"chris jansing reports." at this hour, nikki haley's new hampshire blitz, will momentum after ron desantis quit the race propel her long-shot bid to the ultimate upset against donald trump? we're live on the campaign trail. plus, the potential for a primary day split screen, will donald trump be on the stand as voters head to the polls. we've got the latest from the e. jean carroll trial. show of force, the former candidates, plural, who will join trump on the stage tonight for one last big new hampshire rally. and the phony recording that sounds an awful lot like joe biden, but it's really just, as he would say, a bunch of malarkey. what we know about a robocall telling supporters not to vote tomorrow. our nbc news reporters are following all of the latest developments, and we begin with the haley campaign, and our own ali vitali live from the trail. so ali, i understand nikki haley

was at a bar pouring pints. what else did she have going on today? >> reporter: yeah, and you know what, not the first time that we've seen her behind the bar during this stretch in new hampshire because she celebrated her birthday in similar fashion. i mean, what other choice do you have when you're out here on the campaign trail celebrating life milestones and also running for president. look, this is also a very serious point in the campaign, chris, because it's now a one-on-one race between nikki haley and donald trump. we've said this before, and it's worth underscoring, this is the race that nikki haley was always driving towards, even when it was still a three-person race with ron desantis in it, nikki haley was saying that this was a head-to-head with her former boss. now it's a question of maybe be careful what you wish for because it is a do or die moment in the live free or die state. for haley, they're not casting expectations in that way. instead they're saying that their goal here is to do better than they did in new hampshire -- of course that looks likely, especially with the field winnowing, and she's vowing to stay through until

south carolina and through super tuesday, which is march 5th. that's a long stretch of the campaign. this is why she's saying she's in it. watch. >> this is not a coronation. you had 56,000 people out of 3 million in iowa vote for donald trump. less than 1.5% of that state. we haven't even started with this election yet. we don't do coronations. a democracy is about giving people options. we're in this. we have enough to be strong in south carolina. we're going to go on into south carolina. we're going to be strong. >> reporter: and look, chris, i'll tell you this having covered the haley campaign for almost a year now. they have had a very nose to the grindstone strategy this entire race. they just really put in the work and started campaigning on the trail, allowing debates to really push their national momentum forwar and then inform the grass roots momentum that they're now trying to capitalize on as voters start going to the

polls. i know that it's difficult for us to chart the path for them past new hampshire, but i think the vibe of the haley campaign as far as my sources tell it, is that they want to do well here, and then what's next is next. >> ali vitale, thank you. donald trump's testimony in the e. jean carroll case is still up in the air. what happened? >> chris, we had a number of trial participants either have covid symptoms or exposure. so lou kaplan has decided that trial was off for the day. the jury was sent home to test themselves for covid, and it remains to be seen whether we'll reconvene tomorrow. part of that turns on whether anybody who was in the courtroom was covid positive, but another piece of that also turns on alina habba's request to postpone the trial to allow former president trump to campaign in new hampshire tomorrow and testify on wednesday. it's possible that judge kaplan

will sort of split the baby with the bath water and continue the trial but not with former president trump's testimony. we have at least two other witnesses, one for e. jean carroll, one for former president trump, and some evidence that could be admitted as well. so we'll wait until later today to see what happens with the jurors and to see whether judge lou kaplan enters an order, for now whether there's trial tomorrow and what it consists of is anyone's guess. this is always an unpredictable trial today without exemption. now to the one event donald trump has planned tonight in new hampshire because he thought he was going to be in new york all day today, nbc's garrett haake is on the ground with the latest. i understand that, what, he's got three of his old rivals coming tonight. tell us what's going on there with trump? >> reporter: that's right, chris, continuing the alcoholic theme from ali's hit, what will soon be a donald trump jr. event, one of the former president's top surrogates is at a vineyard today in hollis, new

hampshire, but the only time we see donald trump tonight will be in laconia where he is appearing with three of the four former presidential candidates who have since dropped out and endorsed him. doug burg up. he tries to project that this race is in his view over despite the fact there's another kand candidate and a primary and it's time for republicans to rally around him as the front runner. he's having somewhat more success in that second message, when ron desantis dropped out yesterday he turned right around to endorse the former president. donald trump in an interview on fox sort of returning the tepid thanks to ron desantis when asked about whether the former -- or excuse me, the current florida governor has any future in his administration. listen to this,. >> is there a possibility, since you say there's water under the

