right now, aunt anna cabrera reports, breaking news on donald trump's criminal conviction. any moment, the manhattan d.a. is set to propose next steps in the new york hush money case. could the entire conviction be tossed ahead of trump's return to the white house? also today, lawyer detailing shocking allegations against trump attorney general pick matt gaetz including that he had sex with an underage girl and paid at least two women for sex. the political pressure trump is exacting to confirm gaetz as the debate over that ethics report on the former congressman and broyles capitol hill. good morning, it is 10:00 easton, 7:00 pacific, reporting from new york and we begin with

breaking news on president- elect donald trump's criminal conviction in new york. we are expecting to hear any moment from the only prosecutor to convict trump. manhattan district attorney alvin bragg facing a deadline to lay out how he thinks the hush money case should proceed with trump now set to re-enter the white house. trump's team arguing that since the former president is the president-elect, judge juan mershon should toss the entire conviction, 34 counts. joining us now is nbc news correspondent dasha burns. msnbc legal correspondent lisa rubin and former federal prosecutor barrett berger. walk us through what we are expecting any moment now. >> a number of things we are looking at, ana. first of all, what will d.a. brad and his office say and how they want to move forward or will there be another delay as we have seen time and again in this case. the other deadline that was postponed to today, is the deadline for judge merchan to decide how the ruling from the

supreme court on immunity, might impact the case. does he toss it altogether for that reason, which is what trump's lawyers have been arguing. and if you take a step back, this is another one of the days for the trump team, where they are feeling pretty victorious when it comes to the legal battles that we have been covering for years now. the tactic of delay, delay, delay, that we talk about, early this year over the course of the summer, it is worse and now we are living in the reality where all of these cases, this conviction, the charges, and other criminal cases, the civil cases, none of that hasn't stuck and that was the plan from team trump all along. and that now that he's the president-elect, it has a massive impact over all of those. and the this particular case, because it is one where there was a conviction, will be the most revealing. >> dasha burns, we know you

have your eye on that internet site, where they could post the filing. of course the judge has to agree for it to be posted, or the courts does, before we all get to see it. thank you, keep us posted. lisa, described this moment for bragg is the only executor to secure a conviction in all his legal cases. >> not only is he the only one to secure a conviction but it is a conviction his office feels very proud of, that they feel was done in the interest of justice and they have an interest in upholding that verdict, not only for their own sake, but for the sake of the 12 people unanimously voted to convict donald trump on each of the 34 felony counts that they brought against him. it is a really tough decision for them in terms of how to advise judge mershon about what they want to do next. and i want to be clear for our viewers about what the task is for them today because the order from judge mershon last week says, i will accept this

joint application from both sides for a stay of all existing deadlines. and i expect the das office to file by 10:00 a.m. on november 19th, a brief telling me what the appropriate steps forward are. so it is not that he is asking them for a binary decision tell me whether you favor for example, a prolonged stay of the sentencing, or whether or not you favor dismissal. he is really giving them an open-ended question, what do you think should happen next? should i stay the sentencing? should i fully dismiss the case? or should everything remain as it is, and then the decision goes back to judge mershon about what he thinks is appropriate to do next. of the das office for example says, we think you should stay the case but not dismiss it full out, what does judge mershon do? or conversely if they say, we don't think there should be any change, does he then asked the trump team, fully briefed to me why you think i should dismiss this case and what your constitutional concerns are. what he saw what they said in

their favor? would be the presidential immunity decision? that in and of itself might not get them all the way there to dismissal of the case. it might get them to that aside the verdict not necessarily to dismissing the charges. >> barrett, there is a challenging position that the district attorney finds himself in an and this is how the "new york times" writes about it. he has a no winded -- win decision to make. drop the case and alienate his face or risk intensify being the ire of the incoming administration. what you make of this twice? >> it is really a lose/lose situation. i think it is unlikely. i don't have a crystal ball but i think it is unlikely they would just agree to drop the charges straightaway. for the reasons that lisa was saying, i think there is a notion that we want -- we asked 12 jurors to decide a case and we want to uphold the verdict. it also, i think there dates

