against him. plus, a big announcement from the biden administration coming this week, and how it might lower the cost of your prescriptions. ♪ ♪ ♪ >> good evening and welcome to the show. i am mehdi has on. there was a swastika emblazoned on the gun, and my talking about not see germany in 1933? sadly, no, i wish. we are talking about the united states of america in 2023. just before three pm on saturday, a white man armed with an ar-15 style rifle killed three black people out of dollar general store in jacksonville, florida. at a press conference yesterday evening, sheriff dike water said on equivocally, the massacre was a, quote, racially motivated attack and that the shooter left behind multiple diaries, multiple quote unquote manifestos riddled with rapid bigotry. >> portions of the manifested detail the disgusting ideology of hate. the shooting was racially motivated, and he hated black people. >> earlier today, merrick

garland put out a statement that the justice department is investigating this attack is a hate crime and an act of racially motivated violent extremism. adding that one of the justice department's first priorities upon its founding in 1870 was to put bring to justice white supremacists who brought violence to black americans. that remains our urgent charge today. the problem is though that it has not been an urgent issue, even as white supremacist violence and mass murder has been on the increase. it has not been urgent enough, not just for the justice department and law enforcement, but for federal and local. and also for the democratic party as a whole, for the media as a whole, for the american people as a whole. we have not taken this issue seriously enough. even as a black and brown and jewish and muslim bodies pile up, both at home and abroad. as a direct result of white supremacists and racists violence. we did not take it starts -- after the charleston massacre in june 2015, when a hate filled sociopathic gunned down nine african americans during a bible study. we did not take it seriously enough after the pittsburgh synagogue massacre in october

of 2018 when a racist nutcase killed 11 jews during shabbat morning services. we did not take it seriously enough after the el paso massacre in august of 2019, when and latino hating monster killed 18 people at a walmart store. we did not take it seriously enough after the buffalo shooting in may of last year when a rope far-right bigot targeted black people in a tops serk supermarket, killing ten. we did not take it seriously enough after the allen, texas massacre this past may after a man with a swastika tattoo murdered eight people, half of whom were asian. and now, jacksonville, florida. white supremacists armed with an ar-15 style rifles gunning down black and brown people, attacking synagogues, setting fire to mosques and black churches. at what point do we say enough is enough? at what point do we ask how we came to live in an america where racist violence is on the rise again, where white supremacists are emboldened again? where mainstream politicians are silent again. they are silent. florida governor and presidential candidate ron desantis has strongly condemned the violence in jacksonville, but had nothing to say about the far-right ideology behind it, where it comes from, where to stop it. he had nothing to say about the swastika or weapon of choice. >> perpetrating violence of

this kind is unacceptable, targeting people due to their race has no place in the state of florida. >> to be clear, i'm not saying that desantis or any other top republican is directly responsible for this or any other racist massacre or, directly inciting it. what i am saying is that the republicans have created a permissive environment from white supremacists and domestic experiments in this country. they have echoed the rhetoric and mainstream, they're talking points. just take desantis. this is a governor who has used black and brown people as political state goes, political pawns, where there was the arrest of black convicts, daring to vote in florida, arrests that soon fell apart. or the little game of human hot potato with brown migrants checking them on to hair planes and lobbing them across the country to martha's vineyard's. this is a man who bands critical race theory in florida schools, who defended a curriculum with both sides slavery and anti black violence. and who just recently had to

fire from his own campaign a staff who made it video of desantis standing in front of a neo-nazi symbol. yes, a neo-nazi symbol. is it any wonder that desantis 's 2018 democratic opponent in the governor's race famously said this? >> i am not calling mr. desantis a racist, i am simply saying the racists believe he's a racist. >> why is it that the racists and neo-nazis love it so many of these top conservative politicians and pundits? why is it that the daily stormer, for example, the neo-nazi website, says that they have literally outraged as allies with tucker carlson? why is it in unity richard spencer, highly trump ship shortly after the 2016 election? could it be because tucker carlson night after night on fox used neo-nazi great replacement rhetoric with black and brown migrants? could it be because donald trump campaign for office by retweeting white supremacists?

