who's also been on the picket, line joins me live to discuss that and more. seven days to shutdown. speaker, kevin mccarthy, sends the house home for the weekend with no plan on how to fund the government. we will take a closer look at the chaos in the republican caucus and how it could cost us all. supreme controversy, new ethical questions about supreme court justice, clarence thomas, after a bombshell report on his ties to the powerful and ultraconservative koch brothers network are big. good morning, katie phang is off today, i'm jonathan capehart. this is a two hour edition of the saturday show. we two big moves that the united auto workers strike against the big three car giants. now entering its second week.

president biden said yesterday he will head to michigan on tuesday to join the picket line and stand in solidarity with the men and women of the uaw. it will occur one day before a planned visit to the state by donald trump. biden's announcement came after uaw president, john fain, made an announcement of his own. the union walkout has expanded to include 38 parts and distribution centers operated by general motors and stellantis. famed says ford is being spared because that automaker has met some of the unions demands during negotiations over the past week. nbc news correspondent, jesse, kershaw is live from pontiac, michigan. jesse? >> hey, jonathan. good morning. what we're looking at here is a divergence of how three companies are being handled. the uaw had said that it would expand its strike if it had not seen what it refers to a substantial progress from the big three automakers in those

negotiations. well, they feel they have gotten that from ford. so while it expanded its ranking to gm and stellantis, it did not expand the strike against ford. and the company's responses to the latest action are also telling in how this is playing out. i want to read a portion of statement from gm and stellantis. am says, in part, it is accusing you know leadership of quote, manipulating the bargaining process for their own personal agendas. stellantis writing in quote, we question if the union's leadership has an interest in reaching an agreement of timely manner. ford statement says there's a work to be done, but the union feel there's been more progress made on that front. what we're now seeing unfold is the union specifically targeting parts distribution sites for both gm and stellantis. what does that mean? if you need a car repaired, igm or stellantis vehicle and are trying to get a repair from a dealership, depending on what part you need, that could get more complicated in the days

ahead. i spoke with someone who works with several dealerships in the midwest yesterday, he told me they've been stocking up on higher demand parts. something like a brake pad, but if you need something like an engine replacement, that could be harder to come by as long as this parts distribution strike specifically drags on. that is the latest on the strike front. and the politics of this moment obviously are very much under the microscope. we have president biden expected here on tuesday. just hours, later former president trump is expected in the state of michigan. so a lot to be keeping an eye on here in the days ahead. and we are expecting potentially more ripple effects down the line, john. >> jesse cursed coming to us live from pontiac, michigan. thank you very much for that report. turning now to the looming government shutdown, there are seven calendar days to reach a spending bill. right now the house is only slated to be in session for four of them. and yet, spieth or mccarthy sent members home for the weekend. they come back to the capital

on tuesday. when they do, mccarthy hopes to pass a series of separate long term spending bills. there is one problem. anything that passes out of the republican-controlled house is likely to be rejected from the democratic-controlled senate with an assist from more than a few senate republicans. joining me now, nbc news correspondent, julie tsirkin. julie, thank you for being here this morning. what can we expect to see once the house returns on tuesday? >> if things go according to speaker mccarthy's plan, he told me and other reporters that he wants to bring up a series of appropriations bills about four on tuesday, including a defense bill that went down twice procedurally last week. that's, right a military defense bill that went down among republicans that is telling him how -- the situation is bad. it's not going well for mccarthy or his leadership team that are trying to get those holdouts, the handful of conservatives on board before

the government shuts down in just a couple of days. tuesday is the first time we have potentially -- could see a vote from house republicans. the rules committee basically considers all these dynamics ahead of time, they've been meeting yesterday, they're planning to meet again today. i talk to lawmakers involved last night who told me that this is really still a work in progress to try to shake things loose. of course the conservatives are demanding even more spending cuts than already what was negotiated between speaker mccarthy and president biden. the debt default crisis at the end of may, they are demanding even more cuts to that. they're also demanding the ukraine aid be out even from the defense bill, even from the pentagon budget to train ukrainian soldiers. so this is really a mess on the republican side. we'll see if they can get it together this weekend. >> julia, as you well know, a bunch of bills are supposed to start in the house. what is the likelihood of the senate taking the first step if mccarthy cannot get it out of the house? >> here's the thing, mccarthy

