president-elect trump likely inherit a chaotic situation in the middle east. we are getting a picture of what a donald trump cabinet will look like. >> in el paso. >> new hampshire. >> from msnbc world headquarters. good morning. 11:00 a.m. eastern. 8:00 a.m. pacific. we begin with breaking news. right now, luigi mangione is

being transported to new york city to face charges in the fatal shooting of unitedhealthcare ceo brian thompson. he waived extradition earlier today. he also appeared in another hearing related to his charges in pennsylvania. joining us now, nbc's priscilla thompson outside the courthouse in pennsylvania. here in new york city, mangione is set to appear later today. also with us, charles coren, a prosecutor. what came out of these two hearings this morning? >> reporter: yeah, jose. the top line is charlie a a waived extradition and shortly after that happened, he was loaded into an suv by the nypd now in their custody and taken to the airport where we saw him in an orange jumpsuit getting onto that plane and he is now over the skies making his way to new york city.

but, today, we saw him in court for about an hour and a half. each of those hearings lasting less than five minutes. the first of those hearings was related to the state charges in pennsylvania. forgery and i.d.s. they had a preliminary hearing about. signing papers in handcuffs. we know he was very attentive inside the card home. card home we did have a sketch artist and that is what you are seeing there. also a producer saying that he looks attentive at one point. even smiling as he was sitting next to his attorney, thomas dickey. they were also having some very animated conversations. and when dickey came out of the courthouse, we ask . dickey declined to comment on the. shortly after that, there was a five-minute hearing he announced he would be waiving extradition. he was headed over to the nypd.

and dickey did comment on the. saying, they did what was in the best interest in their client. it was in their best interest to waive extradition. he said that they now have a plan in place so they are ready to move forward and do that. we also heard from the district attorney here in clark county seeing that the cases here in pennsylvania do remain active but for now they are to wait to see how the court case plays out in new york. when the defendant is available, they will move forward with the trying of the charges here in pennsylvania. the attention turning to new york. a dozen nypd officers in new york today. along with three pennsylvania officers. even as mangione is no longer here, there are a couple of supporters is that remain outside. they slowly started to go, but it did have that atmosphere. a bit of that circus-like

atmosphere where you have people to stop the video game character, luigi. privatization is a crime and seeing that is terrorism. saw the things we have been saying online with people being really critical of the healthcare industry or health insurance industry and appearing to sympathize with mangione, manifesting outside the courthouse in pennsylvania. >> meanwhile, let's go to new york city where the suspect is being into as we speak. what is expected to happen in new york city? >> well, jose, as you point out, he left the pennsylvania area. in-flight, it is about a 90 minute flight, plus or minus some times. we got some news not so long ago that we expect that federal

authorities will take him to federal court first where he will be facing charges there. that will be his initial appearance and we are told that any state court appearance would happen here at the monastic district court, that will happen at a different time or a different a . the feds are going to have an appearance in federal court just around the corner from where i am standing right now. that federal charge, if he is found guilty of a federal charge of murder, that could carry a penalty., the 11th counseled them as new york state is concerned, two counts of murder in and he is found guilty in that. he could face life in prison without the possibility of parole. a 26-year-old man accused on december 4th of shooting to death the ceo brian thompson. and, now, he is coming back here after having been found last week in pennsylvania were they say he was carrying a

three-page hand written letter that was critical of corporate america and he had a close gun. ballistics matched the one that was used to kill brian thompson. so everyone is waiting here for exactly what is going to happen. we think it will be within an hour and a half. perhaps two hours before we see some activity. we don't know yet when we will see any activity in the state court here where i am standing now. jose? >> i want to bring lisa rubin. so, lisa, there's the federal courts. there is the state court. how is it going to be carried out today? >> reporter: well, jose, our understanding was that luigi mangione was extradited from pennsylvania. 100 center street. that is the criminal court where he would his arraignment on 11 charges at by the manhattan district attorney. as you were discussing, we now

understand that it is possible that the federal government acting to the department of justice and specifically the southern district of new york will bring charges first. the question is, how are those charges going to differ? in the ordinary course, those are state crimes. but there can be certain aggravating factors that allow the federal government to bring those charges instead. one of the things might differentiate if no charge for example from a state charge is the interstate movement of luigi mangione to target brian thompson, the united health ceo who he allegedly murdered. so if you are for example not only carried out a murder in a premeditated way but you are purposely trying to track somebody's movements from state to state and following them essentially in order to commit that crime, that is where you have the possible involvement of the federal government. there are also charges having to do with that are different in nature and time from the charges that can be brought in

