are staging a write in campaign while his long shock challengers, congressman dean phillips and author marion millions and, are stumping for votes ahead of the state unsanctioned state primary. a new mayoral poll shows how new hampshire voters see this presidential primary. it sees nikki haley fearing best among potential republican -- congresswoman stefanik is out campaigning for trump in manchester today. days after nbc news reports that she is a top contender for trump's vice presidential pick. trump will speak at a rally there tonight. meanwhile, some new hampshire voters are telling nbc's shaquille brewster that maybe the decision this year is turning up three more of a challenge than the anticipated. >> there is a lot on the table. i think in the past it has always been, well, we are clearly gonna vote for this person's, or we are clearly gonna vote for this person. but there is a lot on both sides this time around. it is a tougher decision, i

think, and then most people think. >> do you plan on voting on tuesday? >> probably not. >> why not? >> i'm not really impressed with any of the candidates. don't see this working out well for anything. we have a number of correspondents in place new hampshire covering all of the candidates. leading in with nbc's vaughn hillyard in manchester. what are we hearing from trump before the final days and the primary. what is at stake here? >> what is at stake is a potential opportunity, christine, to wrap up this nomination by the end of january. for all intents and purposes. if he has a blowout win here in new hampshire, in a state where independents can go and take part and potentially make it more than 40% of the gop primary electorate, this would be a signal that donald trump can perform well in the midwest. he can perform well in new england. right now polls are suggesting that he has a dominating lead down in the home state. of nikki haley down in south carolina. last night and having the

endorsement of tim scott, the south carolina senator who was forced appointed to the senate by the then south carolina senator, nikki haley, was telling. he took the stage alongside donald trump last night. it's not just him on the trail here. ohio senator j.d. vance, who has endorsed on trump, is also campaigning with him. and stefanik, the new york congresswoman who is a potential vp pick of him. a chief defender. i wanna let you listen a part of an exchange ahead last night with at least a fonac. while donald trump is seeking this gop nomination, the trials continue to hinder, not only his time on the campaign trail, but also draws scrutiny on him. particularly in the e. jean carroll trial expected to continue this week as a jury determines how much to award for how much -- take a listen to me asking

racketeering case bought plane tickets for them to travel together to miami and san francisco. new video from trump's deposition in the three and a 70 million-dollar fraud lawsuit brought by the new york attorney general shows how his own nerves might influence the amount judge gorman have to pay in damages. wanna stick with me. i wanna bring in christine greenberg, former federal prosecutor and former deputy head of the criminal division of sdny. vaughn, you are in a unique position of covering trump's trials, where do you think the main focus is when it comes to his many legal challenges? where will trump suffer the most and how is he using that on the campaign trail? using t>> reporter: it is the l election interference case that is forefront and is mine. not only are we awaiting the appeals court decision on whether he is granted presidential immunity that all but tosses out those charges against him. for donald trump, the trial right now is still scheduled to start on march 4th here. the day we will continue to be looking at is the middle of

july. that is when they national commencement takes place. that is when the delegates will go on to the floor of that convention hall and they will firmly vote to make donald trump, if he so is the nominee, make him the nominee of the party. that is the question. if we are looking at a three-month trial, whether it is that federal interference case or the hush money case out of new york, if one of those trials wraps and potentially he is found guilty of any of these felonies before the convention there would be a serious conversation within the republican party on whether they,, even if the voters during this primary process decide they want him to be the nominee going forward against joe biden having had a phony connection to his name. >> christine, let me get your developments in the fulton county case. what are the implications there? >> there are allegations that -- regarding the nature of d.a. fani willis's relationship with

one of her prosecutors that she had appointed. i would say the brief was having on allegations, lie on actual supporting evidence and facts. i don't think we want to prejudge. hear her response is due in february. let's see what she has to say about that. there are also questions raised in the brief about the qualifications of mr. way, the special prosecutor that fani willis appointed. they are the new york times have reported that they are scant evidence that they had actually prosecuted any criminal cases. no evidence that he supported or prosecuted a major political corruption case or a r.i.c.o. case under the states complex statutes. this is one of the most significant criminal cases in our nation's history. that is why we are talking about right now. extensive criminal prosecution experience is important to try a case like this one. again i really do look forward to seeing the d.a.'s response to these allegations.