wants to walk and chew gum at the same time, he told. may he wants the house to pass a short term government spending bill to keep the government open. it will close a week from today if they don't do that. but it's not likely that they're gonna be able to pass those appropriation bills in tandem. all 12 of them, by the, way in this deadline. that was republican's biggest negotiating position when they got the majority in the house. mccarthy went over to the senate and told, them we're not going to -- don't try to roll the appropriation bills into one, you're not gonna pass. at your look at the democratic -controlled senate that managed to pass their appropriations bills. they're probably going to start on the sea, are sending the short term government funding bill to the house. house republicans told me last night that if they want to get a conservative deal they have to act first. so again, likely we are inching here are shut down. the problem on the other side is, how do you get out of it? >> nbc news, julie tsirkin, thank you very much for that report. joining me now to t shutdown and the uaw strike is congressman, dan kelly, of

michigan. he's also a member of the house budget committee. thank you very much for coming to the saturday show. we know you've visited the picket lines out of flint processing center in michigan on friday. what did you hear from the workers? >> well, the workers are united, jonathan. thanks for having me on to talk about this. they are united around this principle that they gave a lot -- 14 years, ago when the companies were facing bankruptcy and needed concessions from the workers, those workers gave a lot. now the companies, as predicted, or highly profitable and what they are telling me is that whether bargaining for is simply to get their fair share of the incredible wealth that they generate. and to get back where they were when they made the sacrifice to keep those companies from completely comply saying. there is a lot of new folks out there. younger members who had not been through a strike. much of the conversation i had about the history of our own community and what those past

strikes, the courage that past workers had, what that meant in terms of building the middle class in this country. so it is an important moment for us. >> congressman, as we all, know president biden is joining the picket line on tuesday. two questions, is he doing enough to help with negotiations? how will his presence be welcome? will it be welcome? when >> i think it will be welcome. the fact that he has been very public about the fact that he stands with the workers in this struggle. that is a remarkable statement. i've been through a lot of these strikes in my hometown of flint over the various decades. and i don't recall hearing a president say with such clarity that he stands for square on the side of the workers. they've been responding positively to that. i'm glad the president is coming to michigan to stand with the workers as i have. i think it's an important move and one that, what we don't

have a seat at the bargaining table with, the people of the united states, i as a member of congress, the president as the, president we have a stake in the outcome of these negotiations. he's made that quite clear. >> meanwhile, donald trumpwill hold a rally in michigan on wednesday. the day after president biden is in the state. what impact will that have? >> we it's hard to say. the president, our president, biden, he's coming because he's president of the united states. with former president trump's goal is is hard to say, but i take president trump fans words to be indicative of the way president trump will be seen here. he says he does not need to see the billionaire and millionaire class that were fighting to get our fair share. coming, in interfering with what is going on here. he has the right to his opinion. but he also has to face the scrutiny of his past record. his pack record, president trump,'s is not one of standing

up for workers. and i think that is becoming pretty clear to people. >> congressman, let's talk about the looming government shutdown. it's going to happen, isn't it? >> it sure looks like. it it looks like speaker mccarthy is doing everything he can to make sure the government shuts down. he has it in his power to prevent that. it seems to be unwilling to show the courage it would take to stop a shutdown. just keep in mind, we are arguing now for weeks and weeks about a 30-day extension. and what will be in a 30-day extension. this is insane. rather than just extending spending at the current levels, which almost all of us would support, he is catering to the small group of really deranged members of congress who are insisting there be deep cuts in a 30-day continuing resolution. then we would continue to argue about the long term budget deal.

this is insane. it is just insane. >> so how likely is it then that you will end up voting on a senate generated spending bill because the republican speaker of the house can't get it together to get the budget bill out of the house where they are supposed to? >> it is much more likely that the final product will look like what the senate produces. and we know that, jonathan, because we've already done this once. earlier in the year, we had a big negotiation. it was difficult. it was over the debt ceiling. the idea was, let's make these long term budgetary decisions right now in the context of debt ceiling negotiations. we entered into discussions, over 300 members of the congress voted for that deal. two thirds of republicans voted for the deal. but speaker mccarthy is focused on catering not to two thirds majority of the house, but to 12 or 15 people who will never

vote for whatever the final resolution is. so he needs to stop playing checkers and start playing chess. we look at a mover to down the road, a couple of steps ahead, and he knows the people he's negotiating with right now will not be part of the solution at the end of the day. all of this is interesting. the truth is, a lot of pain will be felt by people around the country if speaker mccarthy's obsession with his own politics continues to be more important than the families that we all represent. they will be harmed by a government shutdown. we know where his priorities lie. >> to that point, and last question because we're already out of time, but i can't let you go without asking you this, one of the big threats hanging over speaker mccarthy's head is a potential motion to vacate being brought to the floor. probably by congressman matt gaetz. would you vote against a motion

