possessing a semy automatic rifle. the individual's name is ryan wesley routh. age 58 according to senior law enforcement officials briefed on the matter. >> the suspect is in custody. a short while ago the palm beach county described the scene where they found him. >> now in the bushes where this guy was, is an ak47 style rifle, two backpacks which were honed on the fence that had ceramic tile in them and a go pro which he was going the take pictures of. >> reporter: they later released these images on what they found on the suspect. that backpack, the go pro camera and an ak47. wesley routh lives in hawaii but previously lived in greensboro, north carolina. some of his previous facebooks

and linked inaccounts have been identified. >> we're checking in with you pretty regularly as we learn more about the suspect. we now have learned a little bit more about his background. his criminal record, social media profile. give us the composite of what we're learning about who this man is in the early hours of this investigation. >> we were told he has a criminal record we did not know how extensive he was. he has over 100 criminal charges previously. most are in north carolina. the question that we're trying to sift through here is what was actually real? what actually made its way to court. what was adjudicated in court. was he ever convicted, did he ever play guilty to anything. how did that go with responds to felonies and should he been able to purchase this weapon. a lot of questions that they're going through right now.

that takes cares of the criminal history and social media component. there's a lot of posts flying throughout social media. we're still trying to confirm some of the specific accounts. because in this day and age given the fake posts and ai driven content we see we want to be extra careful. so we do have a sense though, that at some point at least the new york times appears to have profiled him. he was somebody who is very much proukrainian. but we're still trying to get more details on that. as far as where he is, he's in police custody at this hour. he's going to be brought on most likely local charges. that be state charges by the palm beach state attorney who's dave aaronburg. appeared often times here on msnbc. they will likely put charges on him. that would be to hold him without bail. the fbi says they're investigating this as some of you have been reporting for some time now is an apparent assassination attempt. that is a federal crime. so if they think they have

enough evidence for it that this is the person that they believe is responsible, then at that point, they will perhaps bring federal charges against him. so that's where that stands from a federal component. and then it'll be up to either side to determine who will go first. i think what aaronburg said at the conference, at least for the moment it appears that basically, he'll put those charges you're looking at them there on him and then at some point the feds may move forward with their case and that's how that will work. so that's the next step from a legal perspective. they reference at the press conference the phone content will be typed up. and he was found on a car. they have the go prothere so was he recording on things ahead of time. is there audio. were there statements that may help with the time of event. you don't have to be an avid

watcher of date line to figure out what the next steps that federal investigators are going to take on that. i chuckle at that but obviously this is a very serious incident. just to take a step back guys. we have an ongoing presidential campaign. you've got candidates criss crossing the country. you have the general nation assembly the high week where over 100 world leaders come in. i don't have to tell you what's going on between hezbollah, hamas, iran, with everything going on in the middle east. we have ukraine, there's a lot of foreign interests. the secret service is responsible for that. that's their security preview. so there's an awful lot of responsibility on them. and i think there's some serious questions and very serious discussions i am told happening tonight at the most senior levels of the federal law enforcement community about exactly how does this look going forward. what does it mean for these campaigns and, i have been told

the threats to trump and it's obvious given the events of today. the threats to vice president harris, the democratic presidential candidate have been very high as well. so none of this bodes particularly well as we head into the. >> it'll be difficult to get your hands on a gun. we're obviously not at the point yet where you have a full understanding of where he got the gun and how he got the gun knowing that he's known to law enforcement as they say. >> they'll go back and look at the gun's serial numbers see where it was last registered, where it was last sold. was it in fact, sold to him. was it sold to other

individuals. did he legally transfer this gun in many different ways that that can happen. did he legally transfer this gun to rou th so that's going to be a big question. if he didn't, if somebody sold this there's a potential for federal charges there. that's a little ways down the road. they have to go through this system. it's not terribly efficient. and atf has not received an awful lot of funding to make it efficient so it's a little challenging. >> thank you for that threat assessment and threat seams that are out there. >> nbc news correspondent kathy park is where it all went down. what's the situation now. >> ali, we're right in front of the golf course right now where this incident took place. i can tell you there's a tight perimeter around this resort. and you know earlier today we heard from the sheriff says look, the witness who saw the

