12:00 am
could evening. we are continuing breaking coverage of gunfire reported near former president trump today in florida. >> we are learning new details of what they're calling an apparent assassination attempt at the former president's golf course. we can report the identity of the man who was shot at by secret service while possessing a semiautomatic rifle. his name is ryan wesley routh, aged 58 according to three senior law enforcement officials. >> the suspect is in custody. the sheriff's office described the scene where they found him. >> now, in the bushes where this guy was is ak-47 style rifle with a scope. two backpacks which were hung on the fence which had ceramic tile in them and a gopro which he was going to take pictures. >> they release these images of
12:01 am
what they found on the suspect. that backpack, the gopro camera and nk 47. ryan wesley routh was born in 1966 and according to records he lives in hawaii but previously lived in greensboro, north carolina. he is in custody in the last few minutes some of the social media profiles, facebook page, and his linkedin account have been identified. >> joining us is law enforcement intelligence correspondent. we are checking in with you as we learn more. we have learned a little more about his background, his criminal record and social media profile. give a composite of what we are learning this man is in the early hours of this investigation. >> we were told he had a criminal record but we didn't know how extensive it was. according to public records, our research department, he is over 100 criminal charges previously. most are in north carolina. the question we are trying to sift through is what was real
12:02 am
and made its way to court? what was adjudicated? was he ever convicted? did he ever plead guilty to anything? how did that go with respect to felonies and should he have been able to purchase this weapon? a lot of open questions and something law enforcement is digging through right now. that takes care of the criminal history and the gun component. as far as his views, there are tons of different posts you have made that are flying around social media. we are trying to confirm the specific accounts because in this day and age given fake posts and a.i. driven content, we want to be careful. we do have a sense that at some point, at least the "new york times", appears to have profiled him. somebody who was pro-ukrainian but we are trying to get more details on that. he is in police custody at this hour. he is going to be brought up on most likely local charges.
12:03 am
state charges by the palm beach state attorney who is dave aronberg and he's been down there a long time and appeared here on msnbc . his office will likely put local charges on him to hold him without bail. the fbi says they are investigating. just as you both have been reporting, is an apparent assassination attempt. that is a federal crime so if they have enough evidence, that this is a person they believe is responsible, then they will perhaps bring federal charges against him. that is where that stands from a federal component then it will be up to either side to determine who will go first. i think what dave aronberg said at the press conference, for the moment it appears that he will put those charges on him and at some point the feds may move forward with their case and that's how that will work. that's the next step from a legal perspective.
12:04 am
search warrants are being typed up so they will go through this individual's phones which is a real time black box on our lives, it seems these days. then they have the car where he was taken into custody. you remarked about what was found at the scene. they have the gopro. was he recording ahead of time? is there audio entity make statements that would help with the time line? you don't have to be a watch of dateline to figure out the next steps federal investigators will take. i chuckle at this but this is a serious incident. just to take a step back, think about this, we have an ongoing presidential campaign. you have candidates crisscrossing the country. the united nations general assembly, the high week went over 100 international leaders and dignitaries come in. i don't have to tell you what's going on between israel, hamas, hezbollah and everything in the middle east. we have russia's invasion of ukraine.
