york state attorney general letitia james for bringing the case. >> this case should be dismissed. this is not a case. she should probably be dismissed also. president biden's son hunter pleading not guilty at his arraignment in delaware on gun charges. he faces a trial ten weeks after his plea deal with the federal government collapsed. ♪♪ good day. i'm andrea mitchell in new york. the speaker of the house of representatives could be ejected from his leadership post with the house coming back into session right now. speaker kevin mccarthy is in a political fight for his life as a member of his own party, representative matt gaetz, is pushing to oust him and has enough republicans lined up against the speaker to bring him down unless democrats come to the rescue.

>> i have enough republicans where at this point next week, one of two things will happen. kevin mccarthy won't be the speaker of the house or he will be the speaker of the house working at the pleasure of the democrats. >> joining me now is garrett haake and former republican governor, congressman and presidential candidate, john kasich. garrett, none of us have seen anything like this. it's chaos up there today with different factions, both parties conferencing and coming out with different points of view. what do we know about whether mccarthy can survive this vote which could come up as soon as an hour from now? >> reporter: kevin mccarthy has proven himself a very adept political survivor over the last nine months or so. he may be out of moves. this may be checkmate for his speakership. he has indicated he will go forward with this motion to vacate. he has the option to schedule it at any time. he will go forward with this

this afternoon. matt gaetz said and we have been doing our own vote counting here, that he has enough votes that mccarthy would require democrats to support him to remain as speaker. democrats have made it increasingly clear, after a two-hour closed-door meeting in which dozens of house democrats voiced their opposition to kevin mccarthy, that they are not going to save his speakership. here is what hakeem jeffries told us after the meeting. >> we encourage our republican colleagues who claim to be more traditional to break from the extremists in the chaos, in the dysfunction, in the extremism. we are ready, willing and able to work together with our republican colleagues. but it is on them to join us. >> reporter: the house democrats i talked to basically explained it this way. they see mccarthy as a symptom of this larger problem, not somehow the more

alternative. they say he can't be trusted. his extremism goes back to his embrace of donald trump. they don't see this as a choice of a lesser of two evils. they see it as the mess republicans have that they will not help clean up. we will see how this plays out on the house floor. >> john kasich, you served in the house. what do you make of this war? especially considering they are behind on funding the federal government after passing a 45-day extension. they haven't done any appropriations bills. it's complete chaos up there. >> andrea, i said from the beginning, i thought that reasonable republicans with reasonable democrats could have come along in the beginning and selected somebody and marginalize the extremes. they didn't do that. i hate to go out on a limb here. i'm with you so i'm going to do

it. i think he is going to survive. i don't know -- first of all, the democrats say they don't like mccarthy. people never like the leaders in the other party. they say things, a lot of rhetoric. we have seen that -- i have seen it all along from the time i was in there. at the end, whose interest is it for mccarthy to go down, for there to be no speaker, to go through another long, withdrawn kind of voting? who will it be? one way or another, either by abstention, which would help mccarthy, i sort of thing -- my gut tells me he will survive. i have heard the report from garrett. it's an important one. it's insightful. my instincts say one way or another, i think he will make it through. then we just gotta see how they proceed. i will tell you, even though there is no hint that the republicans and mccarthy and jeffries are talking or

whatever, i guarantee aides are talking about what might come, what might not come. i sort of think he will make it again. whose interest is it to shut the government down? who does it benefit? you will not have a vote on ukraine. you will not have a vote on border security. whose interest is it for the government to just shut down? it makes everybody look kind of crazy and out of touch. that's what i think. >> importantly, it's not in the interest of the president of the united states who believes in bipartisanship and whose economy -- the american economy is at stake. john, garrett, thank you both. garrett, stay with us. we have other reporting coming up. bringing in now mike quigley, democratic congressman from illinois. the only house democrat who voted against the short-term measure that averted a shutdown to keep the government open for 45 days because it did not include any money for ukraine. congressman quigley, would you vote for speaker mccarthy to

