this is a very dangerous scenario that, it's a dangerous game that they are playing. >> and i was at the d.c. courthouse thursday for trump's appearance, and i was not the only one. >> we are here at the trump indictment talking to everyone here about what's going on here. sir, excuse me, what are you doing here? >> our friends at the good liars join me next hour to share what they heard from the trump faithful. also this hour, dramatic new video of a drone attack on a russian oil tanker. the latest on the impact it might have on russian troops. and we are following that extreme heat still going on continuing to make millions in this country. plus, a giveaway. new york city, look at those crowds. leading to absolute chaos. dozens injured, many more put in danger, at a famous twitch streamers under arrest. a live report on that is ahead as well. we begin, though, with that

breaking news of the judge in the election interference case ordering trump's team to respond by monday to prosecutors request for a protective order. this, happening after trump seemed to potentially violate the judges warning about making threats just one day after his arraignment. friday afternoon, he posted a simple message, this. if you go after me, i'm coming after you. all this as trump continues to campaign with an event today in south carolina. nbc's julie tsirkin following the action from columbia, south carolina, with more on this. julia, it's always great to talk to you. how is the trump team responding this afternoon to all of this? as he prepares to speak in just a couple of hours. >> yeah, well, he is responding at the trump team is responding much of how you would expect. i was at that event last night. he was speaking before a friendly crowd, the friendliest crowd he could possibly hope for. a day after he sat for that arraignment in d.c., and they welcomed him with open arms. i spoke to voters yesterday who really had his back.

i should note, yasmin, it was hard to find somebody who actually read the charges, read that indictment itself. but they really are standing strong with him and this is some of what he had to say yesterday to a crowd that was energized, that was applauding him, that was cheering, that use these indictments as political and do believe that it will help him climb higher and higher in the polls. watch what he said. >> they are trying to make it illegal to question the results of a bad election. it was a very bad election. everybody knows that. but only a party that cheats in elections would try to make it illegal because if you have nothing to hide, why would you do that? >> yasmin, he also said just one more indictment, one more indictment and then he said, the race is over. we can close it out. so, he's really trying to tout this as a positive. obviously, you were there in front of that courtroom on thursday. where he was more salient, more dull, was not energized.

obviously, not being met with a friendly audience. tonight, i should note, he's being introduced by senator lindsey graham and he suggested this week that perhaps d.c. is not the right venue for the former president to be tried, because how could the jury there in a blue city be fair to the former president? obviously, that's where he committed the alleged crimes. that's where he would be tried. but it is an interesting point and i do expect that rhetoric to continue tonight, despite this new request by the special counsel of trump's legal team. >> all right, julie tsirkin for, thank, you julie, you give us a lot to talk about in our next segment. we want to continue this conversation on this historic indictment with msnbc legal analyst, former federal prosecutor, glenn kirschner, will also share to carry with me outside that court just a couple of days ago. glenn, good to see you. once again. so, a couple of things i want to take through here and kind of clarify things for folks that are watching this. first and foremost, right? what exactly is smith's team, the special counsel asking for here with a protective order? >> so, yasmin, they are asking for donald trump not to be

permitted to disseminate any of the information that the prosecutors are about to turn over. witness identities, witness statements, grand jury transcripts, because, you know, you can envision donald trump becoming pretty darn upset when he reads about the testimony that witnesses have been giving against him in the grand jury including many republican witnesses. so, the prosecutors want to make sure he says nothing, he posts nothing, that would endanger those witnesses and what they added into the mix, in requesting this protective order, is judge, look what he just posted. if you go after me, i'm coming after you. that would naturally, i think, has a tendency to chill and perhaps intimidate the witnesses who know they are going to be called to testify against donald trump. >> so, essentially, they are afraid that through discovery, right? the former president will be seen with his attorneys, coming up on document that may has a named witness or something taking a picture or not taking a picture, just posting about what it is that he read going

through this discovery with his attorneys. do i have that right? >> you do. when he puts the name of a witness out in the public square, we know how some of his supporters might be inclined to respond. >> so, how do we connect that, of course, that warning that was somewhat not normal, right? the judge, the magistrate judge on that day, on thursday, he gave to the former president towards the end of his arraignment, essentially saying, do not intimidate witnesses. this is not a normal warning that's usually given. >> yeah, the way i think it gets connected is i suspect judge tanya chutkan, the presiding judge, we'll probably have a talk with defendant trump, perhaps at the next court hearing on august 28th, perhaps in advance of the next court hearing. and put him on more specific notice of the dos and don'ts of pre trial release. i have a feeling she might

