let's bring in greg lewstein, and katherine christian. so greg, this filing just came down. it's some 30-plus pages. walk us through what we know. >> yeah. we're still going through the filing, but we know this completely upends what's expected in the last criminal case pending against the former president. remember, this case is still ongoing. district attorney fani willis had that very high-profile questions about whether there was a conflict of interest involving former special prosecutor nathan wade. well, this court ruled there is an apparent conflict of interest that merits her dismissal from the case. i'll read you one quote. while we recognize that appearance of impropriety generally is not enough to support disqualification, this is the rare case disqualification is mandated and we want to restore the integrity of these proceedings. this can be appealed to the georgia supreme court. it is expected to be appealed to the georgia supreme court, but

this is a really decisive order against fani willis being able to continue this case. >> katherine, what's your reaction? what do you make of this ruling? >> it's not shocking. it was shock ing when we found out there was this relationship and you just said it was an unforced error, but usually appellate courts defer to the lower court, the trial judge who fashioned this. he said nathan wade, the man she was having an affair with, had to leave so the office could stay, and this court has said, nope. they didn't -- this court said that judge mavee did not preach that her decision-making wasn't just the indictment. it was who to charge, how to charge it, and that's at the time, when this alleged romantic relationship was going on, and they said, that also was one of the reasons why they think it's more than an appearance of impropriety. it's a conflict of interest, and not just her, the entire office is disqualified. so this is another trump indictment that sort of will disappear, and yes.

they will appeal it, but, you know, donald trump's defense team will use the same arguments that they did for the manhattan office and say he's now going to be president. this should be suspended while he's presidented because you can't prosecute a sitting president. >> you think this is the end of this case? >> ally, yes. trump will appeal it, but he's going to be president. his lawyers are going to say, you know, this is -- he's not going to fulton county to appear in any case. so if anything's going to happen, you have to wait until 2029 when he's no longer in office. so this effectively is another case that sort of will just -- one of the four indictments that will disappear. >> one option i am understanding is this could end up being handed off to a different office, different prosecutor. is there any other office or prosecutor in georgia that would make sense that would be willing to take this up?

>> that's such a good question because there is a prosecutor and a attorney's counsel that could ostensibly take up a case like this, but earlier on this year, that same prosecuting attorney counsel special prosecutor decided not to pursue similar charges against lieutenant governor burt jones who fani willis was earlier disqualified seeking charges against because of another conflict of interest, a completely separate conflict of interest. they've already signaled a very unlikely sort of charges against these codefendants and it's also important to note that the judges, the benches, the appellate court benches in georgia are very conservative. the court of appeals is very conservative, and the supreme court, eight of nine justices were appointed by republican governors. it's a very conservative bench here in georgia. >> so to be clear, catherine, this case and this ruling is not just regarding the charges against trump. this is a rico case. we know there were multiple defendants or codefendants. what happens as far as those codefendants go?

>> all the defendants because it clearly -- if, you know, donald trump was affected by this conflict of interest, so were all of his codefendants. it's not fair they have to proceed, but donald trump gets off, meaning his case gets dismissed. so all of -- i believe, there were 15 remaining defendants. >> what about the people who took plea dyeeals? >> the people who took deals will argue their plea should be withdrawn. that will be another proceeding. it could be argued that, no, their plea was knowing and involuntary and, but they will argue the same conflict was for us and we would never have pled guilty if we knew about it. they're trying to get their pleas back. >> where does this leave fani willis? >> yeah. well, she just won re-election. so she does have another four years in all of a sudden. there was a republican challenger who tried to make this case a big part of her argument, that fani willis should be unseated, that fulton county is one of the biggest

