your response on the other side. take a listen. >> the defense is quite simple, donald trump, president trump believed in his heart of hearts that he had won that election. as an american citizen, he had the right to speak out under the first amendment. he had the right to petition governments around the country, state governments -- this took place after the election. >> your thoughts congressman after hearing his lawyer? >> well thank you so much for having me, the first point i want to make is you can't make the law because you disagree with it. the law has to be prescribed going forward, not in reverse. what he's trying to do is reverse engineer the fact that he lost the election.

all the time, the lawyer and his attorney general in a general counsel, they all told him that he lost the election. we look at everything if he's trying to create another situation, that is not what the law required by law doesn't prescribe that his half bait lawyers running up the tab. he is grabbing anything that he can, but ultimately the law of the law already. donald trump knew he lost, but he decided that he would move forward and permit to promote the big lie. the big lie you know was the fact that he said he didn't lose, but every individual said that he lost. we have thousands of pages of

documents validating the fact that he lost the election. the testimony that we had in all of our hearings. it validated the fact that he lost the election. >> congressman, many have said that the worker committee did was basically what set up the special counsel to have evidence to move forward. and what do you feel about now, just in the past 24 hours that trump is attacking the judge and demanding a recusal. he's calling jack smith deranged. his claim in the jury pool and d.c. is biased against him. he's accusing his former president of turning to the dark side. i perilous up not to dignified these variants but because you are chair of the january 6th select committee. you know exactly how trump uses

his words and posts to rile up his supporters. can you share your thoughts and what he's doing right now? >> as you, know for the most part he's been a bully all of his life. what he's done is try to use the court and broadened all the cases out as long as he could. he's wearing people out. i friends not land at city because he wouldn't pay them for the work that he's done. consistently using the courts to get his way. being a bully in the situation room he has been told by the judge not to do it is playing the fire. i have the belief, i think a lot of other people are as that before long there will be serious penalties applied to president trump. he has been warned that you

can't do this. if he decides to bully the special counsel i am under the opinion that he will be dealt with by the judge. >> now the protective request that trench from's lawyers must respond to tomorrow only pertains to whether the former president can talk about evidence presented in the case. do you think he should consider more extensive gag order for trump? is that even possible given that he is running for president as this case is going on? >> it's just circumstantial that he's running for president. most individuals that are charged with felony offenses are more worried about going to trial than an election. i would say former president

trump needs to be more concerned about the indictments that he is charged with and forget the election. it's just part of his effort to distract from the real issues. what we were searched on the 18 plus months, clearly reflect that he had significant parcel to what went on. so, if he tries to deflect that's his problem. i'm convinced of the special counsel will take him on. if he continues this route, i think he's playing with fire. you can't bully a federal judge. it's just not the thing to do. a lot of us are trying to get this court to approve the cameras into the courtroom. >> you had about three dozen of

your colleagues in the house they were calling for trump's federal trials to be done as the january six committee hearings were held publicly. at least one of trump's lawyers also called for cameras in the courtroom. why do you think this is so important to start there? >> well, the truth is if you can see this with your own eyes you don't have to get it second or third hand. i think the importance of a former president of the united states going to trial is something that we should have serious consideration as to whether or not this is something every american who is interested would want to see. again, i'm not optimistic but we have to put the request in

deadline in the election interference case. trump's lawyers have to respond by five pm tomorrow to the justice department's proposal for protective order. can you tell us more about what we should expect to see tomorrow. how the protective order would expect the case going forward? >> i think what it boils down to, it's really the defense coming with a response. i think this is really significant because the judge. her response to trump's signature move is delay, delay, delay. the denial of that protective extension was prohibited. it suggests he's going to steer it avoiding unnecessary delays. that's really indicative of the timing of the case. second it, show she's not

