this mission in the darkness to save those parents the anxiety of knowing their kids were hanging there into the night. >> unbelievable story. raf sanchez, thanks for bringing it to us. that will do it for us. our coverage continues with katy tur reports right now. good to be with you. three lawyers and three different straenlgs. john eastman has been prosecuted but yet eastman trying to convince mike pence he had the authority to stop counting electoral votes is still claiming that he believes the election was stolen. saying absolutely, no question. that is what he told ali vitali outside of the rice street jail just a few minutes after he he was booked on nine criminal

counts. we will have his statement in a moment. and then there is jeffrey clark the former doj lawyer who donald trump tried to make acting a.g., he is arguing that he doesn't have to show up to be processed at all. what clark is doing by trying to get a temporary restraining order against d.a. fani willis. and finally jenna ellis, there is a $100,000 bond against her. she hasn't yet shown up to surrender, but she's suddenly been very vocal about her legal fees complaining on social media that donald trump should be paying her bills. what might she consider if he does not? joining us now is ali vitali, who is outside of the fulton county jail for us. and also correspondent blayne alexander who is also outside of the fulton county courthouse for us. and nbc news justice reporter ryan riley. blaine, we're getting more of thieves consent agreements, bond

agreements for more of the indicted co-conspirators. we're seeing some of them go in, so far two including john eastman. what you can tell us about what you are seeing there at the courthouse? >> reporter: we're seeing a sort of flurry of activity. just as we're seeing a flurry of activity at the jail, we're seeing a flurry of activity here at the courthouse in the form of the consent bond agreements and also in the form of attorneys for some of these co-defendants going in either entering through the courthouse or being spotted in the d.a.'s kind of waiting room going in, so we believe to discuss the terms of surrender. these are the eight people that you see on the screen right now that we are expecting to show up and surrender at the fulton county jail really at any moment. really at any point. of course these are the people who already had their consent bond agreements in place. so at the top of that list of course is former president trump. we know that he is coming on thursday according to his post on social media. but you have seven others. ken chesebro, jeanette ellis,

sean schieffer, ray smith, all have their terms already ironed out, some just became made public within the last hour or so. so what we've been seeing over the past couple of days is this cadence where we see the consent bond agreement come out and that is really a good indicator to us that imminently we could see a surrender at the fulton county jail. it lets us know that they have already done basically the background work and all that is left is them to go inside and be processed. >> and we got news about jenna ellis who has a $100,000 consent bond agreement. ken dilanian, jenna ellis was very visible around the fake elector scheme and giuliani and all of her appearances were notable. she's been complaining on social media about legal fees, what can you tell us about what we know about jenna ellis, how she's paying for this and what -- sorry, ryan. what might she consider if you were a prosecutor and you see her complaining, what might you

do or try to get her to consider in light of this? >> well, it is interesting about jenna ellis that she switched politically. she's now sort of this ron desantis supporter. so she's a little bit sort of out in the woods i think because you don't have the same face and ability to raise money that you would if you were sort of inside the trump fold or you don't have them paying your legal bills. so there is some about possess sure there. but also fascinating because you have someone who basically fought for thispossess sure there. but also fascinating because you have someone who basically fought for this idea that donald trump won the election, believed it at the time at least, and now in the position that they don't think that donald trump should be elected again. so obviously a lot of this folds into the political. but she has enough of a bull horn on her own, she host as show, i think that she may be able to raise money off of it. but i definitely think that she is someone you'd want to be able to get an in with, maybe someone who you could at least try to flip. but it doesn't seem necessarily

incredibly likely there. of course someone will have to break here you'd think at some point just given the legal and financial pressures that a lot of these defendants will be under. because obviously the early bird gets the worm here in terms of whoever flips first is going to be someone who will get probably the better considerations when the case eventually goes around to getting to trial. but i do think that the time line here on this one is something that is very easily going to get pushback given the pure number of defendants that we're seeing in this case. so i think it remains to be seen whether or not the fast track one that jack smith operating ultimately will be the twoen that we see go to trial first given the complicating factors and recent filings for people who claim that they were working on behalf of the president during that time. >> and here is what ellis tweeted, i was reliably informed trump is not funding any of us. would this change if he becomes

