category four strength. look what happens, alex, it will curve towards the. right this is still to be determined. we have it area of high pressure, the jet stream will work together to stewart. we will watch it very closely. no, it is still thursday at 9:00, still out of the atlantic. back to. you >> thank you for all of, that, michele appreciated. in this, our denied, why a judge said no to mark met owes. also they made the list that nobody wanted to be. on but they could have made it even worse. why weren't they indicted? new theories found on. that the fist bump seen around the world, it might have eclipsed at the g20. i bid you all a good day from nbc news in los angeles. welcome everyone to alex witt reports. we begin with the breaking news out of morocco, where devastating 6.8 magnitude earthquake that struck friday night has killed more than 1000 people. it is the most powerful quake

to hit that area and over a century. the epicenters in the mountainous area outside the historic city of marrakech, where right now search and rescue teams are desperately working to find survivors. and bases, matt, bradley is following the story for us from overseas. matt, welcome back. what more can you tell us about the destruction and the rescue effort underway? >> alex, this is a frenzied rescue effort. turkey, at the moment, covering a different story. i'm on my way to morocco. in just a couple of hours, turkey was the site of another devastating earthquake back in february. we spoke about this a moment ago. that was an issue where there were people who were taken out from under the rubble after five, six, seven days. i'm hoping that that is going to be the case in morocco. this is a situation where people are having trouble reaching some of the more remote regions in the high atlas mountains. this is where a lot of the devastation is thought to be because that is where the epicenter, is about 50 miles outside of that historic city of marrakech that you

mentioned. so a lot of the streets, a lot of the roads that lead up into the mountains are of course damaged by the same earthquake that has damage so many homes and buildings and communities. so there is a delay in reaching them and finding a lot more victims. a lot more survivors. i think we are going to see, as the rescue efforts, and as the recovery effort from the dead picks up pace, we're going to see those numbers, as you mentioned earlier, already sky-high increasing even more in the coming days. possibly weeks, alex? >> it is extraordinary. keep your eye on things for, us we will get you once, again thank you so much, matt bradley. let's go now to some more breaking. news president biden is wrapping up a busy day one in the g20 summit in india. before departing for the, day the president announced plans to invest in a historic international rail system that would now like india, at the middle east, and europe. >> the world stands an

inflection point in history. a point where decisions we make to say we're going to affect the course of the future, all of our futures for decades to come. a point where our investments are more critical than ever. when we invest in low, middle income countries, all countries benefit. >> back here in the states, a judge is dealing a major blow to trump's former chief of staff and codefendant, mark meadows, meadows request to move his georgia election interference case to a federal court has been denied. the ruling is an early win for d.a., fani willis, who has made it clear she wants to try all 19 defendants at once. and that, of course, includes donald trump. a super pac is when pouring $13 million into a massive ad blitz across six battleground states in the hope of giving president biden a boost ahead of 2024. we have more on what this means for his campaign in a moment. this all comes as a colorado watch group is filing a lawsuit to keep donald trump off the states ballot.

this is from the 14th amendment. this morning on msnbc, colorado secretary of state, we weighed in on this legal challenge. >> section three of the 14th amendment clearly lays out in clear terms that if someone swears to uphold the constitution, they are disqualified from holding office. so if we see the litigation through, ultimately i think it's important for our court to weigh in to provide guidance. >> well, colorado is expected to be the first of many attempts to disqualify donald trump ahead of the primaries. similar efforts also unfolding in at least five other states right now. let's go to embassies, julie tsirkin, on the judges decision to deny mark meadows request to move his case to federal court. julie, how is this ruling complicating meadows and his codefendants legal strategies? >> alex, it is a major setback. not only for mark meadows case, but also for the other five codefendants who want to make a similar move and made a similar action. that includes former president,
10:06 am
trump, who this week said he was considering making that move, trying to throw his case out of the fulton county jurisdiction and into the federal court. that could impact his legal strategy moving forward. >> former trump chief of staff, mark meadows, dealt a major blow with the georgia election interference case. u.s. district judge, steve, jones denied his attempt to move the case to federal court. saying his alleged involvement in pressuring state officials to overturn the 2020 election result was not part of meadows work as a government official. jones writing meadows efforts to prove he was acting in his formal capacity as a white house employee and not on behalf of the trump campaign, quote, falls short. meadows lawyers hope to have the court heard in federal court where they can invoke special immunity protections. the judges decision for now is not impacting other defendants who have filed similar actions. that includes former president, donald trump. who, along with his 18