they are aware of any precedent they are setting because again, this is new legal territory, the concept of what is an official act and what does it mean to have evidence of an official acts. infect the rest of the trial. i think they would be wary of any type of action that could be interpreted as them conceding that the evidence that they put forward was somehow improper or that they violated the supreme court decision. so i think that probably they won't dismiss it all together. however that leaves you in this position where you're asking judge mershon to move forward with sentencing and then there's not a lot of options on the table for him with respect to sentencing. we know he can't be sentenced to a custodial sentence, that would violate the ulc memo and -- >> explained that. what it would violate. >> the office of legal counsel has a memo that dates back to 1973 that says a sitting president can't be prosecuted. that has been broadly interpreted that even something that is not just a brand-new prosecution, that something would infringe on his ability to govern, to be president. that was sort of touch on this idea of separation of powers. we can't do. so a sentence that either would

have him be in jail, but not be acceptable but even a sentence that would have him some sort of course of your vision like having to check with her probation officer or having some kind of community service. this probably would touch on that same area of violating or coming close to violating that olc memo. but sort of our traditional notions of separation of powers and why we need the president to be able to focus all of his attention on being president. >> judge mershon has a difficult decision to make as well, as he is awaiting this guidance or suggestions from the prosecution. i mean he has a truncated timeline to make this decision as well. do you expect, after he hears from alvin bragg's office today, that he will give his decision today? >> i don't expect he will give the decision today. first of all, if alvin bragg's office comes back to him and says, we are prepared to dismiss the case, i don't think we will see a written decision from judge mershon on the

pending motion any time, ever. on the other hand, if alvin bragg's office comes to him and says, either we are prepared to stay the case but not vacate the conviction or we think nothing should change, i think judge mershon is going to want to hear, more fully, from donald trump's team, which to date has only put in, as far as we know, the letter revealed as part of the order last week that says, we went to the defense -- i'm sorry, we went to the prosecution and asked them to consider a stay given the constitutional concerns associated with sentencing him. but they haven't fully fleshed out what the concerns are and to bear that point, the olc memo she was referring to, that is binding department of justice policy but it is not law, even as to the federal government. more prudently, and is not binding, much less, anything more than guidance with respect to states or localities that charge someone. so it is those constitutional concerns that animate the olc

memo, that donald trump's lawyers are talking about. but they're going to have to convince a judge that those concerns necessitate a dismissal and have to do more than just site and olc policy to get him there if the district attorney's office wants to stick to that verdict. on a -- one more thing to note, if they ask to either stay the case or just to continue, remember that in the future trump administration, three members of the former presidents and future presidents defense team, will be at the department of justice. and if the case doesn't go away, a future time department of justice will have a say in what should happen with this case, because they will want to defend the institutional prerogatives of the presidency, at-large. and that means three people who have been intimately involved with crafting the strategy behind this case, will be in a position to tell the department of justice, what it should argue for the purposes of the united states. >> judge mershon has suggested he was trying to proceed with

the case, at least prior to the election and prior to it getting closer to that november election date, with the mind- set that this is like any other case. i'm going to treat this defendant like i would any other defendant. that we have heard trump's team arguing that the voters have spoken and made it quote, abundantly clear that americans want an immediate end to the weaponization of our justice system including this case which should have never been filed.., i wonder, how do you expect judge mershon to weigh the election outcome, in making a choice on how to proceed. >> it is really an interesting position for a judge that i think you are right, has gone to great pains to treat this defendant like every other defendant. obviously there has been hiccups along the way and having to deal with somebody with such a vast public profile, and you know, speaking out on social media. but i think that the judge's tenor throughout the entire