suspect actually saw this individual jump out from the bushes. just kind of show you the lay of the land behind me. it's a little dark right now but we can tell you, there are a lot of bushes. very tall bushes. you can't really see into the golf course right now and authorities have not specified the exact location where this individual, the witness saw the suspect. but it was the quick thinking of the witness who quickly wrote down the license plate number. then reported this information to authorities. it was a black nissan and officials were able to track down the suspect on the interstate. pretty much in a matter of minutes. but during that time, resources moved in very quickly. you had local, state and federal agencies blocking off the roadways. and eventually they were able

to arrest the suspect. the former president was on the fourth or fifth hole and when he does this he typically has a bubble around him. agents noticed the gun and that's when agents fired. no injuries were reported. that's how things played out. they mobilized extremely quickly. they were able to get the suspect who once again is now in custody. but, this is something that we're following very closely. not a lot of activity at this point. we did see a caravan of sheriff's deputies kind of go through here just a few moments ago. looks like either they're breaking down and just kind of moving the barricades at this point. we're just reinforcing this area right now. but, just a few minutes ago i

it was under other circumstances. let's start with the basics. what is the potential charge here of this suspect. because we've been seeing some conflicting reporting. is it your understanding that he managed to get a shot off in the direction of the golf course or was he laying in wake to possibly strike? what do you understand as to what he was actually there doing? >> it's my understanding, amon that he was laying in wait. and secret service did a heroic job to see a needle in the hay stack essentially. a guy through the bushes, pointing an ak47 style rifle toward the former president. and they took action. and they shot at him. now, according to what i note, he the suspect pointed the rifle at secret service. so that could create a charge of aggravated assault with a firearm. which since it's pointed at a secret service member could get you up to 15 years in prison as a second degree felony. normally it's a third degree

felony charge. with that said, and tom winter was right. at the press conference i said it looked like we'll be the ones to file the charges first. but the federal government could come in and they could file their own charge at any time. and they have decided to do so. so this will be charged in a federal case. this will not be charged as a state case after the press conference informed us that they're going to be taking it over. they're going to be filing federal charges. this guy is in a whole world of hurt right now because the federal government has a lot of charges and severe penalties that we at the state level do not have. >> what institutes an attempted assassination. by the way, an attempted anything. an attempted murder or whatever it is. if anyone goes through planning and acquires the things they need and end up at this place. but doesn't get a shot off. does that fall into the same category? >> yes, you don't have to get a shot off to be charged with an attempted assassination. just like you don't have to get a shot off to be charged with an attempted murder.

if you've done something, taken some action. he's facing a lot of time potentially in prison. one of the reasons why we were acting to get the warrants together and the motion for pretrial detention is to make sure that he would not be free of federal charges. but no worries about that now. the federal government has stepped in and he will be facing charges shortly. >> did you get any sense from him as to what motivated him, what the ideology was. had he spoken to anyone who had interacted with him from local law enforcement that arrested him. we understand he is in palm beach county in the custody of the secret service. can you shine any light at all about the demeanor of the suspect since he has been brought into custody? >> well, when he was caught in martin county which is about 45

minutes north of west palm beach. shows you he drove on i95 north. i don't know if he was trying to drive back to north carolina. he was picked up and he was apparently pretty quiet. compliant with law enforcement. it shows you he's done this before. he's had a rap sheet so he knew enough not to talk. he didn't. now whether he said something since the traffic stop i don't know. he's back in palm beach county now. but, you know fortunately we had the good samaritan, fortunately had secret service. which they did a great job after they got so much criticism in butler, pennsylvania. they did an excellent job. and we have great communication with our federal partners. >> can you tell me a little bit to two new yorkers here how it works in florida when you have a long wrap sheet but you have that kind of weapon?

