directing federal agencies to get ready for a disruption of services, and we congressional correspondent is joining us now from capitol hill. julie, it's good to talk to. you speaker mccarthy is talking with you and several other journalists, just a little bit ago. what did he tell you? >> speaker mccarthy is remaining optimistic. i don't know if he's looking at the same plot that we are, but he thinks that we are not at crunch time, yet and when we get to crunch, time he believes that he will be able to get some of those holdouts to come on board. right, now there is a gop conference wide meeting happening right now over the phone obviously because other than negotiators and those on the rules committee, the rest of house members went home for an anticipated votes. not sooner than tuesday, i'm told by mccarthy when i asked him what his message was, -- he said it's essentially to pressure the holdouts to ask them what they rather have a conservative option that now would include border security for -- a commission to study the debt as, well or would they rather

have an alternative, which is going to be the senate democrats jamming them with the sea are, if the shutdown does happen, take a listen to more of what he told me when i asked him what his mission was in private of those holdouts. >> what if they told me privately that makes you so confident? >> i'm just an optimistic person. i think there are few people that want to take it all down. for different reasons. for different reasons. i just do not believe, 99.9% of the republicans want that. i don't think that's productive. >> the thing is, and of course you know this well. it does not matter of 99% of republicans are with, him he has a very slim majority, and four or five holdouts means all of this gets tanked, and we are left with a shutdown and mccarthy has no pathway forward. >> let me ask you this. anything here that -- can do to try to avert a

shutdown with this crunch time deadline? >> well, i'm told that schumer is talking to minority leader mcconnell trying to figure things out, we already heard from mcconnell several times, he says he's not going to help house republicans out of, this really putting the pressure on mccarthy, but the senate is going to move their own short term government spending bill, they're going to move that early next week. send it over to the, house but really if the house does not want to reach across the aisle, and work with democrats just yet as -- he's not ready for, then we are looking like we are going to be barreling towards a shutdown that will be on the backs of those holdouts that will be on the backs of republicans, i also asked mccarthy if their former president's comments taking those holdouts to hold strong, and shut the government down, and remember the longer shut down in history over month happened under the former presidents watch. mccarthy said nobody wants a government shutdown, he thinks ultimately that the holdouts will come around, obviously the clock is, taking away from now the government will shut down if they do not come to their terms. >> julie, thank you, we are

going to continue to talk about the shutdown throughout our show. coming up in our next hour as well, house progressive caucus whip representative greg casar of texas, he will be with me to talk about what his style of the aisle could do to prevent a shutdown in just a matter of days. certainly a time crunch. there we are following some weather, everyone some breaking news along much of the east coast. affiliate is continuing to bring heavy rainfall, and strong winds to parts of the mid-atlantic after making landfall early this morning. thousands of residents also without power in north carolina, pennsylvania, even new jersey. i want to bring in aaron gilchrist, and ocean city new jersey, it also -- let me start things off with you, i know affiliates already being felt where you are, at high tide, there will hit in just about an hour or so. what have you been seeing? >> yes, we are in between bands of gray right, now so it's dry out there for the most, part but the wind has not let, up the surf, the waves that we've been watching, those have not

let up either. you may be able to see over my shoulder, here just how strong and powerful these waves have been, and this is been the case for hours. now we have been out here today, overnight we were watching for more hotel window, the stronger -- there is a lot of concern about coastal flooding, all up and down the eastern seaboard today. we've heard concerns about waves reaching potentially ten feet at some point during this storm. it's going to last for hours and hours. there's also this concern about inland flooding. we know in one of the nearby towns here they've had to close one of the main bridges. we've also seen reports about high water, and different places in atlantic county, as well here in new jersey. a lot of people though, at this point while the brunt of the storm has not really hit new jersey, people are calling out to sort of take a look at these really impressive waves. there are maybe two dozen people standing around just where we are here, and i want you to hear what some of them told us a little earlier today. >> it's different than the last time for sure.

