from the new center here in los angeles. welcome, everyone, to alex witt reports. we have the beginning of this breaking news this hour from overseas, where more than 2000 people are confirmed dead, and just as many injured in the devastating earthquake that struck morocco on friday. today, search and rescue teams are desperately scrambling to reach survivors in the hardest hit areas of the atlas mountains outside of marrakech. the 6.8 magnitude quake is the most powerful in the region and more than a century. nbc's ron sanchez is morocco within a close look at the destruction. >> we are in the village where about 30 miles east of the epicenter of the earthquake. we are standing in what was the narrow alleyways of the market. this is all that remains of what was a shrine here in the village. as you walk around in the debris here, you can see little reminders of peoples shattered lives from friday night. this is a bill, these are some

nail somebody had. these are people's homes. if i just asked my camera operator to turn the camera around, you can see that these shops are not going to be open anytime soon. the devastation here is enormous. there are about 3000 people who lived in this village, but locals tell us that around 40 of them were killed in the quick. that is more than 1% of the population that lost their lives. they are part of a growing national death toll that is now climbed above 2000. the rescue effort is perilous. the roads appear in the mountains, they are windy, narrow, and in some places, they are blocked by mud, by rockslides, and by boulders. nevertheless, the rescue operation continues. we're seeing both professional rescue teams here, but also local people who hands by patient hands, are sifting through rubble like this, trying to get their neighbors out.

administration have done. >> a major deadline this week for the election interference case in georgia. prosecutors have until tuesday to submit a brief on why former president donald trump and his 18 codefendants should be tried together. new criticism today into donald trump's campaign after earning republican governor, christine known endorsement this week. chris sununu made this point. >> in terms of endorsements, look, again, if he is a former city in and combine presidents, the leader of the party, and he only has four republican governors behind, and that tells you there's a problem. >> also, a new warning against another trump presidency today from california governor, gavin newsom. here's what he told msnbc's meet the press. >> do you think desantis would be a touch democracy? >> i'll leave it to more objective minds. i'm worried about democracy

fundamentally. i think the vengeance and donald trump's heart right now is more of a threat. >> let's go to capitol hill now, as the house returned to its long reset this week. one of the first republican acts could be attacking the georgia prosecutor leading the charge against donald trump. let's go to this lovely lady on capitol hill for us. julie, there is some new reaction today of house republicans. they are taking a mauve folly willis, right? >> yes. republicans have done this before, right? this is out of their playbook when it comes to the judiciary committee, where they have done this in the case of the former presidents initial first indictment in new york. they've tried to investigate the investigators, investigating him pushing back against the al bin brad. also doing it at the federal level with special counsel jack smith to indictment at the former president. now, we're seeing it again with jordan's efforts to pro d.a. fani willis's investigation and this fourth criminal indictment

against the former president. we have some new reaction, your right. including from congressman dan goldman who sits on the weaponization subcommittee that jordan shares. looking into that, as republicans say this is a dual system of justice. take a listen to what he had to say. >> it's one thing if it were a federal prosecution, which, of course, jim jordan and the house republicans are also trying to do with the special counsel jack smith. it's all together a wholly different thing when the federal government is trying to intervene in a state prosecution. i thought she did a very good job of laying out why this is an abuse of power, an abuse of authority by the house republicans to do the bidding of donald trump. >> what goldman is responding to there is that nine-page letter that willis had sent to jordan and response to this inquiry that jordan lobbied at her, including wanting to know whether she used federal funds in our investigation. willis city back in that response, call in jordan's

actions offensive, accusing him of being misinformed, and saying, it's quote, clear that jordan locks a basic understanding of the law, it's practice, and ethical obligations of attorneys general, and prosecutor specifically. this did not satisfy jordan's inquiry today, he was on fox news actually pushing back against, willis saying they will continue to investigate, saying they have a role to do so, but it's not clear how involved federal congressman on the federal level can get in a state, cases as well as -- >> all right, julie, thank you so much. perfect setup right now as they bring in our msnbc legal analyst, lisa rubin and danny syphilis. so we, so you first. yes she justified, the dea, and pushing back against congressman to head over the documents? >> she is justified. when we talk about congressional oversight, alex, there isn't much ground for jim jordan and the folks in congress to oversee an elected state official in carrying out

