that does it for us. you can listen to every episode of the 11th hour for free. grab your phone and scan the qr code on the bottom of your screen. for now, i am signing up. from all of our colleagues across the networks of nbc news, thank you for staying up late. we will see you again tomorrow. okay. believe it or not, and i cannot believe it, we are 50 days out from the election. i don't know about you sitting at home, but the ground is ever felt shakier beneath my feet just 50 days out from an election than it does right now.
12:01 am
there's a lot happening all the time. the days sometimes feel like weeks in the weeks feel like years. the stakes feel impossibly high. because they are. tonight we will do our best to make sense of this moment that we are living through together with two very smart and sensible people. democratic senators elizabeth warren and jon ossoff will be here at this table, and i can't wait to talk with both of them. first, i want to get you up to speed about where we are right now. starting with the fact that for the second time in about two months, authorities are investigating what the fbi's calling an appear in assassination attempt. here is what we have been able to piece together. yesterday afternoon, secret service agent at the floor to golf club spotted a subject armed with what he perceived to be a rifle on the public side of the golf course perimeter fence. less than 400 yards away from
12:02 am
trump and where he was playing golf. phone records show the same guy had been waiting there for about 12 hours. the secret service agent fired multiple shots, forcing the suspect to flee until he was pulled over and apprehended on i-95. no shots fired except by the secret service. the suspect is in custody and that suspect, ryan wesley routh, appeared in court and charge with two federal crimes. there's a lot we don't know, and there's important questions about whether or not the secret service is up to the task of protecting trump or anyone else they are responsible for. for his part, trump initially reacted to this with a bit of gratitude, thinking the secret service and law enforcement for the incredible job they did keeping him safe. but, didn't take long for him to pivot and when he did, he really pivoted. today, trump told fox news the
12:03 am
rhetoric of president biden and vice president kamala harris is, quote, causing me to be shot at. referencing their past threats, comments calling him a threat to democracy. in the next sentence he said there are people who want to destroy our company -- country. it's called the enemy within and they are the real threat. he also posted to truth social that because the rhetoric on the left, bullets are flying and it will only get worse. he posted again the ominous refrain, fight, fight, fight and all capitol letters linking to his fundraising page. i think one all of that i went through and a moment like this, it's important to take a step back and acknowledge that multiple things can be true at the same time. the threats against trump are abhorrent as they are against any person in public life. they are and should be condemned by everyone.
12:04 am
trump himself is also doing very little to calm things down, and baselessly blaming his political opponents. that's also true that he is doing that. we cannot ignore that second piece and we should not. we can't ignore that right now trump's inflammatory rhetoric is having a real-world impact. look at what's happening right now in springfield, ohio. ever since trump elevated a completely racist lie about haitian immigrants heating pads to 67 million people watching the debate, the city has been on edge. mike dewine announced starting tomorrow, troopers will be stationed throughout the springfield city school district as a precaution. that after elementary schools were evacuated today adding to a week of bomb and shooting threats. clark state college is also
12:05 am
closing its campuses and moving classes online this week. multiple hospitals have been forced into lockdown. members of the haitian community in springfield are hiding in their homes. those are very real consequences of a very fake story that has been promoted and propagated by donald trump and his running mate j.d. vance who represents the people of ohio including springfield. talking about what's happening in springfield and talking about the impact of trump's words is not incitement to violence against him. it's talking about his long history of inflammatory rhetoric isn't incitement of violence ever. don't let anyone tell you otherwise. at the end of the day, no elected official should be threatened. no american city should be terrorized. if you're having a hard time figuring out how to hold this in your head, you are not alone. the second assassination attempt, the impact of trump's words in a city like
12:06 am
springfield has long history of dangerous rhetoric, we have to hold them in our heads at the same time. i get the struggle but we have to. my first guest said something that stuck with me as i was grappling with a version of this question after the assassination attempt on trump in butler, pennsylvania, nine weeks ago. >> president biden rightfully so is calling for the country to end political violence saying it's time to cool it down. do you think this changes the state of the campaign? do you believe these candidates will be somewhat different going forward into the general election? >> let's talk about what it means to cool it down. in my view, cooling it down does not mean not talking about things that are important. >> cooling things down doesn't mean ignoring these important issues. toning things down doesn't mean
12:07 am
turning a blind eye. we are 50 days out from the election. politics should be about arguments of idea and contrast and choices. right now, one candidate is saying there is no place for violence against anyone, anywhere. another is saying there's no place for violence against me. joining me knows democratic senator elizabeth warren of massachusetts. it is so great to see you. i have thought a lot about what you said. a lot of people watching are trying to grapple with this. many things happening at the same time. trying to understand this moment. i gave my sense of this moment. what did i miss her get wrong? >> i think you got it right and that's a part we have to hang onto. we are fighting for our democracy. we are fighting for issues. we are fighting for a woman to make her own choices about abortion, family.