begin to at least consider narrowly tailored restrictions on his speech and on his posts, because he obviously didn't take to heart the warning that the magistrate judge gave him, not 24 hours before he posted that threatening language. so, i think we're going to hear more very soon from judge chutkan, as she tries to rein in donald trump. >> what does a response to this protective order from the defense possibly look like? the deadline for that now monday. >> i have a feeling the response will be judged, we don't oppose receiving this information, this evidence, this discovery from the prosecutors under the protective order and we pledged not to disseminate it or have our client disseminated. they will probably sidestepped the issue of donald trump's recent post altogether, or if they don't, he will just parrot, they will mimic what their client says which is no, this

is all about politics. i was referring to my political opponents in the republican race for the presidency, which i don't think is all that convincing. >> i want you to respond, if you can, just kind of clarify things because a lot of people have been making something of this and i want to kind of get your take on it. john lauro, i believe, was on fox news after the arraignment on thursday evening. he went to head, essentially, and admitted that the former president of the united states asked his then vice president mike pence to essentially pause the certification of his election for ten days, so they can, you know, as he kind of puts it, clear things up. i think at one point, he said to pause the voting, to allow for states to conduct audits. trump himself was also confirmed this, in many different ways, on twitter, out loud, as well. should we make anything of this moment? >> -- has also been making kind of also the media circles, we should say. he's been, you know, making

lots of appearances on various shows. >> yeah, i think what lauro is doing is he's catering to his client. how many times have we heard donald trump make admissions in the harsh light of day? you know, sure, i made a call to georgia secretary of state brad raffensperger telling him to give me 11,780 votes, or else. but it was a perfect call. no, it was perfectly criminal and he is about to learn that the hard way down in georgia. so, what lauro is doing is admitting to the crime, but it's a crime that donald trump has already admitted to. and so, i guess by taking that approach, they think they are sort of softening the blow and perhaps raising the question in some people's mind about, well, if they're inviting too, it maybe it's not criminal. i think they are looking to poison the jury pool quite frankly. and i hope judge shotgun has a little something to say, in cutting that back. >> i wonder if they're already trying to kind of challenge this idea of intent, right?

because you think back to the moment of the indictment, which a lot of people have been pointing to -- the president halves with his former vice president centered to honest, right? and kind of talking about the intent there, in that the former president actually knew that he had lost the election when he was doing all of these things. are they trying to set up their defense here that they are going to try and prove that the former president was doing all of this because he actually thought that he won? >> they only have a hope of proving that in the court of public opinion, yasmin. not in the court of law, in part, because the rules of evidence don't permit the defense to introduce statements of the client unless the client takes the stand, and we don't think donald trump will take the stand,. >> got it. all right, glenn kirschner, my friend, thank you. appreciate it. much more, everybody, on the third indictment of donald trump ahead. but we are back in just 60 seconds on this exclusive ukraine drone strike of a russian ship in the black sea. what may have been on board

zevo. people-friendly. bug-deadly. >> all right, welcome back. want to get to the war in ukraine. right now, tensions they're escalating in the black sea, following two of the deepest attacks in terrestrial territory to date. starting new video i'm showing what appears to be ukrainian see drone slamming into an oil tanker during an overnight mission. a source from ukraine security servicing, the tanker was, quote, transporting fuel for russian troops. nbc news has not yet verified those claims. really stunning, i have to say, to watch this video on repeat. it comes just one day after a separate see drone strike on a russian naval warship just off a major port in a military base on the russian mainland. the last, disabling the ship and forcing it to be towed ashore. we want to bring in nbc's -- for more on this. i have to say, watching this, ali, and hearing about these attacks now on these kind of russian naval ships, it seems

as if the ukrainian military is becoming a navy is becoming more brazen, to a certain extent, considering the support that they have right now and also the precarious position the russians are in. talk me through what more we know. >> i think you hit the nail on the head, they're definitely becoming bolder and more brazen. and then this latest attack, a russian tanker with 11 crew members got hit overnight by a seat drone. now, the footage appears to show the moment the drone strikes the tanker. now, ukrainian security services have told nbc news that it was a joint operation with the navy on the vessel that was transporting fuel for russian troops. now, russian officials have the vessels and dreams damaged and nobody was hurt in the attack. but it is the second attack in as many days. on friday, a brazen attack with an unmanned c drone under the cover of night. struck and disabled a russian landing ship in the black sea

port of nova rosina. now, video released by ukrainian security shows the c drone stealthily making its way towards the russian ship and then just cuts off the moment before impact. now, russia's defense ministry claimed that it thought of the attack, but they made no mention of the ship. footage, however, circulating online showed the ship resembling the one that was attacked limping back to port. now, using satellite imagery and marine ship tracking data, nbc news was able to confirm that the video showed the same class of warship as the one hit by the sea drone. now, ukraine's counteroffensive hasn't been that kind of quantum leap that they have hoped for so far, yasmin. but they're unconventional methods of fighting russia is proving effective. whether that is targeting a high rise in moscow or a battleship in the black sea. now, their russian foreign ministry spokesperson said that there can be no justification for what they call a barbaric actions they said these actions were not go unanswered and

