military chief for alleged war crimes, how israel is responding. plus, major news from the department of justice calling for google to sell off its web browser, what it might mean if you are doing one of the 6.3 million google searches every minute. our nbc news reporters are following all of the latest developments but we begin on capitol hill where reaction is pouring in from matt gaetz's former colleagues and others, i know that you just spoke with josh hawley, what are you hearing overall?>> reporter: just spoke to senator josh hawley, you can see outgoing senator mike braun over my shoulder giving his reactions. holly was one of those republicans that sits on the senate judiciary committee, he made with matt gaetz yesterday, i asked him if he thought this was surprising especially given the fact that matt gaetz was sounding pretty optimistic as he left capitol hill last night and he was one of those

senators who had spoken support of the of gaetz as the attorney general nominee. when i asked if it was surprising, he said maybe not necessarily given the fact that it was an open secret but this was going to be a tough nomination process, certainly another piece is something that i asked as well, which is where other colleagues of his on the judiciary committee vocal about the fact that there could have been problems with them getting to yes and thusly he would have never made it out of the committee. he knew that there were reservations, i asked him if it was four or five colleagues, he didn't know the exact number but that is a question i asked lindsey graham and he is how he answered for me.>> do you get the sense that they were already going to be no on him, is that why he resigned? >> i got the sense that the process was going to be challenging and you need to ask him, here's what i would say, the president nominated

somebody, they chose to not go forward, now he will nominate somebody else.>> reporter: so as everyone moves on to exactly what senator graham is talking about, the fact that he will have to nominate somebody else, nobody is really giving any names, when i talked with senator josh hawley, they are very hopeful and confident in whoever the president-elect decides to choose but ultimately, we have heard on capitol hill, even from senators who are supportive of matt gaetz, it doesn't seem like they are overly mournful of the fact that at least for now they know they are not going to have a very difficult road ahead of them with gaetz as the person they are hoping to confirm as attorney general again, trump has not shied away from controversial appointments so they don't exactly know who they are going to get next either. thank you for that. let's get a reaction from the justice department about this

news, i want to bring in justice and intelligence correspondent, ken delaney. >> expressions of great relief from current and former doj officials, this was a nightmare for them, they know they are going to get most likely a nominee who shares donald trump jaundiced view of the justice department, of the special counsel investigations of mr. trump over the last few years but this was shocking to them, the idea that a person with very little legal experience, who had been investigated by the justice department and who has been such a rhetorical bomb thrower in terms of accusing the fbi and doj of corruption of unethical behavior. the idea of him as the attorney general is just beyond the pale. the question becomes, they are waiting to see who the nominee actually is and i have a little bit of new insight into that, there's a guy named mike davis who has been advising the trump transition team, and he has treated in the last hour that the people of the names he

thinks are the best options going forward and that is mark pealeta and senator mike lee, all of those people have been very tough in terms of demanding reform at the justice department saying it has been weaponized. saying that the president should be able to order specific investigations into specific people which would violate a five decade norm, but those are the names we are hearing and former officials anxiously waiting to see who donald trump will pick next.>> thank you. there are 124 countries where israeli prime minister, benjamin netanyahu could be arrested after the international criminal court issued an arrest warrant for alleged war crimes in gaza. the icc also issued for the former defense chief, hamas commander, i wonder what has been the reaction and what is

happening.>> reporter: yes, the icc today, big move issuing an arrest warrant not just for benjamin netanyahu but israel's former defense minister and also hamas's military chief, mohammed deif, deif was killed in a strike a couple months ago, so the only two living people of the icc seeking to arrest are these very senior israeli leaders and i can tell you in israel, there is a lot of anger about this, not just from prime minister netanyahu's right wing allies as you would expect, but from israelis across the political spectrum, they see this as the unfair targeting of a democratic country that is fighting a war which it didn't start, netanyahu just popped up on israeli television a couple minutes ago to speak to his nation for the first time since this announcement but i run the mac want to read -- i want to