nominee? why then and not now? i agree this is a bigger principle than just one man. why isn't maga inc. funding everyone's defense? so we'll keep an eye on her. john eastman, ali, you were able to speak with him outside of the jailhouse. interesting that is he still claiming that the election was stolen 100% even though there has been absolutely no evidence even today that that is true. >> reporter: yeah, he's doubling down despite the fact that in the years that have passed since the 2020 election loss, eastman still saying that he doesn't buy it. of course we know that that is not right. nevertheless, here is that part of our conversation. do you still think that the election was stolen? >> absolutely. >> still? >> no question. no question in my mind. >> and you won't answer on immunity from prosecution? >> i won't answer that. >> do you think others have a standing? people like meadows?

>> no comment. >> thank you, sir. >> reporter: so i think that there is a few things here. from the time that i spent with john eastman outside of this jailhouse after he surrendered, he was in there for about 90 minutes. of course we know that his consent order came down the day before. the way blaine is explaining it is right, it almost seems like the consent order is then passed over to the jail, like passing the baton in terms of watching these folks ultimately surrendering before that friday deadline. it is a 24/7 operatio. they can come anytime. eastman of course coming this morning. and his lawyer was with him as we huddled with him outside the jail. at times trying to steer him away from reporters, trying to say, hey, maybe we don't answer so many questions. but it was telling what he would answer and what he wouldn't. you saw him there talking to me about the 2020 election. at another point he said that he hadn't talked to former president trump recently. but he didn't regret having

represented him or giving him this legal advice. at another point he answered that he was the one paying his own legal bills. he didn't expand on that in the ways that ellis and other parts of this operation have expanded on it since. but where he got cagy is whether or not he would look for prosecutorial immunity, whether or not he thinks that other people in the former president's orbit have their own case to make for immunity from prosecution and of course mum on what happened when he actually went into get booked. those his attorney said this was pretty of the process as usual which believes us to believe that he was fingerprinted and had a mug shot taken and we'll of course be able to see if we're able to get our hands on that, but that is the sense that we got from his attorney here. >> yeah, we're watching the website for the courthouse and jailhouse to see if we'll get those mug shots. so we've gone through jenna ellis, through john eastman. you've mentioned other that will try to argue immunity, that is mark meadows. jeffrey clark is trying to get an emergency stay against fani

willis and this case. ryan, explain what he is trying to do. >> he is citing for one a law that actually only applies to civil cases. but essentially trying to get this stopped in its tracks. he has been battling a lot of this for a long time. he famously had his house raided by federal investigators as they were investigating sort of the interference with the 2020 campaign. and he is sort of this man inside doj, the man who was almost attorney general despite the fact that he had zero criminal experience and a lot of his colleagues including trump appointees were wondering what the heck was going on with him because he was spouting all of these sort of ludicrous conspiracy theories about how the election was stolen via smart thermostat. so he is an individual basically trying to stop this from the very beginning. but is very much inside of the donald trump fold. in fact only probably a couple months ago was at a fundraiser for january 6 defendants that

was held at the president's estate in new jersey and was seen there with the president. so very much so inside that fold, he's got a lot of support from the broader sort of maga movement and is in fact employed by one of these organizations that supports donald trump and is working to undermine and undercut the justice department and in fact has talked about bringing in or even eliminating the fbi. so he is very much someone who is still within that broader fold and can raise those funds that way even as he sort of, you know, i think is laughed out of a lot of more serious legal circles including from a lot of donald trump appointees they just at the justice department who couldn't believe that he went down this path despite his background in education. >> so jeffrey clark has until friday as do all the other defendants in this case. so far only two have shown up that we know of, that means that 17 more have until friday, including donald trump, blaine, who we know says he will show up