focus on some key issues raised in this week's indictment of donald, trump right now a look at the fake electors scheme and how it works. according to the indictment by the special counsel, trump and his coconspirators organized fraudulent slates of electors in seven states, they try to copy the things real electors are supposed to do. that would be december 14th, 20, 20 casting bogus votes for trump. it also meant signing certificates falsely in some cases, some of the face electors were tricked into taking part, they were led to believe their votes would only be -- he never won any by the way, they were then transmitted to vice president pence and other

government officials to be counted. they also said trump and his allies use the power of the doj, specifically jeffrey cloak to present the fraudulent electors as valid, they're accused of trying to convince pence to use the fake electors and reject the will of the voters, pence refused to go along with it. constitutional attorney, andrew lee, jeffrey clark, the former president of the united states at the time was trying to get jeffrey clark appointed as the acting agent. jeffrey clark is also in a coconspirator number, four, who drew up those letters on behalf of the department of justice to these various states. andrew, thanks for joining us on this. it seems as if the fake electors scheme is integral to this entire indictment, as jack smith wrote in the very beginning. the 45-page indictment, it's not about lying, this is about his efforts to essentially overturn the results of this election and it was in part through this fake electors

scheme. >> yasmin, the fake electors scheme is like a warm knife cutting through butter. it is the thing that overcomes the trump -- he was just saying what he believed, it's freedom of speech, he can say he thought he won. that is what all his defenders said. but the fake electors scheme was him actually and four of his coconspirators, we have chesebro, eastman, giuliani, they're going to the seven states, they're saying signed these documents. we have run of them right over. here signed these documents, i can't believe this, sign the documents, yasmin, and they said our guy. one they submitted to the senate. they submitted to the national archives, they want to get them counted. yasmin, this would be the same thing is if i filed a deed and said i own yasmin's house, i forged her signature, filed it with a county clerk. this is fraud. >> the indictment says there's a plan in wisconsin to have the fake electors vote in case

trump won his lawsuit there. supposedly to preserve his rights. they are kind of going off of this -- and, actually they've said this in various places, but going off of something that kennedy did back in 1960 when it came to hawaii. that was a much different case. they have been putting it up there quite often. can you quickly talk us through what happened with the elector situation in hawaii in 1960, and why it was a valid way. >> yeah, it's actually the playbook, that they wrote off why they're gonna do, this what he missed is that situation was very different. that situation was in the 1960, it was 1960 election, we had nixon as the vp. it was pence's job. he was also running against kennedy. the big differences, i have two big, ones at the time they did

it, there was a recount underway. whereas here we did not have a recount. it's a very big distinction. >> it was court ordained recount, right? it was not ordained -- it was not a recount that was asked for by the trump camp. it was court ordained, right? >> it was quarter and a, and and ultimately the court said that kennedy won the recount. so his fake electors later got ratified, if we're going to do an analogy, but here is the key fact, the governor of that state, hawaii, certified kennedys electors. and transmitted it to the vp at the time, nixon, who said it was correct. here, we don't have the governors, we have the governor saying trump, you're wrong, it's not right, we're not doing this, don't try to manipulate, us don't try to push us. it's a very key distinction in this situation, in that situation there is a recount from the court, number, one number two, kennedy ultimately prevailed and number three, the

governor signed off. on it this is just some guys and gals who i know are sunny documents and transmitting them as if a person one when they didn't. >> my question, is we're looking at, georgia we're looking, ahead we've think another indictment is coming out of the fulton county d.a.'s office. fani willis, likely in the next couple of weeks, at least half of the 16 gop electors there are getting immunity deals in exchange for cooperating. but what you want to know from them? >> well, i will tell you, we already have a window into, that, yasmin because michigan has 16 of these fake electors that were already indicted and one of these ladies was all over the air, as soon as she was indicted, she goes, i was fooled, they manipulated, me i'm paraphrasing, i didn't know what i was doing. and so i think the key here is that eight of these guys and gals in georgia -- they told them to do. it who was orchestrating this? can they corroborate? when you do a case like this, it's all about substantiation,

and cooperation. was it eastman? was it giuliani? to the comfort directly from trump? how do we know this? and this is where the smoking gun is when all these electors realize they're facing things like 14 years in jail and flip on the big guy. >> all right, stay with us, andrew, if you will. we have a little bit of time. you can go get a glass of orange juice or water, if you. what i have more questions for you in the next hour about another key part of this case. trump's first amendment. we have been hearing that a lot as well. thank you. as the nation's attention largely swirls allowing the latest trump indictment. his opponents for the republican nomination are trying to focus on running for president. ron desantis on his bus tour, mike pence is now speaking out more strongly about trump. paying the price for it with voters in new hampshire. >> you committed treason.