democratic strongholds in georgia, but her reputation is damaged, right? this was an unforced error as we said earlier, and, you know, this was all of her own doing, and now it unravels or might unravel one of the signature cases of just of her career, but of georgia. it leaves her damaged and it will be interesting to see what case she tries to make when she does -- when she is expected to appeal this to the georgia supreme court. >> greg bluestein, thank you for joining us on short notice. catherine christian, thank you and stay close. we have more breaking news out of pennsylvania where luigi mangione has waived extradition and could be back on his way to new york city any moment now to face charges for the unitedhealthcare ceo brian thompson on the streets of midtown manhattan. once he gets to new york, they're expecting a swift process. he'll get fingerprinted and get the criminal court before an

arraignment. let's bring in priscilla thompson from ollidaysburg, pennsylvania, and waiving extradition. walks through what happened in his back-to-back hearings today. >> yeah, ana. that news coming just a few moments ago, and in case you're wondering what's happening behind me, one of his attorneys, thomas dickey, has just come out of the courtroom. so proerts reporters are trying to him. luigi mangione was escorted in by officers at around 7:30 this morning. that first hearing got under way at 8:30 this morning. it was related to his state charges in pennsylvania, so charges having to do with weapons, forgery, and some fake i.d. issues, and then there was about an hour break where they were talking in chambers and there was a lot of discussion going on before that extradition hearing got under way, but we know from our producer in the courtroom that mangione was attentive. he was smiling at one point while sitting next to his

attorney, very attentive as all of this was going on, and obviously that extradition hearing got under way and he waived his right an extradition. he is leaving this hearing in the custody of the nypd imminently going to be making his way back to new york city, but i do want to talk a little bit about just the atmosphere out here in the courtroom. you had reporters lined up this morning waiting to get in, but you also had more than half a dozen supporters or sympathizers of mangione out here. some of them in lieu wee ji costumes and this is the support we were seeing online, and it appears that now that is manifesting in person, and important to remember that at the heart of this is brian thompson who was gunned down in the streets of new york city, and of course, mangione is now headed back there imminently to,

you know, stand and face the judge on that account. ana? >> and rehema talk to us about this. he arrives in new york, and then what happens next? >> yeah. we expect he'll get back here quickly and be blown back to new york. he'll be fingerprinted and processed and arraigned in the courthouse here behind me. this manhattan district court. he's facing an 11-count indictment including a charge of murder in the first-degree. there's another count against him called inference of terrorism. the manhattan district attorney, alvin bragg had said this is the charge against him for the killing of ceo brian thompson. this was just on december 4th, and he said it was intended to invoke terror. some are saying, however, it could be problematic to bring that particular charge against him, that charge that was only brought up in terms of being a possible charge post-9/11, but we should point out that when he

was taken into custody back in pennsylvania last week, nypd officials say that mangione was carrying a three-page handwritten letter that was critical of corporate america and he had a ghost gun they say, that was a ballistic match to the one that was used to kill brian thompson. the maximum penalty for both of these charges could be life in prison without parole. there is a talk of possibility of him being charged with a federal count, which could carry a death penalty for the 26-year-old. we are told that he's expected to plead not guilty to these charges and mount a vigorous defense against him. ana? >> please stay close. i want to bring back catherine christian, and also joining us, terry austin, a trial attorney. catherine, you said a swift extradition would be in the best interest of mangione's defense attorney and their team. you're not surprised. explain why. >> i'm not surprised and it's a good thing he got new york state criminal law practitioners

because under new york law, as soon as he's arraigned, then the defense in 20 days, are entitled to all of the discovery in this case. the prosecutors can ask for an adjournment for, like, there's a lot of body-worn cameras because you know there's probably a gazillion police officers involved. they get to learn the facts of the case and then within 20 days, they'll get all the paperwork. so they, karen friedman and i believe her husband, are going to be working together on this. so they are familiar with the procedure laws. they want him arraigned and they want all this information, and they are already i'm sure, hired a psychiatrist for any psychiatric insanity defense that they have, and i'm sure they have reviewed the law in new york state. you may say, of course, this was terrorism. the new york state court of appeals and the appellate courts will probably disagree because those courts have said this is a charge that really applies to 9/11, the oklahoma city bombing, you know, shooting students on

