heavy case as much as trump's lawyers have made that argument. the discovery here is not voluminous. -- point there's 4000 pages of key
