what this means for don trump. that's live in the next. >> a good saturday morning to you all, i am katie phang we officially enter week three since terrorist group, hamas, surprise attack on israel during the jewish day of the sabbath. israel's looming ground invasion threatens millions in gaza as airstrikes continue overnight. thick dark smoke can be seen billowing from buildings. this morning, much-needed humanitarian aid, the united nations says will be the difference between life and death is trickling into gaza from egypt. the rafah crossing opened for only a few minutes to allow a caravan of critical aid to be delivered after a 24-hour delay. video shows 20 trucks loaded with supplies, like food, water, medicine and fuel crossing into gaza. the u.s. state department

reports the rafah crossing may open for some foreigners to evacuate later today. and while the united states reports 200 hostages remain in gaza, the first two hostages were released yesterday. americans, judith tai raanan and natalie shoshanna rode on from edmonton, illinois, were united with family in israel. u.s. officials are getting ten additional americans who are remaining unaccounted for back home this morning. joining me now is nbc senior national correspondent live from tel aviv, israel. jay, good morning. what is the latest update on the rafah crossing temporarily opening, not only for foreigners to get out but for humanitarian aid to come in? >> yeah, and to this point we have not seen any of the foreign nationals make the trip back into egypt. we have seen, as you talked, about the 20 trucks move through. it was a very brief opening. open long enough for the 20 trucks to get in and now they

begin the distribution of the food, water and medical supplies that have been so needed there for the last two weeks. we know there are more than 2 million people in gaza caught in the cross fire here. and they've all desperately been needing some type of delivery to give you an idea of what they normally see in the region, 400 trucks a day deliver goods into gaza. this is 20 trucks for the first time in two weeks. aid agencies in the u.n. have said that we would need 100 trucks with supplies each and every day to fulfill the need there. and one important factor in all of this is, while they are bringing in the food and water and the medicine, there is no fuel going and that is something they are in desperate need of as well. hospitals on the verge of not being able to run equipment, no power, generators can't be run without fuel, that is something they are pressing for as well. he talked about the foreign

nationals the state department says there were about 650 americans and gaza we know many have gathered at the rafah crossing with egypt, anticipating that it would open and some people would be allowed to clear through. we have not seen that at this point. it continues to be something the state department as well as those on the ground or talking about. >> jay, only two americans have been freed by hamas in the surprise released yesterday obviously dozens more still held captive by hamas. any news whether or not more hostages might be released with the assistance of qatar? >> first of all, katie, grade that the mother and daughter were released. let's remember, judith was released on humanitarian grounds. she is ill. that is according to hamas, the reason why she was released. as you would expect, everyone playing it very close to the best as far as negotiations to

release hostages. we know there are about 200. the state department has said there are about ten americans still accounted for. we believe many of those may be hostages as well. we know that officials in qatar are working as intermediaries between hamas and the other foreign entities trying to have their hostages freed. again, at this point, it is all backdoor diplomacy and something that you can understand, they don't want to share publicly for fear of blowing any kind of deal. >> jay, thank you so much for joining us live from tel aviv, and getting us this information we appreciated, and please stay safe. so, it is also 17 days without a permanent speaker of the house. it does not look like we will get one anytime soon. it is three strikes, you are out, for jim jordan after three failed floor votes this week as republican colleagues ousted him as speaker designate and a secret ballot vote. now, at least ten repus have thrown their hats into the

speaker race, including re election deniers the deadline for members to file their candidacies for speaker's tomorrow noon eastern. while the temporary house speaker, patrick mchenry, leaves the chamber through this tumultuous process of finding a permanent speaker, nbc news exclusive report finds he is now threatening to resign because of all the chaos. nbc news capitol hill correspondent, julie tsirkin, joins us live. julie, the house is expected to vote yet again for a possible permanent speaker replacement on tuesday. any front runners that you see or hear emerging in this growing field of speaker hopefuls? >> they are having the candidate for a monday night. the third candidate forum in the last two weeks as they try to find another nominee. you mentioned the expansive list of potential contenders. there is almost a dozen of them. ront runners come to mind, that includes tom emmer, already endorsed by kevin