on thursday. what can you tell us about what that will look like? >> reporter: you know, quickly about that, what is interesting is that that is the only person that we have the timing on. i've got to say that all of the other, attorneys, everybody else, really letting the piper work and filings do the talking. in fact attornes for chesebro wouldn't give me any information.talking. in fact attorneys for chesebro wouldn't give me any information. there are two entrances at the jail. you can either march in the front door which is highly unlikely or key go through that entrance right there, kind of a more fortified entrance. that is largely away from camera view. the only thing that we would likely see is a motorcade. a lot of cars just driving up to and possibly driving into that entrance. but he will enter and exit the building away from camera view. because the terms of that

consent bond agreement has worked out, number one, and of course because he is the former president of the united states, he is under secret service protection, it is very unlikely that he will spend any substantive amount of time in that building. i suspect that they will get him in and out. they will get him processed quickly. but as for what it looks like inside, yes, a mug shot likely, fingerprints likely. all things that were on the table and all things that although we haven't confirmed that that specifically is going to happen for him, very likely that we will see those happen with the former president when he does come down to fulton county. >> blayne alexander, thank you very much. ali and ryan, thank you guys. coming up next, let's talk more about donald trump, the bond agreement he has is pretty strict. what happens if he violates it? plus what his gop challengers are planning to try and seize attention -- to seize attention at tomorrow's debate. after all, donald trump won't be there. and what happened in cathedral city, california when

(vo) make the switch. it's your business. it's your verizon. joining me now, legal analyst lisa rue ben. good to have you. i'm curious with jenna ellis and this complaint about funding her legal fees. if you are looking to flip somebody and you are a prosecutor, is she perhaps flipable? >> it is hard to answer. on the one hand, she has diverged from him backing one of his rivals ron desantis and experiencing quite a bit of vitreal on line for that also. on the other hand, is she a person that necessarily wants to give ammunition to fani willis?

so far she hasn't seemed had way. she has accused fani willis of criminalizing the practice of law again and again, a statement even on her crowd funding page for her legal defense fund. do i think that exploring jenna ellis' potential cooperation is a fruitful avenue? i do. is she a guaranteed flip? absolutely not. >> jeffrey clark is trying to not show up saying that he doesn't have to, that this is something that should be in federal court. you called this a creative strategy. explain why. and what happens if he -- will there be a decision on this before friday or will we see a warrant out for his arrest? >> there probably won't be a decision. in fact there won't be a decision on whether or not it can be removed. what he is trying to do here is a little bit of the tail wagging the dog. he has filed a notice of removal to federal court first and then he has filed a second emergency motion essentially saying because this case should be

removed to federal court, that judge should also immediately stay all proceedings against him in georgia including but not limited to his being booked or processed. he is counting on that second issue being decided before friday. and fani willis' team has until tomorrow at 3:00 p.m. in 25 pages or fewer to respond to that argument. so there is a federal judge paying attention who is demanding an answer. do i think jeff clark will win? absolutely not because his argument relies on the special grand jury which has long ago finished. right? we're in regular grand jury land here. they are the people who indicted him. but it relies on saying that that and the indictment together are some hybrid case, and he needs to involve a proceeding to make out a case for why fani willis' indictment of him should be stayed. creative but not likely to succeed. what about eastman still claiming that the election was

stolen. does that help him in his defense if his lawyers argue that this is what he actually believes? does that help him or refusal to accept reality hurt him? >> there are 19 different defendants here with 41 different charges. and i'd have to refresh my recollection of what he is being charged with. >> he was behind the fake elector scheme, trying to get vp mike pence to stop counting the votes. >> right. and knowingly taking steps in furtherance of a conspiracy, whether or not you believe that the election was stolen doesn't seem to be a defense to conspiracy charges. so i think that in the main it neither helps nor hurts him. it may help him with respect to his criminal exposure in jack smith's separate federal election interference investigation where we know that he is an unindicted co-conspirator who still faces some exposure. >> if you are playing at home and getting confused, you are not alone. we are also getting confused and

have to look it up as well from time to time to remind ourselves who the players were. let's talk about something that is easy not to confuse. donald trump. the bond terms for him are pretty strict about what he can and cannot say especially regarding witnesses. we've seen him -- has he crossed the line on anything so far, or has he towed "up" oig up to the? and could he face actual consequences if he crosses the line? >> we don't know much about the judge here. the judge here scott mcafee has done nothing other than sign consent bond orders so far. on the other hand, i do think that the terms of his release here are more explicit than they are in the federal case. and not only are they more explicit, but in some respects they are a little more ambiguous. donald trump can't take any act that would not only intimidate a witness or a co-defendant, but

