thanks for joining us. good to be with you. we have some breaking news in the trump election interference probe. moments ago, we learned the courtroom deputy said that there have not been any grand jury returns today and they don't expect there to be any. that news after three sources

told nbc news that trump's attorneys met with prosecutors in jack smith's office today. two sources with direct knowledge telling us that they were told to expect an indictment against their client. a trump spokesperson and the former president himself are now disputing that. so what does all of this mean now for the special counsel's time line? we do know jurors and one of smith's prosecutors were spotted at the courthouse earlier. a whole lot to get to. let's start with the reporting and garrett haake yasmin vossoughian and ken dilanian. and also with us, charles coleman. ken, you first. talk to us about the breaking news with the grand jury, what does it mean? >> what it means is that this grand jury is not returning any indictments today. so if we were going to learn about an indictment, only

possibility that leaves is that it happened earlier and it has been under seal. and if we're learning about it today, that means that it would be unsealed again today. again, this is based on reporting and tea leaves we're reading. but this news makes it clear that whatever is happening today, this grand jury that is meeting behind closed doors is not returning an indictment. that we know for sure. >> and so what is going on at the courthouse right now? >> reporter: this was just breaking in the last couple minutes or so. ryan riley inside the courthouse speaking with the courtroom deputy. and as ken laid out, we're not expecting any type of indictment coming out today. and that being said, it is curious though that the grand jury is actually still convened behind me. we haven't seen any indication

of them leaving the building as of yet. usually they some ultimate down business around 4:00 p.m. or so. so we have to wait for them to leave. so we need to look ahead to next week. historically tuesday and thursday the grand jury meets. so we expect the next time will that they will convene next tuesday. and throughout the day there has been a lot of -- and i will say it seems planning going on when it comes to security personnel. u.s. marshals and along with metro and park police kind of convening earlier today outside this courtroom and then making their way inside the building behind me, whether or not they were planning for something that was incoming, we don't necessarily know. nonetheless i think that with

our reporting coupled with of course what we've heard from the former president and his attorneys as well, somewhat surprising to learn that the likelihood that we won't get any sort of indictment today. >> so back to ken for a moment. i'm looking at the wording of our reporting. the courtroom deputy said that there have known been any grand jury returns today, they don't expect there to be returns today. not to say that there are no votes. is that semantics? help me understand whether there is no vote or if it is still unclear. >> i think that is a bit unclear. but generally when a grand jury votes to indict, that immediately gets handed up through an open courtroom in a process we described earlier and they are flatly saying that there are no returns. but i just want to caution folks, it doesn't mean 100% that we're not going to hear about

some kind of action today because it is very possible that an indictment had previously returned and handed up and under seal for some period of time. that is actually the normal course of things in a d.c. federal court when indictments are handed up, they are sealed for some period of time and there is often a lot of reasons for that, anything from notifying the defendants to in the case of a classified documents case that was in miami, they needed to get their ducks in the row with intelligence agencies and inform everybody. so thatis common. we don't know that that is what happened here, but to the extent that we're expecting any news today and we don't know that there is no indictment today, still possible that we'll see something. >> we do know trump's lawyers met with the special counsel today. garrett, what do we know about that meeting? >> we know it took place which is a good start. but beyond that, we know frustratingly little. a moment for journalistic humility a bit.

our sources are telling us different things from the former president and spokesperson on the record. former president is telling us that it was productive meeting and that his lawyers basically argued had he had done nothing wrong and in his language that an indictment would be very damaging for the country. he indicates that there was no -- no indication of notice given, no indication of timing that he was somehow definitely going to get indicted. which is contrary to what our sources told us and what we know a bit to be true what is that he received a target letter more than a week ago which is as about assure sign that you can get. and so this meeting at the special counsel's office appeared to last about an hour give or take and now we're kind of left in the waiting here with another good reminder that these closed doors processes controlled by prosecutors can be very tightly controlled right up until the minute they decide to go public. >> an indictment has to be voted on by the grand jury.

