11:16 am
i am curious, let's get to the interpretation of that message we just played from governor schapiro. is he trying to lower expectations and then reason for donald trump? >> i think a lot of democrats are concerned enough to happened in the june debate and what we saw, there was a debate among democrats about having the microphones turned off. that was something democrats after the debate with biden had regretted because they had felt like audiences would not hear trump coming in and saying things, the points that he was talking. it will be an interesting dynamic to see how these rules impact harris' performance but i think democrats are lowering expectations and about what

11:19 am
as poorly as he did in that debate, but also either seeming restrained or he restrained himself worked. >> it did. if he restrained himself, if that was a cognizant thought, it was because he let it all play. he did not need to jump in in that manner. and there's a strong school of thought about that. as we know it begins just over one weekend some states. independent and third party candidates will be on the ballot. how many of these ballots will be in swing state ballots and how my that shape the election? >> we basically reported that rfk jr. is trying to take himself's off the ballot in red states. he's telling supporters, do not vote for me, vote for trump. that is something that trump sees as a good point for him.
11:20 am
he has had some luck in that regard because he now sees that some of the rfk supporters will go towards him. i'm not certain that will have as major of an impact yet. early on in rfk's campaign going to rallies, a lot of what i heard from voters were people who were not satisfied with either biden or trump. they wanted someone different and when kennedy spoke at those events before endorsing trump, obviously, he spoke about how both candidates have not kept campaign promises and he attacked trump a lot. so i have heard from voters at his events who said that they are not committed to voting for trump yet, ever since kennedy's endorsements i don't know that will necessarily hurt harris as much as the aides are hoping. on the other front, joel stein

now to a head spinning 24 hours of significant developments in the trials of donald trump. judge juan merchan is delaying the sentencing. he attended his e. jean carroll hearing and turned into a campaign event. and judge tanya chutkan spoke. let's get into this because we have first the hush money sentencing where the judge cited the election as one of the reason for the delay. do you agree it should be pushback or is the judge tipping the political skills, as he did not attend to, by withholding a decision. >> good to be back with you.
11:27 am
i don't agree with the decision to postpone until after the election. treating trump different than every other defendant. it benefits donald trump. in this case, the prosecutor, alvin bragg, did not oppose donald trump's choice to push the sentencing until later. because he did not stand up for himself on this one, the judge was like, not going to fight your battles for you. funeral pushback on this, don't look at me. i will not be the bad guy. the judge says we will push it. that is a shame because there's no reason to delay it. in this case, like every case, you have to follow the evidence and the law and ignore the politics and the noise. they listened to the noise and gave donald trump what he wanted. they put judge mershon into
11:28 am
an unenviable bind by agreeing to trump's request to delay sentencing. why would the manhattan d.a. do that? does that support his position that it is all political? even though it works in his political favor. >> it is hard to know why the d.a. did what he did i think it's because the d.a. did not want to look at a more political than he did, but if you choose not to decide, you will still have made a choice, as the letter goes from the band rush. by not taking a position, you have taken a position and are treating him differently, treating better, and laying it all on the judge. that is not fair. the prosecutor has a adversarial role to the defense and when he won't stand up for his position, then he will put the judge in that untenable position and capitulated. i don't blame the judge for this. this to not have to happen i think alvin bragg should have been more aggressive on the timing. >> let's make the point that all of this remains uncharted territory for this country but

election in november. >> in that particular case, tanya chutkan's case you had the trump attorneys saying we should not get drawn into an election dispute. definitely not getting drawn into an election dispute. that was quite powerful right there. let me ask you about another situation that was an extraordinary one we were talking the news. the father of the alleged school shooter in georgia. if convicted, both parents. in the the mess, which right? >> the prosecutors are right. we've had enough school shootings.
11:31 am
we will stop by them them by threatening kids with life in prison. don't care about that. rarely do they survive the shootings. it is rare that someone turns himself in like this one. but at some point parents have to be responsible. this will not make parents responsible in every case. the only time we have seen parents held responsible criminally have been in the most egregious cases with a had a troubled son and said giving him a therapist, got him a gun and ignored his morning cries and refuse to take him home from school. here in georgia, you have someone similar. because it's worse because in some getting the troubled son a gun, he got him and ar-15s style rifle, even after he was alerted by the fbi that his son wanted to be a school shooter. what kind of parenting is that? he should be held accountable. >> you just said it there. thank you. good to see. there are so many burning questions about tuesday's debate, not the least of which is, what will victory look like? what would the wednesday morning headlines say? the political panel tackles

