38 past the hour. judge chutkan has just released the dossier of evidence, including text messages, e-mails and transcripts gathered by special counsel jack smith in former president trump's federal election interference case. msnbc legal correspondent, lisa rubin is following this. lisa, i know you have been looking through this for hours now. there are a couple of thousands of pages here. what have you been seeing that stands out? >> i have been pouring over these. i want to give credit where it's due, to kyle cheney of "politico" who was the first to notice, among these documents, there is a portion of testimony that is credited only to a white house employee. we don't have that person's name. this is testimony that was never made public during the january 6th investigation itself. but when republicans took over the hours, they then released

this transcript with some redactions earlier this year. we now have seen a further unredacted version of portions of this transcript, where this white house employee who appears to be a valet is recounting how he told former president trump on january 6th that the rye rioting started at the capitol. former president trump wanted to know if the valet had been successful in taping the speech that he was giving at the ellipse. the valet informs him, sir, they cut away from your speech because there is rioting down at the capitol. at which point, trump says to him as he recounts in his interview, i want to go see. let's go see this. and the valet describes literally being handed trump's coat, handing him the remote in turn, and then trump parking himself on a chair in the white house oval office dining room to then watch the footage. it is now unmistakable based on this person's testimony that former president trump was

watching on fox news all the violence unfold at the capitol that day. that is an event he has described in recent days as you know, jose, as something that was full of love, something that our eyes tell us that's not what it was, and we know the valet showed him that's not what it was. >> why today? why was this released today? >> it was released today in part because there was briefing earlier this fall about immunity and what to do after the supreme court's immunity decision. this is a part of the exhibits that the special counsel's office attached to that. former president trump and his lawyers argued that these should remain all entirely under seal until after the election. they argued yesterday, it should be november 14th when their own brief and exhibits are due. judge chutkan refused that and said the public has an interest of seeing it, didn't cite conventional reasons for staying the disclosure of a public

judicial document. jose. >> lisa rubin, thank you so much. there's a surprising new twist in the war in ukraine today. north korea has apparently sent 1,500 special forces troops to russia for training, where they will likely be deployed for combat in ukraine, according to south korea's spy agency, and south korea's national intelligence service, working with ukrainian intelligence, official technology says they have identified north korean officers on the ground in eastern ukraine supporting russian forces. nbc's daniele hamamdjian is following this for us. thank you. what exactly is this report saying? >> well, the report, according to the south korean spy agency is that russian vessels were detected between october 8th and 13, carrying as you mentioned, 1,500 north korean special forces who are now in eastern

russia. it claims climatizing training in local military bases, the spy agency alleges that they have been given russian uniforms, weapons and fake documents for when they are deployed in ukraine. you got to wonder, the language barrier, the lack of combat experience, how that is all playing out in the field. now, you mentioned as well that south koreans, the south koreans are working with the ukrainians when it comes to facial recognition, ai technology, to identify the north korean officers who are already, according to the ukrainians, in donetsk, assisting russian forces who are firing north korean missiles. south koreans say this deployment is a threat to south korea, not only to south korea but the international community as well. they did say they would respond. how they would respond is still unclear. they said they would use all available means. it is worth noting, jose, that

over time, south korea has emerged as this major global arms exporter, selling missiles and fighter jets, and south korea has come under pressure by western allies, including washington, to help ukraine with lethal weapons against this war, in its war against russia, something south koreans so far have said no to at least publicly. it was just yesterday that volodymyr zelenskyy, the ukrainian leaders, says he believes 10,000 north koreans are preparing to join russian forces, something neither nato nor american allies have been able to confirm, but zelenskyy says if that is the case, it will be the first step in what he calls a world war. >> daniele hamamdjian, thank you so very much, and north korea adding to the regime of iran that's been supporting the russian invasion into ukraine. thank you. next on msnbc, could attacks on tips end up tipping nevada?

a businessman, an entrepreneur, built a real estate company in the state their roots to madison are where the similarities end. they couldn't be more far apart on the issues, on the economy, on immigration, the border, abortion, which is obviously so important in that state with the democratic governor leading a swing battleground state, and tonight in this debate, voters will get to hear them on the issues. i talked to both campaigns, and they tell me that their candidates are going to focus on the issues, trying to stay away from the political, personal attacks that we have seen so much through these races. i was in wisconsin yesterday. it's interesting to see their dynamics with the top of their tickets, harris and trump on the ballot here. the name recognition has been sticking close to trump. on the other hand, you mentioned

how tight this race is. it's one of three toss up senate races in the entire country. baldwin was running ahead with this in the summer. her team was satisfied, happy. as the fall went on, you saw hovde breakthrough. a new poll, an outlier, from morning consult. democratic operatives are pointing to. they're happy with it, but at the same time, you have republicans continuing to throw money into this race for hovde. tonight's debate is really going to be critical. >> julie tsirkin, thank you. great seeing you. a quick turn around for nevada voters who can start early voting tomorrow. they just got their first and last look of their choices for senate during the debate last night. democratic incumbent, jackie rosen and sam brown traded jabs on several issues including abortion and immigration. there was one topic they agreed on, no tax on tips. nbc's steve patterson is reporting from las vegas. great seeing you. no tax on tips. how is that going?

>> reporter: you know, jose, there's nothing like being in a swing state before a crucial presidential election deciding the fate of the country, and just turning on tv. because you will sit through like four to five minutes of campaign ads back-to-back-to-back and here you will hear no tax on tips from both sides, and so i think people are hearing this message ad nauseam. they're wondering how this will work as a policy. one of the biggest questions, we asked workers, listen to this. rachel is an undecided voter in one of nevada's most prized populations, service workers. in this cycle with the economy top of mind, one offering by both candidates has rachel ready to order. what do you think about having no tax on tips? >> i would love to have no tax on my tips. i want all the money i can possibly get with inflation and everything going on. >> reporter: covid hit nevada hard, and it still hasn't

not payroll taxes. >> at the end of the day, folks are not necessarily wed to a party, but, you know, the economy is the biggest issue out here. >> reporter: in the battle for nevada, the all powerful culinary union is the vanguard. thousands of foot soldiers getting out the vote. in the 2022 midterms, members knocked on over a million doors for democrats across the state. the union has endorsed kamala harris, and they're already out in force. >> you know, working class folks aren't dumb, they're smart folks. they're used to hearing a lot of promises from politicians, and you know, part of the problem with trump is that he lies, and he lies a lot. and so folks are skeptical. >> reporter: some economists are wary of the idea overall, projecting tax revenue to fall by some $200 billion over a decade. and noting it would only help a fraction of workers.