>> well, yeah, unfortunately florida is pretty lose when it comes to gun charges. whether we should have had more protection around the former president. there's a lot of protection around him. the streets are closed outside of mar-- a-lago. the streets are even closed when the president is not there. the golf course is pretty large with a lot of hedges. and it's easy for people to get through that. and it happens with people taking photographs and posting them on social media. there are very lose laws and that may come in the federal level. an assault weapons laws. that may have to come by

something federally. the only thing we don't have is open carry. we have a good samaritan that was amiss. they knew something was wrong. fortunately we averted a tragedy from happening but it is a crime for an exfelon to possess a weapon. but the ability to get weapons it's still pretty easy. >> just because you're familiar with the law more than any one of us. how does the ideology that may emerge as a motivation behind this shooter, change the potential charge. you and i have talked about this sometimes in the past that, we don't necessarily have a lot of strong domestic terrorism statutes but how would an individual's ideological leaning here, if it's connected to a foreign

entity or a foreign organization, it immediately changes the dynamic of what possible charges and then terrorism suddenly becoming in play. >> it's a great point, because there is a federal statute. it's very tough about providing assistance to a foreign terrorist organization to be part of a foreign terrorist organization. but there's no similar statute for a domestic terrorist organization. we do not have a domestic terrorism statute with penalties. that's something i have talked about in the past and i think needs to be addressed. in the meantime the federal government has other laws. they have severe firearms laws they can invoke. they've got attempted assassination laws. and so, they could file serious charges against this guy. as far as his intent it seems like based on his social media

as we learn more about what the fbi is describing as another assassination attempt on trump's life. the task force investigating the first one is demanding new answers tonight. chairman congressman mike kelly and ranking member jason crow have said in a statement we have requested a briefing on what happened and how security responded. we're thankful the former president was not harm bud remain deeply concerned. >> and joining us the former director of the cia john brennan. director thank you for being here with us. your reaction to what is now a second attempted assassination attempt on donald trump. and the secret service as far as we know. their handling of the situation so far. >> well, i think there's still a lot that we don't know about this instant. but it sounds like the secret service did a very good job in

terms of preventing this individual from actually getting a shot off against donald trump. there were a couple of holes ahead of the way donald trump was playing. and the secret service was able to identify this gun that was sticking out of the fence. engaged the individual. so bravo to the secret service for taking those actions. secondly it once again shows how difficult it is to protect individuals in these open venues. especially in a golf course that we have all these open spaces. hundreds of yards without inhibited field of vision. that allows individual to have quite an opportunity to take a shot against somebody. so i know the secret service working with the local authorities is trying to do everything possible to try to ensure that the perimeter of

these events are going to be secure. but again, it just demonstrates how difficult it is. and then finally i think it shows that we are a country awash in guns. including a lot of these high powered assault rifles that really allow individuals, mentally disturbed or otherwise to be able to take matters into their own hands and often act. secret service authorities and others have their work cut out for them. i'm just glad that this is the second time that donald trump was not injured. i do think the authorities are going to try to redouble their efforts as we get even closer to the election. >> director brennan, i was wondering if you can draw on your experience over the course of several decades, working in intelligence and national security. to reflect on the frequency of what we're seeing happening here with these you know politically motivated assassination attempts. certainly assassination attempts going after political

figures not just the president but others we've seen in recent years. members of congress, members of the judiciary. how alarming is it that we are seeing the frequency, the almost regularity, we've almost become numb to it unfortunately when it comes to our schools. we've seen it now escalate if you will against our public servants. >> i think it's more frequently than it has before. the shootings at school continue on an ongoing basis. the violence against public officials is not just here in this country it's also in other countries. there's a shooting of the prime minister of slovakia. the availability of weapons in this country is a worrisome trend that makes it difficult

for law enforcement and secret service and protective authorities to try to do their jobs which is to protect individuals. again especially in outdoor venues where we know that, political campaigning takes place mostly outdoor. politicians want to be able to engage with citizenry, with their constituents and their supporters. i think again the availability of these weapons. the high power nature of them makes it more difficult to trial to ensure the. >> protecting donald trump is particularly challenging for the secret service because his golf outings have always caused a concern. he lets the golf courses stay open to the public. he's out for several hours at a time. the piece went on to say that unscreened people are constantly around him. the president, the former