and so the prosecution can recommend an indictment, but then they take the vote. how does it work, what has to happen? >> the process is relatively straightforward. what the prosecutor will do is essentially read the charges, read the definite nation of the charges and then ask the jury to decide whether they believe it is probable cause that climb occurred. to go back to what garrett was talking about, we can deduce a few things. if donald trump's attorneys were told that he was not for example going to be indicted or that he was no longer the subject of or a target with respect to this particular grand jury presentation, we would absolutely have heard that from donald trump and his attorneys without question. not to say in a jack smith and his attorneys let them know that he is definitely going to be

indicted, but we can deduce more likely than not that an indictment is coming regardless of what donald trump says about how productive the meeting actually was. going back to what you were talking about with respect to the process, there is also going to be forgiven to the actual grand jury about any particular defenses that might be applicable in a particular case. in a case like this, i don't see that necessarily happening, but the prosecutor will lay out the charges, they will basically give you the definitions that you need and they are going to ask you do you believe more likely than not that there is probable cause that the crime occurred. and then you will either get a true bill in which case in many cases it will be sealed until it is unsealed by the prosecutor and released to the public or a no true bill meaning that they voted it down. it is important to know that this is not like a trial meaning that you do not need a unanimous decision by the grand jury. all you need is a simple majority. so that is important to understand.

it is not beyond a reasonable doubt. it is a different standard. >> so 16 of the 23 have to be present and 12 have to return to return a true bill. ken, what are you hearing at the justice department today and if there is an indictment, what can we expect to learn about jack smith's case? >> that is another unanswered and unanswerable question. nobody at the justice department is talking about the details of the case nor the special counsel's office which is in a special location. and there is a lot of speculation and among legal experts that it would be a speaking indictment that goes to the heart of what they would allege is a conspiracy by donald trump and others around him to cling to power. describing the scheme to create slates of false electors in various states, to pressure mike pence, to hold up the

congressional counting of the electoral votes and even before that, various schemes to essentially allege fraud in various forums when they knew there wasn't fraud. and a key to this case would be what was donald trump's state of mind, what was he told about did he lose the election, did he know or should have known that he actually lost and that these allegations of fraud were bogus. remember, we were talking in recent days about the briefing that he got about how secure the u.s. election system was. almost unhackable. so that was in his mind. so these are all the things that we believe based on the charges that we know are under consideration from the target letter, we believed that we would see itindictment. but only that handful of people know what we'll see. >> and charles, what will you be watching for specifically in a possible indictment? >> well, i'll be looking for another speaking indictment from jack smith's office. he has obviously avoided doing much press on this, which i would not be surprised about. it continues as we go forward as

a prosecutor, that is not something that you would talk about to put in jeopardy any continuing investigations that you have let alone prosecution or trial. so he will basically provide to the public evidence as to what it is that he has been doing the entire time in building the case. so that is number one. but i think on a larger level, you can only cheat death, taxes and justice for so long. and what i mean, on a bigger scale, the more and more donald trump gets entangled with indictments, the less and less he has an opportunity of beating one or all of these charges. statistically the probability of him beating the federal government at any one of these let alone all of them is extremely low. and that is important to understand because if he is going to trial on this, if he is going to continue to fight this, it is unlikely that he will be successful, but the more indictments that come out, increased probability that he will be convicted of some it not all of these things just goes

higher and higher. and so i think that something that people need to understand. the federal government rarely misses. and if they do, they won't miss a second time. and more indictments means more trouble for donald trump going forward. >> and as we think about how the process could proceed, we do know that there are still witnesses meeting with the grand jury and with the special counsel including bernie kerik and a couple of the so-called fake electors and theyare scheduled to meet with the prosecution and grand jury in august. but one person who says that he hasn't been contacted is mo brooks. and he is mildly surprised. brooks has said that trump urged him to help rescind the 2020 election and violate the u.s. constitution and federal law. his words. any idea why he hasn't been sought out? >> really only two poekts. number one, the special counsel would have what it would need

