good day, i'm chris jansing live at msnbc headquarters in new york city. one of the most powerful senators in washington now accused of taking bribes including cash, a mercedes benz, and bars of gold. but in a defiant rebuke to today's federal indictment, senator robert menendez says prosecutors are out to get him. he claims what prosecutors describe as crimes are actually a misrepresentation of a normal day's work in washington. plus, congressional lawmakers all but resigned to a government shutdown now with just eight days to find a deal to keep the lights on, the republican speaker of the house tells members to take the next four days off. we'll get you the latest from capitol hill coming up. and a 911 call like you've probably never heard before. the caller saying i guess we've got a pilot in our house, and he says he got ejected. what we're learning about that fighter jet that flew 60 miles without a pilot before crashing.

but we start with the stunning indictment of new jersey democratic senator bob menendez. in a detailed indictment, prosecutors say he leveraged his vast power and influence as a 30-year veteran of congress and especially his position atop the senate foreign relations committee to benefit, among others, the egyptian government. all in exchange for hundreds of thousands of dollars in cash, gold bars and other gifts allegedly linked to the three new jersey businessmen also named in the indictment and discovered during an fbi raid on menendez's home. >> when they got there, they discovered approximately $500,000 of cash stuffed into envelopes in closets. some of the cash was stuffed in the senator's jacket pockets. some of the cash, some of the envelopes of cash contained fingerprints and dna. >> reporter: the indictment charges senator menendez, his

wife and three others with bribery and extortion stretching back at least five years. the indictment includes charges that the senator approved weapons sales to egypt, tried to pressure the usda and engineered the appointment of a u.s. attorney. the senator quickly issued a defitatement against what he called baseless legations. quote, for years forces behind the scenes have repeatedly attempted to silence my voice and dig my political grave. since this investigation was leaked nearly a year ago, there has been an active smear campaign of anonymous sources and innuendos to create an air of impropriety where none exists. ken dilanian has been following all of these governments. also with me former federal prosecutor and msnbc legal analyst, carol lam and "washington post" national reporter and msnbc contributor carol leonnig. good to have all of you here. this indictment reads, it's extraordinary, ken. it's also a dangerous story, right, of what prosecutors say

happens when you take power and you use it in exchange to get goods. tell us more about what this indictment is and says. >> yeah, that's well put, chris. this is a 39-page speaking indictment that is almost cinematic in its details. i should say upfront, in addition to senator menendez his wife and the other co-defendants say they will fight these charges. they are of course entitled to the presumption of innocence. this indictment lays out a sprawling bribery conspiracy that has implication for u.s. foreign policy. it says menendez helped those three men in a series of official acts in exchange for cash, gold bars, a mercedes convertible furniture, exercise equipment and even an air purifier. the conduct began in 2018 after a jury failed to convict him in a separate and unrelated, they searched his home and found over

$480,000 of cash. much stuffed into envelope sps and hidden in a closet. it says he did that to help a businessman get an exclusive contract with the egyptian government in exchange for bribes. there are implications for the u.s. government relationship with one of its biggest recipients of military aid. and as an example of that alleged corruption, the indictment says that nadine menendez texted an egyptian official in march 2020 saying anytime you need anything, you have my number, and we will make it happen. the government of egypt -- excuse me, in addition to the egypt situation, the indictment alleges that menendez intervened in two separate criminal cases on behalf of two other new jersey businessmen who paid him bribes. we all know that the supreme court has made it more difficult for federal prosecutors to prove political corruption in recent years. they have to explicitly link the illegal gifts with specific

acts. as one former prosecutor said to me on the phone just now, it's really tough to defend a case involving gold bars, a mercedes benz and cash, chris. >> yeah, ife can in the control room put those pictures back up. they essentially did a show and tell whenhey had this press conference. ther you see money on top of a shirt or a jacket. you see the car. you see the gold bars. carol, all of that contrasted to what they say senator menendez did. he leveraged his senate leadership position in ways that really do bring to mind concerns about national security. i want to play exactly what the u.s. attorney had to say about all of this. >> the indictment alleges that senator menendez used his power and influence, including his leadership role on the senate foreign relations committee to benefit the government of egypt in various ways. among other actions, senator menendez allegedly provided