as -- in the judge did not buy it. the judge said, you are not acting as a government official at that time. therefore this is not a federal issue. it goes back to the fulton county court. the other people who are considering making this transfer are going to have a difficult legal road ahead. >> what about the unsealing of the special grand jury report? it was the basis for the page -- georgia election case. 39 people were recommended for criminal charges. among the 21 who escaped, were two former georgia senators as well as to south -- south carolina senator, lindsey graham. lindsey graham responded to reporters. let's hear what he said. >> we cannot criminalize with senators doing their jobs when they have a constitutional requirement to fulfill. it would be irresponsible for me, and my opinion, of chairman of the committee, to not try

that. what i did was consistent with my job as being as united states senator, chairman of the judiciary committee. next election, if i have questions, i'll do the same thing. >> so what role are graham, loeffler, and perdue alleged to have played in the case against trump in georgia? is there any indication why they were not indicted? >> those are excellent questions that everybody is asking right now. the pressure they were part of this group of people who were pressuring georgia officials to look into alleged allegations of fraud in various ways. and why they weren't indicted is a great question that we fani willis can answer and she's not saying why. we are left with loeffler, perdue, and graham, they are left in this position of a special grand jury suggested
10:11 am
they be indicted but they're not. so they're in this limbo. we are in this political limbo, it's an odd place to be. normally we don't have a special grand juries. this is a unique thing. now their names are out there. we all know that they wanted them indicted. >> so, what about this? this potential cooperation? is it a reason the d.a. decided against indicting some of these 21 people? is there evidence that some of those who are indicted as well might flip and cooperate? >> i think that is another limbo period, where all the different 19 defendants are jockeying for a position. and there is going to be a point where people are going to flip. people are going to reach agreements with the prosecution and provide information. once that starts happening, obviously the prosecution's
10:12 am
goal is to have that go up the line. the defense argument is hey, we are all -- there is no grandson conspiracy. that's the legal war that is underway here. >> all, right in your article, david schaffer, kathy lee, him sean still, those are names we need to keep an eye on and what they're doing. in the meantime, as you, know prosecutors have until tuesday to submit a brief on why all 19 georgia defendants should be tried together. what can we expect in that? what is the judges attitude towards this whole idea been? >> the fulton county judge has been very specific on that. there is the argument of severance, which would be splitting the trials. that could happen. it is, as you can imagine, creating this logistical nightmare for -- if, for example, multiple groups were split into different trials, you are having the same trial over and
10:13 am
over again. we are talking months and months. now this is fulton county, disrupting downtown atlanta, massive security issues, jurors kept for months. when it is becoming a logistical nightmare that the judge is going to try to figure out. plus, there is the legality issues we. >> there is a lot to consider. cameron, thank you for joining. us we look forward to seeing you again. later on this, our we're going to talk more about the big names who escaped and indictment in georgia on the election interference case. why did they get a pass? i will speak with charles coleman, -- msnbc legal analyst and kristy greenberg, former federal prosecutor, about, this in so much more. in the meantime, we are back to the breaking news out of india, where president biden is preparing for day two of the g20 after a very busy for a state meeting world leaders. nbc,'s mike memoli, is joining us long distance. he is with the president in new delhi. mike, china was absent today. how are the countries reacted
10:14 am
to president xi jinping's decision not to attend? >> alex, it's interesting because when you talk to white house officials about, this on one hand they say they are disappointed. dealing with some of the complex economic challenges, all over the, world requires being able to work with not just our close allies but countries like china, who they call a strategic competitor. think of the big announcement we were just talking about in the last, hour that it was revolving around close partnerships with saudi arabia, mohammed bin salman, the crown prince there. somebody who has had a complicated relationship with president biden. today they were shaking hands after making progress on an important development. on the other, hand when you think about how president biden has framed his foreign policy about the importance of showing that democracies can work more effectively than autocratic governments like china. it is giving the president and his team an opportunity to say, we are here, we are showing up and we are proving that we are delivering while some other leaders are on the sidelines. this is exactly the point that
10:15 am
was made in a conversation i had here in new delhi with the new u.s. ambassador to india, eric garcetti. listen to part of that conversation. >> what does that mean for the success of the g20 summit here that while the president is coming you have president xi of china, president putin of china not attending this summit? i think it's very proud moment for the united states. a president is here. that speaks volumes, we are not disengaging from the world, we show up time and time again. this is a president who is traveling the world, a government that engages every single day. telling, folks this is not about geopolitics for us. this is about our values. >> and alice it's also vladimir putin of russia who did not attend the summit. he has worked trying to court some of the developing world. with the other countries that were here as well. there were presence here, even not at the presidential level, felt in the final communiqué issue today. one of the other headlines, today alex, there was a more