we can't get in the water, but it's still fun to see. >> it's crazy, i love watching the ocean, it's so wild. >> let's try to go for a walk for a little, bit and see what's even open. >> we talked about that concern around the waves here, and some of the coastal flooding will be a russian that's happening on the base here is just being wild to, watch as the waters come out and chopped away at parts of the beach here. , again it's worth noting yasmin that we are hours away from the storm being done. >> wow, we're in the midst, a bit erin thank you, i know that thousands are now without, power certainly a major concern. what more can you tell us about folks getting that power back on? what would a time like that look like? >>, yes the way that this works is the storm and a lot of places needs to be done. looked at power outages, and we're seeing them in significant numbers in, virginia in north carolina

where the storm made landfall earlier today. the numbers have been fluctuating a little bit throughout the, day we've had these bands of rain coming through, and so while there may be some progress in getting the power back on in some, places another surge of weather will come through, and that sometimes can knock out more power. people think because this is not a hurricane, maybe there is not as much to worry about, but the reality is that we're still getting a ton of, rain and a total -- continuous, rain that's potentially taking down tree limbs, or trees on the hole, and taking down power lines to. >> erin, i will let you get to, it i know you are in a position in which things could feasibly change pretty quickly when it comes to the weather. thank you for that. pleased to see a fight amidst all of, this michele grossman -- give us a reality check on, this were kind of in the midst of this day. there's certainly gonna be more bands of rain that they're going to have to be dealing with this forum affiliate. talk us through what we've been seeing, and what we can expect. >> hi, there -- were looking at 36 hours, still

to come of some really heavy rainfall, that's going to create life-threatening flat flooding -- we've seen some water rescues, in portions of the carolinas. it's going to do it, slowly we're still having this trouble of characteristics, it made landfall this morning around 6:15, with 70-mile-per-hour, once that's a category one storm. we saw that surge in -- salt water moving on, that we're gonna see some really large swells. we saw that in the live shot. there are some really big waves that -- taking a look at the maps, here because we are still looking at a tropical, storm and we do expect it to keep these tropical storm characteristics. at least in the next couple of, hours and then it kind of loses that warm core. it's still creating a lot of, rainfall you can see that really rain shield even into portions of new england, and mid-atlantic. that's where you see those. colors especially the, allows the reds, the oranges. that's where we're seeing those heavy rain bands -- that's where we have the concern for, flooding over the next 36 hours in addition to that flash flooding. it's moving north at 13 miles per, hour or so it's moving, and that's an average pace. we're looking at 95 miles south of richmond virginia, we're

looking at the cow -- virginia as well as portions of the northern mid-atlantic, even as far as into central pennsylvania. penn state has a big game today, lots of tailgaters outside, lots of people want to be outside on the weekend, this is an indoor weekend, because as we look at this track, we are going to see it moving up to the, north it's going to become a remnant low, that's what's left over from the storm, but either way we are looking at rainfall all weekend long. even into, monday so that's going to create some issues, in portions of the northeast, even into new england on monday before it's completely out of here later monday over the atlantic. still lots of tropical alerts, that's in the orange there from portions of the -- into parts of the carolinas. we are talking about, virginia beach chesapeake bay, down to cape hatteras, and religious battering winds. it's a miserable weekend in this part of the country along the east coast. there is that rain for once. again you can kind of see that red in parts of the carolinas, that is a flash flood warning, that means flooding is imminent, flash flooding is imminent, or it's happening right. now millions of people are

impacted on this saturday, we are going to see that again on sunday. that stretch is all the way up into portions of new england. flooding, that's one of the concerns, flash flooding another concern. especially where you see that pink, there in parts of the carolinas. that's a moderate, risk that's a high-risk this week over portions of the east coast. it stretches all the way into atlantic city, to ocean city where aaron is. lots of rainfall. we have seen over half a foot of rain in many spots, you can locally see up to eight inches, these dark colors are telling us where we expect the heaviest amounts of rain. certainly around the, coast but it pushes inland, so even those yellow shaving, even close to st., college pennsylvania. in parts of -- continuing. when we are concerned about storm surge. this is the net wall of water, salt water goes over them, so it's a really, a wall of, what are we are going to have to be careful, if you are along the coastlines, here move your car if you are in those areas where we get flooded often. 2 to 4 feet is where you see the yellow, so that's part of, virginia beach so also more -- we have some storm surge in blue --