sensitive, non-public u.s. government information to egyptian officials and otherwise took steps to secretly aid the government of egypt. >> conversely, carol lam, what senator menendez said is what he did is all in a day's work in washington. tell us how you with your legal eye read this indictment. >> chris, clearly it's not in the everyday work of a senator. i think that if you were to read this indictment, each allegation more astonishing than the last. you have a situation where apparently senator menendez at the behest of his wife ghost wrote a letter for the egyptian government to send to the senator's colleagues in the senate urging them to lift a $300 million hold on aid to egypt. it's such a betrayal of his colleagues and the senate and the nation. there's -- the indictment is stunning not only in terms of

the allegations and the illustrations as ken put it cinematic in terms of what the bribes were, but also the strength of the evidence from a former prosecutor's eye, this is an extremely strong case. you have not only the nature of the bribes, but also the consequences of the bribes and although, yes, there has been some pulling back on the use of the statute, this is going to survive any challenge to that because of the nature of the crimes, and then of course you have the cover-ups. you have the deletion of texts and emails by both the senator and his wife, and the interference, the attempted interference with prosecutions of these -- of the egyptians who were friends with the senator's wife. it's just -- it's just stunning in its scope and breadth. >> for people, carol, who don't understand the inner workings of carol leonnig, we have two

carols here, of washington, help us put this into context, both the power of someone who sits as chair of the foreign relations committee and the amount of control, the amount of money, the amount of influence that comes along with that position. >> chris, it's a ton of power, but there's a ton of protection. i think what's most interesting about this charge, this conspiracy that is alleged today and this morning by the u.s. attorney is that there has to be such a high bar for this group to bring this case, especially because bob menendez was charged with very similar, although not as extensive, very similar acts in helping a friend who was a very wealthy ophthalmologist, helping him with keeping an incredible business in the caribbean, helping him and using

his role to avoid some tax problems that the ophthalmologist was facing, and health care fraud allegations. in that case menendez was basically accused of using his powerful position to help a person with a ton of money who just so happened to also be giving some of that money in donations to bob menendez's campaign. the charges failed ultimately. there was a locked jury, deadlocked jury and a mistrial, and he was acquitted of those charges. but the government knows who they're dealing with here, and the government knows what the bar is that they have to reach, and in this case, they're not dealing with a long-term friend of bob menendez as they were with the ophthalmologist. in this case they're dealing with some new jersey businessmen, and in this case the new jersey businessmen

aren't donating to bob menendez's campaign, which is allowed. apparently their dna is on stacks of cash hidden in the senator's closet, and also sitting in his driveway in the form of a car that was paid for. so it's pretty amazing. i want to stress, again, both the power that a senator with the kind of standing that menendez has, no government prosecutor is going to come for him after losing a case in 2016 and the fact that he's a senator who's allowed to take all sort s of steps in his daily job to help people, to twist arms, to help local businesses, to help constituent, he's allowed to do all of that. but no government prosecutor is going to come for him with this kind of protection that he has to do his job unless they have

stunning evidence of something else more nefarious behind the scenes. and i think as ken and carol point out, the cinematic detail and the stacks of cash are really sort of compelling pieces of evidence in this set of charges. >> and then that brings me, carol lam, to intent, and one thing we haven't mentioned and this they don't show in those pictures are thousands of text messages sent and received by senator menendez's wife. is there any light between what she may have done in terms of her communications and the senator himself? >> so the prosecutors in a sense were fortunate here because although the senator himself was fairly circumspect in terms of his own communications, his wife was not. his wife whom i believe he began dating in 2018 after the hung