he can't do anything that would also have the purpose of intimidating a victim or he can't intimidate the community or take action against property in the community. one of the things that confuses me is who are the victims here. broadly speaking you could say every american is a victim of the conspiracy that has been charged here in fulton county, georgia. but does the judge need something other than that. when the parties got together to negotiate donald trump's conditions of release, did they have a meeting of the minds about who the victims were and what is the community at stake. does that just mean fulton county or all of us. and i think those questions necessarily have to be answered to determine whether donald trump has gone up to the line or over it. >> so this judge mcafee, he is so new, only six months on the bench. this would be by far the biggest case that he has ever seen as a judge. again, he is 34. he is brand new. and we have no indication yet as you said about what sort of --

how he sits on the bench, what he tolerates and what he does not. we have more about judge chutkan for instance in d.c. >> yeah, we have a whole lot more about judge chutkan. and, you know, one of the things that we have about judge chutkan is how she behaved at that initial hearing that i was at a couple weeks ago. a couple hours of experience with her and the department of justice lawyers and trump's lawyers. scott mcafee is a blank slate and new slate. as you mentioned, just 34. he has been out of law school for 9 years. that said, he has had a lot of prosecutorial experience. he has been assistant d.a. and also a federal prosecutor and he is likely to be a person that takes violation of conditions of release seriously. how he interprets these conditions is going to be the whole ball game here because we've seen from donald trump in the last few days including today some communications for

fundraising purposes on social media that depending how you interpret who is a victim, who is the community, could go over that line. >> donald trump will be there thursday to surrender, but not a in- arraigned on thursday. when do we expect that he will come back to be officially read charges and plead? >> sometime after september 5. the agreement was, or rather the order was, from fani willis, i want a trial date in march and i want these defendants to be arraigned anytime after september 5. we don't expect all 19 of them in a courtroom together at the same time. so we should expect waves of arraignments, maybe not necessarily individual arraignments, but at least clusters of them sometime after labor day. >> and we should expect this will be on television as well. cameras will be allowed in the courtroom at least as of now. lisa rubin, thank you so much. coming up next, what do you do when more than half of iowa's republican voters still believe that the 2020 election was

sharing center stage. what are they planning on saying and what can they say when so many voters still believe that the election was stolen, so many gop voters? joining me now is dasha burns in milwaukee for us and also mark murray. dasha, talk to me about what you expect to hear from the candidates tomorrow on the debate stage. >> reporter: well, look, you put a pin on the issue at hand. they will have a hard time with issue that so many republican voters think that donald trump won the 2020 election. i mean, this is why in my interview with florida governor ron desantis it took multiple followup questions to get him to admit that trump lost in 2020. because they have such a tough needle to thread with so much of the republican base at this point. and it will be interesting to

watch and see how they do it on that debate stage where this is a major republican event, right? this is the first primary debate, the first time that lot of voters are really tuning into this primary and the frontrunner is missing and this is happening under his shadow. he is counter programming the event, forcing a split screw between the debate and his interview with tucker carlson and we know the hostess will be asking the candidates about him. so no doubt right now all of the candidates are in their prep sessions trying to figure out how they will thread the needle and walk the line, how much that they will go after each other, how they will deal with the trump factor. and florida governor desantis is probably the one with the most to lose here. he is the one that has the biggest name i.d., he is the front run other that stage. so the attacks will be coming his way. everyone else has an opportunity with trump's absence to really have a potential moment, introduce themselves more to

voters. he is the one that has to be prepared to get the most arrows. >> mark, one of the questions has to be do you believe the election was stolen. seems like a softball. and when you look at the latest polling that we have with nbc news and "des moines register," you see that 51% of the respondents say they believe donald trump that the election was stolen. what room does that give the candidates, and to put it conversely, 41% say that they do not believe it was stolen. does that give somebody like chris christie a real opportunity to gain ground especially since he among the field is one of the only ones willing both to say it wasn't stolen and to go after donald trump directly and aggressively? >> yeah, i think there are two ways to look at it. on the one hand, yes, there is room to maneuver. the party is split among those likely republican iowa caucusgoers that were polled. and the poll shows that disproportionately if you