united auto workers have expanded their strike now 2:38 parts of distribution locations across 20 states as that strike stretches into its second week. the uaw is targeting general motors and stellantis, thought not for it after union president john thing said they made progress in the glaciation's with that automaker. president biden says he is going to hit michigan on tuesday for their own pickup line, with uaw workers. that will be just one day before former president trump also says he is top with union workers. i want to bring in jesse hersh. standing by for us in pontiac, michigan. good to talk to give. give us a list, if he will, on these ongoing negotiations. and the progress made so far, especially progress we are hearing about what we've made before? >> yes. so, yasmin, that is the only automaker the union is saying has made, quote, real progress swiftly. warning come from the union is if it does not see substantial

movement from the companies in the goshen's before noon yesterday, it was going to expand its strike. so, we saw the strike be expanded at general motors and stellantis, but not as -- signaling that the union is in a better place with that automaker, with four, then it is with the other two in terms of what it feels it's getting from the companies in negotiations. what the union is now specifically targeting's parts distribution facilities for those two companies. it is hitting 38 facilities across 20 states, and what this means for you at home watching is if you need your car repaired, if you have a gm or stellantis vehicle, and you need a repair, depending on what part you need, that might be trickier in the days and weeks ahead. i spoke with a dealer group yesterday, and the gentleman i spoke with said they have been stocking up on higher demand parks like brake pads, that kind of thing. but if you, perchance, have something like an engine overhaul, that could get more difficult as long as this strike lasts in this specific

space. what's notable about where the union is now targeting, this is a group of facilities that may not this is a really hit the companies directly in a major financial way. but you can imagine that this could be a more potent weapon, perhaps, in reaching the american public. if it's hitting consumers at home who haven't necessarily been paying the closest attention to the strike, may not be directly impacted by this, but if you need your car fixed and you can't get it fixed as quickly, that's a way you might be able to reach the public more directly. it will be interesting to see how all that plays out. and as you mentioned, we have the politics of the moment. president biden vowing to walk the picket line on tuesday, and, then hours later, who is shaping up to potentially be his chief rival in the fall 2024, president donald trump is also expected to make a visit to michigan. so, a lot to be keeping an eye on here in the days ahead, yes. >> all right, jesse kirsch there for us. thank you, jessie. appreciate it. still ahead, tempers flaring in the courtroom. the trauma that an floated between donald trump's lawyers and the judge between these two

coming at the crisis on the u.s. southern border, homeland security secretary alejandro mayorkas visiting the reach right now, as well as the president of andres. it's coming as the biden administration is tackling the migrant crisis, which has forced one texas city to declare a state of emergency. want to bring in colin venegas from where secretary mayorkas just with the under in president. guad, good to talk to you. walk us through what the two are talking about to alleviate some of these surge of migrants that are coming from honduras to this country? >> well yasmin, the visit the president of honduras coincided with this migrant crisis, it, seems she had things to discuss with dhs secretary mayorkas about migration coming from under us. they came a processing center here in mcallen, but of, course the majority of migrants arriving at the u.s. mexico border say they come from venezuela. there are some migrants coming from honduras, and this is something that the secretary

and the president spoke about. mayorkas also talked about the humanitarian crisis that currently exists, that is the root of this migration. they both discussed the existence of smugglers and organized crime that traffics humans and they said that is something they are going to fight. mayorkas also said they plan to apply lost anyone who intends to enter the country illegally. here is mayorkas speaking just about an hour ago. >> we will work to remove, as quickly as possible, those who do not qualify for relief. under our law. we are combatting the smugglers, more intensely, than ever before. by arresting and prosecuting them. disrupting and dismantling their networks and seizing their properties and funds. >> now, this visit was in the mcallen area. we are still few hours away from eagle pass. that is the area that, right now, is ground zero, yasmin. that's where we have seen these

