impeached, not a one count did you get. he's been acquitted on all charges. he will now decide whether he returned to his job, that is that if it goes back to his job as attorney general. they're or not. again, this is just come down the last 15, 20 seconds. so, i will duly him this over to my colleague, he has been vossoughian to pick this up, and more. stay with us, aussie back here. >> hey, everybody. alex, with just said it, yasmin vossoughian joining on a very busy saturday afternoon, this just breaking in the last 20 seconds or so. out of texas, we're seeing senators there just finish voting minutes ago, acquitting attorney general ken paxton. on all articles of impeachment. he's been suspended from his duties since may. but can now, in fact, return to work. i wanna bring in msnbc priscilla, thompson standing by for us. also following this from the very beginning. priscilla, walk us through what we know. >> yeah, yasmin.

after almost two weeks of testimony and closing arguments with both sides making the best-case possible, today those senators went into the chamber, they voted on each of these 16 articles of impeachment. which included things like bribery, conspiracy, dereliction of duty, and ultimately, the votes are in, and two thirds of the chamber did not feel that he was guilty of those crimes. he has been acquitted of every single one of. them and they were also for additional articles of impeachment that were not being can considered, because of other pending things going on in court. those were just dismissed. he is cleared of all 20 of the articles of impeachment that were originally brought by the house. he is free to be reinstated, and return to work as the attorney general here in texas. what we saw in this vote was there were almost two republicans on any given article that voted to impeach. of, course it wasn't enough to

hit that 21 vote threshold that would have been required. i expect it will be getting a statement from ken paxton any moment now. we know that the folks that lead the house managers that lid this, those attorneys, are expected to speak in just a short while. certainly, got to the big disappointment for them, this was a historic impeachment. we have not seen anything like this in more than a century. here, clearly, the members of the house believed that there was reason to convict. it is why they sent it over to the senate. but after listening to all of that evidence, there were not 21 senators in that room that wanted to vote to convict him. of course, there is also the underlying political issues here. those two republicans i mentioned, who did vote in favor of some of these articles of impeachment are not up for reelection until 2026. but ken paxton super pac has made very clear, any republicans who did not stand

with him through this would be in their target. as the upcoming elections come. up that is the state of affairs here in texas, and we are continuing to work for any additional reaction. yasmin? >> a couple things i want to dig into, priscilla. as you're standing there, outside where it is this vote took place, what type of reactions are you hearing so far, if any? >> yeah, it's interesting. there's obviously a lot of press in the gallery. also a lot of just average folks who came to sit in. we didn't really see any reaction from the crowd as all of this was playing out. it's very different from what we saw when the house voted on this. impeachment there were ken paxton supporters lined up to get into this gallery to hear what was going to be presented. we didn't see that today. we are, of course, hearing from the democrats in the state, with the texas democratic party, releasing a statement, and a lot of folks just, saying how

could we allow this corruption, is pretty much the message we're hearing from democrats very disappointed in this outcome, and just to remind folks of how we got here ken paxton was accused of helping a wealthy political donor in exchange for bribes, those were accusations that were made by his former top staffers. those staffers were fired. the attorney generals office settled on multiple terminations two for three point $3 million. the reason it is come up in the texas state, house because ken paxton asked that the state money, taxpayer dollars, the used to fund that settlement. so, that is when the texas house launched an investigation. they voted to impeach, of, course those articles of impeachment were sent here for the senate to decide on after listening to testimony in this trial, where we heard from many of those former staffers. very emotional. talking about how difficult this has been for them.

we saw some of those staffers in the gallery today, clearly, they're also likely disappointed. many of them feel like they put their careers on the lead. to speak about something they felt was wrong. they wanted that wrongful termination suit, clearly, the evidence was not enough to convict in the gop-controlled senate. yasmin? >> priscilla thompson for, us thank you so much for standing by for us. we are gonna be speaking with state senator roland gutierrez in just a minute, who was inside that room behind you. and just coming out to vote. as soon as he gets out, we'll talk to him. we want to turn now note to the list of the doj's election interference investigation, former president trump. where we learned special counsel jack smith has asked the judge in that case to place a limited gag order on the former president. the special counsel's office saying, in a statement, trump, quote, as made good on his threat, on his august 4th. if you go after me, i'm coming after. you don't bring msnbc justice reporter, ryan reilly.