jury in his prior case and immediately began communications with her friends who are now also co-conspirators saying i'm now dating the senator. here are things that we can do. it's really a sign that she was sort of no holds barred with respect to her communication. evidence of intent can be what we call both direct and circumstantial. in this case we have certainly a lot of direct evidence of her intent, but she also involves her husband in those communications, and again, we have evidence or the prosecution has evidence that the senator deleted texts and emails that were incriminating to him that the prosecution was able to get then either from his wife's cell phone or from the carrier, the cell phone carrier. so you know, in this day and age, it's very, very hard to destroy all evidence and despite his best intent, his best

efforts, the senator was not able to do that. >> we only have a minute left, ken, but we heard the u.s. attorney say this investigation is very much ongoing. where does it go from here? >> he made a direct appeal that if anybody has information to please call. that's how i read that. they lost a case against the senator back in 2017, and they know that you cannot have enough evidence when you're trying to convict a u.s. senator. so they are continuing to investigate and i'm sure they hope they can cut deals with one or more of these co-defendants to testify against senator menendez. >> ken dilanian, carol lam and carol leonnig, great conversation and we thank you all. we're back in 60 seconds with the political fallout from the senator's indictment and why it could put democrats in a bind as the race for the white house heats up. happened even before prosecutors held the press conference announcing it. a source close to menendez says he will step down as chair of the foreign relations committee. one of the most powerful positions in washington, and while that is required under caucus rules, the open question is whether menendez can stay in the senate all together. with control of the senate up for grabs, there is very little wiggle room for senate leader chuck schumer to risk what should be a safely democratic seat. government watchdog group citizens for responsibility and ethics in washington is calling for menendez to resign. that would allow the democratic governor of new jersey to appoint a replacement. stuart stevens was the chief stat gist for mitt romney's 2012 campaign and a senior adviser for the lincoln project. nbc's steve kornacki joins me here. you spent three and a half years covering new jersey politics. last time senator menendez was indicted, a lot of folks had his back including his fellow senator cory booker. is there anything from that we

can learn about how they might respond now? what are you hearing? >> yeah, i mean, so far i'm hearing nothing. now, it's only been a few hours since the indictment was announced. that is the key question politically here. cory booker, his fellow senator in new jersey who not only stood behind him at the beginning on the first day of menendez's trial several years ago, booker made a show of going to the courthouse and sitting in the front row right behind menendez to show that level of support. governor phil murphy, nothing from him yet. the state democratic chairman, nothing from him yet. i saw congressman josh gottheimer was on last hour, he said i'll get back to you on that. nothing from him yet. a lot of decisions within the democratic party in new jersey are made by consensus of county political leaders. they could have a hand in deciding menendez's political fate. nothing from them yet. the key question is those stakeholders in new jersey, they all unanimously stood with bob

menendez the last time he he went through this. they prevented a serious primary challenger in 2018. he had a hung jury months before that election. he was rep remanded but with all the democrat in the state behind him, he had astronomical disapproval numbers on election day, but he beat his republican opponent by 11 points. new jersey wanted nothing to do with donald trump who was president at the time and they would rather have voted for me menendez. you look at the time line, this trial seems like it's likely to drag on through the election campaign next year. if he's intent on running, the first question is do democratic leaders in new jersey have his back the way they did last time? so far we have no indication of that. >> you've got to imagine those conversations have already started. >> yeah, and i am dying to know somebody like cory booker, phil

murphy, what they say. that will set the tone here. even if they stand behind him, even if there's an initial wave of support for menendez, i think there's a possibility. there are some ambitious democrats in new jersey, especially in that congressional delegation who look back at '18 because somebody did get on the primary ballot against menendez in '18. she was unknown, she had no money, she had no party support. she was just a name on the ballot. she got nearly 40% in that primary. >> that's an astonishing number given those circumstances. >> new jersey democrats didn't want to vote for bob menendez. in the end they would vote for the democrat over the republican. i think the ambitious democrats, even if there are statements of support, i would not be surprise if one or two members got in the primary. >> we mentioned thatenendez vehemently denied the charges. the excesses of these

