left in the congressional fiscal year and that is how much time congress has to pass the national defense act. this week, the bill passed the republican-controlled house and is now on its way to the senate. however, congressional republicans have not been shy about their willingness to use 2 million active guard and reserve service members political pawns. if it allows them to go on offense in the culture wars. the house's new defense budget is laden with amendments targeting reproductive health care, transgender service members, and diversity, equity, and inclusion programs. while the eight -- deals with pay races for service members and other defense priorities, republican concerns can be summed up in one word. woke. >> he woke military -- >> indoctrination from the moat woke mob. >> wokeness and all of the indoctrination attempts that you are seeing within the

an amendment. >> is the unanimous consent consent to have the word stricken? >> without objection, so ordered. >> congresswoman, he made the distinction that you did not want to see cranes original language amended to people of color, you wanted to see it stricken from the record entirely, why was that so important for you? >> i think it is important for a variety of reasons. it was certainly inappropriate, even the house speaker mccarthy said that he did not condone or support it. leader hakeem jeffries supported the words being brought down. and it was by unanimous consent. it's important for historical reasons that we are not going to continue in this cultural war, we are not going to continue to let colleagues on the other side of the aisle deny us the right of diversity and inclusion training. this is a great example of why we need diversity and inclusion

training. and that we need to understand that there are different cultures, and this is 2023, not 1923. >> congress men -- said he misspoke and it was a mistake. has he reached out to you order the congressional black caucus about the comment? >> he has not reached out to me nor to the congressional black caucus, i have been advised that he said he misspoke again on a social media page, that is simply not acceptable. and it was unanimous consent. there were plenty of opportunities for someone else on the other side to raise questions. they didn't. there is a reason for why they didn't. it's the reason why the speaker didn't support it. they know exactly what he was doing. and it's simply not acceptable. and we are not going to stand for it or be quiet, as we find them putting the disparities, and denying people --

because of their race, taking away our freedoms like women reproductive rights, talking about lgbtq and not allowing, or allowing this, this business now to say that they are not gonna do it design or put a talk on my cake or what if case against lgbtq, or affirmative action. now denying race as a qualification for higher education when we allow legacy? and i know legacy is based on race in the majority of the ivy league colleges where that is still standing. we can fight for our country and die, but we can't get educated? >> -- >> that -- >> congresswoman, you have referenced to supreme court cases where the court has really moved the needle back on some of the progress that african made over the past couple years. but were you surprised that those battles have now shifted to this sort of van duyne

legislation that has historically been passed within partisan support? i, mean are you surprised by the sheer volume of the amendments being proposed here? amendments that nothing to do with the traditional fundamental defense? >> i wish i could say i was surprised, but i am not. we saw this forthcoming when we had the first action after 50 years of the constitution protecting roe v. wade. when now we are looking at what they are doing or with affirmative action. we know that much is on the horizon to come. and we are ready for, it we are not going to stay -- have the things happening at the highest level of our court, that you can have these things happening on the senate and the congressional house floor, we are not going to be absent and we are not going to be quiet. because the american people need to know, this is why we need to reauthorize the voting rights act. this is why people have to vote,

because there are consequences, and we are gonna be very loud and clear the we put people over politics, and they are playing petty politics for the politics over people. >> are these pella talks gonna extend to the senate? which of these really extreme admins do you think will make the final version of the bill that comes from the senate back to the house? >> well i am very comfortable that the senate is not going to take the house version, we may end up in conference, committee with this. we have to count on the senate to make sure that they stand up for the american people. and i am very comfortable that the leadership there will do that. >> before we go, congresswoman, president biden has recently announced 39 billion dollar program for student loan forgiveness. this comes on the heels of the supreme court invalidating and earlier forgiveness program. how confident are you that this new program will be fully realized, giving americans the kind of relief that they have desire for so long?

like a business, it needs money to stay afloat. and on this front, president biden has some really good news. his campaign, the democratic national committee, and a joint fundraising effort include state parties across the country, has raised more than seven d $2 million combined in this first quarter since announcing his reelection bid, according to the campaign. that includes over 10 million in small donations. that has international -- and undulations under $200. this outpaces the republican candidates, even leaving aside that the fact that biden is the incumbent, has the full support of the democratic national committee, is a really strong numbers. here to discuss, rick wilson, a former republican strategist and cofounder of the lincoln project, and keith boykin, a former clinton and white house aide. welcome. so keith, these early numbers, and biden is not facing a serious primary challenger. but what does this significant hall indicate to you about the

