new indictments. it comes as he reacts on the campaign trail to his latest charges and the classified documents case. >> they waited two and a half, almost three years, so they could bring him right in the middle of my presidential election. its election interference. >> i consider it actually a great badge of honor. i do. it's a great badge of honor. i'm been indicted for you. >> new reporting from the washington post shows financial pressure is building. people familiar with the matter say trump's political group spent more than $40 million on legal costs in the first half of 2023 to defend the former presidents and his advisers and others. for more today, presidential candidate will hurt says the voters might start to take notice where their donations to trump are going. >> donald trump, all he's doing is litigating past elections.

when people start learning, when you give money to donald trump it's going to pay his lawyers, three out of $4 that donald trump raises this going to pay for his legal fees, and people are starting, even folks and republicans who voted for donald trump twice, they recognize this baggage is hurting him. >> now a federal grand jury will meet tuesday on special counsel jack smith's election interference investigation. earlier today, former january six committee member waited on the case as we await possible charges. >> i would imagine that if the target letter one out, of their hub in these last-minute conversations, they're ready to indict. he may just wanted dotted, i cross the t, instead of the wheels of justice moving slowly. they have moved very slowly. they appear to be arriving at their destination. >> trump could also speak face indictment in georgia where barriers are now surrounding the focal county courthouse in

atlanta. d a fani willis is giving new insight into her election investigation as she vows to give americans an answer by september 1st. >> some people may not be happy with the decisions that i make, gain and sometimes when people are unhappy, they act in a way that could create harm. i think the sheriff is doing something smart, and making sure that the courthouse stay safe. we've been working for two and a half years, we're ready to go. >> we have two reports on today's major developments, also new today, a brand-new fund raising pitch for donald trump, attacking former gop allies as rhinos republicans in name only. this after large crowds turned up at the scene of his rally last night in pennsylvania. with long and winding lines, people waiting to get to hear him speak. nbc's marissa is here for us. marissa, it looks like it was a large crowd. what did you see and hear from voters?

>> hey, erin. i'll point out for, israel, check the former president did post on truth social twice this morning. among the many things that he was saying, he was claiming, he called a special counsel jack smith, and everyone who worked with them thugs. i think that this is just part of the offense of the former president has been playing in the days since those new charges. starting with the iowa republican dinner on friday, and of, course last night with that rally here in pennsylvania. so the thing to remember, among the many, many claims, the defense, an offense that he's, playing kind of at the same time here, not just going to the offense when it comes to his rivals, his gop rivals, but then of course, as we mentioned, the special counsel jack smith, and everyone on that team. the thing that was interesting is that as he is currently being investigated, the former president, being investigated for his own efforts to overturn the 2020 election, among the many things that we heard last night, was a claim offered by the former president, without any proof, that all of these

indictments and charges are part of a scheme to rig the next election. listen for yourself. >> what you are witnessing is a continuation of the single greatest witch challenge of all-time. this is a prosecutorial misconduct. its primary purpose is to steal another election. they break the presidential election of 2020. we're not going to allow them to rig the presidential election of 2024. >> so this is rhetoric that we have heard from the start. you can see that his fan base has remained loyal throughout all of these legal woes and battles, as your bug to hear from herself. a lot of what they're saying is largely echoed and using the same rhetoric that the former president has been using and all of his public appearances. >> there just doesn't seem to be a red line for loyal trump

supporters. >> yeah. -- >> i'm out of the running. they're desperate. it's, the man's, he's done nothing. nothing to go to jail for. >> they're trying everything they can. all these trumped up charges. it's all bowl. >> he's winning in all the polls. i think they're just trying to frame him, get him in trouble. >> so i will point this out as well. we have talked about the tricky landscape that the former presidents gop rivals have right now. on friday we saw that former texas congressman, we'll, heard was faced with when he had harsh words for the former president. he was met with boos. this morning, we saw nikki haley, very cautiously say, i don't think he's the right president moving forward, otherwise we're going to have a

general election filled with legal battles. aaron. >> marissa parton, pennsylvania, thank you so much for that report. never going to head to nbc's julie tsirkin on capitol hill. with new reaction from lawmakers, julie, what are you hearing from both sides of the aisle today about trump's latest legal troubles? >> mueller, i don't know if you can, tell but this capital is empty. lawmakers went home for recess. even where they were here, we could chase them all this week for reaction to this new a slate of charges that the former president's face with as he still awaits his potential looming third indictment. republicans really didn't want to talk about a. as to respond to this news out of -- they really repeated claims that they have been making after the first indictment, after the second indictment. this was of course the federal indictment for those documents charges. they keep saying that this is a weaponization of government. this is against conservatives. even if they don't feel like defending him. this morning, we heard from governor kristin you knew of new hampshire, he was coming from iowa where he attended that lincoln dinner on friday

