matt gaetz officially withdrew because of allegation that he had sex with an underage girl and paid two other young women also for sex. allegations he denies. given this, trump today had to give up on his choice of a maga loyalist from florida a fixture on fox news and will, instead, nom nighting a maga loyalist from florida who is a fixture on fox news. he picked pam bondi. you may remember her from many guest appearances on the political reality show that donald trump forced us all to live in. in 2013 when she was still attorney general of florida she had reportedly been looking into allegations of fraud at trump's sham university. then trump's sham charity gave an illegal $25,000 donation to a pack supporting pam bondi.

and pam bondi decided she was not interested in investigating trump university anymore. years later, trump's universeity and his charity would be shutdown. after being investigated by attorneys general who did not receive any large donations from trump. you may remember her from part of her role of defense team where she demonstrated her skills as a litigator. >> he remained on the board until -- april -- of 2019. >> nailed it. like any good reality tv star you remember pam bondi from her

many, many appearances on television and specifically on fox news television. mrs. bondi filled in on fox three times while she was still the sitting attorney general of florida. she spent plenty of time on the network since she left office. >> murders, rapists from venezuela prisoners coming straight into our country. they are coming to a town near you. it should scare and terrify everyone in this country this is just one big press conference, trying to smear donald trump, trying to hurt donald trump. >> we have evidence of cheating. i will talk about that in a minute. we are still on the ground in pennsylvania. i am here right now and we aren't going anywhere until they declare we won pennsylvania. >> that last clip that you saw there was from just after the 2020 election when pam bondi was promoting the big lie that trump won the election. bondi part of the legal team that tried and failed his

election conspiracy theories in court. filing lawsuits on trump's behalf in battleground states. she has been one of his most loyal foot soldiers. stood by him in his manhattan trials and defended him outside of the courthouse. >> listen, all of the rights here, i am a prosecutor, former prosecutor, all of the rights here go to the defendant because it is his liberty at stake and that has not been happening in this courtroom. this case never should have ever, ever been brought. >> all of that is why trump chose bondi for his attorney general. she will be ever bit the loyalist that matt gaetz would have been just with a little more legal experience and a little less baggage, or so it seems. joining me now is jamie raskin. ranking member of the house oversight committee and the lead impeachment manager in the second trial of former trump,

congressman, thank you for being here. i am eager to first get your reaction to trump's second choice pick of pam bondi to be his attorney general. >> reporter: well, i suppose her virtue is she does not have the baggage that matt gaetz brought in terms of charges of sex with an under age girl using prostitutes, showing obscene photos on the floor of the house and so on. but she obviously is schooled in the exact same legal culture of whatever donald trump wants, donald trump gets. and, so, here we are. you know, it has been quite a week as they have begun to unveil what their january agenda will be. they brought forth a bill to abolish diversity, equity inclusion in every federal department and then disqualify the people who have been working at them for

reassignment, this purge of anyone who had anything to do with dei. it will be a scarlet letter for them and then today on the floor, of course, they were arguing for legislation to give the president of the united states through the secretary of the treasure unlateral executive authority to strip 501c of their tax exempt without going to court or proof t. is within the discretion of the secretary of the treasure. afterwards you can go to court and then you have the burden of showing you are not a terrorist- supporting organization. which capsizes the whole meaning of due process. this is what we are looking at from the lawyers coming out of the trump hemisphere here. >> yeah, let's just talk a little bit about pam bondi specifically. given what those lawyers are doing and what she has done and she might head the department

of justice. i wonder if she, in your estimation, be more skilled as it were than matt gaetz who seemed to not really around stand the full scope of the department of justice and only sort of a passing career as a lawyer. pam bondi was the florida attorney general, she led the, she was part of the defense team for part of trump's first impeachment. she has been at the center of legal fights in a more high profile and meaningful way. does that concern you? >> reporter: well, she met the only real test for the job which is she willing to do whatever donald trump asks her to do. you know, as you showed from the various episodes that flashed up on the screen, you know, she might not be this century's answer to f lee bailey but she has had courtroom experience. she has been a lit gator in

different context. that does not improve the merits of what they are saying. but i think she at least will not be sort of as much of a catalyzing, lightning rod figure as matt gaetz would be. >> i would wonder. she is steep in maganism. proven herself a trump person. and it seems like a problem for people who are, i don't know, interested in the preservation of documentary and constitution and the rule of law. the fact that she has been heading up part of the litigation wing of stephen miller's america first policy institute suggests to me, i don't know how you think about this, but she will be working together with stephen miller as they come up with the ideas