mccarthy, the former house eaker. amar was part of this leadership team. he was part of the team who -- now he's trying to rally the votes for himself. you see the other contenders on his screen the problem for emmer, the hard right conservatives that took issue with mccarthy will likely take issue with emmer because he's part of mccarthy's former leadership team. he's someone who is seen as more moderate than a jim jordan, who is a conservative flamethrowers. definitely somebody the heart rate was sad to see lose out yesterday, especially in the secret ballot held after the four votes where jordan lost half of his conference. where do we go from here? monday night, the candidate forum behind closed doors, they will hoping they will pick someone else yet again after scalise and jordan were chosen in the first two rounds. tuesday morning, we are -- told they want to hold a speaker election on the floor. the magic number of 2:17, they can only afford to lose about four republican votes.

>> nbc news, capitol hill correspondent, julie tsirkin, thank you for joining, us i appreciate it. let's bring in democratic counselor and congresswoman, sarah jacobs, with more insight. congresswoman, thank you so much for joining us early this morning. i want to start with something hitting close to home for you. that is the israel-hamas war. you are the youngest jewish american member of congress. you have family living in israel. you have said, we need to lead with our values. what is your reaction this morning to the humanitarian aid that is finally being able to cross into gaza from egypt? >> as he said, i have family who lives there i understand the importance of what is going on there and the urgency the israeli government is feeling right now. but i'm very glad we have seen some humanitarian assistance get through the rafah crossing. this is something that president biden really pushed while he was there.

he was able to negotiate that while he was there. but let's be honest, 20 trucks is not enough. while this is a very good start, we need to be doing a lot more to make sure that we are addressing the humanitarian situation in gaza. >> congresswoman, we are watching things like jim jordan trying to become the permanent speaker, failing three times, we are seeing hakeem jeffries name being put forth strongly and in unity by the democrats we talk about getting to do 17 and -- more centrist voices from the republican party joining the democrats. americans are being held hostage by the gop right now. nothing is getting done. no legislation has been presented since september 30th. an erosion from the solidity -- solidarity from the gop, nobody is going to break ranks, come join the democrats? >> we have both publicly and privately message that we are open to a bipartisan way forward. i would love if five republicans came and voted with

us and hakeem jeffries became speaker. but there are many options that a bipartisan way forward could look like. i'm hopeful that some republicans will take us up on that offer as wig clark said, take yes for an answer. work with us so we can get the house reopened a back of the business of the american people. >> how exasperating is it to see names like these, also rebel rousers in the right, putting their hat into the race. throwing their hats into the ring to be beat the sport -- permanent speaker of the house? >> at this point, democrats are open to a bipartisan way forward and part of that will be trying to stop anyone to become speaker who objected to the 2020 election, trying to overturn the election. so it's disappointing to see so many people who still feed into the big lie, putting their name in first beaker.

i was in the house chamber on january 6th, it was my third day in office. i was sworn in on january 3rd. i remember how terrifying it was. and how real it was. we have people who want to leave this body, who still feed into the very thing that incited that violence. it is deeply problematic. >> congresswoman, before i let you go, i have to ask along that vein, it is alarming that there has been the normalization of violent and violent rhetoric within the gop. how has it been viewing what is happening on the other side of the aisle? the fact that death threats have been made when people didn't vote for somebody like jim jordan? >> it's very concerning. it should be no surprise that jim jordan is willing to use violence to overturn the will of the people and change an election outcome. we have seen him do that before. but i actually used to work in international conflict

resolution and i know that, actually, this normalization of political violence is incredibly dangerous. it is the first step of what could be a dangerous and difficult path. i am very concerned about a lot of the rhetoric that we are seeing from the other side, the threats and intimidation and violence, frankly, that we are seeing. >> congresswoman, do you think it is worse -- i've been advocates for investigations to be done with these threats that have been made, is there some interest on your part to make sure this does not happen? that it is not continuing in any way by investigating who is making the threats? >> i, mean i think it makes sense to do that. to make sure we understand who has been encouraging, it especially from inside the body. at the end of the day, this is a republican civil war. this -- republicans need to figure this out amongst themselves so we can all get back to work and get back to the important work we need to do, with all the crisis happening around the