trial has been, this is a regular criminal case, regular defendant and i'm not going to give special treatment. but i think everything has changed now. this is no longer irregular case with a regular defendant. i think because we have this, you know, this immunity, because of this olc memo, because we have the practical problem of dealing with somebody who's also going to be at the same time running a country, this has to be treated differently. so i think he's going to be hesitant to wade into the political mess that this is, and in some ways, he probably would be delighted if the district attorney's office said they would drop the case. so he didn't have to reach a decision, you didn't have to get into the murky territory. but really, the first step he had to do, is purely illegal and -- a legal one and decide if this evidence that was entered into, the trial, violates the supreme court said, would be official act. so the first step he has to do, putting aside sentencing, is to make a purely legal decision on that matter. >> please stay close as we

report on the former republican congressman will be buried or if it will be shared more broadly. as we await their decision, a lawyer at the heart of the probe is speaking out. he says his client told house investigators, that gaetz paid them for sex and one of them claims she saw gaetz have sex with an underage girl. however the attorney said his client's testified she did not think gaetz knew the girl was a minor and that gaetz stopped the sexual relationship when he found out. until she turned 18. gaetz denies all accusations. here's what the lawyer told nbc news about potential additional testimony from his clients. >> my clients position has always been they are willing to speak with someone on this -- by law. if they are requested, with a valid legal subpoena that requires them to speak they will do so. but at this point they do not wish to speak any further and i want to make that clear, the only reason i'm talking today is to avoid further exposure of my clients.

and to the extent that they want, what they say to be heard. so far we have heard one side of the story. it is not like they are dying to tell their story but the story has been told and they don't wanted to go to waste. >> let's go to capitol hill and nbc's ali vitali. also with us, leanne caldwell, co-author of the washington post early 202 newsletter and former new hampshire gop chair, jennifer horn. do we know what will happen at tomorrow's meeting, there at the house with the ethics committee? >> we don't know what will happen but we know what they are going to be talking about because it is all anyone here on capitol hill is discussing as well, which is, what is the fate of the ethics report but at this point all members of the health -- house ethics committee have read but the question before them is, is it on them to release it. the reason they are entertaining this at all is because gaetz is no longer a

member of the house and technically once you are not a member of the house anymore, the jurisdiction of the ethics committee no longer applies. you've got the house speaker mike johnson, basically telling the committee hey, that is what usually happens but the committee also knows that there is precedent for releasing ethics probes of former members in the immediate aftermath of those resignations, where those instances apply. those are rare incidents but there is president of it and here is what the chairman of that committee, congressman mike gaston is saying to reporters about the johnson plush and what his committee might do on their own. watch. >> he just wanted to let me know that he made a statement publicly. and he wanted me to be aware of that. and he reiterated that he believed that the report should not be released. mike has not tried to weigh in one way or another. he has not tried to influence the committee. >> when he says mike, he is talking about the speaker and the speaker have reason to open in his words, a pandora spite -- pandora's box if these ethics investigations and complaints were released after members left the chamber.

we will see, they meet wednesday in the afternoon. >> full-court press coming from the trump team. we know that fans will head to the hill tomorrow. where is your sense of where things stand with the senate and those who have to confirm? >> we are starting to watch the full court press coming into play. not just on behalf of gaetz but on behalf of other embattled nominees like seth heads --. but we heard from dick durbin in the last few minutes regarding the gaetz of it all and the ethics complaint. listen to what durbin said. is typical from what we have heard from democrats and some republican senators. watch. >> the sooner it is turned over, the better. it is fundamental to the confirmation, or the lack of confirmation of this nominee and they get this information at the outset and get it early, they may decide his fate one way or the other. >> dick durbin adding his voice to an already growing chorus of

senators who say they would like to see the ethics report. but you are right to point out that senator j.d. vance, the incoming vice president will be a key sherpa of sorts, to these nominees on capitol hill. as he comes up tomorrow, our team is reporting to try to do some early outreach to some of his soon to be former senate colleagues. and of course you've got the president-elect making phone calls himself to some members who have expected -- expressed public residents -- reticence about voting for gaetz including kevin kremer of north dakota. he told our team he received a call from trump about this and this is only the beginning. we know two months between now and any confirmation battles is a longtime. a lot can happen. mines can be changed or maybe they won't. >> ali vitali, thank you for your reporting my friend. leanne, what are you hearing and what is your sense