we're all the gop candidates who were running for president gave speeches, and address the crowd. here's what he had to say when asked a response to these latest charges. on the flip bend, you will hear from a democrat who had a front row seat during the former presidents forced and peach back in 2019. watch. >> well it's kind of the boy who cried wolf, right? we have seen the indictments one, two, three times. we expect more to come. >> the most important thing to take away is that donald trump does not believe that the law applies to him. he simply believes that he's above the law, and that he can do whatever he wants. we already had a very detailed, devastating indictments. now you layer on the knowledge that trump shows about the illegality of his conduct, and it just gets worse for him. >> now, erin, that was dan goldman, and a freshman congressman from new york. back in 2019, he was the lead counsel for democrats during the impeachment. when you heard combusted news melvin terms of this indictment, it's really what we've been

hearing from republicans even those who don't support the former presidents. sununu is certainly in that crowd. >> all right, julie, thank you for that report. in a few minutes, we'll take deeper into the latest indictments, and why one particular argument is not likely to hold up in court for donald trump's lawyers. right now, millions of people in the northeast and the mid-atlantic are finally feeling relief from the sweltering temperatures. today, cleanup is underway in virginia where a man was killed when a tree crashed on his homegrown storms last night. 200,000 homes lost power. meanwhile, other parts of the country are in the grip of a record shattering heat wave. today, phoenix enters its 31st straight day of 110-degree temperatures. this could end tomorrow, with temps and the southwest dropping slightly. and birmingham, alabama, rain just move through and now will feel like triple digits.

this will get even hotter across the south this week, if you can believe. at nbc's -- is in florida. right now it feels like a sweltering 95 to brees. floridians might be accustomed to these high temperatures, but how are they coping? >> aaron, floridians are accustomed to high temperatures, but not these high temperature. is this been hotter than usual during this heat wave. just standing out here in the sun, i have a hard time keeping my eyes open looking at the camera into the distance. there's been a lot of coverage of but the water heating up to 100 degrees that was in the key south of the miami area where we're at. yesterday, when we were here, i thought about getting the thermometer. i have a laser thermometer. i wanted to show you how hot the water is. now this is the bay here, this day. by no means is this an exact science, but, at least this gives you an idea. this is a water bottle that has

been sitting in the shade, not even cooler, but not in the sun. so a water bottle that's been sitting there for about an hour i'm going to make sure i get this right, okay here we go. 96 degrees, that's what we're getting. water bottle that city not here. if i touch the water, 103 degrees. now this is very, very shallow water. one more time, here it is. 103 degrees. this is very shallow water, it's not the ocean. if you were to go in the water, and take a swim, in the bay right now, the water you would touch would be 103 degrees. that is hotter than usual. people of course during these heat waves, the condo bodies of water to refresh. you can go to the, i can go to the ocean. and sell for these past few, weeks people will come to the beach, and you will hear them get in the water and say, wow, that's almost too hot to refresh me. yesterday there was a family that came with kids, right away, one of the kids took off issues around into the water and it's

interesting how a child, who's obviously not listening to the news, or understanding what's happening, the first thing he said when he touched that water, turns around his mom and said, mom, the waters to hot. so that is what we've been experiencing here until florida. of, course during this heat wave that's been blasting into the northeast, mid-atlantic, which they are catching a break. the temperatures here are expected to remain in the upper 90s. the heat indexes been in the upper 90s as well. now, the heats and the osha, the water warming, up air, that is something that we need to pay close attention to. it can have even more effects on the coral reefs, and also the temperatures. now we have more humidity in the air from the hot water. there was all sorts of effects that come from that, which scientists are going to be paying close attention to as we keep moving forward with these heat waves. >> yeah, and we all should pay attention. thank you. next, legal trouble still hanging over donald trump's head. while one of his mar-a-lago workers gets his first day in court. we'll be back in 60 seconds.