speakership of kevin mccarthy could not look any more chaotic and weak, something happens to make it look more chaotic and weak. at the beginning of this, week speaker mccarthy vowed the house would work through the weekend to find a solution to prevent a government shutdown on october 1st. days later, mccarthy sent members home with no votes planned until tuesday. and, not once, but twice, a group of republican hard-liners

taint a defense spending bill from advancing to the floor for a vote. even plans for a continuing resolution, which is a short term funding measure to allow more time to cobble together an actual budget bill, are dead on arrival. according to the new york times, congressman, matt gaetz, there mccarthy nemesis who left pies of a motion to vacate the house ba speaker in a closed-door meeting wednesday, quote, thathd oppose any plant to passthe measure to keep the government om stting down no matter what concessions he makes, they are immovable. mr. gates said with confidence. the house is not only out of order it is in disarray. joining me now is nicholas wu, congressional reporter at politico. nicholas, thank you for coming back to the saturday show and for being on set. i want you to listen to speaker mccarthy venting on thursday

after failing to advance the defense bill for the second time. listen to this. >> it is frustrating in a sense that i don't understand by anybody votes against bringing the idea of having a debate. and you have all the [inaudible] this is a whole new concept of individualism [inaudible] it doesn't work. look, i know it's a lot, but i find it as a challenge, and we will [inaudible] >> okay, why is the speaker surprised that people want to burn the whole place down? >> what we're seeing here is the threats that conservative hard-liners have been making all along. they are becoming real. this is something that the speaker's team really miscalculated as they tried to bring these short term spending bills that were filled with a lot of conservative parties and these longer term spending bills that were filled with conservative priorities to the floor. what they miscalculated was the conservative hard-liners that

they thought they won over would vote for this key procedural vote to actually allow a vote on all of this. but they didn't. with >> some republicans are pushing to move away from short term continuing resolutions, yet they want to pass several spending bills. how realistic is this when votes won't start until tuesday and the government runs out a week from tomorrow? >> i would put the chances of that at very low. given that it's hard enough for congress to advance all these bills in the regular appropriations process when those months to do. it much less so when republicans, hard-line republicans, have dug in against combining all of this into -- you even see how last week went. the idea that mccarthy and his allies would be able to move all these bills through in a week just seems very farfetched. >> okay, so that's the chaos in the house. it seems like there is something resembling regular

order happening in the senate. there is reporting that a bipaisan group of senators wasstushing legislations that wood and shutdowns and trigger two-week stopgap bills. if that happens, is it dead in the house given what we are seeing now? >> it would almost certainly be done in the house assuming that a proposal like that could even passed the senate. part of the reason why the senate has had its own problem advancing appropriation bills lately is a certain conservative hard-liner in the senate digging against advancing funding bills. what remains to be seen is how this will all sort out. so we know about the speaker's problems with this conference, particularly with congressman, matt gaetz. but on a political podcast this week, house minority whip, catherine clark, floated the idea of vong against the motion if -- the motion to vacate, if mccarthy put an end to the biden impeachment inquiry. how real and offer is this?

would mccarthy even take it? >> what i found interesting about the wits remarks was four weeks, democrats have been publicly muddled on how the motion to vacate the leader would have been. -- for now, with clark to put a certain number of demands on the table, some of which closely mirror where bipartisan compromises might, by that might be the funding goals of the debt deal, ukraine aid and disaster relief. democrats could probably get. that she also asked for republicans to end their impeachment inquiry in exchange for saving mccarthy. there's lots of contours of bipartisan deals that might emerge. the question for mccarthy is whether or not he's willing to take it. >> speaking of the impeachment inquiry. hearings are supposed to start, if memory serves, that is your area, on thursday. correct? it's supposed to be at least one or two starting on thursday. given that we are hurdling to a government shutdown, is likely

that hearing doesn't happen? or will they forge ahead? >> it's looking like they're gonna forge ahead with. it in many ways, impeachment inquiry was one of these mccarthy concessions to the hard-liners in his caucus. this could be something that he could offer them. a little bit of red meat before he will need their votes for a government funding bill. >> you would think they would use that, all the time they could possibly get to focus on getting a deal. but it is speaker mccarthy house. so nicholas, congressional reporter for politico, thank you as always for coming to the saturday show. >> after the, break only the best, why special counsel, jack smith, is adding a veteran or crimes prosecutor to his team and the role he could play in donald trump's criminal trials. we will discuss that next. we will discuss that next. we will discuss that next. we