images of groups of hundreds of migrants arriving in -- mexico, crossing the river and turning themselves into the sea deep. eat this morning, we moved the crew to mcallen to be here for mayorkas visit, and we are getting reports that hundreds showed up in eagle pass. so, every day, large groups are showing up. many of them riding the trains, the freight train is the cone north from central mexico. in fact, the company that operates those trains in mexico halted them briefly, but the reports indicate they moved the trains yesterday. so, that could've been the reason why groups of hundreds arrived. so, when we look at this issue, yasmin, it's important to keep in mind this is a crisis in latin america, and the united nations have reported more than 400,000 people crossing the jungle in panama, assuming most of those are trying to make their way to the united states. we have to expect this migration to continue as the u.s. tries to figure out how to apply immigration laws. most of these individuals, yasmin, are not using the cbp

more democratic officials are calling for senator bob menendez to resign in the wake of that bombshell federal indictment on corruption charges. this includes those in the senators home state of new jersey. the latest the democratic state committee chair. but not everybody is ready to go there, which is where we find fellow new jersey senator, cory booker, who is remaining silent for now. after the latest, want to turn to nbc news chief justice contributor, jonathan deets. >> calls for senator bob menendez to resign after a stunning corruption indictment. menendez defiant, releasing a statement overnight saying, i am not going anywhere. prosecutors accuse the new jersey democrats have a wide ranging bribery scheme. saying he and his wife accepted gold bars, piles of cash, and a mercedes-benz. all in an illegal effort to help three businessmen and egyptian officials.

>> the senator and his wife accepted hundreds of thousands of dollars in bribes. in exchange for senator menendez using his power and influence to protect and to enrich those businessmen, and to benefit the government of egypt. >> one of those businessmen, fred davies, is an admitted fraudster who allegedly paid menendez and his wife with these gold bars. after getting the gold, the indictment says some and then this went online to search how much is one kilo of gold worth. >> these three kilograms, together, our words approximately $150,000. >> during a search of menendez's home, prosecutors say they found $480,000 in cash, including these envelope's, stuffed into one of his suits. more than a safe and in closets. according to the indictment, senator menendez also abused his powerful position as chairman of the senate foreign relations committee. >> senator menendez allegedly provided sensitive, non public,

u.s. government information to egyptian officials. >> senator menendez and his wife both night wrongdoing, saying forces behind the scenes are trying to silence him with false claims. there's been an active smear campaign of anonymous sources. the excesses of these prosecutors's apparent. they have misrepresented the normal work of a congressional office. attacked my wife for the long-standing friendships she had before she and i even met. while many democrats are remaining silent, new jersey's governor, friday, saying the allegations are deeply disturbing and calling on menendez to immediately resign. >> thank you jonathan dates for that. let's bring in chuck rosenberg, former u.s. attorney and senior fbi official, now an msnbc contributor. chalk, fantastic to talk to you about the stuff. i got to say, i read through these full 39 pages of this indictment, and there are some really stunning details in this indictment. but talk to me about how difficult it is to prove

bribery for official duties. >> it's a great question. and the department of justice has struggled with that over the years, because the supreme court, in a 2016 case, i believe, mcdonald, former governor of virginia, has narrowed the definition, yasmin, of what constitutes an official act. but here, like, you i read the indictment. i find it compelling, and the official acts that are alleged, they are trying to, for instance, help the government of egypt. or trying to intervene in a criminal case. or trying to help businessmen when a monopoly. i'll strike me as official acts. so, my sense of is, it is well pled and avoids the problem you and i just discussed. what is an official act? >> i also wonder if prosecutors will try to establish a pattern of practice. this is from the current