bridge, he hasn't asked for any of those, is there a possibility of joining the forces? >> it's probably unlikely, but i have to be honest, everything's a possibility, but i think it's highly unlikely. >> reporter: now, chris, it's not clear how a desantis/trump ticket would help the former president. he's already very strong in the state of florida. there's some constitutional questions about having two floridians on the ballot, and it's clear although it is a little warmer here in new hampshire than it was in hawaii, -- iowa, things are going to have to thaw out significantly after a pretty nasty fight between them for most of the last year. >> it would take a great thaw, no doubt about that, thank you, garrett haake. appreciate it. now to a robocall scam that tells supporters of joe biden not to vote in tomorrow's primary. mike memoli is reporting from new hampshire. this call was digitally manipulated, right, to sound like biden? what more do we know? >> reporter: yeah, that's right, chris. we know that every four years,

of course, we talk about elections coming down to turnout. there was never any question, of course, that the turnout in the democratic primary here tomorrow was going to be far lower than what we saw on the republican primary, especially because president biden himself is not on the ballot. but we're hearing new hampshire democrats really sound the alarm about what this robocall might mean, because it does have what sounds like a familiar voice seeming to discourage turnout even more. listen to what this message that has been going out to some new hampshire voters sounds like. >> you know the value of voting democratic, when our votes count. it's important that you save your vote for the november election. we'll need your help in electing democrats up and down the ticket. voting this tuesday only enables the republicans in their quest to elect donald trump again. your vote makes a difference in november, not this tuesday. >> now, chris, since nbc news broke this story this morning,

the new hampshire attorney general says it has received several complaints about this. its election law unit is investigating. the biden campaign, their campaign manager releasing a statement saying they're considering additional actions here and that any effort to potentially use this information will not stand. we are here in nashua where dean phillips, the minnesota congressman who's challenging biden in that democratic primary was campaigning. his campaign saying this is wildly concerning and any effort to suppress the vote is concerning as well. we should add the note that dean phillips' campaign has already been accusing the biden campaign of its own efforts to suppress the vote. remember, it's the dnc acting on the president's wishes that said new hampshire's primary as one recent letter from officials said is a meaningless election. this is all part of the climate of uncertainty heading into the democratic primary tomorrow where the write-in vote will be closely watched here, chris. >> mike memoli, thank you. in 60 seconds, nikki haley's

>> reporter: donald trump perhaps wouldn't surprise anybody is responding himself, chris. donald trump is somebody who clearly is very much rubbed the wrong way by any insinuation that he is declining, whether it be physically or mentally, though at the same time, donald trump has mocked joe biden incessantly over the course of not only the last two years but also you'll recall heavily during the 2020 campaign when he made the case that joe biden was hiding in his basement because he was unable to actually operate as a candidate himself. of course, i will let others determine anyone's cognitive abilities, but for donald trump, i'll let you listen to him just last night, his defensive posture towards his own cognitive state. take a listen. >> a lot of times i'll say and president obama is doing a lousy job meaning that obama's running the show. they'll say, donald trump doesn't know who our president

is. no, no, because cognitively -- you know, i don't know if you saw but a few months ago, i took a cognitive test my doctor gave me. i said give me a cognitive test just so we can -- you know what the standards were, and i aced it. >> reporter: donald trump also at two different events here this weekend, chris, worth noting he referred to congresswoman elise stefanik as elise stef-an-ic. for donald trump, he has made it a key tenet of his campaign to question joe biden's mental state and mental fitness and now it's nikki haley who is calling into question her republican rival. >> brendan, trump's defense of these moments of confusion, you know, i really was just talking about obama is really running the show, might be enough for his base, but is there potentially a real opening here for haley?

>> i think there may have been an opening if she started talking about this a long time ago. look, donald trump didn't just get old in the last month. there have been real questions about his cognitive capacity for years now, and i do think that the age could have been one of the best hits against donald trump if nikki haley -- but not just her, if the other candidates in this primary had been talking about it for months going back. we know that people have questions about joe biden's age. i think they probably would have similar questions about donald trump's age if people talked about it more. i do think joe biden is showing his age a little more than donald trump, and i think that's reasonable to expect that different people are going to age in different ways, but donald trump certainly is old. he will be one of the oldest presidents, if he is elected and they should have been talking about this months. but talking about it here on the eve of the new hampshire primary when you're down by 15, 20 points is probably a little bit too little too late. >> somebody who's going to be running after the rest of the republican field goes away, brendan, president biden has