who's also the author of the upcoming book, sedition hunters. our january 6th broke the system. set for release next month. also, leslie caldwell, former assistant attorney general of the colonel division of the probe of justice. ryan, if you, will bring us up to date on where we are with. this >> yeah, so, essentially, they were one of the very limited gag on donald trump. speaking about, in terms of him speaking about witnesses in this case as well as the prosecution. and the judge in this case saying that the comments you're hearing would impact the opportunity for him to have a fair trial, and get this case to trial. it's mostly going in march. which is coming up very quickly. less than six months. out. now saying that essentially, what he's doing now, is the same thing that he's doing in the lead up to january 6th itself. using threats and making these threats that are interfering with the process in the same way they ultimately did on january 6th itself. >> all, right ryan reilly for, us thank, you ryan.

i'm natalie hugo. leslie, let's dig into some of. this can, first and foremost, what is a limited gag order look like? >> so, essentially, it appears the czech smith's team is trying to enforce against trump. a rule that already applies to all the lawyers in the case which is a local rule in d.c.. which is similar to locals and many other districts. which prohibit the attorneys from talking disparagingly about the case, the judge, the witnesses, et cetera. normally, you don't see the criminal defendant himself doing the talking. but that's what's happening here. essentially, jack smith is seeking to have a local rule, or some sort of iteration of the local, rule apply to the defendant. >> how would one enforce a gag order, and, or a limited gag order? >> the enforcement mechanism would be contempt of court. if there is a gag order, that

is issued, a violation of that order could be contempt of court. which could result in fines, jail sentences, et cetera. >> i know that judge chutkan herself has been threatened. has personal security as well. how does that play into her decision to grant this limit a gag order? >> i think most judges are fairly dispassionate about the fact that defendants appearing in front of them have views about the judge. i don't think that would be fricker. the bigger concern would be the potential effect on a jury pool. i mean, the former president is obviously trying to try his case in the court of public opinion. as opposed to a courtroom. and the judge will try to have the court case trade inside the courtroom. >> we're also learning of new evidence here, leslie, that i want you to talk a little bit about. from these court filings, 32

direct messages, draft tweets as well. by the former president. all on twitter, which is now named x. how significant is evidence like this, now in possession of the special counsel? >> so, i don't know the contents of the direct messages. but i do know that, in every single criminal case, whether it's a drug case, a corruption case, or this case, electronic evidence plays a critical role. everyone communicate that way. again, depending on the contents of the messages, they could be very significant. or they could just be another piece of evidence on the pile. it's hard to say, without knowing the contents. it's certainly not unusual for the government to get a search warrant. and obtain electronic evidence from twitter, slash ex, or facebook or google. >> along with attorneys as,

well with my, colleague kristen welker. tomorrow morning. given interviewed meghan kelly under siriusxm program this week as well. talk about these, cases still publicly considering of course now this ask for? >> i think, as a criminal defense lawyer, the rule of thumb that i think pretty much everyone follows, every cases, don't let your client be talking to the press. don't let your client be opining about the case. or the prosecutors, or the judge for the witnesses, or anything else. i think that, as i said, this strategy has stuff -- inside the courtroom. playing to his base and public opinion. i think that i don't know the extent to which his lawyers are having influence over him.

general motors right now. on day two of the strike. some 13,000 workers across the midwest are on the picket line, it happened after leaders could not bridge the gap between union demands and contract talks. and what detroit three automakers are willing to pay. 20, now msnbc's check -- from where the picket lines in toledo, ohio. shaq, good to talk to you. currently, only a fraction of uaw's ranks are excellent strike. what is the latest on these negotiations that we're hearing right now? >> right, currently, only a fraction. about 13,000 of these auto workers on strike. although, we did learn from 40 yesterday about 800 autoworkers, non striking workers, we're going to be laid off. gm previewing. that one of their plants with some of their 2000 workers, potentially, could be laid off, if the strike continues. and if they start feeling the effects. as far as those negotiations. yes, pretty good news from the uaw. saying that at least in their conversations with ford, only

one of the big three automakers, that they have reasonably productive conversations. it depends, you have to really dig into. that that's not a deal you have to see what that ultimately, it remains to be seen with that ultimate really means. we know the sticking points in this negotiations. of, course the uaw asking for a significant pay increases. going in at 40%. i'll tell, you maybe people don't expect it to land a 40%. but they want significant pay increases. they want better work life balance. an end to this temporary worker status that allows people doing the same job to get different levels of pay. also, improves retirement benefits. i want you to listen to one of my conversations with one of these auto workers who are out here, presenting to him essentially a deal that we know has been offered, in terms of the pay increases, by the big three auto companies. listen to a bit of that conversation. >> the latest offers from the automakers it's been about a 20% raise, over the course of four years. why is that not enough? >> that's terrible.