keep him in office? >> i think that first vote saturday reinforces why i wouldn't want to help speaker mccarthy. he put out a bill and passed it to save gas stoves, but he wouldn't put money out to save ukrainian lives. you know i was in the room on january 6th when the far right crazies attacked our democracy and our capitol. the next day speaker mccarthy said that he blamed trump for that. then later, he attacked the january 6th panel and tried to delegitimize it. it's hard to support a guy who you can't trust, who works against the interests you care about most. >> what is the alternative? if there's no speaker in place, there's paralysis. nothing can get passed, including a separate deal on ukraine. >> look, it wasn't going to happen under speaker mccarthy anyway. again, this is their civil war.

at this point, if the best we can say about mccarthy is he might be better than somebody else that we put in place, that's a tough vote to take. >> tell us what happened in the caucus meeting today. >> look, today -- first half of the meeting was regular business. second half is how this is going to proceed. none of us have been through this process. listen to what the members of the caucus had to say about this and what they thought we should do. >> what's your take on where the caucus is headed? >> i don't speak -- i don't think speaker mccarthy will get any help from this caucus. let me reinforce, it's another reason i voted no on saturday, because i thought it was our last best chance to do it. we had the votes to do it then. this is an unforced error. unfortunately, all this chaos and that vote was a victory for putin. >> let me ask you this also. i know how important ukraine is

to you and how you voted on that before. if there's nothing that's going to get passed, isn't that worse for ukraine than at least the agreement that has mccarthy now -- mccarthy, mcconnell, schumer and the president on it from saturday night, which would be that there will be a separate bill on ukraine, which may or may not have border -- most likely would have border money in it, too. >> no guarantees were made. the fact is, last thursday the house voted roughly two-thirds of the vote for a separate bill funding ukraine. further evidence that we had the votes to accomplish that. look, i get the chaos that's there. we didn't bring it about. you can't help a speaker who we know will be more chaos and renege on everything he made promises to. this was avoidable in june. there was a deal to avoid the debt ceiling issue and to fund the government. a week later, the speaker reneged on that and lied about

the fact that he had made any promises. >> one more thing also, i keep saying one more thing, but i have so many questions because you were in the room where it happened. how big a deal was the impeachment hearing that mccarthy let happen last thursday in house oversight? >> the list is long and legitimate reasons people are mad. a baseless impeachment inquiry. there's a long list of grievances. i think pretty much the caucus consensus is, we could do worse, but how can you support somebody who has been this bad for the issues that we care about? >> congressman mike quigley, thank you very much. let's bring back garrett haake. what's your take? >> reporter: democrats have been remarkably unified in this

congress. going back to january and the 15 votes for speaker jeffries, they have hung together on these issues, even one of the most conservative democrats will stick with jeffries and the conference on this. with all due respect to governor kasich's gut, the democrats are interested in saving mccarthy. it wouldn't put us back into a situation like we were in in january when there was no speaker. there would be a speaker pro tem who would have limited authority. a little bit of chaos, but it wouldn't go back to the chaos we saw in early january. >> levels of chaos. >> reporter: on this beat, there are. >> i do want to ask you about a serious and frightening thing that happened last night. a carjacking with the texas

congressman as the victim. tell us what happened. >> reporter: he told reporters he was coming back to his apartment or leaving with food last night. he lives about a mile from the capitol when three people held him up at gunpoint and demanded his car. he described the scene and trying to stay calm in an interview in the last hour. >> you could tell there were -- they were young folks. i hate saying this, they were young punks with guns. i looked at one and he said, i want your car. i looked to the other side. there another with a gun pointed at me. i looked behind me, there was a third guy behind me. i said, sure. stay calm in this situation. i gave him the key. >> reporter: he has been working with capitol police and the local d.c. police. his car has been recovered.