defending neo-nazis as very finally people, and since, has been hosting a -- and don't even try the, why are you politicizing this? we should be focused on the only the person to pull the trigger, and nobody else. i am muslim. you don't get to play that card with me or my community. for the past 20 plus years since 9/11, muslim communities in this country have been relentlessly questioned, examined, pathologized, scrutinized for the slider signs of extremism or violence. white conservatives have demanded that brown muslim subject themselves to extra checks that their places of worship and work. white conservatives have asked, why the violence with muslim communities? what is the ideology, who are the hate preachers, the young, men they have demanded the muslim community get their house in order. tonight, this brown muslim is asking the white conservative community to do the same. get your house in order. crackdown on the hate preachers who you have empowered, and they're footsoldiers that you have in bold and. condemn the rise of white supremacist ideology. of white supremacist terrorism, and denounce the daily racist outburst on your daily cable news channels, and talk radio networks. don't hide behind lays all --

about black lives matter and antifa. neither of whom who have ever massacred anybody at a church or walmart. but perhaps unsurprisingly, that is not what happened on the sunday morning shows today. republican presidential candidates did not want to do any soul searching or self reflection. the politicians did not want to talk politics. >> i don't think this is a left versus right issue, i don't think we should politicize the pipe partisan goggles. >> it was an active evil. when our prayers are with the families who lost loved ones, and those that are injured, we've prayed this morning for them. >> mike pence also went on to say that he wants the death penalty for mass shooters, which is a bizarre thing to say in the wake of a mass shooting, in which the shooter killed himself. he's already dead. then again, maybe it is not so bizarre. at least in so far is it frictions as a smokescreen for pence to hide behind, to protect them from having to address the actual root causes of white supremacist terror and gun violence. of course, if he actually did, that he would have to confront nearly every feature in fixture of republican politics. from his former boss, to his allies in conservative media,

to even the policies that him himself has champion for decades. just considering, that he dodged. every other mainstream republican politician eagerly leaves that job, time and time again to somebody, to anyone else. it is a shame, but not a shock. the dead black people in jacksonville, the dead asians in allen, the dead jews in pittsburgh, the dead latinas in el paso, they deserve better. joining me now, melissa murray, an msnbc legal analyst and and why you professor of law. and charles blow, an msnbc political analyst and columnist for the new york times. thank you both for joining me tonight. i wish it was not under these circumstances. melissa, the shooting yesterday occurred during the commemoration of the 60th anniversary of the march on washington, where multiple speakers called out the scourge of gun violence as a threat to all americans, but particularly black americans. what was your reaction as a black american hearing this

horrific news out of florida yesterday, of all days? >> mehdi, in that litany of white conservatives that might contribute to this culture of hate through the combination of this kind of violence and rhetoric that underwrites it, you could also have added the six members of the united states supreme court. they have also facilitated this through their expansive interpretation of the second amendment, the unprecedented expansion of the second amendment that facilitates the keeping and bearing of arms. it allows those kinds of violence to happen. just a few weeks after the buffalo shooting last year on june 23rd, the court announced its decision in bruen, a major gun rights case, which expanded the scope of the second amendment beyond anything that we have seen in the history of this country. again, every branch of government is involved in this. every branch of government has facilitated, this and every branch of government has a role to play in making us more safe and ideologically terroristic. >> charles, president biden was asked today if he would speak to governor ron desantis given the shooting in florida. he responded, i'm going to speak with the people of jacksonville. i have to ask about is somebody like ron desantis or mike pence. why can't all of these top republican politicians of or anything, say anything in response to racist tragedies

like jacksonville or the others that i mentioned, beyond thoughts and prayers? seriously, is it not time that they were forced to address not just their pro gun policies, but they're coziness with white supremacists? >> we have to go back and look at what the data on hate crimes say about what commits it, and who is the target of it. the data continued to show that the largest category of targets in a single hate crime are black people. the data continue to show that the majority of people who commit these crimes are white people. it is coming primarily in one direction towards one group, and is coming primarily from another group. that dynamic implicates the power structure itself by association. they understand that they have -- you know, that this violence and this environment is scaled on the one and. you have politicians that create an environment of permissibility. they do so not because they themselves are violent, or because they explicitly call for violence, but they excuse an environment that says that it is okay for me to have the