12:05 am
there's a lot of foreign interests in the u.n. ga. the secret service is responsible for that. it's an awful lot of responsibility on them, and there are serious questions and serious discussions, i am told, happening at the most senior levels of the federal law enforcement community about exactly how does a so going forward? what does it mean for these campaigns? i have been told the threat to trump, and it's obvious given the events didion pennsylvania, the threat to trump are high. the threats to vice president kamala harris and the democratic presidential candidate have been very high as well. none of this bodes particularly well as we head into the last two months of this presidential campaign. >> let me ask one question. you have been talking as you get more information we are finding this guy has a lot of rap sheet. that would suggest it would be
12:06 am
a little more difficult to get your hands on a gun. we are not at the point you have a full understanding of where he got the gun and how we got the gun given that he is known to law enforcement, as they say? >> that is right. they will look at the gun's serial number and where was registered and sold. was it sold to him? was it sold to another individual? is that somebody they could be looking at? did he legally transfer the gun. there are many ways that could happen but did he legally transfer the gun. that will be a big question. if he did not or somebody sold it or there was a straw purchase there's a potential for federal charges. that's a little ways down the road but they have to go through the system. it's not terribly efficient. atf has not make funding to make it efficient. spent time win with that threat assessment. thank you. let's go to west palm beach
12:07 am
florida where this went down. correspondent kathy park is there. what is the situation now? >> reporter: we are in front of the golf course right now where this incident took place. there is a tight perimeter around this resort. earlier, we heard from the sheriff saying the witness who saw the suspect actually saw the individual jumper from the bushes. to show the lay of the land, it's a little dark right now, but we can tell you there are a lot of tall bushes. authorities did not specify the exact location where this individual, the witness saw the suspect. it was quick thinking of the witness who quickly wrote down the license plate number and then reported this information to authorities. it was a black nissan and the were able to track down the suspect on the interstate
12:08 am
pretty much in a matter of minutes. during that time, resources moved in quickly at local state and federal agencies blocking off the roadways and they were able to apprehend the suspect who is in custody. officials are stressing there is no longer a threat. there are still roadblocks in this area. to go back a little bit, as to how we got here. we are told the president was somewhere playing golf on the fifth or sixth: typically when he does this, he has a bubble that follows him. there were agents in front of him and that's when they noticed something was wrong. i noticed the suspect allegedly aiming in that direction and that's when agents fired at least four rounds, we are told. it is unclear if the suspect fired back but no injuries were reported. that's how things played out, and they mobilized quickly.
12:09 am
they were able to get the suspect who is now in custody. this is something we are following closely. not a lot of activity at this point. we did see a caravan of sheriff's deputies go through here a few minutes ago. either they're breaking down and moving the barricades at this point or reinforcing this area. just a few minutes ago, speaker johnson posted an x that he spent a few hours with the former president. kelly and i are departing mar-a- lago i spent hours with former president trump and we are thanking god for protecting him. no leader has endured more attacks and remained so strong and resilient. he is unstoppable. right now, the investigation is pressing ahead. evidence is being processed. you have the ar-style weapon they are looking into as well as the backpacks that contain the gopro and ceramic tiles. it is in infancy.
12:10 am
a lot we are tracking. >> kathy park, thank you our next guest was at the press conference. dave aronberg, palm beach county, florida and their overseeing charges against the suspect. it's good to see you again. we usually talk to you every sunday night. we wish it was under better circumstances. let's start with the basics. what is the potential charge here of the suspect? we have been seeing conflicting reporting. is it your understanding he managed to get a shot off in the direction of the golf course? or was he laying in wait to possibly strike? what do you understand as to what he was doing? >> it is my understanding he was laying in wait and secret service did a heroic job to see a needle in the haystack.
12:11 am
a guy through the bushes, pointing an ak-47 style rifle toward the former president, at and they took action and shot at him. according to what i know, he, the suspect pointed the rifle at secret service. that could create a charge of aggravated assault with a firearm which, since pointed at a secret service member, could get you up to 15 years in prison is a second-degree felony. normally it's a third-degree felony charge. at the press conference, i said it looks like we will be the once a filed charges first. the federal government could come in and they could file the run charge at any time. they decided to do so. this will be charged a federal case and not a state case. the federal government after the press conference informed us they will take over and will be filing federal charges. this guy is in a load of hurt because the federal government has a lot of charges and severe penalties we, at the state level, do not have. >> what constitutes an
12:12 am
attempted assassination. if someone plans and acquires the things they need and end up at this place but does not get a shot off, does that fall in the same category? >> you don't have to get a shot up to be charge with attempted assassination. if you have done careful planning and you have done something, taken some action, he is facing a lot of time potentially in prison. one of the reasons why we were acting to get the warrants together and the motion for pretrial detention is to make sure he would not be release pending charges by the federal government. there is no worry of that now. the federal government has stepped in and he will face a federal judge in the near future. >> it's still early, but in a few hours your office was involved before the federal government stepped in, did you get any sense from him as to what motivated him?