12:08 am
to be able to make choices about ivf. we are fighting for bringing down prices for working families. these are serious issues. donald trump wants to go one way and kamala harris wants to go in a very different direction. donald trump has a concept of a plan. kamala harris has real plans to do that. you put things on the table and test them. you talk about the strengths and weaknesses and to would be helped and hurt. part of what's happening here is donald trump would like nothing better than to shut down the comparison over issues. let's face it. when we talk about what's happening in america today for example on reproductive freedom, and people making their own decisions, we live in an america where nearly 40% of all women live in states that ban abortion. this means that for these women,
12:09 am
they walk into an emergency room in the middle of a miscarriage, the doctor can examine someone and say, i know what's coming but you are not near enough death now so go to the parking lot and hemorrhage for a few more hours and then come back and maybe i will be able to give you the medical treatment you need. doctors, instead of thinking what does my patient need, they think of a criminally prosecuted if i miss guess how close my patient is to death when i go ahead and give her the abortion that she needs to save her life. so, the reason i emphasize something like that is trump doesn't want to talk about that. j.d. vance doesn't want to talk about it. republicans running for office don't want to talk about it, but make no mistake, it's on the ballot. donald trump and j.d. vance are coming for abortion,
12:10 am
abortion ban nationwide. kamala harris and the democrats are saying, we will put roe v. wade, access to ivf right back in and protect not just people in blue states but protect everybody in the country. that's a clear comparison, and trump, j.d. vance, they've got to find something else to talk about. throw up what they can. >> the choices which are clear to your point, that must be hitting them right now. one of the things that struck me, to your point, they are trying to change the subject. this fight, fight, fight chant what you heard trump do right after the shooting in butler. we saw that once again on truth social. that scares me a little. how do you feel about that? >> i am a fighter.
12:11 am
i have written books that talk about fighting, but i mean with words. that is all this means. in a democracy, we need to be able to go back and forth with our words. we need to be able to disagree and put those issues in front of the american people. that is how we inform people about our positions, and that's how we get back in and make a decision the majority of americans want. it's only by talking about those. that is very very different from a man who incited an insurrection. a man who refers to his political rivals is firm and. a man who has said just in recent days that he wants to lock up the people who don't agree with him. that is a very very different kind of approach, not just a politics, but to democracy.
