it has been. it has been so dry. all of this like a tinderbox. the drought conditions really concerning making sure the reservoirs have water. you can see lots of water here. this is some of the helicopters picking up some of the water for those water drops to put over the ridge to make sure the fire does not spread. these firefighters, i have to tell you they are exhausted. there have been a number of fires through the northeast that they have been fighting for weeks if not months. fortunately, fema says they will pledge some dollars to help with the cost as they continue to try to put some relief here to at least keep them going for a little while longer until some rain in the forecast appears. take a listen to what they are telling us about the conditions. >> we are stretching our resources to the limit with all the fires we've had, not one at a time but they all seem to be following each other.

new york. welcome to alex witt reports. 65 days until inauguration day. the trump transition team weekly naming pics for 23 key positions. the team has yet to float names for the roles of treasury, commerce, or labor secretaries. critics are raising concerns over four choices with new reaction to speaker mike johnson's effort to repress an effort -- an ethics report on sexual misconduct and drug use allegations. >> mr. gaetz resigning after the notice of this appointment in order to try to avoid liability under the ethics report, as well as the speaker's actions. you saw he said it will be up to the ethics committee. the next day he turned around and said, this should never see the light of day. this is what i call the texas two-step.

it's not just a dance. it's also a legal strategy to avoid liability. the rnc cochair larry trump defending the pick of pete hegseth just a short time ago. >> let me make a comment very quickly on pete hegseth who i think would do an incredible job. not only is he holy in the fight for the position, i think something people don't talk about enough is how recruitment is down for the u.s. military. we want a strong, robust military. we never want to have to use it. peace through strength is donald trump's motto. i think we can use pete hegseth as a recruiting tool for the military. it's the type of person that we need. president biden meeting with asian-pacific leaders. he's expected to meet today with the chinese president. we have a number of reporters and analysts ready to go. we will start with julie tsirken on capitol hill.

i understand you have some new reporting about matt gaetz. the majority of senators say they feel confident he will not be confirmed? >> reporter: we do but we have seen this play out before. i covered this during the first trump presidency. i remember when mitch mcconnell after january 6 indicated he could potentially convict trump for his action surrounding that day and ultimately me -- he and many other senate republicans didn't pick that said, the overwhelming job drop of this appointment and picked by trump is maybe something we have not seen before and perhaps these 30 or so senate republicans who are privately expressing deep consternation about gaetz heading the agency that once investigated him for sex trafficking charges, nevermind the fact that most republicans and democrats in the capitol think he is a chaos artist.

one republican told me he destroyed the house by ousting kevin mccarthy as the speaker last year. a lot of bad blood for gaetz and a lot of republicans want to see all of the facts, ones that you just heard talk about that johnson, the speaker, wants to keep from getting out there. take a listen to what former republican congressman charlie dent had to say about his future. >> i would say, i bet they will have to withdraw his nomination. i think it is a bridge too far. nobody should underestimate how much these house republicans dislike him. dislike is a dramatic understatement. i think he has a problem. that ethics report that is looming, there's a good chance that might come out as well and those reports are not pretty. >> so the ethics committee is supposedly going to postpone the meeting that they canceled

yesterday where they were going to vote on whether to release the report or not. that said, i will believe it when i see it because johnson had told us yesterday he directed the republican chairman not to release the report. the pressure could build from the other side of the capitol. republicans say they want to see the report. if not this report certainly there will be a background check. there will be extensive questioning he has to face before the judiciary committee. it's a very long road and just one more point on this. johnson had flip-flopped as madeline dean laid out to you. one day saying he would leave this in the hands of the ethics committee and then two days later saying nevermind. between that moment was his meeting with president-elect trump in florida. he did not save that specifically came up with that is what happened between those statements. >> i wondered about that and the fact that they did have a meeting so it all makes sense.

thank you for that. we will go now to allie raffa who is near mar-a-lago. can we expect any more announcements today. >> reporter: until now whenever these announcements to drop, tonight we know he's going to be returning to madison square garden for a ufc fight. as we have been proven for years and years, anything is possible with the president- elect.'s cabinet is starting to fill up with these notable names that still need to be confirmed. there are still several top jobs that have not been field. you mentioned the secretaries of energy, education, treasury as well as who will be tapped to lead the fbi. there are reports that trump is considering picking former congressman mike rogers who is a former fbi special agent