of where things are headed in tomorrow's ethics meeting? >> there's a lot of pressure on republican members of the ethics committee to not release this report. the fact that speaker johnson came out and said, after he was in mar-a-lago that the ethics report should not come out, which is a reversal of what he had said a couple of days prior. so, there does seem to be, the heavy hand from trump world, is weighing heavily on these republican house members. meanwhile in the senate, we are also seeing a subtle shift, when gaetz's nomination was announced last week, that first there was shock and then there was has a sense -- hesitance that he would be able to be confirmed. and now we are seeing senators start to slide back a little bit, where a couple of senators last night including senator john cornyn senator thom tillis is up for re-election, in 2026 saying that maybe the ethics report isn't necessary for these confirmations. we do know, as she said, president-

elect trump is calling senators himself. i'm also told people close to trump are also gauging where senators stand to see if the nominees can pass through the senate. but this is just the beginning of if donald trump continues to stand by his man, that the pressure campaign is going to get only more and more intense, as they get closer. it is also important to note that matt gaetz is making calls himself. he called members, republican members of the judiciary committee and asking them to ensure that he gets what he's asking for, a fair hearing. >> jennifer, vance is on the hill tomorrow, trump is calling senators to get them to that day should back gaetz. we heard from lindsey graham, top republican on the judiciary committee saying that nobody should be disqualified because of a report in the media. how do you see it? is this a test to see how far trump can get republicans to go?

>> it certainly is going to end up being one regardless. but you know, lindsey graham's ridiculous comment of no one should be denied because of a report in the media. he's right, he should be denied because of a report that is on the desks of the ethics committee. and there is precedent to release this information. and this is a case where it is absolutely imperative that this be released. we are talking about a guy who's going to be appointed to be the attorney general of the united states of america. who has had very credible accusations, according to reports, made against him. and i know that people are going to push back on the word credible. these are women who have not sought fame or notoriety or money or anything else. we're told that there are venmo receipts and text messages back and forth, that gaetz was engaged in this behavior.

that, alone, disqualifies him to be the attorney general. and when it comes to the pushback, that some of the folks in the senate are getting right now from whether it is j.d. vance or trump or anybody else, you know, matt gaetz is in a tough situation. he is not a good guy. he doesn't have a lot of friends in the party. he has not set himself up to be very well supported in this kind of situation. so you know, if the ethics committee or others end up really standing firm and releasing this information about him, i believe it is the right thing to do. it is how you protect constitutional leadership but it is also going to be in large part his own fault. >> john cornyn, republican in the senate, said that we need to have complete betting of the nominees. not only so we know the nominee is qualified, but also to protect the president. you are hearing that from at least some republicans, who

will have to vote to confirm. leanne, we also heard the house ethics chair say speaker johnson's opposition to releasing this report won't influence republicans on the committee. you buy that? >> i mean, no one knows what is happening inside people's heads, but that is not how this works around here. when you have a message, a public message from the speaker of the house, usually members for most cases following line. especially when it is not necessarily about matt gaetz, it is about donald trump and donald trump being successful in his presidency. you know, there is a lot of republicans on capitol hill. i would say most republicans on capitol hill do not like matt gaetz. in fact, they severely dislike matt gaetz for a host of reasons. personal, professional, they think he is a chaos agent. but what matters now, is that donald trump is president and

most of these republicans have been unwilling to buck the president, especially a new president-elect, i should say, as he is coming in, starting to form his cabinet. usually members of congress, the senate, give deference to a president, on their cabinet choices, for the most part. and when it comes to matt gaetz they are going to have to choose between potentially someone they dislike, someone they think is not qualified for the job, or going against the leader of the party. >> it is not just matt gaetz, there's controversies surrounding multiple cabinet pics, from gaetz to rfk jr. to be had seth to -- pete hegseth. mike johnson is not reporting -- addressing reporters on capitol hill. we are monitoring and if he says anything about the process of met dates specifically, we will bring that to you. jennifer, here's what democratic senator richard blumenthal said about the prospect of calling these two witnesses, these accusers of