justice? no tapes were deleted. he turned them over, he cooperated as he always does. >> well that hunt, if that's their position in court, they can't just simply say the tapes were turned over because the government is not alleging that the tapes were destroyed. they are alleging, as you noted, an effort to get rid of the tapes. >> and there you heard it. a new line of defense today to the charge that donald trump wanted mar-a-lago surveillance tapes deleted. and it was immediately shot down. trump directly denying the charge, saying on social media, quote, i never told anybody to delete them. joining us now lisa rubin, msnbc legal analyst, and eric tucker, justice department reporter with the associated press. he's also coauthor on the latest ap report, fresh charges tie trump even more closely to cover up effort.

lisa, let's start with you. these are fascinating new developments. how do you interpret trump's outright denial? >> that denial is only going to be affected in the court of public opinion and with people who are already predisposed to him. the charge that has been made here, not only the obstruction of justice charge, but the other charges against trump, nauta, and thw codefendant, carlos de oliveira, all they are about our an attempt to persuade the i.t. worker we now know was trump employee number four to do that deletion for them. trump may be technically correct that he did not ever give an exact directive to someone with the authority or it information essence airy to delete those tapes to do so but he made that message clear through intermediaries to nauta and then to de oliveira and then two to various. distancing himself as a mob boss would.

but that is not going to save him legally. the very fact they conspired to do it and the tempted to persuade taveras to do, it that is within itself enough to constitute a federal crime any serious, one aaron. >> that being said, the fact that trump's lawyers argument is that the tapes were not ultimately deleted is adding and evil -- is not even an irrelevant defense? >> no, it's not irrelevant defense. i should know the person making that defense right now, alina have a, she has been a lawyer to the former president but she is not a lawyer involved in these proceedings. for purposes of this case, she is a trump affiliated lawyer who is doing legal affiliated pr. she's not involved in the defense of this case. you will not see todd blanche or john -- , for example, who are the lawyers defending trump against this case, todd blanche or chris -- who are involved in this case, you won't see them on tv advancing this defense because i don't think it is a defense

in court. >> the superseding indictment lays out a timeline showing when the draft subpoena went out and then trump calling carlos de oliveira and then the final subpoena going out and not getting a message that trump wanted to see him. now to changing plans and traveling to mar-a-lago, looking at surveillance cameras, and then the whole exchange involving de oliveira telling another employee, quote, the boss wanted the server deleted. eric, what is your sense of the physical evidence prosecutors have on the alleged cover-up attempt? >> that's a great question. i do think one of the things we've elected to hear from trump's defense going forward is the evidence alleged in the indictment is largely circumstantial, not direct. i do think the government is going to have to establish that trump did indeed say what he is alleged in the indictment who have said. i think that will be important. i think it is worth noting that the government did make clear, it did interview the people who are at the root of these

allegations in the indictment. we do know they have spoken several times to walt nauta, and we know that they spoke to carlos de oliveira. i think it's clear that they do have a decent sense of the chronology. you can see they have these phone records that lay out the exact length of time these conversations took place. clearly, there isn't the evidence i think we are likely to see them turn to going forward. >> lisa, back to you, the indictment also refers to the use of shush emojis, walking through tunnels with a flashlight, use of an audio room, and jumping through bushes for the alleged meeting between nauta aunt de oliveira. the property next to mar-a-lago. what is the case prosecutors are trying to make here? >> they are trying to show that nauta's trip to mar-a-lago right after the receipt of both the draft subpoena and then the ultimate subpoena was meant to be secret. he didn't want other people to know about it. and they had walt nauta's phones to pull text from's.

that's where that session modi comes. from the fact that they could also see them walking around the perimeter of the facility pointing at security cameras tells us that they also have surveillance footage not only from the storage room in which these boxes were kept and moved, but they have surveillance footage from around the property. they were able to see we nauta and de oliveira take that tour and basically try to evade detection, right? there's a description at one point of going through the bushes, even, to have a conversation. they didn't want to be seen because they knew where the cameras were. unfortunately, they were still seen. >> lisa, how much does the notion that donald trump allegedly asked to erase security video suggest he's actually aware of potential wrongdoing? does that carry any legal water? or is it just too much of a leap? >> i don't think it's too much of a leap, aaron. everybody who's -- nobody who's ever done nothing wrong with to delete security footage, let's start there.