president should be able to golf like anybody else. is this a trump specific problem or are we just going to see these kinds of problems as presidents leave office or as, prominent people get targeted? >> again i think politicians like to be able to engage with average citizens. they want to go out. we would have the same problem with president obama when he would go out to golf. also concerned when they go through rope line or shake hands. are individuals wearing some type of explosive devices. making sure they're going to be patted down in these places where there's going to be. making sure everything is done that is possible to try to protect individuals. but again, with the

availability of these weapons and ammunition and some of the devious names that people use is increasingly difficult. it's commentary to say that we're likely to see more of these in the future. but again, i think the secret service did a very good job today and i will only hope that it's going to be the case in the future. >> director brennan i wanted to ask you from your vantage point as the head of the cia formerly. something that was brought up earlier in our conversation from a former secret service agent when we asked her the threat streams that exist out there. these lone wolf individuals who are self-radicalized perhaps or who carry out these attacks versus the state actors that are out there. when you look at the threats that are out there from adversaries, china, whoever it might be. looking at these incident, looking at these attempts how this increases their threats. they're watching this. they're seeing what works, what doesn't work. what they learn from these

attempted failed assassination attempts. and how much more complicated the job of the secret service becomes even with these failed assassination attempts. >> it's very difficult for the secret service, fbi, local authorities when you're dealing with u.s. citizens who engage in these type of activities. we pride ourselves on being a country of freedoms and liberties. and so people will say things on social media that might in fact, indicate that they have this against individuals but that's not a basis to be able to launch an investigation on individuals. as difficult as it was to try to uncover foreign states, there's authorities you can use on nonu.s. citizens. when lone actors, these are individuals who may not share any information or plans with anybody else. and so it makes it very, very difficult for the local authorities to uncover these

breaking news from florida. the suspect now identified at ryan wesley routh in custody. according to officials briefed, his social media accounts on x and linked in have been identified. it comes nine weeks after the former president survived the attempted assassination in butler, pennsylvania. trump was fine, was not hurt. correspondent ken delaney join us now. what are you hearing on the latest regarding this suspect who has now been identified ryan wesley routh. any political affiliations. >> not quite that specific, amon. but we're starting to get a greater picture of his life and interests. we know he had a long history in north carolina and we're seeing some very serious charges in north carolina

including possession of a weapon of mass destruction back in 2002. and some other felonies. we know at some point he lived in hawaii or said he lived in hawaii. and he was in ukraine. there's a video we've now authenticated of him doing an interview while in kyiv saying he went over to ukraine to try to fight with the ukrainians against russia. but he's 58 years old and no former military experience. so he was turned away but said he was trying to recruit people. but when you see his twitter, you see very strange things. like asking kim jong-un to come to hawaii. just very nonsensical and strange things. raising questions about his mental state. we know from law enforcement is we have someone who was lying in wait for donald trump. pointing a rifle through the fence at the golf course.

he fled, according to law enforcement got in an suv. they were able to track town that suv. pull him over on the highway and arrest him. he's now in custody. they've recovered an ak47 style rifle. a go pro he had with him. a backpack with ceramic tiles which appears maybe he thought those were akin to ceramic plates in a bullet-proof vest. again this is a man with no military experience. he got within yards of former president trump. that's bound to raise questions about the secret service protection even though in this case they were able to thwart

this. >> and we've been talking about tiles. you're telling me these are not ballistic tiles. >> in the picture he appears to be wearing a military style vest that is often used in war zones. with military style plates. we don't know if there was anything in those. in the past we've talked about trying to construct the final steps in movements of let's say the assassination attempt in butler, pennsylvania. a lot of that came down to the technology background of the shooter. in this case, the suspect is alive. so he has the right to stay silent. that would only i suspect make the initial part of the investigation that much more challenging for investigators.

