kevin mccarthy will ratchet up the investigations in to president biden, formally backing an impeachment probe. reaction to that and the perfect storm facing the house speaker with a shutdown looming. and later, kim jung-un reportedly now inside russia ahead of a meeting with vladimir putin. how soon those two men could be face-to-face. thanks for joining us. it is 10:00 eastern. and we begin with the breaking news on that urgent manhunt for a convicted killer intensifying this morning in pennsylvania. police just gave us an update confirming that danelo cavalcante, who escaped the chester county prison nearly two weeks ago, is now armed after he stole a gun last night. >> at 10:10 p.m., a call was received from a resident on

coventryville road indicating a short hispanic male, no shirt, and wearing dark pants had entered his garage while the homeowner was in it. and that he grabbed a .22 rifle that was leaning in the corner of the garage. the homeowner drew a pistol and fired at cavalcante as he fled with the rifle. cavalcante is considered armed and extremely dangerous. >> this morning police are asking residents to stay inside, to lock their doors and monitor their home cameras. that left picture there is the latest we have in terms of how he now looks as he is clean shaven, all the local schools are closed. let's go to lindsey reiser who is joining us from chester county, pennsylvania. and we also have jim cavanaugh standing by. a lot of fast moving developments overnight and into this morning. walk us through what we know right now. >> reporter: yeah, this really marks a new phase here, dramatic turn of events overnight. last night around 8:00 p.m., a

woman says she was driving and she sees a male crouched at a wooded line. she turned her car around and he was gone. so that sets up a new per rim difference for law enforcement. remember the day before they basically had gone into a containment phase where there wasn't really a set perimeter that we have now. then about two hours later, around 10:00 p.m., they get a call that resident has shot at a man believed to be cavalcante who entered his garage, stole a .22 caliber rifle with a flash flight and scope. he had ditched his prison boots, he had stole another pair of work boots from a nearby porch, goes into this garage. the homeowner fires at cavalcante. he runs away with this firearm. but right now, police say they have no reason to believe that he is injured, but they say he is armed and dangerous, not to approach. so we have this roughly 8 square mile perimeter now, we have plane and helicopters quloefrd,

and 500 officers are mobilized. police believe that he is just trying to avoid being captured, but believe he knows this area. when asked whether he was getting any assistance, police say they don't believe that -- they can't comment on whether he is getting any assistance but believe he is beyond assistant at this point. again, asked if he was desperate enough to potentially use that firearm, law enforcement says that they do believe that he would be desperate enough. so dangerous situation out here. but there are no active evacuations, not a shelter-in-place order. local schools are closed, but residents are just being asked to lock their doors, lock their outposts. this area is dense, wooded. we have cow and horse pasture, a lot of barns and nooks and crannies where he could hide. george solis asked what went wrong here, how is he continuing to evade capture and state police said nothing has gone wrong, they have the perimeter,

they believe he is in this area and they say no perimeter is 100%. >> okay. thank you for that update. please come back to us if you get additional information. jim, some serious intensity with the knowledge that cavalcante is now armed, a .22 caliber rifle we're told. as someone who has been involved this searches like this, what is like inside that investigation right now do you think? >> well, try to keep that perimeter because he has the key. cavalcante now has the key which is the firearm to get him where he wants to go which is the southern border. this guy wants to get a vehicle and he wants to get to the southern border. but is he cagy, he's been a fublg difference a few times and he knows how do this. >> he walked into a garage with the homeowner there, that is pretty brazen. >> the homeowner would be dead and his car stolen if he didn't have a firearm and shoot at cavalcante. once he got ahold of that rifle, if the homeowner didn't have a gun, he would have killed him

and took his car. heis trying to get a car. >> and how much harder once he's escaped the perimeter to try to actually catch him? >> well, it will be a crime spree. once gets a vehicle, this is what he wants, now he has the key for that because as the wid said, he can crouch in the bushes, wait for someone to walk to their vehicle, soot them because he has a rifle with a scope, walk over, get the ski, throw the body in the ditch and drive away. get a few hours head start, he could be a few states away where there is no one looking for him. >> and so people are told stay inside, lock your doors, schooled are closed, stay out of the way. this morning police are characterizing the search area as being about 3 miles in one direction, 2 in the other. hilly terrain. they say tactical teams are