before he served in congress when he sat as the head of the house and tell committee. you will remember in 2017 trump was also considering him for this job after firing james call me. another critical position the secretary of the treasury with top contenders for that job. that was addressed during an appearance on fox news this morning. >> it's not about supporting me. it's about the cabinet that president trump is going to create. donald trump has been so correct on his policies. the past few months i have had the chance to travel with president trump. we were out of barbershop in the bronx and i recently sat in a meeting with he and elon musk on this new efficiency commission. who else could do that? both

plan to oppose matt gaetz's nomination for attorney general. house speaker mike johnson said he is strongly against the release of the house ethics report. you have been speaking to doj staff for both parties. give me a sense of the reaction to gaetz as potential ag. >> the term that comes to mind of my conversations is a train wreck. i would also add i have been a spokesman for three u.s. senators. the default position for most senators is to give incoming presidents the opportunity to make out their own batting order to allow a president to put his own team in place provided that those folks are qualified. that is the rub here with this attorney general nominee. as far as we can tell, matt gaetz has never even argued a case in court. he has scant management

experience. the doj has 115,000 employees, multiple bureaus and components and matt gaetz has no national security experience, not anything meaningful. he certainly has no experience with criminal law except for being the target of a federal criminal investigation looking into inappropriate sexual contact with a minor. i think ultimately this is a loyalty test for senate republicans. will they join senate democrats to do what they know is right and that is reject an unqualified nominee? or will they bow to what donald trump wants. unfortunately i think for all of us who promote and support the constitution and the rule of law i suspect senate republicans will give him what he wants. >> i will add that he also practiced law for less than two years. the question to you, will republican senators fall in line or with a reject him?

could they torpedo this nomination given that outrage at him potentially leading the doj but then confirm other questionable pics? >> it certainly does provide a level of cover for some other people. like pete hegseth who surprised a lot of people as well. i would not want to be in his position to say the least. he's obviously not coming in with a strong hand. i'm not ready to say that republicans are going to reject him. i think you have to appreciate how many republicans see what donald trump just did and would be very concerned about crossing him. we've seen reports of as many as 30 republican senators willing to vote against him but that has all been set anonymously. i do think if he gets to this point this will be some of the most insane confirmation hearings we've ever seen. the

things that the house ethics committee has been looking into, whether or not the report comes out will be front and center. don't think that democrats on the committee will just let that go if it does not come out. >> do you not envy john thune's position having to oversee all of this given the heavy footprint of donald trump everywhere? >> john thune's position is probably going to be clear. he will have to say that he's for him but it's not his decision alone. obviously susan collins and lisa murkowski are leaning out there but it's not hard to see some of these other senators who have been critical of donald trump in the ones who think this. the other obvious dynamic his donald trump has raced -- raised this idea of recess appointments. allowing congress to go out a session long enough that he can

appoint who he wants. that feels unlikely to me. that is the same vote . you have to affirmatively vote to go into recess that way. i don't know why there are a number of people blocking these confirmations will turn around and pretend like that is not the exact same thing. i'm skeptical that that will play out. i think the way he gets matt gaetz or some of these other people through is just by leaning on them . pure trump politics and leaning on them. one thing i want people to appreciate. for all the things you just said he is not a dunce. he's a smart and shrewd operator. he kicked out the speaker of the house and paid no consequence. one thing people should understand is he is in a lot of hot water. he's very in morrow but we need to not just assume that he's roadkill. >> senate judiciary chair durbin slammed these picks overall because they also include his

personal defense lawyers as deputy ag and solicitor general . durbin said, quote, these selections show that donald trump intends to weapon eyes the justice department to seek vengeance. donald trump viewed the justice department as his personal law firm during the first term and these selections are poised to do his bidding. what kind of long-term damage can be done to the doj if it is not an independent agency? >> it's important to remember that the reason he wants these individuals in these positions of high power is because they will do his bidding. right now the justice department, it has a number of post-watergate norms that the department put in place over decades to prevent the department from being used for partisan political purposes. right now with these nominees you have people in place who put

politics before party. right now doj will tell you they follow the facts and law those tell them where to go next. that is not the case with matt gaetz. quite frankly he will be a puppet for donald trump going after his perceived political enemies regardless of what the facts say, regardless of what the rule of law says. these deputy positions, in many cases they are even more dangerous because they have worked in the department before. they know how to navigate the structure. they know how to use the department and weapon eyes the department for his political ends. i think that should have all of us concerned. not just democrats but all americans who support the rule of law. >> the requirement that he looks for is loyalty. time magazine reported in his