new york attorney general letitia obtains and donald trump faced off during a preliminary conference for the upcoming civil fraud trial set to begin october 2nd. james's office has suggested that the court find the trump family's business is liable for fraud before the trial even begins. with council fore a.g.'s office calling the inflation of assets, staggering. ump's lawyers arguedthat james has no valid authority to sue and called for all seven causes of action to be dismissed. the hearing ended without any rulings. however, the presiding new york judge made it clear that he was not going to tolerate any bs in his courtroom. th the judge, at one, point pouting his fist on the bench and telling the trump legal team, quote, you cannot make false statements and use them in the business. joining me now, msnbc legal analyst, former federal

prosecutor and host of the justice matters podcast. glenn kirschner. glenn, always good to see you, pretrial arguments are set to continue on wednesday over the scope of the new york case against trump. what is the likelihood that either de succeeds for a summary judgment in this case? >> i would have said, john, the likelihood was low. but then reading accounts of just some of what judge arthur and grant was saying to the defense attorneys makes me think he might actually find partial summary judgment in favor of attorney general, shames case, which would mean he could decide some of the issues himself rather than forcing those issues to trial. if you will permit me, i wrote down a couple of comments that give you a flavor of how he was presiding and how he was receiving these arguments from trump's defense attorneys.

first of, all he called some of their arguments, quote, a joke. for example, they were citing as authority things that were not authority, like the opinion of some retired judge on some point of controversy in the case. that is not the way authority works. and judge and garon called them out on it. he said some of the arguments they were making had been rejected by judge edgar on in prior litigation and he called those arguments borderline frivolous. he was considering sanctions against donald trump's attorney. and i love this, because trump's attorney argued, with respect to donald trump inflating grossly the value of his properties, his attorney said well, judge, he is a master at finding value in his properties where others do not. translation, my client is a master in the art of deception. i don't think that hearing went

all that well for trump. >> i mean, i'm glad you brought up those points, glenn. because they are breathtaking. there was another situation where, didn't trump's defense attorneys argue that, valuation is subjective. i think my home is worth 5 million and you might think it's five. that is just business. >> that is just deception. it's just misleading the banks and the insurance company. and the tax authorities, because donald trump was trying to cheat on all fronts. they also -- the defense team, they also argued that there is no harm here. nobody was harmed when our client made these alleged misrepresentations in valuations. here is one judge and grant said to. that judge and grant is a blunt

talking, no nonsense, new york judge. he said no victim? fairness in the marketplace is the victim. so as i say, at every, turn judge and giron was calling trump's defense attorneys out on their nonsense and i don't think it is going to get any better for them moving forward. >> wow, glenn, i have to get you on something el we have to switch gears a bit. get a load of this from the rolling stone, which r, quote, while trumicly professes confidence, privately, three sources familiar with his comments say he has been asking lawyers and other people close to him what a prison sentence would look like for a former american president. would he be sent to a cb fed sow prison, a place that's relatively comfortable, as far as these things go, or a bad prison? >> this is in relation to the federal cases against him. what does this tell you about

trump's mindset? >> it tells me he is scared to death. it tells me he has overwhelming consciousness of guilt because he knows he did wrong and he knows he is about to be held accountable for his crimes. so it is not surprising that he is obsessing. if he was confident that he would be completely exonerated, would he have to obsess about what his future time in prison might look like? i think the last refuge for donald trump can be seen in a recent post where he urged the republicans to defund essentially the prosecutions against him. which, to this whole prosecutor, jonathan, smells a lot like an attempt to obstruct justice. >> and one more question for you. glenn, wh does it say to that special counsel, jack, smith recently added to his team a veteran or crimes prosecutor

who he worked with when he was at the hague? >> yeah, and it's already a strong team, and jack smith has just made it stronger by adding alex whipping, who is a former deputy of his in their prosecution work at the hague. he also worked at the international criminal court. he was a federal prosecutor for ten years. first in the civil rights division, and then named justice in d.c., an assistant u.s. attorney at the boston u.s. attorney's office. handling organized crime in corruption cases. of, course a professor of trial practice at harvard. he is somebody who has dedicated his law to public service and academia, rather than going into private practice and chasing the almighty dollar. not to criticize my friends in private practice, but jack smith continues to strengthen his prosecution team. and i have to say, jonathan, donald trump's lawyers are going to be that lee mismatched