indictment, and they want to read it for you. and then this promise to end that use his influence and power to breach its official duty to recommend that the president nominate an individual as he was attorney for the district of new jersey, o menendez believed could be influenced by menendez, with respect to the federal criminal prosecution of fred davies, the defendant, and to seek to disrupt that same prosecution. and then, chuck, back in 2014, you remember, we learned that menendez made a telephone call described by some officials as, quote unquote, inpropriate to a u.s. attorney. investigating one of his top fundraisers. multiple justice department sources telling nbc for the york. will this be part of the prosecutions argument here in that this is allegedly a pattern of practice, it seems, for senator menendez? >> yeah, to the extent some of this is charged in the indictment, yasmin, the government will be able to induce him at trial. but to a larger point, there is a pattern, and there is a rule of evidence that accounts for this, that allows the government, if they are trying to prove intent or motive, or m

o, to prove similar acts. i think it's important to say, too, but federal prosecutors that menendez targeted, that he was seeking help from, didn't capitulate. they didn't do what he wanted them to do. that doesn't mean it's not good evidence, because attempts, as you all know, are also prosecutable. you don't need to succeed in robbing a bank if you try to rob a bank. that's a crime, to. so, yes, i think prosecutors will try to induce this at trial, not just what's in the indictment, but a pattern, as you said, of this misconduct that stretches back over years. >> all right, chuck rosenberg, thank you. do not go, check. i have more questions for you regarding former president donald trump as well. we will be digging into that as well in just a little bit. we know the next gop presidential debate is happening wednesday, but we now have details on the third debate. a scheduled to happen on wednesday, november 8th, in miami. it's going to have these strict

time is quickly running out on capitol hill. two from the government and avoid across the government shutdown. that -- is one week from tonight, when the clock strikes midnight on saturday, september 30th the. satan will have a major impact on this entire country, really. nbc's brian chung has more. >> hi there. yeah, the countdown is on to a potential government shut down. here is what's at stake. if we take a look at the last episode, where we did have a government shutdown, which was 2018 into the beginning of 2019, lasted 34 days, that's that the u.s. government backed by 11 billion dollars. three billion dollars of which the congressional budget office says was permanently lost. that is not enough to necessarily tilt us into a recession, but this is most impactful for a lot of those households that employ or have people working in the federal government. because in that last shut down, we saw 300,000 workers furloughed without pay. in the 2013 shutdown, we saw even more people impacted by

it. over 100,000 people that were furloughed without pay. so, this could be pretty impactful for those households, especially during a time of high inflation, where that crunch could be even worse. so, right now, we are really talking about a situation where it depends on how long a potential shutdown would go. that would really tell us about how many people would be impacted, but again, all eyes towards next week to see if we could avoid that type of situation, but both the monetary and the jobs impact that could come from a potential shutdown. back to you. >> all right, thank you to brian chung for that. appreciate it. we are following this breaking news on this possible government shutdown. it is coming out of capitol hill. house republicans are holding a conference right now, a conference ca tget a plan on their full funding the government, with a week left until the deadline. spkemccarthy telling nbc's julie tsirkin he plans to tell the whole -- quote, that is not the time to work against him. going on to say, you've got to stop that, saying, people need to work together. i want to bring in msnbc

political analyst, david jolly, and former republican congressman from florida. congressman charlie, thank you for joining us on this. we appreciate it. i mean, is it really going to work? also, let me brief you what he said after that failed vote. this is a whole new concept of individual that just want to burn the whole place down. this is from representative steve womack, a republican from arkansas. it's a soap opera. what do you guys want to call this, all my children? has that already been taken? mccarthy calling this, these individuals wanting to burn the place down, but then trying to negotiate with them to kumbaya and negotiate to get this through. >> look. mccarthy is wrong and he knows. this didn't just happen. this caucus has been there since the tea party emerged in 2010. in fact, kevin mccarthy used this caucus to help elevate himself to the speakership. i would also say what they are working on right now, we can cut to the short of, it is not going to work. because what kevin mccarthy is trying to do is pass something through the house with only republican votes.

