in a 60-page supersedeing timt, -- superseding indictment. i'm going to ask our legal experts what it could prove about donald trump's intent here. keyword there, and who else, by the way, was involved. what we know about the third and newest defendant in jack smith's indictment, and i want to remind you of this interview the former president did on fox news last month after jack smith's initial indictment accused him of holding on to a top secret war plan related to attacking iran, and showing it to two writers working on mark meadows' book at his bedminster golf club. listen to this. >> there was no document. that was a massive amount of papers and everything else, talking about iran and other things and it may have been held up. that was not a document. i didn't have a document per se. there was nothing to declassify. newspaper stories, magazine stories and articles! so according to this superseding

indictment, there was a lot more than newspaper clippings. prosecutors suggesting they don't just know about that iran document that donald trump is accused of waving around in that interview. they actually have it. could this be the game changer, and what happens next? we have got a may 20th state date for this trial. could a new defendant, new arguments push that back? a whole lot to get to with the best people for it. joining me now, justice and intelligence correspondent, ken dilanian, vaughn hillyard who's outside of trump's new jersey home in bedminster, also with, msnbc legal analyst, lisa rubin as well. ken, start us off. bring us up to date. walk us through the latest addition, de oliveira, and walt nauta as well. >> there are two sets of significant allegations against donald trump in these three criminal charges. in the first one, he's charged

with one additional count of willful retention of national defense information. that's related to the war document. that's deeply significant, especially because he denied it exists. now it's clear the government has it. the other two counts related to altering or destroying or mutilating documents. that's an alleged obstruction of justice scheme. a new scheme in the superseding indictment between donald trump and two employees. one his codefendant, and wallet walt nauta. shortly after donald trump received a subpoena demanding surveillance footage from mar-a-lago, he started this plan in motion. he called both walt nauta, and carlos de oliveira. nauta makes an unscheduled trip to mar-a-lago. he wasn't meant to be there. according to the indictment, he speaks to de oliveira, and they

walk together and scope out the locations of the various surveillance cameras and then two days later, de oliveira is in a conversation with a fourth person, described as employee number 4, and he says the infamous words, the boss wnts the server deleted. now, there's no allegation or description in the super supers indictment that anything was delayed. but they received footage from mar-a-lago, people in trump's orbit were worried about de oliveira's loyalty, and they could about it, and there was some assurances made that he would get a lawyer. now he's a codefendant. he's face ago separate false statements charge on his own.

this is somebody the government would like to flip. he alone knows the conversations between him and the former president were about this alleged obstruction of justice scheme. >> right. he's the connector really there. before we kind of get into the nitty-gritty with lisa rub in, i want to go to vaughn because our you're outside the former president's home. give us the reaction the since the latest indictments dropped. >> donald trump this afternoon suggest thag in his words, deranged jack smith ought to be the one thrown in jail here. donald trump is looking to take his own legal defense or more, i should say, his legal offense on the road. he's going to be leaving here from bedminster, new jersey, in just an hour or two to go to the lincoln day dinner. i want to listen to the

immediate response, a radio interview that did not press him on the allegations laid out in the superseding indictment from the department of justice. i'll let you listen to donald trump's response to it. take a listen. >> they went after two fine employees yesterday. fine people, and i don't think they think the tapes were taken. i don't think we would have had to give it. i'm not sure we would have had to give it. these were security tapes. i doubt, if we wanted to fight that, i doubt we would have had to give it. regardless, we gave it. >> two things, one, donald trump in that interview did not outright deny the allegations that are laid out in the indictment, but number two he referred to the two very fine people, those were his two staff members named as codefendants, alleged coconspirators. for donald trump, the save

america leadership pac supporting his 2024 presidential bid, they have paid money, substantial, tens of thousands of dollars to the law firms representing those codefendants. there's money on the line here, and for donald trump, ensuring they do not testify is important. as of right now, we believe their lawyers are being paid by this pac supporting donald trump, and coming from donations of americans around the country who are acting in realtime, donating to the legal effort. >> that's the politics of it as well. i want to dig into what ken was talking about there looking through the 60 page indictment. what stood out to me specifically, and what doug dug into is the conversation surrounding the surveillance footage, and i want to read a part of this for you, and then have you react. so it talks about this new codefendant, de oliveira, telling trump employee number 4 who we know as mr. tavarras that