hostile to other people. they do this through -- what you are seeing, through these candidates now, with refusing to call out black supremacy -- by saying that when black people see there is a racial issue, racial progress, they discount the fact that that is a real thing. they say that this is an illusion, that white supremacy is a myth, and that on one end of the scale, helps to create the environment of permissibility. that environment trickles down to the violent people. to call them out is to implicate themselves. >> yes, very much so. we are going beyond permissibility. we are entering into the world of victim blaming. gop presidential candidate vivek ramaswamy said this on this morning. >> i'm genuinely worried that we're seeing a new wave of anti black and anti hispanic racism. as a consequence of the so-called anti-racist sentiments. >> that's an astonishingly offensive thing to say. irresponsible as well in the wake of a mass shooting. >> obviously, i would not expect less at this point. it is to their advantage because they are the party that is this muscular interpretation of the second amendment. the party that insists upon making guns available. even in circumstances where the democratic process would require that the people have a

say, and the people have decided that they would want more limited access to guns, especially those that might be dangerous to certain elements of the community. they insist that the access to john guns, the keeping and bearing of the guns must be completely free, and subject to very few limitations. i'm not entirely surprised. i'm not surprised by the effort to blame these victims in families that would be terrorized, and to blame everybody that would be wondering at this point in time whether that would be turned on them. again, as charles says, the data makes clear who are the targets of the racially motivated attacks. it is often people of color, black people, people that are the most vulnerable in our society. >> charles, more than a decade ago in 2009, a bomb's first term in office, his department of homeland security sent law enforcement agencies and briefing warning of a rising threat of domestic right-wing expressionism, including right-wing terrorism. republican outraged, demeaning retraction, they got one. obama's head of dhs publicly apologized, and that team of enlisted produced that report was disbanded. in hindsight, a crazy mistake, but also, just a broader point, the liberals have been on the defensive about the rise of white supremacy for far too long. have they not? they've been far too worried about offending conservatives

that often play the victim on this. >> it is worrying about offending them. it is also this sheepishness when it comes to dealing with white people when -- on this issue of terror. we don't treat them -- you could put this in your intro about how we have treated the muslim community. they might so far as to do things that they were outright unconstitutional. with muslim communities, and searching for and trying to go through those terrorists. we don't treat these people who are also terrorists in the same way. the only reason that we do not do that is because there are white people, and white people are still the majority. or in some states, the plurality in this country. that is the only reason. until we are honest about why we are not doing this, we don't need to dance around whether or not it is a partisan issue, polling issues, concerns. no. the only reason that we are not doing this is because these are white people, and white people are still the majority of this country, and a lot of white people do not want the association but there is a problem in the community, and it needs to be sorted out. it has nothing to do with most white people. the vast majority is any group of people, racial, ethnic, religious, are not committing violent crime, and they're not committing hate crimes. it's not about all of anyone.

long history of racism, when which proceeds presidency and political of career. he's had a problem with people of color for decades. he especially is a problem with black people, and we know that he has a real issue with black women with strong black women. don't take my word for, it take donald trump's. he led a chant of send her back

against congresswoman -- and even spread violent racist conspiracy theories about her personal life. he called vice president harris nasty and disrespectful, in just this week, mocked the way she talks. >> she speaks in rhyme. it's weird. it is weird. she has great moments. >> speaks in rhyme? >> the way she talks. here, and then the voice will go there, it's weird. >> he accused justice ketanji brown jackson is being disrespectful.

there it is again. towards the white gop senators who are questioning her. even his former advisor newman was not spared, he called her a dog. and yes, he insults everyone and anyone, but there is something particularly vicious and bigoted to his rhetoric around black women. there is a huge irony to the fact that the center of his many legal troubles right now are three strong black women. first of, the first prosecutor to get a mugshot of trump, and is now prosecuting -- racketeering overturning the 2020 election results. remember, jack smith, merrick garland, they didn't exist on a motion for trump in the two federal indictments around trump and florida, and d. c.. fani willis did.

despite trump very personal attacks on her and her character, willis made it clear that she would make her decisions based on the facts and law. >> i make decisions in this office based on the facts and law. the law is completely nonpartisan, that's how decisions are made in every case. >> second, there is judge tanya chutkan, who is expected to set a trial date for the special counsel election interference case against the former president. chutkan has recently been the subject of racist attacks and death threats. this month, a texas woman was charged with threatening the, saying quote, if he doesn't get elected in 2024, he'd already earned trump's ire, rejecting his bid to keep secret papers apparently his actions and conversations leading up to january the 6th, saying quote,