state court. those are the two other charges i am looking for to see if they manifest. >> charles, of all the different counts, 11 in the state court, in new york, in the statement, including first- degree murder in furtherance of terrorism. what are the difficulties that prosecutors have in getting that count to stay? >> sure, jose. the notion of establishing intense. when you talk about this particular charge, the first- degree murder charge is a purely almost intent charge in terms of what it means. what the government is going to need to solidify the idea that mangione committed this better for the purposes of essentially stoking a larger fear, not just with brian thompson. and in this case, the argument is going to be he committed this crime for essentially scaring the healthcare industry

in to doing what it was that they are not doing now. that is the motive that prosecutors will have to make if they want to establish this first-degree murder with terrorism peace. that will be helped by the manifesto that they found in his bag but it will still be a high burden that the prosecution is going to have to add at trial. you are talking about the affected. the affected the effect on an entire industry, and that is very, very difficult to prove. >> we are now getting word indeed the justice department is expected to fail federal charges this afternoon against mangione. there is the issue of deth penalty. >> this is likely to manifest as a stocking murder. me know what is reported. traveled to new york specifically to target brian thompson and because he crossed

state lines, because we have the manifesto, there is also another notebook that is a planning document that investigators are looking at. all that will be pieced together to establish he travel to new york interstate for the purposes of killing brian thompson. that is what makes epidural. >> what is it that makes it death t versus contrast to the state charge? >> the death penalty has not been a part of new york law for many, many years but under federal law the death penalty is applicable. there have to be aggravating factors with respect to the case in respect for the death penalty to be on the table. the feds will have to make that determination. in a case like this, it is certainly something that can be applicable. jose, you have a case like this now. these really high-level charges. is this something to possibly leverage a plea deal? plead guilty.

life without parole in new york. maybe 25 years to life? have the opportunity to pearl a 26-year-old guy. >> with respect to the federal charges is life in prison if mr. mangione is convicted of murder. it does not have to rise to capital punishment. it is very, very probable that prosecutors will seek to have him get life and invoke the idea of a plea deal. life in prison. >> so, lisa, there is communication and agreement between state and federal in a case like this. >> reporter: not necessarily, jose. a lot of times, behind the scenes as to which office will bring charges first or which will bring charges at all. a lot of times, you see one office standing in lieu of the other and that is a

particularly complicated issue. one being the manhattan district attorney's office. the other being the u.s. attorney's office for the southern district of new york. greater severity of punishment due to those aggravating factors. sometimes a federal law punishes possession of gun paraphernalia used to accomplish crimes in different ways than states do. here, i am not sure that we see an agreement yet. impact, we are getting are gettg conflicting information. it is not clear to us where luigi mangione will be arraigned first. weather here or the court behind me or just around the corner at 500 pearl street. oui, nbc news, continue to work on getting affordable and reliable information, and as soon as we have the, jose, we will come to where that lance. >> in many ways privileged.

he has a team of lawyers in pennsylvania. he high-powered team in new york city. what do you see as a possible defense for the new york team with this specific amount of information and, you know, video cross-referencing. >> what the defense team is going to try to do is get some of had evidence protruded. so you know he is apprehended at a mcdonald's. right? he was asked to take his mask down. literal smoking gun. he has a ghost gun. he has a manifesto. he has a false i.d. he used in new york. there was no warrant to search the backpack in violation of his constitutional rights. the case changes dramatically. and there can be fruits of the poisonous tree. any other evidence collected as a result of what was found

could also be precluded. the defense team will make that argument. whether it is successful, we cannot tell because we do not that information. >> you are talking about multiple jurisdictions and agencies on first that had their hands on this case. then creates a potential. something to go awry with respect to custody. with respect to how he was remanded. so you are going to be looking at every "i" and every "t" to make sure it was dotted and crossed. >> we will of course continue to bring you updates on this developing story. the u.s. government appears to be barreling towards a shutdown after president-elect trump effectively killed a bill that was meant to stop a shutdown. so what was next?

go back to the drawing board. now we find ourselves in a state of limbo. well house republicans will control how this process begins, they don't necessarily have an end game. they cannot guarantee how it ends. that is because in part this is a deal that needs to be bipartisan. the margins are still very slim. democrats control the senate and it would require votes on any piece of legislation. this is what some of them said today. >> we had negotiated a bipartisan deal. republicans have walked away from it. >> we are done. >> the deal. the deal was made with total agreement of the republicans and kratz in both houses. it is a good deal for the american people. >> i don't know who is to win the shutdown but i know who loses, and it is american people. >> and an added wrinkle to what

was already a complicated situation. donald trump suggesting this negotiation should include eliminating the debt ceiling. that is something that house democrats that they are not comfortable with. the house minority leader hakeem jeffries going to blue sky, which i think is important. elon musk's platform x. heath hood heath hood he would be a hard pass for any elimination of the debt ceiling at this point because he is worried it could impact entitlement programs think social security. we will see how democrats plan to handle this situation, this has this ha that we found ourselves in and how cooperative they will be with house republicans. >> and, i mean, garrett, you spoke with president-elect trump. what did he tell you?