12:13 am
what the ideology was? has he spoken to anyone who when directed from local law enforcement that arrested him? we understand he is in palm beach county and in custody of secret service, can you shed any light about the demeanor of the suspect since he has been brought into custody? >> when he was caught in martin county which is 45 minutes north of west palm beach, he drove 95 north. i don't know if he was trying to drive back to north carolina, but he was picked up and apparently he was pretty quiet. pretty compliant with law enforcement. it shows perhaps he has done this before, we know he has a rap sheet. he has had previous interaction with law enforcement and know enough not to talk, and he did not. whether he has said something since, i don't know. he is back and pull beach county. fortunately we had a good
12:14 am
samaritan and secret service who did a great job. especially after they got so much criticism after the incident in pennsylvania. they did an excellent job here and we had good communication with our federal partners. >> can you tell a little to new yorkers how it works in florida when you have a long rap sheet but you have that kind of weapon? >> yeah, florida is loose when it comes to gun laws. perhaps that is something we should be discussing instead of whether we should have more protection around the former president. there is a lot of protection around them and the streets are closed outside of mar-a-lago and even when the former president is not there, the streets are closed. the golf course is a large place with a lot of bushes. it would be easy for someone to sneak in and people do that who take photographs. as far as the possession of the
12:15 am
ak-47 style rifle, there are lose laws in florida. we need to be tougher on that but perhaps that will have to come at the federal level. assault weapons ban or something. florida has some of the looser laws in the country. one thing we do not have his open carry. if you're caught with a gun in the open, that is a crime. there is an attempt in florida to allowed to carry guns openly which would be a huge mistake. this shows why. you had a bystander who knew something was amiss perhaps because she or he saw this person emerging from the bushes with a weapon perhaps or so i weapon in this person's position. we averted a tragedy but it is a crime for an ex-felon to possess a firearm, but as far as the ability to get guns like assault weapons? it's pretty easy. >> because you are more familiar with the law than either one of us, how does the ideology that may emerge as
12:16 am
motivation behind the shooter change the potential charge? we have talked about this in the past, we don't have a lot of strong domestic terrorism statutes. how would an individual's ideological cleaning change what he is charged with? as we heard from frank and tom and others, if this in any way shape or form, fits connected to a foreign entity or a foreign organization, changes the dynamic of what possible charges and terrorism comes in play? >> that's a great point because there is a federal statute, it's tough, about providing assistance to a foreign terrorist organization, to be part of a foreign terrorist organization. for a domestic terrorist organization, we do not have a domestic terrorism statute on the books with penalties. that is something i've talked about and i think needs to be
12:17 am
addressed. in the meantime, the federal government has other laws that has severe firearm laws they can invoke. they have attempted assassination laws. they could file serious charges against this guy. as far as intent, it looks like based on his social media profile that he was really impassioned about the ukrainian cause against vladimir putin and calling it good versus evil which is interesting. a guy who can correctly identify the ukrainian's are good versus putin who is evil. at the same time couldn't realize what he was trying to do was an evil act in itself? when you have someone who try something like this, you don't get people who are normal. people who are a little to arrange. doesn't mean they are legal and seen. >> we are always looking for clear answers. what's the motivation? and things like this -- a

as we learn more of what the app is describing is another assassination attempt on trump's life the first one is demanding new answers tonight. congressman mike kelly and ranking member jason said in a statement, we requested a briefing in the u.s. secret service about what happened and how security responded. we are thankful the former president was the harm but remain concerned about political violence and condemn it in all its forms. the task force will share updates as we learn more. >> joining us is the former director of the cia john brennan. it's good to see you. your reaction to what is now a second attempted assassination attempt on trump and the secret service, as far as we know, their handling of the situation so far? >> i think there's a lot we don't know about this. based on the preliminary report, the secret service did a good job in terms of preventing this individual from getting a shot off against trump.