but at the and of the day, where does this lead? could there be potential ethics violations? perhaps. at the end of the day i think it is delay and distraction. the recourse is not going to be dismissing the charges. it is not going to be disqualifying fani willis and her whole office. it is just going to mean more time added to the clock. >> kristie, you were in judge engoron's courtroom for some of the new york fraud trial. i want you to listen to some of what trump said in the videotape deposition released yesterday. >> my most valuable asset, i didn't even include on your statement, that is the brand. when i became president, it was because of the brand. okay? i became president. i think it is the hottest brand in the world. if i wanted to show you a good statement, i would've added maybe ten billion dollars or something for the brand. >> the judge would have seen this before he found trump guilty of fraud. is this an admission from trump

that he might randomly add value, christy, if he needed to show a, quote unquote, good statement? >> this is really a nonstarter. the statements of financial condition that were entered into evidence in this case expressly stated that the goodwill that is attached to the trump name, it's brand value, does have significant financial value. but it has not been reflected in the statements themselves. the statements themselves are what is at the heart of this case. whether or not they were fraudulent. the statement say that the brand value is not part of. it what is interesting is the brand value actually was incorporated, just not disclosed in some of the statements with respect to the golf courses. essentially they add this premium for the brand value but they don't say that they are doing it. that is where you get into fraud allegations. we have to be clear about what is in your statements of financial conditions of the banks, the lenders, the

insurance companies, can actually rely on them. i don't think that this is getting him anywhere. the brand value testimony that came in and trials is all over the. place you have a professor, an expert for trump saying, well, he's worth billions. his lawyers said the same in her closing. again, there is no evidence as to how they came up with that number. and i do not think it is anything the judges really going to evaluate and consider a trial. >> right. another new development in a different case. trump'slawyer is filing for a mirial in the e. jean carroll defamation case. kristie, you are also in case for this. this attorney appeared to have a rough. the one exchan of judge kaplan she complained about the judge not pause in the trial for the funeral of trump's mother-in-law. saying my client and i would like to reiterate, she meaning e. jean carrolln sit here every day. she did not have a death in her family. it is insanely prejudicial.

judge replied, the right he has according to the supreme person or by council.t i the application is denied. i said sit down. the attorney said, i don't like to be spoken that y, i will not speak to you that way. the judge said, it is denied, sit down. what was it like in the courtroom, kristie? how far will the latest mistrial motion go? >> not far. it will be denied. donald trump did not attend any of the first e. jean carol trials when actual liability was assess. this is just a trial to assess the damages that e. jean carroll suffered. compensatory damages or punitive damages. he has been in the courtroom. he was not in the courtroom on thursday to attend the funeral. but he has been in court in other. days he was represented by counsel. there is no mistrial application here that the judge is going to grant or that any appellate court would grant, as well. >> trump is now arguing that he

should be entitled to, what he calls, full immunity, even for events that, quote, crossed the line. what is the lastn his immunity appeal? what are you hearing from his supporters on the campaign trail about criminal jeopardy for the former president? >> right. we are waiting for the u.s. circuit courts ruling on this appeal. the three judge panel that will ultimately make the determination before if in fact they were to affirm judge chutkan's decision that he does not have full immunity. we would expect donald trump's team to appeal to the u.s. supreme court. we saw that in a post about 36 hours ago. heaid presidents should be granted full immunity, even for events that crossed the line. you will recall during that appeals court hearing that when the attorney for donald trump was squarely asked by one of those judges whether that would include the president ordering the assassination of one of his political enemies. it wasn't all but yes. answer you see donald trump

articulate that he is of the belief that a individual who supervising the capacity of the white house should have full protections to ask how they see fit. of course there is a lot of hypotheticals that we can go down. for donald trump in this particular instance is making this argument to prevent himself from having to go to criminal trial on these federal election interference charges that are very serious charges that could very well come with prison time if he were to be found guilty. this is the way that not only he, but his attorney and legal representation, have chosen to argue the merits of this. >> so many legal developments in an election year. certainly unprecedented. here vaughn, kristie, thank you so much. we are headed back to new hampshire to check on rhonda santas and nikki haley campaigns. later, mind the enthusiasm gap. whose voters are the least and most motivated for tuesday? back in 60 seconds. ck in 60 seconds