brooks based on public comments already and don't feel that they would need to bring him in. and number two, that they have heard what he has to say in public and don't think that what he has to say is especially relevant to the case that they are building. he has an ax to grind so speaks to the idea of why he would want to complain publicly about the fact that he has not been called. and also we have too just be cognizant of all the things we don't know about what is going on behind closed doors and what information jack smith and his team may have gathered from other sources or discarded as not relevant. >> thank you all so much. stay close. we'll come back to you. meantime coming up, the

national airport, and of course the bigger fall in march that sidelined him from coming to work in the senate for several weeks as he was recovering both from a concussion and fractured ribs. but his colleagues are standing by him. watch. >> i talked to mitch last night. he seems strong and alert. obviously what happened was disturbing. but mitch is strong. he's stubborn as a mule. >> whatever he tells me, i'll trust to be true. >> she run for the new congress? >> that is 18 months away. and i'm trying to figure out how to get the authorization bill off the floor today. >> and that last man that you heard from there is the number two senate republican, senator john thune. he was asked about if mcconnell should stay as number one republican atop the senate

we still have four days to go until the end of the month, but we already know this july is likely the hottest month on record. ever. this is according to new research from a u.n. weather agency. and it is just the latest headline about this relentless heat. last month was also the hottest june on record. phoenix set to be the first major u.s. city to hit an average temperature of over 100.

and in florida, ocean waters are reaching the temp of a hot tub. and president biden says we can no longer deny the effects of climate change. joining us now from steamy philadelphia is george solis. i know that you've been out there all day long. how are you holding up, how is everybody there doing? >> reporter: i'm a florida bay and thought i was used to the heat but now i have second thoughts. earlier 85 felt like a cool fall breeze. right now we're flirting with the 100s. a lot of children are staying indoors which is good because that is the advice from the health experts saying if you

don't need to be out here for very long, don't because this is the type of temperature that can kill. not just uncomfortable anymore, this can be deadly. so here in philadelphia and other major cities we know that there are heat advisories, health warnings, cooling centers, pools open. just anything so people can beat the heat. a little earlier this morning i spoke with a member of the health department here in the city who was urging just a lot of caution for residents with dos and don'ts. of course follow advice of checking on children, pets, on the elderly. everything that you can do to help anyone out during the crazy heatwave that is feeling like it is going to lost longer and longer in this particular climate that we're having. here is more of my conversation. >> what i want you to take away from this is that heat will kill. it has been shown. and here in philadelphia because we sit in a valley, it can

overtake us very quickly. so if you start to feel woozy or dizzy or anything, that is the starting point of heat exhaustion. so make sure that you check on your loved ones that may be elderly, your neighbors or anyone that also may be vulnerable, someone that may be pregnant or have small children in the home. >> reporter: such crucial advice when the temperatures are this hot. other things that we're doing and that your crew is doing is wearing the loose fitting clothing, drinking a lot of water and finding shade whenever we're not on tv because we're also cognizant for our health as well. and other things you shouldn't do, don't jump in the creeks or rivers or any body of we are that is unsupervised. and don't open up the hydrants. that can lead on other emergencies. so advice is stay indoor, find

the ac where you can and just try to stay cool as cliché as this sounds. because we don't want to see any health emergencies out there. >> george solis, go get cool. thanks. and let's turn to michelle grossman now. and michelle, it doesn't seem like we're getting a break anytime soon, are we? >> this will stay in place for quite some time. we're seeing a warming atmosphere that is flooding the jet dream. extreme. and that moves the weather out. and so this one is stuck. and so it is important to heed all the warnings. we've seen the heat from the south into the northern plains and ohio valley and northeast. we'll see records broken. we've seen all-time records fall and that is not just in the u.s., that is across the earth.

