the country. more on that story a little bit later this hour. we're going to start this hour with what is expected to be the first public appearance for carlos de oliveira, the mar-a-lago property manager, luis just added as a third defended in the superseding classified documents indictment. he scheduled to be an arraignment in miami tomorrow morning. he's facing for charges including obstruction of justice and he is accused of being part of an attempt to delete subpoenaed security footage on we half of the boss. joining us now to discuss it is jordan reuben. jordan, good day to you. we expect this arraignment to happen tomorrow giving the delay we saw with walt nauta and him claiming not to have local council. do you see this happening with de oliveira? >> so, i actually do. earlier this afternoon not long before i am getting on air now, i reached out to john irving, the known eloy or for mr. de oliveira. i asked if he expected to have

a local florida council ready to go by tomorrow. he said he did not think he would. i don't expect much to go forward tomorrow. we don't know how much of a further delay there will be. i won't expect much to go forward tomorrow. it is a question of a bit of a delay before mr. de oliveira's case gets going. >> you said we are not sure what happens next. based on precedent, will not as an example here. do they just not move forward? does it stop for a week? does it stop for two or three weeks? what's the possibility? >> those are some of the possibilities. until you have that local council secured as we saw with walt nauta, that really stops the case from moving forward. how much leeway did they wind up getting to sort this out? it's unclear. the indictment did just come down. given all the delays that have already happened with walt

nauta, i would imagine that the court is going to want to embrace a lot of delays. at this point, it would be very surprising to me if mr. de oliveira went with the arraignment tomorrow. >> what does this mean for this specific charge? what does it mean for donald trump? >> it makes a bad case worse for donald trump as for the substance of the charges, saying nothing for what it does to the case being delayed. >> twice as worse? this is 50% worse? i'm not actually going to take out my calculator here, but how much worse does it make it? >> you know, it's worse. the thing that i would emphasize is that it was already really bad. i think that while the superseding indictment is not as shocking it is not a piece of legal work that needed a lot of improvement. i'm referring to the initial indictment. whatever magnitude you want to use, it was already really bad and now it is really, really

bad. you don't want to be prosecuted under either version of the indictment. i think the question is when it actually gets to a jury. >> may was the month that was thrown out. what happens to the? >> possibly nothing. it would be a little surprising to me if there is actually nothing. we actually saw the special counsel in a filing which was filed alongside the superseding indictment among other things. by the way, there is no reason that the trial date or the litigation schedule needs to be altered. they are cognizant. they are referring to the justice department. they're wanting to get out in front of this knowing that regardless of what judge cannon ultimately does the difference is going to try to delay here. it already bakes in a delay. frankly, that is not the problem of the defense. that is a governments choice to add these charges.

they are going to have to deal with whatever happens next. >> is this the defensive strategy here? i don't have local representation. >> you know, it's too early to say whether that is going to happen with de oliveira. there was a bit of that happening with walt nauta. look, we are just a few days out from this. i think it's a question of how the judge responds at the arraignment. we will see how much leeway looks like they are going to get. >> jordan, thank you. jordan reuben with us today. as former president trump looks to unseat biden, it appears he's not content to wait until 2024 to do that. duringlvia rally last night, trump called on republicans to aid in impeachment efforts or else. >> the republicans just don't fight the way they are supposed to fight. any republican that doesn't act on democrat fraud should be immediately primaried and get

out. out! >> i want to bring in maria gaye scanlon from pennsylvania. i appreciate you being with us. you are also chair of the house judiciary committee. when you hear donald trump right now, a member of the judiciary committee, when you hear him saying that, are there republicans wavering? is that his concern right now that they are saying that they are not going to go that far in the impeachment probe to go after joe biden at the moment? are you sensing that? >> i think we have been hearing that over the last few days that republicans who are aware of how our constitutional system should work and those who have some respect for those checks and balances are not ready to go into an impeachment of joe biden when there is no evidence to justify. that is where the president and his supporters are trying to continue whipping up their rage machine.