swayed or intimidated by political ties or high profile defendants like the defendant. lastly, it shows the governments readiness to show sensitive material, like the grand jury proceedings. like the witness testimonies. it shows the readiness to prosecute the case. as you are talking about with representative thompson, if it critiques his ability to deal with case details. this protective order is important to be ready and to go. especially, as you pointed out, as we enter the 2024 gop primary. trump speech is going to get very complicated. but the significance of this five pm deadline is really that the court seems really determined to keep this case on the fast-track to conduct affair trial and they want to be ready to try this case. >> in addition we have our eyes on georgia fulton county fani

wallace says she's quote ready to go with her election interference case. on friday, trump posted that one more indictment would secure him the 2024 nomination. is an indictment out of georgia imminent? >> how do you think that gets to play itself? >>. >> i think it's absolutely imminent reverend. we are expecting charges to come any day now within this week or next week. and it's interesting that while these cases are legally distinct it's gonna come down to whether he's convicted of these federal charges. it's really gonna hold trump accountable. even though they are legally distinct keep in mind georgia is a state charge. so it has a particularly consequential effect that if trump or one of his allies become president, a state charges not something they can pardon. you have to deal with a

government pardon which he may not receive in part in georgia or new york. with the federal charges and holding trump accountable if in fact he is convicted. >> i want to get your thoughts on integral legal headache. a seven defamation trial against trump but e. jean carroll the case will begin on january 15th. the new york writer has already won a 5 million dollar jury against trump for sexual abuse and defamation. i want to ask you about this because you worked on many sex abuse cases, including the prosecution of bill cosby one of the implications of the carroll case not only for trump but for other women who have accused him of sexual misconduct, i can tell you from

mass shooting in nashville. another white lawmaker that would also participate in the protest, a state being expelled by just one vote. the incident said often nationwide uproar and eventually republicans had to relent and reinstate pierson and drones but only on an interim basis where they were forced to run in elections to keep their seats. last week those special elections were held and the results were undeniable. representative pierson won more than 97% then he didn't fit well representative jones won more than 75% of the vote in the nashville district. the peaceful of tennessee turned out to the polls the middle of a hot summer to deliver a clear message that, suppression and intimidation tactics will not be tolerated. the people's voices must be

think he's found a lighthearted moment too nice to talk about it, he does not wanna talk about the selection. while people can agree that mike pence did not have the constitutional power to determine the outcome of the 2020 election the same whether kamala harris can't do the same the 2024 election. too many republicans think that the election of 2022 was stolen and it was illegitimate despite lacking any proof to backup that claim, what's your take on mike pence do you think he can turn his record on january 6th from a weakness from republican voters to a strength? >> you know i think you probably can but i don't think it'll be the cycle i think overtime is gonna look very well in this and i think it'll be a strength for him. i'm just not sure it's going to be in this cycle in part

because you've got so many of the other republican candidates that were in effect campaigning for donald trump. they were solidifying his message that the election was stolen and that this is all a witch hunt and that this whole investigation of him essentially at the biden administration as going after a political enemy but ron desantis and then mark trump's best campaign is to solidify that information. so ultimately i have enough faith in the american people to follow the republican party and say that i think mike pence will come out of this very well. i just don't think it's gonna be in time to get him where he needs to be in this 2024 presidential primary. >> let me get your thoughts on the back and forth between florida governor ron desantis and gavin newsom over a

proposed debate desantis as we propose ground rules for the debate had a mocking response from the newsom team which accused desantis from trying to cut his time onstage allow for cheap notes and a cheering section. as is a desperate move in for the governor's party even consider such a debate. >> now this is been in the works for quite some time and i think it's a desperate move by newsom to be relevant nationwide. when they already have a nominate nation for president joe biden. he wants to do this to show that there is some exciting alternative. maybe it's in this maybe it's in the next but i don't really know what either one of them gets out of this debate other than attention for themselves and looking desperate. desantis is every right to counter a debate fallout which

would favor him. the noose in team obviously put in a favor for them. that's part of the negotiation and now they're mocking. i really don't understand the point of any of this debate i think it's a lose for both of them. >> desantis has also tried to challenge vice president kamala harris to a debate over his fraud lesson plans about slavery. is it ever a good idea for presidential candidate to debate someone who is not running for the same office? >> i think that desantis does look desperate. he continues to fall farther and farther behind so he's looking for any way that he can to get some kind of spotlight and grab some media tension. he only gets this in a very negative way right now. vice president harris is not going to bait something that is not debatable. it's not debatable.

