on january 6 of 2021, donald trump had just finished his speech at the ellipse, walked back to the white house and asked the valley if he recorded the speech. he asked that i get it all on tv. to validate that he explained it was cut off at the end and what was happening. i don't know the direct quotes, it was sir, they cut it off because they are rioting at the capitol. he was like what do you mean? they are rioting. he said oh really? let's go see. i get the tv and hand him the remote if he started watching. i step out to get him a diet coke and he is seeing it for himself. the president sat down with a diet coke to one -- watch. it

is the appendix to jack smith brief arguing against the immunity claim. the document also confirms the exact time when he learned about the riot, 1:21 pm, three hours before he posted a video telling supporters to go home. joining me now is lisa rubin who has been writing about the document release. i think i lost the thread a little bit. >> these documents were used by the team to support the immunity brief. when they wrote to the judge and submitted a 175 page brief saying this is why our indictment should survive the immunity decision. they support about narrative with a heavily footnoted brief. the footnotes went to citations. these are all the documents.
5:41 pm
today's appendix is heavily redacted. scores of pages are fully sealed. we don't see what is on page after page. what we can see gives us an understanding of how jack smith wanted the judge to understand. >> it is the universe of evidence that supports the brief . we can survive the ruling. what are the redaction's? >> anything the government considered sensitive under the existing protective order that was entered when they first started turning over discovery, that remain sealed. for example, if somebody gave a transcript interview to the fbi or they gave grand jury testimony, we don't see that at all nor do we see the name of a witness. what we do see our transcripts of interviews that people gave to the january 6 committee.
5:42 pm
>> it seemed to me that most of what is in the appendix are things that were previously in public domain in some way or another came >> yes but like many things it is the compilation of them together that tells you more than each of the parts. i went through the snippets of the transcripts. they were presented in alphabetical order and put together a list of witnesses by matching them to their already public transcripts based on data and text. you can see who jack smith relied on. everyone from bill barr and kellyanne conway to greg jacob to bill -- who was then the campaign manager. one of the things i noticed that is interesting, the pen shaped hole. between the january 6 committee testimony of jason miller, who was then a senior advisor and

katrina pearson who was a campaign advisor that later advised the woman who gave nearly $3 million for the funding of the rally. there are 100 pages missing. if you think about alphabetically who is missing? the person that is missing could be pence and it's also the case that in the brief itself, when you look at the descriptions of the conversations between pence and trump, when you look at the page ranges it goes back to that nearly 100 page hole. and that is testimony that mike pence gave to a grand jury or gave an agreement to the special counsel's office. >> that is the reason we don't have it? >> correct. >> that reaffirms the suspicion that if and when it goes to trial, pence would be a witness came >> that is absolutely true. the supreme court said that it

5:51 pm
and mutually exclusive, but they are both made by the same pro-trump action committee to micro-target and manipulate vastly different groups of voters. it is the grossest, most cynical ploy i've seen in election cycle that is rotten with cynical ploys. it's all made possible by elon musk, who has given $75 million to the super pack that is bankrolling all of those micro- targeting campaigns. musk is just one of three billionaires -- three people total -- who poured $220 million into efforts to elect donald trump. musk is unique and uniquely dangerous, because with the website formerly known as twitter, human and an absolute vector of disinformation and bigotry which he sometimes personally interact with, all in the name ostensibly of free speech. but he is now banning reporters and blocking links to news the trump campaign doesn't like.