read to you a statement he put out earlier, israel rejects and with discussed the absurd and false actions charges against it by the international criminal court, which is a biased and discriminatory political body. there is nothing more just than the war that israel has been waging in gaza and goes on to say that netanyahu will continue waging that war. these are very serious allegations, the court saying that there are reasonable grounds to believe that both netanyahu and gallant deliberately used it as a war in gaza and they point two israeli government to intentionally target palestinian civilians inside the strip. practical terms, unlikely netanyahu is going to be in handcuffs anytime soon but he does now join a lonely club along with vladimir putin of major world leaders who are wanted for war crimes and

exactly as you pointed out, the u.s. and israel may not be signed up to the icc but 124 countries around the world are, including most western democracies, the u.s., the uk, france, germany, canada and at this point, it is not clear that netanyahu could step foot in any of those countries without facing arrest which is a shocking position for the prime minister of israel to be in.>> thank you. the justice department is demanding that google sell its chrome browser, i mean this is probably the biggest monopoly case since the government went after microsoft 25 years ago. what are the real-world implications for everybody? most of us googled many times a day.>> you and me both, this is huge but this is not a done deal yet, this is a long legal

process, if the government succeeds in their request which is what this was, google would have to sell off chrome, but also have to do a number of other things including possibly selling off android, the mobile software system, not taking, not paying apple for the default search position on their devices and selling states and a.i. companies that might compete in the search business, a bunch of changes that the government wants google to make. google will have a chance to respond in court to all of this and it'll be up to a judge to decide, that is not expected to happen until maybe august of 2025, google put out a statement reacting to all of this, here is what they are saying. doj had a chance to propose remedies related to the issue in this case, instead, doj chose to push a radical interventionist agenda that would harm americans and america's global technology leadership, doj's widely overbroad proposal goes miles beyond the court's decision. that gives you a sense of the

was asked if what if somebody doesn't make it through and he said we have backup plans for every position, we have lists of 10 or 12 people, we just heard that a legal ally that helped with the transition added the names of mike lee of utah, the former ambassador to mexico, so what do we know about this list, and is there a clear front runner?>> do you turn to somebody like mark peoleta, as somebody that has been at the forefront of arguing that donald trump's doj should be operated not as independent defection from the white house but somebody who is a dod that should take directions of donald trump and yet somebody that also doesn't have the baggage of matt gaetz and may not have the name recognition or draw the same level of scrutiny that i think that is where you could see him going potentially in a direction like that, and you said mike lee, the senator from

utah who has remained a close ally but if you want to get mike lee, clearly matt gaetz cell because of a very narrow republican majority, one of which they need every guaranteed republican senator which mike lee all but is from these nominees. you may lose his vote for robert f kennedy junior or pete hegseth and that might be a sacrifice they are not willing to take, you named matt whitaker who has been up for consideration but literally just yesterday he was nominated to be ambassador to nato so that is where suddenly this becomes a little more difficult, you could have todd blanche who he nominated to be his deputy ag. but, this i think is a clear blow to donald trump in his transition right now that anybody that he puts forward is not necessarily going to get a free pass by the republican majority in the senate.>> well

of course, our good friend vaughn hillyard brings up something very interesting, which is a very narrow majority, which we saw in the house, the speaker goes to donald trump and says don't keep stealing my people, i don't have very many of them. so now we are talking about mike lee and eric schmidt as the new name, but would he care, would that be high on his priority list? i wonder what you make of this, or whether the two people who we mentioned who are whitaker and ratcliff has been picked to lead the cia, could they be back in the mix? is anything possible is my question. >> if we know anything, anything is possible, but todd blanche is one of the folks to keep your eye on, as vaughn hillyard just said, he is very close to trump , he has been