public is responding to this campaign? >> the job of keeping the party relatively united, that there is still a general consensus of support for the incumbent president. but he is going into the race with a strong amount of cash on hand by the way, to. he has more cash on hand right now than obama had at this point when he was running for reelection. so i think that those are all good numbers for him. but i think it is also a reflection of the fact that republicans have put themselves out of touch with ordinary people, and a lot of people in the democratic party or response it into that. there is obviously, as you mentioned, some challenge to gordon in the party, but it is not a serious challenge at this point. he is not threatening, he has a commanding lead in the polls. about 64% i think currently compared to what it was 31% for years ago at this time when he was running in the democratic presidential race. he's in a good possession. >> all this is happening as the

republican candidates are fighting it out to oust former president donald trump as the front runner in their primary. and nbc reports that florida governor ron desantis has tapped out his top donors, he has fired a dozen staff members, and he is still facing concerns about the solvency of his campaign. rick, as a former republican strategist yourself, is desantis taking the right steps to ease the financial strain on his embattled campaign? >> well the problem here is that there is nothing around desantis can do to make himself likable or connect with humans, what you have emotions that feed people feel our general genuine and relevant to their lives. he is a goldfish, he is a guy that was always put out there as a sort of replacement for trump. but until people met him they didn't realize just how unlikable the guy was. and so you have seen that his performance has been so lackluster on this stuff. his major donors are starting to pull back from him, as we saw from his campaign finance reports, the campaign took in

85% of his money from major donors, and there are only so many billionaires out there, and a lot of them have got very cold feet about it, ron desantis. i think he's a lot of trouble, and the burn rate he has had has been unbelievable, one point $2 million a week basically inside the campaign. it doesn't work that way. you can't stay afloat if you are spending that money that quickly. >> to the point of bringing in those top donors and reassuring them, and we seniors has now listlessly reported that the detentions campaign has circulated a confidential memo in which he reassures his top donors and acknowledges republican senator tim scott as a growing threat. it even said that they expect tim scott to receive, quote, appropriate scrutiny in the weeks ahead. keith, is tim scott a real threat here? and if he is, how should the stop campaign be preparing for the inevitable scrutiny that will come from the left and the right? >> i think we are kind of missing the point. tim scott will not be the

republican nominee, ron desantis will not be the republican nominee, unless donald trump somehow disappears in the next 12 months, donald trump will be the nominee. and what i think the desantis campaign is missing here is that you can't win a republican presidential nomination if you don't take out the leading candidate, the front runner, and that is donald trump. tim scott may be a threat, but tim scott is running for vice president. and it looks like ron desantis is running for vice president too, because he is afraid, as well as so many of the other candidates, to take on donald trump. i mean, what we are seeing here is profiles and in cowardice from these various candidates. how you can you convince the american people that you have the courage to take on americas enemies if you can't even take on a nearly 80-year-old retiree in florida who is leading the polls for your party. he is you are afraid to take

the sky, on and you expected to be the leader of the free world? it is not a relevant realistic campaign strategy. >> well to your point, he, thought to get back on the point. scott, desantis, and all these other presidential candidates were in iowa this week touting family values. but the real front runner, donald trump, appeared before young conservatives at the turning point action conference, where he continued to deploy some really militant rhetoric. so let's take a listen. >> 2024 is the final battle, either you are on my side and we will demolish the tuesday, we will expel the warmongers. for our government, we will drive out the globalists. we will cast out the communists, the fascist. we will throw off the slip -- political class that hits our country. and we will out the fake news media, we will defeat cricket joe biden, and we will drain the swamp once and for all. >> >> rick, on a scale from one

to absolutely unhinged, how would you rate this? >> look, this guy is, this guy is as bonkers as they come. it is done in a deliberate way, it is done to stoke the public republican base, the maga base of the party. they now want to hear all of the authoritarianism all the time. they want trump to live out their fantasies, that they have of running down the country, and replacing american democracy and the american republic with this authoritarian status, weird personality cult that surrounds trump. i think it is an unbelievably irresponsible thing, but that is par for the course for donald trump. and i think it should really reflect more about what the base of the >> party looks like now, then what donald trump, he is just reflecting what he thinks is gonna keep him in good standing with that pace. you cannot control them, you cannot appease them, they are always gonna want more and more and more of that crazy red meat. and he is throwing it out there at industrial scales with speeches like that. >> before we go, rick, let's go

back to the other side of the, i'll u.s. inflation has slowed to 3%, its lowest in years, although prices still remain higher than the 2% target rate. but how do you think that the lowered inflation rate will affect republican criticism of biden's economic record, which has actually been quite strong? >> they are still gonna criticize joe biden, they can't help, it is the only thing they have got, even though it increasingly is one more thing republicans talk about that is fake in the minds of most voters. they don't think this election is about hunter biden's lap top, they know that the biden record has been spectacular on reducing the cost of inflation on american families. they know that the job picture is ascot as it has ever been in the last 80 years in this country, there is a growing sense that we are gonna have a soft landing and avoid a recession. and, you know, all of the republican petitt it's gets about election where that we were gonna be in some sort of economic, you know, maxwell cape. it is just not working for the