12:23 am
there were a couple of holes ahead of where donald trump was playing and the secret service was able to identify this gun sticking out of the fence and engaged the individual. bravo to the secret service for taking those actions. it shows how difficult it is to protect an individual in these outdoor venues, especially a place like a golf course where there is large open spaces. fairways that go on for hundreds of yards. some of these high powered rifles, ak-47 has a range of 300 yards. ar 15, 600 yards. with uninhibited field of vision, that allows an individual to have an opportunity to take a shot against somebody. i know the secret service working with local authorities is trying to do everything to try to ensure the perimeter of these events are going to be secure. it demonstrates how difficult it is.
12:24 am
it shows we are a country awash in guns including a lot of the high-powered assault rifles that really allow mentally disturbed or otherwise individuals to take matters into their hands and engage of these awful acts of political violence. the law enforcement authorities, secret service and others have their work cut out for them and i'm thankful it's the second time that donald trump was not injured and i think the authorities will try to redouble their efforts as we get closer to the election. >> i was wondering if you could draw on your experience over the course of several decades, working in intelligence, national security, to reflect on the frequency of what we are seeing happening with these politically motivated assassination attempt going after political figures and nudges the president but others in recent years. members of congress the judiciary. how alarming is it that we are
12:25 am
seeing the frequency, they almost regularity. we have almost become numb to it when it comes to schools. we are seeing it now escalate, if you will, against our public servants? >> i think it is more frequent than it ever has before. the shootings at schools and other public places just continue in an ongoing basis. also, the political violence directed against public officials, not just in our country but other countries. the recent shooting of -- and other things. what we are seeing are people believing they can take these matters into their own hands. the availability of weapons particularly in this country really is a worrisome trend that makes it difficult for law enforcement and secret service and protective authorities to
12:26 am
try to do their jobs which is to protect individuals. especially in outdoor venues where we know campaigning takes place mostly, outdoors. the politicians want to engage with citizens early in their supporters. i do think the availability of these weapons, high-power nature, and standoff range makes it even more difficult to try to ensure the security and well-being of protected officials. >> the tactics become important. you mention this about golf courses, the washington post reported protecting trump is a challenge because of golf outings. he lets the courses stay open to the public. he is in a exposed environment for several hours. they mentioned unscreened people are constantly around him. the president, former president should be able to golf like anybody else. is this a trump specific problem?
12:27 am
or will we see these problems as presidents leave office? is people get targeted? >> i think politicians like to engage with the average citizens. they want to go out. we had the same challenge with resident obama. they would have to shut down the roads near the golf courses. this is something that is a fact of life. also, concern is the go and shake hands, are individuals wearing an explosive device that could go off? the use of magnetometers, making sure they will be pat downs at these venues where there will be directed direction with public officials, these are things that will -- have become a reality to make sure everything is done that's possible to try to protect individuals. with the availability of these weapons and ammunition and some
12:28 am
of the devious means people use, it is difficult. it's a sad commentary to see we will likely see more of these in the future. the secret service did a very good job today and we can only hope it will be the case in the future. >> i want to ask you from your vantage point is the head of the cia formerly, something that was brought up earlier from a former secret service agent when we asked the threat streams that exist out there, these lone wolf individuals who are self radicalized to carry out these attacks for whatever reasons versus the state actors that are out there. the hostile threats from other countries, adversaries, enemies. looking at these incidents and these attempts, how that increases their threats? they are watching and seeing what works and what doesn't work and what they learn from these failed assassination attempts and how much more complicated the job of the
12:29 am
secret service becomes even with these failed assassination attempts? >> it is difficult for secret service, fbi, local authorities went dealing with u.s. citizens who engage in these activities. we pride ourselves in being a country of freedom and liberty so people say things on social media that might indicate they have this animus against individuals but that's not a basis to launch an investigation. as difficult as it was to try to uncover foreign terrorist operations in the united states, you are able to use certain authorities that you can use against non-us persons. when u.s. persons are involved, and as you point out, loan actors, these are individuals who may not share any information or plans with anybody else. it makes it very difficult for local authorities to uncover these plans in advance of their activities. there will be a look at routh's
12:30 am
activities and social media and email and whatever else. trying to find out these things in advance is difficult as long as we are a country of laws and trying to protect the rights and liberties of american citizens. this is difficult and local law enforcement and federal law enforcement authorities are grappling with this now to make sure they balance the need for security and the appropriate methods prior to any attempt and at the same time respect the rights of american citizens. >> it's good to see you and thank you for being with us. john brennan, formerly the director of the cia.