12:12 am
one that ultimately does put our democracy at risk. puts us all at risk. just as you stated, i want him to be fully protected. i want kamala harris to be fully detect -- protected, but we have to keep the space open to talk about the issues and to draw the contrast with donald trump. he is responsible for the things he has said in the same way that kamala harris is responsible for what she has said, for every plan she has put out there, for every idea she put in the public space. we need to keep this open so people talk and people are able to make a decision. do you want a candidate who is embracing nationwide abortion ban? he wants to lie about it and pretend because he knows it's unpopular, but will not say that he would be to an it, he
12:13 am
will wink and nod at his extremist groups. or do you want someone who flatly puts it out there and says give me a chance is kamala harris does and i will sign protection access to abortion and ivf into law. >> it is a huge difference. i want to ask, i mentioned springfield because i think it's important for people to understand the facts and the impact of language. i want to play something that j.d. vance said about springfield and talk about that too. >> the american media totally ignored the stuff until donald trump and i started talking about cat memes. >> it wasn't just a meme. >> if i have to great stories of the media pays attention to the suffering of the american people, then that is what i will do. >> i raise that because people are being terrorized in springfield, ohio. there are haitian families
12:14 am
huddled in their homes. he said he is making up stories. it's a distraction but having real-world consequence. >> think about what he said. he said he will lie to get attention. when someone has said that, then you can't believe anything they say. he will lie to get attention. if it hurts other people, if the consequences of that lie are to put people at risk? evidently j.d. vance just doesn't care because he is hopeful that it will advance donald trump and j.d. vance, and give them one more opportunity to win the election. i talked to people, we have a vibrant haitian community -- >> third-largest in the country. >> and i talk to people in our
12:15 am
patient community. i had a conversation on saturday with one of my dear friends who was describing what it's like to have to tell little children whose parents are haitian, growing up in america, and tried to explain what's going on, what they are hearing in the news. and what it is like for seniors who have come here and flood times of great stress and try to build secure lives here, and they watch something unfold like this? this ugliness and hatred, fingering them, pointing them out? all a lie but a lie that can do enormous damage. that is the kind of thing that tells you who people are. for this one, once again, think about the contrast. who do j.d. vance and donald trump fight for? nobody but themselves. kamala harris, tim walz, they
12:16 am
are fighting for all our families. not a few but all our families. >> quite a contrast. thank you for agreeing to stick with me. we have some any more questions. ore questions.
12:17 am
if we can come up with a plan that will cost our people, our population, best cash then i would absolutely do it. until then, i run it as good as it can be run. >> you still do not have a plan? >> i have concepts of a plan. >> i wish we had seen vice president kamala harris face in that moment but that moment will have shelf life. donald trump has been promising to get rid of the affordable care act since he first ran for president 10 years ago and has no plan what he would replace it with. having only concepts of a plan is probably one reason trump
12:18 am
doesn't talk about health care on the campaign trail. senator elizabeth warren said there's another big reason. a new bed, the problem is not that trump can't think of a way to put his values into action. the problem is when he and other republican leaders produce plans with details, they horrify the american people. senator elizabeth warren is still with me. there's a lot to be said, but you are a policy nerd in the best way possible. what is one horrifying thing they don't want people to know? >> that they have tried to repeal the affordable care act. so everyone remembers, that means repeal the law that says everyone with a pre-existing condition cannot be discriminated against. anybody out there with a child with a heart anomaly for anyone who has had any medical condition, donald trump wants to say they can be discriminated against. 26-year-old on your policy and millions of people, millions of people across this country, who
12:19 am
have access to health care now because they have insurance through the affordable care act. donald trump doesn't just say, i will work something out. i still remember because i was in the senate in 2017 when they got it through the house to repeal the affordable care act. then they went to the white house and celebrated taking away health care from millions of people, but they had to get it through the senate. you may remember that night. >> i do. >> kamala harris, senator, was on the floor. we were so nervous you literally couldn't sit down, democrats. we understand the republicans have the votes. if they stick with donald trump, americans are going to lose health care all across this country. it was john mccain that last vote when he did the thumbs down and saved health care for
12:20 am