gaetz to testify in a confirmation hearing. >> he's been victimized once, i am loath to victimize them again , if they are resistant to relive the pain and grief of that time in their lives. if there are alternatives, i would vastly prefer to use them , and even talking about the subpoena or having them come forward, i think puts pressure on them. >> another argument for turning over that report from the house ethics committee to the senators. and i think back to the brett kavanaugh hearings and confirmation process. you know after his accuser, came forward and had to testify, why would someone want to put themselves to this high profile congressional

testimony, especially now that you have someone like elon musk, with one of the world's biggest bull horns downplaying the allegations. >> right, and the danger and destruction of elon musk and his team is a conversation for another day. we could really get into it. that any time somebody comes forward with these kinds of accusations, especially under these circumstances, we have to be cognizant of whether the necessity of knowing the truth about people who are going to be put in very powerful positions. you know, i think their attorneys have been clear, their attorney has been very clear that they don't want to, they are not particularly seeking it. none of us know who they are. they have been very conscientious about protecting their own identities and all of this. but we have to remember, those of us who spend this time talking about reprehensible politicians like matt gaetz, is that there are good people in the world, and that most people in this world want what is

right and good for our country. and i think that many people in this position are led by character and honor and wanting to make sure that the people know what the truth is. and when it comes to matt gaetz, i'm going to use the word again, he is reprehensible. he is a reprehensible nominee. and i think that it will not surprise me if they decide to come forward and share that. i think they have an obligation to share as much information as possible. >> jennifer horn and leigh ann caldwell, thank you, ladies. up next on ana cabrera reports, we could see executors rest the case today in the killing of nursing student they can wryly. what we learned about the murder suspects condition when officers talked to him. plus the brazen stabbing spree in new york city, that left three people dead and in three locations.

today, prosecutors expect to call their final witnesses in the trial against josi botta, the man charged with the murder of 22-year-old nursing student lincoln riley on the university of georgia campus earlier this year. so for the trial included emotional testimony from riley's loved ones as well as surveillance video and testimony about her dna, found under his fingernails. his defense argues the evidence is circumstantial. the case has become a political flashpoint with republicans

highlighting his undocumented immigration status to call for strict border policies. kathy's park is monitoring -- kathy park is monitoring for us. how are they tying up the arguments today? >> good morning. prosecutors continue to present a number of forensic digital and video evidence this morning, a surgeon with the university of georgia walked through several cameras showing a man wearing dark colored clothing, appearing to match the description of the suspect. he is seen stalking an apartment building and there was a moment we saw images of laken riley out on a run and it was the same day that she was killed and during that time, her mom and roommates began to cry, understandably so. we heard about her phone activity and one of the texts from her mom was read out loud and she wrote, i am worried

sick about you. prosecutors have said they would likely wrap-up today. it is unclear what time and how many witnesses they will call to the stand. the judge though, made an announcement a short time ago saying that five body camera photos will be reviewed and however the media is asked not to publish the images. >> we are continuing to monitor. what is happening inside the courtroom should the defense get the case today, of course moving quickly because there is no jury. the judges having to handle the decisions. the prosecution could rest what kind of argument is the defense adding up? -- setting up? >> the defense called the evidence circumstantial and suggested someone else could have killed wryly. a woman who shared an apartment with ibarra said she saw him throwing away his jacket and thought that was a bit strange because keep in mind that jacket was entered into evidence because prosecutors say they found ibarra's and riley's

blood on it. during cross, defense was able to get her to confirm she didn't notice anything that morning, the day that laken riley was killed, as far as anyone leaving the apartment. and as you mentioned, the defense anticipates being done pretty quickly in less than half a day. >> kathy park, thank you very much for the update. in york, this morning a suspect is in custody and new york city is reeling after a deadly stabbing rampage, that was in broad daylight in three different places and left three people dead. people he say 51-year-old ramon rivera, seen here, preparing his gloves and weapons to travel within three miles across manhattan, taking strangers with kitchen knives. now police eventually caught the alleged assailant after a tip from a taxidriver. nbc's aaron mcglocklin is following the story and joins us now. what more do we know? >> this is a shocking stabbing spree. according to police, the suspect had an extensive criminal history and serious mental health issues.