including rounding up migrants and the rest. does that concern you? it looks like the centerpiece of the new trump administration she would be the chief lawyer in operation and against everyone suing, presuming it is done in the way it was done in the past. running over people's civil rights and civil liberties and what the law does. so, yeah, i mean i think she is lined up to do that. remember, the attorney general himself or herself rarely appears in court. even the supreme court that is the solicitor general. she is really presiding over

the bureaucracy. that is where she will be the key transmission belt between donald trump's orders and then making the bureaucracy move. that, of course, is what everybody at the department of justice is so afraid of. there will be a wholesale abandonment of the law in the constitution and it will become like the donald trump law firm. >> do you, i mean, the enemy's list has not gone anywhere, right? that was a figure of the matt gaetz agenda and i am assuming the list will be given to her. i would imagine that you and some of your democratic counterparts will on that enemy's list. when you see someone like matt gaetz now going to pam bondi. >> republicans rank higher. liz cheney and you know, at the end of the campaign a lot of

them were coming forward. the president's former chief of staff, john kelly, former chair of the joints chiefs of staff, mark milley. those people are on a list of hundreds of people who are on the enemy's list. sure, if the whole administration is just about exacting revenge and retaliation then they are going to find different ways to go after even legitimate legislative activities like legislative committees. we think that we have been covered by the speech and debate clause as well as the first amendment as well as separation of powers. that may be tested. just like they want to go after immigrants and public schools and they want to go after federal workers they also want to go after anybody who dare to challenge them on their dubious constitutional assertions. and, so, that means we have to

. matt gaetz withdrawn his name from consideration as united states attorney general. the sex scandals were apparently just too much. and that matters because gaetz is not the only alleged sexual predator, sexual pest whatever you want to call him with wild political views that trump picked for one of highest positions in government. >> did you sexually assault a woman in monterey, california. >> as far as the media is concerned it is simple. the matter was fully

investigated and i was completely cleared. thank you very much. >> sir. >> sir >> that was fox news personality trump's pick for defense secretary pete hegseth. the allegations he is denying stem from an incident in 2017 where a woman says he sexually assaulted a woman in monterey, california. in respond to record's request, the police department released the police report about that incident. the report details the woman's allegations that after the conference she went to an afterparty and then the hotel bar. both of which hegseth went to. at the bar she believes some form of drug was slipped into her drink. she says she remembered walking out of the bar and ending up at the hotel pool where she claims to have had an argument with hegseth. she says her next memory is being in hegseth's hotel room where he took her phone and physically blocked her from

leaving his room. she remembers saying no a lot. she remembers a sexual encounter took place. the sexual encounter part of the report is a little too, not safe for work, for television, just know i am sparing you some details here. hegseth denies wrong doing and frames the incident as consensual pointing to the fact he was not charged as his innocence. the police and the local attorney did not give a reason why they did not charge him. deciphering what is true here is complicated that hegseth paid a undisclosed amount to the accuser as part of an nondisclosure agreement. they can not speak out. it remains to be seen if the allegations will move the needle in the senate the way the allegations against matt gaetz did. this is how roger wicker, set

to chair the senate arms service committee this is how he spoke about pete hegseth's chances today. >> what are your concerns about the nomination and the answers of those concerns that have been raised. >> i think he will be in pretty good shape. >> why is that. >> did you read the allegations? >> we were not specific. but, you know, since no charges were brought by the authorities we have only the press reports >> should you have gotten into the specifics would that be a judcasion. >> judication. >> it does not seem promising. but, sexual assault allegations are not the only reason that pete hegseth can give republicans pause this week nbc news reported that trump's team is drawing up a list of current and former u.s. military

officers they would like to court-martial. another list that trump's team is drawing up of all of the pentagon officers trump wants to fire. trump has been loudly doubling down on his threat to use the u.s. military to round up, detain and deport millions of immigrants. that would mean using the u.s. military on u.s. soil sending troops into american neighborhoods. in the previous trump administration there was a belief, accurate or not. some of the people around trump curbed his extreme impulses. there were adults in the room, if you will. as much as republicans in the senate claim they are all aboard maga train, they all do hope there are some adults in the room at the end of the day. rand paul came out a bridge too far for paul.