i, mean we haven't had raised in 13 years. so, that's terrible. come on. they're getting paid money. their macon raises. they're getting 40%. why can't we get. we deserve it. >> we did also learn a little bit more today about the last offer from -- this is a rejected offer, he said that before the strike even began. we do know that they offered about a 21% increase over the course of four years. including a 10% increase in that first year. that's a little bit of a conversation that we were having. listen, the automakers are saying that an automaker, they're saying that, at this, point they can't sustain, and they can't meet the demands and the -- can't afford to have 46% increase. they can't perform.

absolutely ridiculous, he has been. what just went on over the last two, hours of the last two weeks. this is an absolute political response, in a political reaction by republicans. rather than to seek justice, rather than to see the evidence that we all saw in the public for the last two weeks, the fact that this man was bribed by a developer, was given over $120,000 and house renovations. it was only until the day that he got caught that he decided to pay him. we had that same developer paid for his girlfriend to have a job. so many things that transpired in this process. fired seven, highly conservative republicans whistleblowers, just ridiculous where we are in texas today, yasmin. >> when you hear that the state attorney general is going to be targeting republicans that voted against him, i believe there were two, how does that make you react?

what do you expect those targets to look like from this state attorney general? >> yasmin, they've already made these threats against the 60 or so republicans in the house of representatives, and these two republicans of good conscience. look, the rest of the world saw this in black and white, and in full color, quite frankly, yasmin. we saw all of the evidence that was presented to us. and what we saw was crystal clear, that ken paxton was bought off, he was coerced, he conspired to steal government resources, to give this man confidential fbi information. that man has now under eight counts of a federal indictment, has been arrested two months ago. where we are, and what we saw was crystal clear, for every buddy but the other 18 or so republicans and that chose, 16 rather, republicans that chose to make a different decision. to those two that were full of

integrity, and made the right decision, i commend them, i commend them. as far as this man targeting these folks, he can do whatever he wants, i imagine he's going to be busy with the fbi in the next several weeks, i hope. >> senator guterres, have you had an opportunity to speak to those two colleagues of yours, who voted in favor of impeaching the state attorney general? >> they fought very hard yesterday, a -- there is actually more people that were on their side. but then, they started making political calculations, realizing that they would not be an office, in the very highly ultra far-right conservative districts. but this is bigger than that. we should have integrity when we come in. when we take our oath of office, it is to uphold the law. what happened here wasn't a toss-up, this was an easy thank -- every one of these republicans saw this evidence, the evidence that you saw for the last two weeks. they should have all voted for

conviction. but, they made the political choice, or rather the expedient choice, rather than the hard decisions. and sometimes, you have to risk the consequences, when it's about integrity, when it's about justice. clearly, there was no justice in texas today, yasmin. >> correct me if i'm wrong, but it was republicans, obviously house republicans as, well that were being very outspoken about the impending possible impeachment of the state attorney general. and so, now that he has in fact been acquitted, is there a possible fracture within the republican party, and the legislature there in texas, that democrats can seize on? >> he hasn't, the evidence against this man was so great that about 60 republicans in the house of representatives chose to impeach him. they saw that evidence, just like we all did, and they presented over several thousand documents to the senate. the two members in the senate

i want to turn now to the president, into department of justice's case against his son. we have new comments from white house press secretary kareen jean-pierre, who promised president biden would not pardon his son, should he be convicted on any of those can relate to charges filed this week. to talk more about this, i want to bring in emits -- to -- as well. monika, i just mentioned some of the comments coming out of the white house, do we know where they're stand on the sting. what else can you talk to us about, when it comes to the case against the president's son, hunter biden?