whatever that product looks like, but senate won't pass it. not because chuck schumer and democrats don't want it, but mitch mcconnell doesn't want it either. >> could you hold office one second? there is a briefing going on on capitol hill right now, by some republicans. we want to listen in for just one second. >> lives on the line, yet not be paid. we shouldn't be in a situation to where we are fighting to close the southern border, but not have our border patrol paid. this is an unreasonable situation, and i think it would be a failure on our part if we actually reached that point. i think that republicans are aligned on the strategy, at least 95% of them, and we're going to continue working to do this. last point i want to make, i want to remind everyone the appropriations bills are moving forward. the appropriations bills that the appropriations committee report it or voted or passed out as far back as may of this year. there have been aggressive efforts by the members standing here as well as scores of other

republican members of congress to try to get these bills to the floor for a vote as soon as possible. and those efforts have been supported, despite much effort by the entire leadership team, the speaker of the house, the majority leader, the whip, and others. with a bat, i want to turn to congressman -- to say again, a member of the rules committee, who just finished voting a little while ago on reporting the rule out for the four bills that sort of determines the conditions under which these bills be considered. >> thank you, garrett. we've just come out of the rules committee. we are going to have maybe the largest rule we have ever passed out of the rules committee that contains four appropriations bills with hundreds of amendments that are allowed to be offered for that's process. again, i want to reiterate what congress greg said and, many of these appropriations bills have been noticed. they have put out of committee for months. we have been trying to get these bills to the floor.

a handful of people have sort of been standing in the bite of that. we're going to keep moving forward. we're going to keep trying every single day to get these bills through because, you know, you're fighting against what the biden administration is doing or not doing on the border, and this rules package in particular contains some strong border provisions we hope the senate and the president will take seriously. >> i think i walk away with with the call we just had its how unified the republican conference is and two key things. one, to address the runaway spending and reckless spending of the biden ministration. and two, to get serious about securing the u.s. mexico border. the conversation we're havoc here are the final days is the tactics to get here, but i think the strategy will are unified behind. hopefully, over the next couple of days, we'll be able to move these bills forward. get it ultimately, make sure we're not shutting down the federal government. will be a stopgap here and the time we need to completely appropriations bill. but the work we can do this week, i think, will really build the momentum in the

appropriations process. but also, give us the opportunity to get the stopgap funding bill across the line, so we can completely work with the appropriations. >> the vast majority of the republican conference is unified on the strong, and i think we are exactly where the american people are, which is reducing spending and securing the border. i know i hear, and every guy here -- every time we get calls to our office, it is let's reduce spending, let's secure the border. so, those are the two things we are bringing to the forefront in our appropriations package. i'm excited to see these bills come to the floor, get a roll through, and continue to do the work. congressman style -- stated the stopgap measure we are working on, yes, we are working on a stopgap measure, but we are also, at the same time, collectively working together to try to move our appropriations. >> it is a new stopgap measure? one point 471, that conference, or is this going to be reworked out? >> look, exactly what that looks like, not sure right now. continue to have conversations.

you know, i want to make a point that i think is important. we saw several days ago where people like congressman buyer donald, congresswoman chip away, scott perry, dusty johnson, stephanie, bison kelly armstrong worked at a really good approach that i think gave us a path to actually reduce spending, reduce the border, at something was absolutely every day we get closer to the end of the fiscal gear, the opportunities to use the leverage to force this white house, to force president biden, to cave on those issues, it's waning. and i think it's a huge mistake. so, we're continuing to work on this, but also, another part, the speaker of the house and the debt commission, to look at long term -- >> so you're taking a lesson to members of congress there, congressman garrett graves, congressman style, i believe, from wisconsin, and congresswoman houchin as well.