as aaron alluded to earlier, he had a 24-minute long conversation with carlos de oliveira, who is a property manager. i'm going to guess they weren't talking about the state of azaleas, but rather they were talking about when did you move the boxes? what kind of security footage would have detected that? how can we get rid of it? who is in charge of it? those are the kinds of details that might have been part of the conversation between them for 24 minutes. and then as eric just noted to you, they did talk to carlos de oliveira and walt nauta allegedly, they are alleged to have lied to federal investigators about certain details. of that they may have memorialization of the statements that they gave when they were interviewed and the feds will use those. >> eric, back to you. what are you expecting when de oliveira makes his first court appearance tomorrow? do you expect trump's denials have any effect on what happens in court? >> i don't, at least for tomorrow. i'm anticipating a fairly perfunctory initial appearance in which he is going to have

the opportunity to enter a not guilty plea. i don't expect the former president as a codefendant to be there, he's not required to be there. i think we will see's what we saw with walt nauta when he was arraigned earlier this month. i think it's going to be a fairly dry recitation of facts and a not guilty plea from mr. de oliveira from his attorneys. >> and the other big element of the superseding indictment, eric, is listed as document 32, classified as top secret. and not to be shared with foreign countries. prosecutors say this is the document trump showed at bedminster. what are you hearing about how this came to be added? >> this is fascinating because if you look at the chronology, this is a document that was alluded to in the initial indictment and we had very firm denials from donald trump that he had ever shown this document to anyone. he was suggesting this is just newspaper clippings, just regular paper. but he suggested that he never, never had this document to

actually show to anyone at his bedminster golf club in july 2021. this suggests jack smith team is actually paying attention to the public statements donald sharp is making. this is an opportunity for them to publicly contradict his public assertions that he didn't know anything about this document. one other thing i think is notable from the allegation of the indictment is this is a document that was apparently returned in january 2022 in the initial batch of 15 documents, 15 boxes of documents and donald trump gave back to the national archive. months before the subpoena was ever issued. >> okay, lisa reuben, eric tucker, thank you so much for joining us and for your insight. >> thank you. >> they are going up and nobody is happy about it. the reason why next. nex imagine you're doing something you love. rsv could cut it short. ♪ rsv is a contagious virus that usually causes mild symptoms

new today, americans facing the highest gas prices nationwide in a long time. this weekend spike the highest

since november of last year. joining me now is nbc's dana griffin in los angeles. and dana, what exactly is driving the surge? and can we expect prices to continue to climb? >> you definitely can, erin. believe it or not, heat is actually playing a role in why we are seeing the price increase the pump. as people across the country are sizzling under the sweltering heat, so are our wallets. take a look. these gas prices show today's national average. right now it's $3.75. last week, that's about 16 cents higher than the 3:59 we were paying a week ago. last month, 20 cents higher since then. but the good news is it's still less than what we were paying a year ago, which is an average of $4.23. i gotta speak with adam, and oil and energy expert, he had a bit of a prediction as to what we can expect in coming weeks. listen. >> i expect that gasoline

prices will continue to rise another 7 to 10 cents a gallon, to a national average of around $3.85 a gallon. but in addition, diesel prices are increasing and that means the cost to deliver goods and services to the consumer is going to increase as well. and of course, that stokes more inflation. >> so there you have it. and the other concerning thing is right now we are in the peak of hurricane season. so if a hurricane or trouble storm makes it into the gulf of mexico, it can disrupt production. because those refineries will have to shut down, which could increase, again, the gas prices. right now, the only thing people can really do to try to help offset the costs is to figure out a way to drive less so that you are spending less time on the road and, hopefully, we will be able to save some money there. >> a staycation would be a good idea for the end of the summer. we nbc's dana griffin, thank

associate of hunter biden is expected to sit for the closed door testimony with the house oversight committee. the hearing is the latest in republican efforts to investigate president biden and his family. it comes after hunter biden's plea deal collapsed this week. earlier today, oversight committee members on both sides weighing in. >> this is a person who was in business with hunter biden, biden family members, he was the bff of the president's son. he has a lot of information, i believe, that we will be able to fact-check and cooperate with other witnesses and other whistleblowers. >> the fact of the matter is that this is a trump-appointed u.s. attorney, a trump appointed judge, this is a very

independent and thorough investigation. i think whatever happens in the hunter biden case, we can rest assured that it was done based solely on the facts and the evidence. >> and joining me now is texas congresswoman jasmine crockett, and democratic member of the house oversight committee. congresswoman, thank you so much for joining us. democrats like yourself take part in his hearing tomorrow, and from a republican perspective, how much do you think this is political? >> first of, all it's good to see you, erin. no, we will not be taking part. this is going to be a closed door hearing that they are going to have. it's just going to be the republicans on the committee, which means we cannot be sure that we will get the truth and facts out of this hearing. seemingly, the republicans are allergic to facts. i don't look forward to whatever lies will be spewed. interestingly enough, i think a