the brooklyn bridge, and it'll be interesting to see the evidence that the manhattan d. d.a.'s office that they'll say health care ceos are considered a civilian population or mangione tried to influence the outcome of government policy. it's a hard charge that may be a harder charge to squeeze a plea. >> we're getting color from the courtroom, that defendant here was attentive in court. he was smiling with his attorney, in this case it was thomas dickey in his hearings in pennsylvania, and we do know that the judge here in new york now assigned to this case is veteran new york judge, gregory carrow who will handle the arraignment expected as soon as he returns or gets brought to new york, and he's facing 11 charges. i want to play a part of what kathy hochul said about this case just yesterday. >> i'm ready to bring him back here, and to make sure that

justice is served to someone who had the audacity to gun down any new yorker. i don't care what their title is, but that brazen move on our streets not far from here, must result in severe consequences. >> terry, among the charges mangione is facing, is that first-degree murder charge in furtherance of terrorism? how hard could it be to prove that beyond a reasonable doubt? >> i think the prosecution will have a difficult time proving that because it's first impression. it's like the first time we have had someone who's an individual who has killed another person. it's murder. it's second-degree murder, but here's what the prosecution can do. they can show that social media. they can show what the outcry has been since this crime occurred. it did influence what people were thinking, and it could influence policy. they'll also point to that manifesto because in

manifesto, he talked about companies taking money from people who need help. they have evidence to support that terrorism charge on both counts, the first and the std. >> do you agree with that, catherine? >> i think that's what they're going to argue, and of course, the defense attorney is going to say, this is ridiculous and look at the case law. the attorney years ago was tired of violent street gangs terrorizing neighborhoods and that was the case that went up to the court of appeals with the court of appeals said, yes. it's horrible. it's horrible that a little child was murdered. it's horrible that someone was paralyzed, but this is not what terrorism -- this charge was for. it was for the 9/11. it was for the okay lahoma city bombing. it'll be interesting, will the appellate court say, you black and brown people in the bronx were terrorized? that's not terrorism, but this solo person who was murdered horribly will say this is terrorism because this defendant had a manifesto and was going to go after -- i don't know if this is facts, but to say it was facts to go after other health

care ceos. it'll be interesting. >> i know you know the defense attorney, at least the one who we have been told is assigned who he retained. how should you expect them to frame their defense? >> i think -- well, i don't know what facts they have learned, but she, before she was retained -- >> there he is. those are live images as he is being escorted out of that custody in pennsylvania, put into -- it looks like a vehicle here where he will make his way to new york city to manhattan to then face a judge for his arraignment in the 11 charges he faces, but again, you can see there we have the suspect, luigi mangione just getting into the car in that orange jump suit. in court described as attentive and smiling, and visiting with his lawyer. we'll keep an eye on these images. >> you can see he's in custody of nypd police. so they are the ones going to be taking him down to 100 center street in manhattan for his arraignment in front of judge carrow who's been a judge for over two decades.

but i expect the defense one to argue that this murder one charge, they'll say was, you know, ridiculous. it's overcharging, and then they will probably -- they may not do it at his arraignment, but they wait to start getting the discovery, and say there is some sort of insanity defense, that he lacked criminal responsibility because of some mental disease or defect, but i don't have all the evidence and quite frankly they don't have all the evidence yet. so we'll see this play out in a couple of weeks. >> your thoughts on that, and how quickly could this all move once he's back in new york? >> i agree they will probably assert the insanity defense. it's an affirmative defense and it's just by the preponderance of that evidence, but it's not a high standard, but i think there is some evidence there. we haven't seen it, that may say because he cut ties with his family, and he just went in a whole other direction that he probably was facing some mental illness or some disease there. so i do think that that's the best route that the defense could do at this point in time. >> and priscilla, i know you're