they are getting off this call, the republican caucus. about averting a government shutdown, essentially. want to bring david jolly back into the conversation. david, i don't know if you have heard what i heard, but they are saying they are unified. doesn't necessarily seem like they are unified, i got. they are unified over two things, they say. stopping what they say is the out of control spending that the biden administration, and unified on the southern border as well. that's about. it to say they are working on this stopgap measure, they think they can get it done to actually get the appropriations bill in. however, they don't necessarily know what is in the stopgap measure. we know they have voted against the stopgap before. so, not them specifically, but members of the republican caucus. so, with that in mind, what's your reaction to what we were just hearing there? >> so, very importantly, we are hearing right now from three allies of kevin mccarthy who are presenting an optimistic picture from kevin mccarthy, particularly garrett graves, louisiana, one of his closest

allies who often speaks for the speaker. we are not hearing from matt gaetz and others. but importantly, what graves did there is he name checked the number of freedom caucus heart right members who have been cooperating, almost to isolate gaetz and others to say, why aren't you coming along? here is the bottom line of the plan they are now going to pursue. it will not work with the senate for the president. it won't work with mcconnell, and in some, ways they don't have time to actually cast the number of bills that are talking about. i've worked with the committee, the appropriations committee, for 30 years. it will not work with us and for the president. the question is, will this plan work for matt gaetz and the sixth hole does or say we, will not vote for any short term measure? we don't know the answer to that yet, yasmin. >> so, i wonder this. is is from the washington post, and up at peace. the tie is, enough is enough, carthy must bring the gop rebels toheal. i want to read a partf is thing, and if you th's the strategy mccarthy should be employing at this part. mccarthy can damage those plans for when a person could beed

removed fromhe conference and from their committee signments for defying the overwhelming will of the party. for example, the rules could specify that any republican member might face removal if they defeat a measure brought to the housefloor that receive 95% support from conference members. do you think this would even be an avenue in which mccarthy would even consider taking, considering his unpopularity already in his own caucus and the threats to his leadership? >> so, he doesn't really have the ability, to. that would be part of the rules package that happens every two years. that was a package negotiated where mccarthy basically gave away the house so we can become speaker of the house. the whole idea of the motion to vacate, but only by one member that -- rebel. so, the only endgame here is for mccarthy to work with democrats. he has known that since january, when he became speaker. the question is, can he survive his speakership if he does that? i think what he has done, yasmin, is this. he said to gaetz and others, okay, we will do with your white this week. he expects that to fail, and

when it fails, perhaps, his caucus says, the problem is gaetz, not mccarthy. we've got to figure out how to get rid of gaetz. i don't think that rules change will do, it's but -- >> but republicans are still -- i don't mean to cut you off. but the republicans are still going to take a hit on that, whether or not they are going to point their fingers at marjorie taylor greene or matt gaetz, it seems. at this. point. the republicans are still going to take a hit on this if the government shuts down, and by the way, out, the american people. >> it's a bunch of kids on the playground right now. this is internal gop politics, that doesn't translate to mainstream. and again, to govern mccarthy will have to work with democrats. so, the house gop is on the brink of collapsing internally. who survives it? is it kevin mccarthy? is it others? i don't know. when the music stops, i don't know who is standing in the house gop after this. >> david jolly, thanks for sticking with me through this. appreciate it. live report from capitol hill, coming up, everybody, at the

top of the hour. we're going to pivot here. we want to talk about the former president as well, a lot of stuff happening there. we are learning some stunning details about yesterday's trial hearing in new york attorney general, letitia james's business fraud lawsuit against donald trump. his adult children, his company as well. all ahead of this october trial, which trump is trying to prevent from ever happening, as they push for a dismissal of this case. but they face some pretty tough questions from the judge, and were even called at that time, snow so doubly when a trump lawyer christopher kise was told by the judge this. you cannot make false statements, and even ended one of many tense back and forth with case by simply declaring, disagree. back with us, chuck rosen, former u.s. attorney, now msnbc contributor. as i mentioned, some pretty contentious back and forth with the former presidents attorney's, along with the judge as well. as a team trump, i should say, is trying to persuade the judge, essentially, to throw the case out, what do you make of