her responsibilities to investigate and prosecute. the most tenuous threat is really what connects them, which is congress appropriates money to the justice fund, willis isn't the recipient of various grants administer by doj. that's about it. as she goes and her letter, those grants have nothing to do with the case here, or any prosecutions. they're really to help her office and the cases and the events of domestic violence or violent crime. she had a right to pushback, and push back strong. >> so here's the question, danny, an investigation like this could it at all derail the georgia case, or any other federal cases, for that matter? >> much less likely to have any effect on the georgia state case. ultimately, congress has the spending, power which is one of the broadest powers that congress wields, and in the past, it has use that power as a lever against states to get what congress wants, so what the federal government wants, and an area that they couldn't

otherwise legislate. the national drinking age is a good example, that was secured not by congress for the states, but conditioning federal highway funds, for example. all in all, if there is in effect, it would be much more likely to go to the federal prosecution. virtually no effect other than to be newsworthy on the state prosecution in georgia. >> okay, so as we look at the week ahead, first off fulton county prosecutor, they have until tuesday to justify why they want to try all 19 codefendants in the georgia election interference case at once. trump's attorneys and the january 6th case, they must follow brief on trump statements. jack smith say this could prejudice the jury pool, so lisa, what are their concerns surrounding trump's statements, and could judge -- and ordering a gag order that could mean huge penalties for trump? >> yeah, my understanding, alex, of the case before judges that

it is actually on whether or not the department of justice requests for really should be sealed. we have an in clean is that, as you just said, trump's extrajudicial statements, statements he makes out of court, and how they will have an effect on the jury pool, but as judge has said, trump's attorneys before, the more he does, that's the more inclined she is to go quickly to trial. we already have a march trial date in that case. other than pushing it sooner, i think our next lover against him is to start to impose some other forms the sanctions. i remain curious as to what she is going to do, and what we'll hear at the department of justice as to why we deserve insight into that fight. >> drag the seal documents, let me continue, danny. fani willis's team said that the codefendants would take four months. they called about 150 witnesses. what with the briefing they have to file about this say to convince a judge that everyone,

including donald trump, should be tried starting october 23rd. >> i can't imagine a justification for starting all of this in october. it's a little unrealistic by the d.a. to think that they could even commence the trial. they may have a trial date on that date, but other things are going to happen, even if they have jury selection. there's currently a r.i.c.o. case, a high-profile r.i.c.o. case, and that has been a jury selection for eight months. otherwise, just jury selection, not even the trial, so things happen, the dea could be ambitious, and try for as early as possible, but even she must, realized it's just not going to happen that way. >> okay, both of you, lisa danny, we're going to talk 14th amendment a little later. first, we have some shocking pretty scary developments overnight in the case of that escaped prisoner in pennsylvania. we're back to cheryl, that in 60 seconds. 60 seconds

developments for the search for a convicted murderer in pennsylvania. the escapees stole a white van, and he was spotted overnight 25 miles from the search done. and, he's got a new appearance. nbc's melissa cars outside the police command post. this is huge, marissa. it is a major new challenge now for the police search. what are they saying about him getting through their perimeter? that was a couple of miles, as if you're reporting yesterday. >> yeah, that's gotta stay for the people who have been surging here, especially given the fact that yesterday, we have been talking about how they narrow the perimeter to four miles, down from the 8 to 10 miles a day before. there was a lot of indications that they thought that they were narrowing in, they thought they were getting closer, here so to find that he has now stolen a car, and then been seen about 45 minutes north east of here, i know that there is definitely some frustration right, now especially among not just the people search, and