it is a low bar but it is a bar. the moment for congress to reign in trump's worst instincts is right now. pete hegseth if he is confirmed appears to be more than willing to go along with everything trump is asking for and treat anyone who stands in trump's way as an enemy of the state. in addition to being a fox news personality he is a prolific author. three books, american crusade, battle for the american mind and war of warriors. american crusade calls for the defeat of the left with utter a my lags. he writes our american crusade is not about literal swords and our fight is not with guns, yet. in the war on warriors he makes clear that he views the

american left as actual enemies of the united states. the expectation is that we will defend america against all enemies both foreign and domestic. not political opponents but real enemies, yes, marxists are our enemies. he considering the ideas of the rules of law more "woke" nonsense. our enemies should get bullets not attorneys. here is how they reflected on the books as a whole. the main question i was looking to answer when i started reading his collected works is if he would follow a trump command to shoot peaceful protesters. after having read them, i don't think he would even wait for the order. joining me now is richard bloom

blumenhal. >> we talked about matt gaetz and tulsi gabbards. pete hegseth, those writings about turning the united states against other american citizens with whom he disagrees seems just dramatically dangerous for someone who might be the defense secretary. what is your reaction? >> dramatically dangerous is the right way to do view it. we are talking about they will do his bidding, bondi, just like gaetz would have done. where prosecutions can be brought as retribution at least you have the courts. >> as a stopgap. >> as a buffer as a fire wall.

in the department of justice if there are -- department of defense. if there are orders to shoot in case of a protest or a gathering in a church basement or any kind of meeting, there is no restraint of the same kind. and, so, what this kind of threat represents is something profoundly dangerous to our democracy. that is why i have actually proposed a measure that would constrain the insurrection act, the legal basis for the president to order this kind of military intervention on american soil. remember, we use the military to defend our nation. we do not use it against our own citizens on american soil. and that is the basis of our constitutional principal and also the insurrection act. unfortunately the insurrection act is so brood he can misinterpret it >> do you think senate

republicans share your trepidation? >> i think my republican colleagues are very sympathetic to it. it is not just about donald trump it is weak innocence our law. it can be misused by an independent or a democrat in the same office. we should move to correct it. but right now we can see the fire on the horizon. we ought to do something about it. i think our republican colleagues ultimately will be judged harshly by history if we fail to do so. i think this concern about the misuse of the military also deeply concerns our military. >> yeah. of course. there is also the issue of, you know, what hegseth as the secretary of defense might do to the actual military itself. i want to play a little bit of audio. from earlier this month. this is pete hegseth on a podcast talking about what he wants to do if he is in charge of the military. let's take a listen. >> first of all, i got to fire,

you got to fire the chairman of joint chiefs, bring in a new secretary defense. any general, admiral, involved in the dei woke got to go. either you are in for war fighting and that is it and that is the only litnese test we have to be worried about. whatever the standards, whatever the combat standards were, say, 1995, let's make those the standards and as far as recruiting, hire the guy that, you know, did top gun maverick and create real ads that motivate people that want to serve >> top gun maverick and throw away the combat standards and rewind time 30 years ago when warriors could be real warriors. that raises like alarm bells for me. i don't know how you hear that and if you think there is a possibility that someone like hegseth can turn america

fighting forces into a army of maga warriors. >> more than alarm bells for me, alarm bells for military. we need professional war fighters. we need people like joints chief of staff. a general who knows how to do a military budget, who knows how to hire and promote and recruit and retain the best fighters in the world which is what our national defense requires and he knows how to keep secrets. >> yes. >> which unfortunately people like hegseth do not know how to do. and one other point on sexual assault. chairman brown, milley before him, their predecessors, our military focused on trying to stop sexual assault in the military. i work with senators for the last 15 years it is still a skurg to have someone in the

military who, himself, is potentially guilty of sexual assault is such a violation of public trust and when he says he was cleared. no. he was not cleared. they stopped the investigation. we don't know why. and, we need to get to the bottom of why the investigation fact was stopped in the armed services committee before we confirm him. >> do you think you will? >> we are going to look for those files, i think we need them. we deserve them before we make judgments. and i would challenge roger wicker, as he got in the elevator. to do a full investigation. it should not be classified or confidential. the american people deserve to know the truth. >> hopefully we are on the way to do that. >> thank you, appreciate it. >> thank you. still ahead this evening. we will get reaction from

. you don't have the votes. that is what president-elect donald trump reportedly told matt gaetz during a phone call today, ending his hopes to becoming the attorney general. on the call trump reportedly said these senators aren't move >> they confirmed five republican senators already made it clear that they would vote against gaetz. it marks trump's first defeat. what does it mean for his pick for secretary of defense? pete hegseth facing serious sexual assault allegations that he denies and what does it mean for pam bondi that is now trump's choice for attorney general. joining me now are two good friends of the show. gentleman, thank you for being here tonight. i don't, i don't, i am trying to think of how to categorize

the behavior of senators, tim, shred of decency. none of them came out and said they would not vote but they were saying it behind closed doors and it sounded like it mattered. do you have, i would say maybe not renewed faith but optimism after a day like today? >> maybe slightly. all of these courageous republicans that go on background and talk to people like mark lebovich that finally became useful. you can be courageous talking to background reporters and in private with matt gaetz. so, i don't, i don't, i thought that gaetz was going to get through it to be candid. the fact that he withdrew means i should update my priors a little bit on what might happen on the hill. i remain skeptical that when in the rubber meets the road on one of these other nominations