involved. what sort of search tactics and techniques might they be using? >> all the srt and s.w.a.t. teams, special response teams, dogs, tracking dogs, air assets, infrared radar to see movement at night. but the canopy blocks a lot of that, the thick leaves. so it is very tough. cavalcante is cagy and he grew up in a ranching area in brazil. and he is brazenly killed a victim with a gun in brazil. he's killed with gun, he's killed with knives. this guy is a killer. and he will kill to try to escape. >> a scary situation. jim cavanaugh, thank you so much for being an expert on this for us and analyzing where we're at. if anything happen, we'll bring you back. appreciate it. turning to washington now where the house is back in session. in a few hours speaker mccarthy is preparing for a massive

political escalation. nbc news learned that the speaker will formally endorse an impeachment probe into president biden this week. let's bring in capitol hill correspondent ali vitali and also former adviser for the romney presidential campaign kevin madden, and former communications director and senior adviser to speaker pelosi ashley. ali, let start with you. what can you tell us about mccarthy's plan? >> it is like we never left because here i am standing in the hall waiting for the speaker to come out of his office and give us some kind of update on the latest box that he is in because of the wide range of disagreements within his conference. you know mccarthy has been under pressure for some kind of move on impeachment. it seems now according to our sources that he recognized that an impeachment inquiry is his way to try to placate the right most flank while also not doing the most damage to moderates. but this is a gamble in and of itself for mccarthy because it

is not clear that he has the votes to move forward on this, but also not clear that it will placate the people that it needs to placate and all of this of course playing out before the government could shut down just a few weeks from now on september 30th. all of these dynamics in play greeting mccarthy for yet another inflexion point and this inquiry would allow them to go into bank records and other assets that president biden has. it is a way for them to show that they are deepening their investigation into the president despite the fact that democrats and even some republicans will remind here that none of the investigations that the republican committees have done so far have actually led to the belief or proof that joe biden actually did anything wrong. so again, this is hard politics for mccarthy as he comes up again against tight margins in his conference, the idea that any one member can trigger a motion to vacate and these are the dynamics that he has to play

against. >> thank you for that reporting. ashley, what is your reaction to this move from the house speaker that is expected? >> well, i mean, i'm with the republican members asking the question where is the evidence. the republicans haven't put up any evidence that constitutes high crimes or violation of an oath of office. here is the thing. i think the american people will see this for what it is and it is the republicans' attempt to settle the score for donald trump and mccarthy's attempt to keep his job. i ran the first impeachment war room for speaker pelosi and she withstood pressure from her party for more than a year to move forward with impeaching donald trump was there was no evidence. in addition to that, snelt like it was too devastating to pull the trigger on impeachment without there being evidence. and so i think that is what is at play here. mccarthy is trying to keep his job, trying to do trump's bidding, but all at the expense of the health and security of our democracy.

you know, that is the thing that i think democrats will have to do, which is, a, hold them accountable for producing the evidence,secondly, they will have to elevate the hypocrisy. the fact that they will not hold donald trump accountable for attempting to overturn the election and initiating insurrection but yet will move forward with an impeachment with no evidence. >> kevin, let's listen to ken buck who is also a former district attorney from colorado essentially saying that there is no "there" there. >> the time for impeachment is the time when there is evidence linking president biden, if there is evidence, linking president biden to a high crime or misdemeanor. that doesn't exist right now. >> the evidence is not there. so is this move really anything more than just mccarthy trying to save his own job? >> i think that ken buck gives voice to a lot of the concerns that many moderate members in the republican party or even

conservatives who happen to be in very competitive districts around the country have about taking on a process like impeachment, very weighty constitutional process, a definite political escalation, and taking that on by being forced into it by a number of national members inside the conference. i think that is the biggest problem. if you will take on something that big, you don't want to be pressured into it. so that is a challenge that kevin mccarthy has over the next weeks and months as he tries to satiate rapid appetites who want to see the inquiry go forward. and at the same tim, he is facing a budget showdown that is very serious, potentially facing a government shutdown by the end of the month, that will take all of his attention. so having to thread the needle on an impeachment inquiry while staring down everybody around a budget showdown, quite a

