for the year. and terrifying moments in the skies with a series of small plane crashes across the country. we begin with mounting legal troubles surrounding former president donald trump. just moments ago mar-a-lago property manager appeared in federal courtroom in miami to be arraigned on charges related to the classified documents case, prosecutors say trump asked him to delete security camera footage to obstruct the investigation. trump and his aide walt nauta pleaded not guilty to the original indictment last month, this as the former president could face new criminal charges as soon as this week in special counsel smith's other investigation into interference in the 2020 presidential election. grand jury in washington investigating the manner is expected to meet again tomorrow. all of these investigations come with a huge price tag the

washington postreports trump's political group has spent more than $40 million on legal costs in the first half of this year to defend trump, his advisers and others. with us to talk more about this is katie phang and ken delianian. katie, you were in the courtroom just a few minutes ago for today's hearing, what did you see? >> so, jose, as predicted there was no local counsel able to practice in the southern district of florida that appeared with carlos -- the only person who came with him was his other lawyer out of washington. i want to note, jose the first time we have seen carlos's face and they entered the courtroom

in front of the judge torres, the arraignment has been rescheduled for thursday, august 10th. his lawyer currently asked for more time. interestingly, judge torres responded with the following, the judge as cannon wants him to handle this before that upcoming august 25th pre-trial -- the hearing on the section 3 motion for protective order. released on $100,000 personal security bond. his passport has to be returned. there was no objection by counsel to a special condition that both trump and nauta have to abide by which is there will be no contact with the list of witnesses that the government has turned over, the head of the counterintelligence division was present in court today along with an assistant. at this time, the arraignment

has been rescheduled for thursday, august 10th in fort pierce. there was announcement that he's quote in the process of obtaining local counsel, but again, he didn't enter a plea at this time. the charges were read to him from the superseding indictment. >> so, ken, he still doesn't have a florida-based attorney, how could that affect the case going forward. >> jose, it could delay things a bit, but he has an existing lawyer who's beginning to get up to speed right now and it's interesting that judge cannon wants to get the arraignment done before the pre-trial hearing on the classified information, she wants to move this thing along, most legal experts believe the addition of this third defendant and the new

conspiracy to obstruct justice. a lot of things could delay this case. there's a chance that might not go to trial before the 2024 election, jose. >> dave, how do you read this? is this something that could actually delay things to, you know, past november 2024? >> bit by bit, piece by piece, i do think this case is heading to a trial after the 2024 election, that's what trump wants, walt nauta said he couldn't find local counsel delayed things further and now he's following that playbook, they're all doing this with trump-paid lawyers, no surprise that they are pushing for more delays and each bit of delay makes it harder and harder for jack smith to try this case before the election, i think he has an insurance policy, i think the january 6th indictment coming i think that will be

tried before the documents case because that's going to be in d.c. with a d.c. judge. >> dave the fact that if you can't find local counsel it does affect things legally for you, do you think this is something that's part of the plan from the trump defense team to delay things? >> we prosecutors don't believe in too many coincidences and when you have a defendant wliek donald trump, whose strategy is delay, delay, delay, and all of a sudden his co-defendant walt nauta said he can't find a local attorney and now this, yeah, call me skeptical but i think this is part of greater strategy to push this past the election because trump doesn't have a defense in this case, he has not articulated a defense to the documents case, i think his only

defense is hoping that he or an ally becomes president and can end this investigation, you got to push this trial past the election. >> garrett, we're finding out that trump's political group has spent more than $40 million on legal fees, raising some eyebrows. >> that's right, jose, defending the former president and his allies in these court appearances is an expensive business, the washington post first reporting over the weekend the price tag was $40 million so far this year. that's from a pac that takes some money from donations that come in from average people when they donate to donald trump, some of their money ends up in that pac. that may not not be the format going forward. the former president is looking to set up a legal defense fund. a trump spokesman said because this people are being targeted and it's only fair to help them get through a legal process that

they wouldn't otherwise be in. it's raising eyebrows. it's a legal use of campaign adjacent funds coming from a leadership group, a pac, not directly out of the campaign's bottom line. >> dave, some of those legal fees are going to lawyers who represent several different people involved in the trump's investigations, is that also something that's above board. >> it's not illegal to pay for your colleagues' attorney fees even if they become defendants like nauta. what's a crime is if you try to tamper with a witness, try to condition paying for their fees on what they will say and so that's what jack smith is going to be looking at but what could be a better -- a charge for prosecutors is if they could show that the money that was raised into the pac, that is paying for the attorneys' fees

