donald trump is leading efforts to steal this upcoming election also. republicans are filing a flurry of frivolous but dangerous election lawsuits in swing states across the country. like in georgia for the third largest county in pennsylvania with are trying to tell officials to count ballots by hand. also in nevada. or in all the places they are working try to delay or block the certification of election results. 30 days out from the election. these are pages out of the same playbook we sought in 2020. this time they've had some practice. i know trump's allies like to say there focused on the future. all of this is the future. we saw on january 6th and what jack smith outline and list cheney outlining, this is not the past but the plan. a former capitol police officer who protected the capital during january 6 and has been out campaigning across the country. michael cohen is don trump's

get your thoughts on it. >> i'm confident it will be free and fair. i don't know if it will be peaceful. he didn't accept the outcome of the last election. i'm concerned about what they will do. >> it's a remarkable thing for any president to say i'm not sure if it will be peaceful. >> absolutely. it was peaceful for the entire history of america until it wasn't because of donald trump. donald trump set the precedent for it not being peaceful. you mention the lawsuits. of got to acknowledge mark and his group and the work they are doing trying to save democracy at the dish excuse me in the courtroom. it's important that donald trump -- when he debated joe biden he was asked three times would he accept the election results. he could not answer that straightforward. that's what he did leading up to january 6th.

he planted the seeds of doubt and that's what is doing now. when joe biden said it may not be peaceful, it's unprecedented for him to say but it's also a real hottie because we saw what happened on january 6 were police officers were beaten because donald trump. they were there because of a lie. while they were attacking police officers, they said because donald trump sent us. the election was stolen. january 6, the violence that occurred that day was based off of a lie. congress and i appreciate the work they did with the electro college reform act. they've done things but -- what joe biden said it would be free and fair but will it be peaceful ? that's yet to be seen. >> that statement and what we are seeing with our own eyes. a reminder and michael, there are a number of republicans out there who are saying let's move on. january 6 is in the past i'm struck by the fact that donald trump is essentially running on

this. he's made clear he wants to replicate some of the things that happened in 2020. you know him well. what you make of all of these efforts by enough republicans it's in the past and does it matter. any reason to doubt you was to repeat the actions he took four years ago ? >> that's an interesting question. first and foremost, let me say the republicans that are demonstrating their fealty to donald have something they want as a result if god forbid trump wins the election. there are also a slew of republicans that are not asking for the same thing. they do not want to just put this in the past. they want to see the united states. they want to see unity in the united states and start getting rid of the chaos and divisiveness so we can work together for mutual benefits. this is very different than

what donald trump is saying. donald trump continues with the rhetoric of divisiveness and hates. the big warning i want people to understand is what donald trump says something, stop saying -- what he intends to do and when he turns around and says the head of this network or other people who are critics he intends to use. the military to round up his critics or opponents. he intends to do it. i say that with first-hand experience. what donald trump, bill barr the department of justice, bureau of prisons did to me. the unconstitutional re-manse of the united states citizen to give me the first political prisoner in this country to be held by my own country because

>> by 1:30 on the afternoon of january 6, donald trump was alone in the white house dining room scrolling twitter and watching fox news. here's a little taste of what he saw in real time. >> why did you come here ? >> because president donald trump told us. we had something big to look forward to. i believe vice president mike pence was going to certify the electoral votes or not certify them. that has changed. it's a big disappointment. several hundred thousand people who are very disappointed. i still believe president donald trump has something else left. >> that sounds a lot like some of trump supporters were awaiting marching orders. it was moments later the trump added fuel to the fire tweeting mike pence didn't have the

courage to do what should have been done. all of that is detailed in a new special coun filing released by a judge this week that says when trump learned pence was at risk he responded, so what. joining me now is our inside law firm. two favorites of msnbc. andrew, because the evidence against trump in the case that became public. we did learn more extensive details that were known but as you read this, what were your main takeaways from this brief ? >> it is true the broad picture is something we knew but the level of detail minute by minute almost keystroke by keystroke details were devastating. that's how prosecutors put together a case. you have witnesses but you have hard evidence through text, telephone records and what a person is doing.