the boss wanted the server deleted. trump employee 4 responded that he would not know how to do that, and he did not believe that he would have the rights to do that. trump employee 4 told de oliveira, he would have to reach out to another employee, de oliveira insisted to trump, employee 4, that the boss wanted the server deleted and asked what are we going to do. how damming is this part of the indictment? >> lisa, i believe you're muted. just unmute it, lisa. >> so sorry. i was going to say, ordinarily. >> there we go. >> ordinarily a statement like this wouldn't be admissible, but for the fact that de oliveira is

alleged to be trump's coconspirator. what's interesting about this passage that you read, trump employee 4 likely spoke to federal investigators and gave them this full accountable of what happened in the alleged audio control room at mar-a-lago where this conversation took place. you should believe that we will hear from tavarras again. he may be one of the most important witnesses throughout the superseding indictment. >> what we don't have as i read through this part of the indictment is an actual conversation, text message evidence that the former president asked de oliveira to erase this footage from the surveillance camera, despite the fact that de oliveira actually says that, right, to employee number 4.

>> that's right. but one of the things that we have in the new superseding indictment is an allegation that the department of justice sent over a draft subpoena for surveillance footage on june 22nd. on june 23rd, the next day, not only did trump have a call with de oliveira, as ken mentioned earlier, that call was 24 minutes long. de oliveira was the property manager. before that a valet at the property. i'm not sure what he and trump would have to discuss for 24 minutes. i'm pretty sure it wasn't a conversation about the plants surrounding mar-a-lago, which are the sort of things that were in carlos de oliveira's bailiwick. i think you can put two and two together. there's a 24 minute conversation, he makes plans unexpectedly to travel to mar-a-lago. he lies to staffers about where he's going and why, and then ultimately it culminates in the conversation between de oliveira and trump employee 4, where he asks him, point-blank, delete the footage.

the boss wants it done. >> you know what i also thought was pretty shocking, the fact that it seems as if the special counsel has this document in hand, iran war document in hand. nbc news obtaining the audio of the exchange former president with the journalist, waiving these documents. i want to play that. >> with milly, i've got to show you an example, he said that i wanted to attack iran. isn't it amazing? i have a big pile up here. this just came out. isn't that amazing? this totally wins my case, you know, except it is highly confident or secret. >> it's interesting because you hear this audio, and you remember the audio i played at the top of the show, the former president said there isn't a document. these are newspaper clippings.

how it that the special counsel got access to this document? where did this thing come from? >> what's really interesting here, in the superseding indictment, there's a large charge. each of the documents is alleged to have willfully and unlawfully detained. 32 is the iran-related document that he's alleged of waived around at bedminster, and it shows you how long he held on to the document from january 20th, 2021, when he left office to january 17th, 2022. that's the day that trump returned to the national archives. the federal government has been back in possession of this document, and it came to him from mar-a-lago, even though it had at bedminster in january of 2022. the next question is how is the government and the special counsel's office, that is the document that trump was waving

around. i'll venture a guess it's through witness testimony. there were at least four people in the meeting at bedminster, a writer and publisher, associate with mark meadows books, and two staffers. at least one of the four of have to say, that's the document. you can see in the audio and the transcript of the audio in indictment. he repeatedly says, look, look, look, it's obvious he's showing them something, and somebody must have remembered well enough to confirm that to federal investigators. >> a lot more to talk about. lisa rubin, vaughn hillyard, ken dilanian, thank you as well. coming up, what is the special counsel's strategy in the mar-a-lago documents case. we're going to ask chuck rosenberg, coming up. plus, the world is watching a growing crisis in niger, amidst an attempted crew we're live on the ground, you don't want to miss that. in michigan, day two to

with high profile complicated cases, but what do you make of the strategy here? >> i think you're right. ideally, it's one case in one place at one time. that's easier for the government and its witnesses. there was probably a venue issue with respect to the classified documents portion of the case that i think necessitated bringing it in the southern district of florida, and that's okay. the government has the resources to try two cases in two places. it probably would not have been his preference. >> what do you make of the start day, may 20th, 2024. pushing into the primary season. that's the summer before the republican national convention. who knows who the potential nominee at that point will be. does this now superseding indictment likely push that date back considering there is more discovery to be done by the former president's attorneys,