was raised under false pretenses, was raised to pay me and donate to my pac so that i can find these so-called election fraud and then it gets diverted for pay for attorney fees, that's fraud. that's a crime. that could be prosecuted by jack smith. >> jose, we're watching for any sign that donald trump's attorneys come in to make a final appeal to senior doj officials before the mar-a-lago indictment. the grand jury meets a few blocks from here tomorrow and a lot of signs and tea leaves are pointing to action this week but it's a secret process. >> thank you all for being with us. turning now to another major

case concerning the former president, just this morning a judge rejected trump's attempt to squash the fulton county grand jury's investigation and disqualify fani willis after she reinforced she'll make decisions before september in the investigation into trump's efforts into overturning the election in georgia. >> the citizens of fulton county, that we're going to be making some big decisions regarding the election investigation and i would do that before september the 1st of 2023 and i'm going to hold true to that commitment. >> joining us now is blayne alexander. good morning. what else can you tell us about the judge's rejection? what it means for the case? what we should be watching for? >> reporter: so let's start with that judge's ruling, so the attorneys for former president trump really have made a three

attempts in different filings to get this whole thing just kind of go away essentially, asking to discall my the fulton d.a. to investigate the former president and squash the report that came from the grand jury. this is now the second time that such an attempt has been knocked down by a judge. the judge essentially for a number of reasons he was going to deny that request, another hit to the trump legal team which i find it interesting they're making these requests before charging decisions have been made. as for what we're watching here in fulton county, behind me you see these orange barricades set up in front of this courthouse, that's something that's new, the first day of a thee-week period that we're watching very closely, fani willis back in may said given the strongest indication yet this is going to be three-week span of time where

we're going to hear charging decisions from her, july 1st to august 18th. she said that she's having 70% of her staff working remotely. secondly, she asked judges from to refrain from scheduling any. >> coordinating security around this courthouse she wanted to give ample time to make sure that the security is up to snuff. to make they've done their due diligence to secure this building, secure this complex ahead of potential indictments against the people that she's been investigating namely the former president, jose. >> thank you so very much. up next, the u.s. urges americans to get out of haiti as soon as possible as word comes

number on your screen, or visit coventrydirect.com. 14 past the hour, right now u.s. officials are racing to help rescue an american nurse and her child who were reportedly kidnapped in haiti. they were taken from the campus of the aid organization where she works according to the statement from the group. the kidnapping took place on thursday the same day the state department encouraged u.s. citizens to leave the country amid increased violence and civil unrest. kristen, good morning. what are the latest developments in this case? >> reporter: dorsenville is from here in new hampshire, she considered haiti home at this point, you know she spoke about

how she loved helping the children there, she was working as a nurse for this aid organization founded by her haitian-born husband, that organization said it's doing what it can working with its trusted part nerts in haiti to secure her release as quickly as possible. this is as you mentioned coming at time where the conditions are deteriorating in haiti, many cities are in control of gangs, there are reports that there have been 40 kidnappings and another 70 killings during the period from may 1st to july 12th. when the state department sent out that warning non-essential workers to leave the country it also said that it had limited abilities to help americans in an emergency. at this point. it so's unclear exactly what channels they're using to try

and secure this woman's release, but a very dangerous situation there in haiti the united nations is urging partner nations to take the lead in some security force moving into that country. we're contining to monitor that situation. lot of people around here watching very closely, jose. >> indeed. it's got to be so difficult for officials to try and get through to the people that may or may not have them in their possession, it's haiti going through such difficult times, the haitian people have been suffering for so long, now this is touching americans, it's very difficult to see how this is going to be resolved. >> reporter: right, and you know with some many gangs if control and moving through these cities it's unclear at this point who those negotiations might even be with, the organizations that have dealt with them in the past

22 past the hour, this morning brand-new polling gives us fresh insight into the state of the 2024 race for the white house. donald trump leads the pack with 54%. the only candidate to hit double digits is florida governor ron desantis with 17%. no other contender broke past 3%. joining us now jeff bennett,

victoria francesca, so, victoria, the times also points out that trump, quote, led by wide margins among men and women, moderates and conservative, those who went to college and those who didn't. how do these other candidates chip away and trump's broad republican support? >> it almost seems insurmountable and the bump that donald trump recently got with the indictment is also not surprising because what we've seen in the is that donald trump is really at his best when he can highlight or frame that he's being attacked, the underdog, that he's the victim, accused of unjust things, that speaks to that base and has an incredibly

rallying cry, but these last couple of bumps really speak to that. the rivals get back to figuring out about the table issues. connect to folks on everyday issues that affect their day-to-day lives. >> nbc reporting is of the dozen of people who served in trump's cabinet only four say he should go back to the white house, explain the disconnect between those in washington and maybe even in the media and republican voters? >> reporter: it's remarkable. what it suggests to me jose it's a message that's not getting through to and not resonating with the trump base, you know one of the prevailing questions going into this election cycle was, is there another candidate who could own the mantle of