believe that donald trump falsely -- his false claim that he is won the 2020 presidential election, you are more than likely to be one of his voters. someone who supports him for first choice in the poll. but if you are part of that 41% who say, no, i don't believe donald trump's claim that he is won, you are desantis voters, you are tim scott voters or maybe even chris christie voters. but i will also say this, that in a multicandidate field like we see right now, eight republican on the stage minus donald trump, that is nine candidates, that 51% is more than a winning number in iowa, new hampshire and elsewhere even probably 40%, 41%, 42% is a winning percentage. so those kind of -- donald trump's rivals will need to actually start get more to that majority even and pick into that if they want a chance to get the republican nomination. >> how do you do that when the majority is so firmly behind donald trump, how do you peel it

away from donald trump? is the only other alternative to try to go after him? i understand chris christie's logic and i know it is a long shot, but i understand that more than i understand what ron desantis might be doing. because if it is not donald trump, then i mean, it will be donald trump unless he is taken out of the field for some reason. or decides not to run. what is the point in trying to be the runner up to donald trump? >> i think that the zike heist of this republican race and even with donald trump not on that stage, it is really about him and his leadership. and let me just run one other polling number by you from our most recent nbc news "des moines register" poll of iowa, and that is 41% of likely republican caucusgoers want donald trump to continue as their leader. that almost matches perfectly will his first choice in our poll with 42%. and you have 57% say maybe we'll consider other leaders.

but i think that question gets at do you want donald trump to be the leader of the party and as long as you end up having 40% or more of the voters from your party saying yes, it will be hard for anyone else. >> mark murray, dasha burns, thank you very much. more breaking news out of fulton county, georgia. let's bring back in lisa rubin, our legal analyst. so mark meadows is filing a petition in federal court asking a judge to make a ruling before friday that says that his case is moving to federal court or that fani willis cannot arrest him. >> that's right. so mark meadows already had filed what is called a notice of removal. he has a hearing scheduled on that notice of removal for monday. and it is not just any hearing. it is supposed to be an evidentiary hearing where you can present evidence, whether it is emails or hard copy documents or even put people on the stand. many of us were waiting to see how that would go down on monday. now mark meadows is saying, hey court, you need to decide that

motion before friday because my lawyers have tried to work out a reasonable extension with the d.a.'s office and they are not having it. in fact in this motion, mark meadows' lawyers quote from an email directly from fani willis to one of the lawyers saying i'm not granting any extensions. i gave two weeks for people to surrender themselves to the court, your client is no different than any other criminal defendant in this jurisdiction. the two weeks was a tremendous courtesyat 12:30 p.m., i will file warrants. you are a criminal defendant and the way that you have excepted yourself from the normal application of the law, that is no longer going to be how we play. you are like any other criminal defendant before me in this system irrespective of the fact that you were formerly white house chief of staff and that you think your case belongs in federal court. you will have to deal, mark meadows. >> what is the likelihood that the federal judge will rule before friday?

>> i think there is a possibility that the federal judge will impose some form of a stay or some form of a block, maybe even extending the hearing or moving the hearing back. what i don't think is likely is meadows' first choice option which is immediate removal without a hearing and without the judge's involvement in terms of any argument between the two sides. that is not going to happen here because his overall argument for why he should be in federal court while a decent argument is not ultimately a winner. why? because even though mark meadows sat down the hall from donald trump in the west wing of the white house, he was acting as trump's campaign consigliere, not as chief of staff. >> lisa rubin, thank you very much. coming up, what maui residents are asking for as they start to wrap their heads around what rebuilding might look like after that deadly wildfire.