things and kamala harris will be able to hear these things. what will happen is the vp will be on her square and she will fact check him, irrespective of the fact that those microphones are going to be muted. she will roll into her responses as well. donald trump has posed a challenge because he lies and lies so quickly that it can be difficult to keep track of all of them at once. but for kamala harris, it is for her to rise above the muck. twirler story and help america get to know her better. she has to do two things, just to call trump out for the lies he tells and more importantly, showcase who she is and why people should be invested in and supporting her. that can be something that in the time frame they have could be difficult but this a woman who's been practicing and prepping and is more than ready for the debate night. >> what you say about the accusations? the "new york times" says that trump is trying to install doubt to say if he does badly,
11:38 am
it is not his fault. they were ask if he was trying to lower expectations when it comes to the rules and he said no. so what are the expectations and does harris have unfairly high ones placed in her as compared to the overall low expectations on trump? >> absently has higher exultation is placed on her not just because she can string together a sentence without meandering five times and telling four different lies. there are additional expectations on her for quite a few reasons. number one, this has been a short campaign. we have to continue to recognize that just over 100 days, she became the candidate and has been having to reintroduce or introduce yourself to the american people all over this country and in a very truncated campaign that normally would have taken two years to build up.
11:39 am
she has additional work to do and additional expectations placed on her because there are more questions surrounding her. but we have to recognize that as a woman at the podium and as a south asian woman at the podium and certainly as a black woman at that podium, she has a particular line that some people are expecting her to tell that she will show up as lawyerly and prosecutorial but she also has to appease certain people by not crossing into the category of angry black woman. that is an impossible task to do because no one how clearly or eloquently she expressed herself, some people think that anyway. we know there are additional expectations placed on her because of race and class. there should be high expectations for every single presidential candidate yet these are higher than we have ever seen. >> this is interesting because the former white house indications director told investment platform that he expects trump to use racist dog
11:40 am
whistles and viciously try to tear at her and attack her. he said instead of focusing on policy as hillary clinton did, harris should lean into the sparring match and outwit him. how much should she hit back as opposed to appearing calm and presidential? >> i go back to something that britney just said. one of the things that kamala harris is going to have to rise above and one thing every black woman unfortunately has to rise above is angry black woman trope. will be difficult considering that donald trump will use racism. he will use sexism. he will use all of these things that we have seen him use on the campaign trail irrespective of his advisers and the current speaker of house advising him not to do so, he will use as an attack line for her because water to bite back. for kamala harris it is remaining stoic and in the policy wing. and calling out and naming him
11:41 am
for who he is and what he does. she cannot get up there and spark back and forth. i do not think it is fruitful for the american people. it is definitely not fruitful for her or her campaign. she's done an excellent job rising above the muck. even when president trump tried to make her decide what race she could be. kamala harris does not have to prove to donald trump who she is comes to those who she is. she misses stick to her points. just to showcase her policy agenda and also to call him out for the person he happens to be. we will see the prosecutor versus the convicted felon. i think we will see input racism and white supremacy on full display. kamala harris is a smart woman who has been a woman of color her entire life. there's nothing he could say on that states she has not heard. she is risen to the ranks that she has in spite of these things, not because of them. >> former senator liz cheney has joined the ranks of republicans. >> i don't believe we have the luxury of writing in candidate

's names, particularly in swing states. as a conservative and some who believes in and cares about the constitution, thought deeply about this and be because of the danger that donald trump poses, not only am i not voting for donald trump, but i will be voting for kamala harris in this election. >> adding to that her father, former vice president dick cheney is also backing harris calling donald trump the greatest threat to american history saying he can never be trusted with power again. what you think the impact is of endorsements like this from prominent republicans? >> i think the campaign has a responsibility to be very careful here. when it comes to this debate, there are moments that are beneath the dignity of the office and if it comes to those racist tropes or sexist tropes,
11:43 am
that kind of sparring and back and forth says those kinds of questions and that line of thinking is actually worth answering and they are not. their places for her to fight. so if you want to see the kamala harris that we saw in the senate questioning brett kavanaugh on the rule of law, on the things that matter, on the policies that matter. especially, the progressive and younger wing of the party that is looking closely to what the policy answers are going to be. holding the balance between support from moderate republicans all the way to i think dick cheney, someone who is further to the right everyone who is naturally part of the tent on the left feels seen, heard, and respected in her plans is going to be a