leading the mayor of new york city to question why he was on the streets. the man accused in a deadly stabbing spree charged with three counts of first-degree murder. police say the chilling surveillance footage shows the moments before the attacks in the heart of new york city. you see the suspect put on a hoodie and gloves. he then pulls a large knife from his backpack. >> is a tax to be unprovoked. he just walked up and began to attack them with knives. >> reporter: the suspect identified as 51-year-old ramon rivera used these kitchen knives to stab three people and three separate attacks, and locations across manhattan on monday morning. killing two men and a woman who died at the hospital, overnight. >> this is our suspect for all stabbings. >> reporter: the eyewitness as a cabdriver believed he witnessed the robbery. >> yelling stop that guy, stop that guy. >> reporter: another bystander said the witness --

the house. also happening today on the hill, fema administrator deann criswell is expected to face tough questions on the agency's response to hurricanes helene and milton. amid revelations and now fired fema employee told workers not to offer help at homes with trump campaign science. nbc news l correspondent ryan nobles joins us now. let's start with the democrats leadership elections. what are we watching for? >> it is interesting that democrats chose not to change course in their leadership in the house of representatives despite the fact that didn't win the election and there was a lot of hope that house democrats would have a shot at winning back the majority in this in 2024 election cycle. but essentially the margin between republicans and democrats is going to be roughly the same and instead of blame being put at the feet of hakeem jeffries, katherine clark and pete aguilar, many democrats are pressed they were able to keep the margins as

tight as they were, especially with the direction of the presidential campaign many of the hospital grounds were fought in places where the presidential election was not being contested and many of these house democrats ran ahead of kamala harris on the ticket. that is part of the reason why you have not seen too big of a groundswell to try and remove these three from their leadership posts. is that house democrats choosing to go with consistency is a look ahead to the next term election or perhaps historically, the party in power, the presidential power loses seats. that is where democrats find themselves. keep in mind that the margins are so incredibly tight. we have braces that nbc news has yet to call, the republicans are looking anywhere between three and five seat majority, once congress reconvenes next year, which is very small. >> on the fema hearings, and straighter criswell testified before two committees today. what is the latest? >> this hearing is getting

underway right now and we expect her to get quite a few tough questions from this panel, particularly about whether or not people that were perceived as trump supporters were not given the same level of support and assistance as people who are not. but also, i fema not have been in a position to handle the daily dish of power outages, and flooding. in parts of the country that don't normally deal with hurricanes. particularly the mountains of north carolina and places like that. and an update on what fema is doing right now to help those people in need. there are still thousands and thousands of americans who are digging out, as a result of this terrible hurricane and situation. we also expect questions about how fema will behave going forward. do they need a new posture, for instance when big storms like this hit, to have people located ahead of the planning, even in places where normally storms like this don't do a ton of damage. she can get a lot of tough questions throughout the course

come within a short drive of william and kate's family home. >> reporter: this morning, new questions about the security of the royal family after a burglary on the sprawling windsor estate where prince william and kate live with their three children. king charles and queen camilla, who often at windsor castle, were not there at the time and it is unclear whether william, kate and their three children were home at the cottage, just a few miles from the farm where the burglary took place. police say it happened on october 13, a sunday night at 11:45. they say two offenders enter the farm building, stealing a black pickup and red quad bike. the closest entrance, a gate often used by the royal family and just five minutes drive from what you meant kate's home. >> it is a little concerning, they should have the best security in the world. >> reporter: it is not the first time the royal family has dealt with the break-in. years ago on christmas day 2021, a masked man broke into windsor castle, armed with a