prosecutors is apparent. they have misrepresented the normal work of a congressional office. does he have the right to stay whatever the stakes, or would you not be surprised if there was some pressure on him to, frankly, step down and let the democratic governor, let the party put somebody in place who then may have an easy path to make sure that new jersey has no problems with that democratic seat? >> yeah, look, this is an episode out of "the sopranos." this guy should resign. he should resign by the weekend, and every democrat in new jersey and every democrat in the senate and house should call upon him to resign. you can't defend this. there should be a senate ethics committee investigation, which has a much lower burden of proof than a criminal charge. in january 2025, it's hard to imagine this guy is going to be a united states senator. the choice of democrats is are

you going to stand by what you believe. this guy is obviously corrupt. nobody has bars of gold lying around and half a million dollars of cash stuffed around their house. or are you going to elect a republican? and the republican party could very well get themselves together and nominate a candidate who's a decent person, and they could win this seat. what he's saying now just plays into the hands of every republican who says there's a politically charged agenda to get donald trump. it's an attack on the rule of law and democrats should not guilty -- should not stand for it. >> that is what democrats are facing. if you stand up and say you have got to believe in the justice system, you have got to believe in the rule of law whether it's george santos or donald trump, what do you say when it's somebody in your own party? >> there's only one thing you can say. we believe what we believe and

no man is above the law. if you say that about donald trump and you don't say it about me menendez, how do you have any krebltd credibility? this is clear cut. it should not be a difficult choice. there are a lot of chummy relationships, but cory booker has got to stand up and call out that this guy needs to resign. >> so if the possibility exists that the republicans could get their act together as stuart says, mount somebody who could be a no name and put money behind it, could this see be up for grabs? we know that control of the senate is up for grabs in 2024. >> i think the only chance republicans would have at this seat is if menendez does end up the democratic nominee in 2024. even then, remember, in 2018 bob menendez had been indicted, charged, tried and was a hung

jury. he was severely reprimanded. menendez beat him in a landslide despite the fact the overwhelming majority of new jerseyans did not like or trust bob menendez. there is a lot that can happen. if menendez happens to be the democratic nominee and if donald trump facing these charges and indictments is the republican nominee for president, i think it's a very open possibility the voters of new jersey, a deeply blue state that deeply dislikes donald trump ends up saying we're going to votes for menendez because we dislike the republican party more. i think the political threat to bob menendez is on the democratic side. it's within his own party. the question is as stuart is saying, what will his party say here. in 2015 his party said menendez 2018, we're all on board. are they going to say menendez 24, we're still on board today.

. with no plan to keep the government's lights on beyond next saturday, house speaker kevin mccarthy has sent the house home for a long weekend with very little prospect of a deal. he just said in the last couple of hours that he's hopeful there can be a vote on tuesday. but across washington, federal agencies are being notified to prepare for what would be the fourth shutdown in the last six years. it's a level of dysfunction so deep some house republicans are openly questioning whether their own colleagues even understand how congress works. >> this would be a meaningless shutdown if it were to occur absolutely impact people's lives.

we need to make certain we keep the government open and get this deal done. >> we are completely dysfunctional. >> there needs to be a realization that you're not going to get everything you want, and just throwing a temper tantrum and stomping your feet, frankly, not only is it wrong, it's just pathetic. >> i want to bring in nbc's senior national political reporter sahil kapur and stuart stevens is back with us. sahil, where do things exactly stand right now? >> reporter: things are in a bad place on capitol hill as far as this debate goes. don't take it from me, take it from the republicans you just heard. any lingering optimism about averting a shutdown has faded and the question has become how is congress going to reopen the government after what appears to be an all but inevitable shutdown. the house failed for the second time to debate an appropriations bill. you have this situation where speaker mccarthy is dealing with a small minority of his small majority that wants to dictate policy for the entirety of

washington and the country, even though they don't have the votes in the senate and certainly not a willing president who's -- you know, who's going to sign their bills. nevertheless, after mccarthy adjourned the house yesterday for a long weekend, his leadership team reconvened, tried to negotiate with some of these hard right members who are holding out in terms of finding a path forward on appropriations. let's play what mccarthy said a little earlier. >> i think we've made some progress to those who have been holding up passing the rule to get onto these bills. we wanted to do it individually rules but i guess we'd do like a mini bus rule. we've got rules that will go in today. we've got members working and hopefully we'll be able to move forward on tuesday to pass these bills. i still believe if you shut down, you're in a weaker position. you need the time to fund the government while you pass all the appropriation bills. >> reporter: look, chris, let's take the optimistic view for a