there standing by. what is the scene outside the court? you talked about how there had been perhaps supporters of luigi mangione outside the courthouse and the hearing this morning. fill us in. >> reporter: yeah. it is almost that circus-like atmosphere we've seen at some of these high-profile trials in the past where you have people appearing to sympathize or support luigi mangione who showed up this morning, stood out in the cold for more than an hour as these oceedings were taking place and remained out here with signs. some of those signs with the words that were on the bullets on the signs out here, you also have people who were dressed up like luigi, the video game character. again holding signs in support. some people with signs that say, free luigi, and so this is what we're seeing here at this courthouse today as we saw just a short while ago. mangione being es corted out of the courthouse via in a side

entrance that they have been using to bring him in and out and it appears he might be on his way to where he's going to -- the airport where he will pick up that chopper and head to new york city, and this comes after about an hour and a half inside the court. we know that there was about an hour delay where there was talk going on behind the scenes, and chambers, his attorney, thomas dickey saying they had some things to work out, but the hearing itself, the first hearing on the pennsylvania charges lasted about 20 minutes, and then he waived extradition and effectively that was the end of it in that second hearing, but we know that while mangione was in there, he was smiling at one point, with his attorney. people described him as being pretty animated in some of the conversations that he was having with his attorney, mr. dickey, and we did ask when mr. dickey came out of the courthouse about those conversations, and he declined to disclose what exactly they were talking about, but what he did say is that he waived extradition today because he was ready, that they have a plan in place, that they were

ready for him to go back to new york, and so that's why we're seeing the waiving of the extradition, him getting in that vehicle to now be transported back to new york, even as those people who are supporting him continue to stand out here, holding up their signs to express their support as he prepares to head to a court in manhattan and be arraigned on charges that he's facing there. ana? >> so do we know what the plan is after he arrives in new york? he's going to have this arraignment. do we know ultimately where he'll be held? >> reporter: we haven't gotten definitive word on where he will be held. the chances are it could be ryker's island. where many defendants are held awaiting their trial, but as priscilla was talking about, there being people outside who were supporters of mangione, we don't see any signs of that here. that's not to say it won't develop once it comes back here.

the expectation is they'll bring him back here as quickly as possible which means it would be in flight because it's about a five-hour drive from that pennsylvania location to where we are here in downtown new york. as you point out, that he is going to be processed very quickly. fingerprinted and processed, and face arraignment on these 11 counts, those two very severe murder charges that he's facing and two of them as we pointed out earlier. if he's found guilty, this 26-year-old man could face the possibility of life in prison without any possibility of parole. so it is -- there's a lot of focus, a lot of attention here because it was only just blocks north of here back on tes december 4th where that ceo, brian thompson, was killed, and it ignited a flurry of attention and concern around the health care and the issues involving health care and payments for people who were suffering and looking for payments for medical treatment. now what's going to happen in light of a suspect being found,

that's what we all are here waiting to find out, and how long it would take for him to get back to new york and exactly for that processing and arraignment to take place, will be here to let you know exactly how it plays out. ana? >> and of course, there are multiple states involved with multiple charges already. pennsylvania, new york, and a couple of sources familiar with the matter telling nbc news, terri that they're considering federal charges in addition. what do you think they might be weighing in making that choice, or decision? >> i think they want to see what will happen in new york. i think they'll be gathering evidence just like everyone is gathering evidence, and if there is enough to bring that federal charge, which does carry the death penalty, i do think the defense could possibly argue that if he is convicted of the higher count or even the lesser count in new york, that he would face double jeopardy for the same crime on the federal level.

posts railing against the bill. eventually trump then joined the pile-on with his own statement, and this morning the president-elect just spoke with nbc news laying out his thinking here telling us over the phone, quote, if there's going to. be shutdown, we're going to start it with a democratic president. >> we have julie tsirkin, and nbc's garrett haake who just spoke with trump over the phone. let's start there. garrett, what else did president-elect trump say? >> he was pretty unconcerned with the prospect of a shutdown. he essentially wants to see some of these issues, most notably the debt ceiling which wasn't even part of this conversation really a day ago, be cleared off his plate before he takes office. on the subject of the speaker, i asked if he still has confidence in mike johnson, he said, we'll see. he was clearly very disappointed with the work product that came out of the speaker's office in the form of that 1,500-page continuing resolution that was nuked yesterday by he and elon