with the people who live around here. we'll get to that in a moment, but let's go through all those new developments, because there have been a lot. so remember, we are in the long gardens area. we're across from the fan, poses a nerve center were all those decisions have been made. the gardens, the south of technical gardens where they really focus on that search, and that was the four mile radius yesterday. there is a dairy farm just a few miles away, and that is where that stolen van was reported to be missing from, so this local dairy farm, they said they were missing the white van, then we saw that ring doorbell camera, we're seeing pictures from that ring doorbell, cam you'll see in just a moment. he's sorting and new look, he's got that sweatshirt, he's got a hat, freshly sabin, appears to be smiling or smirking in some of the photos. there were several released, you see him right there, we're not clear on when those voters were taken, frankly, that's information that we have asked police, they haven't gotten

back to us that information. you can in terms of where things stand with the van, we're asking, them do we believe he still in the, van has the band been found? they have not reported back to us is confirmation, but you can imagine that people in the area are wondering where he, is a lot of people are on edge, we're not just talk about this local area, it sounds like the greater area as a whole, especially near phoenix, have we heard from just a bit ago. take a listen. >> we're out looking for the fugitive, because i have teenagers, and yesterday we were at a party, we thought he was contained and longwood gardens, and we were out of party and phoenix fell, and my teenage children were driving around. now i'm concerned. >> so there are a lot of questions, especially when was he last seen, when we see last seen in that band, do they still believe he is in the ban?

>> to say that a section of the 14th amendment's election interference, and considering how to uphold the constitution, is election interference. it's an american. we know that the former president is a liar he will do everything he can to hold on to power. >> joining me now is colorado congressman, jason crow, a democratic member of the house intelligence foreign affairs committee. good to see you. how serious is this effort, and what are the chances that successful? >> well, i think that any viable effort needs to be pursued here, now that the former president is a felon, he's a danger to our democracy, he showing he'll do anything, inside an insurrection, and murder police officers, so i like this suit, i had a chance to redo it the other day. and section three of the 14th amendment, which says simply that if you are involved in an

insurrection, a rebellion against the united states, and you took an oh, the previous oath to uphold the constitution, then your ineligible to hold office, it's very simple. that's clearly what happened here. i do support the, suit is likely all be a witness in this case, which i will, and we'll see what happens. >> you would be a witness in what regard? how would you be a witness and why? >> well as you might recall, i was one of those members of congress on january six who was surrounded by that violent mob, and trump there for about 40 minutes. i saw firsthand the violence, what was happening, and the efforts to derail the democracy. that's clearly what this was, right? nothing last. they were trying to take over the capitol. they were trying to interfere with our certification of the election, full stop. >> any effort to let voters decide this? what's your reaction to that? >> well, voters will ultimately

decide, this in my view, i mean that's what this is all, about we're going to take the case in the ballot box to. i've long said that donald trump is in this democracy, and that is a legal element here. i was involved in the impeachment trials that donald trump, i was in an impeachment manager at his first peacham trial. we tried to remove him from office because he was such a, danger such a threat, so there are mechanisms in place to either remove the president from office, or to prevent someone from holding office. we certainly should uphold the constitution, in addition to that, we will take to the campaign trail as, well it's make the case of donald trump is not qualified to be president, let alone someone's babysitter, frankly. >> let's switch gears and focus on new mexico, governor michelle, who temporarily suspended the right to carry firearms in public. this across albuquerque and its county for 30 days. the democratic governor is declaring a public health emergency for the shooting to