violent crime in general and carjackings specifically are way up in d.c. this year. it's a major local story touching a major national figure here overnight. >> three men all armed with guns on them. that is terrifying. carjacking, according to our data, that's up 100% in the district in this year. it's a real problem. garrett haake, thanks so much on all of that. joining us now is stephanie bice of oklahoma. she helped speaker mccarthy avoid a shutdown this weekend. i don't know if you heard, but mike quigley saying that from his perspective, they just cannot trust speaker mccarthy and they will not help him get out of the bind. what does that mean for his speakership? >> this is a gift to matt gaetz. he is not interested in making sure we continue to govern.

he has suggested that he wanted to see the appropriations process move forward, but in fact, he is thwarting that by putting a motion to vacate on the floor. let me be clear. this isn't about kevin mccarthy. this is on matt gaetz. matt gaetz wants to wreak havoc and chaos within the republican party. he is doing just that. unfortunately, the american people are pawns in his narcissistic game of charades. >> do you think that you could rally enough republicans, including some republicans from biden swing districts, to go with you? is the number five republicans -- if you lose five republicans, he lost the speakership, if the democrats hang together? >> we have a slim majority. it's a four-seat majority currently. we think there are as many as seven members of the republican conference that are not interested in supporting the speaker moving forward which

throws the house into chaos. we want to work on the appropriations process. we have been doing that. it's disingenuous for matt gaetz to stand before the press and say that he wants to continue to change things in washington when we tried that. we put a conservative continuing resolution on the floor on friday that continued to fund our defense, cut spending for non-defense agencies by 30%. it fully funded our border patrol agents and protects them and put initiatives in place. yet he voted no. he and 20 other republicans voted with every democrat to not continue to not fund government. he doesn't want to pay his service members, which he proclaims he wants to support, because he represents a district with many servicemen and women in it. he doesn't want to protect our border patrol agents, who are fighting tooth and nail against this administration's lack of

securing our southern border. what is he for? >> is there someone -- let's just say that those seven vote against him and the democrats don't wore -- they don't rally to his defense. what's plan "b"? >> we will stick with kevin mccarthy. i was in a meeting this morning where 95% of the republican conference supports kevin mccarthy. if you look at his track record, he has continued to push conservative policies forward that have been passed by the house. hr1, energy policy, hr2, border security, fiscal responsibility act, which caps spending and cuts spending from the fy23 numbers. these are all wins. i would also just argue, what has the senate done? we have been passing what we believe are bills that affect the american people. the senate has been sitting on their hands looking at judicial nominations and not looking at

former president trump is back in a new york courtroom today for day two of the civil fraud trial against him and his two adult sons and the trump organization. a few moments ago, trump was asked during a break by reporters if he will take the witness stand. he said he will at the appropriate time if he is called. he was listed as a potential witness by the attorney general side. the judge found him liable for fraudulently adding billions to

his properties to get better loan deals. it will determine who is to blame for that fraud and how much penalty must be paid. in a taped deposition played in court monday, michael cohen, trump's former lawyer and fixer, that trump instructed him to inflate the values. >> mr. trump would call us into the office. let's say it said he was worth $6 billion. he wanted to be higher on the forbes list. he then said, i'm actually not worth $6 billion. i'm worth 7. in fact, i think it's now worth 8 with everything that's going on. allen and i were tasked with taking the assets, increasing each of those asset classes, in order to accommodate that $8 billion number.

where donald trump sits in the courtroom and then walks out and speaks to camera with his own version of the events. for donald trump, this is day two of sitting inside of the courtroom. it's not clear how many days he intends on being here. if he sticks around long enough, potentially this week, weisselberg, who served time related to state charges in a plea agreement he made as part of a tax fraud scheme at the trump organization, as well as the controller for the trump organization, jeffrey mccony, both will testify as soon as this week. so far, witness number one remains on the stand. that's donald bender. the defense hasn't had their opportunity to cross-examine him because of the hours spent with him from the new york attorney general's office. he was the accountant who was working on trump's personal tax returns from 2011 through 2020, preparing them. so far on the stand, taking questions from the prosecution,