musk. the conversation was about the debt ceiling. he's keen to see it lifted as we've all covered so many times in the past, and he would like to see it gotten rid of entirely, which has been expressed by democrats in the past. he said it's something he would welcome and actively campaign for. he argued the debt ceiling doesn't work for its purpose. it doesn't actually control debt at all, and that its effect is merely psychological, most often used by republicans as a choke point to get something they want out of the majority when they are in the minority. he told me in no uncertain terms this morning, he would like to see it gotten rid of entirely. i can tell you within the last few minutes, elizabeth warren, the democratic senator for massachusetts, got the opposite end of the political spectrum on so many issues, tweeted her agreement. ana? >> interesting. julie, tell us more about where things stand with lawmakers on the hill. >> they either stand in a holding pattern or extremely fluid because those are both statements told to me by

republicans who were shuffling in and out of the speaker's suite this morning. they're trying to figure out what they're going to do here because i think as they take one step forward, you have a conversation happen like garrett's with trump, in which he makes things a lot more complicated for them. now saying that he wants to get rid of the debt limit entirely. this is not popular among republicans. this was an issue back in may of 2023 when kevin mccarthy made a deal with the biden administration that sunk his speakership. so johnson has a lot to figure out now, and republicans really don't know which way they're going to go here. are they going to attach disaster relief to clean government funding bill through march 14th or attach the farm bill to it or disapatch all the other provisions on it that trump seems to not like? will they put a debt ceiling lift as part of this government funding bill in the next 36 hours before the lights are out? that remains to be seen. here's steve scalise as he was walking into the speaker's suite this morning. watch. >> there are some things we had some real progress last night.

i think if you see a deal come together in the house that passes, it's going to likely pass in the senate too, but we got to start here and get our work done in the house. that's what we're focused on. >> what's the solution? >> we're focused on making sure the shutdown doesn't happen, but we're not the only ones that control that. we're going to try to get it done today. >> reporter: republicans aren't sure they'll have anything to vote on today, but one thing is very clear, and that is that republicans are likely going to have this alone, and republicans won't bail them out this time around. >> so karen, i've got to ask a little bit more about musk's role in all of this. elon musk, did he force trump's hand here or was his team aware that musk was so opposed to this bill? were they really kind of working in tandem? >> the president-elect says they were working in tandem. i asked him about musk's role here, which came first, the chicken or the egg in terms of support here? what the president-elect told me is that he and musk had essentially discussed this, and he told musk that if musk agreed

with him on opposing this, he should go ahead and issue a statement. now musk obviously has gone much further than issuing a statement with that barrage of posts on x, his advocacy as important as anything, and what donald trump did also tell me is he and musk have different issues with this bill, that musk was looking at it, i think purely from a cost-cutting standpoint. trump's issues went beyond that including, as i mentioned before, his desire to clear the debt ceiling raised from his plate from across his presidency. so perhaps some different end goal, but he told me they're on track working together on this issue. >> what are you hearing from democrats? what's their play? >> reporter: well, democratic leadership are really holding their cards close to their vest. we heard from hakeem jeffries for example, who spoke to us last night and this morning. he also just posted on social media about the debt ceiling idea. now this was before garrett's conversation with the president-elect, but he said that it's a, quote, hard pass for democrats to help

republicans lift the debt ceiling. he equated it to something about the social security program that elon musk has floated to get early every, but republicans have been saying that that is not in their cards, not in their plan. as well we have heard from schumer who spoke on the floor recently. he's the senate democratic leader. he said, anything that republicans do must be bipartisan on the containing resolution of course, not what trump wants. he wants republicans to, quote, take away all of the democratic traps in this bill. i want you to take a listen to what jeffries had to say last night when this all was going down. watch. >> house republicans have been ordered to shut down the government and hurt everyday americans all across this country. house republicans will now own any harm that is visited upon