jurisdictions? it has to be killing him, no? >> if it is killing him, it's killing him softly, because these women are packing a big punch in a velvet glove. these are women who are at the top of the, game they know what they're doing, tanya chutkan, fani willis, tish james. they could not face off against a more formidable trio. he can's do all he likes, it is a virgo season, and these are peak virgos. >> barbara, with d a fani willis's rico trial with trump and his associates in georgia, i have to ask you as a prosecutor, what actually happened in court? do we have 18, 19 people sitting together with the lawyers being tried together? does not make it a more complicated trial, harder to get commit conviction? >> be surprised if we had trial with all 19 defendants. first of all, i expect statistically that a large number of these defendants will entered guilty pleas. statistically 90 to 95% of defendants a entered guilty

pleas. that usually piercing down. it might be that some good severed for trial. we sikanni chief river don't demand a speedy trial. we might see one group of defendants being tried first. typically, child gets severed down to groups of more manageable sizes, and they could be more than one trial ultimately that gets handled in this case. and then you end up with five or six not end up in trial at one point. i think that in terms of managing court has resources, just that sheer size, making sure that the juror jury keeps the evidence straight against the defendant. it seems more likely they will see more jury groups that go to trial. >> interesting. of course, fani willis has successfully prosecuted rico cases against gangs and others. charles, as somebody in atlanta, tell us what the mood has been like there with the spectacle of the trump motorcade arriving at court, the time of his choosing. 18 of those defendants who were

all white, having walked out after being booked. the one black defendant, harrison floyd has had to stay. you can make this stuff up. even as republicans complain about a two tiered justice system. >> you cannot. what i will say is that i live in midtown, atlanta. we don't see that kind of crisis, and i'm not too far from the crisis. we haven't seen a lot of it there. we have seen some people congregating on the motorcade route to the jail. some people are outside of it. it hasn't been that case that that was in the city, in the city of atlanta. you bring up a good point about this to tear justice system. there are two tiers. he's getting the good side of it. he's getting the brakes. we have to keep saying that. no other defendant would be treated in this way. with that does also is that implicates the justice system

itself. it says to the rest of america did the justice system can be a comedy. if it chooses to. it is just not doing it for you. >> such a good point. when i heard fani willis saying that you have until friday to turn in, next friday to turn yourselves in. i was thinking how many criminals to get that opportunity? just pick it's time to turn up on the jailhouse. chad can in the d. c. case, expected to set a trial date tomorrow in the election interference case the jack smith has brought. he is asking for january the 2nd. we don't know if she'll go with, but at the trial where to start in january, certainly it would be all over before the election in november. how does that appeal from trump factor into the timeline of trials in 2024? >> that is exactly right. it's the reason why judge smith

asked for the debt early deadline. so they could stay clear with the doj guidance, the you don't have these kinds of prosecutions, that could be viewed. over the course of the election. the general start day would allow for that. not clear but judge chad, can the prosecutor or defense here, they could try to split this baby, although to be clear, there is a clear line between what the prosecutors have asked for and the defense's request -- she obviously is going to be picking somewhere in between these, but it feels like she very much wants to get this done and over with. she is a straight shooter as a judge. i don't imagine that she could leave a lot of room here for donald trump to have an opportunity to appeal.

he certainly will try, but she will be careful about dotting her eyes and crossing her t's. she knows this is a high profile case, in this is an incredibly litigious defendant. she has lots to do here. she will do well. >> and you mentioned, melissa, that the date trump has asked for after the election, asked for 2026, cameron said it. they joked that trump probably wants the date of his death certificate to be the date of the trial. bob, you have trump asking for 2026 at the earliest. then you have kenneth chesebro, the lawyer, he mentioned earlier requesting a speedy trial. that is now set for october 23rd. you also have former trump lawyer sydney powell asking for a speedy trial. what is the thinking between

one is that sometimes, they can catch the prosecutor flat-footed. they're not quite ready, they didn't expect anybody to ask for a speedy trial. getting everything together that quickly could be a challenge for a prosecutor. based on the statements that fani willis has made, i doubt the cheese in that camp. maybe they are a gaming that. the other thing that happens here is that if they go first, they do create a little bit of a roadmap for the defendants that followed. donald trump in the other defendants. they will meet transcripts of the testimony, everyone will see all of the case against them. strategically, it could be helpful for the second set of defendants that go. i will say this. politically, for the way that donald trump, he seems to be