>> yeah, i mean, it's not uncommon when you have a play mare like this for the incumbent riding coat tails of people attacking in this primary. i think what this ultimately shows is joe biden understands he has a vulnerability, and he's trying to do something to even the playing field, but nikki haley at some point is going to start feeling like she's very isolated. i think there's going to be a lot of republicans who are going to see ads like that and say thank you for running, but you are only hurting the person who's very clearly going to be the nominee. she's gotten the race that she needed, that one-on-one race. it feels like the walls are closing in on her, and there's going to be a lot of pressure if she does not have a huge night tomorrow to get out quick because people will say she is only helping joe biden. >> how does joe biden take advantage, brendan? >> well, like that. i mean, one of the things that i've been struggling with with the biden campaign as it were is they've been pretty hands off

that they are protecting abortion access across the country. she said that republicans were creating a health care crisis, and she said that president biden would veto any possible federal ban on abortion. she also, of course, is touting the administration's efforts here. just today the biden administration was saying they are going to put out new protections to expand access to contraception and medication abortion using federal departments including the department of labor, treasury, as well as the office of personnel management. they're also putting out as you noted, a new ad highlighting the stories of women impacted by the overturning of roe. take a listen. >> i never thought that i would need an abortion for a planned pregnancy. but i did. two years ago i became pregnant with a baby i desperately wanted. at a routine ultrasound i learned that the fetus would have a fatal condition and that there was absolutely no chance of survival. in texas, you are forced to carry that pregnancy, and that

is because of donald trump overturning roe v. wade. the choice was completely taken away. >> now the vice president and president are hoping that stories like that really going to hammer home the point that abortion access is critical in this country, and of course that's why she's here in this deeply red county that former president trump won twice. i should also tell you i just spoke to a woman who told me a heartbreaking story. she said she was 19 1/2 weeks pregnant when she was told her baby had an abnormality that would not be consistent with life. she was forced to have an abortion. she said that that was a heartbreaking decision and that lawmakers in her state need to have nuance with this. she said she had to make that decision in one day because of the 20-week ban that is in place in the state that republicans are trying to make that a 14-week ban. emotions here are high and the white house and president, of course, vice president harris are really hoping that helps mobilize voters in their favor. chris. >> yamiche, thanks for that. that new ad, the biden/harris ad

is set to play during the season premier of "the bachelor." it's going to run on hgtv, bravo, hallmark, food network, oxygen. talk about the voter targets for this ad. >> well, the key targets, chris, are women and younger voters who are a critical voting block for democrats. ever since the supreme court overturned roe, it has turned into a political liability for republicans. abortion has been on the ballot seven times since the landmark dobbs decision, and in every instance anti-abortion advocates and republicans lost, and that's even in red states like ohio, like kansas, like kentucky, and so what you're seeing are democrats trying to tap into that energy. big picture, it's a way of making the 2024 election less a referendum on president biden and more a choice election about these big issues. so as vice president harris is in wisconsin today, president biden, as you mentioned, is here

back in washington, convening a meeting, talking more about extending access to contraception, and then tomorrow the vice president, the president and their spouses are going to appear in northern virginia at a campaign event around this issue. the reason why is democrats last year in virginia campaigned heavily on the idea of reproductive rights and they were able to win back control of the state legislature. democrats see this as a resonant and salient issue. >> the fact that they're going to be together, that is their first joint campaign appearance of 2024. so geoff, what are you going to be looking for? >> you know, i'm really interested to hear what president biden has to say because he often doesn't speak about this issue at length. the white house has deputized vice president harris to be the person who speaks about abortion access and in part it's because president biden as a devout catholic has said previously that personally he is against abortion, but publicly he doesn't view it as an article of faith. and what we've heard from vice

president harris is that you don't need to abandon deeply-held beliefs or abandon your faith to arrive at the decision that the government shouldn't have a role in your medical decisions. so i'll be keenly interested to hear what president biden himself has to say on this issue, chris. >> it's also been interesting, yamiche, to see just how targeted this messaging is. women like the one who you say came up to you that say, look, these laws never accounted for someone in my situation, but what they've done is put me in a precarious, untenable situation. the sound that you played from vice president harris saying the top ten states with the highest rates of maternal mortality all have abortion bans. clearly they have a very specific focus on how they want to tell people why this is something they should worry about, even if you've never thought about it in this way

before. >> certainly, chris. really the message is this could happen to any woman in our country and that any woman could find themselves in a position where they have a medical condition that forces them to have an abortion. they might not get proper care to save their life if they don't have access to abortion. the woman i talked to today along with her husband heather and jason, they told me they didn't want to have an abortion. they never thought they would be having an abortion. this is a child they wanted. she's a mother of two. she said in her case, her baby was not going to live not one day, in her case as i said, she had one day. the couple had one day to make the decision. that was infuriating to her because she said to me, if i had to go out of the state to have an abortion that i didn't even want, i would be away from my comfort zone. i would be away from my community, and i would have the government telling me what to do with my body while i was trying grieve. the ability to have that abortion allowed her to have another child. she was able to properly mourn that child. the biden administration and