the american people that results from a government shutdown or worse. >> reporter: so clearly democrats are leaving the ball in republicans' court. as for some of those democrats that garrett mentioned like senator elizabeth warren, i'm told by sources that democrats have not been presented with anything from republicans. they are still operating with their originally negotiated agreement that is now dead. >> all right, julie tsirkin, and garrett haake. thank you both. let's bring in robert garcia of california now. congressman, thanks for joining us. from your view, where do things stand? can this congress get its act together before tomorrow night? >> well, first, welcome to the elon musk presidency, one where donald trump has been relegated to be the vice president. clearly what elon musk wants, elon musk is going to get, and where we're at right now is complete chaos on the republican side. we have a government shutdown that is looming, that is real right before christmas, and we

should be really clear. what we're talking about here is not paying our military members during the holidays, not paying our tsa workers during the holidays, not paying the people that are working on all of our holiday travel that are out there working for us every single day. so this is an incredibly serious moment. it's one where speaker johnson has lost complete control, and clearly where elon musk is pulling the strings of what republicans should be doing. so it's quite chaotic, but democrats are united. we had a bipartisan deal negotiated, and have completely gone and turned their backs on it. >> you just got out of this house democrats meeting. we saw leader jeffries' comments yesterday. if there's a shutdown, everyone loses. so what do you see as your party's role right now? >> well, first, there's nothing now right now on the table, and so republicans are going to have to decide what they bring forward, but we don't expect anything to happen here in the next few hours. we think they're obviously

negotiating right now. it's important for our leadership to continue meetings within our own caucus, but what we're clear on is we do not want the government to shut down, and we had a deal in place, and let's think about this. the deal that was in front of the congress had $100 billion for disaster relief for states across the country like north carolina, like florida, like california. it was necessary and needed to get help to the people on the ground, and republicans have now turned their back on disaster relief, and on supporting farmers across the country. on top of that, you have 85% of the federal work force by the way, who worked outside of washington, d.c. millions of americans were depending on services. now in really a dire situation right before the holidays with the shut the shutdown looming and they need to get this in front of the congress. what that's going to be, we're not sure, but elon musk is pulling the strings. >> we heard what trump told nbc news about this, saying

musk and others are calling for a shutdown after trump's inauguration. what do you say to that? >> it's shameful, and i think this idea that we're going to play with people's lives, particularly during the holidays, let's be very clear, that people don't get paid are military, are folks that are depending at our va hospitals, people working at our nation's airports would not be receiving pay during a shutdown. the people we depend to help seniors with social security, with medicare, those folks would not be receiving a paycheck, and so this is actually very serious for working class americans across the country, and this idea that elon musk, the richest man in the world could care less about people and harming folks because he wants to take more of their hard-earned money, is shameful. it's dangerous. you should fight against it every single day here in congress. >> do you think speaker johnson comes out of all this retaining the speaker title? >> i mean, who knows?

another legal victory for the president-elect. how is trump world reacting? >> we're waiting to hear directly from the president-elect about this. of course, this is part of the appeal that after the trial judge back in may made the determination that fani willis would be able to stay on this case as long as the special prosecutor who she had a romantic relationship with, nathan wade, removed himself from the case, and resigned which he did. over the course of the months, we have been waiting for the appeals court decision, and here just in this last hour, the determination made by the georgia court of appeals that fani willis, as well as the entirety of the district attorney's office in fulton county, shall be removed from these proceedings. the indictment itself against donald trump and the other now 14 defendants who have not pleaded guilty at this point, has not been tossed out, and we should expect district attorney fani willis to appeal this decision to the georgia supreme