death of an 11-year-old boy. as you might suspect, they are facing legal challenges from gun rights groups. will this kind of action hope reduce gun violence, and should more democratic governors try to move in that direction? >> yeah, i support the governor's action, here she is clearly doing what she needs to do to protect your citizens, and her constituents, and let's, and i am somebody who believes in a responsible firearm ownership. i've been a gun owner most of my life. i've gone hunting, for shane, i'm an avid sportsman. the modern gun culture, when it's been perverted into, you, know this notion that you can take an assault rifle, and wander around in a fast food restaurant, really, what people are trying to do is intimidate people. they're trying to puff up their chests, act like, big tough, guys. they're trying to intimidate people. it's shameful, frankly. that's not what the second amendment was really about, it's clearly not the intent of our founders, to allow people to intrude on others faces, to intimidate them, and, you know,

the governor is doing the right thing. >> yeah. moving to the topic of the war in ukraine, today, anthony blinken was pressed about these reports. elon musk refused to provide starlink access to the ukrainian military for their operations against rachel. take a listen to the exchange. >> musk says he was reportedly afraid that russia would retaliate with nuclear weapons, musk says that's based on his private discussions with senior russian officials. are you concerned that musk is apparently conducting his own diplomatic outreach to the russian government? really, none of this concerns you? >> jake, i can't speak to the conversation that may or may not have happened, i don't know, i'm focused on the fact that the technology itself, storyline, has been really important to the ukrainians. >> well, to blinken's, point it

certainly, has it's been really the crux of a lot of the ukrainian military operations, and then muskets involved, allegedly, by those one particular approach, one operation, what do you make of that? should elon musk face some sort of repercussion? >> well, here's what's happening, this is a broader challenge that we're facing as a challenge right now. space is becoming commercialized, he used to be government domain, but private companies are bigger and bigger players launching the satellite constellations that are critical for our communications, and that trend continues. other aspects of our national security continue to move more towards the climate sector. there are some benefits, they're on a lot of incredible technology is certainly coming out of that, but we cannot, and i just want to be very adamant about, this we cannot be in a situation where you have a billionaire, one person or private company that is making

decisions over the matters of national security, or the national security of our partners and allies. that's unacceptable, i will be getting into this as a member of the intelligence committee, and the foreign affairs committee, to see what checks we need to put in place to make sure that these unelected, on executives, or, billionaires cannot make decisions like that. >> i've got to say when i was reading about this, the whole concept is, well but let me ask you finally, tomorrow, marks 22 year since the september 11th terror attacks, and it has been a little more than two years since the full u.s. withdrawal of troops in afghanistan, which brought an end to the two decade-long war. you are a former army ranger, you sort three tours in iraq and afghanistan. how are you reflecting on the big picture? >> well, alex, these days are always major reflections for me, my entire life changed that day, as to the lives of frankly millions of americans,

thousands on september 11th, in 2001, millions of americans surge in various capacities in the global war on, terror they had been a national guard soldier, an illicit soldier for years before 9/11, but the attacks got me to actually go active duty, become an infantry officer, and paratrooper, army ranger. to really change the trajectory of my life. i'm thinking about the last 20 years, our mistakes, our feelings, but also the opportunities that we have to do better. to make sure that we are doing better about our national security, because 9/11 prompted us to embark on these wars. one of which was a failed endeavor in afghanistan. that's not to say that those who fought that didn't do so honorably, they did, but 20 years of that war, trillions of dollars, thousands of lives later, we owe it to the american people to take a deep look at how we can prevent this from happening again, and keep

the homeland safe. >> i want to thank you for your devotion entity to this country, it's always good to see you. let's bring you more on the breaking news from overseas. president biden is wrapping up a busy day in vietnam, we're gonna go straight to janis mackey who's with the president. welcome, what are we hearing from the president on this, what, last full day overseas? >> well president biden hailed this newly upgraded relationship with vietnam, what they call a comprehensive strategic partnership. it's a status the vietnam holds with only a few countries, so the biden administration is seen as a significant step in its effort in this part of the world to counter the influence of china. earlier this evening, at a press conference, president biden called the new partnership a breakthrough, saying it strengthens ties with another critical indo-pacific partner, because earlier in the day, he had said, quote, the

united states as a pacific nation, and we aren't going anywhere. that seemed to be a message that was directed at china. in, fact most of the news conference the questions were about china, and the contentious relationship with the u.s.. here's more of what he had to say. >> i am sincere about getting the relationship right. one of the things that is going on now is china is beginning to change some of the rules of the game. in terms of trade and other issues. as i said, i'm not looking to hurt china. sincerely, we're all better off if china does well. >> when did you meet mr. xi. >> i hope i get to meet him sooner rather than later. -- over the last 12 years. i hope to see him again soon. >> tomorrow, u.s. tech executives will meet with tech executives here in hanoi.