>> well for sometime now, the white house was bracing for this indictment. we knew there was news that likely, he would be charged by the end of this month. so when this actually happened this week, it came didn't come as a major surprise to the white house. but of course, the other huge development and story this week, politically, that also involves hunter biden, is the opening of this impeachment inquiry into president biden, where house republicans are trying to make some kind of a linkage between hunter biden's business dealings and his father, which so, far they have not been able to provide any evidence for. so the white house has really been going on offense, when it comes to that matter. they have an entire war room responding all of the time, to the gop. but when it comes specifically to hunter biden's own legal, issues and the special counsel, they aren't going to comment or weigh in on that at all, because of course they want to continue to talk about this independence that the white house has from the department of justice. instead, they are referring to

hunter biden's personal attorneys, in statements like the one you see on your screen now, which they say again, they believe that these allegations are baseless. but i can tell you from conversations that i've had with sources who are close to the president, and my colleagues and i have been reporting on this, that this is certainly taking an emotional toll on the president, who approaches these really sensitive family matter is as a father first, which you can imagine. and so in terms of trying to get his messaging, his agenda, the legislation he has worked hard to pass, getting all of that front and center is still the priority, but then of course there are these other issues that are weighing on him quite heavily, we understand, yasmin. >> monika for, us thank you -- let's dig into some of this. first and foremost, what are we hearing from hunter biden's attorneys, essentially is that this is all going to be settled, and it's going to be dismissed essentially before trial. now, we know that there is a plea deal about six or so weeks ago, that basically blew up.

could that be the case? could this be, in fact, dismissed before trial? >> so, i don't think it will be dismissed by the court. it could theoretically be dismissed by the prosecutor, although i think under these circumstances, that is unlikely, in the absence of a guilty plea. this is a very unusual charge, i was a federal prosecutor for quite a few years, and i've never once seen this particular statute indicted as a stand-alone felony violation. it's quite unusual. i think that it's surprising that it wasn't resolved before the stage we are now, and it may still be resolved. >> so let me read from you a statement from biden's attorneys, hunter biden's attorneys, i should say, i want to be specific about that. they are writing this, as expected, prosecutors filed charges today, that they -- just six weeks ago, following a five-year investigation into this case. the evidence in this matter has

not changed, in the last six weeks, but the law has. and, so has maga republicans improper, and partisan interference in this process. >> does he have a point here? >> i think he has a point, in that he is correct that this statute is rarely charged by itself. honestly, i've never seen a charge by itself, for somebody who is a drug user, who had a gun, and didn't use the gun, and there was no other conduct that was included in the indictment. i also don't, i don't know the extent to which it is politically motivated, and i don't want to comment on the intentions of the special counsel. but i do think that this is a very unusual, case and i have to be a part of the reason why he got indicted is because his last name is biden. >> why is this such an unusual charge? can you talk more about that? >> sure. so, most gun cases are brought

when people actually use their guns, for some sort of violence, or in connection with drug trafficking, or some other conduct. it is very unusual to see a charge where a person is accused of lying on a form, to possess a gun that they never used. so, that is just an unusual situation. >> all right, leslie caldwell forest, thank you leslie, and thank you for sticking with us, we appreciate it. all right, a stunning verdict in a michigan courtroom, three men accused of aiding in the plot to kidnap michigan governor gretchen whitmer, acquitted by a jury. eric -- and twin brothers michael and -- william were the last of the 14 men charged in the 2020 plot. nine have been convicted. the men were all members of a group with anti government beliefs, and militia ties, who are upset over which mueller's covid restrictions. prosecutors say the group connected meetings, spoke in code, ran gonna drills, and even drove around winners property a couple of times. a -- both took the stand in their

thrashing part so the coast of new england and canada, i should say, as a post-tropical cyclone's expected lake landfall this afternoon in nova scotia. some areas are seeing 80 mile an hour winds. the president, approving a state of emergency for massachusetts, with cape cod and martha's vineyard along this path. -- more than 95,000 customers are without power right now. -- is in bar harbor maine for us. marissa, what are you seeing? >> hey there well, i can tell you right now, not much has changed,. even since we've been here this morning. so, just to point out, you can probably see the choppy waters behind me. over here, we saw people trying to walk out and see the waves thrashing against the rocky beach. as you can tell by the cones here, they have since, and by, they emil police here, the local police have closed off quite a bit here. they've closed off not just a bunch of walkways, they've also