along with this new codefendant as well. >> possibly. adding a third defendant and a few more charges runs the risk prosecute government's perspective of having the trial dates slide a bit. i don't think it has to. may is ten months out. they didn't add much to the indictment. and the new part of the case is discrete. that said, the defendant will argue they need more time. the prosecutor will argue it's sufficient to try the case in may. it will be up to the judge. i've heard conventional wisdom that the trial date would slide. i'm not sure that's right. there's enough time between now and then: we were all awaiting this incoming indictment as was being reported and told to us by sources on the ground. and there was this assumption it

was going to be about 2020 election interference. we knew the former president's attorneys met at the special counsel's office. what do you make up at the end of the day, instead of the third indictment, we have this superseding indictment. is there a possibility that the discussion that happened yesterday in the special counsel's office was in fact about the superseding indictment and not about a potential indictment for 2020 election interference. >> it's entirely possible. we don't know what the discussion was about. we know this, yasmin. mr. trump has received another target letter. it was related to the events of january 6th, and his attempts to thwart a fair and free democratic election in our country. prosecutors don't send out target letters on a whim. it's a real thing and so even if

it didn't come last week, it's coming soon. >> do you think with the superseding indictments this is how jack smith will play ball, maybe the indictment will come, and maybe a superseding indictment to that indictment will come as well. considering this time line crunch they have with the former president running for reelection. >> i was a federal prosecutor for a long time. you don't do superseding indictments because you hope to have your case wrapped up in one charging indictment. present it to the grand jury and have the grand jury vote on it. what happened in mar-a-lago, and this is conjecture, they had another piece o. case dangling out there, and they probably very much hoped that mr. de oliveira would be a witness and not a defendant. when fbi agents sat down with him in his home in january of this year, he had an option, which was to tell the truth.

he chose not to. the government had a dilemma, do you ignore it and walk away from somebody who's lied to the fbi and tried to obstruct justice or do you charge him, and i imagine the answer was simple. they had a charge and they had to do what they did. that doesn't mean he could never be a witness. lots of times witnesses later decide to plate and cooperate, and that could happen here. i hope mr. deolerer ra has a good attorney and has his interests in mind. one option would be to plead guilty and cooperate. as you mentioned earlier, he would be a very important witness. >> and that is why we talk about to, chuck rosenberg, about this stuff. thank you my friend. officials in alabama announcing charles for carlee russell. what kind of trouble does she face for orchestrating a kidnapping host. up first, it's hotter than

welcome back, july is set to be earth's hottest month on record, and it is not letting up. today, 149 million people, million people there under heat alerts in this country. that could set record highs. today, including washington, d.c., el paso, atlantic city as well, but heat is not the only danger facing america. millions are at risk from severe storms ranging from the midwest to mideast. george solis is in philadelphia, and nbc news meteorologist michelle grossman. george, i'm going to start with you, how things are getting relief in this heat?

>> reporter: you might be wondering why i'm not in the pool considering i'm dressed for it. as it happens with young children in pools, one had an accident. they are cleaning it right now. rest assured, as soon as we get the go ahead, we are diving right back in. that is one of the ways many people here in the city of philadelphia and a bunch of the northeast are beating the heat this weekend because it is scorching out here. it was so pled in there, i really can't underscore that enough how much we were enjoying it until we had to get out. now i can feel the heat again. it's uncomfortable. we are seeing a lot of parents with their kids, making sure they're hydrated, have that sunscreen on. that's the case across the city of philadelphia. we have the spring ground, the cooling centers here in philadelphia, just to make sure people are able to stay safe because obviously we know this heat can be deadly. another factor that the city of philadelphia is sort of addressing right now is making sure that they are contacting the elderly, making sure parents don't forget their kids in their

he did talk about obviously there are some very serious concerns when it comes to what we're seeing across this country right now. cities breaking records across the board. >> yeah, yasmin, i'm glad you broke that to him. it takes a long time to get the pool back in shape. death comes from the high heat. it's a number one cause of a weather-related death. it's not just daily highs, monthly highs, yearly highs, all time records, we're looking at all time records in the ocean. the earth's surface is covered by 70% of oceans. it directly transports heat to our poles, the lit regulator. this is really important, as we look at the hot water, it jacuzzi like. not just around the u.s. we're looking at 45% of the world's ocean surface temperatures in a marine heat wave. that's nearly half. but look what happens by september. we expect it to be half of our oceans in a marine heat wave. what is a marine heat wave. it's higher than normal

