at msnbc headquarters in new york city, like him or loathe him, the question is, will they vote for him? matt gaetz for attorney general, a test for skeptical senate republicans, can he survive what is shaping up already to be a messy confirmation fight. plus, it sounds like one of the onions own headlines, this website buys alex jones's infowars with help from sandy hook victims. and wondering why you are still getting text messages and emails from kamala harris's campaign even though she lost the election, more than a week ago, new reporting on why they are short on cash after raising $1 billion. we have a lot to get to but we start with donald trump, sending multiple strong signs that he plans to take a wrecking ball to the u.s. government, stocking his

cabinet with partisans who happen to have an axe to grind with the agencies they have been asked to lead. matt gaetz, tulsi gabbard, evidence that trump is prioritizing retribution against his enemies, as he promised during the campaign, coupled with those vows to demolish the deep state. matt gaetz is also a clear challenge to senate republicans, many reacting with skepticism and shock but none so far at least are a flat out no.>> i don't think it is a serious nomination from the attorney general. >> surely we have a lot of questions and i'm sure all of that stuff will come out, then it is a question of can he get 51 votes.>> i'm certain that there will be a lot of questions.>> this is no show,

chances there are enough votes to confirm matt gaetz? >> at this point, knowing that they haven't said no yet, many of them said they are going to consider it, they are going to go through the deliberative process that a nominee would be afforded in a situation like this, and with a president that has ultimate deference on something like this but it is fair to say there is a degree of skepticism and before they hand their votes over, they want all the information, listen to what john cornyn had to say earlier today.>> i don't know mr. matt gaetz from adam, so i have read about press reports, and that sort of thing, but i would rather get the information myself, with an opportunity to work with my staff and other members of the committee, but rest assured, we will perform our responsibility's under the constitution.>> that

information includes whatever could possibly be in this house ethics report that has been sitting in the house ethics committee for some time and this has been an exhaustive investigation by the house body responsible for that, a bipartisan probe into the allegations against matt gaetz. there is a company getting factor with this because as of noon today, he is no longer a member of congress, his resignation has been read on the house floor and it's not clear what ability to ethics committee would have to release the report because they no longer have jurisdiction over matt gaetz as a member of congress. the senator said they would like to see that report even if they don't get the report itself, they believe they are entitled to the underlying evidence that the committee investigated, i believe they are going to get it in some fashion before they have to make a final decision on matt gaetz in the very near future.>> steve bannon said he would act as a blowtorch to the justice department, what could that look like and what do you think the prospects are that

something like that, those kinds of reports, those kinds of concerns would keep him from getting confirmed?>> i think based on the reaction so far and let's face it, the outside press, the new york times and the editorial board apparently agreed this is not a great idea, those two boards don't agree on much, as you know. the reaction has been interesting, you have republican senators politely noncommittal about this, i think senator cornyn is spot on when he says the senate has a role to play here, they should take this seriously and do their due diligence, they should be able to rely on a full fbi background investigation and i do think that we will see the house ethics committee made available to senators, notwithstanding the fact that mr. matt gaetz is no longer a member of the house, so i think there is a long way to go with this one

and it will be a real test of the senate's ability to exercise its constitutional role as it always has in the past.>> one of the fascinating things here, in this era of sharply divided government, trump has managed to bring people together in opposition over this pick or at least concerns over this pick. the new york times wrote this, these are just appointments, they are loyalty tests. so i wonder what you think, is trump daring republicans to cross him, is he serious about this? >> a part of this might be donald trump figuring out how far he can push the envelope, we know he likes to push the envelope and he is possibly testing what the limits are for senate republicans are there are other theories that this is just some kind of a ploy to help matt gaetz resigned from the house before that report was released on friday, we know the committee's jurisdiction

over gaetz ends immediately once he departs congress. if they do proceed with this nomination, it is going to be an uphill climb in the senate, i understand senate republicans don't want to confront president-elect trump right now, actually he hasn't even been sworn in but, there is a lot of heartburn going on in the senate and also in the house, with members of the house as the ones who most know gaetz and a lot of them think this is a horrible choice as well.>> we are going to look at what andrew clyde said on fox today about the change and what the doj might look like. >> i think there's going to be a lot of people that might lose their jobs, there's going to be a clean sweep of the top echelon in the department come all of these agencies have come out against the american people and have done so in a way that is contrary to the constitution.>> what are the

practical applications for the rule of law when the mentality seems to be focused on tearing things down, sending a message that the department you work for is broken, we are going to blow it up to fix it. >> the congressman is correct in one regard, as always with a new presidential administration, the top leadership in every department is replaced, the political appointees who run the department and are appointed by the president, they are replaced, there is no doubt that will happen with this transition. but below that political tear at the top, there's thousands of career positions, those people really aren't going anywhere unless they decide to resign for one reason or another but they simply cannot be forced out. the underlying premise of the comment i would submit as false, there is no problem here that needs to be fixed with a blowtorch or any other way. every department, mistakes are

made from time to time, we know that but the suggestion that the permit of justice and/or the fbi is so in need of reform or fixing or a purge if you will, that it has to happen with a blowtorch or in some other way, i think is just a misunderstanding of the nature of the department of justice and the fbi and is more political spin than anything else.>> i do want to remind people what the presidential elect said last year, claiming that his indictments essentially paved the way for him to weaponize the doj. >> the people aren't going to stand for it but they have done something that allows the next party, if i happen to be president and i see somebody who is beating me badly, i can say go down and indict them. >> so what is the reaction you were hearing from inside the