and, you know, when the nominee is put up and they have to go to the vote and they have to vote against donald trump, i just, i think it will be challenging to get more than 2 or 3 votes but they only need 4. they have a narrow majority here. i guess i would update my priors to say maybe there is a glimmer of hope. that is nice. but i think it might have been a unique situation that was, that was maybe unique to matt just because of his not so swell personal relationships with his colleagues. >> i was thinking that as well, mark, it was made difficult most people including most people in his party don't like him on capitol hill. does not pertain anything for pete hegseth that faces a serious potential scandal, alleged scandal. and on paper should be equally

as disturbing to the same senate republicans but will he be? i don't know. do you have a thought if it is an apples to apples or is it apples to pomegranates. >> i think to pick up on what time was saying. the rubber never hit the road here. gaetz made it hard for himself and easy for trump to pull away from this, he made it easy for the senators. they never had to speak since that publicly. they never had to really say anything for the record that would be counted and get noticed here. and gaetz was a unique case. i think the larger thing here is, you could argue that hegseth is equally problematic. you can say kennedy is problem mattic, gabbard. there is a scenario here for the nature of the republican party today in which 4, 6, a number of them could lock arms

and say no. we actually want to have some decency here. some shred of check and balance and you are going to put some nominees up that we can actually debate and confirm. you know, we have not seen anything in the ballpark of that happening yet. but, look, i think it does become easier to do this going forward once you have one nominee withdrawal. that is what we had today. >> you know. to that end. tim, there are the dynamics at play. >> i think you had a hard time thinking trump would pull a nominee. stick to member presidency of his own party, walk the plank is something that, if the past is fur log, something he likes to do and would have been expected to do again. but, dumping gaetz constituted

a remarkable about-face for donald trump who would not but was going to use a recess to install him. although trump won big fighting pointed battles within in his own party >> it is hard for me to see the words awareness and donald trump in the same sentence, tim, but what do you make of that? and i think the best observation you can give about this, he is not a long-term thinker to say the least, right. he is a person that lives off of the land and goes with his gut. for whatever reason, confluence of events. maybe. the other thing is my spidy sense is up on this. j.d. vance can fight from another post, a vague term, another post, maybe they figured something out in the back that

i think that remains to be seen. to me, i think the question is, does this type of strategic donald trump stay or is it a one-off thing? i am inclined to think it is a one-off. we will monitor it. it could be a question. mitch mcconnell does not like robert f. kennedy anti-vax stance. pete hegseth i would say is less qualified and more serious objections to him than could have been put forward by matt gaetz. if trump is facing rejection on multiple fronts do we see the lash out trump, bullying trump, the one that wants to humiliate people, my suspicion is yes, but we will see. >> can we talk about mitch mcconnell for a minute. i am struck by this. mitch mcconnell made himself the head of the senates rule

committee. leapfrogging over others. he is retiring. he is not a fan of trump. he had racist slurs against his wife. he can go out guns blazing and say not on my watch. this is, you know, he could link arms with people. how much of a factor do you think it can be in play here and how effective could he be as a bull work against trump? just as a character that knows the ins and outs of the senate? >> reporter: he can be effective with the loyalty with the other members. it is also perhaps a little easier for him because he is outgoing at there point. not outgoing verbally but outgoing -- [ laughter ] -- leaving the job of majority leader or republican leader at this point. no longer in leadership. the rules job is interesting. i do think that he will have a level of independence that he never had before. having said that, we have seen mitch mcconnell over and over and over again come up way

short of being any kind of bull work against trump. despite his own personal reservations. i would be hesitant to have any conflicts. >> i should, i mean only in terms of nominating absolutely bonkers people, like bonkers, really extreme level, capital letter, bold, underlined? he can not stand up to the extreme maga in trump. to that end, tim, if we talk about shame being an animated factor or republicans recognizing they are way out there on some of this stuff, mass deportation camps there has been a lot of human cry from people like tom homan refusing to being knowledge that camps can be set up despite what our reporting is telling us, land in texas set aside to set up mass concentration camps and using

the phrase super detention facility instead of mass concentration camps for potentially undocumented migrants. do you think that reflects a kind of acknowledgement on the part of the party that they could be in real trouble when they try to execute some of these more nef draconian levels. >> i do think it is a concern about backlash. looking at it so key in the early days just to focuses in and hone in on the media side and on the democratic side of what they are actually doing and responding to actions. because, i, it could go either way. whoen hand, stephen miller and homan that know their way around. i can see the draconian way.