something you heard from yesterday? >> first, yasmin, this is not a criminal case. this is a civil case brought by the attorney general state of new york. essentially seeking money damages, because the application is that the trump organization and his officers and employees inflated the value of their assets to get more favorable loan terms. with that, what usually works in court, and that was a prosecutor for a long time, our facts and the law. the quality of the argument doesn't matter, in fact, if anything, it can tend to backfire on you. i don't blame the trump team for trying to dismiss the allegations. that is what lawyers do. it doesn't seem likely to me to succeed, and i guess, yasmin, is that this will proceed to trial. perhaps in october, there might be a slight delay, but it seems to me is going to be tried eventually. >> well i have you, chuck, i want to check through a couple things. i want to talk about what's happening in georgia as well. we are looking ahead. we know now chesebro, sydney

powell, their trials are going forward without the 17 other codefendants. we are now getting a glimpse of the list of the states witnesses. one name actually that so that was lin wood. lynn would, be lawyer who pushed trump's false election claims. lynn he would then tweeting out that, in fact, he has not flipped on the former president. what would you make of that admission from him, or what he is saying, and the fact that he is also being called as a state witness? >> first of all, it may be true, and it may not be true, that he is cooperating time. we'll tell. but you are viewership no often, as you get closer and closer to trial, both sides of the government, both sides put out a number of witnesses under subpoena. it doesn't mean they are going to call them all. it just means they have the option of calling these witnesses, should they need them at trial. it's number a, guarantee the government would absolutely call, and some number, they may be keeping in reserve,

depending on how the evidence goes in and what, if any, arguments i'm sorry, mister chesbrough seem and sidney powell's team make in response. so, you know, for now, i guess we can take mr. wood at his word he isn't cooperating. we will see. but again, not unusual for the government to issue any number of subpoenas for witnesses for trial and then to call on a small number of those as the case proceeds. >> before i let you go, chuck, you are wrote a really brilliant piece of the appointment of special councils by the department of justice. we saw attorney general merrick garland -- house this week. as they saw, accountability as republicans in the house of this as accountability as to what the department of justice is actually doing when it comes to the appointment of special counsel, especially david weiss. they spent a lot of time talking about the investigation with regards to indictment of hunter biden. you write in your piece, quote

unquote, two of the three, bert hur and david weiss, were originally pointed at u.s. attorneys by former president donald trump. we'll have since been appointed as special counsel's by garland. wanted to investigate president biden's classification -- and want to investigate the president son generally. but is not a problem, to? what was impressive to me about the grilling of merrick garland and also coupling that's with what you talked about the little in your piece as well was they asked him, what's the oversight you have over david weiss? and if, in fact, there is oversight, why is their oversight? as if there was not necessarily a clear message. i wonder if that, in part, plays into how it has become somewhat problematic, how many special counsel's half, in, fact been appointed over the last, let's say, six years or so. >> well, five in the last six years, three in the last ten months, yasmin. look, i think merrick garland is a smart guy and a principled guy. i have no quarrel with him. but the point that my article was that i, resorting to

special counsel's over and over again, frequently, again, three in the last ten months, i think it implicit just that the department of justice can't do difficult and complex and sensitive work. you can't trust the career men and women at the department of justice to do the very thing they do extraordinarily well, and every corner of the country. so, i get that attorney general has to make tough decisions. i get that i'm not going to agree with all of them. i don't believe that he is acting nefariously. again, i think he is highly principled, but when you appoint republicans to investigate democrats, or refer sully, democrats to appoint to investigate republicans, that is quintessentially a political decision. so, you front if there is a solitary reason for it, they, it is still a political decision, and that is what concerns me. >> check rosenberg, as always, thank you sir, we appreciate you. all right, everybody, we've got a lot more coming up. you are watching