cannon will preside over the first patrol hearing in the federal classified documents case against former president donald trump. the parole hearing will set the terms for the handling of classified information, related to the case. it will be one of the likely many proceedings on this topic. the hearing comes after a last-ditch effort by trump's legal team to delay the trial indefinitely, possibly until after the 2024 election. special counsel jack smith fired back, insisting that the request has, quote, no basis in law or fact. this as we are learning more about the scope of jack smith's investigation into the january 6th insurrection. nbc news reports that new mexico's top election official has spoken with federal prosecutors. and georgia and into michigan secretary of state have also spoken with smith's office. all of this reveals that jack smith is casting a broad net as he tries to uncover the truth

about the plot to overturn the 2020 election. joining me now to discuss is former federal prosecutor paul butler, who is also an msnbc legal analyst. hello, paul. >> hey, melissa. >> trump,'s defense team says that his campaign schedule requires a tremendous amount of time and energy. but to me this kind of reads like a delay strategy. is it an effective delays ravaging? >> that is all up to judge cannon. we know that trump's defense in mar-a-lago is going to be, he is running for president. and if he is successful, he will either pardon himself or a an attorney general who will dismiss the federal case. so if trump can get judge cannon to delay the trial until after the election, all of that will be likely. >> well today on fox news, paul, donald trump was asked about this motion that's legal team

filed on his behalf. so let's take a listen to what he had to say. >> do you have any indication the federal grant this motion? >> i don't know, i know it is a very highly respected judge, a very smart judge, and a very strong judge. >> you appointed her. >> yes, and i'm very proud to have appointed her. she's very smart and very strong. and loves our country. i, mean loves our country. we need judges that love our country. so that they do the right thing. >> paul, what did you make of this message here? this is a message that donald trump is aiming a judge cannon herself? is this a coded message to her? >> it might be. because during the first proceeding, regarding her and donald trump, she was more on team trump and she was doing her job as a federal court officer. and melissa, that is white jack smith came for donald trump so forcefully in his court filing last week. the speedy trial requires judge

cannon to set a trial date. so trump's defense was actually asking her to do something illegal by not setting a date. jack smith is basically like, we are just waiting for defense counsel to get up to speed, and then we will be ready to go. >> it's also likely that jack smith was laying a record for any appeals of judge talents decisions, if there are ones. i want to turn though, briefly, paul, to the supreme court, which has gotten a lot of press coverage in the past couple of days. this is one of donald trump's biggest successes in his domestic agenda. he managed to stop the federal judiciary, the lower courts, and the supreme court with movement conservatives. now we have learned in recent weeks that some members of the supreme court have had questionable interactions with moneyed interests that actually have business before the court. and democrats are pushing for the supreme court to have unenforceable code of conduct. the chair of the judiciary committee dick durbin says that this week his committee will vote on a bill targeting supreme court ethics reform.

>> a solution to the problems we are seeing in the supreme court is simple one, they need like every other cordon america to adapt unenforceable code of ethics. every federal judge in the country is bound by a code of ethal conduct and a set of ethics rules and enforcement beckon-ism's, except for nine, the nine justices of the supreme court who sit across from this building. >> paul, as you know, the court has shown no interest in adjusting these addressing these ethics questions itself, leaving congress to please the court. but is this congress going to be able to pass a reform bill under the polarized conditions in which it works? >> i doubt it. even though we have this scenario where justice and mrs. clarence thomas take this 500,000 dollar vacation paid for by an ultra right wing billionaire. and melissa, it's bad enough that justice thomas accepted the private plane ride and the yacht trip from this

conservative activist who has interests before the court, but then thomas hides from the public without all these exposés we wouldn't know that this billionaire purchased a house where justice thomas's mother lives. so yeah, if you work in the white house you have to follow mandatory ethical rules. if you are a federal judge who is not on the supreme court you have to follow mandatory ethical rules. the supreme court is the highest court in the land, it has the loosest ethical standards. which opens the door to corruption. so this new proposal for supreme court integrity is vital. but i doubt that this conservative congress will allow it to pass. >> so paul, we are both professors, and i can't resist the opportunity to do a little teaching here. i want to listeners to know that back in 1969, liberal supreme court justice -- resigned from the supreme court after taking a 20,000 dollar consulting fee from a foundation that worked on civil rights and religious freedom. at the time, there was a