building is nikki haley with three days to go before the new hampshire primary. her campaign is holding a live event in peterborough this hour. haley lost an endorsement from south carolina senator tim scott friday who said he's backing donald trump. haley appointed scott as senator in 2012 when she was governor of that state. her focus now on independent voters. here is how nbc meet the press moderator christian wilke put it this morning. >> reporter: in order to win this day, she needs independents to turnout in fourth. they make up about 40% of the electorate here. i spoke with a number of them yesterday. they told me they are energized. a number of them still undecided. >> let's get more now from nbc's aly vitaly covering the nikki haley campaign. and joshua burns covering rhonda sanders. ali, to you first. to no state here. first, of the bother the haley camp that fellow south carolinian tim scott endorsed and? trump's second, you also

covered at least stefanik there. tell us all about that. >> christine, i think you are right to ask this as a twofold question. on the one hand and nikki haley is on the receiving end of the best stick in politics. tim scott is someone who she herself had elevated to the senate back in 2012 when she was the governor of the state of south carolina. tim scott, a fellow rival nfl oso carolinian, of course, in this field, coming out and now endorsing the former president, donald trump. we also reported this morning, my colleague olivia sunlight and i, other members of the south carolina delegation will be coming here to new hampshire. you know they are not braving this kind of cold for nothing. it is all part of the trump campaign strategy. trying to show that even folks from his rivals home state are coming home and endorsing the former president. most of these folks who are coming up here today are people who have endorsed trump many months ago. still, nikki haley trying to make the pitch that this is her versus the former president. it is clear that she is on the former president.

mind even last night at a campaign rally, he had a familiar refrain when he usually talked about than speaker nancy pelosi during a riff about january 6th. instead he was talking about nikki haley during that time. i asked elise stefanik, who was out here as a top reporter of the former president, if he losing a step? did he mix-up those words? did he mix-up those names? here is her explanation for that? >> what do you make of that? >> that is not a mix-up. >> she wasn't speaker. >> nikki haley is relying on democrats, just like nancy pelosi, to try to have a desperate showing and new hampshire. >> but he was talking about january 6th. >> trump has law not lost a step. he is stronger today than he was in 2016 and he was in 2020. compare that to joe biden's weakness. den'>> seemed pretty clear to m, and most of the folks listening, that trump did in fact mix-up nikki haley's name with nancy pelosi's name. there we see the spin from one of his top surrogates. possibly someone we are gonna be talking a lot about,

christine. stefanik left the door open to the possibility of at least being included on trump's veep stakes list. all of that gets ahead of where we are in the primary right. now nikki haley trying to show that she can at least get second tier and get as close to the former president. that is a shift. she had previously been saying that this was gonna be a win for her. now they're saying, doing better than she did and i was good enough here in new hampshire. >> thank you, ali. now to nbc's dasha burns with ron desantis campaign. desantis, notably, not in the granite state this weekend. instead is campaigning in south carolina. dasha, desantis is polling far behind trump and haley new hampshire. does that explain why he is, essentially, skipping the state entirely out of tuesday? what is his strategy going forward? >> christine, this is not fertile ground for him. they know this, they have seen the same numbers we. have he does not do well with the independent moderate voters here in new hampshire. those that make up the majority of nikki haley's pace. they are moving on to south

carolina. they believe, they hope, that is where she will hit a wall. they are hoping, in fact, that she will hit that wall white before south carolina. in this one-on-one matchup she is created for herself here in new hampshire, she will underperform and drop out before she goes to her home state. they're feeling pretty confident that if that doesn't happen that she will have a very hard time in south carolina. they think if you lose your home state than it is gonna be very difficult to move forward. desantis has the look of the primary calendar. the fact that his home state of florida is further down the line. again, lucky for him. they believe that that is going to be a big favor to him as they tried to turn to a two-person race. this has what has been their goal from the rear beginning. make this a two-person mash-up. from there they could, potentially, take a shot at him. re they could, potentially, take they believe n once they hit south carolina. that is where they are focusing