first term aides and advisors were able to blunt is more extreme and ill advised assistance noting, quote, the degree could to which he paced the face pushback from his own employees was the extraordinary nature of his orders. with few guardrails or checks on power will it be clear how the independence of these agencies is a norm rather than explicitly written rule? >> there is something deeply unsettling about how these trump people talk about loyalty. it's normal to have the people who come into an administration are loyal. i assume most people who work at the white house are loyal to joe biden. they are talking about whether you will prioritize law, the constitution, what is good for the country over what donald trump wants you to do. what is best for him personally. that's what all of this is about. that's what matt gaetz going in as attorney general is all

about. he's a believer that there are people undermining the government at every step. what will his first priority be? to fire a lot of people. it will be firing anybody they think will get in the way of rounding up millions of people for deportation. that is the kind of thing they are talking about. pressing the limits. who will you side with. donald trump or the law. that's what they mean when they say loyalty. >> the word that they are really after here is obedience. they want somebody to do exactly what donald trump wants regardless of what the facts and the law say. that's very different than what we saw with his first two attorney general's who were loyal but they headlines they would not cross. bill barr refused to go along with a that the election was stolen. that's why we have a different mold of attorney general. they do not want anyone whose fidelity is to the

show for the first time. let's talk about one of your issues which was the expansion of healthcare. what do you make of the pick for rfk jr. as head of health and human services? >> they are clearly not sending the best. we all know he petal since the conspiracy theories. beyond all of that he is simply unqualified to manage a department with a $1.6 trillion budget a department that not only protects public health but administers medicare and medicaid, critical benefits americans rely on to get health coverage and stay healthy. having somebody like rfk and the leadership of a critical department is going to grind that department to a halt. it will undermine benefits and programs that american workers, retirees and families rely on and it will have dangerous consequences for the american people. it's one of the reasons why the

senate must step up to fulfill its constitutional responsibilities to hold the administration accountable and guarantee that these dangerous and unqualified nominees do not get these positions. >> former congressman and now democratic governor of colorado jared polis said he is excited about the appointment. he wrote, he helped us defeat vaccine mandates in colorado in 2019 and will help make america healthy again. he later clarified that while he and his family are vaccinated and the science backed decision to get vaccinated improves public health and safety, he continued, if as a country we follow the science we would be far more concerned about the impact of pesticides on public health, the policy on nutrition and lack of access to prescription drugs due to high prices. how do you interpret what he's

saying there. is he potentially whitewashing what rfk jr. is hoping to achieve? >> there is no question we have to hold polluters and those who would poison the environment accountable. there's no question we have to hold pharmaceutical companies accountable and bring down the cost of prescription drugs for the american people. and is something that democrats did when they had control of the government. that is not what rfk represents. he represents dangerous conspiracy theories that could lay the foundation not just for individual americans to get sick but could lay the foundation for another pandemic in this country and globally at a time when americans are thankfully finally through covid-19. >> rfk jr. has repeatedly and absurdly claimed that chemicals in our water are changing children sexuality and gender identity. pete hegseth the secretary of defense.

said being transgender in the military causes complications. donald trump said in his second term he will pull providers out of medicare and medicaid for offering gender transition care to minors and will purge anything deigned to promote transgender identity. what impact will the next trump administration have on the lgbtq community behind -- beyond the search of calls to crisis hotline's >> there's no question the incoming administration will seek to undermine freedoms for americans of all backgrounds including lgbtq people. this is a weird and bizarre obsession with trans people on the part of the republican party . i agree with republican governors who when presented with the spate of anti-lgbtq bills in legislatures across the country said these are solutions in search of a problem.

that's what we have to be crystal clear about moving forward. whenever you see a politician or political party focus on an issue that impacts a handful of people in a handful of places, you have to ask yourself why. the answer to that is they are trying to distract from what they are actually doing. over the next four years every time we see any member of the administration talk about trans people, talk about immigrants, muslims, any vulnerable group in the country, look what they are doing with their right hand because i can guarantee you at the same moment they are working to pick the pockets of american workers, police seniors by privatizing social security and medicare. they are working to undermine the critical programs and benefits that americans of every background and every political persuasion rely on to get through the day. that's what these are. they are an effort to distract from the real issues that are

back on a report that advisor elon musk met with a diplomat and new york. danielle is joining me from beirut. what are you learning and what else can you tell us about the fallout over the alleged plot to assassinate president elect trump and how that could affect relations? >> reporter: this was initially reported by the new york times a couple days ago that elon musk had met in new york with the iranian envoy to the u.n.. it was allegedly to discuss ways to defuse tensions between iran and the united states. today the statement from a spokesperson in the foreign ministry dismissing, categorically denying the claim that the men met and expressing surprise that this had been widely played in american media. iran and the u.s. don't have formal or official diplomatic