temperatures. 190th percentile, and intensity for a period of time. look at the temperature on the gulf, we're going from sauna out on land, right, into a jacuzzi. we're looking at temperatures in the upper 80s, 86 around florida. we're looking at 87 off the coast of texas, but it's not just those temperatures. we're looking worldwide. the mediterranean sea record warmed at 83 degrees. tropical atlantic, 83. 76 near 77 in north atlantic. that's 10 degrees above what is average for this time of year. gulf of mexico, manatee bay, i wanted to save this one, 101. that is the water temperature, so that is dangerous. and what does that mean? well, it means we're going to see really strong storms. remember, it's hurricane season, so we're looking at more intense, more frequent, more long lasting heat waves, and doesn't that sound familiar. extreme weather, longer, it's bigger, it's stronger and that's the story. that will be the story as we go throughout time. yesterday, secretary general said we've ended the era of

>> reporter: the potential trump indictment looming large over the lincoln dinner tonight here in iowa where 13 presidential hopefuls will take the stage. basically everyone except chris christie, and the event will mark the first time that former president trump and florida governor ron desantis will be at the same event here in iowa. this crucial early voting state, and while former president trump is still enjoy ago massive lead here in the polls, governor desantis is trying to reset his campaign, and trying to gain some ground. we spoke with some of his supporters at one of his events last night. take a listen to what he had to say. >> i voted for trump. i supported him 100%. >> now you're thinking perhaps desantis? >> yeah, just because i don't know that it's trump's fault he's got so much baggage, but because the democrats just present too much baggage for him. >> reporter: meanwhile, governor desantis is facing criticism from one of his other gop

rivals, senator tim scott, who is blasting him over those controversial african-american teaching standards that were just adopted by the state of florida. the governor has said that any criticism of the standards, which includes a portion that talks about potentially benefits that slaves got while they were in captivity, the governor has said that that was taken out of context, that overall the standards are robust. but last night, senator tim scott that there is no silver lining to slavery. joining other republicans including congressman byron donalds and vice president kamala harris in attacking governor desantis. his campaign pushing back on that. that issue, plus the trump indictment, looming large in iowa just a few hours before the lincoln dinner. back to you. >> thank you to gabe for that. i want to bring in political white house correspondent and playbook coauthor, eugene

daniels to talk about this. he's an msnbc political contributor. it's great to talk to you. the indictments, they done seem to be hurting the former president in the polls. i'm wondering, as gabe alluded to, how they are affecting his challengers. >> i think the challengers are getting more and more frustrating because the thing that should be the biggest weakness for donald trump, that he has been indicted and may be indicted more times in the future, including in the coming weeks, they can't use that against him or it hurts them and helps him, right. we saw between the time he got indicted for the first time, his quarter two numbers actually went up. he fund raised more. he almost doubled his fundraising from the quarter before. they can't use that against him. the voters as you heard from that voter that gabe spoke with said, you know, he liked trump before. now he's speaking about desantis

right? vice president kamala harris has spoken out against it. former congressman, donalds criticizing it. senator tim scott joining in as well, saying there's no silver lining to slavery. this is what governor ron desantis had to say. part of the reason, he says, our country has struggled is because d.c. republicans all too often accept false narratives, accept lies that are perpetrated by the left, and accept the lie that kamala harris has been perpetrating even when that has been debunked. is this yet another instance in which florida governor ron desantis is stepping in it? >> yes, because over the last couple of weeks, we keep hearing from the campaign is that this is a reset. he is going to run back as an insurgent candidate, it's going to feel a little different, and it doesn't. it doesn't feel different. it feels very much the same.

welcome back, we're following breaking news, four days after confessing her 49 hour abduction was a lie, carlee russell has in fact now been charged. joining me to talk more about this, nbc news correspondent priscilla thompson. good to talk to you. what exactly are officials saying here? >> reporter: yeah, yasmin, carlee russell has been arrested and charged with two misdemeanors, one for falsely reporting to law enforcement authorities and also falsely reporting an incident. each of those misdemeanors carries up to a year in jail and a $6,000 fine. police released her mug shot which was taken earlier today before she was released on bond, and what officials here are saying is that, yes, these misdemeanors may seem small like it's not enough, but they are prosecuting her to the fullest extent that the law allows, and officials said that she opened wounds for real victims of crimes like this, and also