his lawyer in one of his many legal cases. at the end of the day, not even donald trump has a pain point, it was very clear for a very long time, from day one that matt gaetz would have an uphill climb and once he got on and talked to the senators, donald trump himself had been leaning on a bunch of senators and it became clear that this wasn't going to work and donald trump is someone who does feel like he has the power over the republican party and he's right to a certain extent. he seems to be listening to some of the senators and their concerns, that also means there's probably a world in which senators say look, please don't take any senators, let me have my people so we can deal with everything else. because they do have a longer list of folks who would it be taken out of the senate and some of these people may not want to go through the entire process of being vetted by the judiciary committee and going to the hearing with folks that they work with.>> well, yes,

and i wonder, even going beyond that, you have to make a decision about whether you want to be a part of this administration, right? >> yes, and that tells you a lot, the folks that maybe aren't so interested, despite the fact that they are going to have this trifecta, it is still going to be very hard to get things done. and if you are a member of the cabinet, the way that donald trump works is a little bit differently than people have noticed. so, he wants something done, he's going to demand that the secretary of xyz, the attorney general gets it done. and bureaucracy despite the fact that they are going to try to dismantle him in some ways, it is still morning -- going to move very slow. and is that something that these folks who have good careers, who have their futures want to put themselves through for four years before they lead

somebody as president for some time?>> chris murphy told nbc news about gaetz's withdrawal, it is good for democracy but who comes next ? it could get worse. what do you think the likelihood of that is, or, i'm sure he's not happy that he did not win this one, he was making calls himself and the folks at mar-a-lago were confirming that he was working the phones on behalf of matt gaetz. so, will he look potentially, given the number of names on this list for someone with the credentials to get through? >> yes, i do think so, this is a major embarrassment for donald trump, a major embarrassment for jd vance, the vice president-elect to be lobbying for matt gaetz, this is a massive loss for the incoming president and he has to file right now. it also reflects the importance of susie wiles in this process,

it has been reported that this was a surprise to susie wiles and she was left out of this conversation and in some way i think this incident foreshadows what we are dealing with over the next four years, when donald trump makes brash decisions with some of the lesser qualified advisers to him and ignores the council and says susie wiles, we end up with a situation like this. i think i disagree a little bit with chris murphy on this because i don't think it can get worse. here's what i mean by that, all of the names available to donald trump will do his bidding, he is not going to nominate something that now refuses to do his bidding and in many ways, bill barr did his bidding but if you consider he came on and fixed what had gone wrong, not in the eyes of the constitution, bill barr's was a henchman for donald trump in many ways. donald trump has a different priority that he wants his ag

to go after now, the enemies list, he wants to make the department of justice a tool of the executive office of the president. many nominees eventually could do that, including u.s. senators. i think what we were spared in this case is a nominee wholly unqualified, matt gaetz lacks qualification for the job and the questions of his personal fitness with very substantive allegations of sexual misconduct with a minor. those probably will be eliminated from the potential next nominee. donald trump is going to get his person and he will be confirmed and we are in a new era for the department of justice. but i think of the other names, i find them qualified to run the department. >> so i wonder who might have the president elects here on this, for one of the nominees, who happens to be the last person at mar-a-lago, maybe there's also a question about are there people on this list who are generally more popular

or have more support among the people who might have his ear whether it is his son or elon musk, you tell me. >> i think this is an important conversation to have because it is going to be representative of this white house very likely because the way we talked about this, the way he ran his 2024 campaign was by having a very small nucleus of advisers who were very much trusted. susie wiles, jason miller, maurice epstein, again, this is a very small nucleus that he placed his trust in as well as donald junior who took a much more active role in personnel. but we have seen elon musk be added and howard let nick, so it has grown a little bit, but i think that his decision to choose matt gaetz in the first place when he was on an airplane with matt gaetz to mar-

a-lago was the head turner that this is his decision-making process and even if it is on a whim, he's going to make the selection he feels most comfortable with. there's bailey, the missouri attorney general, but i think what we have seen with these numerous selections is that donald trump had several names thrown his direction but, ultimately, makes the decision in ways that are not necessarily choreographed or even foreseen by a great many people who are his allies even around mar-a-lago and in washington, d.c., too. there's only so much guessing that can take place because he is instinctively making these selections in real time that can be really indicative of how we can expect his white house to run, too. >> vaughn hillyard , david