lot of my colleagues need to go back to school and maybe go into the work of being detectives. seemingly, that is what they want to do right now, is play detective. they want to weaponize the government. this is the party of projection. they continually say that this is what the democrats have done with these indictments of trump, not recognizing that, number one, these indictments have come not only from the federal level, but also the state level in multiple states, in addition to the fact that to weaponize the government means to misuse the government, say, for political purposes as your question insinuated. that's all this is. it's political. they don't want to focus on the problem known as trump who is their front runner for the presidency. >> congresswoman, i want to get your reaction to the new charges against donald trump in the classified documents case. do you feel republicans are unmoved by this latest evidence? >> i think republican primary

voters are unmoved by this latest development. i think it's a problem of their own making because they have the sensitized so many of those republican primary voters to the idea of reality, two facts. and so, we know that what they are thinking is that this is all a hoax. it's kind of like what we saw with covid-19. they continued to lie to these poor people and believe the lies. i don't know if they recognize that trump is in real trouble. i have practiced in federal courts. the last thing i ever wanted to see was a superseding indictment. in fact, we know normally were informed before one may be coming down. a lot of times, it allowed us to go ahead and enter a plea. they are usually really open about the facts and evidence they plan to put on in the superseding indictment. but this is a bad, bad look for trump, this entire thing was a

bad look for him. i am seeing no good coming out of this. >> all, right and i want to ask you, one of your colleagues, democratic congresswoman becca balint is pushing to censor republican marjorie taylor greene for dozens of controversial comments as well as actions. a list of 40 grievances includes her showing that graphic image or graphic images of hunter biden during a hearing, and being sympathetic towards insurrectionists. should mtg face censure by the house and it would have your vote? >> it would absolutely have my vote. censure would be the least of her worries, honestly i still don't understand how this woman sits in the chamber. she is completely disrespectful to the entire institution. she is disrespectful to the entire process of what it looks like to conduct a hearing. i actually was sitting in a far from her when she pulled that out. i was in utter and complete

shock. in fact, the majority of us were. but seemingly the majority was not in shock because the chairman decided to give her extra time. she continued to go over and over and over. we normally only get about five minutes to question a witness. she did about eight minutes of questioning. it was absolutely absurd. the fact is, she was not asking anything of consequence. while she was doing was disparaging his character, embarrassing him and his family by displaying these very graphic pictures in our institution. >> i want to switch gears to the current crisis in your state, a legal fight is intensifying between the doj and the state of texas over this floating barrier in the rio grande meant to stop migrants. the doj wants a judge to order governor greg abbott to remove those buoys you see there, while the lawsuit proceeds. but the governor's office said it will not back down. you are among the lawmakers who

everything. there is a bit of a sociological and cultural phenomenon to donald trump that could be studied for years. but politically, what we know is that his grip on the party remains as strong as ever. i believe at this point we might see donald trump go wire to wire in the republican primary, as all these other candidates will just never have an opportunity to encroach upon him, which then sets up a very hard question for the nation. as you've discussed, we likely will have a house republican conference that may impeach joe biden and expunged, though it is legally meaningless, donald trump's impeachment. donald trump will run around the country saying joe biden -- i wasn't impeached, you were. what we know from republican voters as they believe him and a by that. donald trump will put this almost existential question for democracy on the ballot next november. will you look at my view of law and order and justice? or will you accept the traditional view of line justice, which joe biden offers? it's a dangerous question. in a general election, we know

it's a tough argument for donald trump to make, he's lost on that in the past. >> and, don today, republican new hampshire governor chris sununu remains confident trump will not be the republican nominee. take a listen. >> we will narrow that field down, it's not going to be 30 people going into iowa and -- new hampshire by any means. by super tuesday, i think it's a one-on-one race. the former president loses. that is how the math is ultimately going to play out. because the majority of republicans don't want donald trump. it's not what he has, it's what he doesn't have, right? and again, in the next six months, it's only going to get worse. >> do you agree with that math or do you envision trump ultimately facing president biden in 2024? den in 2024? >> donald trump is your nominee, electorally, he is the nominee. i don't know what we've seen from 2015 when he -- to now that would suggest he has not won the hearts and minds of the majority of republican primary voters. that is over.