16's -- in the meantime, house republicans have fled washington amid their week long speaker saga. the caucus now planning to regroup on monday for a speaker candidate forum. joining me, now democratic -- and republican's tragedies, student -- both nbc political analysts. so good to see you guys. it has been a while. let's start with, you are here. republicans go from kevin mccarthy to jim jordan. i mean, there is no quality control apparently going on in the gop. now you're looking at that list, byron donalds? i mean, it's not getting any better for them. they have to go behind the scenes and they have to figure out how to get behind to create a new speaker designate. what are the chances of that happening? >> the chances are not good that it will happen quickly, katie we've seen this despite -- this function on display for 17 days. it's easy to get caught up in the political horse training and race of who's going to be the next speaker. i think it's important that america take a timeout and understand how dysfunctional,

yes, but how dangerous this moment is for the country. katie, this is a problem that is wholesale owned by the republican party. the maga republican extremes has created the situation that has put our country in extraordinarily vulnerable situations. or congress literally cannot function. there is no speaker of the house. and for all of their acting and temporary approaches, that is not how government was designed to work in this country. i suspect, and fear, if we are candid about what is going on, this is exactly what maga wants to happen. they want to burn it all down. and we are living for this in realtime. beyond the dysfunction, this is disqualifying. i think the american people have to take a really long, hard look. do they want this chaos wholly owned by the republican party brought to the congress by the republican party where they are comfortable going to, three, four weeks? maybe longer? without a functioning speaker of the house of representatives? or do they want the unity, the

competence, the intelligence and the seriousness that the democratic party and the democratic caucus wants. it's important, we sometimes lose sight of it in the jockeying for who is going to be the republican speaker. >> susan, are we at that point where it is the proverbial dog having caught the car? the chaos that they wanted to have, donald trump did through his surrogates, through the jim jordans, the matt gaetz, the kevin mccarthy's, they got it. but it is clearly not going to there benefit. for americans at large, it is not helping them either. >> right, and that is their goal. to have government stop. that is it. they do not want it to function, those maga republicans. they do not want to govern and they certainly do not care if they are in the majority or not. what we have to start looking towards is the minority of both the democrats and republicans probably getting together to

come up with some solution. because if you want to govern, you cannot do it in partnership with maga republicans. you just can't. and as for india mentioned, we have our legislative branch, i notice the house but for all practical purposes the senate can't do much without the houses working together. our legislative branch of government is not working. and it four weeks, we are going to hit a shot down. the republicans will get blamed. make no mistake about it. but you have a group of maga republicans that don't care. they don't care if they lose the majority come 2024. so that is why it is up to those republicans who really believe in governance. and there are those republicans that believe in it. they need to come together and come up with a similar deal that the senate hat in the first two years of the biden administration. some sort of power arrangement where republicans make chair of committee. there is equal members of disease and hours on each

committee. they have to -- bring a bill to the floor and have a vote it is democratic, it is the way to move our country forward. so we know that there is going to be some republicans against it. but that is really where we should be headed. inst it >> you, know the house majority whip, tom emmer, his name is being thrown into the mix as a possible nominee, a speaker designate for speaker of the house. we are hearing now, donald trump says no. i don't support it. do you think they are still listening? donald trump did not lift a finger to help kevin mccarthy, when he was on the skins. >> you know, the extreme maga cult personality republican members are listening. the cult leader says no, he is not good enough. and so his forever problem with trump is that he voted to certify the election results. that is a bridge too far for anyone in the maga caucus. but katie, what is this going to come down to? i think there is a way. people, say is it possible for hakeem jeffries to end up speaker? it's going to be difficult, almost impossible, but it is a