he has suggested that he all but took the word of the trump organization and their financial records and their statement of financial conditions that they signed as legitimate. not only the family members, donald trump, weisselberg. he was answering questions that it became apparent to him by 2013 he was not receiving all of the documents needed to accurately prepare donald trump's tax returns and began asking for, as an example, appraisals beginning in 2013 from the trump organization. he sort of is a linchpin before they get to the trump organization financial witnesses to kind of lay down what he, while trying to represent donald trump as his accountant, actually had access to and what he didn't have access to. >> if he were to take the stand, they can call him. they put him on the list. he can take the stand. he can take the fifth. then there's an adverse

inference to that, because it's a civil case. it's not without some penalties. >> it's a judge. the judge will take an adverse inference. it doesn't look -- it would look bad in front of a jury. he is going to testify the way he has been doing it, outside of the courtroom. giving his own version of the facts, which is why -- i'm not critiquing the judge. why it's important that this trial should have been televised. he couldn't give alternative facts because people would see what was going on. that's not a critique of the judge, just a statement. >> did he have the option? >> the judge has, in new york, discretion to do that. you saw video, which have been played over and over again, the judge allowed early on video of the parties. he said absolutely not for the rest of the trial. >> it's not the same as hearing evidence. >> exactly. >> jeremy, you have been

covering donald trump for a long time. he seems to be more focused on this, feeling threatened by a civil trial which could cost money but not cost him going to jail or some other terrible penalty down the road if he is convicted. this is the case he is focused on. he doesn't have to be there, but he is showing up. >> he is showing up, that's right, because he wants to turn it into a tv show. this is what he did from the opening moments of his campaign, what he did during his presidency. he wants to set this trial on his terms, frame it as his -- he knows his supporters will see it. as they are hearing it portrayed in conservative media. it's being held up as a sham, as another sign the justice department -- or the american justice system is rigged against him, not only because it allows biden and democratic prosecutors to go after their chief political opponent, but also because that same justice system they will argue allowed hunter biden to cut this sweetheart deal. from a number of fronts, trump

and his supporters are trying to undermine the credibility of law and order in the united states saying that this is all stacked against him. it appears to be working if you look at the polls of republican voters. >> they keep going up as he gets indicted and faces these courtrooms. speaking of courtrooms, he is attacking the attorney general. is she just going to let that happen? >> there's nothing she can do other than be dignified, which she has been, and show up in court. she's not personally trying the case. her lawyers are. she's there because it's an important case. he attacks the judge, the judge will shake that off. the problem is, he has many supporters. some of them may not be law abiding. that just puts fire -- i mean puts gasoline on the fire for people who may not be stable. that could cause -- we hope no dangerous threats to either the attorney general, the judge, or the other people that he criticizes on a regular basis.

or felony federal charges filed after his plea deal fell apart in august. hunter pleaded not guilty today through his lawyer, but could face up to 25 years in prison. that is extremely unlikely a a first-time offender. while that played out in wilmington, two hoursaway on capitol hill, house investigats in the biden impeachment inquiry are questioning the federal prosecutor who an irs whistle-blower says refused to bring a tax case against hunter biden. joining me from outside the court in wilmington, tom winter, and mike memoli. back here is former manhattan assistant d.a. catherine christian and joyce vance. tom winter, you were in the room. tell us what happened.

>> reporter: 70 days ago, we had what we thought was going to be a standard plea agreement, even if some of the terms were a little bit different than normal. those would typically last an hour to two, depending upon how the judge wants to discuss it and conduct it. how much the defendant in that particular instance, hundredor -- hunter biden, would have to say. that fell apart. today's hearing took place two floors down in what seems like a world away from that moment when hunter biden made his initial appearance and his plea. different from last night. it was following a script from the judge today. that's what they have to do. they have to make sure hunter biden was aware of the charges, that he understood the specific counts, the specific potential penalties, and then the judge was able to take his plea, which was not guilty according to his attorney, who entered it on his behalf. he said the conditions for his