we're looking at three continents looking at heatwaves. and we're looking at so many triple digits. but the heat index is what your body perceives. feels like 106 in wichita, 109 in st. louis, 105 in nashville and really warm in phoenix. and in many, many spots across the east, it will feel like 107 tomorrow. like 99 in new york city. i extended out a bit earlier and it feels like the wet blanket on you. and that is where it is really taxing. so nice to see president biden asking for that alert hazard because we're looking at people who need to be outside. police officers. firefighters, farmers who need to be outside, so we need to have that in place that protect them. we have the heat in place and

humidity in place, two triggers. and the front can trigger storms. heavy rainfall is part of the climate connection too. we could see flooding with these storms. and so this is what it looks like right now in the northeast. all these bright colors here indicating where we have the heavy downpours especially the red. we're also looking at a lot of lightning indicating that we have a lot of energy to the storms. where you see the orange boxes, that means that severe weather is happening. the yellow is a watch box so you need to prepare for the weather. we do have a flood alert as i mentioned, a lot of humidity in the air. when the storms come through, they drop a lot of moisture. so 11 million people impacted. where you see the green here, that is a flood watch. red means that it is happening right now. so if you are driving, you want to pull off the road.

stay indoors if you can. don't travel in water because it can move your car. 60 million people at risk for severe weather today. we're looking from new england all the way to portions of the mid-atlantic and really a lot of really big cities. portland, hartford, down to d.c., we had some wicked weather just two days ago, a lot of flash flooding. we'll see that once again today. winds gusting to 60 miles per hour, that could bring some trees down, it could take some roads out. and also we could have winds. and we could see a few tornadoes. so we'll watch out for that as well. and then it is about the rainfall from portions of the midwest to the great lakes and ohio valley, into portions of the mid-atlantic northeast, new england, this will be the rest of the thursday. as we track these storms that are dropping heavy rainfall. so let's look for the rest of

today, we're talking very humid conditions ande dits once again in the southwest. we've had weeks and week of triple digits. that is when it gets really taxing on the body. as we slide across to the southeast, heavy rain also because we're looking at the chance of really warm air and humidity that could bring heavy rain. and storms with record highs. so we'll continue to see the records fall. we get a traffic jam in the atmosphere. and so we're looking at the high pressure enlarging. so then as we look to the northern plains, severe storms there, heatwave continuing on friday. and saturday strong storms and relief by sunday in portions of the new england and northeast. >> so glad you got to the weekend to tell us that that is when we'll have the relief.

allie raffa. and they just had this brief full spray a moment ago. talk to us about the significance of this meeting. we know that she is the head of italy's most far right government sense the end of world war ii. but she is getting a pretty warm welcome there in d.c. >> reporter: yeah, notably she is the last of the g7 leaders to be meeting with the president at the white house. and this is coming as we're seeing this warm welcome, sort of showing -- showcasing the evolution in how the president and his administration view maloney especially in the wake of the public tension that we heard after she was initially elected because of her far right instances on issues like abortion, on lgbtq rights. but she has been praised on the world stage for her foreign policy decisions. and based on what we heard very briefly from them before their meeting started, that was going to be the focus of this meeting

between these two, the first conversation that they have had since they met up with each other in lithuania during the nato summit earlier this month. and no surprise that ukraine is going to be top of the agenda. she has proven herself as a staunch supporter of ukraine. and there are over 150,000 ukrainians now on -- lives on italian soil. and they will be talking about reducing dependence on china. and also talking about the mass migration crisis that italy is facing. italy recently declaring a state of emergency because of that. so no shortage of topics on the agenda today between these two for this meeting. >> we'll keep watching and obviously stay on top of any news that is made. allie raffa, thank you. now to the 2024 campaign trail. this afternoon florida governor ron desantis is looking to get his campaign back in gear kicking off a two day bus four in iowa. and after make shakeups.

in the last week the desantis team has fired more than 40% of its original staff. and the campaign only launched two months ago. and gabe guttierez is joining us from iowa. and firings happen, but 40% of the campaign staff? that is a lot. all right and behind me you see the never back down bus tua pulling away. this is and it unit for the governor to street, reboot, whatever you want to call it. he has been meeting voters, petting goats. he just came from a previous event where he spoke with a very small crowd inside a very small room.