department?>> well, it is negative, not only from inside the department but, from former colleagues of mine, doj, fbi colleagues, it is a shocking nomination and the rhetoric, we just heard an example, has been and still is shocking, it's just not the way that presidents have talked about their own government, their own department of justice and the fbi in the past. and that is just because it is not an accurate way to describe how the department and the fbi operate, and or have operated with respect to the president- elect, so we've heard that rhetoric i suspect we were -- will continue to hear it but the facts are the facts.>> let me ask you, from what you are hearing and i know you talked to people inside, shock understandably and they are not

alone but, are you expecting from what you are hearing defiant, people are going to continue to stay and do their jobs, are people actively considering whether they can stay?>> everyone is going to face a test and figure out exactly there line is, where they will draw the line in the sand and here is a line i will not cross. there is a real test of our institutions coming up in the next several months, and several years, and what i will say, there is no one that could have been nominated really that would be exactly on the same page as donald trump, and in terms of being a criminal defendant in two ongoing cases or one really major case in gc -- d.c. but matt gaetz is about as close as you can get to a federal defendant, he was never charged and it should be abundantly clear but he wasn't a target of a federal

investigation so a lot of his grievances are donald trump's grievances, they have the same complaints, they have the same issues and they use the same type of rhetoric. matt gaetz is a pretty solid choice to do the types of things that donald trump has clearly said that he wants to do to the department of justice. so these will be one of the most critical moments in justice department history and for a lot of us, the most critical moments in our careers coming forward and covering what is going to be happening at the justice department in the coming months.>> and add to that, what we have already said, for the senate republicans who are going to have to make a decision that may involve them saying no to their president who was elected with a mandate, so if matt gaetz ends up not having the votes to get confirmed, what are the chances we see trump trying to get him through a recess appointment?

>> i think it would be very high, this is the first confirmation that could happen between the president and the senate majority of which he is in the same party as. i do think that we need to pump the brakes a little bit, there's no reason to think at this stage that matt gaetz won't win confirmation, not a single senator sent a will vote against this nomination, many of these same senators have said repeatedly that donald trump has won a mandate election and it is their job to confirm his appointment. this was before the gaetz nomination came out, so there is definitely a degree of skepticism but until you get the names of five or four united states senators that are republicans saying they can vote no on this nomination, you need to expect that matt gaetz will be the next attorney general and this will be a test for republicans as to whether or not they do the senate and the congress as a coequal branch of government or whether or not they believe their loyalty to donald trump is more important in this regard.>>

several families almost $1 billion, or over $1 billion in defamation damages, so he says he has been playing this cat and mouse game with bankruptcy lawyers, so they said finally we are going to liquidate all of your stuff, so they announced they would have an auction and they invited the bidders, and alex jones saying he has been working with roger stone and he was an entrepreneur that came to him, so he had some alex jones friendly bids that he could have if they basically just worked for them. but, there was at least one very unfriendly bid and that came from a partnership between strangely the onion, this satirical news website and the group of connecticut families who have been saying after alex jones offered them millions of dollars in settlement, that we want you shut down. the onion seems to want the

authorize established government departments and fund government departments. they are going to have a lot of trouble doing that unilaterally.>> what are you hearing about this budget cutting marriage of elon musk and vivek ramaswamy ?>> vivek ramaswamy came on the scene over the last year and a half, as this provocateur with big brash promises but ultimately now, this is going to come down to actual consequences and proposals and potentially actual efforts that could lead to the budget, the congressman is talking about and i want to let you listen to him a little bit more of what he had to say. >> what we are solving is not a natural problem, this is a man- made problem and when you have a man-made problem, you better have a man-made solution, that is what we are bringing to the table, we are assembling the

vote on it, having said that, if they or their group of great minds says they are already assembling, and they do have donald trump's ear and he tells congress, this is what i want, is that the overwhelming concern? i'm wondering what you know about elon musk's influence at least as it is right now and what his plans are.>> right now, his influence with the president-elect in particular is tremendous and again, this would be an extra governmental agency, elon musk would not be going into the government, he will be serving as outside adviser, there's an irony there that you are creating an entire department to try to eliminate or make other departments more efficient but, as anyone who has covered donald trump for a while knows that the people who are close to him, not just confidence but we literally in

his proximity have tremendous influence and that is what elon musk has right now. he has been dining with the president-elect, treating him as his equal. every time donald trump enters or exits the mar-a-lago patio, he has his group with him. there are people scrambling to see if they know anyone who knows elon, to lobby trump, from palm beach to washington yesterday on the plane. if you're in his circle, you know that he has his cabinet picks, he is weighing resumes and offering insight, they say

he is offering advice on areas that he knows nothing about. but right now in that unofficial way, elon musk is the premier person right now.>> so far, so good is the message, but i'm trying to imagine these three men all in the same room when there is a tough decision to make, they are all used to being the boss, they are used to having everyone around them ackley ask, there is alliance, friendship, whatever, can this last? >> that is a fascinating question and people are already talking about if and when that eventual implosion will come. right now it is mutually beneficial and in certain ways, i would put my money based on my reporting on musk lasting longer than people might expect and longer than some aides already would like, in part

because he represents what trump at myers and respects. he is incredibly rich, he is self-made and most important, he doesn't need anything from donald trump, he stands to benefit from donald trump with all these financial entanglements and government contracts, but also, trump might resent people when he feels they are profiting off of him in some way but musk has some independence, he can walk away from this at any moment, that is what will make trump want to keep him close and win him over and sort of forgive some transgressions that he might otherwise be more concerned about coming from somebody else. >> thank you. still to come, a massive security presence in paris, why