bipartisan effort to convince forests that he had to resign from the court. why hasn't there been bipartisan support for curbing these ethical lapses at the current court? >> because these ethical lapses serve a certain ruling group of rich, straight, white men. and all of these new rules are trying to support legitimacy for the supreme court. but it detracts from the legitimacy of the supreme court, where not only do they accept all these lavish vacations, but they make these decisions that take away the rights from everybody who isn't a right rich, straight, white man. so this court has so far to go in terms of reestablishing its legitimacy. but the republicans in congress, melissa, or more of a hindrance

they did not say how much it will cost. on friday, in a different development, i was governor signed a six-week abortion ban in july, preventing abortions in the state once a fetal heartbeat is defected, with only limited exceptions. six weeks is very early in pregnancy, usually before most women even know that they are pregnant. the law makes iowa one of just a few states to enact a ban of the six week mark. abortion rights advocates and providers have filed a lawsuit in iowa -- calling the ban unconstitutional and requesting an injunction while this plays out in court. the judge that he would make a decision next week, which could help than until the suit is concluded. 20 to discuss is doctor jim yellow peril, she is an ob/gyn and president unseal of physicians for reproductive health. welcome, doctor parrot. your work focuses on how reproductive rights, social justice, and sexual health intercept. what is your reaction to the iowa law, and what concerns do

you have about the way -- access to abortion? >> as a physician, and someone who provides comprehensive reproductive health care for my community, i am deeply disappointed, and also not surprised as someone who has worked in the reproductive health rights and just justice space for my entire career. we have seen these efforts to push these arbitrary gestational age bans, the worst of which for sure are the six-week ban's really sweeping the country. and iowa is part of this race to the bottom, this desire to allow nate access to care for our communities. and it is going to be harmful and devastating for so many folks. >> what can we talk about the harms, this ban makes abortions in iowa the legal once a fetal heartbeat is detected. they are saying that is at six weeks, i used to allow abortions up to 20 weeks into a pregnancy. that is a considerable difference. but what is the impact on the ground of this new timeline? >> it's virtually eliminates

access to abortion in the state, period. the likelihood that somebody actually knows they are pregnant and's able to get in to see their health care provider for prenatal care, much less even abortion access, it's impossible in most places in this country. unless you are wealthy, unless you are resourced, unless you live on the coasts. and so this essentially bans abortion totally for folks in that state. and we are seeing this play out, right? this is justice by geography, depending on where you live, what resources you have access to, who you know, what strings you can pull, you get a different level of health care as compared to folks who are less resourced, we're living in states where we are seeing these restrictions and bans play out. >> many doctors and democrats have argued that the bills exceptions are very vague. as dr. yourself, what judgment calls do you anticipate having to make to decide if an abortion is permissible under the circumstances? >> i want to be very clear in

saying, exceptions are no protection. as someone who has helped people navigate these exceptions in states, these so-called exceptions in states where i have practice and where i've lived, i know that it is nearly impossible to get coverage under these narrow restrictions, the health of the mother, rape or incest, because of the way folks lives unfold, it means that these exceptions are really not providing any protection for the community. and what that means from a provider perspective is that we are having to weigh the risks and benefits for the people in front of us. we are having to help people navigate these very very difficult six said circumstances. to get the care that someone in the next eight over or in a another community would have access to. this is not health care. this is not what so many of the doctors on our network, this is not what i signed up for when i took that oath. >> the suit that was filed in opposition to the law criticizes it for excluding

psychological conditions from the definition of a medical emergency that would warrant an exception. why is the exclusion of psychological situations so significant in the way this will play out? >> well the exclusion of psychological conditions is certainly much more, it is left to the discretion of the provider, and the person that they are caring for. and we have to really be very clear, the intention behind these bands are to eliminate abortion access period. anything that shifts that, anything that allows access absolutely these folks are going to be against. and so when we open up this window to be able to say, i know that i cannot carry this pregnancy, i know that it would have long term impacts on my mental health and my psychological well-being. and as someone who lives in this stage where we don't have these bands, in a city, excuse, me i'm in a district, we are not in a state, in a city where these bands are not in existence, then i know, i

believe my patients when they tell me that. they have taken this positional capacity away from the pregnant person, as well as the health care provider that is caring for them. >> so one last question, dr. parrot, we got some great news this week about the over the counter birth control pill that could become available next year. could this be a bright spot in expanding access to reproductive freedom as more and more women in a growing number of states seek reproductive and conscripts of access at this point? or is this is gonna be another battleground is being drawn? >> it is already a battleground that is being drawn. so that is a foregone conclusion. if we thought that the assault on our reproductive rights were gonna end, begin and end with abortion access, we are dead wrong. so contraception is already on the table, as are so many other modes of reproductive health care, including infertility treatment, including the care for folks who are experiencing pregnancy loss. this is a bright spot, but it is not a panacea. and we have to understand that,