that's documented to cooperate all of that. for instance, in the january 6th the image of the president being derelict in duty which is true is given a lot more amplification he was doing things. he was seen the violence on tv and react thing. he was causing people to call people in congress to take action. he was sending out his famous tweet about pants provoking violence. you get a more granular detail description because of the tools federal prosecutors have not available to people on the hill during the january 6 investigation. >> it was an interesting level of detail we can reconstruct the day. the texture that andrew mentioned that the forensic details outlined in this report, why is that important to the process and how would it be used moving forward by jack

smith's team ? >> the supreme court in june this year's said that when trump asked in his official capacity he's immune but if he acts in his personal capacity he's not. with this filing by jack smith is designed to say is trump everything he did that they basically, the personal was the political and vice versa. there was no independent official acts he was saying it. he was trying to run as a candidate and cement or take his position as a candidate and not acting as the president. for example, andrew talked about how there was this dereliction of duty on january 6th. at the same time, trump is tweeting things to pence and alike the most important point is that one of his aides came in and said to him, pence is under attack and trump's

response was so what. paints the picture of someone who was not protecting the country, whose out for his own personal ends. this is why trump is trying to distract from his filing and say i'm looking forward and alike. not surprising he's looking forward. jack smith showed 77 potential witnesses and statements that will be used against trump at his criminal trial. >> no surprise at all to your point. andrew, let me ask you about this claim about the release of the filing for the informal 60 day quiet period before an election. that's been debunked. since you are here, explain why. >> as we like to say in the law, that takes an enormous voice to make that claim. this should have already gone to trial where the defendant,

donald trump would've had his day in court and the public would have seen the evidence and the verdict is one at a jury would have determined this was slow rolled as a result of donald trump's own actions. to sit there and say i'm appalled that evidence has come out about a case that's been indicted is beyond the pale. the 60 day rule to answer your question does not apply to indicted cases. it's about doing things like what james comey did. smearing someone who has not been charged and never was charged by saying is a criminal investigation when the person has no ability to defend themselves at that point. here, donald trump has had ample opportunity and still can't if he thinks there's something factually wrong in the jack smith submission. he is free to file something and notably he said i will not

file something until after the election. what does that tell you about his ability to counter the facts that have been put forth by jack smith ? >> tells you alive. the other thing i've been wondering about is what comes next. the election is 30 days away. trump lawyers as for a five- week delay to respond with a similar brief. they have until november 7th which is two days after the election. is this delay tactics ? what are they scrambling on behind the scenes in your assessment ? >> all delayed patrick's. trump's whole plan have been successful in delaying resolution passed the election. here's what i think really matters and we sat in the vice presidential debate. you saw the vice presidential candidate say basically that he could not admit that donald trump lost the election. when j.d. vance did that and he is the

number two person and can't stand up to trump, that tells you all you need to know. the most important thing you do as a president is surround yourself with people who act as a check and balance against you. fdr, lincoln did that. by contrast with trump has done is surround himself with a person who is a 100 % lackey and trump is telling the playbook now which is whether they win or lose they will claim they won and have a vice president who will accept that and pressure state legislatures, pressure governors to try to throw out the votes in these various places. if they can't admit 2020 was a loss for them, what makes you think that 2024 is any different ? that's why this discussion matters. that's why with jack's -- jack smith did explain to the american people with the detail that andrew mentioned, that's

immigrants. this week we got another egregious example of that strategy. trump lied about the efforts to help those impacted by hurricane helene. >> they stole the fema money just like they stole it from a bank so they could give it to their illegal immigrants that they want to have vote for them. this was a tragic hurricane. may be the worst we've had. they've got no money. what happened to the money ? they were given only billions for this. he spent it on illegal migrants coming into the country. a big percentage of which are murderers. >> first of all, that is not true. funds are not being stolen. communities are not being ignored. fema and the biden administration and not choosing migrants over disaster victims. trump has purposely inflating two different programs funded by two different sources.