so whether or not slavery had positive aspects to. it that is just not a debatable issue here. i think desantis, well maybe he doesn't feel. maybe i'm giving him too much credit, maybe just doesn't know that he's trying to do it. but it just seems to me as desperate as you possibly can get for somebody to reach out and try to debate things that are not even debatable. >> well, you know desantis went to harvard and yale. i don't know he could not know slavery was not louviers -- >> rick has democratic lawmakers in congress for supreme court justices. we are learning new -- it's reporting the justices nearly 300,000 recreational vehicles that were purchased in part with money lent to him by a wealthy friend, who made his

money and health care industry. he wouldn't say whether he repaid the loan or if any interest was charged. the report comes on the heels of the lavish gifts and trips, just as thomas received from other rich benefactors. what do you make of these revelations? >> well, i think they are disturbing. i had a problem with them trying to get this assistant. at the same, time they do have a role. they should make this for anyone who is nominated for the post. whether it's biden and president, if they agree to some code of ethics. now, this is really straightforward stuff. i blame chief justice roberts. you can't have one third of the governmental institution that

doesn't have a code of conduct that people can adhere to. and apparently, there hasn't been one. but i'm also disturbed that clarence thomas or anybody who is on the supreme court, even the appearance of impropriety was going to damage the court. certainly roberts knows that. so, they had a clean house. now they need to fix it before it gets worse. >> doug, on tuesday voters in ohio will go to the pros to weigh in on issue one. controversial issue that will raise the threshold for the state constitution from a simple majority to 60%. if the proposal passes, oh make it much harder to pass an amendment coming in november to protect abortion rights in the state. and could complicate future estimates to do things like raising minimum, wage expand medicaid. several other states are also considering some of the plans,

limiting the power of citizen led ballot initiatives. what's your opinion on these? >> you know, i can't think of anything less democratic than efforts to undermine the majority. that is exactly what ohio is doing. it is exactly what others are doing. and, you know, it's what's apparently really simple answer to why this is happening. you have got some very conservative republican control less so senators who are not in this because of gerrymandered districts and their house and senate. they're not in step with the majority of the people know states. we saw happen in kansas, we've seen that happen in other states. so, they are trying to limit the people's right to vote and limit that simple majority. it's really pretty outrageous with what they're trying to do. 60% in today's world, at

politicsnation. today we mark the 50 anniversary of the voting rights act, signed august six 1965. and the 2024, looming some democrats looming a may not be able to engage or re-engage the black vote. it's. the with a losing ground black voters over the past three years and this week a new analysis of u.s. census data by the washington post found that

ten point drop of voter turnout and last year's midterms compared to 2018. joining me now is cliff albright, cofounder of the executive director of black votes matter and terrence woodbury for h.i.t. strategies. thank you both for joining us tonight. i want to read a bit from the post analysis this week. it says, i'm quoting, in key states like georgia ascent of democrats planning to mobilize black voters and large margins for biden in 2024, turnout in last year's midterm election was much lower among younger and male black voters. and your view, how words to democrats be about this dip in the turnout? >> well, thank you have. i, mean there should definitely be some amount of worry, right?

but not necessarily for the reasons that people are worried. back in 2016 when black voter turnout took a day, people today i think that was in the first presidential election since the gunning of the voting rights act by the supreme court. similarly, when we look at the decrease turnout in 2022, people act as if we had not just come out of a year in 2021 that saw wave of voters sweeping the country. including the state right now in the state of georgia. so, the first thing in the state of -- what the turnout has been over the past year and a half, it has been in the context of a wave of voter suppression. we told people what would happen if there was a federal legislation and action to deal with. that's exactly what happened. with that said, we now have to focus on, how do we overcome those barriers? how do we give support to the groups that need it? and how do we message in a way that inspires people enough that if they're able to come out in historic numbers, and spite of that suppression. keep in mind, people say that