>> he is somewhat unconcerned about the prospect of a shutdown right now. suggesting it would be a shutdown on president biden's watch. not his. and he and his team have essentially two different sets of problem with this c.r., this government funding bill. he says a lot of things in there or not his priorities. and elon musk, his ally, sees a lot of unnecessary spending in there. more donald trump, something that was not even part of this conversation 36 hours or so ago. that was the debt ceiling which was probably going to be bumped up against sometime in the summer in the early part of his presidency when he has a lot of other things he wants going on. he does not want to be negotiating with democrats then. or he would like to see it abolished entirely. the united states is one of only two countries in the world that have a debt ceiling. donald trump told me the democrats want to get rid of it. he said he would lead the

charge. jose, i cannot hear how unusual this is to hear from a republican president or president-elect. he sees the debt ceiling a psychological. basically fake. he is correct and think has had no effect in controlling the u.s.'s debt but is used as a pinch point to abstract something. has orion just outlined, there are a number of hurdles redo that. not the least of which will be in his own party. >> yeah. senator elizabeth warren posted in, i agree with president- elect trump that congress should eliminate the that were in the never again governed by hostagetaking. specifically when something like a government shutdown is just hours away from becoming a reality. ryan, why was this not a clean c.r.

and rather a c.r. that is 140 pages? >> reporter: that was the question, jose. take his thought process was to clear the deck for donald trump. to clear any issues he has into his presidency that he would not have to deal with so he could instead deal with issues like his deportation plan, extending tax cuts, et cetera, et cetera. and the thought process was due packed in as much stuff had universal or most agreement from the majority of a public ai and democrats. republicans have put a lot of blame on democrats for the additions that were made to this package. but republicans have their own issues and things that he wanted to be part of this deal as well. this is part of the way congress work at the end of the year. you throw a bunch of stuff on

it to clear it at the end of the next congress. then the out of the farm bill. then they talk about reforming us benefits managers. giving control of rfk stadium in washington, d.c. back to the city of washington to potentially bring their nfl team right here. that became too much for conservator republicans that hate this kind of legislation. so the idea makes sense in principle, jose, but it clearly got he too out-of-control. >> thank you both so much. pennsylvania congressman, ranking member of the house budget committee. thank you for your time. so i know democrats just held a meeting about the funding bill and possible shutdown. what came out of that meeting? >> well, we have total unity on the demo cratic side.

the government will run out of money and will shut down must speaker johnson allows a vote on the house floor for the very bill that he negotiated and that republicans agreed to. all this problem started about 24 hours ago when elon musk went on his farm and repeatedly bashed the bipartisan agreement that democrats and republicans agreed to. it is time to stand up. they were the ones who were elected. not elon musk. it is time for them to stand up, be true to their word, and do the work of the american people. >> look, the president-elect has been very clear in these last for first for first that is his position as well. not elon musk, but is his position adding the whole debt ceiling issue. congressman, for us that are outside of capitol hill, how does something like a c.r.

get negotiated? who is in on the negotiations and why does it seem that for republicans, certainly, the trump-world republicans, this was almost like a surprise? >> yeah. so first typically large bills such as this are negotiated by what is called the four corners. house democrats, house republicans, senate republicans, senate democrats. nothing should have come as a surprise to donald trump or people close to him. one would presume that speaker mike johnson and his republican leader team were keeping the president-elect informed. the reality though is donald trump does not always make clear to them what exactly he wants. even yesterday, it was hours and hours of elon musk loan out there on twitter on his platform bashing this and an

untimely some hours later donald trump finally broke his silence and came out against it. that has been a problem i saw before the first time donald trump was president. even a bill his own treasury secretary has negotiated. >> so what do you think is going to happen midnight friday tomorrow? >> well, one of two things will happen. either republicans will be true to their word -- >> or their will -- >> or their will be a government shutdown. >> your thoughts on this whole debt ceiling issue. it is unusual to see president- elect trump and elizabeth warren agreeing on something.

what is your position and why is a position that should be talked about? >> well, this is an issue i have worked on for a decade. i am the author of a debt ceiling reform act. we need to permanently resolve this issue period the whole concept of the debt ceiling is actually an accident of history and quite dangerous. why are we talking about something that does not come due until next summer? we have a possible government shutdown. a probable government shutdown facing us in 36 hours. let's deal with keep the government funded first and then we will have time in 2025 to deal with debt ceiling. >> and it seems as though the republicans were not able to put this bill, 1540 page bill, to a vote because of all the things we have been talking about, if that is not a probability, what do you think?