release, the same he has been out on. we did pick up a little bit of a detail there. it's consistent with what we have been told and what we reported. hunter biden has had several drug and alcohol tests since late july, since that guilty plea hearing fell apart. they have all been negative. we did get a little news at the end of the proceeding, i'm sure our legal analysts anticipated these challenges, which the lawyer says the team is prepared to file for dismissal. a two-pronged approach. the first one is going to focus on the idea that the pre-trial diversion agreement, which addressed the gun possession conduct, it was charged in this indictment, that that is still in effect. so this never should have been filed and is null and void effectively. they are saying hunter biden signed it, federal prosecutors signed it. it's an agreement between the two. there's no reason why this should move forward. the head of probation did not sign it, obviously, federal prosecutors have different ideas. otherwise, they wouldn't have filed this in the first place

and moved to dismiss that information as they are expected to do. that's prong one. second prong is that they will try to ask for a dismissal based on the constitutionality of at least one of the charges that's been brought here. that argument, some legal analysts think, has more merit. >> that's because in the fifth circuit, there's an adverse ruling against one of the charges, one of the gun charges here. catherine, what are the chances of dismissal based on the fact there was the prior plea agreement? >> not dismissal by the prosecutor, because -- >> i mean by the defense -- the defense argument the judge should dismiss the case. >> you know what, it's a good argument that both sides signed it, it's a contract. the contract should stay. the fact that probation didn't sign it, you know, may or may not be relevant. probation would be interviewing him to see if he was suitable for this. it probably will fail. i think that's why the

prosecutors went ahead and presented this indictment. they did it so quickly, because the statute of limitations runs october 12th of this year. that's why they had to move quickly and indict this case. >> joyce vance, what about the constitutional argument because of the supreme court considering -- they have taken the circuit appeal, the appeal on the fifth circuit decision ruling against that gun charge. >> it's a very interesting issue, andrea. in last term's case, the supreme court held it was unconstitutional for the federal government to impose restrictions on gun possession and gun ownership that weren't in existence at the founding of the country. hunter biden is charged with being a drug user in posssn of a firearm. that's not a restriction that was in existence at the founding. so we will get an opportunity to see whether the supreme court

really meant what it said. if so, that would dictate that this indictment be dismissed. procedurally, it's early. the fifth circuit decision is not binding on a court in delaware. we will see what the judge decides to do with it. >> if the supreme court upheld that, that would mean all gun restrictions that have been passed for decades now would be invalidated. it would be huge. mike memoli, that would be another issue for the president. he has no public events today. how much is this arraignment and the impeachment inquiry weighing on him? >> reporter: andrea, the number one concern is that the president's love for and concern for his son is really crowding his attention at a time when he needs to be sharpening his focus and sharpening the country's attention to the contrast between him and donald trump, his likely opponent at this

kevin mccarthy from his leadership role. mccarthy told his republican conference he would bring the motion to vacate early in today's session. joining me now is mike turner. thanks for being with us. >> thank you for having me. >> will you support speaker mccarthy? >> absolutely. he brought support of the conference today. everyone raised their hand indicating he is the person we want to lead this house. this is a small group of individuals who want to shut down the government, that would have achieved nothing. they have been voting repeatedly against conservative amendments on the floor and conservative packages. they are not conservatives. this is their own vendetta. i think everybody will stand strong behind kevin. i would bet on kevin mccarthy any day. >> he doesn't have enough republican votes. according to all the head counting, the whip count is there are at least seven against him. he needs democrats. the democrats seem to be organizing today against him. they have strong feelings.

>> right. these guys, this small group of who are opposing everything, they need the democrats to pass this motion. it's not that kevin needs democrats. they need democrats. today if this motion passes, matt gaetz and his gang will have done so by joining with democrats to take down the republican speaker. >> how does he hold on? explain to me how he can have enough support to get a majority to keep him in the chair. >> i can tell you that the support for him is overwhelming, other than that small group of individuals who i think have a personal vendetta and are against everything. they wanted to shut down the government. now they want to remove kevin mccarthy. they are tearing everything apart and burning the house down. this group is not going to be successful in the end. i think we will have kevin mccarthy as the speaker.

