just how dangerously unfit he is to serve. reenforced by his other recent threats. like threatening to execute outgoing joint chiefs chairman, mark millie. general millie's offense you'll recall was making a phone call to reassure china making a siege on the capitol by trump supporters. in fact in a recent profile, he would come after him in the white house. mark esper said millie's concerns are a legitimate fear and he would throw his political emies in jail if elected again. underscoring the danger of re-electing a mob boss, a georgia judge has ordered the name of jurors in the case against trump be kept secret until the trial ends. all very serious. about the danger he poses to

meaning in plain english, mccarthy can either get right wingers on board which he's trying to do by floating massive cuts like taking a million low income families off nutrition aid, slashing home heating aid by 70% before winter and cutting school lunch assistance by 80% all to appease his negative detractors. what a box to be in. so with half of the house of representatives currently a nonfunctioning puddle of chaos, americans have until saturday night for congress to figure out a plan to keep the lights on. joining me now is charlie sykes. msnbc contributor. and sahil, nbc news senior national political reporter. sahil, i want to go to you first. you're on the hill. what is the state of play? how close are they to getting anything like a deal to keep the

government open? >> well, they're two very different states of play in the senate and the house and the senate, they are moving forward with a bipartisan bill to keep the government open on a short-term basis. the vote was just clocked in at 77-19. they voted to proceed with this. but the details of this bill are i'll say it briefly, it keeps the government open until november 17th on a short-term basis. about $6 billion in economic and military aid to ukraine. about 6 billion additional in disaster are relief funds and extends the faa's authorities through the end of the year. that also expire t at the end of this month. that's the senate side. they're in good shape to pass this bill. unclear if they'll do it by the saturday deadline. some republican senators could reject to a speedy vote. in this house, it's a very, very different situation.

they're still trying to negotiate with the senate, get it through the democratic controlled senate, they're going to have to get president biden. the hard liners want a steep series of cuts which he's struggling to get through the house of representatives in his narrow majority. some also say they will not vote to fund the government on a short-term basis which leads him in a jam. he's chosen to keep his job. he's trying to get these bills through the house. it's going to be a pretty wild ride. >> there has been people like catherine clark, the vote counter. the house whip on the minority de has talked about what the price would be of democrats

coming to the table and helping. one of the things would be to end the impeachment inquiry. what is is democratic side saying about what price they would exact from kevin mccarthy if they've got to provide him the votes to pass a bill. >> this question keeps coming up because of the way people like matt gates are trying to overthrow mccarthy is all but inevitable and democrats will have a choice to make. do they support the motion to make it the speaker's chair. minority power would always do that. it would not support a republican speaker. i've got to say i'm very, very skeptical. this sounds like an episode of the west wing. not something that happens in reality for democrats to basically protect mccarthy's job and keep a republican speaker. that doesn't play well in even competitive district. also, democrats want a whole series of demands from mccarthy.

that he is never going to provide because it would further weaken him to the point of untenltability. they want him to let go of the inquiry. they want him to pursue bipartisan government funding levels. in the words of one aide, stop letting the crazies one the house. is mccarthy going to do that? it's unlikely. democrats might just be hastening his departure from the speakership. >> okay. i'm not lawrence o'donnell, but it's the stupid west wing. charlie, this is a stupid, this is stupid. because the reality is kevin mccarthy cannot from what sahil's reporting has told me is that he cannot avoid the motion to vacate. he's out there now trying to blame president biden. let me play him. trying to make himself sound

to make to keep the country running, open or to protect his speaker shim. as we know, he'll opt to protect his speakership. when he made one compromise after another. he's talking about the fundamental responsibilities of the president. one of congress is to keep the lights on. he's not doing it. what's really extraordinary in listening to the breakdown, what is this shutdown about? the executive vice president of the chamber of commerce, a republican leaning organization, say he's thinking of this like the seinfeld shutdown. it's about nothing because there's no end game. they're not going to get what they want. at a certain point, this is for people like matt gaetz, the fight is about the fight. keeping it going. the more chaos he creates, the better it is for him no matter how much damage he does to the country. and you're seeing what mccarthy is willing to do.