road to one. if there is one republican, member of the congress, who is thinking about retiring saying, you know, enough of this, all it takes is one to break the dam and change the conversation. is there one out there? i know for a fact there is, i've talked to one republican member of congress who was, like i'm to the point where i want to leave. i can't do this anymore. it does not mean they are necessarily going to support hakeem jeffries, but that is the thinking. the longer this chaos, this dysfunction, this paralyzing of the american government while putin watches and licks his chops is the open question. are we going to allow that to continue or are some republicans going to work out a deal? i think that's what we will find out over the next couple of weeks. >> susan, is that a pipe dream? fernand is an idealist, that's the best part about him, he's a pragmatist but he's always living in the land of idealism. is that a pipe dream? i agree with fernand, and i agree with you, it is a democracy, it should work out that way. it should not just be a numbers game.

but you have to think, jim jordan still has a decent number of plug-in votes from the moderate republicans. they still voted for him. jim jordan, the insurrectionist so is it really possible to peel off enough to be able to get some but he like hakeem jeffries into the speakership? >> like fernand, i am a west wing energy, maybe the moment can happen. but it is doubtful. at the end of the day, i like the idea that it takes just one member of conscious, perhaps, but all the names that showed up there, none of them will be next speaker. it has to come deeper. i think probably someone like a tom coal, that name has been held in reserve for a good reason. one thing about donald trump, donald trump did not have a lot of media coverage between -- i mean, the georgia lawsuits

2020 election interference case, three defendants have called plea deals with fani willis's office. legal experts think this signals that more are on the way the latest domino to fall, chemist chesbrough who's been called the architect of this fake elector scheme -- one felony count of conspiracy to -- chesbrough has agreed to provide testimony that could implicate other co-dependence including president donald trump. chesbrough was turned over documents to the d.a.'s office to be in compliance with this probation as a lawyer for trump and his campaign it includes attorney client -- joining us now is the attorney for kenneth chesebro, scott i have to tell you, i watched you fighting the good fight for your client for a while. at the 11th hour, literally, you guys take a plea deal, or your client does. why? why the 11th hour plea for

kenneth chesebro? >> cristobal, katie, thank you so much for having me i really appreciate it look, that is often what happens in criminal cases like this whether it is this case or just a run-of-the-mill case, you file for three trial motions, you make the best arguments you, can you try to get the charges whittled down as much as you can you try to put as much pressure on the district attorney, the prosecutor, and then you know, sometimes towards the end when you're about to contrary, the reality sing sandwiches, my future is going to be decided by 12 strangers and sometimes that is a really sobering thought for a criminal defendant so i think oftentimes what happens is the closer you get to trial the more a defendant thinks about plea deals. this plea deal katie, in my opinion, was really just too good to say no to. because there is no jail time,

and i think just as importantly, the r.i.c.o. charge was dropped and so i think it's important to note that mr. chesbrough did not plead guilty to ricotta. mr. chesbrough pled guilty to conspiracy to commit a filing of false documents. while mr. chesebro was ready for trial, we were ready for trial, this was the best outcome. he is now home with his family and he can put this behind him. >> yes, but scott, i have to push back your client pled to a felony. he's the first want to have to plea to a felony thoughts far. he did not just plea to -- let's dig deeper. he pled guilty, no contest. he said i'm guilty of count 15 of the indictment which implicates donald trump, rudy giuliani, john eastman and a conspiracy to file a fake elector certificate knowing that that was not a truce. so your client may have gotten a probationary deal, but at

this stage he has admitted that the big lie was a lie and that everything he was doing was not right. >> yes, i'd like to push back, respectfully, on you katie. first of all, mr. chesebro never believed in the big lie. if you ask him, who won the 2020 presidential election? he says joe biden. you referred to -- i know you are quoting the district attorney's office and others but you referred to him as the architect of the fake elector scheme. i want to be clear about something, while yes, this is a facility he pled guilty to, it was the r.i.c.o. that accused him of being the architect of the fake elector scheme. . i want to ask you and all of your listeners, katie, for one moment to think about this question. if mr. chesebro was the architect of the fake elector scheme, if mr. chesebro was the architect of some plan to bring down democracy, which is what i've heard over and over for the last couple of months, both in court and out of court, with