challenge ahead for the next few weeks. >> and we should note we just learned that we'll hear from speaker mccarthy at 11:00 we are told. so we'll be on the lookout for anything he has to say about this formally. nbc also reporting that democrats are planning to go on offense to fight any impeachment inquiry. a memo from congressman jamie raskin goes point by point against the claims and describing the gop-led probe as a total bust and epic flop. what do you think that democrats should do? >> i think again they should hold republicans accountable for producing evidence. and they also have to make sure that they contain the story lines. media as a way of sort of running with these headlines that there is some evidence that doesn't actually exist. but here is what i think strategically they should do, going into the five districts

that republicans only have a five seat majority, those seats were won by joe biden, go into those districts and aggressively pressure those members to hold the line to not move forward with impeachment especially without any evidence. i think that that will reap some benefits because mccarthy, he has his speaker ship on the line with this decision. not in the immediate, but even in the long term. so if i'm democrat, i'm using this to my advantage and going after those five members and seeding the narrative that this is just another attempt by the republican congress to, again, settle the score for donald trump. >> and let's circle back to what you touched on and yes there is the political maneuvering, but this is also a little bit about character and also about principle when it comes to what impeachment means, right? trump was impeached twice. so he wants this impeachment inquiry to three to level the playing field, flight but these situations aren't equivalent. and the constitution says that

the standard for impeachment is treason, bribery and other high crimes and misdemeanors. so what does it tell you about the state of politics where it seems impeachment has just become tit for tat? >> yeah, i think certainly in congress the bar has been sort of lowered on impeachment unfortunately. and i think -- again, i believe that takes constitutional process that should be considered pretty heavily. but i think -- and there is a revenge element here sure and that is driven by a lot of the partisan politics shaping our politics today. i think one of the things that you have to remember though is that many partisans at home, many voters, are not constitutional scholars. they don't look at it through the lens of the constitution. so i think while there is potential for overreach, there always is anytime with an impeachment, we've seen that with past impeachments, democrats will still have very serious challenges here. hunter biden is not a very

we're back with new coach. s in the investigation in donald trump. the former president now asking the federal judge overseeing his election interference case to recuse herself citing previous comments judge chutkan made in other criminal cases involving the january 6 attack. trump's lawyers for example point to an october 2022 ruling in which the judge wrote "the people who mobbed that capitol were there in fealty, in loyalty to one man, a blind loyalty to one person who by the way remains free to this day."

judge chutkan has given the special counselor team until thursday to respond and of course the decision to recuse is up to the judge herself. our legal analysts are joining us to discuss this and other developments that have happened. let's get to it all. catherine, judge chutkan has senl handed down some of the harsh punishments to some of the january 6 rioters that have come before her in her court. what do you think is happening here, is there legal merit to this? >> no, they had to make the motion. they are competent defense attorneys. you make every motion that you can that you can argue with a straight face. that quote was which you willy judge chutkan responding to the defense. the defense was that we came here because we were exorted by other people. obviously she meant trump.

so are they just judge shopping here, charles? what do you think is the difference? >> i think it is important to understand that throughout the entirety of all of these cases, donald trump's attorneys are going to exhaust every available legal maneuver that they can. so they are going to judge shop, they will forum shop, they will do any and everything that they can to try to shift the scales in their favor. if it includes a motion to recuse, then they will do that. if it includes a different forum as you may have heard them talk about in new york, they will do that as well. all of these things are, number one, designed to get donald trump the best odds in terms of being victorious in a trial because he is not -- he doesn't have very much that he is working with. but also number two, there is always the question of delay. so they will exhaust all of these different legal mde maneuver, trying to cherrypick their judge. i think the jury selection once we get to a trial, it will be a huge mess because they will try to figure out who it is that

they can count on to hold out against jack smith's prosecution. so it is not unusual, not unexpected, but ultimately i don't expect it to be successful. >> so maybe this is long the same lines in a different case, this one down in georgia, trump's team for the first time officially has moved to dismiss the georgia case and all the charges that follow it. where does this one go. >> that will be denied too. they would be incompetent if they didn't move to dismiss. this is a very thorough indictment so they can't say they didn't understand what the charges are. and they weren't given notice by -- it wasn't specific enough. this was a very specific and detailed indictment. so they will lose that. but as charles said, you make every motion you can and you hope because if your client is convicted, you will have some appeal issues. because if you don't make those motions, you can't argue them on appeal. so that is also a loser. >> another motion here, this one coming from mark meadows,