millions of americans by one vote. don't tell me trump doesn't have a plan. his plan, he said it plain as day just last year, his plan is to get rid of the affordable care act. understand that is not all of his plan. his plan is to get rid of that $35 insulin and the $2000 cap on what seniors are spending. to get rid of the negotiation with medicare, the big drug companies. the plan is a nationwide abortion ban. get rid of mifepristone. how do i know? because they laid it out. they laid it out and project 2025. trump himself has said it. j.d. vance has said it. they laid out their plan, and it is horrifying. here is the thing about it. it's not just horrifying. it's the american people don't want it. i'm not just talking like a handful. i am talking they are
12:21 am
majorities of americans. i like having access to health insurance. i like having people with pre- existing conditions being protected. i like people being able to make the run decisions about ivf and abortion. the answer now from donald trump and his sidekick j.d. vance is, concept of a plan, because i don't want to talk about exactly what they will do if they have the power. we will not let them get away with it. >> i know you are not. i want to ask, there's a vote on ivf. >> tomorrow. >> last time republicans did not allow the right thing to happen, shall we say. is j.d. vance going to show up? >> let's see. where is j.d. vance? allegedly, donald trump friend of women, champion of women, says he is all linsky and he
12:22 am
wants to protect ivf and help pay for it. you will be glad to hear that helping pay for it and making sure it is accessible across the country, that's what the vote will be on tomorrow. i haven't heard it, but i assume donald trump is on the phone tonight calling every one of those republican senators seeking vote to protect ivf. let's wait and see if that happens. >> we will wait to see if that happens. it was great talking to you. always love having you on the show. donald trump is unveiling plans for his latest graft as we speak. this time in the crypto space. fortunately, my colleague is here. she will join us in a few minutes. if you want to understand what the republican party is trying to do on everything from abortion rights to voting rights, look no further than

since the overturning of roe v. wade, we have witnessed the horrifying effects of state abortion bans and restrictions including stories of a woman being refused care, forced to suffer in parking lots. we were talking about this with senator warren, until they're

sick enough to be treated. left to miscarry and bobby bathrooms. according to a report from pope paul the -- republican, we know they have resulted in the death of at least two patients in georgia. this focuses on the story of one of those two patients, amber. she was a 28-year-old single mother of one. she died on august 19, 2022. one month after the six week abortion ban went into effect. because of that ban, amber was forced to find care out of state and north carolina. when she returned home to georgia, she had a rare complication and on the evening of august 18 was rushed to the hospital after vomiting blood and passing out. as her condition deteriorated, her doctors discussed initiating a procedure called the d and c but georgia made performing the procedure a felony with few exceptions.
12:29 am
any doctor who violated the law could be prosecuted and face up to a decade in prison so amber waited and she waited and she waited. after 20 hours, she was finally taken to an operating room. by then, the situation was dire and during the surgery, her heart stopped. according to the findings from georgia's maternal review committee, there was a chance that her death would've been prevented if she had received a d and see earlier. this is post roe america. today would've been hurt 31st birthday. she should've lived to see it. i want you to hold that story in your mind as you listen to what j.d. vance said tonight in the state of georgia. >> the supreme court's decision was not only a victory for the constitution but a victory, a testament to the resolve of tens of millions of pro-life americans who never gave up on
12:30 am
the cause of life. we are united in our gratitude and admiration for these devoted defenders of the unborn and the judges, justices and especially trump. >> overturning roe was a victory says j.d. vance in georgia today. i know one thing. it sure wasn't a victory for amber thurman or her little boy who lost his mom. joining the senator jon ossoff of georgia who chairs the senate subcommittee on human rights and was in atlanta this morning were held there second field hearing to directly hear from women and doctors on the impacts of the six week abortion ban. he's married to an ob/gyn who i'm sure impacts your thinking. the story i just told from propublica a shocking and upsetting. i had a hard time getting through it. it is not an anomaly and you were in georgia this morning and you have had these hearings, you are hearing the
12:31 am
stories from these women who are experiencing the impacts of a six week abortion ban. what did you hear from seven these women? >> good to see you. in these series of hearings we have heard directly from ob/gyn doctors and from women whose pregnancies have been impacted by the state's extreme six week abortion ban. it's worth setting the scene. before donald trump overturned roe v. wade and governor kemp impose this abortion ban, georgia had one of the highest maternal mortality rates in the country and half of our counties lacked any ob/gyn at all. there's an underlying mortality crisis in georgia. what we heard from ob/gyn's in these hearings is, first of all, ob/gyn's are deterred from training and practicing in georgia by the threat of criminal prosecution. worsening the ob/gyn shortage. second of all, this law is putting women's lives at risk.