we heard it last week that there 90% of the deal has been agreed to by hamas and the israelis but it is the 10%, that 1% that is left that is really holding the deal up and that has been holding the deal up for the past but are part of the year versus the last time that there was a week long pause in the fighting that released half of the hostages in november. this deal, while there is an added urgency and imperative behind it to get over the line, none of the diplomats were trying to work on it are necessarily any more hopeful than they have been in the past. >> it is tough. i'm taking it all in. they just want the hostages home. get a deal and stop the fighting, but it seems to be just too difficult of a task at this point. hope springs eternal. thank you. for details about the bombshell plot to influence the u.s. elections uncovered by the doj this week and what vladimir

putin came out today and he has endorsed kamala harris. i have feeling, i don't know. i don't know exactly what to say about that. i don't know if i'm insulted or if he did me a favor. >> donald trump referencing putin's sarcasm. putin saying, he likes harris's infectious laugh and is hopeful she may lift u.s. sanctions on russia. joining me now, former cia officer and national security analyst. hi, mark. why would he say he wants harris to win? is it because he knows his endorsement could hurt her chances?
11:57 am
>> this is vladimir putin being his own self, or true self. which is an intelligence officer. something he did for many, many years. he's trolling the united states. clearly, he is not endorsing kamala harris. whether it's the opinion of the u.s. intelligence community or people within our world that follow this. it's absolutely clear that putin once donald trump because they share the same policy platforms, which is an end to u.s. aid to ukraine, reducing the strength of nato. this is putin being an intelligence officer. just messing with united states. he does this with a smirk. no one takes this seriously and you would of course expect someone on the right, including former president trump, to take this up. nothing to be seen as a real endorsement. not that an endorsement whatever matter. >> 100%. let's go to this week. the biden administration announcing sanctions and criminal charges against russia to thwart its efforts to interfere in the election. intelligence officials say russia's activities are more

sophisticated than in prior election cycles and the kremlin is using authentic u.s. voices on social media platforms and websites to promote propaganda and divisive narratives aimed at swaying american voters to favor donald trump. how prepared are intelligence agencies to prevent russia from influencing the outcome of this election? the whole concept is not new. >> they did this in 2016. we are better at countering this. it's good to see that the doj actually did something with these indictments in the past they would sit back and watch. now we took action. to me, was really interesting about this is going back to my old world with the cia active measures campaign. look for the effect. what kind of outcome resulted? if you take a look at of the content that was put forth, again, emanating from russian intelligence that is perhaps useful idiot right-wing

influencers, it had to do with things like ending aid to ukraine. so what happens with this? they got former president trump to come on one of their shows. at the end of the day there is an aid package, the $60 billion aid package was stalled in congress for months and months. ukrainians died. i think that was a measure of effectiveness. champagne corks were popping in russian intelligence headquarters. once again, despite us catching this, they come out on top. it's something you have to keep counteracting. illness needs, alex, a war room 24/7 mentality to counteract with the russians are doing. i know the iranians and chinese are doing this too. >> i was going to say the same thing. they can get their foot off the gas pedal for a second on this. nbc news reports the biden administration is considering, mark, cutting a deal with hamas that does not include israel. it would secure the release of the four american hostages it believes are still alive in gaza. the hostage families have been

pressing the white house to make a unilateral deal after the increasing certainty that benjamin netanyahu will not agree to a cease-fire exchange. is a deal like this realistic? the cease-fire negotiations on the brink of what the u.s. is calling a final proposal is a unilateral deal with hamas the best option now? let me add, they would also want the remains of the three americans they have confirmed have been killed while being a hostage. >> we have to certainly acknowledge the frustration of the families of the hostages. pain i can't even imagine. there's also frustration on the part of the biden administration about prime minister netanyahu's -- he does seem to be making blockades to negotiations. but the u.s. has to be careful. a unilateral or separate deal could drive a wedge between the u.s. and israel. it would be campaign fodder for the republicans.