all of their efforts. they've seen this timeline, christine, as an advantage for them. the fact that there is about a month between the new hampshire primary and the south carolina primary. they can take advantage of having their stuff on the ground. essentially using a bit of the iowa playbook in south carolina rally voters. here is the argument that desantis is making from self. here in new hampshire last night. >> there has been a lot of different pathways that people have gone through to the nomination. we have had a lot thrown at us. look at her record in south carolina. one of the most republican states in the country. she underperformed. these are lackluster victories. one by way less i won in florida and very good republican years. iran in a bad year for republican. both times. 18 was horrific. it was an anti trump wave. 22 was a massive underperformance, we massively overperformed. and over performed in the polls, by the way. >> reporter: the question is,

east. iran accusing israel of launching an airstrike in syria today that killed at least four iranian military advisers. also new today, u.s. forces hit houthi targets in yemen for the seventh time in 11 days. the strike following attacks by houthi rebels in the red sea. -- what else can you tell us about this attack on iranian officers and the latest on the war in gaza? >> christine, this strike took place in syria the capital, damascus. the target appears to have been members of iran's revolutionary gone core. the iranian state media is now saying five members of the

revolutionary guard were killed in this attack. one of them appears to have been a senior intelligence official from the quds force. and ali iranian expeditionary unit. you will remember qasem soleimani, he was the head of the force before. he was assassinated in iraq by the trump administration. this is a key part of the iranian regime. iran is blaming israel for this attack. israel, we know, has carried out a years-long bombing campaign inside of syria. they tend not to comment on the specific targeted strikes. that is the case today. the israeli military neither confirming nor denying that they were responsible. christine, this is part of the dizzying flurry of attacks and counterattacks that we have seen all over the middle east. it is very difficult to keep track of, frankly, at this point. there was a strike in southern lebanon earlier as you mentioned. the u.s. military, once again, hitting houthis militants in

yemen. the common nexus here is the war in gaza, which has been the inciting incident for this escalation all over the middle east. christine, there is very public disagreement right now between the biden administration and the right wing government of prime minister benjamin netanyahu about the future of gaza. president biden making clear that there needs to be a two state solution. prime minister netanyahu saying that that is a nonstarter. the president was asked if the white house had an idea on how to resolve the differences. we want you to take a listen. >> do you think that prime minister netanyahu will change his mind on his opposition to his two state solution, sir? >> he is of the right one. >> are you able to convince netanyahu of that decision? >> yes. >> you heard the president there taking a glass half full approach to this. under the right circumstances,

this is a live look at pittsburgh, new hampshire. yes, there is a pittsburgh in new hampshire. we are getting new reaction at the clock ticks down to the next big marker in the 2024 race for the white house. nikki haley and donald trump advocates a ramping up their efforts to get voters to the polls on tuesday while ron desantis in president biden are focusing on the larger race. nbc's -- joins us from the cornea, new hampshire. shaq, are the voters you talking to excited to get out and vote? >> hi there. i will tell you that despite the tens of millions of dollars that have been spent on television ads, digital ads, there's still a lot more work that needs to be done to excite regular everyday voters.

you can see us here on the bowling alley. people are coming in to enjoy their saturday. people -- i've been asking them about politics. one overwhelming idea that i have been hearing is there are a lot of people who are undecided. not sure what they are gonna do not sure what most undeclared voters are gonna pick up. if they will vote in the democratic process of the republican primary. that could be an opportunity for nikki haley. as you mentioned is coming into tuesday's primary behind by double digits with donald trump. doing well among those undeclared and independent voters. again, this is about mobilizing and activating people. getting them to come out to the polls. based on some of my conversations, it is more difficult for some than others. i want you to listen to a few those exchanges. >> i don't think it matters. >> why not? >> because they are all crooked. >> i had to say it this way, i don't think it is gonna make a difference. i still think trump has double