it really is fairly remarkable. the only people who are on board with this are the ride or die trump supporters. >> when you are in the chamber and the fellow republicans are sitting close to you, is it like, here we go again? i am worried because i saw my fellow modern publicans getting primaried. i better do something. >> i have not had those conversations. that is certainly what we have seen over the last three or four years. those republicans have been willing to stand up for the former president. they were willing to vote for the january six commission and for impeachment. most of them are no longer in the house either because they were attacked so viciously by the former president and his supporters that they decided it wasn't worth it anymore. they retired. they tried to stick it out.

the president primaried them. this is a threat he has made good on. people seem very aware of that. we have his primary supporters, the three jeez. they are leading these crazy efforts. >> at the rally, donald trump was speaking. he mentioned that congress should refused to provide more aid to ukraine until information is turned over on hunter biden to congressional relic and's. in government and governance, these two things don't seem like the other. will this work? >> what it shows is the through line of donald trump carrying putin's water at every opportunity he gets. he may very well need putin's help if he is going to run for office again. it really is shocking.

check and balance between the different branches of government? >> there certainly are the checks and balances. congress does have some rights to regulation over the court including how many people are on the course. there are arguments for term limits. there are exclusive constitutional provisions who say congress has the same jurisdiction of the court. the broad statement certainly is not true. what we have here is self inflicted wounds by justices like alito and others who haven't been holding themselves to a high standard. at a time when courts and everything else have been so politicized, important that the court does unfold the highest standards rather than opening the door for the kinds of legitimate criticism which some of the justices have gotten for muddying the waters when they are overseeing cases, that they

a lot of people escape the heat by going to lakes are coming to the beach. this heat wave has been so bad with those ocean temperatures rising that the water has not been a very refreshing at all. this is a water bottle that has been sitting in the shade, not in the sun. we would say it's normal temperature. i have a laser thermometer here. the water bottle that has just been sitting outside right now it is 84 degrees. the water inside of the bay, if you were to step in right here, it's 97 degrees. of course, this is not an exact science. this is just the bay. it's not the ocean. this is shallow water. i've been trying it all day. i've gotten some parts were its 103, 100. you get the idea. if you were to go for a swim in the bay in miami, you would touch water that is almost 100 degrees. it's not really refreshing.

and that is why a lot of suspicion is bound to be falling on islamic state in pakistan and afghanistan for the latest attack. so, there is that dynamic and there's also the fact that this was a rally that was ahead of a general election throughout pakistan expected to be coming up in the fall and we've seen a lot of political turmoil and pakistan a lot of increased terror attacks and this is the latest event. a lot of people are just worried that with the increased tax that some of the targets could fall on elections and could fall on political parties which would keep a lot of pakistanis at home away from the vote and could end up scheduling the results so there's a lot of concerns that pakistan is already a very politically unstable country could be having more instability from the two forces. the resistance from the islamic

state and the instability that's going to come from this upcoming elections in the fall, richard? >> nbc's matt bradley thank you for that report we appreciate it all eyes will yet again be on miami as a mar-a-lago property manager and third defendant the superseding classified documents indictment is scheduled to make his first public appearance there tomorrow morning he is facing four charges including conspiracy to obstruct justice he's also said that deleted subpoenaed footage at mar-a-lago on behalf of the boss in his request. drumming to discuss is the formal prosecutor glenn kirschner he's also the host of the podcast justice matters gland for just revisiting the story how big of a deal is this now that he is being added to the prosecution's case.

>> it's a big deal for a couple of reasons. anytime you add a codefendant or conspirator to the mix there is a chance that that person will cooperate with the authorities against the bigger criminal fish people should know that often prosecutors will find developing witnesses before people are indicted because those potential witnesses want to play hardball and they see their name as a marquee defendant on the wrong side of the v. versus carlos and sometimes that is a wake up call. i've had lots of defendants hold strong but once they saw their name on an indictment they decided it became very real and it would often jump-start discussions between prosecutors and defense attorneys trying to break that newly-charged defendant on board as a co-operator.