court where that supreme court could potentially undo the decision of the apeoples court and put her back here on this case. at the same time, this is a major victory because it only delays -- a major victory for the president-elect. it only delays the proceedings of this case even further, and hits at the heart of the arguments that donald trump's legal defense team was making, that there was more than an appearance -- more than a conflict of appearance of impropriety, and we should note the appeals court made the determination that the appearance of conflict of interest was so high that the position at the district attorney fani willis, should be removed from this case, but there was a dissenting judge on the appeals court who wrote that disagreed with the decision. so we could very well expect this to continue to play out, but for now, at least at a minimum, the proceedings will only be delayed further in fulton county. >> yep. that's right. and it may be eliminated altogether, this case out of

we're back following the breaking news out of pennsylvania right now. luigi mangione about to travel from here, altoona, blair county airport to new york city where he'll face charges in the murder of unitedhealthcare ceo brian thompson. these images just moments ago after he waived his extradition to new york earlier this morning in back-to-back court hearings in pennsylvania. back with us now our reporting team, priscilla thompson and rehema ellis. we're watching what's happening there in pennsylvania right now. i'm reminded of what we're hearing from our court reporters or those -- our producers who were inside the courtroom about mangione's demeanor, how he seemed animated, chatting with officers even. what more can you tell us? >> reporter: yeah, absolutely. he was sitting in the courtroom

just behind me a little bit earlier today, and he was very attentive according to our producers in the courtroom as he was having to sign papers and read through documents as they were talking through the charges he faces here and also the possibility of extradition. at one point, he was even smiling while he was sitting next to his attorney, thomas dickey. we know they appeared to be having some pretty animated conversations and we did ask dickey about those conversations when he came out and spoke to the press after all of this was over, and he did not -- as you might expect, divulge what exactly they were talking about or what led him to be so animated in those moments, but things wrapped up very quickly here as we sort of expected. each of the hearings that were held this morning were only about five minutes long. so five-minute preliminary hearing on the state charges and then a five-minute hearing for him to waive extradition, and then pretty quickly they were loading him into that suv, drove him to the airport, and as you see there, him in that orange

jump suit, making his way onto that plane, and he will now be off and on his way to new york city. we know that the nypd had a very heavy presence in the courtroom today. about a dozen nypd officers were in the courtroom compared to only about three pennsylvania officers, and we also heard from the district attorney's office here in pennsylvania saying that those charges in new york are going to supersede what's going on, the charges here in pennsylvania and they will wait for those to be dealt with before they go into any more details about what's going to happen with the state charges, but that they were ready and prepared to send him on to new york city. we also heard from mangione's attorney, thomas dickey, saying similarly that they were now prepared to fight these charges as they have said they're going to do in new york city, and so it was basically time for him to go, that they were prepared, they were ready for this, and so even as mangione boards that plane to make his way back to new york, there is still a number of his supporters outside

the courtroom here with signs saying that private health care is a crime, calling that terrorism. obviously alluding to this first-degree murder charge that has that in furtherance of a terroristic agenda on it, and so folks here dressed up as the luigi character from the video games, again, showing their support, their sympathy for him as he left court today and now is on his way to new york city. ana? >> and rehema, we are just getting new reporting about what might happen when he gets to new york. fill us in. >> reporter: yeah. he's going to be in a courthouse here at some point later today. i would suspect it will be either late this morning or early this afternoon. this is what we're just getting here, ana, and i'm going to read some of it. some federal criminal authorities are letting us know that federal criminal charges are expected to be filed against mangione in new york today, and

the criminal complaint expected, mangione is expected to be sent as we know from pennsylvania to new york. where the feds and nypd will bring him to federal court for an initial appearance in the state new york state court appearance on the state murder charges would be put off for another time/date. guidance on all of this is congress through. coming through. this is something that's just happening now that the feds are expected to charge him on federal charges. we have been speculating about that before, but this is now saying, several sources are confirming that it is expected he's going to be first facing arraignment only deral charges and then the charges in reference to the state charges and what the manhattan district attorney, alvin bragg would charge him with. that would come at a later time this is all very serious, the federal charges as we pointed out, those could carry a death penalty for this 26-year-old man. the state charges against him, two murder charges, one in the first degree. they, if he is convicted of