another defendant in the georgia case. he filed an emergency request. remember he initially had wanted to move venues to federal court from state court to federal court. so different jurisdictions all together. and his lawyers are now writing asking a judge to stay the motion that he could be convicted and incarcerated by the time the appeals process plays out. is that true? >> i don't believe that is the case. i think that they are looking at a most extreme scenario. i think ultimately this will be denied. i think those of an appeal with respect to this judge's decision not to allow hark meadows to move to federal court is going to be denied. because there is no solid grounds through which they can make the argument that somehow mark meadows' actions were something that occurred under his authority or his employment as a federal employee. and i think that that is really what this boils down to. the judge's order was very straightforward, very clear. mark meadows is trying to avoid number one being on camera in

flooding. the deluge of rain from the storm caused flooding and submerging part of the northeastern city, filling roads with all the debris. and let's get to josh letterman with the very latest. what can you tell us about where things stand? >> reporter: we are in that tragic state of the disaster, just as soon as authorities feel like they have some handle on the number of people that have died, that number increases sometimes by hundreds or even more than 1,000. so we're seeing various death tolls from different officials and the different government authorities that rule parts of libya ranging from a little 2002, and now more than 5200 according to an official. and the number expected to climb far higher as some of the missing are loektsded. according to the health

minister, one of the biggest challenges in figuring out the scope of the disaster is the fact that lot of bodies are buried either under the rubble or actually been washed out into the mediterranean sea. i want you to hear from a representative from the red cross and red crescent who spoken to the u.n. about what they are seeing on the ground. watch. >> it might reaches 2 thousands. but what we can confirm now, that thousands have lost their lives, thousands have lost their homes and thousands of families are stranded. >> reporter: humanitarian assistance now flowing in to libya from countries like the united states, from here in qatar and united air emirates. and now to morocco, the search for survivors from the

earthquake enters the fourth day. and the death toll from this quake rising to more than 3,000 people. with the u.n. estimating more than 300,000 in need of help including 100,000 children. many forced to sleep on the streets for a fourth night with medics battling against the clock and residents lining up to donate blood. and matt bradley is on the ground in morocco. where are the medics and rescue teams trying to focus right now? >> reporter: yeah, they are trying to focus on some of the more remote areas that they haven't touched yet, and those are places where there is thinking that possibly there are bodies. but i spoke with a british rescue worker and he said that there is a lot of frustration and they really aren't seeing the same kind of dynamic that we were seeing back in february in turkey where six, seven days later they were recovering survivors from beneath the rubble. here is what he told me. when it comes to finding survivors, what are the challenges you are facing?

>> challenges we found this locating survivors is that many of the sites we've been to, the collapse has been total. so based on recent events such as the turkey earthquake, what we found is is that we have what we call survivable voids, gaps where people can survive until we reach them. some of the sites here, they have been a total collapse so unfortunately, we haven't had that opportunity. >> reporter: and what is the difference there, somewhere like turkey and here? >> it can range from the scale of the earthquake, the distance of those buildings from the epicenter, the building construction materials, the construction style. so a lot of different factors. it is difficult to pin it on any one thing. but ultimately what we're finding is that those that collapsed are completely collapsed. >> reporter: which means that no one is alive. >> which means that we have limited survive ability options. >> reporter: and so as you can see here, i'm in a place, a village in at has mountains that was pretty hard hit. there is a lot of destruction around here, but there is not a lot of urgency.

that equation have reasonable evidence based arguments for and against vaccination for the general public. >> that certainly what you hear talking to just friends and family members, the questioning of whether it is really, really necessary especially if you have had covid, if you have gotten the previous shots and have had relatively mild symptoms, how at risk are we really is the question on many people's minds. but since covid vaccines first came out in the 2020 time period or so, there is concern about side effects, one is the threat of heart inflammation or myocarditis. what more do we know three years or so into this? >> right, so from the beginning we always knew that the rick of the myocarditis seemed to have disproportion nat effect on both males as well as adolescent males. and that has head up. the most recent review that i've been able to see was actually almost a year ago now because

again the number of people who have taken up the booster was so low, but we do see an increase incidence of myocarditis especially after the second shot if you had that two shot series. and then also we've seen cases after the certainly cardiologi treating covid-19 patients say the risk of coronavirus or covid-19 cardiac involvement is almost always going to be more severe than the potential from the vaccine that is self limited. it's something you would want to have a conversation with your physician about if you fall into that at-risk group. if it's just a cold, think twice about reaching for the over-the-counter medication, and