minute. let's say mccarthy is able to pass appropriation bills. these are republican messaging bills that have no shot of getting through the senate, much less getting a presidential signature. they're fighting over what their opening bid should be to start negotiations with the senate, and that's where the real compromises would begin. that's where things get even more painful for speaker mccarthy in trying to tame his far right. the only foreseeable path forward in the near-term while these negotiations happen is a short-term bill, a continuing resolution, and there mccarthy is dealing with the same far right members who say no short-term funding bill under any circumstances. he's really in a vice here, and the question is likely going to be how much is he willing to risk as this persists, is he willing to potentially risk his gavel? some of these members are going to attempt to overthrow him. is he going to make a move, ultimately deal with democrats to pass a law that risk that happening? that's one of the biggest questions here and his path going forward is very, very

murky, chris. >> reporter:. >> yeah, stuart, vice is a painfully evocative word after that embarrassing defeat of the stopgap spending bill, matt gaetz stepped in and here's what he said last night. >> the house has really abandoned the mccarthy cr strategy today and has embraceds matt gaetz strategy of single subject spending bills. that's to the credit of some of the moderates who i think wised up and said, well, if we're going to go into a shutdown, let's at least lay out what our priorities are. i feel more productive today than i did yesterday when my soul goal was to kill governing by continuing resolution. i think we've got that pretty well buried six feet under for now. >> stuart, who's running the show here? >> nobody's running the show. you know, this is sort of an interesting test of who is more interested in what they were elected to do, which is govern. i don't think there's any question that politically there's a government shutdown, that president biden and the

democrats are going to win. they're arguing about something that really doesn't mean anything to anybody in their daily lives which is the federal deficit, which is why we have a federal deficit versus things that affect people like paychecks and the military. look at matt gaetz, i mean, is this really an appealing guy? if you're a party, do you really want matt gaetz to be -- and marjorie taylor greene to be out there as the figure heads of your party? and part of what president biden is selling is confidence, calmness, government that you don't have to wake up every day and think about, which is supposed to be one of the great benefits of a civil society, and this sort of inside nonsense and nastiness of the republicans, i just don't think appeals to anybody. nobody understands it, and nobody is going to support these people who is any kind of swing voter. >> let's see what happens on tuesday, stuart stevens, sahil

right now, and donald trump's lawyers want a new york judge to throw out most or all of the fraud case just ten days before a scheduled trial. new york attorney general letitia james accuses mr. trump's business of massive financial fraud that could block the company and its executives from doing business in his long-time base of operations, new york. i want to bring in "new york times" investigative reporter suzanne craig. you were inside that courtroom today. what can you tell us about what happened? >> reporter: you hit it, this trial is starting in a week, just over a week, and there's so much legal wrangling going on right now. when we were in court today for sort of two different pieces, one is there's two motions for what they call partial summary judgment. each side is asking that this case almost just be tossed out for either side. the attorney general is saying that the fraud was so massive that we don't even really need a trial. they're saying that he so over

valued his assets in order to get bank loans and favorable terms from insurance companies that we can just have a ruling on that. trump is saying, hang on, there's not even really any fraud here. all these statements that were submitted to banks had so many caveats on it that it just didn't matter. the really important thing that was playing out and happened right before i left court was just exactly the scope of this trial and what can be included, and that starts at what date should it include. there's been a court decision, an upper court decision about this that trump's team feels very much should narrow the scope, which would leave the attorney general's case really narrowed if they just said, okay, only transactions from instead of maybe 2006, they start in 2018 or roughly around that period. and the attorney general is saying, hang on, maybe some of the initial behavior happened in 2016, but it continued on, and he continued to submit bank