those, they could mean life in prison with any possibility of parole. we have been talking about this fact that his defense is expected that he will plead not guilty on all of this, and that they're going to mount a very vigorous defense for him, and for his innocence. off to my right, i guess it's screen left for you. we hear the sound of one person, one woman who is screaming, free luigi mangione. that's just one person. we saw more people in support of him outside the pennsylvania courthouse. just one here. it could grow, but it's very small right now. ana? >> thank you for bringing us the very latest. we're continuing to look at these images. luigi mangione just about wheels up from pennsylvania to come to new york to face these murder charges here in the big apple. catherine christian and terri austin are back with us. what's your reaction to what you

just heard from rehema's reporting from what's expected to come today and there might be federal proceedings before the state court proceedings? >> it's surprising, but it can happen. there can be parallel proceedings. it's a complaint, not an indictment. he will be arraigned two blocks from where he would be on the supreme court indictment in manhattan on those federal charges. the question is will he then be held in custody in a federal jail? which again, is literally two blocks away, and then the manhattan d.a.'s office will have to have him brought to state court two blocks away and he'll be arraigned on state indictment. the question is will he be held in ryker's island or in federal court on the federal charges? so it'll be interesting to see. it's not unusual to see for a defendant to have a federal case and a state case. usually the most serious case goes first, but you're talking about life without parole on the manhattan d.a.'s office case.

it'll be interesting to see what actual charge the -- i'm assuming the southern district of york is charged with. >> and his attorney, karen friedman had put out a statement responding to the possibility of federal charges coming, and let me just read part of it. she said in part, quote, the federal government's reported decision to pile on top a defendant already overcharged first-degree murder and state terror case is highly unusual and raises serious constitutional and statutory double jeopardy concerns. terri, are these potential federal charges putting the double jeopardy rule into play, and in question? >> i think it's a good possibility that they are. she's making a great argument. what happened apparently, and it is surprising. they agreed. they must have, you know, on the federal side and then on a state side, to say, look. let's go first in federal. this is the more serious charge. let him be arraigned in federal court before he is arraigned in state court because we have the

welcome back, and we have more breaking news this morning. what could be a massive holiday headache for all of us who shop on amazon. s beginning to strike at amazon facilities this morning, in what the on calls the largest strike ever. priya s rithar is there for us. what could we see because of the strike? >> reporter: it really depends on who you ask. there are about 10,000 amazon

workers workers and delivery drivers including this one in alpharetta, georgia about 30 miles north of atlanta. also facilities in california, illinois, and new york city. they're saying this is the largest strike against amazon in u.s. history. they're asking for better pay and working conditions, and they're saying that amazon hasn't been following the law, and hasn't come to the negotiating table to bargain with their workers who were organized through teamsters. i got a chance to speak to some of the amazon workers who are in this picket line behind me here. let's take a listen to what they had to say about what they're looking for. >> i'm out here as you can see. we're stoked. we're happy to be here. we're fighting for our rights. fighting for more pay, more benefits, more everything, you know? we're out here fighting for each one of us. each one of the drivers that you see driving past, we're fighting for each one of them. >> reporter: now the president of the teamsters union says if your holiday package is delayed this season, you can blame, quote, the insatiable greed of amazon. amazon for its part is saying

this is all a publicity stunt and that the teamsters are intentionally misleading the public. they also say that only about 1% of their work force is actually unionized and this is going to have a very minimal impact on their operations, but of course, labor experts are saying that the timing of this strike is of course, strategic. so i guess time will tell if this actually has an impact because of course, we're less than a week away from christmas, ana. >> so should people who may have orders who are outstanding who are planning to put orders in for those gifts be concerned about gifts arriving by christmas? >> reporter: that's certainly what the picketers here that i've talked to are hoping. they're hoping that, you know, the fact that they are striking right now might have a ripple effect, and that they unfortunately -- they don't want the burden to be on the consumer, but they feel as though the only way that amazon would take notice is if there was actually some sort of impact on the holiday season, ana. >> okay. thank you very much for being on