trumpism, that if trump candidacy were to collapse, someone else to carry that flag theoretically ron desantis was poised to own that lane but the trump base, the republican base is not focused and not really energized or animated to move on, they're not concerned about policy, they're not all that concerned about electability. republicans lost the house on his watch in 2018. 2022 in the midterms republicans underperformed in large part because of his influence, the republican base is focused entirely on trump's personality, the cultive personality that is now the republican party and reporting out the poll findings i was struck by a couple of voters, one said as long as

trump is in this race trump's the guy, another voter talked about the difficulty that ron desantis will have in overcoming trump enthusiasm in the republican base. you don't see anyone wearing a desantis hat. beyond the enthusiasm, trump's rivals have another problem is that the republican infrastructure is heavily weighted in donald trump's favor, state party chairs who are maga -- winner take all republican nominating system which means even though donald trump -- has about 40% of the republican base that's enough, that's muff to win enough states and to emerge as the gop nominee, jose. >> i mean, i want to bring in former republican congressman barbara comstock, thanks for being with us, your thoughts on this, some republican candidates are taking some aim at trump,

watch these. >> i think a lot of the stuff when he hits me with the juvenile insults i think that helps me. >> donald trump isn't running for president to represent the people that voted for him in 2016 and 2020. donald trump is running to stay out of prison. >> it's most likely that by the time we get on the debate stage on august 23rd, the front-runner will be out on bail in four different jurisdictions. >> you know, barbara, for many weeks republicans have skirted away from attacking the former president, what's the bet they're making? >> well, for one thing they're speaking honestly, will hurd and chris christi and asa hutchinson who also spoke at that event and pointed out that these are serious charges that he'll be

facing, you know, they're explaining in a general election donald trump who lost the white house, the house and the senate, is not going to be a very viable candidate, and one of the things that trump said this weekend, he's telling other candidates to get out of the race, money shouldn't be wasted on them that should be going to him but he's wasting $40 million on his legal defense if you're donating to donald trump you're essentially donating to his legal defense fund not to a campaign for president. so chris christie and will hurd are exactly right. he's running to stay out of jail. so this is not, you know people aren't -- republicans need to be focused on the general election if they any interest in winning and donald trump, you know, in pennsylvania this weekend he lost that by 80,000 votes, almost 100,000 votes, i don't

see those votes switching, i have family in pennsylvania. they kicked donald trump's hand-picked candidates last year to the curb by pretty big numbers. >> barbara, how do you explain how people outside washington and new york and in places the first primary's going to be held or the first caucuses are going to be held, how do you explain their -- it looks as though dogmatic support of donald trump come whatever may come. >> the problem is the other candidates certainly, desantis who i really think that's over, put a fork in him, they've been skirting around it, so that's why i think it's helpful for these candidates who are speaking truth.

a lot of seats with lost in 2022 by trump candidates. but so many republicans have been telling them that trump won. so if you're one of those republicans who think trump won in 2020, you're somehow thinking, oh, he can win again, well of course he didn't win and in 2024, when kamala harris is going to be in that seat not mike pence donald trump is not going to call her up and say, hey, just say i won, so, you know, this is not a winning strategy, and, you know, republicans still have an opportunity to change course and look at some of the other candidates and i think that's what, you know, at least people like chris christie and will hurd and asa hutchinson are trying to warn walking off a cliff again with donald trump he only cares about himself. he's using your money to fund his defense.

not a campaign. and as always he's lying to you and, you know, he doesn't do well in court so he's going to be tied up in court when he needs to be out campaigning and he's going to be spending campaign money on those very cases. not a good candidate. >> meanwhile, victoria, the washington post points out that democrats are becoming worried their most loyal voting bloc black voters won't turn out for biden in 2024. >> well, there's no one right answer to this connecting to them on the grassroots level, it's talking about what hasn't been done, if you ask folks to go out and vote that's not going to cut it you have to be able to connect what the biden administration has done, how it has affected their lives and why we need to keep moving forward i think that's the number one

37 past the hour this morning, police in north carolina are searching for the driver of this black suv who they say is an older white man after he appeared to intentionally hit six migrant workers outside a walmart there yesterday. police released new surveillance video, pulling into a parking lot before hitting the workers. police say all six people were transported to a hospital and that their injuries aren't life-threatening. turning now to fallout from

extreme temperatures across the country with millions of americans facing sweltering heat, drivers are now seeing the cost of filling up their gas tanks go up. today the national average for a gallon of regular gas is up 16 cents from just one week ago at $3.76 according to aaa. in california, it's much higher. a gallon of regular costing about $5 on average. joinings us now in los angeles is steve patterson, what's about the recent heat waves that has made the cost of gas go up. >> reporter: $5 on average in california but as you see over my left shoulder it can be much, much higher and los angeles isn't the worst place, some places are averaging $6 a gallon which is just ridiculous to think about and before we get to the heat we have to talk about things reporters normally say this time of year, the height of

driving season with that dreaded summer blend and crude oil prices are a bit different with production being cut worldwide, that's one of the biggest contributing factors but certainly so too is the heat because specifically these refineries that you'll find along the gulf in places like texas and louisiana and on the west coast are so overheated with repeated hundred-degree days that they literally can't operate at full capacity which means production at those refineries, they take that crude oil turn it into usable stuff that we use every day. they can't operate because it's so hot at those places which it makes it really, really difficult. and spikes the gasoline prices.