mentioned the exclusive reporting, by kathryn, doyle about concerns that trump allies have about his presence and engagement here in the hawkeye state. which is around four months to, go until caucus day. his allies are concerned that his presence here in the state it is not strong enough, he has not come here and engage with voters enough. this is, today it's going to be his seventh trip to iowa since launching his campaign, ten months ago. and that is compared to ten trips that he had made by this exact time back in 2016. so, the trump campaign for their, part their vehemently denying these concerns exist. they're arguing's campaign time, former president has not been able to -- the presence here, for the last two runs in the white house, because of the legal proceeding surrounding criminal indictments, so the question now comes down to we know what it takes here to win the iowa caucus, it hasn't changed since

the americans position, is look, you know the saudis are an important ally. they have chosen to basically try and move on from tensions of the last years, in the middle of this rather remarkable negotiation, to try and bring the saudis together with the israelis, in open diplomatic relations for the first time. negotiations were successful, transforming the middle east. they are in a position right now where they are trying to make friends with the saudis, rather than enemies. that's what i think you're seeing right here. and in new delhi. >> so specifically though, peter, relative to saudi arabia. and mbs, how much is this about oil? >> well it's about oil, but it's also about saudis position in the region. right? israel, at the end of the trump administration made diplomatic relations with three of its arab neighbors. the only one that counts, the one that counts the most, anyway. it is saudi arabia. their custodian of the two mosques, that are still wholly in the islamic faith. they are one of the leaders, in

restraint here. an independent judgment. she looks at the proposed recommendations for the grand jury, and then she assessed based on the evidence known to, her what she understood of the possible defenses. and she came up with her own charges in her own defendants. so i think it is a good report. as for why she would have charged, certainly, i think it's interesting if you look at the votes with respect to senators graham, purdue. senator graham there were 13 votes in favor of charging him, with the national effort to overturn the 2020 election. but there were also seven nose, and one abstain. similar numbers for the other two senators. when you have mixed votes like that, from the grand jury. it would certainly give any prosecutor some pause, and make them really look as to whether or not those are charges you want to bring against political officials, where those charges
10:40 am
are going to be really scrutinized. >> a very valid assessment there, thank you. charles, should these 21 be relieved? or could they still face charges in georgia, or elsewhere? or could it be that they know they are safe because they are cooperating with prosecutors? well, i do think it is difficult to assume either of those things might be true. i can tell you that, more likely than not, as far as fulton county, they will likely feel like they are in the clear. it is possible to jack smith, the special counsel's office and the doj have been taking a look at this from the very outset, if not before. the point of fani willis, given what we know from the january six commission what was turned over to the federal government. this is not, necessarily, going to be news to them, as well. in terms of the federal level and being in trouble there. at this, point if they are cooperating and they have not necessarily heard from the doj than they may be in the clear
10:41 am
as far as fulton county is concerned, more likely than not, this is an indication that they do not have charges pending as it relates to the current r.i.c.o. statute. again, it is difficult to assume. in some cases there may be some cooperation. it is safe to say that as far as fulton county concerned, they did not have to further the prosecution. >> good to know on that front. christine, donald trump posted on truth social that the release of the special grand jury report undermines the credibility of the findings and shows that they wanted to indict anybody who happen to be breathing at the time. how unique is it that, yes, we have actually learned the names of those who are considered her indictment but not. is it in the public's interest to know that information? >> well, usually when the grand jury votes to indict or not indict those decisions are subject to secrecy. however, there are lawsuits to
10:42 am
try to get that information. the information the defendants in this case and many of whom wanted to have -- it is not surprising that it is been released. the actual report itself does not go into the reasoning of the grand jury as to why they recommend charges against certain individuals and not others. it's simply states here the charges they considered. here was the vote. the one area that is very interesting that was substantive in that special report was that the grand jury made a finding. a unanimous vote. there was widespread election fraud. they also say that there was evidence presented on both sides from poll workers and investigators in experts as well as those who believe the election was stolen. the grand jury came to the unanimous vote that there was no election fraud. i thought that was, in terms of substance, and incredibly