ties. they rely on switzerland to communicate. according to an official confirming to nbc that in mid- october two swiss diplomats delivered a message to washington and the message was that tehran would not try to kill donald trump. the biden administration had sent a previous message that any attempt on donald trump's life would be considered an act of war. how this is playing out, remember the context that this is not the same iran that donald trump dealt with when he was president the first time around. this all changed after october 7. iran has proxy group that are significantly degraded. leadership decapitated. air defenses have been destroyed, its economy is not doing well. if it is fearing that donald trump will come and apply this

met with the ambassador in new york. you just heard that they have denied the meeting took place. the transition team refused to comment. what is your reaction to musk's involvement overall and whether you think such a meeting could happen. >> certainly we have seen him engage in what are diplomatic discussions. i think it definitely could have happened. i am curious about what was discussed, what went on. there's a question of elon musk as a private citizen negotiating with a foreign government when he's not authorized to do so and donald trump is not in power yet so i question that which would be called the logan act which i think is raising questions right now in national security circles about what he actually negotiated. i'm also were worried about

what the quid pro quo was and what he is offering. lastly i will just say this. this is a sign of what is to come. this was classic during the first administration where these external actors that are not in traditional roles, marco rubio is one that has been said will serve in the secretary of state role but then you have the shadow ambassador over here of elon musk. it definitely points to the direction of what happened in the first administration where there were external actors that were inserting themselves into diplomatic relations. the first one that comes to mind is rudy giuliani and what he did. now we have elon musk which is maybe a more richer and more competent person than giuliani that still begs the question of what's to come and his involvement going forward. >> let me reiterate that iran is denying that any meeting took place. we have former congresswoman

tulsi gabbard who is the pick for director of national intelligence. she has never worked in intelligence. she blamed the u.s. and nato for russia's invasion of ukraine and has been accused of either wittingly or unwittingly spreading kremlin propaganda. yesterday congressman debbie wasserman schultz made this astonishing claim. >> tulsi gabbard is somebody who has met with war criminals, violated the department of state guidance and secretly clandestinely went to syria and met with the sod who gassed and attacked his own people with chemical weapons. she is considered to be essentially by most assessments a russian asset and would be the most dangerous. >> is that how you consider her? >> there is no question. i consider her someone who is likely a russian asset. >> what do you make of that and

what concerns do you have if hers is the final say on what intelligence is delivered to president trump? >> certainly if it walks like a duck and quacks like a duck call it what it is. i think she's being accurate. we have somebody here who has repeated kremlin talking points and pushed russian propaganda. i think that is incredibly dangerous for someone that will be overseeing the intelligence community. i say that it is dangerous because i do think it will implicate and affect international relations with our sharing intelligence with our partners, allies and i'm curious to see whether they will continue those relationships. if i were them i would be super guarded. why would you hand over intelligence to the united states with the possibility there's a direct line to foreign adversaries. that affects the security of americans in the homeland. that's what i keep trying to

right now president biden is in peru for the asian- pacific economic summit preparing for what could be a tense meeting with chinese president xi jinping. lets go to mike who is following the president. what can you tell us about this meeting? likely the last time they will be sitting down together before biden leaves office. >> reporter: that is right. president biden often says all politics is personal. that includes foreign policy. there's no more important relationship in the world than

the u.s.-china relationship. as he approaches this meeting he will be leaning on a relationship that began when i traveled with him to china in 2011. both men were the vice presidents. and has boasted he's had more meetings with xi jinping than any other world leader so that enables him to have the kind of direct conversations he intends to have today on issues like taiwan, navigation of the south china sea, the alleged hacking china engaged in involving u.s. officials in the campaign and government. that will be the backdrop of this meeting. as we talk about the importance of these relationships, one of the other dynamics has been the concern that these other 20 leaders that are attending have what is coming in terms of the trump administration. we heard from canada's prime minister who has the benefit of having been in office the last time donald trump was an office. listen to how he talked about navigating tricky issues including trade with the

report that could make him look bad. if you are going to become the top law enforcement officer for the united states at the bad look to try to hide a report. it's very jim jordan of him to do so. this is serious. it is that department of justice is the one that prosecutes sex trafficking. whether matt gaetz did anything wrong or not , it's part of the confirmation hearings that need to be discussed is what is in the report. i think if they continue to try to root -- suppress the report it will only make them more -- look worse. >> do you expect gaetz can pass confirmation and what you expect his priorities would be as attorney general's? >> pain, i think that is what his priority would be. pain for anybody that opposed donald trump or investigated donald trump. he would be donald trump's retribution. i think it will be hard for him to get confirmed. he's upset a lot of people.