>> vladimir putin said russia launched a new experimental ballistic missile at ukraine overnight, part of a barrage on the eastern city, ukraine claimed it was an intercontinental ballistic missile designed to carry nuclear warheads and travel thousands of miles and especially powerful weapon which as of yet has not been used in the war. we have the new york times the medic responded, what do we know about this latest attack from russia? >> we know the russians are saying this was an intermediate range ballistic missile that it was a new kind of missile according to president putin

who addressed the russian state just in the past few hours and it's the first time that this kind of weaponry has been fired at ukraine, it is notable for its speed, a lot of this we are getting from the russians. but, witnesses on the ground in ukraine talk about a different kind of sound from it. so, clearly what the russians are trying to do and president putin is not being open about this, to signal a warning, kind of use a weapon that is capable of carrying a nuclear warhead, even though it didn't have a nuclear warhead and he is very openly trying to say look, if you do more to support ukraine, then we will do more and of course this comes days after the biden administration agreed to the use of long-range weapons by ukraine and clearly

the situation is escalating. western leaders this week have a pin -- have been accusing russia of rattling and somewhat say even this is another example of that.>> michael, let's talk about the escalation on both sides, just yesterday again, actually several days ago, ukraine started launching long-range missiles into russia, putin lowered the threshold for russia's use of nuclear weapons, what do you make of what you are saying, how much of it might be tied to his imminent return to the white house?>> well, it is a lot of signaling here and one way to look at it, which would be more optimistic from a western ukrainian perspective is that the russians are already basically going all out and short of actually using a

nuclear weapon, which would be an incredibly drastic act, there's not a lot more that putin can do, so you can interpret this as him essentially trying to intimidate and play mind games and play chicken. obviously it is a very dangerous game, obviously anything involving nuclear weapons is extremely dangerous but at the same time, he doesn't have a lot of cards up his sleeve, in terms of military responses, he's already basically going all out and facing manpower shortages. the bad news of course for the ukrainians is that the trump administration is coming in and me cut aid to kyiv and that would put ukraine at an enormous disadvantage and force them to peace talks with putin. it is hard to know how this might play into his calculations whether he thinks that escalating somehow, one theory could be it allows him to de-escalate a little bit when trump says okay, i have

someone here that i can deal with, everybody calm down, i'm a reasonable guy, let's make a deal. that is one possibility but it is really hard to know what he is thinking.>> in the days between now and then, when donald trump returns to pennsylvania avenue, obviously the biden administration is trying to do what he can for ukraine, including moving to cancel what $4.6 billion of ukraine's debt, what impact might that have?>> well, every little bit helps, there has been a lot of focus on the military support the u.s. provides but we have been pulling -- playing a huge role to keep their government afloat so they can pay salaries, keep their schools running, firefighters, unfortunately in this context, $4.5 billion doesn't go very far, so the biden administration is trying to do everything they can, this will be helpful to the

>> there's definitely a huge sense of relief, this notion that someone who is the target of an internal criminal investigation would have been the attorney general of the united states was really something that a lot of people are bracing themselves for and worrying what that could spell going forward but now there's a lot of relief that matt gaetz is no longer the nominee. one person said certain events, like the sun chasing away the dark of night are not surprising, they are expected. but that doesn't stop me from being grateful for each sunrise. i know what is going to be the first feather of my gratitude handprint turkey this thanksgiving. another official told my colleague, that this is such a relief, it is hard to imagine him appointing someone worse but we shall see. so obviously the next big question is who is that attorney general nominee.>> ryan