the district attorney of fulton county have offered him probation and first offender status? i think the answer is no. and i think if you asked her the answer, it would be no. so while mr. chesebro did take responsibility for conspiracy to commit filing false documents, i want to make something clear. he did not implicate anyone else. he implicated himself in that particular charge. and while he is required to go testify truthfully if he is called by the state, and mr. chesebro is a man of his word and he will testify truthfully if call by the state. the state has to decide at some point whether they think mr. testimony will help them, and if they believe it will help them they will call him and he will testify. at the same time, katie, i will say, if he is called by a defendant, he will come testify and testify truthfully. >> scott, listen. you and i have been doing this for a long time.

although i technically don't do it anymore. i do this. but your client gave a -- what did he say? >> i'm not a liberty to say exactly what he said. someone asked me earlier, if you are donald trump, would you be worried? i can personally honestly answer no. it's not that mr. chesebro is trying to protect donald trump or anyone, else he's, not he's ready to move on with his life. but i was there. i won't say what it said, i will probably get in trouble, but i can say personally that i do not believe the state will call him to testify on their behalf. if they do, and i'm wrong, mister chesebro will be there, he will testify truthfully. if i were the state. i would not call him. >> scott, quickly before i have to let you go, another thing you said about being the architect of the fake elector scheme et cetera, your client

did not just do legal memos. the client was asked to the u.s. capitol on january 6th, he accompanied alex jones and others. it's more than writing legal memos. it is doing it at the behest of someone else. maybe he thinks that he does not implicate donald trump, but you and i both know he would not -- value to the state. the state would not give the plea offer to your client unless it was something they can help with the other defendants. >> i think the state gave the plea author -- because they weren't ready, and that is why we filed a speedy trial demand. that's why a lot of defendants do. let me say this. i disagree, he was not -- i think you said with alex jones. he was in d.c. on january 6th on business. he did see alex jones. he took a picture. i can absolutely promise you he never met alex jones, he took a picture because he recognized him from tv. and let me say this. i have personally seen text

messages, and so has the district attorney, where on january 6th when mr. chesebro found out about the horrible violence at the capitol, he said how much he detested it and he specifically said, and it's not now that he's sorry for what he, did this was on the day that it happened, he said i wish there would never have been a rally. i really wish this wasn't violent because it took away from what we, can and others were trying to do from a legal standpoint. so mr. chesebro detest the violent that happened at the capitol. he was not part of. it he was not in the capitol. i want to make that clear. >> scott, it's good to see you, i'll see you soon when your client testifies at trial in atlanta. i will see you. thanks, scott. >> thank, you katie could buy. coming up after the break. still relevant, three now possibly 16 to go.

interview i did with scott grubman, it's kenneth chesebro and sidney powell, it's two of the top in our circle people coughing plea deals from lawyers, which i think it's important. lawyers for trump. lawyers for the trump campaign. they are taking these deals, having to cooperate, grubman says he does not think there's anything of value he gave to d.a. fani willis what do you think about that? >> it, look. i think that scott grubman is a very smart lawyer i've seen him advocate in a very zealous faction for his attorney for the last few months with that said, i do not agree with him whatsoever that this is as insignificant as he makes it out to be. chesebro, the alleged architect of the filing of the fake elector certificate, that is a core part of the indictment in

georgia. and you know, i want to push back on what scott said about the fact that the r.i.c.o. charge was dropped to me that does not hold any significance about the supposed value of mr. chesebro potential testimony. anyone who knows anything about r.i.c.o. cases, knows that it is kind of like you have all these different crimes, all these different overt acts, the state proves the crimes and acts and it is all pleased together to allow that there was not -- there was an enterprise, and a conspiracy to overturn the election. it is the fake elector certificates that was the core of part of that conspiracy as alleged in the indictment. even if mr. chesebro did not clean out to the r.i.c.o. charge, this is an ignore miss significant thing that he has pleaded to a felony charge in which he admits that he