>> and you're absolutely right. if he's not talking, we don't know the answer to that question. whether he's talking now. we only know what the law enforcement official said at the press conference. when he was detained he had a flat affect. he did not seem curious about why he was being surrounded by law enforcement officers with rifles and that he, i believe they said he had not been cooperating up to that point. that's hours ago. we don't know if he's talking now or not. unlike the shooter in butler he appears to have a much more extensive public social media. this is the reason why law enforcement is learning more about him. different from the shooter from pennsylvania who took care of

not having a footprint. and discover why he may have done this. at the end of the day if he was mentally disturbed it may not ultimately make sense. if he was very passionate about the ukraine cause, obviously donald trump has not been as passionate about the ukraine cause and has been sympathetic to putin. these are the things that the fbi will examine. >> we just got a statement released by the president, joe biden. it reads, i've been briefed by my team of an assassination attempt. i am relieved that the former president is unharmed. there's an active investigation into this incident as law enforcement gathers more. there is no place for political

all right moments ago, we received a new statement from president biden on what appears to be the second attempted assassination on donald trump. i'm going to read a part of it. quote a suspect is in custody and i commend the work of the secret service and their law enforcement partners for their vigilance in keeping the former president safe and i'm glad that the former president is unharmed. >> joining us now to discuss where the fbis investigation goes from here and how we got here. rob d' amico. there will be all sorts of monday morning quarterbacks. but it's more clear how it went down. it's unknown where he got a shot off. the information we got is he did not. he was shot at. he then tried to get away. someone got a picture of his

tags. they used some sort of license plate technology to identify the tags and he gets pulled over about 40 miles north of palm beach and arrested without incident. not a bad day's work considering that someone could have been assassinated today. >> absolutely. when you look back at everything that went wrong in pennsylvania, i think this one, everything went right. and i think part of it is because pennsylvania happened. i think pennsylvania happened because some complacency. how many events had they gone through and nothing happened. you get lulled into this state of oh it's just another whatever. i think, if this was, if pennsylvania hadn 't happened and the secret service agent saw this what he thought was a rifle barrel sticking out of his fence. i don't think he would have taken a shot. i think the fact that he was under the mentality that this could happen because it just happened literally. he saw that and he reacted to it the way he should have.

i think they caught the shooter before he was, he was ready to shoot. i think the fact that he had his ballistic vest hanging on the fence and his backpack, he was probably siting in his rifle. because when you're looking through a scope, the field of view gets very narrow. so he's probably putting it through, what he could see and where he could better take the shot. that's probably when the secret service saw him. he was probably wetting for trump to get into the ambush site of where he had a better site. and the secret service interrupted him. >> i don't think most people can wrap their head about how it is to identify a gunman in a shrub. >> i can't see a gunman 20 feet with a barrel. that's quite something. >> talk to us about that. the ability for that secret service agent. this heroic secret service agent that took this suspect out. we're not sure how close he was

to the fence. but the shooter was 300 to 400 yards from the president as the secret service agent made his way to the hole ahead of the former president and the other members of the party. how remarkable is that? how well trained must you be to spot amidst the shrub and what appears black backpacks. we don't know what the suspect was wearing. if he was camouflaged. >> like a black gun barrel. >> in trying to conceal the gun barrel. >> it's great for someone to be able to do that. i was an fbi sniper. as a sniper you're always thought to not let your barrel prude out a window, out the bushes, you always cut back the vegetation and you shoot from behind it because people can see a barrel. so as in the sniper world, when you hunt a fellow sniper, you don't do those things. so the fact that this agent was walking down and there's so

much bush in that area, for him to see one barrel sticking out and to identify it as a barrel. >> and not a tree or branch or anything that could be sticking out. >> it's straighter than a branch, it's straighter than tree things so it does definitely. for him to do that and engage it. my thing is, he engaged it without maybe being able to know he would get a good shot. but what he did is disrupt the ability for that gunman to shoot. i always say that when they looked up at the, in pennsylvania, when the one police officer just looked up and caught, if he got a round out. you're interrupting that person's engagement plan. i think on this one, it might have been that the secret servicing agent was walking down probably on the side where the golf cart path was. if the gunman was looking through his scope. he can't see peripheral. he's looking through the scope. probably at one to 200 yards out. seeing what he could see, he