>> can you get enough democratic votes to join your large majority of republicans supporting him? but can you peel off enough democrats to come over? >> there's all kind of different strategies that are being played out here. i think we will have to watch this unfold. this is going to be a significant amount of drama, much like when our effort was to elect the speaker. phenomenal job. people will join with democrats, the same people that wanted to shut the government down, are trying to take out the future. >> what's the future of ukraine funding? will it stand alone? will it be with some border funding? >> we have had over 300 people vote in favor of continuing ukraine funding out of the 435 members of theoverwhelming suppr ukraine funding. this administration has been neglectful of the border. you see the videos on every channel of your news of thousands allowed to cross.

this needs to be addressed. there's reason not to address the border immediately. we have to take care of ukraine funding immediately. i think these will move together. >> what if the speaker -- what if you have an interim speaker? could the ukraine funding be in jeopardy as well as coming up with long-term funding after the 45 days run out? >> i think things are going to be difficult around here for a while. at the same time, you have support in the house for these measures. i think what you will see is there's going to be some real difficulty in getting things done. in the end, the majority will prevail and we will get this done. >> as the intelligence chair, you might have concerns as well. the president is calling world leaders to reassure them the ukraine funding will continue. vladimir putin is watching this. president xi is watching this. what's the impact on our foreign policy? >> this certainly is very

california will get a new senator today to replace the late dianne feinstein. when vice president kamala harris swears in laphonza butler, the head of emily's list. a long time activist in california for progressive causes, butler will be only the third black woman in the senate and the first openly gay senator from california. she was appointed by california's governor gavin newsom to temporarily fill the seat. he passed over the preferred choice of a congressional black caucus, who has been running as a long shot in an already crowded field and butler has not ruled out running for the seat in the march primary herself. joining me is mark murray. so, mark, this is getting a little confusing because it was always thought that gavin newsom was his decision, said it on "meet the press," it would be a temporary post, not anyone who is already a candidate. not to put his finger on the scale. and now butler has, since she

was named, has not ruled out running in the march primary. and the california democrats are not happy and they -- the congressional black caucus is very unhappy about barbara lee being passed over. she's been in the race and widely believed to be number three in the race, in terms of polling and money. >> yeah. andrea, this has all created a tremendous amount of intrigue. precisely because as you ended up mentioning, a month ago, gavin newsom, california's governor, went on "meet the press," said pretty unequivocally that this pick if there is a vacancy for the feinstein seat, would be an interim appointment. and then all of a sudden flash forward to yesterday, where newsom was saying, well, it is actually now up to butler to decide what she wants to do. and the silence from butler, at least as of now, not ruling out a potential run, could end up

scrambling an already competitive and expensive california senate race, andrea, where the featured candidates are the likes of adam schiff, the democratic congressman from california, as well as barbara lee as you just ended up mentioning, the congressional black caucus asking newsom to make her the pick and katie porter. already those candidates raised millions of dollars and it is important to note that california has a top two jungle primary system where the top two candidates in the march primary advance, regardless of political party. and so all of a sudden going from three well known democrats to a fourth democrat who ends up being the interim or at least the appointed senator could really, really scramble this entire race. >> and it really does disadvantage barbara lee. she was a former head of the plaque caucus, very popular, and she has been outdistanced by both katie porter and adam

schiff. so, there is a congressional component to this as well. >> yes, and as you mentioned, the congressional black caucus before this pick by gavin newsom urged the california governor to make her the pick after the late dianne feinstein's passing. and so, yes, you know, again, we have no idea what butler will end up saying, but having four candidates running three possibly being women, two women of color, could end up just creating just a big shake-up in this contest. and then, andrea, also worth noting too that butler, you know, already, if she does decide to get into this race, would need to actually start raising money and fast, though coming from emily's list certainly has, you know, connections in that democratic fund-raising world. but also just, you know, she had been living in maryland the last two years before being tapped