county, but not in a lot of other places. does that seem like a heck of a coincidence? >> if you things there. everything he said there about dominion voting machines is flatly untrue. as the company pointed out in a statement yesterday, and as we all learned last year when, as we remember, fox news had to pay dominion $788 million to settle a defamation lawsuit after repeating trump's lies about the voting machine company. trump also used his rally to bond with fellow paranoid conspiracy theorist. >> you think there is a shadow government behind the biden/harris administration? >> let me put it this way, it's not biden. >> who is it that is behind him? we know obama, okay? but obama -- >> i am just as curious as you are. you know, it is -- as far as i can determine, there isn't anyone sort of puppet master.
5:54 pm
it is more like there is 1000, or a lot. but it's just obvious that biden is not in charge. i mean, they just replace the biden puppet with the kamala harris puppet very obviously. i think it's not one puppet master. it is many. but, you know, i'm interested to see the conflict. >> a few things here. one, it's not a shadow government, it the actual government. biden is the president and kamala harris is the vice president. that is the government. number two -- i will give him this. the man is a supernova of charisma. just an incredible stage presence. and finally, it is pretty unnerving that the richest man in the world is just casually suggesting that there some unseen puppet masters who control our government and hung out with jeffrey epstein. that's a little loud, even for

great. i just want to start with just noting, i think you noted that rick, who is a sort of manufacturing industrialist in the southwest and musk, just the three of them putting up 220 million. is that right? >> yeah, and that was just in the third quarter of this year, and that's what we know about. we don't know about any contributions made to minorities. i do feel like the millionaires, is very concentrated. part of that is because of a beguiling republican ticket. there are plenty of wealthy center-right, pro israel tax cuts republican wealthy people. they are obviously not the primary audience at a trump rally, and so the types of people who are donors who rallied around donald trump, it's a peculiar bunch. it's people who have one issue they really care about, or people like elon musk, just
5:57 pm
kind of want to be in the room. >> elon musk thing, again, american history is long and we got the really interesting periods. sort of famously in the late 19th century, there was no campaign-finance regulation. in fact, lots of it came about because of how blatantly corrupt the relationships would be between robber barons and politicians. essentially sponsorship. it's just hard to find something quite like the precedent here of the richest man in the entire country fully completely behind one of the major party nominees, to the point of musk. >> i was that event show yesterday outside of philadelphia, and i was sitting there wondering, why is this happening? clearly, elon is there to encourage people to register to vote in pennsylvania. he has basically moved his operations there. so one way to think about why he's there's because he's
5:58 pm
trying to create an earned media moment, get people to show up and cover it, and some folks registered to vote because of that event. another reason, though -- and this is something you did not see them do or read hoffman do, or any other kind of billionaire, sometimes you think elon musk is a candidate. he came out to a song i've heard it plenty of trunk rallies. you can see he was standing in front of this massive american flag. out the town hall, he was weighing in on tons of topics. he go over 10 minutes of the time without talking about donald trump. it's like, what you think about a.i.? it almost reminds me of a book offer doing a talk, which is fine. but i was baffled by what was happening, and elon was fully entertained. he had to deal with unruly, you know, activist, and he was doing a lot of politician stuff. >> he is right now -- i think on air right now, it's a live
5:59 pm
shot of him on stage now in pennsylvania doing exactly the same thing. he's wearing a different outfit, i think that is live and tonight. everything here is, obviously we don't have campaign-finance anywhere posted. i mean, we sort of do, but not really. one of the reasons you have them is, let's say there's one guy who provides all of the money for a campaign, which is a possibility. it could happen under the current regime. so you gave him $1 billion. you might think, if that guy gets elected, your window that person a lot. and clearly, this sort of dependence on donors, lots of rich folks with money in politics, but it seems like elon musk wants to be on the other side of this if donald trump is elected and play a very significant role. and he is a guy with a lot of government contracts and money on board. >> yeah. trump has said publicly that is going to need elon musk in the
6:00 pm
department of government efficiency, whatever that means. elon, who has tons of interest in china, under tons of federal investigations, is going to be in the conference room. elon tweeted a photo the other day with no explanation of him with howard let nick, the code trump transition team. to some extent, we are sitting here trying to guess what is going on, but it's pretty obvious what's going on. elon musk is donating tons of money. i do a lot of reporting about what elon musk is saying behind the scenes, and what he saying behind the scenes is what is tweeting in reply to eggheads on twitter. he clearly believes that, you know, american democracy is at risk of falling due to undocumented immigrants, and he believes that crime is out of control. i think what we see is what we get here. >> thank you so much for your time tonight. >> sure thing. >> that is all in