vice president harris in particular coming to this county that is a deeply red county. she's trying to tell people and voters, you really need to think very hard about this. this is not a black and white issue in our minds. there needs to be nuance for people to make personal decisions that the government should be out of it. there is a message from the biden and harris administration and campaign here to really try to humanize and personalize wla abortion access looks like and to not just it be the sort of blanket conversation but to really also hammer home the point that a lot of women who have abortions, they're mothers, chris. >> yamiche alcindor, geoff bennett, thank you so much. we have some sad news to report, dexter scott king, the youngest son of martin luther king has died. he had been battling prostate cancer. he was just 7 years old when his father was assassinated. he became a civil rights activist in his own right, chairman of the king center and president of the king estate. dexter king died in his home in california. he was just 62 years old. still to come, nbc news goes

a victory for the d.a. prosecuting donald trump, at least for now she will not have to testify in a messy divorce proceeding that threatened to derail her own case against the former president. fani willis had been fighting a subpoena in the divorce of nathan wade, the trump special prosecutor she's accused of having an improper relationship with. as "the washington post" reports, the allegations have given the former president and his co-defendants a new line of attack on the validity of the georgia case and willis's decision-making. nbc's blayne alexander reports from georgia, also with us former brooklyn prosecutor and msnbc legal analyst charles coleman. so what happened in court today, blayne? >>. >> reporter: well, chris, two things of note. the first is that a judge

ordered that the divorce records are now unsealed. they're been unsealed for two hours. we've been going through them page by page. that's notable because it was requested by a number of media organizations in addition to the attorney for michael roman, one of trump's co-defendants because she had said that that would have evidence to underscore the claims to back up the claims, the allegations they made that wade and willis were having an improper relationship. and more importantly, that she was financially benefitting from it. so that's number one. issue number two, however, had to do with fani willis being subpoenaed to testify. she doesn't have to do so tomorrow, that was the originally scheduled date. it's not a complete victory. the judge said he's going to decide at a later date whether or not she needs to testify at all. after the hearing today, i caught up with andrea hastings. she is the attorney for wade's estranged wife and i asked her about what she had to say about

willis's allegation that this request to testify is nothing but harassment, harassing her because of the position she holds. >> it wouldn't matter who she is and what position she holds, if she's having an affair with my client's husband and he's spending my client's money on that relationship, i'm going to find out about it. and it has nothing to do, in my view, with her being the district attorney of fulton county. >> so there you have it, chris, that issue is clearly far from settled. we do know that she's going to continue to pursue this, getting fani willis to testify under oath. this is just now another kind of piece of the puzzle in a completely different case that has now become very intertwined. >> thank you so much. so charles, here we are again, you know, a judge having to look at something that could potentially have political implications but trying to make a decision based on the fact. he's put the deposition of fani willis on hold. what will go into or what should

go into him making a decision under the mate will? >> it's going to be a high standard in terms of getting fani willis to testify. they're going to think about what is the timing. what are the contours of what can be asked during a potential deposition and why? they're also going to be thinking about is there a protective order that's necessary to conceal the contents or the conversation that occurs during the deposition so that these things are not publicly available. so all of these factors are going to come into play. is this a witness that needs to be deposed right now? is it possible that this deposition could be mutual fund -- moved later on in discovery. all of these things are going to come into play as to whether they're going to allow fani willis to be deposed or not. >> going back to what "the washington post" wrote and we read, first of all, this could be considered salacious, right? but it also gives an opening to

donald trump and his supporters to say just goes to show you. is there concern about impacting a jury pool? is there concern politically about how this might play? or is it just a side show, something for people who love donald trump to gossip about? >> i think it has to be a concern. i think it's something that you as an attorney are thinking about in terms of just -- again, and it's important to understand why the majority of jurors may not be bothered by this and they will see it for what it is, all you need for a hung jury is one holdout, and so if you're able to influence the jury pool such that you get one holdout on that jury, then you have a chance of getting your client a mistrial, and then he lives to fight another day. so i do think that while i don't expect it to sort of influence and impact the entirety of the jury pool in fulton county rgts i think it's something prosecutors are concerned about because, again, all you need is one and donald trump does not

degrees warmer right now than this time yesterday. it probably feels like spring in a few cases, like raleigh is up to 50 degrees, mid-30s in new york. we still have a little bit of cold air in place, the southern portions of the great lakes and northern ohio valley. that's why we still have these advisories that are out for freezing drizzle. it's not a big deal, but when you're going home from work or school, when you get in this freezing drizzle patch, that's where you can get slip and falls, mostly indianapolis, north wards into southern michigan. all of the ice is over with in oklahoma, arkansas, and even now missouri is going above freezing. and of all places, the worst weather in the country right now, southern california. this storm system has kicked through with a lot of heavy rain. we've had a couple of inches in some spots, flash flood warnings for san diego, and some of the desert areas of southern california. and as this moves tonight, it will head into areas especially around phoenix with some heavy rain, mostly during the overnight hours. it's pretty rare to see this heavy rain in southern california, and eventually, chris, that's the rainstorm that's going to head into areas of the south later this week.