mccarthy is willing, his speakership hangs by a thread from mar-a-lago. he knows what donald trump can do with him and he knows that he has to make one concession after another. but it's never enough because the point is not to be a governing party for people like gaetz. it's to create as much chaos as possible. to exact as much pain. the fact that he's willing to go along with the very online extremist in his caucus and cut the kinds of programs that you just listed, you have to wonder at what point do the moderates in the caucus say to hell with this, we're not going to go along with this. i don't see how this ends well for mccarthy and unfortunately, the rest of us are being held hostage as well. >> i mentioned the things they'll be doing to the working poor in this country. cutting nutritionol funding. we didn't even get into military pay. people in the united states military will not get their paychecks. they claim on the republican side they care about the

military. that's what they would be cutting. so republicans are willing to be responsible for the members of the united states military who are already not getting promotions because of the alabama senator, tuberville. now they can't even get their checks. they're supposed to be so good at messaging. how do you message that? >> this is a party that claims it's pro child, pro family. pro military. pro life. all of those things and what are they doing as their opening gambit? their opening bid? let's slash all of those programs and of course the ads almost write themselves which again, we have yet to hear from the republicans in the swing districts who have got to be going to kevin mccarthy. we know the extent to which you are willing to sell off various body parts to the marjorie taylor greene but do you understand what you are actually doing here. and i think the classic headline

threatened to kill her. the woman has been arrested. there was breaking news late today in the civil fraud lawsuit that trump indeed committed fraud. it is a major blow to trump who was asking the junl to throw the case out entirely. that trial is set to begin on monday. so many trials so little time. catherine christian, former manhattan district attorney and msnbc legal analyst and david k. johnston, syracuse university law professor and author of the big cheat. donald trump's least america. very appropriate title. tim, i want to go to you. we're going to go in order. this man has so many cases and so many trials it's hard to keep track. let's start with the claims. jack smith is saying trump is

claiming there is no threat and that in fact, it's special counsel jack smith who is, has attacked trump. this is what trump's filing says. prosecutor jack smith held a press conference -- falsely claiming he's fuels an unprecedented assault. here's what jack smith said. >> the attack on our nation's capitol on january 6th, 2021 was an unprecedented assault on the seat of american democracy. it's described in the indictment. it was fueled by lies. lies by the defendant targeted at obstructing a bedrock function of the u.s. government. >> well, the words jack smith is saying are based on what a grand jury has found probably cause which means more likely than not the former president did exactly what jack smith just said.

i think the challenge for judge chutkan is how is she going to balance donald trump's first amendment rights versus his position as a defendant in this case. i think he has a long history of saying inflammatory things. we saw it particularly after the election from everything from the debate stage saying to the proud boys stand back and stand by. he set up the rally, be there, be wild. we saw how his campaign sent fund raising e-mails day after day telling folks there's going to be a fight, the trump army up until the capitol was attacked. so, the former president has a long and extensive history. if he violates the speech, what does he do? when i was a prosecutor when you have time for a defendant threatening people on facebook and the judge says things like

that's -- >> explain to me, it's in my hand. i'd like you to explain. it seems the summary of this is trump wanted to get this thrown out. the judge said no and did some sort of summary judgment saying you did it. you did overvalue your assets. is this case over. it's not but is a big, big victory for the new york attorney general. trump, his two adult sons have engaged in repeated, fraudulent activity. so that ruling he's been found liable. the trial will be dead they falsify business records, financial statements and commit insurance fraud. and he's the bench trial. so there's no jury so that judge will decide that.

the reason trump has been fighting for so long, if he loses, his two adult sons are barred from ever being an officer in a new york state corporation and they're barred from getting loans in new york state from my bank. it's a big deal. he's not going to jail. it will effect his business. >> alvin bragg declined to take this, a very similar case to trial on a criminal basis. if this, if he loses this, is he at risk of maybe bragg going you know what, maybe i don't just care about the hush money. i care about this. >> exactly. now it's prepond rans of the evidence so perhaps the d.a.'s office was looking to see the evidence to see maybe we'll go for it. the investigation is still open. d.a. bragg has said it's not closed so there is still time if he chooses to go to the grand jury. david, we woke you up.

follow? >> honestly, i was actually surprised that i was the first one. it's black and white. so clear. the last times there's ever been a man with so much cash in their home in new jersey was tony soprano. it's not a close call. and if you were looking for the most incriminating kinds of evidence, nobody could even come up with gold bars in a mattress. so and again, he's entitled to have his day in court but he is not entitled to remain in the senate and he needs to go. >> you know, a lot of people think about the quickness senator al franken at a time when they really needed his vote, it was the 60th vote that got us obamacare to pass in the united states senate. there were people who are quite, a lot of moral rectitude when it came to him. have some of those senators,

that have not called senator menendez to resign. i wonder if some of the more i should say, sanctimonious senators that we have heard from on things like senator frank and other issues have come forward. i think about christian sinema, we haven't seen her saying much. we have not seen joe manchin saying much. have you heard from any of those senators and what they think of all of this? >> obviously i don't before anyone else in the senate or myself but what i can say is that you know he has to go. new jersey is a save, blue sea and they have a governor ready to appoint somebody that is ready to step in and make that kind of votes that it needs to do and again, it is never been about him, it's about the senate and the integrity and he needs to go. >> you know you've been the subject of a lot of right-wing freak out and your casual dress code, which again there people accident or sinema who dresses as you know, in our very own