so there are questions about the enthusiasm. his campaign has burned through cash and forced to layoff a good chunk of its staff. and there is another controversy. it is a situation in florida where the florida board of education approved new african-american teaching standards which has stirred a a lot of controversy. democrats including kamala harris with seized on that. one portion says that slaves derive benefits that they were able to use later on in life that desantis campaign has been pushing back strongly on that, but a former desantis ally,aldd put out a tweet saying that while those standards are robust, the attempt to feature the personal benefits of slavery is wrong and needs to be adjusted. but the desantis campaign is strongly against that.

justice department and state of texas over this floating barrier in the rio grand meant to stop migrants from crossing in to the u.s. the dog doj is asking a judge t order greg abbott to remove the barrier while the lawsuit moves forward. julia ainsley is joining us. what happens next and how is texas responding? >> reporter: well, the justice department say that this needs to be a robust investigation, that texas is blatantly violating the rivers and harbors act along the rio grand. and the barrier of buoys needs to be removed immediately. they think that even though the case may play out later, it may go all the way to the supreme court. that this is now a problem that needs to be immediately remedied.

that is why they are asking for the preliminary injunction so that the judge can step in and say that while the court decides, this needs to be removed. but texas has said that they welcome the court fight. earlier this week we saw governor abbott says see you in court saying that texas has all the sovereignty and rights to justify putting the barrier there because in governor abbott's words in his opinion that the state of texas now responsible for enforcing the immigration laws that he thinks that the biden administration has a abdicated. of course there is only a fraction of immigrants compared to the hundreds of thousands by the border control. >> and there is exclusive reporting on an increase of my grant oig families with children? >> reporter: yeah, since early june we see the demographic almost tripling. going from about 790 in early

june to just on a single day this week being over 2200 families. families who cross with children under 18 across the southern border. and i started looking at this because when i was speaking to dhs officials after title 42, i thought crisis averted but i was told watch the families. they were worried about that. and this is what we're learning. it is a growing demographic and people operating shelters and interacting with migrants, it is because that lot of families decided that they can no longer wait for the appointments, they are in merciless heat, they are being threatened with violence and they feel that they have to take matters in to their own hands and cross the border illegally without an appointment. also the biden administration made the decision not to detain families so now they are looking at other options which could

more than a week ago. now nbc news has an exclusive interview with king's family pleading with president biden and congress to help free their son. here's nbc news foreign correspondent matt bradley. >> reporter: nbc news speaking exclusively to the family of private travis kang. if you remember, the young man who darted across the border in north korea more than a week ago and in that time we haven't heard from private king or the north koreans even acknowledging they have him in custody. now, we've heard from the family and they've expressed once again they were baffled by this behavior and also baffled by his behavior here in south korea. he was engaged in at least two accusations of assault by south korean police and served a little time here nearly two months in a south korean prison and supposed to be back to the united states facing probably more military discipline. but we spoke with this family and they expressed a level of frustration as well with the

u.s. government. here what they said. >> i feel like he shouldn't have been at that border in the first place. i feel like whoever's job it was to get on a plane and come back home should have made sure he had his passport and everything and was able to get on that plane to come back home. >> i feel like a suicide. why run to our enemies? way deeper than what i can imagine. i just feel like deep down in my heart my brother was afraid of something. because why would he run? you know? what was his point if he was coming home? >> reporter: even though we haven't heard from private travis king or the expectation, in the midst of interrogating him. quite likely they will simply release him if they determine not a threat and more trouble than he's worth but we need to be patient and wait for them to figure out why he did what he did.

harrowing scene imagining in the moment the expectation she was going to die sitting there realizing she was bleeding, texting her husband saying you know, essentially an active shooter and kind of a good-bye text. she was, you could see still processing these memories now from 2021 still on the stand. this comes after hours of listening to law enforcement describe what it was like for them on the scene. some of these officers had trouble coming back to work after this and these are men and women who covered homicides, done child abuse cases and this was smug that really changed the trajectory of their careers. so the other sort of fascinating part of this hearing, it's not a question of, did ethan crumbley do this or not? he already pled guilty to murder and terrorism charges. sort of a philosophical and ethical conversation between the defense and prosecution of, well, when a minor does something so heinous what do we do about it? do they go behind bars rest of