closed the pier. this was a popular place to, be we were here all day yesterday. now, this whole pier has closed for several reasons. one, they were worried about those waves, as this water has gotten consistently higher throughout the day. they were worried about these waves rocking over the seawall, which has taken damage before, with previous storms. and then, we also have, there is a top over, there you cannot see, that but it is broken, it's damaged from already what we've seen today. and then furthermore, something else that has been interesting. we talk about the local economy, lobster men. this is a huge part of the local economy. we spoke to lobster men about what this storm means to them. because you know, this is an area that used to nor'easters, that used to powerful storms. but yesterday, we are watching as they were making their final deliveries, all the precautions they were taken to make sure that their livelihood stays intact, after the storm passes. take a listen. >> so, what's the biggest concern for you, as a lobster man? >> well, just the -- law --

we see what we do have. >> what are you seeing, other lobster men and fishermen doing differently right now? >> they're just moving their traps on to the shore. because of -- a lot of them. and overall, at this harbor, they are all -- but i'm not doing that. >> with so, i want to point out a couple of things. behind me, this is normally, on a september saturday, this is normally filled with boats. i mean, i am told sometimes upwards of 100 boats at anytime. you can see that most of them have fled for safer waters. now, we were here when lobster man found out that one of their boats had, unfortunately, taken damage. so they tried to take, they call it a skiff, it looks like a dinghy. they tried to take that out to rescue their boat. and unfortunately, they couldn't get far enough, they have to turn back, because the water was just too dangerous. and you know, it's really unfortunate, because that really is truly their livelihood, -- but the, other thing to point out, before i let you go here is, it's not just the waters,

automakers are actually willing to pay. i want to bring in charles wave, he is a uaw member out of michigan, where he works on the final assembly teen. charles, thanks for joining us on this, appreciate it. so, let me talk about some of your demands. you guys want increased wages, increase pay, right. you want to make more money. you want reduced work weeks, and you want a shift back to traditional tension. what does your work week, right now look like? >> right now, our work week is we are barely getting 40 hours, because of a lot of issues, i guess, with parts and engineering, with the bronco and the rangers. >> and, what about wages? how much of an increase are you asking for, percentage wise? >> i do believe we were asking for 46%. i don't quite know where the negotiations are going. reno >> got it. so, you have folks watching, at home, wondering your story, and wondering what it is you guys

are really aiming for. you have the floor charles, tell them? >> well, we are trying to set the new american standard -- and get our middle class back. our economy has been stagnant for so many years, and it's because the middle class has been stagnant, as far as their wages. 46% we are asking for is literally just the 20 years of losses that we have taken. we are just asking for back. this is money that we should already have. >> when asked about her 30 million dollar salary, on top of the ceo of general motors, mary -- she said that 92% of her compensation was based on the performance of the company. what is your reaction to that, and why this negotiation is such an uphill battle, when individuals like her making so much money? >> i'm appalled, because she makes that money off of the backs of the labor, the union, the uaw.

to say something like that, is -- just like saying, i don't know what kind of work she is doing up there. i would love to request for her to come work on -- for a couple of years, tell me if she might change her stance. >> you talk about the economy being stagnant, you talked about a return of the middle class. i'm wondering, for you specifically charles, what would it mean for you, to have an increase of your salary, and a better work life balance? >> it would mean a better future for my family, and that's what we do this for, it's about feeding our kids, maybe going through college, maybe going on a couple of vacations, or basketball game, a football game. it's about just living comfortably. we used to be middle class, now we are just pour. when we are slushy the ones who drive the economy, we are the consumers. and if we get this, money it's not like we're not going to spend a little more. maybe we would actually able to -- >> even with this, because of the point that you are, making

and what you want to get out of it, how difficult is it to actually go through a strike like? this >> extremely difficult. there is people that are living week to week, and there is people with three, four, maybe five kids, maybe even just one kid. a lot of single women, single moms. and whether it be single dads as well, they need the time, they have to work overtime just to support their family. that's how our wages are, we need the overtime. 40 hours a week will cut it anymore. and, that's all i've got to say. >> how long do you think you can hold out? how long do you think all of the striking workers can actually hold out, if that is their current predicament? >> i don't know how long everybody can. but i think most of us are willing to -- three 65, seven days, 24 hours a day, just to make sure that we see that we can make a good enough living to provide for our families. we don't want to be on strike,