from the ballot are moving ahead in colorado, where a loss to travel and jane his eligibility are underway. the case centers on a clause in the 14th amendment that goes, no person shall hold office who has previously taken an oath -- was on msnbc this morning. >> this is that disqualification and it's important for the survival of the republic that somebody who has shown him or herself to be an insurrectionist against the constitution, to not get another chance to try. let's >> bring you back msnbc legal analyst and deniece of all. as you heard that the use of the 14th amendment in this case is not a criminal punishments,

it's a disqualification. with that lessen the blow for trump if he were to be banned from the ballot? i mean one of the chances this could work? >> i think it remains to be seen whether it can work. this is the ultimate situation, first impression, and away. it has been tried, i should note, in two courts already. it was tried in georgia against congressman marjorie taylor greene, it did not work there. it was also try to new mexico against a gentleman in cory griffin, who is county commissioner. he did end up being removed from office. he was also a january 6th defendant, who has been through the federal criminal process. it's anyone's guess whether this will work against candidate donald trump. there are a number of people who think it's worth, crime particularly in a state like colorado, where it is easier to establish citizens standing. that means six ordinary voters with the plaintiffs here can go into court and say, we have the right to try and enforce the

fourth amendment and a colorado state court. as you, know donald trump, after initially trying to move this case to federal court, ultimately conceded at the end of this week, no, actually, this does belong and colorado. at least that battle is behind, them and will move on to the actual indication here about his disqualification. >> well, we know donald trump is pushing back on the legal effort to ban him from the ballot, and here's donald trump earlier this week on that. >> what they're doing is, it's called election interference, in all these lawsuits get in the way. the 14th amendment is just a continuation of, that it's nonsense, no one's even said it's an insurrection. by the, way the interaction, it's frankly for the people who interfered on the election, those of the insurrectionists. >> so, first of, all know guns at the capitol, that is false. do you think the trumps argument stands up against his

14th amendment cases? >> if his argument is that i have not been charged with the crime of insurrection by the doj, or by anyone else, therefore, i am not an insurrectionist, the no, that argument won't work, for a couple different reasons. one being that the 14th amendment does not likely rely on the doj charging someone, or even convicting them of insurrection. the constitution is the core document, it contains the word insurrection, it does not limit or defined by federal statutes that are thereafter an active by congress. another probability is that trump's first amendment defenses, for example, this was not incitement, or insurrection, because i had first amendment defenses, those probably would be unavailing as well because the first amendment, in the 14th amendment operate independently of each other. the 14th amendment contains those words, it is not thereafter limited by, say, what courts do, or the doj does. there's an argument to be made that as long as somebody, a

the general election? what are her challenges for skating through the primaries? >> yes, she maybe four general election the best republican option, and here's why, listen, i think donald trump and ron desantis, and that you can bring and ramaswamy into this, they are uniquely dangerous. i think a lot of americans, particularly democrats, see them as uniquely dangerous, so either the constitution, a constitutional protections. among the other republicans, nikki haley, mike pence, and others, there are certainly reasons for there to be concerns about their ideology, but they would operate within the traditional constitutional norms. ultimately, in a general election against joe biden, republican should have somebody, one operating within the general constitutional norms, because if it is donald trump, or wrong desantis, or even ramaswamy against joe biden, the contrast there is clear. they will grow the economy by protecting the constitutional order, or the republican nominee who had shredded the