>> reporter: look, as you heard from hakeem jeffries, the democratic leader, this is a problem they are putting squarely in republicans' corner. because we have been staked out outside of republicans, seeing leaders coming in and out, they keep saying that they are essentially in a holding pattern, and i think that is in part because the president-elect keeps adding demands, complicating johnson's already complicated situation. he could lose about three republican votes and still have this pass. at this point of course he is only relying on republican votes. forget about any of the governments he was going to have help bail him out. you also have the whole idea of attaching a debt limit increase are getting that debt limit altogether. so far, this is something that house democratic leadership is not touching. hard pass on that. you also talk to brendan boyle who authored at bill. he clearly wants to handle the

government funding bill now. and then talk about anything else in the future. this is a huge mess. just 36 hours until the government is supposed to shut down. many republicans, though siding with elon musk and trump, don't care to do. we also have breaking news from georgia this morning. the state appeals court disqualified district attorney fani willis from the fulton county election interference case against donald trump. president out elect trump's team released a statement that reads in part, "in granting president trump an overwhelming mandate, the american people have demanded an immediate end to the political weaponization of our justice system and a swift end." senior political reporter and nbc news legal analyst. so, grade, so, grade,

what exactly happened and where was this decided? >> georgia court of appeals. relationship with nathan wade, the formal -- former special prosecutor who handled the case. there has been a lot of litigation back and forth over the personal relationship, that romantic relationship between the two. now, the court of appeals is saying not only should fani willis be disqualified, but also her entire office because there are only a handful of offices that can take on this case. then she is likely to take it to the georgia supreme court but it is likely a very conservative bench and it is an uphill battle to reverse this rolling. >> this has broadened the entire team. >> entire team. the entire fulton county prosecutor's office has been disqualified from pursuing these charges. but the underlying case is

still intact. but the fulton county d.a. can -- in her office -- can no longer bring these charges. >> as i consider everything we are talking about with respect to fani willis's office being disqualified, to me the biggest take a and the biggest loss here is this has nothing to do with why we were actually here. and it doesn't have anything to do with the degree of guilt or innocence that donald trump and the other 18 defendants caught up in this rico case have that they were facing in the state of georgia to encrypt the results and sabotage the 2020 election. the saddest thing is we will never be able to litigate and adjudicate those wrongs that were alleged against those 19 people because this sideshow has now likely tanked this pace. >> this sideshow was likely created by some of the people

that were today being disqualified. >> here's the other thing that people need to understand. because i did read it this morning, the court of appeals acknowledges that usually the appearance of impropriety is not sufficient to warrant disqualification. so my question is, why is it that the court of appeals believe that in this case it was a great day worked in the entire office, not just fani willis, not just any of the prosecutors, but her entire office to be removed? i find that to be dubious and problematic. i understand when you're talking about the legal system and the justice system, the appearance of impropriety can be a significant factor. >> so, and six, and six if the entire team has been disqualified, who is left? >> that is an office at conceivably has the resources to take on this case.

then remember though, this is a republican led state. earlier, a special prosecutor from the prosecuting counsel decided against bringing charges against another potential defendant. a separate conflict of interest that arose in fani willis's prosecution of these banking co- defendants. banking co- defendants fani willis had cosponsored a political fundraiser for jones's political opponent. so we have already seen the counsel say they would not intervene in another smaller, much more narrow case. so it is seen as unlikely they would intervene should the georgia supreme court to overturn. >> charles, it looks like this is pretty much end of the road. >> we are not likely to see this prosecution go much

47 passed an hour. more breaking news this morning. workers at amazon facilities across the country are what teamsters are calling the largest ever strike against the country. the country. negotiations with those warehouse workers. joining us from outside a amazon facility in georgia, good morning. so how widespread are the strikes and what are workers asking for? >> reporter: hey. about 10,000 are represented and there are thousands of workers. we are hearing striking at eight different facilities across the country including this one 30 miles north of atlanta. also facilities in california, illinois, and new york city. they are saying this is a larger strike against amazon in new york history. they are asking for better work conditions and pay and they are