we are following breaking news with the fbi confirms its investigating what appears to be a attempted assassination of trump at his golf club. the suspect identified as ryan
12:35 am
wesley routh in custody and according to senior law- enforcement officials briefed, was shot at by secret service while in possession of a semi automatic weapon. 's social media accounts have been identified. it comes nine weeks after the former president survived the attempted assassination on his life in boulder, pennsylvania. trump was not heard. justice intelligent corresponding ken dilanian joins me now. what are you hearing with regards to the suspect who has been identified, ryan wesley routh. any political affiliations, known associations or affiliations? >> not that specific but we are starting to get a greater picture of his life and interests. we know he had a long history in north carolina and we are seeing serious criminal charges including possession of a weapon of mass destruction in 2002 and some other felonies. at some point he lived in
12:36 am
hawaii or said he lived in hawaii and he was in ukraine. there is a video we have authenticated of him doing an interview saying he went to ukraine to try to fight for the ukrainians against the russians, but he's 58 with no military experience so he was turned down so he was trying to recruit people to the cause of the ukrainians. very passionate and articulate but when you look through his twitter accounts, you see strange things like a tweet urging north korean dictator kim jong un to come to hawaii. barry nonsensical and strange things, raising questions about his mental state. we know from law enforcement that we have somebody who allegedly was lying in wait for donald trump, pointing a rifle at the golf course, discovered by secret service who fired shots at him. he fled and got in an suv. they were able to track down that suv and pulled them over
12:37 am
and arrest him. they have recovered an ak-47 style rifle, a gopro he had with a backpack with ceramic tiles. maybe he thought those were akin to ceramic plates and a bulletproof vest. a very serious threat. got within 500 yards of former president trump as he was playing golf at that course. not long after another person was able to take a shot at trump and that's bound to raise questions about the secret service protection even though they were able to the word this attack. >> we have been talking about ceramic plates. are these actually tiles but not ballistic plates? >> that is my understanding and officials referred to them as tiles -- >> i thought that seem strange. there's a difference between ceramic tiles in your bathroom and ceramic plates that go in your bulletproof vest. he seemed to be interested in
12:38 am
ukraine and military service -- >> the picture we have, he is wearing what appears to be a military style best. often used in war zones with plates that are often sometimes plays. we don't know if there was anything in that best in that picture. let me ask about what they have access to right now? do you know if he is cooperating with the investigation? in the past when we have talked about trying to construct the final steps and movements of the assassination attempt and butler, a lot of that came down to the technology footprint of the shooter, accessing his phone and computer and laptop. in this case, the suspect is alive. he has access to a lawyer and remaining silent. i suspect that would make the initial part of the investigation challenging for investigators. >> you are right. we don't know the answer to the question whether he's talking.