digit leads in most of the states. >> i'm not really impressed with any of the candidates. i don't see this working out well for anything. >> you are just checking out? >> i'm checking out. >> nikki haley has multiple events throughout the state today. the reason why i say there is some opportunity there for her is i mention the most independent voters who can choose to vote in the republican primary process, if she can turn more of those voters out, if she can extend the base of support and the voters who are participating in that process when, the secretary of state saying they may see a republican side with record numbers of voters coming out. that means she can shift the tide and change what we have seen so far in the polling. all right, shaquille. thank you so much for that. great perspective from so many of those would-be voters. joining me now is jennifer horn. former rnc executive committee member, former rnc congressional candidate, and host of the podcast, is it just

me or have we all lost our minds? [laughs] welcome! look, new hampshire polling can be all over the place, notoriously. it is hard to state to get a read on sometimes. what are you hearing from the ground? who are voters leaning towards? >> the reason it is hard to get a good solid read on it, sometimes, are those and declared voters that year voter just referenced. they can come in on election day and choose either party. they can become a democrat for a day or a republican for a day. nikki haley needs a really strong turnout from those undeclared voters. there has been top on the ground that they are even trying to target some of the left leaning, who normally vote democrat, undeclared voters. or targeting moderate democrats even. as we all know, joe biden isn't participating in the primary in answer this year. the problem with that is, on the ground, the democrats in

new hampshire are trying to launch a writing campaign for joe biden. so some of those votes that nikki haley might have been hoping to get are being targeted by their own party. that is why it is hard to get a solid read on the ground sometimes for what is happening in new hampshire. >> motivation is really critical here. jennifer, which candidates voters are the most motivated to come out next week? who has the most and least motivated voters? >> unfortunately for nikki haley, her voters, in the polls at least, seem to measure the least and fuzzy as i'm for turning out. the daily tracking poll from suffolk that shows donald trump is continuing to creep up. one point out of time. he is about 17 points ahead of nikki haley right now. that same poll shows that 90% of the people who say they are going to vote for donald trump also say they are very and through the last weekly gonna

vote for donald trump. they are definitely going to show up for donald trump. nikki haley it's only something like 46%. i believe that ron desantis's numbers were actually ahead of her's. as far as and through the awesome, he is still down in single digits, unfortunately, right now. unfortunately for him. >> there have others who have said new hampshire, this is nikki haley's best chance of winning a primary. but you don't necessarily agree. he said haley beating trump on tuesday is just not gonna happen. her campaign has gained momentum in the last several weeks. she has this endorsement from popular new hampshire governor, chris sununu. why are you so sure? >> i'll tell you, there are a couple of different reasons why. nikki haley not only has the endorsement of kristen ooze, she also has an awful lot of money in there from the koch brothers from americans for prosperity. i think the push he was going to get from that has already been seen. it has already been measured.

you have to remember that before those two things happened she was way, way, behind. we have kind of already seen that push. we have seen the jump in the polls as a result of those two things. governor sununu, chris is a very skilled politician. very accomplished as a politician. he went with a coalition of moderate republicans and more moderate-leaning undeclared and even some moderate democrats. those are the voters she has already got. she is going to get them. he really doesn't bring that conservative republicans. and he is not gonna be able to steal any trump vote for her. i'm just not convinced that he is going to bring to the table what she would need to defeat trump. >> jennifer, we have a new article that caught our attention. the writer, sarah longwell, in this article calling on former trump officials to speak out against. him this week you have been very critical of republicans like governor sununu have took

think it could be a major gamble for democracy? >> they are not rooting for donald trump. they aren't gonna say that but they look at his nomination at this point it's probably a foregone conclusion. but probably the one that they are most equipped to handle, right? biden versus trump campaigns, they feel like they're not around. that they did three years ago, successfully. they believe they can do it again this year. the trick will be not to argue about biden's accomplishments so much as make the case that donald trump is a danger to the republic if he comes back. that is the way to get these disaffected biden voters, they think, back into the fold. they may be upset with biden about the border his age, or the border whatever but once they realize the other alternative is to get donald trump back, presumably, these democrats think they will get back into the biden camp. that doesn't mean they want trump to win. they do see a path to victory there. there was a younger republican. if it was nikki haley, let's say, for instance. there is a whole different challenge there. trying to make the argument