it's hotter in general which means those refineries get hotter quicker and it's a vicious cycle, jose. it was of course a lot worse last summer the hope that it doesn't spike even further but as we have been speaking to experts we expect another seven to ten-cent increase maybe along the lines of $3.85 before the driving season ends. it will get worse before it gets better. that's what we're hearing. the only advice if you don't have to be in your car especially here in california don't be. find another way to travel. jose. >> steve patterson in los angeles, thank you very much. this afternoon, stocks are poised to close higher for july as the month wraps up today. and this week marks another busy slate of earnings reports with apple and amazon's quarterly updates coming on thursday.

dominic chu is with us to break it down. >> reporter: two of the most popular and recognizable consumer brands out there, two of the most valuable companies in the world both are part of that so-called trillion-dollar club, the market value of each of them, apple is the biggest company out there with a market value of over $3 trillion. and amazon is worth around $1.4 trillion. there are only five publicly traded companies in the sfier s&p 500 that are part of that trillion-dollar club. because of the big market values, there are a lot of things that people will be paying attention to in those earnings reports and the price action to follow because apple is roughly 8% of the entire s&p 500 just by itself and amazon is about 3%. within the nasdaq 100 those ratings are even bigger, apple

ukraine has not claimed responsibility but following the strikes president zelenskyy said that the war is returning to russia. in pakistan, funeral rgs being held today in a province near afghanistan border after a suicide bomber killed at least 45 people. the attack took place during a rally for a pro-taliban cleric on sunday, no one immediately claimed responsibility for the attack, but police said the islamic state's regional affiliate may be behind it. in niger, thousands took to the streets on sunday in support of a military coup d'etat there. some demonstrators swarmed the french m embassy setting a premer the door on fire. meanwhile, this is first image of niger's president since the coup as he met chad's president.

joining us now from nniger, courtney kubie. what the situation like today? >> reporter: we were pretty surprised to see the democratic elected president of niger today. we've seen him since this coup unfolded last wednesday, it started wednesday morning when members of his own security services took him into custody in his own presidential residence. he's been held there ever ever since. they believe that he's still in good health and they've been able to communicate with him throughout the last six days. but the president of neighboring chad was set here as a em sarry, there was a meeting of these western african nations yesterday, they came together

and came out with a pretty stern warning for the military leaders behind this coup here, saying they would cut all ties with niger, close down their borders with this country and if they didn't release the president in the next week they threatened there could be military there could be military action. so the president of chad flew here today in in addition to meeting with the president, he met with at least one of the leaders of the military junta who are now the self-proclaimed leaders of this country. but you also mentioned these protests. from the beginning, there have been a couple of smaller protests. at times, they grew a little violent. but what we saw yesterday was these demonstrators in huge numbers. upwards of 20,000 people took to the streets. blotched traffic. most of what we saw in the streets yesterday were relatively peaceful. people were smiling.

skies across our country. the national transportation safety board is now trying to figure out what led to several small plane crashes in different part of the country. unfortunately, seven were killed in the crashes. jesse kirsch has the latest on the investigations into these incidents. >> in the middle of a picturesque new hampshire beach day, a terrifying scare in the sky unfolding just offshore. >> aircraft in the water from the main beach. >> this single engine plane was towing a banner when it crashed into the ocean near hampton beach with only the pilot on board. it happened roughly 90 feet from shore with state life guards helping the pilot get safely back on land. adam and his family were there. >> it's a miracle quite frankly that nobody got hurt on the beach or cabin. >> outside los angeles sunday, a pilot and two passengers were taking over from this california

airport when the faa says the plane slammed into a hangar. all three were killed. in wisconsin, there were two separate deadly crashes near an air show. authorities say two people were killed saturday morning when a t 6 texan single engine plane plummeted into the lake then just hours later. >> they hit another airplane. >> the faa says a helicopter and gyrocopter collided midair. the sheriff's office saying two people died with the other two injured. air show organizers say both aircraft belonged to event attendees an were not involved in the air show. also this morning, an emotional update in massachusetts after a small plane with three people on board crashed into a residential area earlier this month. one of the survivors, richard bower, wearing a halo brace