>> from what we, know might he flip? >> you know there's always a chance does he want to go down with donald trump because if you read the indictment richard there are some blockbuster evidence in there for example when trump employee number for the i.t. director mar-a-lago said that codefendant came to me and said the boss wants the server to leave it that is blockbuster incriminating evidence of a cover-up. the other things people should know is the rules of coconspirator statement say that statement when introduced into evidence will be used to incriminate the oliveira but any statement by any coconspirator is admissible against any other coconspirator even though de oliveira is the one that made that statement it can be used to incriminate the boss who is donald trump.

so it's very sharply incriminating evidence. now the prosecution's burden is here to prove the boss equals donald trump presumably but he could have a bosses, there could be a metal box that said oliveira go do that. how would you handle that? >> that's the beauty of a juror trial richard these are decisions that jurors will have to make the prosecution will prove pretty compellingly that the boss who wants mar-a-lago services deleted is donald trump the defense is free to prove that it's somebody's perhaps under donald trump who has the most to lose if incriminating information from those servers comes into possession of federal prosecutors. >> it's obviously donald trump so i like the prosecutions odds of persuading injury that in

the context of the statement is donald trump as the trump teams are raising money now paid for a lot of trump and his colleagues thought lovera in this particular case they are helping to pay for their defense and they're saying the political action committee requested a refund on a 60 million dollar contribution that it made in the re-fund was sought as the political action committee save america spent more than 40 million in legal fees incurred by donald trump. witnesses in various legal cases relayed him this year alone. so if the money dries up and we have more claw back from these donors into these packs, what can trump do to cover the legal fees. does he have the money, it seems like he might but what would happen if he doesn't have the money that he thought he

had. he can fund-raise he can dig into his own pocket his own bank accounts and assets. i think prosecutors would be less concerned about where the money is coming from and more concerned about whether the attorneys who are being hired to represent for example codefendants and coconspirators like if they really truly independent defense attorneys who are zealously representing their clients rather than representing the interests of donald trump, because conflict free counsel is something that is guaranteed by the constitution so i think the prosecutors will keep their eye not only and where the money is coming from but where the attorneys are actually representing the client. >> if he says he doesn't have local council how long will that last is a stalling tactic if it is a stalling tactic. ? >> not long they can get a

has control over the room he is still able to go to iowa and dominate the process there think it's also important to say that you do have some of the candidates for directly going after him give chris christie and asa hutchinson. look at where they are pulling right now look what happened to will hurd former congressman hurd who made that case to republicans an eye when he was booed off the stage the republican base right now is locked under donald trump and they don't want to hear this kind of criticism even though you have republicans who are waving the red flag saying do you really want to go into the 2024 general election with someone facing indictment and perhaps convicted of multiple felonies. are we falling into the same dynamic potentially for a moment consider this charlie what we saw on 2016 and 2020 donald trump raises his arms says anything he wants to pose

all the air out of the room doesn't matter what the candidates are opponents are saying he's able to control the space whether it's good or bad and it's good for him. it is at this point and what else is good for him as rhonda sanchez who's supposed to be the big trump killer is floundering. one of the best things it's happened to donald trump is that ron desantis really took up a lot of space and time and people thinking he was gonna be a plausible alternative and he has been crashing and burning since he launched his campaign. so yeah i lived through 2016 i lived through 2020 we saw what happened there is no question that donald trump is going to continue to suck all of the air out of the room dominate the debate. republican candidates should not make the case that they're making. at least right now republican voters cannot say that they have not heard the other side

that you need. and right now, gas is being added to that list. it is not just the fact that production has been cut. it is also because of this record breaking heat that we have experienced. right now, the average for a gallon of gas is $3.75. that is 16 cents higher than last week. although, cheaper than a year ago which was at $4.23. and 20 cents higher than we were at last month. so, experts say it's because of the cuts that have occurred to oil production. it is also the heat. refineries are not built to withstand 100 plus degrees temperatures for several days in a row. so, it is not making people have to choose between whether they need to pay for gas or other necessities. including one woman who had to make a tough decision. listen. >> i had to take money out of groceries to make sure i have gas to get to the store. so, it's like a lose lose situation basically. >> you are going to look and