12:32 am
it is delaying their access to care during complications, during high risk pregnancies, and during miscarriages. today, we heard from two women who had high risk or nonviable pregnancies but were forced to continue those pregnancies are to leave the state to get care because their doctors feared prosecution. >> it is horrible to hear and these standard forms of treatments when there are bans, women don't have access. you raised the impact on doctors. i wanted to play a video from your hearing today. >> physicians, myself included, have seen patients in the icu with sepsis, with renal failure needing to feeds, with hemorrhage, needing blood transfusions or a hysterectomy. who would not have been in those positions if we had been able to offer care to avoid
12:33 am
further harm. >> i am not a doctor, but you're taught as a doctor to heal. do no harm. these doctors are not able to do what they were taught to do in medical school. talk, you mentioned a little, but the impacts on the medical profession and ob/gyn's across georgia who are trying to save women's lives and unable to do it because of the law. >> one doctor told a story. she was a young doctor born and raised in georgia and wanted to practice in georgia but because of the threat of criminal prosecution for doing her job had decided not to train our practice in georgia. we already have a shortage of ob/gyn's. instead, she was practicing in massachusetts. a pregnant woman from georgia who was having severe complications had to leave georgia to get care. on the way, lost her pregnancy. wound up in this dr.'s exam
12:34 am
room in massachusetts with sepsis, a life-threatening blood condition because she had been unable to get the care she needed in georgia. what we are clearly hearing from doctors and from women who have experienced pregnancy under the georgia abortion ban is it's having a severe impact on maternal health and resulting in denied or delayed and potentially life- threatening denials and delays of care to women with high-risk pregnancies. >> it's horrifying to hear these stories and they stick with you. one of the things we were talking about before we started this conversation, it's not a secret what and abortion ban would be like. a six week abortion ban is essentially, a lot of people don't even know they're pregnant. when trump and vance say leave it to the states, georgia, you know what it's like in georgia. this is what it would be like across the country. i want to play something vance said about the possibility of a
12:35 am
national abortion ban and talk about what people should know. you are talking to women who are experiencing it. >> veto of federal abortion ban? >> i think you would. >> j.d. vance has said you would veto it if it came to your desk. >> i did not discuss it with jd >> would he veto it? >> i think i've learned my lesson on speaking for the president before we talked about an issue. >> i wanted to play that because it's often this talking point, we can punt it back to the states and he would veto and abortion ban, but there's real-world consequences. what do you want people to know to use this talking point to send it back to the states. the states can decide. >> it has been two years since trump overturned roe, brian kemp banned abortion at six weeks. we have had the time to see the effect of these laws and by listening to ob/gyn doctors, by
12:36 am
listening to women whose pregnancies and health have been threatened by these laws, we can see the devastating impact this is having on women in georgia. georgia women, no matter their political affiliation, do not want or need donald trump, brian kemp, j.d. vance managing their high risk pregnancies. managing their miscarriages. doctors in georgia feel criminal prosecution because of this law. that means women are not getting the health care they need and we heard today in georgia that women are forced to continue with high risk and nonviable pregnancies as a result. >> the subcommittee is doing important work in elevating the faces and voices of these stories that make it clear what's happening. i told that amber thurman story and the georgia committee, fall of 2022.
12:37 am
there's a lot of time that has happened since then. is there anything the subcommittee can do or other legislative tools that can have a better accounting for deaths that are resulting from abortion bans and the impact of roe overturned in georgia or other states? >> i am holding these hearings to give doctors and patients the platform to testify to what they have experienced. we are going to continue to hear from more and more doctors and women who have been impacted. the bottom line is a six week abortion ban, which takes effect before many women even know they are pregnant, is having a dire negative impact on the quality of health care available to pregnant women in georgia. we hear through personal stories and we see it through the data. >> it was great talking to you. thank you for holding these hearings and you will elevate more stories, potentially. important for people to hear. donald trump is launching his latest grift right now

charge of deregulating already under regulated industry, what's the real world impact, people sitting at home should understand that could have? >> imagine the wild wild west inside out and upside down and backwards. it is no surprise, he is no fan of the sec chair and remember trump would be in a position to choose the new is easy chair and he says he's done a terrible job and not open to crypto. crypto enthusiasts would argue we need someone more pro-crypto. vice president kamala harris has said she's open to learning more. the industry has to be regulated. it shouldn't be open or close, but you have a massive conflict of interest if the president of the united states can stand to make a fortune if the business has no regulation. people must pay attention to this. >> thank you for explaining to me, to all of us, and we will be watching you at 11:00 p.m.