the voters from going to come out in 2020. black voters came out in historic numbers across the country. >> your polling firm focuses on young nonwhite voters. washington post announces also notes the key battleground states are registered to vote, but only do so infrequently endemic rats put too much emphasis on trying to convert conservative white women rather than engage with black men. i bring all that up because there is often a media portrayal of black man as being politically disengaged, as if we aren't of the democratic party's second most reliable block behind, of course, black women. biden's political team says it's gotten the message on -- black male voters. what would be your advice on that? >> yeah, rev, black voters are acutely aware of the role that they played delivering for the

biden administration, helping him clinch the nomination in 2020, in south carolina, giving the win against donald trump in keep out around states like georgia, wisconsin, pennsylvania, all the way to helping to secure two senate seats in georgia in 2020, both in the general and the runoff. because of a lot of the hard work that folks like black lives matter were doing. and since then, while the biden administration continues to deliver on the black agenda, far too often black folks are not familiar with that. that's where we begin to see this gender and generation gap between black voters where, but i want to be clear about this, this gender and generation gap. it's not unique to black voters. black women vote more than black men. but that is true of all women of all races. older voters vote more than younger voters, but that is not just true of black voters, it's

true of all voters. that is something that democrats should be concerned about, but they do have time to address before the 2024 election. >> terrence, staying with, you some political analysts say that the problem democrats face in the party's focus on donald trump and republican extremism versus the parties policies that help the black community. in that scenario, how do democrats keep the culture war debates from drowning out any policy based messaging to black voters? >> that's right, right. when i was in focus groups in florida, right before the 2022 midterm, there was a young black man who told me his hood hat and gotten any better under obama, had not gotten any worse under trump. what does joe biden have to do with him? it's that cynicism, that frustration that we have to address. when we ask black folks that didn't vote in the last two elections why didn't they vote, while there are structural barriers like the lions being

too long, that not knowing which i.d.'d to bring, barriers that we know are being directed to make it hard enough or just enough like people to vote to make -- the top reason that they have not voted in the last two elections are structural reasons, attitudinal reasons. they don't believe politics makes a difference in their lives, or they don't believe -- agree with any of the candidates. we have to address these attitudinal barriers as much as we've been focus on the structural behaviors. >> what we all know is that for president biden, there is no path to win that doesn't involve massive turnout from black voters. so as a field organizer, as the executive director of black vote matters, what are the resources needed to successfully mobilize black voters and fight voter suppression, expectantly in key states? is it just money, is it message, which i think is critical? what do you think, cliff?

>> it's a combination of all the above. you've got to be, clear that money is a big part of it. i always say, if the party or the candidate ever put as much money into on the ground supporting the organizations that are those critical messengers, the deal, the issue that terrence is raising is the deal that added two new issues, the sense of whether or not things have been done and messaging that you've got to have authentic messengers on the ground doing this work 365 days out of the year, doing that. that takes resources. if there was ever as much money put into that as is often put into tv ads and to large consulting firms that don't know our communities, if there was the right amount of money put into, that then the folks on the ground closest to the issues and closest to the voters and community members, we know how to message, but we need those resources. along with that, again, we also have to deal with the structural barriers, some of the voter suppression issues.

and we need our candidates, we need candidates, any candidate to have good messaging, right? to be able to message what they do well. but when they don't message, here is the magic, we know how to message. we just need the substance, we need the materials to work with. >> cliff, on, that the right messages and the right messages. what i've always observed in my activism and even in politics is, one, i totally agree that you can't just go with the airstrikes on television and even radio, but you also have to have the right message and messengers that that committee people know and trust. whether they agree with them and everything, but the people they know and trust. you can't impose trust on people in communities. >> especially when you have the levels of misinformation and disinformation that we know was targeted particularly to the groups you mentioned. to our younger voters, 2016, 2020, a lot of disinformation targeted to younger voters,