12:39 am
we only know what officials say at the news conference which when he was detained he had a flat affect and didn't seem curious why he was being surrounded by law enforcement officers with rifles. i believe they said he had been cooperating but that was hours ago. we don't know whether he's talking or not. we know, unlike the shooter and butler, he appears to have a more extensive public social media history. it stands to reason the fbi is learning more about him right now going through than they could learn about the shooter and butler and took pains to hide his electronic footprint. the fbi is obtaining search warrants and going to the providers, every device, canvassing the potential relatives and associates and former employers to create a picture of this person and discover why he may have done this. at the end of the day, if he
12:40 am
was mentally disturbed, it may not make sense. it is fair to say if he was passionate about the ukraine cause, donald trump has not been as passionate about the ukraine cause and been accused of being sympathetic to putin. that on its face looks like something interesting but these are the things the fbi will examine. >> we have a statement released by the president, joe biden. he reads as follows, been very regarding the federal law enforcement is investigating as a possible assassination attempt of former president trump. a suspect is in custody and i commend the work of the secret service and their enforcement partners for their vigilance and efforts to keep the former president and those around him say. i am relieved the former president is unharmed. there is an active investigation as law enforcement gathers more details about what happened. is i've said many times, there's no place for political violence or for violence ever

hostage rescue team. thank you for being with us. there's all sorts of, there will be monday morning quarterbacking but it's interesting how this went down. it's unclear whether the suspect got a shot off. the information right now as he did not. he was shot at by somebody in the secret service identified him and shot a him and he tried to get away. the used a license plate technology to identify the tags and he gets pulled over 40 miles north of palm beach and arrested without incident. not a bad day's were considering someone could have been assassinated today. >> absolutely. when you look at everything that went on in pennsylvania, everything went right here. part of it is pennsylvania have been. pennsylvania happened because of complacency. how many events have they gone to and nothing happened.
12:46 am
you get lulled into this state of its another, whatever. i think if pennsylvania had not happened and the secret service agent saw what he thought was a rifle barrel sticking out of the fence, i don't think he would have taken a shot. the fact he was in the mentality this could happen because it just happened literally, he saw that, and he reacted the way he should have. i think they cut the shooter before he was ready to shoot. i think the fact he had his ballistic vest hanging on the fence and his backpack, he was probably sighting in his rifle. when looking through a scope, the field-of-view gets very narrow so he was probably putting it through and seeing what he could see and where was the best place to take a shot. that's when the agent saw him. he was probably waiting for trump to get in his amber side of where he had a better shot. the secret service agent interrupted him.
12:47 am
>> let's talk about that. i don't think most people can wrap their head around to identify potential gunman in the shrubs. >> i'm not sure i could see a gun man 20 feet away. >> talk about that. the ability for the secret service agent who took the suspect out, were not sure how close he was to the fence, but the shooter was 300, 500 yards away from the president is the agent made his way to the whole ahead of the former president and the other members of the party. how remarkable is that? how well trained must you be to sure -- spot amidst the shrub, we don't know with the suspect was wearing. trying to conceal his identity but seeing that in that landscape and identifying the potential threat and engaging immediately? >> it is great in order for someone to do that. i was an fbi sniper and is a
12:48 am
sniper you are taught to not let your peril protrude out a window or out the bushes. cut back the vegetation and shoot from behind it because people can see a peril. in the sniper world, when you hunt a fellow sniper, you don't do those things. the fact this agent was walking down and there's so much bush in that area, for him to see one barrel sticking out and identify it as a rifle barrel it's one of those things. it is straighter than a branch or tree things. it does definitely -- for him to do that and engage it, my thing is, he engaged it without maybe being able to know he would get a good shot but he disrupted the ability for the gunman to shoot. when they look in pennsylvania, when the one police officer looked up and caught, climbed
12:49 am
down if he got a round it out, you are interrupting the person's engagement plan. on this one, the agent was walking up probably on the side where the golf cart path was, at the gunman was looking through his scope, he can see peripherally. 100, 200 yards out, seeing what he could see and he doesn't have his peripheral vision so the agent saw it and engaged like a should have and that person was interrupted and ran. he did not have his vest on. the fact he brought a vest meant he was looking for some type of engagement knowing when he took the shot he would probably receive fire back. he wasn't there yet. i think he interrupted it which is what you want to do. you want to catch an assailant in the planning mode rather than the execution mode. it's left and right of x. x's