and maggie vespa tells us what led to laura ann carleton's murder. >> we're all suffering. the whole community is. >> reporter: tonight in what is being called a senseless act of violence, a california community in mourning after authorities say a shop owner, designer for the stars, wife and mother, was shot and killed angry about a pride flag. deputies say 66-year-old laura ann carleton died friday at her store mag.pi near lake arrowhead. the suspect had moments earlier made several disparaging remarks about a rainbow flag that stood outside the story. robin nearby said others had noticed a man peering in to storeducking between cars but had no idea things had turned violent. >> basically screamed lori has

for once house judiciary committee chairman jim jordan and means committee jason smith have been looking into political interference played a role at all into the probe of the president's son, hunter, and they think they found something. the two chairmen are zeroing in on a specific meeting and subpoenaing irs and fbi officials to testify about it. joining me now, nbc capitol hill correspondent ryan nobles. what is this meeting, brian. >> reporter: this tracks back to the testimony from the two irs whistleblowers who told the judiciary committee that they were part of a meeting in which david weiss, the now special counsel in delaware who is investigating the hunter biden probe, told them he did not have the ultimate authority to bring charges in the case. this is something that weiss himself has refuted in two

separate communications to congress, saying that he had always been given the ultimate authority to make charging decisions in this case and it was something that was even backed up by the attorney general, merrick garland. well, these two whistle blowers testified the exact opposite under oath and in a public forum, so what the two chairman are looking for is to try to reconcile the disconnect between the two sides and their version of the meeting so they're subpoenaing four difo fishes, two from the irs and two from the fbi, who they say have direct knowledge of what happened in this meeting. they want them to testify about what they heard, whether or not the version the whistleblowers told is true or whether or not the version that david weiss and the attorney general has provided is true. they believe this gets to the core of their premise that hunter biden was given some sort of sweetheart treatment by both the irs and the department of justice in their investigation into his situation. of course, these charges against hunter biden, initially he was expected to plead not guilty,

that all unravelled in a court hearing about a month ago in delaware, and now david weiss has special counsel status and says that the investigation into the president's son is ongoing. it could ultimately end up in trial but we're not exactly sure what those charges may ultimately be if it ultimately comes to that, katy. >> ryan nobles. ryan, thank you very much. there have been a lot of scary close calls at airports around the country. what the faa is doing to address it to make sure nothing terrible happens.

a passenger on board an alas can airlines flight on sunday caught a very rough landing on camera. the plane slammed on to the runway while landing in southern california. those are sparks you see flying off. it is yet another close call in a series of incidents on runways across the country. nbc news aviation correspondent tom costello has more on what the faa is doing about it. >> reporter: yeah, katy, this was flight 1288 coming in during the tropical storm, heavy rain, gusty winds. it hit the ground very hard, dragging its left wing down the runway. at the same time the nbc news is learning the faa is ordering airports nationwide to hold urgent runway safety meetings. >> why are we going so fast.

>> reporter: this morning a terrifying landing caught on camera. on board an alaska airlines flight traveling from seattle to orange county, california sunday. . >> holy [ bleep ]. >> reporter: sparks flying from the aircraft as the plane made a rough landing at john wayne airport. >> we have a category 3 737, had a main landing gear collapse. it is resting on its engine. >> i see the 737 main landing gear collapse. >> reporter: alaska airlines says the aircraft was unable to taxi to the gate due to an issue with its landing gear. thankfully no reports of injuries, but passengers this year have faced a number of frightening incidents in the skies and on the runways based on another issue, close calls related to control tower and pilot communications. nbc news has learned the faa is calling on airports nationwide to hold runway safety meetings

now. following growing concerns over a rising number of close calls. >> anywhere between 300 lives or more were put at risk in these near collisions. >> reporter: one close call at austin airport where a controller cleared a fedex 767 cargo jet to land on the same runway a southwest 737 was landing full of passengers. you can see in this congressional animation how close they might have come. another incident at boston logan airport. a leer jet pilot took off without clearance as a jetblue flight was landing on a crossing runway. this image from the cockpit showing that very moment. the faa's runway safety meetings are scheduled at more than 90 airports and will focus on situational awareness in cockpits and towers. double confirming radio instructions and stair el cockpits. pilots should only be talking to each other about the job until they reach 10,000 feet. >> everybody needs to be more vigilant and double down on