most influential political organizations in the united states. and basically news has not independently verified the propublica story, and thomas has not publicly commented. but these new allegations of justice thomas's participation at the coke network events come as the supreme court will reconsider the landmark 1984 chevron versus nrdc case, which sets a 40 year old precedent on the powers of federal agency. agencies. according to propublica, the coke network has long pushed to see chevron overturned. joining me now, josh kaplan, reporter on that propublica story. thank you very much for coming to the saturday show, josh, please explain the details of this reporting and why it's concerning. >> so we found that clarence thomas has secretly participated in small --

in high dollar donor events for the coke network, which as you, said is one of the most powerful and influential political groups in the last half century. so every year the coke network has its pick annual fund-raiser in palm springs for donors that give at least $100,000 a year. and we found that during the 2018 door summit, -- they flew out to palm springs on a private jet, which he did not disclose, then he attended a small private dinner for high dollar coke donors. and why was he there? well former koch staffers say -- it was seen as a fundraising tour. perk for donors. which puts this -- promise in an extraordinary position which is far outside

the norms of misconduct. he has served as a prestigious fund raising drop for a network that has brought multiple cases to the supreme court including one of the biggest cases of this coming term. >> you know, josh, senate judiciary committee, dick durbin, has asked justice thomas to recuse himself from the chevron case. how to use think thomas will respond? >> i don't want to make predictions, but you know, i think i'd be surprised if he recused himself. with questions like that, i mean, the only person making that decision is thomas himself. which gets to an issue that is underscoring this whole story, when it comes to questions of what is appropriate for justice to attend. when should a justice recuse themselves? at the supreme court, unlike the lower courts and unlike the

rest of the federal government, it is just the justices making that call. if thomas says it's fine, then it is. >> you know, recently justice brett kavanaugh said there could be concrete steps soon to address ethics concerns. what would that look like? do you think the other justices would be on board? >> yes, so cabinet has said that. i believe kagan said that. that was yesterday afternoon. john roberts has said similar things. there is certainly an effort within the court to -- there is an expressed interest in implementing these rules. however, justices have been publicly saying that the court is going to implement a code of conduct soon for least four or five years now. it has not happened yet. so i think it's a big open question about, what are the obstacles to doing that?

coast. what motivated you to create this docuseries? >> thank you so much for having me. you know, i am a lawyer by training, and a lot of my work in the past has dealt with legal issues. in the past several years, i have just become increasingly concerned with the direction of the court, but the direction of the court i mean how the court is making decisions. how it is departing from precedent, how it is changing the very way that pieces are taken up. and you know, i watched with such interest and dismay the story that you just did, which is really really shocking. you can't overstate the importance of the reporting that you are highlighting, and that so many other journalists are doing. so your discord's lieutenant. the discord is losing its reputation for the american public, that our confidence is

eroding before our very eyes. >> right, the reporting you're talking on is the propublica reporting on previously undisclosed -- for supreme justice clarence thomas before conservative network. speaking of public opinion, then how has public opinion of the court changed over the years? >> you know, a recent august poll had democrats, public opinion favor biloxi readings for the supreme court, is that 17%. republican approval of the quarters at 16% -- so that reflects the title. it is really our country that is deadlocked, and we are seeing this in our different opinions of the court. but overall, the public opinion for the court has never been lower. this is a real concern. as we say in the series, the power that the court has is its legitimacy. it is that we believe that the

court is making decisions fairly, and with respect for the rule of law. if we lose that public opinion, if we lose that confidence, then my friend and colleague here -- from -- says why obey? why would the american public obey it believes is not acting fairly, or the adamantly, or ethnically. >> in the dock you serious, it is not just focus on the travails of the court in right now that we are talking about. it looks all the way back to the 1950s. how has the court shifted since then? >> you know, the war in court is traditionally the one that -- the miranda warnings that they are also -- getting the right to an

attorney, so historically this has been a court that has protected the rights of individuals. overtime, we have seen a slow rightward shift, until the court that we have today. the court that we have today is not just a conservative court. this is not just a matter of shifting political opinion, or political power. this is a court that has been fed by conservative ideological groups, like the federal society, and leonard leo, and the federalist society or some of the compatriots of the people the koch brothers, and the reporting propublica has done. so this is not accidental that we have ideologically determined 62 conservative majority completely adjust up with the american people. but this did not just happen