damning findings by the special grand jury. >> absolutely. the unanimity on that, for sure. charles, what about judge scott mcafee? you know that he still weighing the prosecution's request to try all 19 codefendants together on october 23rd. that is the trial that that has been set for codefendant, sydney powell and kenneth chesebro. was yesterday's ruling denying mark meadows request to federal court factor into mcafee's decision? >> not necessarily. i do think, if you listen to mcafee as he announces his decision regarding to the motions to sever, with chesebro and powell, i think you have some insight into what he is thinking about regarding the viability of fani willis's desire to try all 19 defendants at one. it is important to remember that because a speedy trial what the law dictates, those two individuals in particular, meaning chesebro and powell, meaning those trials will be moved forward on around that october day that they received

requests for. that is what the law requires. that is what the law provides for. fani willis in her office is going to be ready to go. however, i do suspect that not only with respect to the judge but also phony willis's office overall, there is going to be something of a recalibration in terms of how to deal with the remaining 17 defendants. whether they are going to proceed in october. i imagine what we will ultimately see, alex, is going to be these defendants grouped in tried in clusters. that is what is often the case in regard cases that involve a large number of defendants. what will be most practical for the cases of this nature. despite what fani willis initially said at the press conference tonight, wanting to try all 19, it's just simply not practical. i think you get a sense of that from the judge at the hearing. trust and believe that powell in chesebro are going to be moving forward. >> let me ask you both the last question asked you answered quickly. the prosecution says it is going to present 150 witnesses
10:45 am
and unexpected for month-long trial. does that mean donald trump will be sitting in the courtroom and potentially off of the campaign trail for a full third of the year? kristie, you first. >> she said that there were 150 witnesses. the special grand jury report indicated that they heard from 75. it is unclear whether or not she actually is going to call 150. if she expects, for example, custodians of records and others may be a part of that. if the defense is not going to agree. to it it is hard to say how long that this will actually go. certainly as long as there is a trial, donald trump is required to be. there i do not think we will see a trial until sometime in the spring or summer, given the fact that he is unlikely to be part of this october trial date. >> do you concur with a, charles? >> generally speaking with one caveat. i do think the, as it contains to the paris custodial winds,
10:46 am
is those who are handling chain or custody in those other things, there could be requests from donald trump's attorneys that he doesn't have to appear in trial on those dates. the trial judge may or may not granted. his defense team may or may not be in favor of. it it is not going to be good for the jury to go look at that empty chair word on trump should be sitting. it will be interesting. it could be something that they asked the court for. under the circumstances, it is possible the judge may allow for certain witnesses. >> donald trump will somehow managed to work it into his agreement campaign, let's put it that way. charles and kristie, is good to see you both. thank you much. for 100 officers, one prison escapee, why police say it is just a matter of time before the convict is caught. r of time before the convict is caught. the convict is caught. ahhhh!