statements so that is all fair game. and they're wrangling over it. it means a lot for both sides, and i would expect the judge said he should have a ruling by tuesday on that. and then separately, trump, he's already suing the judge to get a favorable opinion in the upper court even before this judge rules. there's just a lot of moving pieces, one week before a massive trial in new york. >> this is one that we haven't talked about nearly as much obviously as the other legal challenges, right, that donald trump is facing? you know the former president's business dealings and finances better than just about any other reporter. so help folks understand what the real world stakes are for the former president at this trial. and it has been largely overshadowed. >> reporter: i got to tell you, if this was any other president and it was a trial like this, a civil trial involving allegations of massive fraud against his businesses, it would be front page news every day. it just happens that this trial

in just about an hour, the white house will unveil a new tool to help fight gun violence that advocates, including the brady group, call a huge deal. president biden will announce the first ever white house office of gun violence prevention. vice president kamala harris is taking the leads, connecting with students on a college tour, meeting with a rapper whose nephew was shot and killed last year. so far this year more than 31,000 americans have been killed by guns. there have been more than 500 mass shootings in the u.s. according to the gun violence archive. joining us now stephanie feldman, policy adviser to president biden, who will be director of the office of gun

violence prevention at the white house. thank you, stephanie, for joining us. this is such a huge and persistent problem, so what will the work of this office look like? >> so president biden has already made historic progress to reduce gun violence, but he will be the first to say that it's not nearly enough, which is why he is creating this platform to accelerate his policies in four key ways. first, we're going to be fully implementing the bipartisan safer communities act, which is the gun safety legislation he signed last year and the dozens of executive a he's already announced. second, he's asked us to dig deep, be creative to find ways within existing law that we can take additional executive action to reduce gun violence. third, he's violence. third, he's asking us to enhance our partnerships with cities and states, for example, some cities and states are passing laws that allow gun manufacturers to be sued and held liable for their products. and we will be convening other states to help pass similar

laws, and fourth, he's asked us to coordinate support for survivors and communities impacted by mass shootings. if a hurricane devastates a community, we have fema. if a mass shooting devastates a community, we need coordinated support to deal with the economic, physical consequences. >> mass shootings, school shootings, shootings involving teenagers, the numbers are deeply disturbing. so in a situation like that, are you at the point where you can say now what exactly you would be able to do to help communities, to help a school, to help a town or a city? >> yeah, so this office is the launch of a lot of work ahead. and really shows the direction that the president wants to be headed. as i said, we have made a lot of progress. we have put historic amounts of mental health funding to help young people deal with the grief and trauma dealing with gun violence. we have put funding into the streets for community violence

interventions. the president is saying that's not enough. he wants to do more. he's setting up an office to drive this work faster and more effectively. >> do we know who's going to be involved? obviously this is something that you know that the white house is able to do but are there solution-oriented republican voices who will work with you to broaden more support for action. is there an idea that this could go beyond what happens within this office, that it could set the stage for perhaps some legislative action in the future? >> that is absolutely the goal. the president and the vice president are going to continue to call for congress to act. we did pass some bipartisan gun safety legislation that we are working to build on. we are also looking for republicans and democrats in states all across the country to drive this progress forward. at kitchen tables across the country, this is not a partisan issue. people do not want to live with the constant anxiety of gun violence. the president is bringing us together to push forward an

agenda and work across the aisle to advance additional action to save lives. >> we have a minute left. i want to show a number of headlines this week alone, cases involving teens, many who are victims of gun violence, some with teens being the ones who are firing the weapons. firearms are the top cause of death for children and teenagers in the u.s. how big of a focus will this be for this new office? >> yeah, absolutely a tremendous focus. the president thinks it is unacceptable that the guns are the number one killer of children across the country. he has spent his career fighting for common sense gun safety laws. he has succeeded many times. in 1994 he helped secure one of the first major pieces of gun legislation, the assault weapons ban, and he wants to do it again. he meets with survivors of gun violence all across the country. often he's spending hours with them out of the public eye. he mourns with them, he grieves with them, and he hears their call to action that we need to do more, and he's going to help lead the way. >> stephanie feldman, thank you