witness to the prosecution. what i am upset about is, when pence says things like, anyone who puts themselves above the constitution. no. he should come out there now, he has already lost the trump people. come out and, say donald trump tried to put himself above the constitution, and that was wrong. he is going -- to >> so you are saying the difference is name him? >> yes, and a name in history for calling him out, salvage anything of your reputation, because right now he is still playing those games as if he has a shot whatsoever with the trump voter. >> so then there's a moment that i talked about already because it just stands out so much. charlie, it speaks more to the intent of the former president of united states and the moral character, not necessarily what jack smith is going after indecent night meant. but the exchange that he has

with bike president, mike pence, in which it reads, the vice president responded that he thought there was no constitutional basis for the authority and that it was improper. in a response, the defendant told the vice president, you are too honest. as susan just, said and this is running around a lot of circles, bike president, mike pence, can be the star witness. what kind of witness could he be? how does he navigate that on the campaign trail? >> yeah, not only is he a star, witness he's also a victim. donald trump is trying to get mike pence to collaborate with him in the commission, of a crime, and that is what is happening. i think mike pence has to be much stronger in his denunciations of the former president for a whole host of reasons. he needs to draw a sharp. contrast one foot, in one foot, out saying yeah, trump was violating the constitution, but he shouldn't be charged? that's just not going to help him. he has already lost that hard-core trump voter over his

actions on january 6th. he took the correct and ocean on january 6th, so i'm not relation what mike pence's game is, but in terms of this trial that's going to come up, mike pence will be front and center. he is going to be most assuredly defending himself, he had all the things the president tried to get him to do that were, at the very, laced improper and probably illegal in most cases. so i'm not sure what pence's political strategy is right now, but the legal strategy is. clear he has to stand up until the truth and be honest because he has been. >> susan, is it anybody's game? if you're running for president of united states, for the republican party in this primary, race nobody is getting a break out roll here. everybody is really trailing donald trump. they are not using, necessarily, this opportunity possibly to at least break ahead in a more distinctive way. desantis spoke out against the

indictment, tim scott, i believe nikki haley was more reticent to respond. so far, everybody really being lukewarm when you have a former president of the united states indicted over 70 counts, looking at three, four trials ahead inside the 2024 election calendar. something could not be headed giannis over putter more so than the situation. >> right, and it's time for any candidate to stand up for the foundation of our democracy. the fact that they are not willing to go against trump means one of two things, either they're afraid of the retribution, which is real, or they are just hoping they can bide their time and maybe be a potential number two, either to trump or if trump goes down, all of the sudden they will emerge, which they won't. the one person who i think makes no sense, and he should probably call it quits is run desantis. on desantis time is over. he should have called out trump

back in march, in february, when trump was vulnerable. trump's numbers have only gone up since the manhattan indictment. these candidates -- i give chris christie and asa hutchison credit for constantly calling the former president out. >> sorry to cough, susan, why you're talking, the water went down the wrong throat. it had nothing to do with anything that you're saying. president biden's campaign manager spoke to alicia menendez, her show is six pm eastern. time i want to play what she had to say and then have you respond on the other side. >> it is about making sure that we are really talking to the american people about the issues that matter most. we know that these court cases will continue to move forward and they will take their course of action. but for us, it's about making sure we're talking to voters about lowering prescription drug costs, lowering energy

costs, focusing on what matters most to them right now, and continuing to, again, ensure that they understand the choice that is in front of them. and the clear contrast of that kind of extremism that we see from trump, desantis, and the entire field, versus what we are delivering, right now, for the american people, and really investing in our communities. >> charlie, maybe when she says clear contrast is referring to going more down the road of these, indictments i understand, especially as, we are the official election, they have to ride the, line they don't to be seen as president biden's justice department prosecuting the very person his running against former president because that's not the case. the special counsel is separate from the white house and his administration. all that being said, do you agree with what she had to say and what they should be focusing on? >> certainly, if i were in their shoes, i'd be talking

about my record, whether you like it or not, it's another matter, but they should be talking about the things they did on prescription drug prices, clean energy, infrastructure, these are things they believe will help them in the election going forward. it's more aspirational, they're talking about results, which is always important, as opposed to what donald trump is talking about, with the likely republican nominee, which is his grievances and relitigating the 2020 election, which we will now be doing in court. so i think they are smart to focus on their record of accomplishing. it might not be enough to win election, i think at some point they're going to get into a massive battle with donald trump over his conduct in office and contrast that with biden's conduct, i think that's where we'll be. despite, that joe biden's numbers aren't that strong, cole came out this week showing -- >> we actually will dig into a little bit the communication when it comes to the economy,