let's be clear about what's happening. trump is trying to exploit the victims of a natural disaster to demonize migrants. even many republicans are begging people to stop pushing this information. will you all stop this conspiracy theory junk that is floating all over. it's a distraction to people trying to do their job. the republican mayor of knox county, tennessee said, please quit spreading those rumors as they are counterproductive to response efforts. north carolina center thom tillis have this to say that the federal response. >> this is a new playbook for anyone who thinks any level of government, anyone here could have been prepared concisely for what we are dealing with clearly are clueless. they have done a great job. >> during any natural disaster, the goal is for leaders to work

we know you've had quite a week. we appreciate you being here to talk to us. i know we will talk about the strike but let's start with the hurricane and aftermath of hurricane helene. your department has helped. the washington post reports that rumors and conspiracy theories have prompted a necessary evacuations and some of these falsehoods have been viewed millions of times on social media. that some of the reporting. there's lots of reporting and local papers how damaging this has been. you and your department have been so involved. how damaging has the misinformation been and what impacts are you seeing in terms of the recovery and people are trying to find loved ones and get accurate information ? >> it can have a real cost for people on the ground who are already dealing with so much. it's right up there with making sure people have access to transportation, making sure

they get their power back on, making sure communications come back. also making sure you can get good, accurate and useful information. unfortunately, that has become more difficult in the digital environment. it's become more important to have trusted and reliable sources. we've worked to make sure information that gets to users is good. state 511 systems and for responders we set up a hotline so if you're involved in an emergency operation, you can call and get our data about where a road may be open and available or if a bridge is taken out. a lot of it seems to be driven by politics. that is actively harming and disrupting the process of getting back to normal for so many people whose lives were upended by this awful storm. >> and the recovery is

continuing. i saw this and i'm sure a lot of people saw this. you pushed back from misinformation about hurricane relief in exchange with elon musk on twitter. we are showing it. telling him that he can call you if he was confused. he publicly thanked you and said you're on the ball which is something he doesn't do. did you speak with them or that he take your word for it online ? >> he took me up on that. we had a conversation. what was happening was the faa was the closing down any airspace but there was an issue with pilots helping to get started link equipment to where it needed to be. having the right information. we work that with local authorities and took care of it. to me it's an example what the best thing to do is pick up the phone. i don't want to get too much in the weeds but since it has been

confusion and misinformation about the fias temporary flight restrictions. this is a process in place for decades. if you have a disaster area and there's a lot of rescue operations going on, a local airport or fire department or coast guard flying helicopters can request what's called a tfr. doesn't shut down the airspace but increases the level of coordination that goes on. you want to make sure the airspace is safe and you prevent the risk of collisions. when you hear that term, that's what's going on. i don't mean to get that technical but have been amazed how little detail gets blown up on the internet into something it's not. a lot of good samaritans and civilians helping because they've pilots licenses and that's a great thing. it's important they coordinate and make sure it's safe. >> sometimes the weedy details are essential for accurate

information. let's talk about the port strike. if this had not been resolved and it was resolved quickly. it would have had a huge impact on the economy. with everything going on, i don't know if everyone understands the depth of the crisis that was averted. i'm sure you did scenario planning and thought about this internally. what would have happened if the strike continue for weeks or months ? >> this was a major, major concern for transportation systems. if it were not for the fact there was so much else going on that same week, it would have been the number one thing on americans minds. it has caused issues. the ports and supply chains are working through. they will catch up. there's a big difference between a short stoppage and long stoppage. in three days, there was a deal where the parties agreed to higher wages for these dockworkers who are very deserving. these are folks who come to

work in tough conditions. they didn't get much of a raise under the last contract. many of them were going to work during the toughest days of covid. dozens of them lost their lives and they are trying to participate in profitability that the shipping sector has experienced in recent years. what happened was an agreement to get back to work and agreement provisionally on increased wages and get back to the table and work through other things like what to do about technology and automation and issues around other paid loyalties and benefits that go along with their work. the bottom line is we really count on our ports. we experienced this with issues on the west coast ports in 2021. we were able to work through those. you could really feel the pinch and in order to make sure our economy is running smoothly, there's no substitute for having all of our freight systems whether it's trains,

have to finish college. i believe that very much. you hired a lot of people and give great advice. marcus is not ready to be paid senior advisor yet. someone like him who is paying attention to, any fights -- advice or thoughts ? >> i will start with this. we have a great group of folks we call fellows who work for the michigan democratic party and do what you did. they spend time on the internet talking to their friends, neighbors and colleagues on campuses and high school. we would love to have you join us and be in michigan democratic party fellow and help spread the word. dip your toe in and see if you would be a campaign manager or campaign adviser. that's how i started. i was a young democrat first then it kept going from there., join us. you'll see if it's something you want to do. >> that sounds exciting. marcus, what you think about
